		<official-title display="yes">To modernize and expand the reporting
		  requirements relating to child pornography, to expand cooperation in combating
		  child pornography, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Securing Adolescents From
			 Exploitation-Online Act of 2007</short-title></quote> or the
			 <quote><short-title>SAFE Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id09D8F4799562438289D447A8E56CE78F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reporting requirements of electronic
			 communication service providers and remote computing service providers</header>
			<subsection commented="no" display-inline="no-display-inline" id="idE9660382E10A43949398B8DFEF865F7E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 110 of title 18, United States
			 Code, is amended by inserting after section 2258 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB258AB988035476A8F75AF2ECAC433D8" style="USC">
					<section commented="no" display-inline="no-display-inline" id="ID119616832bf04b29b1669d5a858a8059" section-type="subsequent-section"><enum>2258A.</enum><header display-inline="yes-display-inline">Reporting requirements of electronic
				communication service providers and remote computing service providers</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID6e6509ad26294699a40c0bfed3a078a8"><enum>(a)</enum><header display-inline="yes-display-inline">Duty To report</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id22BBF314F6A7470DA84C26A5E797B9CC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Whoever, while engaged in providing an
				electronic communication service or a remote computing service to the public
				through a facility or means of interstate or foreign commerce, obtains actual
				knowledge of any facts or circumstances described in paragraph (2) shall, as
				soon as reasonably possible, make a report of such facts or circumstances to
				the CyberTipline of the National Center for Missing and Exploited Children, or
				any successor to the CyberTipline operated by such center.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7E356B0327D04DF7BBF3A72613CBEF78"><enum>(2)</enum><header display-inline="yes-display-inline">Facts or circumstances</header><text display-inline="yes-display-inline">The facts or circumstances described in
				this paragraph are any facts or circumstances that appear to indicate a
				violation of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idBB7E0E8CC35B4F86A7076A7E30C47905"><enum>(A)</enum><text display-inline="yes-display-inline">section 2251, 2251A, 2252, 2252A, 2252B, or
				2260 that involves child pornography or;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8840A5FB41F42BCA5276BCA470C98D9"><enum>(B)</enum><text display-inline="yes-display-inline">section 1466A.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6CE6AF6121AD4D9BB1550360C45E6CD1"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of report</header><text display-inline="yes-display-inline">To the extent available to an electronic
				communication service provider or a remote computing service provider, each
				report under subsection (a)(1) shall include the following information:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8df00bda4026435fb6a654a1c708af99"><enum>(1)</enum><header display-inline="yes-display-inline">Information about the involved
				individual</header><text display-inline="yes-display-inline">Information
				relating to the Internet identity of any individual who appears to have
				violated a Federal law in the manner described in subsection (a)(2), including
				the electronic mail address, website address, uniform resource locator, or any
				other identifying information.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2F16BD490D94EFB9D7AD8CBAA647430"><enum>(2)</enum><header display-inline="yes-display-inline">Historical reference</header><text display-inline="yes-display-inline">Information relating to when any apparent
				child pornography was uploaded, transmitted, reported to, or discovered by the
				electronic communication service provider or remote computing service provider,
				as the case may be, including a date and time stamp and time zone.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa9d74a0c6cce4d278863b386717c2869"><enum>(3)</enum><header display-inline="yes-display-inline">Geographic location
				information</header><text display-inline="yes-display-inline">Information
				relating to the geographic location of the involved individual, hosting
				website, or uniform resource locator, including the street address, telephone
				number, area code, zip code, or any Internet Protocol address.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd2e5342a3a6140de96e2d74b636303d6"><enum>(4)</enum><header display-inline="yes-display-inline">Images of apparent child
				pornography</header><text display-inline="yes-display-inline">Any image of any
				apparent child pornography relating to the incident such report is
				regarding.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73f06658379e4d17a85faf451c754f69"><enum>(5)</enum><header display-inline="yes-display-inline">Company contact information</header><text display-inline="yes-display-inline">Accurate contact information for the
				electronic communication service provider or remote computing service provider
				making the report, including the address, telephone number, facsimile number,
				electronic mail address of, and individual point of contact for, such
				electronic communication service provider or remote computing service
				provider.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID88d17124cbdf41d9806499fa100bf940"><enum>(c)</enum><header display-inline="yes-display-inline">Forwarding of report to law
				enforcement</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idB78C6AACAF7540F191D5C5AE6408B3DE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children shall forward each report made under subsection (a)(1) to
				any appropriate law enforcement agency designated by the Attorney General under
				subsection (d)(2).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0191a6e6d62e4b8abd61e4cbd8bd07f4"><enum>(2)</enum><header display-inline="yes-display-inline">State and local law
				enforcement</header><text display-inline="yes-display-inline">The National
				Center for Missing and Exploited Children may forward any report made under
				subsection (a)(1) to an appropriate official of a State or political
				subdivision of a State for the purpose of enforcing State criminal law.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6a2b09330aa14fe0b48aed336c5e2178"><enum>(3)</enum><header display-inline="yes-display-inline">Foreign law enforcement</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children may forward any report made under subsection (a)(1) to any
				appropriate foreign law enforcement agency designated by the Attorney General
				under subsection (d)(3), subject to the conditions established by the Attorney
				General under subsection (d)(3).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID73d3412d211b45be801e59c0ee1b9bab"><enum>(d)</enum><header display-inline="yes-display-inline">Attorney general responsibilities</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idC23F2A3A7EE4459095C8C0ED6D7A810A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General shall enforce this
				section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB8BA682D22B7485E974E01B3812D5610"><enum>(2)</enum><header display-inline="yes-display-inline">Designation of Federal
				agencies</header><text display-inline="yes-display-inline">The Attorney General
				shall designate promptly the Federal law enforcement agency or agencies to
				which a report shall be forwarded under subsection (c)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce33abf69bb0463889d0123e3ae1b9c5"><enum>(3)</enum><header display-inline="yes-display-inline">Designation of foreign
				agencies</header><text display-inline="yes-display-inline">The Attorney General
				shall promptly—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idBC9A6A906A1947D6ABC7AE2ABBCDA5D2"><enum>(A)</enum><text display-inline="yes-display-inline">designate the foreign law enforcement
				agencies to which a report may be forwarded under subsection (c)(3); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CDDB24F613E4B8E811BD67B0D45DE9B"><enum>(B)</enum><text display-inline="yes-display-inline">establish the conditions under which such a
				report may be forwarded to such agencies.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfafb970f42c649d3911a04af02dd493f"><enum>(e)</enum><header display-inline="yes-display-inline">Failure To report</header><text display-inline="yes-display-inline">An electronic communication service
				provider or remote computing service provider that knowingly and willfully
				fails to make a report required under subsection (a)(1) shall be fined—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4cd49d1a200a48d5a502cd03c0265e53"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of an initial knowing and
				willful failure to make a report, not more than $150,000; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3423c247a1b8430d88058720c33ea1e6"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of any second or subsequent
				knowing and willful failure to make a report, not more than $300,000.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5d33aad1bc8b4e1c94dbdb861d194650"><enum>(f)</enum><header display-inline="yes-display-inline">Protection of privacy</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to require an electronic communication service provider or a remote computing
				service provider to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id53C4EE519EF04BA593ACBB252550F07F"><enum>(1)</enum><text display-inline="yes-display-inline">monitor any user, subscriber, or customer
				of that provider;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC2C0891403DF44328B08BA27428D3C00"><enum>(2)</enum><text display-inline="yes-display-inline">monitor the content of any communication of
				any person described in paragraph (1); or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC2EDF66D8261440B8B66AB30C2D875DC"><enum>(3)</enum><text display-inline="yes-display-inline">affirmatively seek facts or circumstances
				described in subsection (a)(2).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID14c08621900146a9a93367a9a00ca08e"><enum>(g)</enum><header display-inline="yes-display-inline">Conditions of disclosure of information
				contained within report</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDa633a93e25ee4b65bb0b18601b0ceb95"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a law
				enforcement agency that receives a report under subsection (c) shall not
				disclose any information contained in that report.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC4D5545CD8504A6A85B6D9BB480ED8EC"><enum>(2)</enum><header display-inline="yes-display-inline">Permitted disclosures</header><text display-inline="yes-display-inline">A law enforcement agency may disclose
				information in a report received under subsection (c)—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7851b37e670943c28e3374d4e2495e7d"><enum>(A)</enum><text display-inline="yes-display-inline">to an attorney for the government for use
				in the performance of the official duties of that attorney;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID956d0ba5a9fb45e8b9b14ba74c5cd4df"><enum>(B)</enum><text display-inline="yes-display-inline">to such officers and employees of that law
				enforcement agency, as may be necessary in the performance of their
				investigative and recordkeeping functions;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID957c541cf40042e282cddc79191c03ae"><enum>(C)</enum><text display-inline="yes-display-inline">to such other government personnel
				(including personnel of a State or subdivision of a State) as are determined to
				be necessary by an attorney for the government to assist the attorney in the
				performance of the official duties of the attorney in enforcing Federal
				criminal law;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5c21a47f8927455582abaf915e76bee3"><enum>(D)</enum><text display-inline="yes-display-inline">if the report discloses a violation of
				State criminal law, to an appropriate official of a State or subdivision of a
				State for the purpose of enforcing such State law; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id123B1D401359447DB5BC6032F5BAB935"><enum>(E)</enum><text display-inline="yes-display-inline">to a defendant in a criminal case or the
				attorney for that defendant, to the extent the information relates to a
				criminal charge pending against that defendant.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2DFF7A4B998D4064851F3D3FF1EB97C7"><enum>(h)</enum><header display-inline="yes-display-inline">Evidence preservation</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idB4C328BA22B0430398D05AE3C8D45EF3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An electronic communication service
				provider or a remote computing service provider shall store any image and other
				information relating to the facts or circumstances of any incident reported
				under subsection (a)(1) for not less than 180 days after the date that the
				report is transmitted to the National Center for Missing and Exploited Children
				through the CyberTipline, or for such longer period of time as may be requested
				by a law enforcement agency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2cc341837760410fa7b2eb912ef3d3a3"><enum>(2)</enum><header display-inline="yes-display-inline">Destruction of evidence</header><text display-inline="yes-display-inline">An electronic communication service
				provider or a remote computing service provider shall not destroy any data
				that, to the knowledge of that electronic communication service provider or
				remote computing service provider, relates to an incident reported under
				subsection (a)(1) during the 180-day period beginning on the date that report
				is transmitted to the National Center for Missing and Exploited Children
				through the CyberTipline, or for such longer period of time as may be requested
				by a law enforcement agency.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID92ac1594a9f642bfb676c69abb19ea82" section-type="subsequent-section"><enum>2258B.</enum><header display-inline="yes-display-inline">Limited liability for electronic
				communication service providers and remote computing service providers</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDfd894488b1d7410899c6c06ded8c26ec"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsections (b) and
				(c), a civil claim or criminal charge against an electronic communication
				service provider or a remote computing service provider, including any
				director, officer, employee, or agent of such electronic communication service
				provider or remote computing service provider, arising from the performance of
				the reporting responsibilities of such electronic communication service
				provider or remote computing service provider under this section, section
				2258A, or section 2258C may not be brought in any Federal or State
				court.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID363ee70a9a0c43dc8dbcaabdaf6d4ce1"><enum>(b)</enum><header display-inline="yes-display-inline">Intentional, reckless, or other
				misconduct</header><text display-inline="yes-display-inline">Subsection (a)
				shall not apply to a claim if the electronic communication service provider or
				remote computing service provider, or a director, officer, employee, or agent
				of that electronic communication service provider or remote computing service
				provider—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id7F5FD57EC6424CEEB088C1F9C20601CA"><enum>(1)</enum><text display-inline="yes-display-inline">engaged in intentional misconduct;
				or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id366DE274BC334CE384D615301B15BE8E"><enum>(2)</enum><text display-inline="yes-display-inline">acted, or failed to act—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8B2473F0FF5D4D7AA141E27DC1B792F8"><enum>(A)</enum><text display-inline="yes-display-inline">with actual malice;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5834593C824C42A2BA9A9F00BA6FEF04"><enum>(B)</enum><text display-inline="yes-display-inline">with reckless disregard to a substantial
				risk of causing injury without legal justification; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD4FCFEA9ED844342A240B2FC296F2866"><enum>(C)</enum><text display-inline="yes-display-inline">for a purpose unrelated to the performance
				of any responsibility or function under this section, section 2258A, or section
				2258C.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDca68d44f15af4a54be1a1c5041f6ecc2"><enum>(c)</enum><header display-inline="yes-display-inline">Ordinary business activities</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an act or
				omission relating to an ordinary business activity of an electronic
				communication service provider or a remote computing service provider,
				including general administration or operations, the use of motor vehicles, or
				personnel management.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id404C25C6002B4FBC880E91443808E710"><enum>(d)</enum><header display-inline="yes-display-inline">Minimizing access</header><text display-inline="yes-display-inline">An electronic communication service
				provider and a remote computing service provider shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idDE4E735BDD784FF7848D603FA1B16B65"><enum>(1)</enum><text display-inline="yes-display-inline">minimize the number of employees that are
				provided access to any image provided under section 2258A or 2258C; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3F4AA4E3AF34C958216C34C7029CFE9"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that any such image is permanently
				destroyed, upon notification from a law enforcement agency.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID04e75ef639a741bf971daa32ee134cdb" section-type="subsequent-section"><enum>2258C.</enum><header display-inline="yes-display-inline">Use of images from the CyberTipline to
				combat child pornography</header>
						<subsection commented="no" display-inline="no-display-inline" id="id51F72F2DDE4A48689BFF7D69E72E1CB7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children is authorized to provide elements relating to any image
				reported to its CyberTipline to an electronic communication service provider or
				a remote computing service provider for the sole and exclusive purpose of
				permitting that electronic communication service provider or remote computing
				service provider to stop the further transmission of images. Such elements may
				include unique identifiers associated with a specific image, Internet location
				of images, and other technological elements that can be used to identify and
				stop the transmission of child pornography.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id95752A67BFAD4E30A0C45714DB2B6EC7"><enum>(b)</enum><header display-inline="yes-display-inline">Use by electronic communication service
				providers and remote computing service providers</header><text display-inline="yes-display-inline">Any electronic communication service
				provider or remote computing service provider that receives elements relating
				to an image from the National Center for Missing and Exploited Children under
				this section may use such information only for the purposes described in this
				section, provided that such use shall not relieve that electronic communication
				service provider or remote computing service provider from its reporting
				obligations under section 2258A.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1b7bdefe8bc944a0bf9b033029c88a16" section-type="subsequent-section"><enum>2258D.</enum><header display-inline="yes-display-inline">Limited liability for the National Center
				for Missing and Exploited Children</header>
						<subsection commented="no" display-inline="no-display-inline" id="id707C91B691154AB482D7D62336964D75"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsections (b) and
				(c), a civil claim or criminal charge against the National Center for Missing
				and Exploited Children, including any director, officer, employee, or agent of
				such center, arising from the performance of the CyberTipline responsibilities
				or functions of such center, as described in this section, section 2258A or
				2258C of this title, or section 404 of the Missing Children's Assistance Act
				(42 U.S.C. 5773), or from the effort of such center to identify child victims
				may not be brought in any Federal or State court.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID79c263e9b1bc48208b454a7d3c465f0b"><enum>(b)</enum><header display-inline="yes-display-inline">Intentional, reckless, or other
				misconduct</header><text display-inline="yes-display-inline">Subsection (a)
				shall not apply to a claim or charge if the National Center for Missing and
				Exploited Children, or a director, officer, employee, or agent of such
				center—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idB51FC3B61363472FA9178A9D3E7ADCBC"><enum>(1)</enum><text display-inline="yes-display-inline">engaged in intentional misconduct;
				or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id562004E1AC6B413994FFA77C9655B55B"><enum>(2)</enum><text display-inline="yes-display-inline">acted, or failed to act—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idB9DB9215A77E43E1BA3E4591B5E5FE0C"><enum>(A)</enum><text display-inline="yes-display-inline">with actual malice;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAB9D3EB67BEF4BA9B96C66FE3E87C9C7"><enum>(B)</enum><text display-inline="yes-display-inline">with reckless disregard to a substantial
				risk of causing injury without legal justification; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66945372809F47B7BD4D61296FF7BCAA"><enum>(C)</enum><text display-inline="yes-display-inline">for a purpose unrelated to the performance
				of any responsibility or function under this section, section 2258A or 2258C of
				this title, or section 404 of the Missing Children's Assistance Act (42 U.S.C.
				5773).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID375f4bab90144d54838f648575c63dc0"><enum>(c)</enum><header display-inline="yes-display-inline">Ordinary business activities</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an act or
				omission relating to an ordinary business activity, including general
				administration or operations, the use of motor vehicles, or personnel
				management.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id0701E529E6874554BE2A7C0C7D2B03E5"><enum>(d)</enum><header display-inline="yes-display-inline">Minimizing access</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idD64A60D858AF446C9159CF168B36E3BD"><enum>(1)</enum><text display-inline="yes-display-inline">minimize the number of employees that are
				provided access to any image provided under section 2258A; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id230F009836DE4813B6198BCC4DA3EF6C"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that any such image is permanently
				destroyed upon notification from a law enforcement agency.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID16519d63f43b4815b4f1a5b535b6460e" section-type="subsequent-section"><enum>2258E.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In sections 2258A through 2258D—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDbb2a575afbd941b0a03ec05596920f97"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>attorney for the
				government</term> and <term>State</term> have the meanings given those terms in
				rule 1 of the Federal Rules of Criminal Procedure;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0a9828025753496f8b658f03bbe05f96"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>electronic communication
				service</term> has the meaning given that term in section 2510;</text>

				address</term> has the meaning given that term in section 3 of the CAN-SPAM Act

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id855193031B674E0F84B3B27324A5F0E1"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Internet</term> has the
				meaning given that term in section 1101 of the Internet Tax Freedom Act (47
				U.S.C. 151 note);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47c37016bd7d42d2a1f39b7a83fa2f4e"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>remote computing
				service</term> has the meaning given that term in section 2711; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA622FAE09E144AD5AC8111529992B83C"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>website</term> means any
				collection of material placed in a computer server-based file archive so that
				it is publicly accessible, over the Internet, using hypertext transfer protocol
				or any successor
				protocol.</text>

			 authorized to be appropriated to the Attorney General $25,000,000 for grants to

				offenses relating to recordkeeping), or chapter 117 (excluding offenses
				relating to transmitting information about a minor or filing a factual
				statement about an alien individual); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id5F50ADE850A94EF7850923C96E73C0FD"><enum>(II)</enum><text display-inline="yes-display-inline">that involves a
				minor.</text>

			 Code, is amended by adding at the end the following:</text>

				factor</header>
						<subsection commented="no" display-inline="no-display-inline" id="id05DBAFD4CD124FF2AA53A726CFE2868E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person
				to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id40F4E732BE52458F80440DED8D7BFA87"><enum>(1)</enum><text display-inline="yes-display-inline">commit a violation of section 1466A, 1470,
				2251, 2251A, 2252, 2252A, 2252B, or 2260 that does not require, as an element
				of such violation, the use of the Internet; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59B622BEFF864DC8A76A9B2246F006AC"><enum>(2)</enum><text display-inline="yes-display-inline">use the Internet to commit the violation
				described in paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0910863881014AEBAE5D3EF6A121061F"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a)
				shall be sentenced to a term of imprisonment of 10 years in addition to the
				imprisonment imposed for the underlying
				offense.</text>

			 inaccurate data regarding registered domain names, including any contact
			 information.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id91F91D20C84248BFAFB5A7AFF7A449B9" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Report regarding prosecutions</header>
			<subsection commented="no" display-inline="no-display-inline" id="idE9EA1C4AD30A493BB3C493B297E76841"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General of the United States
			 shall submit to Congress and make publicly available on the website of the
			 Department of Justice an annual report regarding—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7BD3213758DA4506A1E580BFC733B53A"><enum>(1)</enum><text display-inline="yes-display-inline">the number of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID1b0bf296943840e9826eab524fd45e63"><enum>(A)</enum><text display-inline="yes-display-inline">investigations by local, State, or Federal
			 law enforcement agencies of crimes of sexual exploitation against
			 children;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe6c951d2a4fc4366a4dfc5f4ca1d8328"><enum>(B)</enum><text display-inline="yes-display-inline">prosecutions resulting from investigations
			 by local, State, or Federal law enforcement agencies of crimes of sexual
			 exploitation against children;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2a394350f5764cdaa6c5f419e3cebc89"><enum>(C)</enum><text display-inline="yes-display-inline">convictions resulting from prosecutions by
			 local, State, or Federal authorities of crimes of sexual exploitation against
			 children;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1b2ccc08417f45d596438138d0b05446"><enum>(D)</enum><text display-inline="yes-display-inline">convictions of repeat offenders; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5033e58e7a7456b95384b7622f764bc"><enum>(2)</enum><text display-inline="yes-display-inline">descriptions of sentences given to persons
			 convicted as a result of investigations described in paragraph (1)(A).</text>
