			<subsection commented="no" display-inline="no-display-inline" id="H1D56F2FA581E49B397D1DDC3C63035A7"><enum>(a)</enum><header display-inline="yes-display-inline">Designation of wilderness</header><text display-inline="yes-display-inline">Section 1 of Public Law 100–326 (102 Stat.
			 584; 16 U.S.C. 1132 note), as amended by Public Law 106–471 (114 Stat. 2057),
			 is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HAEB5CF84480D401EA72C631F19FB039F"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by
			 striking <quote>System—</quote> and inserting <quote>System:</quote>;</text>

			 Virginia Wilderness Act of 1984 (Public Law 98–586; 98 Stat. 3108) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H3A2754FA380140C3958FEC06468CC476"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>certain</quote> at the
			 beginning of paragraphs (1) through (4) and inserting
			 <quote>Certain</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95AEA72842E14C0F92D84FCF97CB3B66"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the semicolon at the end of
			 paragraphs (1) and (2) and inserting a period;</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF22C20742E3C4625A27EA4FB33A942AE"><enum>(c)</enum><header display-inline="yes-display-inline">Maps and legal descriptions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H6E9B17A2D6FA42B38F83BEF93C3BB72"><enum>(1)</enum><header display-inline="yes-display-inline">Filing</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Secretary of Agriculture shall file with the
			 Committee on Agriculture, Nutrition, and Forestry of the Senate and the
			 Committee on Natural Resources and the Committee on Agriculture of the House of
			 Representatives a map and legal description of each wilderness area designated
			 or expanded by the amendments made by subsection (a) and of the Lynn Camp Creek
			 Wilderness Study Area designated by the amendment made by subsection
			 (b).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H15D8BEF60CB2431198713E2DEC30BA41"><enum>(2)</enum><header display-inline="yes-display-inline">Force and effect</header><text display-inline="yes-display-inline">The maps and legal descriptions referred to
			 in paragraph (1) shall have the same force and effect as if included in this
			 Act, except that the Secretary of Agriculture may correct clerical and
			 typographical errors in the maps and descriptions. In the case of any
			 discrepancy between the acreage specified in the amendments made by subsection
			 (a) or (b) and the corresponding map filed under paragraph (1), the map shall
			 control.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E6D6DBBA5E9479B9E9B72B925E255B6"><enum>(3)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The maps and legal descriptions referred to
			 in paragraph (1) shall be on file and available for public inspection in the
			 Office of the Chief of the Forest Service.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE426FBB26D7745F9A411D6FCD654DAC3"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H6B0AACCC372543BF8B8090FD7600C883"><enum>(1)</enum><header display-inline="yes-display-inline">New wilderness areas</header><text display-inline="yes-display-inline">Subject to valid existing rights, the
			 Secretary of Agriculture shall administer the lands in the Jefferson National
			 Forest designated as a new wilderness area by the amendments made by subsection
			 (a) in accordance with this section and the Wilderness Act (16 U.S.C. 1131 et
			 seq.), except that, with respect to such lands, any reference in the Wilderness
			 Act to the effective date of that Act shall be deemed to be a reference to the
			 date of the enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H06DDCD28AD88408A932521E3E94634C"><enum>(2)</enum><header display-inline="yes-display-inline">Expanded wilderness areas</header><text display-inline="yes-display-inline">Subject to valid existing rights, the
			 Secretary of Agriculture shall administer the lands in the Jefferson National
			 Forest designated as wilderness and incorporated into an existing wilderness
			 area by the amendments made by subsection (a) in accordance with this section,
			 the Wilderness Act (16 U.S.C. 1131 et seq.), and other laws applicable to that
			 wilderness area, except that, with respect to such lands, any reference in the
			 Wilderness Act to the effective date of that Act shall be deemed to be a
			 reference to the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="HE7DF034A1A9C453DB2282D24CF65CDB1" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Designation of Kimberling Creek Potential
			 Wilderness Area, Jefferson National Forest, Virginia</header>
			<subsection commented="no" display-inline="no-display-inline" id="HA02A0A12C1714BE7A69015E6F437598E"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">In furtherance of the purposes of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), certain lands in the Jefferson
			 National Forest, which comprise approximately 349 acres, as generally depicted
			 on the map entitled <quote>Kimberling Creek Additions and Potential Wilderness
			 Area</quote> and dated February 2007, are designated as a potential wilderness
			 area for eventual incorporation in the Kimberling Creek Wilderness designated
			 by section 2(2) of the Virginia Wilderness Act of 1984 (Public Law 98–586; 98
			 Stat. 3105).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HAAC7909D6F51475BAF002E31D6E8A3D8"><enum>(b)</enum><header display-inline="yes-display-inline">Map and legal descriptions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA1BE4FE3D2A04A8EAF8CDC3B9CC7DADB"><enum>(1)</enum><header display-inline="yes-display-inline">Filing</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Secretary of Agriculture shall file with the
			 Committee on Agriculture, Nutrition, and Forestry of the Senate and the
			 Committee on Natural Resources and the Committee on Agriculture of the House of
			 Representatives a map and legal description of potential wilderness
			 area.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H968C4439BB6A4E47A261B5A189085367"><enum>(2)</enum><header display-inline="yes-display-inline">Force and effect</header><text display-inline="yes-display-inline">The map and legal description referred to
			 in paragraph (1) shall have the same force and effect as if included in this
			 Act, except that the Secretary of Agriculture may correct clerical and
			 typographical errors in the map and description. In the case of any discrepancy
			 between the acreage specified in subsection (a) and the map filed under
			 paragraph (1), the map shall control.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5D16A99AEACE4C3B90E058E79F73287C"><enum>(3)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The map and legal description referred to
			 in paragraph (1) shall be on file and available for public inspection in the
			 Office of the Chief of the Forest Service.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFA84432B6B5B43DDB0FB445000F96FB9"><enum>(c)</enum><header display-inline="yes-display-inline">Management</header><text display-inline="yes-display-inline">Except as provided in subsection (d) and
			 subject to valid existing rights, the Secretary of Agriculture shall manage the
			 potential wilderness area as wilderness pending its incorporation in the
			 Kimberling Creek Wilderness.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5A59770A12DF48D9B97E949C9C29CFF2"><enum>(d)</enum><header display-inline="yes-display-inline">Ecological Restoration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HB52C27D4F47A48E4BCEF25603BACFF61"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of ecological restoration
			 (including the elimination of non-native species, removal of illegal, unused,
			 or decommissioned roads, and any other activities necessary to restore the
			 natural ecosystems in the potential wilderness area), the Secretary of
			 Agriculture may use motorized equipment and mechanized transport in the
			 potential wilderness area until its incorporation in the Kimberling Creek
			 Wilderness.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE8CFA2CF2E64261B7803DD69330134D"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">To the maximum extent practicable, the
			 Secretary shall use the minimum tool or administrative practice necessary to
			 accomplish ecological restoration with the least amount of adverse impact on
			 wilderness character and resources.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE3AF22F309274BF7005100FC569FBA4"><enum>(e)</enum><header display-inline="yes-display-inline">Wilderness Designation</header><text display-inline="yes-display-inline">The potential wilderness area shall be
			 designated as wilderness and incorporated in the Kimberling Creek Wilderness on
			 the earlier of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4B221937E49E4320BFF72AEB634212"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the Secretary of
			 Agriculture publishes in the Federal Register notice that the conditions in the
			 potential wilderness area that are incompatible with the Wilderness Act (16
			 U.S.C. 1131 et seq.) have been removed; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H946303F0480E470094F2F900ABD4578"><enum>(2)</enum><text display-inline="yes-display-inline">the date that is five years after the date
			 of the enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H76035396E5E84D72B9BA2BC471566BAF"><enum>(f)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Subject to valid existing rights, upon
			 incorporation of the lands designated as wilderness under subsection (e) in the
			 Kimberling Creek Wilderness, the Secretary of Agriculture shall administer the
			 lands in accordance with the Wilderness Act (16 U.S.C. 1131 et seq.) and other
			 laws applicable to that wilderness area, except that, with respect to such
			 lands, any reference in the Wilderness Act to the effective date of that Act
			 shall be deemed to be a reference to the date on which the lands are designated
			 as wilderness under subsection (e).</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="H43088D021FE34113B535EA39DAD807" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Designation of Seng Mountain and Bear Creek
			 Scenic Areas, Jefferson National Forest, Virginia</header>
			<subsection commented="no" display-inline="no-display-inline" id="H4017E16FC70D49F48ECB2DF224A00F4"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The following National Forest System lands
			 in the State of Virginia are hereby designated as National Scenic Areas (in
			 this section referred to as the <quote>scenic areas</quote>):</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA23F61D86EA74D2F87D9E8F318B1724B"><enum>(1)</enum><text display-inline="yes-display-inline">Certain lands in the Jefferson National
			 Forest, which comprise approximately 6,455 acres, as generally depicted on the
			 map entitled <quote>Seng Mountain and Raccoon Branch</quote> and dated February
			 2007, and which shall be known as the Seng Mountain National Scenic
			 Area.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB14C0CA29B64D68BCE9188FC9FC5122"><enum>(2)</enum><text display-inline="yes-display-inline">Certain lands in the Jefferson National
			 Forest, which comprise approximately 5,128 acres, as generally depicted on the
			 map entitled <quote>Bear Creek</quote> and dated February 2007, and which shall
			 be known as the Bear Creek National Scenic Area.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA49CAA8994E2420AB0E003F75476B8C"><enum>(b)</enum><header display-inline="yes-display-inline">Maps and legal descriptions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H20766C5F7DB34DA8ABA980F00537002C"><enum>(1)</enum><header display-inline="yes-display-inline">Filing</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Secretary of Agriculture shall file with the
			 Committee on Agriculture, Nutrition, and Forestry of the Senate and the
			 Committee on Natural Resources and the Committee on Agriculture of the House of
			 Representatives a map and legal description of each of the scenic areas.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC11110A6B2C14608B359C4747E7939DF"><enum>(2)</enum><header display-inline="yes-display-inline">Force and effect</header><text display-inline="yes-display-inline">The maps and legal descriptions referred to
			 in paragraph (1) shall have the same force and effect as if included in this
			 Act, except that the Secretary of Agriculture may correct clerical and
			 typographical errors in the maps and descriptions. In the case of any
			 discrepancy between the acreage specified in subsection (a) and the
			 corresponding map filed under paragraph (1), the map shall control.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H17FCA11D56A446B0876554B290BED1F9"><enum>(3)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The maps and legal descriptions referred to
			 in paragraph (1) shall be on file and available for public inspection in the
			 Office of the Chief of the Forest Service.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE75A751F54AF45FC8EB732437801BFCF"><enum>(c)</enum><header display-inline="yes-display-inline">Purposes of scenic areas</header><text display-inline="yes-display-inline">The scenic areas are established for the
			 purposes of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H765544431DFA494CBEE290C2D2C5D85"><enum>(1)</enum><text display-inline="yes-display-inline">ensuring the protection and preservation of
			 scenic quality, water quality, natural characteristics, and water
			 resources;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H001D430CA9874A68821E41AD05AE5134"><enum>(2)</enum><text display-inline="yes-display-inline">protecting wildlife and fish habitat,
			 consistent with paragraph (1);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA353BCA777804928BF353B2572F0AFF6"><enum>(3)</enum><text display-inline="yes-display-inline">protecting areas that may develop
			 characteristics of old-growth forests; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA19737DE198F4A128300002F74AA7937"><enum>(4)</enum><text display-inline="yes-display-inline">providing a variety of recreation
			 opportunities, consistent with the preceding paragraphs.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H42FCE808EB4A4EDB96C55F672FFB1D7E"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HB133A80C04664D178DF4F004543EB9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall
			 administer the scenic areas in accordance with this section and the laws and
			 regulations generally applicable to the National Forest System. In the event of
			 conflict between this section and other laws and regulations, this section
			 shall take precedence.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H212B66D0A50742AB887137DAC7DF3ED3"><enum>(2)</enum><header display-inline="yes-display-inline">Consistent
			 use</header><text display-inline="yes-display-inline">The Secretary shall only
			 allow such uses of the scenic areas as the Secretary finds will further the
			 purposes for which the scenic areas are established.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD3C70B539BF345D5A5574800A28613C8"><enum>(e)</enum><header display-inline="yes-display-inline">Management plan</header><text display-inline="yes-display-inline">Within two years after the date of the
			 enactment of this Act, the Secretary of Agriculture shall develop a management
			 plan for the scenic areas consistent with this section. The management plan
			 shall be developed as an amendment to the land and resource management plan for
			 the Jefferson National Forest, except that nothing in this section requires the
			 Secretary to revise the land and resource management plan for the Jefferson
			 National Forest pursuant to section 6 of the Forest and Rangeland Renewable
			 Resources Planning Act of 1974 (16 U.S.C. 1604).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HEC6DB621187D4B72B564DDCB1D73CFF6"><enum>(f)</enum><header display-inline="yes-display-inline">Roads</header><text display-inline="yes-display-inline">After the date of the enactment of this
			 Act, no roads shall be established or constructed within the scenic areas,
			 except that this prohibition shall not be construed to deny access to private
			 lands or interests therein in the scenic areas.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H97EA6EC7E4794AD000462DFA0000DC73"><enum>(g)</enum><header display-inline="yes-display-inline">Vegetation management</header><text display-inline="yes-display-inline">No timber harvest shall be allowed within
			 the scenic areas, except as the Secretary of Agriculture finds necessary in the
			 control of fire, insects, and diseases and to provide for public safety and
			 trail access. Notwithstanding the preceding sentence, the Secretary may engage
			 in vegetation manipulation practices for maintenance of existing wildlife
			 clearings and visual quality. Firewood may be harvested for personal use along
			 perimeter roads under such conditions as the Secretary may impose.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4146F708C6034B2189DD2D901C7F6FF1"><enum>(h)</enum><header display-inline="yes-display-inline">Motorized travel</header><text display-inline="yes-display-inline">Motorized travel shall not be permitted
			 within the scenic areas, except that the Secretary of Agriculture may authorize
			 motorized travel within the scenic areas—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4A4D258A582743E8A42699B7CA27300"><enum>(1)</enum><text display-inline="yes-display-inline">as necessary for administrative use in
			 furtherance of the purposes of this section;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7F2399A766024861BE46627D9E052F2E"><enum>(2)</enum><text display-inline="yes-display-inline">in support of wildlife management projects
			 in existence as of the date of the enactment of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8115C6E31CB248DFB70318007CBED500"><enum>(3)</enum><text display-inline="yes-display-inline">on Forest Development Road 9410 and 84b
			 during deer and bear hunting seasons.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H571101D2653F416E9707B4646D07A5DA"><enum>(i)</enum><header display-inline="yes-display-inline">Fire</header><text display-inline="yes-display-inline">Wildfires in the scenic area shall be
			 suppressed in a manner consistent with the purposes of this section, using such
			 means as the Secretary of Agriculture considers appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H86694123C15548FE80E15DC408F84951"><enum>(j)</enum><header display-inline="yes-display-inline">Insects and disease</header><text display-inline="yes-display-inline">Insect and disease outbreaks may be
			 controlled in the scenic areas to maintain scenic quality, prevent tree
			 mortality, reduce hazards to visitors, or protect private lands.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF8A1F6260AE94BF891E5C245D9502B00"><enum>(k)</enum><header display-inline="yes-display-inline">Water</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall
			 administer the scenic areas so as to maintain and enhance water quality.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB62AA435C84344B900D28F128CFE5461"><enum>(l)</enum><header display-inline="yes-display-inline">Mining withdrawal</header><text display-inline="yes-display-inline">Subject to valid existing rights, all
			 federally owned lands in the scenic areas are withdrawn from location, entry,
			 and patent under the mining laws of the United States and from leasing claims
			 under the mineral and geothermal leasing laws of the United States, including
			 amendments to such laws.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="H40B5B913986E4530BE44DD9BE90015C" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Trail plan and development</header>
			<subsection commented="no" display-inline="no-display-inline" id="H01F39EF9A060497A007BD755BB6DEA8D"><enum>(a)</enum><header display-inline="yes-display-inline">Trail plan</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall
			 establish a trail plan for National Forest System lands described in this
			 subsection in order to develop the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H40BB9C332826434088E2A84615007C2C"><enum>(1)</enum><text display-inline="yes-display-inline">Hiking and equestrian trails on the lands
			 in the Jefferson National Forest designated as wilderness by the amendments
			 made by section 2(a), in a manner consistent with the Wilderness Act (16 U.S.C.
			 1131 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58F79F8EF03C4A2DB2FB2E8D506D00B1"><enum>(2)</enum><text display-inline="yes-display-inline">Nonmotorized recreation trails within the
			 Seng Mountain and Bear Creek Scenic Areas designated by section 4.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC4EBFAE03F244263A932C3BAA1F88B7C"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall
			 establish the trail plan in consultation with interested parties.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA33BA399D6014AC49F004628896F5839"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation report</header><text display-inline="yes-display-inline">Not later than two years after the date of
			 the enactment of this Act, the Secretary of Agriculture shall submit to
			 Congress a report on the implementation of the trail plan, including the
			 identification of priority trails for development.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4E9DDB169CA04CDEAF784B4F8E5D96C4"><enum>(d)</enum><header display-inline="yes-display-inline">Trail
			 required</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall develop a sustainable trail, using a contour curvilinear
			 alignment, to provide a continuous connection for non-motorized travel between
			 County Route 650 and Forest Development Road 4018 in Smyth County,
			 Virginia.</text>

				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id0e57aa8c-6cba-4209-a3d9-ed3a0574c697" reported-display-style="italic" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Designation of Kimberling Creek Potential
			 Wilderness Area, Jefferson National Forest, Virginia</header>
			<subsection commented="no" display-inline="no-display-inline" id="ida5236c96-e8e4-42b0-a9d6-0dc9059aba0a"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">In furtherance of the purposes of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), certain land in the Jefferson National
			 Forest comprising approximately 349 acres, as generally depicted on the map
			 entitled <quote>Kimberling Creek Additions and Potential Wilderness
			 Area</quote> and dated April 28, 2008, is designated as a potential wilderness
			 area for incorporation in the Kimberling Creek Wilderness designated by section
			 2(2) of the Virginia Wilderness Act of 1984 (16 U.S.C. 1132 note; Public Law
			 98–586).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idf2dfc5a5-287a-4877-bc33-9efd2a1d56a1"><enum>(b)</enum><header display-inline="yes-display-inline">Management</header><text display-inline="yes-display-inline">Except as provided in subsection (c) and
			 subject to valid existing rights, the Secretary shall manage the potential
			 wilderness area in accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id20a6d941-5f02-459e-b8ac-91b46038bdfb"><enum>(c)</enum><header display-inline="yes-display-inline">Ecological Restoration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id7c5fbc64-3c04-4b1d-9246-74ff46a5792f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of ecological restoration
			 (including the elimination of nonnative species, removal of illegal, unused, or
			 decommissioned roads, and any other activity necessary to restore the natural
			 ecosystems in the potential wilderness area), the Secretary may use motorized
			 equipment and mechanized transport in the potential wilderness area until the
			 date on which the potential wilderness area is incorporated into the Kimberling
			 Creek Wilderness.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c106077-1b4b-4889-ab64-8b39e087519a"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">To the maximum extent practicable, the
			 Secretary shall use the minimum tool or administrative practice necessary to
			 accomplish ecological restoration with the least amount of adverse impact on
			 wilderness character and resources.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida0640c81-c957-4fa9-aaaf-92e2c2a2f995"><enum>(d)</enum><header display-inline="yes-display-inline">Wilderness Designation</header><text display-inline="yes-display-inline">The potential wilderness area shall be
			 designated as wilderness and incorporated in the Kimberling Creek Wilderness on
			 the earlier of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id01034ac4-f9c4-4b8c-8ba3-b34365273381"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the Secretary publishes
			 in the Federal Register notice that the conditions in the potential wilderness
			 area that are incompatible with the Wilderness Act (16 U.S.C. 1131 et seq.)
			 have been removed; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47a389af-4889-4b7d-9f61-7fce4376af3e"><enum>(2)</enum><text display-inline="yes-display-inline">the date that is 5 years after the date of
			 enactment of this Act.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="H383150B361254F1A9ECF82C8540414D8" reported-display-style="italic"><enum>5.</enum><header>Seng Mountain and Bear
			 Creek Scenic Areas, Jefferson National Forest, Virginia</header>
			<subsection id="HCF9489BA2A164E15ADB940CAEAAA469"><enum>(a)</enum><header>Establishment</header><text>There
			 are designated as National Scenic Areas—</text>
				<paragraph id="HE05282269BBE49B78541049D94B5ADBD"><enum>(1)</enum><text>certain National Forest
			 System land in the Jefferson National Forest, comprising approximately 5,192
			 acres, as generally depicted on the map entitled <quote>Seng Mountain and
			 Raccoon Branch</quote> and dated April 28, 2008, which shall be known as the
			 <quote>Seng Mountain National Scenic Area</quote>; and</text>
				</paragraph><paragraph id="H42C2E142B09B413196A653B419D5843F"><enum>(2)</enum><text>certain National Forest
			 System land in the Jefferson National Forest, comprising approximately 5,128
			 acres, as generally depicted on the map entitled <quote>Bear Creek</quote> and
			 dated April 28, 2008, which shall be known as the <quote>Bear Creek National
			 Scenic Area</quote>.</text>
				</paragraph></subsection><subsection id="H6BDC18CCA72E4DB8A52D9E3CA3BABBF8"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the scenic areas are—</text>
				<paragraph id="ID45e236c0210646c887d69e357bd824fe"><enum>(1)</enum><text>to ensure the protection
			 and preservation of scenic quality, water quality, natural characteristics, and
			 water resources of the scenic areas;</text>
				</paragraph><paragraph id="IDdc33cf15c6bd42c5936c98f5c1d3e3c6"><enum>(2)</enum><text>consistent with paragraph
			 (1), to protect wildlife and fish habitat in the scenic areas;</text>
				</paragraph><paragraph id="IDb3ddb78382e041968eeae1ce56221c31"><enum>(3)</enum><text>to protect areas in the
			 scenic areas that may develop characteristics of old-growth forests; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE5167A3AFC734858BA8388D2B3706B3D"><enum>(4)</enum><text>consistent with
			 paragraphs (1), (2), and (3), to provide a variety of recreation opportunities
			 in the scenic areas.</text>
				</paragraph></subsection><subsection id="H79396CFF710E47F18ED00C3F4E43756"><enum>(c)</enum><header>Administration</header>
				<paragraph id="idDFE5ED6C6A04421F8B1BA20F9F674736"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall administer the scenic areas in
			 accordance with—</text>
					<subparagraph id="id4369C6A4F07841D58546AD4E5A4B2DE3"><enum>(A)</enum><text>this Act; and</text>
					</subparagraph><subparagraph id="id5BEAFAC8FB114E3295F7FED68D338CC9"><enum>(B)</enum><text>the laws (including
			 regulations) generally applicable to the National Forest System.</text>
					</subparagraph></paragraph><paragraph id="H3E5FA047107148C4A05B5E8F2100C24C"><enum>(2)</enum><header>Authorized
			 uses</header><text>The Secretary shall only allow uses of the scenic areas that
			 the Secretary determines will further the purposes of the scenic areas, as
			 described in subsection (b).</text>
				</paragraph></subsection><subsection id="H861E85FB06094A4FA97CA883F1F3E2A9"><enum>(d)</enum><header>Management
			 plan</header>
				<paragraph id="idF02E99A503394F8393C64CEFEF508164"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary shall develop as an amendment to the land and resource
			 management plan for the Jefferson National Forest a management plan for the
			 scenic areas.</text>
				</paragraph><paragraph id="idDEA8E94BB302471DAA9037C730AB5405"><enum>(2)</enum><header>Effect</header><text>Nothing
			 in this subsection requires the Secretary to revise the land and resource
			 management plan for the Jefferson National Forest under section 6 of the Forest
			 and Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1604).</text>
				</paragraph></subsection><subsection id="ID6b99271a523842ae935e4762212f76dd"><enum>(e)</enum><header>Roads</header>
				<paragraph id="ID29c99a7e9ed34f908f8e9bb204043cd1"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), after the date of
			 enactment of this Act, no roads shall be established or constructed within the
			 scenic areas.</text>
				</paragraph><paragraph id="IDaead9cf285a4488c94760259c14d8413"><enum>(2)</enum><header>Limitation</header><text>Nothing
			 in this subsection denies any owner of private land (or an interest in private
			 land) that is located in a scenic area the right to access the private
			 land.</text>
				</paragraph></subsection><subsection id="ID6db1128e34a04862bd3aadb93ae28d4f"><enum>(f)</enum><header>Timber harvest</header>
				<paragraph id="id9C72544DF11B46DC94D26230F7699CF8"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraphs (2) and (3), no
			 harvesting of timber shall be allowed within the scenic areas.</text>
				</paragraph><paragraph id="id5942C853F82C419BBEA91C75FBE506D2"><enum>(2)</enum><header>Exceptions</header><text>The
			 Secretary may authorize harvesting of timber in the scenic areas if the
			 Secretary determines that the harvesting is necessary to—</text>
					<subparagraph id="id3AE5C3CBEDEB44EFA7330D18853B3733"><enum>(A)</enum><text>control fire;</text>
					</subparagraph><subparagraph id="id7A60CF09588F41B0B71A4C038EA99285"><enum>(B)</enum><text>provide for public safety
			 or trail access; or</text>
					</subparagraph><subparagraph id="idA7830F89CA0D41A6AC154CB37CCE56CC"><enum>(C)</enum><text>control insect and
			 disease outbreaks.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9E7457E36A7E4F37AE769FBD0B704391"><enum>(3)</enum><header>Firewood for personal
			 use</header><text>Firewood may be harvested for personal use along perimeter
			 roads in the scenic areas, subject to any conditions that the Secretary may
			 impose.</text>
				</paragraph></subsection><subsection id="idEB5C9226D0044BEBA9517C6CC6723B7A"><enum>(g)</enum><header>Insect and disease
			 outbreaks</header><text>The Secretary may control insect and disease
			 outbreaks—</text>
				<paragraph id="ID35a21052e15c48b58a23e4b2e45f3a8f"><enum>(1)</enum><text>to maintain scenic
			 quality;</text>
				</paragraph><paragraph id="IDf8b94197502242c680d1404ddf100f0b"><enum>(2)</enum><text>to prevent tree
			 mortality;</text>
				</paragraph><paragraph id="ID94db22c5275c4d36b778e05dabde994d"><enum>(3)</enum><text>to reduce hazards to
			 visitors; or</text>
				</paragraph><paragraph id="ID46f06e5fd58d45c7b8d9de7dd3769a9d"><enum>(4)</enum><text>to protect private
			 land.</text>
				</paragraph></subsection><subsection id="IDed58c2b6290f4a82a75909dd67b4ec1e"><enum>(h)</enum><header>Vegetation
			 management</header><text>The Secretary may engage in vegetation manipulation
			 practices in the scenic areas to maintain the visual quality and wildlife
			 clearings in existence on the date of enactment of this Act.</text>
			</subsection><subsection id="ID38eac5c6532d4392b3c04aac9b409bdd"><enum>(i)</enum><header>Motorized
			 vehicles</header>
				<paragraph id="idC8E288CAE9DA40568D5357B0406CD7A0"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), motorized vehicles
			 shall not be allowed within the scenic areas.</text>
				</paragraph><paragraph id="id857198A73A8B4D0493B88EB58F7B14BC"><enum>(2)</enum><header>Exceptions</header><text>The
			 Secretary may authorize the use of motorized vehicles—</text>
					<subparagraph id="ID12dd2f718b094d8f9c6e298bf72c611d"><enum>(A)</enum><text>to carry out
			 administrative activities that further the purposes of the scenic areas, as
			 described in subsection (b);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf131dea4b3d94ce8970cd38d0ae37e7d"><enum>(B)</enum><text>to assist wildlife
			 management projects in existence on the date of enactment of this Act;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20585652E6834F9D845665482B52040A"><enum>(C)</enum><text>during deer and bear
			 hunting seasons—</text>
						<clause commented="no" display-inline="no-display-inline" id="idCB4737B637C24DAD825D27C9E6C97170"><enum>(i)</enum><text>on Forest Development
			 Roads 49410 and 84b; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF1DEA60862D7488EAFF2AFD13774C460"><enum>(ii)</enum><text>on the portion of Forest
			 Development Road 6261 designated on the map described in subsection (a)(2) as
			 <quote>open seasonally</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H613B00911AEC4CCAA9A6BECA82CDF0B5"><enum>(j)</enum><header>Wildfire
			 suppression</header><text>Wildfire suppression within the scenic areas shall be
			 conducted—</text>
				<paragraph id="id0FCA6C2A87AA4050A683C6F9BC224BD4"><enum>(1)</enum><text>in a manner consistent
			 with the purposes of the scenic areas, as described in subsection (b);
			 and</text>
				</paragraph><paragraph id="id85EA8298A1D34869AE421A4F3EBD20B7"><enum>(2)</enum><text>using such means as the
			 Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa81b07545604414daa4619a3a8f37bfa"><enum>(k)</enum><header>Water</header><text>The
			 Secretary shall administer the scenic areas in a manner that maintains and
			 enhances water quality.</text>
			</subsection><subsection id="ID8467261388c642ca91433deefeb0ff97"><enum>(l)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, all Federal land in the scenic areas is withdrawn
			 from—</text>
				<paragraph id="idA05FC6DCE27942BAAD675D90E1551AFA"><enum>(1)</enum><text>location, entry, and
			 patent under the mining laws; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA522C8EFDACD48EC8BEA3FD8D79F4E4D"><enum>(2)</enum><text>operation of the mineral
			 leasing and geothermal leasing laws.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="H87CD2A662C1941D5A8B9E1C1A1100DB" reported-display-style="italic"><enum>6.</enum><header>Trail plan and
			 development</header>
			<subsection id="H5A53EB7D2A3A46ECB265F174AA81B7A4"><enum>(a)</enum><header>Trail
			 plan</header><text>The Secretary, in consultation with interested parties,
			 shall establish a trail plan to develop—</text>
				<paragraph id="H15BA045D38494AE5BBA5398BBDEB5670"><enum>(1)</enum><text>in a manner consistent
			 with the Wilderness Act (16 U.S.C. 1131 et seq.), hiking and equestrian trails
			 in the wilderness areas designated by paragraphs (9) through (20) of section 1
			 of Public Law 100–326 (16 U.S.C. 1132 note) (as added by section 3(a)(5));
			 and</text>
				</paragraph><paragraph id="H3D9C742D0E93497DB047CC324A22C64"><enum>(2)</enum><text>nonmotorized recreation
			 trails in the scenic areas.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEF5ED2D85CBE42898ECEBBADFB46D013"><enum>(b)</enum><header>Implementation
			 report</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Secretary shall submit to Congress a report that describes the
			 implementation of the trail plan, including the identification of priority
			 trails for development.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAD98867DCCF5442FA1FFF374934DF4C6"><enum>(c)</enum><header display-inline="yes-display-inline">Sustainable trail required</header><text display-inline="yes-display-inline">The Secretary shall develop a sustainable
			 trail, using a contour curvilinear alignment, to provide for nonmotorized
			 travel along the southern boundary of the Raccoon Branch Wilderness established
			 by section 1(11) of Public Law 100–326 (16 U.S.C. 1132 note) (as added by
			 section 3(a)(5)) connecting to Forest Development Road 49352 in Smyth County,
			 Virginia.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="HED5504C3423C4BFC8703B6D1B89E28B" reported-display-style="italic"><enum>7.</enum><header>Maps and boundary
			 descriptions</header>
			<subsection id="id82CA826F79CC446BA5102525C9CCDC42"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file with the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources and the
			 Committee on Agriculture of the House of Representatives maps and boundary
			 descriptions of—</text>
				<paragraph id="idB3DC10892AB7447CB6B92660ADC24624"><enum>(1)</enum><text>the scenic areas;</text>
				</paragraph><paragraph id="id1C2264A79C164F9E8C836CFF560CBFBB"><enum>(2)</enum><text>the wilderness areas
			 designated by paragraphs (9) through (20) of section 1 of Public Law 100–326
			 (16 U.S.C. 1132 note) (as added by section 3(a)(5));</text>
				</paragraph><paragraph id="id1737838D363748919013F4E2521E48DB"><enum>(3)</enum><text>the wilderness study area
			 designated by section 6(a)(5) of the Virginia Wilderness Act of 1984 (16 U.S.C.
			 1132 note; Public Law 98–586) (as added by section 3(b)(4)); and</text>
				</paragraph><paragraph id="id0B20165D95FF42A5A19A8A413304773A"><enum>(4)</enum><text>the potential wilderness
			 area designated by section 4(a).</text>
				</paragraph></subsection><subsection id="idCA8A01B8844D4F07B12FFFA5E9BAE5F5"><enum>(b)</enum><header>Force and
			 effect</header><text>The maps and boundary descriptions filed under subsection
			 (a) shall have the same force and effect as if included in this Act, except
			 that the Secretary may correct any minor errors in the maps and boundary
			 descriptions.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id816978A14ADE41E5B013D1584E070F81"><enum>(c)</enum><header>Availability of map and
			 boundary description</header><text>The maps and boundary descriptions filed
			 under subsection (a) shall be on file and available for public inspection in
			 the Office of the Chief of the Forest Service.</text>
			</subsection><subsection id="ID71d4db96e56840d88be845cadadac310"><enum>(d)</enum><header>Conflict</header><text>In
			 the case of a conflict between a map filed under subsection (a) and the acreage
			 of the applicable areas specified in this Act, the map shall control.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="id3CC9A94C992E4A78A63ABA1BD3C0E78C" reported-display-style="italic"><enum>8.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Any reference in the
			 Wilderness Act (16 U.S.C. 1131 et seq.) to the effective date of that Act shall
			 be considered to be a reference to the date of enactment of this Act for
			 purposes of administering—</text>
			<paragraph id="ID5432de20097b41fe9aa53840a996efaf"><enum>(1)</enum><text>the wilderness areas
			 designated by paragraphs (9) through (20) of section 1 of Public Law 100–326
			 (16 U.S.C. 1132 note) (as added by section 3(a)(5)); and</text>
			</paragraph><paragraph id="ID48fb70cd58064d7fae51f42e6fcfba52"><enum>(2)</enum><text>the potential wilderness
			 area designated by section 4(a).</text>
