		<section commented="no" display-inline="no-display-inline" id="H49F31EA915504C41829B6D840081D97" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>SouthEast Crescent Authority Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H86F2DC09BA8A40F19C80E3DBC05567DA" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HAA6F8BA8F33E431CA5FF8B81A1878512"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">The term <term>Authority</term> means the
			 SouthEast Crescent Authority established by section 3.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H954E99B87B5448919ED707972064B191"><enum>(2)</enum><header display-inline="yes-display-inline">Federal grant program</header><text display-inline="yes-display-inline">The term <term>Federal grant program</term>
			 means a Federal grant program to provide assistance in carrying out economic
			 and community development activities.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90EA7A51E944431A81D972EF1B3BF700"><enum>(3)</enum><header display-inline="yes-display-inline">Non-profit entity</header><text display-inline="yes-display-inline">The term <term>non-profit entity</term>
			 means any entity with tax-exempt or non-profit status, as defined by the
			 Internal Revenue Service, that has been formed for the purpose of economic
			 development or has a proven record of economic development experience.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H364BC84D4A6B4C858632E5D086972E31"><enum>(4)</enum><header display-inline="yes-display-inline">Region</header><text display-inline="yes-display-inline">The term <term>region</term> means the area
			 covered by the Authority (as described in section 16).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H7669AE63C7664AF2AC00549F47E6F26C" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">SouthEast Crescent Authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="H51F4B7659E3A4A7FA1C6A58FB0989D1F"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H3B23448EA6D64CD591218EBA637911C6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established the SouthEast Crescent
			 Authority.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6215F98F47DE4EE1BD038350802C7839"><enum>(2)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Authority shall be composed of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF3082F3BD1044A62ABDDC395E97E702"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal member, to be appointed by the
			 President, with the advice and consent of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBD3D69EF1E5A49FE8B06D0178D937411"><enum>(B)</enum><text display-inline="yes-display-inline">the Governor of each State in the region
			 that elects to participate in the Authority.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H549A0B7EC120401BB79076B74CA0075"><enum>(3)</enum><header display-inline="yes-display-inline">Cochairpersons</header><text display-inline="yes-display-inline">The Authority shall be headed by—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HCB0C639689E34C8AB21662D1DADFF8BB"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal member, who shall serve—</text>
						<clause commented="no" display-inline="no-display-inline" id="HB7DA16A031FF428B818E23D63D9116C"><enum>(i)</enum><text display-inline="yes-display-inline">as the Federal cochairperson; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H044893580A624FC9BA5F81AEDECAE696"><enum>(ii)</enum><text display-inline="yes-display-inline">as a liaison between the Federal Government
			 and the Authority; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED464D3650074C4785F230FBA42EBD75"><enum>(B)</enum><text display-inline="yes-display-inline">a State cochairperson, who—</text>
						<clause commented="no" display-inline="no-display-inline" id="HF76EC74B981547AF95F2F4F73F6C30EE"><enum>(i)</enum><text display-inline="yes-display-inline">shall be a Governor of a participating
			 State in the region; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HAC161A94BAF74A218F226D4D463F8F77"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be elected by the State members for a
			 term of not less than 1 year.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9C8001C1DE904A0A9BF384BCEDE908EC"><enum>(b)</enum><header display-inline="yes-display-inline">Alternate members</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H19A59C216FEA4B34AB19D946DD00002E"><enum>(1)</enum><header display-inline="yes-display-inline">State alternates</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H65410F952D7E44BFA983F3D1DF9BA2B6"><enum>(A)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The State member of a participating State
			 may have a single alternate, who shall be appointed by the Governor of the
			 State from among the Governor’s cabinet or personal staff.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC90534080D63466E997229F58353D7D8"><enum>(B)</enum><header display-inline="yes-display-inline">Voting</header><text display-inline="yes-display-inline">An alternate shall vote in the event of the
			 absence, death, disability, removal, or resignation of the member for whom the
			 individual is an alternate.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H716021B646BA48C48950C8A53300264F"><enum>(2)</enum><header display-inline="yes-display-inline">Alternate Federal
			 cochairperson</header><text display-inline="yes-display-inline">The President
			 shall appoint an alternate Federal cochairperson.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B4779840EF24A44B946D06400446215"><enum>(3)</enum><header display-inline="yes-display-inline">Quorum</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3AE8353D8ED242558EC81514D9670400"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the requirements of this
			 paragraph, the Authority shall determine what constitutes a quorum of the
			 Authority.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H574544867A9C4982B83FFA03776C89E8"><enum>(B)</enum><header display-inline="yes-display-inline">Federal cochairperson</header><text display-inline="yes-display-inline">The Federal cochairperson or the Federal
			 cochairperson’s designee must be present for the establishment of a quorum of
			 the Authority.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H08A760DAF9614FEA817D05AD16DE99EA"><enum>(C)</enum><header display-inline="yes-display-inline">State alternates</header><text display-inline="yes-display-inline">A State alternate shall not be counted
			 toward the establishment of a quorum of the Authority.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55F0E0D7D63A4B7800886B780085A2CA"><enum>(4)</enum><header display-inline="yes-display-inline">Delegation of power</header><text display-inline="yes-display-inline">No power or responsibility of the Authority
			 specified in paragraphs (3) and (4) of subsection (c), and no voting right of
			 any Authority member, shall be delegated to any person—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD76E39E1938949F889F4FE49D48DF7B8"><enum>(A)</enum><text display-inline="yes-display-inline">who is not a Authority member; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE4C7B39F80FC46DC8266B6A3C0E78F42"><enum>(B)</enum><text display-inline="yes-display-inline">who is not entitled to vote in Authority
			 meetings.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H642264100FFE4CDEAB65B484EFBD2B41"><enum>(c)</enum><header display-inline="yes-display-inline">Decisions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HCCC6E3E968D9485BA4D2ABECC7670071"><enum>(1)</enum><header display-inline="yes-display-inline">Requirements for approval</header><text display-inline="yes-display-inline">Except as provided in subsection (g),
			 decisions by the Authority shall require the affirmative vote of the Federal
			 cochairperson and of a majority of the State members, exclusive of members
			 representing States delinquent under subsection (g)(2)(C).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCCF3C81F779B4709A24600ED60006085"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In matters coming before the Authority, the
			 Federal cochairperson, to the extent practicable, shall consult with the
			 Federal departments and agencies having an interest in the subject
			 matter.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28277FA0A12E4564860220276814269F"><enum>(3)</enum><header display-inline="yes-display-inline">Decisions requiring quorum of State
			 members</header><text display-inline="yes-display-inline">The following
			 decisions may not be made without a quorum of State members:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H30C06168B2CC4D51903006F47E96E3DA"><enum>(A)</enum><text display-inline="yes-display-inline">A decision involving Authority
			 policy.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0DFEE39EE314E328E9E26582230A836"><enum>(B)</enum><text display-inline="yes-display-inline">Approval of State, regional, or subregional
			 development plans or strategy statements.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9861097759BC4747A7666483B550D700"><enum>(C)</enum><text display-inline="yes-display-inline">Modification or revision of the Authority’s
			 code.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3DBBEACDB5A240EBBA9FB6C6BCD0B6D6"><enum>(D)</enum><text display-inline="yes-display-inline">Allocation of amounts among the
			 States.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H61FFECE5BA29409FA741108BBBB37232"><enum>(E)</enum><text display-inline="yes-display-inline">Designation of a distressed county.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H79606B71606446F397EB64E13F52A857"><enum>(4)</enum><header display-inline="yes-display-inline">Project and grant proposals</header><text display-inline="yes-display-inline">The approval of project and grant proposals
			 is a responsibility of the Authority and shall be carried out in accordance
			 with section 10.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDBE468A5AE3342A0B5718650EE8F4665"><enum>(d)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Authority shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEA08C1B18915420200B153914153AA99"><enum>(1)</enum><text display-inline="yes-display-inline">develop, on a continuing basis,
			 comprehensive and coordinated plans and programs to establish priorities and
			 approve grants for the economic development of the region, giving due
			 consideration to other Federal, State, and local planning and development
			 activities in the region;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF36234990EC7425089737DC4346BD71"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 365 days after the date of
			 enactment of this Act, establish priorities in a development plan for the
			 region (including 5-year regional outcome targets);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5048B6252CBB49F9972F5FBD72267588"><enum>(3)</enum><text display-inline="yes-display-inline">assess the needs and capital assets of the
			 region based on available research, demonstration projects, assessments, and
			 evaluations of the region prepared by Federal, State, or local agencies, local
			 development districts, and any other relevant source;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF57DF60CC4394D929080B0668972C2DB"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4A9D128D9E1348F1ABE3D78F2DC0B1C4"><enum>(A)</enum><text display-inline="yes-display-inline">enhance the capacity of, and provide
			 support for, local development districts in the region; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H32B29A6A13224D41976BF93DAA58A00" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if no local development district exists in
			 an area in a participating State in the region, foster the creation of a local
			 development district; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H31421576FB4E4B3C90E068B8198D2276"><enum>(5)</enum><text display-inline="yes-display-inline">encourage private investment in industrial,
			 commercial, and other economic development projects in the region.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCE7E1195C476446E8C88A800CF065900"><enum>(e)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">In carrying out subsection (d), the
			 Authority may—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE91EE3021F624BCD8B3FC870B2D7CB9F"><enum>(1)</enum><text display-inline="yes-display-inline">hold such hearings, sit and act at such
			 times and places, take such testimony, receive such evidence, and print or
			 otherwise reproduce and distribute a description of the proceedings and reports
			 on actions by the Authority as the Authority considers appropriate;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H283D93A464B64F5CBDD8C8FC7844F7DB"><enum>(2)</enum><text display-inline="yes-display-inline">authorize, through the Federal or State
			 cochairperson or any other member of the Authority designated by the Authority,
			 the administration of oaths if the Authority determines that testimony should
			 be taken or evidence received under oath;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAEE3415232EF4782991327A521DD6721"><enum>(3)</enum><text display-inline="yes-display-inline">request from any Federal, State, or local
			 department or agency such information as may be available to or procurable by
			 the department or agency that may be of use to the Authority in carrying out
			 duties of the Authority;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H976F63918EA14681BD40483821F3C349"><enum>(4)</enum><text display-inline="yes-display-inline">adopt, amend, and repeal bylaws and rules
			 governing the conduct of Authority business and the performance of Authority
			 duties;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4630D6B044F84D3C875E8138D1180E8"><enum>(5)</enum><text display-inline="yes-display-inline">request the head of any Federal department
			 or agency to detail to the Authority such personnel as the Authority requires
			 to carry out duties of the Authority, each such detail to be without loss of
			 seniority, pay, or other employee status;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9123DBC365D474980F6632C8B19E670"><enum>(6)</enum><text display-inline="yes-display-inline">request the head of any State department or
			 agency or local government to detail to the Authority such personnel as the
			 Authority requires to carry out duties of the Authority, each such detail to be
			 without loss of seniority, pay, or other employee status;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4095BBCA854B424D8B4DDBD5CAA286FB"><enum>(7)</enum><text display-inline="yes-display-inline">provide for coverage of Authority employees
			 in a suitable retirement and employee benefit system by—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC9B5047642F24E08BAAE8C57B5B86DCF"><enum>(A)</enum><text display-inline="yes-display-inline">making arrangements or entering into
			 contracts with any participating State government; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H657FDB5564FC4F86A4A6ABC16DBA43BB"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise providing retirement and other
			 employee benefit coverage;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H245B3BB60EBF40468EAED6266A84204"><enum>(8)</enum><text display-inline="yes-display-inline">accept, use, and dispose of gifts or
			 donations of services or real, personal, tangible, or intangible
			 property;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF8DFD2C3B107487C9F3E4610AFD6CAEE"><enum>(9)</enum><text display-inline="yes-display-inline">enter into and perform such contracts or
			 other transactions as are necessary to carry out Authority duties;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49EBC38C51E640F6BB47329EBF4ECCEF"><enum>(10)</enum><text display-inline="yes-display-inline">establish and maintain a central office
			 located within the Southeast Crescent Authority region and field offices at
			 such locations as the Authority may select; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A9D90ACD28B4EDDB6A6AA9CC606D3EB"><enum>(11)</enum><text display-inline="yes-display-inline">provide for an appropriate level of
			 representation in Washington, D.C.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD4917E490CFC409F8EB7C71E276E4707"><enum>(f)</enum><header display-inline="yes-display-inline">Federal agency cooperation</header><text display-inline="yes-display-inline">A Federal agency shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H579E2BE47406491ABCDC14CC15A58FA6"><enum>(1)</enum><text display-inline="yes-display-inline">cooperate with the Authority; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H224D4C5DF3BF4A658DF60608201658AD"><enum>(2)</enum><text display-inline="yes-display-inline">provide, on request of the Federal
			 cochairperson, appropriate assistance in carrying out this Act, in accordance
			 with applicable Federal laws (including regulations).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H111ACA87CB9041A0A4286FC3A2AE35AA"><enum>(g)</enum><header display-inline="yes-display-inline">Administrative expenses</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HEFC793C655E24375B32221CE51316E00"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Administrative expenses of the Authority
			 (except for the expenses of the Federal cochairperson, including expenses of
			 the alternate and staff of the Federal cochairperson, which shall be paid
			 solely by the Federal Government) shall be paid—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2008B1F44CD84B97957C7FD6C888816C"><enum>(A)</enum><text display-inline="yes-display-inline">by the Federal Government, in an amount
			 equal to 50 percent of the administrative expenses; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA028D888066D4BCFB9033DAB83DCBDA5"><enum>(B)</enum><text display-inline="yes-display-inline">by the States in the region participating
			 in the Authority, in an amount equal to 50 percent of the administrative
			 expenses.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C43A70D884C41A7B41CCDA701E8B7E7"><enum>(2)</enum><header display-inline="yes-display-inline">State share</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3CD896E304984FD8AD54131C1DCCFDB7"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The share of administrative expenses of the
			 Authority to be paid by each State shall be determined by the Authority.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6725AC1741C84CD9BF63EF2B65AAD26E"><enum>(B)</enum><header display-inline="yes-display-inline">No Federal participation</header><text display-inline="yes-display-inline">The Federal cochairperson shall not
			 participate or vote in any decision under subparagraph (A).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H994F05B61CD946DFB3EAA840916E2718"><enum>(C)</enum><header display-inline="yes-display-inline">Delinquent States</header><text display-inline="yes-display-inline">If a State is delinquent in payment of the
			 State’s share of administrative expenses of the Authority under this
			 subsection—</text>
						<clause commented="no" display-inline="no-display-inline" id="HF9E467EF42D94258950026877FF2AA64"><enum>(i)</enum><text display-inline="yes-display-inline">no assistance under this Act shall be
			 furnished to the State (including assistance to a political subdivision or a
			 resident of the State); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H62B26DE50D1F4534B04F8C77F5011614"><enum>(ii)</enum><text display-inline="yes-display-inline">no member of the Authority from the State
			 shall participate or vote in any action by the Authority.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D2EE1AE761E4027AB787E2B521F91B5"><enum>(h)</enum><header display-inline="yes-display-inline">Compensation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HABCD4801DF154696BAC091D7B9CF71D2"><enum>(1)</enum><header display-inline="yes-display-inline">Federal cochairperson</header><text display-inline="yes-display-inline">The Federal cochairperson shall be
			 compensated by the Federal Government at level III of the Executive Schedule in
			 subchapter II of chapter 53 of title V, United States Code.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5BDD248CE45F45769B2E0987328F0016"><enum>(2)</enum><header display-inline="yes-display-inline">Alternate Federal
			 cochairperson</header><text display-inline="yes-display-inline">The alternate
			 Federal cochairperson—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H46ABD2E127AD474D853B4EE3B8B38031"><enum>(A)</enum><text display-inline="yes-display-inline">shall be compensated by the Federal
			 Government at level V of the Executive Schedule described in paragraph (1);
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB0203208C2E40F1969C7253375C7300"><enum>(B)</enum><text display-inline="yes-display-inline">when not actively serving as an alternate
			 for the Federal cochairperson, shall perform such functions and duties as are
			 delegated by the Federal cochairperson.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB42FB26BF1444A0598ADD75170AA207F"><enum>(3)</enum><header display-inline="yes-display-inline">State members and alternates</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HE6BA270CE3A24DD4A04DCB8CEB541C6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State shall compensate each member and
			 alternate representing the State on the Authority at the rate established by
			 law of the State.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0526DE5CFC44DD5B3C4E241FCA5F3B2"><enum>(B)</enum><header display-inline="yes-display-inline">No additional compensation</header><text display-inline="yes-display-inline">No State member or alternate member shall
			 receive any salary, or any contribution to or supplementation of salary from
			 any source other than the State for services provided by the member or
			 alternate to the Authority.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6911C52E6AB4463CA6B7E34787CBF800"><enum>(4)</enum><header display-inline="yes-display-inline">Detailed employees</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H17283BBBBA04405DA101C978901429DF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No person detailed to serve the Authority
			 under subsection (e)(6) shall receive any salary or any contribution to or
			 supplementation of salary for services provided to the Authority from—</text>
						<clause commented="no" display-inline="no-display-inline" id="H6C9476E09A0A42C1B0335533352115EA"><enum>(i)</enum><text display-inline="yes-display-inline">any source other than the State, local, or
			 intergovernmental department or agency from which the person was detailed;
			 or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H0936C21EE97A435CBB4D33BB9B70F676"><enum>(ii)</enum><text display-inline="yes-display-inline">the Authority.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H45F9A62B59014180AE08C11039827163"><enum>(B)</enum><header display-inline="yes-display-inline">Violation</header><text display-inline="yes-display-inline">Any person that violates this paragraph
			 shall be fined not more than $5,000, imprisoned not more than 1 year, or
			 both.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA9C24C1DCB9C4E66BC1969C2CA855080"><enum>(C)</enum><header display-inline="yes-display-inline">Applicable
			 law</header><text display-inline="yes-display-inline">The Federal
			 cochairperson, the alternate Federal cochairperson, and any Federal officer or
			 employee detailed to duty on the Authority under subsection (e)(5) shall not be
			 subject to subparagraph (A), but shall remain subject to sections 202 through
			 209 of title 18, United States Code.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83BC3B18DC06406EBF0200164E12F067"><enum>(5)</enum><header display-inline="yes-display-inline">Additional personnel</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H75EDBB12CB05406DA9195EB1BBD9F691"><enum>(A)</enum><header display-inline="yes-display-inline">Compensation</header>
						<clause commented="no" display-inline="no-display-inline" id="H0AD6DAFE91BB4AA6824E65AF54FF39BD"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Authority may appoint and fix the
			 compensation of an executive director and such other personnel as are necessary
			 to enable the Authority to carry out the duties of the Authority.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H710912F454C14F0EA516E60885CE7CCA"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Compensation under clause (i) shall not
			 exceed the maximum rate for the Senior Executive Service under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5382">section
			 5382</external-xref> of title 5, United States Code, including any applicable
			 locality-based comparability payment that may be authorized under section
			 5304(h)(2)(C) of that title.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDEEB6CBA44DE40A3B15C537F45411F3F"><enum>(B)</enum><header display-inline="yes-display-inline">Executive director</header><text display-inline="yes-display-inline">The executive director shall be responsible
			 for—</text>
						<clause commented="no" display-inline="no-display-inline" id="H0C3BFFF203EA4A5E924E475192FD0826"><enum>(i)</enum><text display-inline="yes-display-inline">the carrying out of the administrative
			 duties of the Authority;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H1E0FF00930764B8CA2AE79FF50A42865"><enum>(ii)</enum><text display-inline="yes-display-inline">direction of the Authority staff;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HAC54A4999BEE4074B2A586FCBBB5A034"><enum>(iii)</enum><text display-inline="yes-display-inline">such other duties as the Authority may
			 assign.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96D1D2BBE9264A78B04D448F6E56A6E5"><enum>(C)</enum><header display-inline="yes-display-inline">No Federal employee status</header><text display-inline="yes-display-inline">No member, alternate, officer, or employee
			 of the Authority (except the Federal cochairperson of the Authority, the
			 alternate and staff for the Federal cochairperson, and any Federal employee
			 detailed to the Authority under subsection (e)(5)) shall be considered to be a
			 Federal employee for any purpose.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2F4BB339D695448394DC8CB11C08A0C1"><enum>(i)</enum><header display-inline="yes-display-inline">Conflicts of interest</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2F881190B210432DB45024AFD2AE5346"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided under paragraph (2), no
			 State member, alternate, officer, or employee of the Authority shall
			 participate personally and substantially as a member, alternate, officer, or
			 employee of the Authority, through decision, approval, disapproval,
			 recommendation, the rendering of advice, investigation, or otherwise, in any
			 proceeding, application, request for a ruling or other determination, contract,
			 claim, controversy, or other matter in which, to knowledge of the member,
			 alternate, officer, or employee any of the following persons has a financial
			 interest:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5337892F8B77475A95CC5BDE277ECF9"><enum>(A)</enum><text display-inline="yes-display-inline">The member, alternate, officer, or
			 employee.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2F375A55C6C74B5294FC86A81180B8F6"><enum>(B)</enum><text display-inline="yes-display-inline">The spouse, minor child, or partner of the
			 member, alternate, officer, or employee.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6036AD740124A49A6422E87F07CAA37"><enum>(C)</enum><text display-inline="yes-display-inline">Any organization (other than a State or
			 political subdivision of the State) in which the member, alternate, officer, or
			 employee is serving as an officer, director, trustee, partner, or
			 employee.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H737B344A15A544B4AA67D7C91C55E359"><enum>(D)</enum><text display-inline="yes-display-inline">Any person or organization with whom the
			 member, alternate, officer, or employee is negotiating or has any arrangement
			 concerning prospective employment.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD01BB63994944DB5A171D04436E238AC"><enum>(2)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply if the State
			 member, alternate, officer, or employee—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H709883BD31C343049C9796FAE24838E6"><enum>(A)</enum><text display-inline="yes-display-inline">immediately advises the Authority of the
			 nature and circumstances of the proceeding, application, request for a ruling
			 or other determination, contract, claim, controversy, or other particular
			 matter presenting a potential conflict of interest;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6F84D17883D445AB06F5700B3C0757E"><enum>(B)</enum><text display-inline="yes-display-inline">makes full disclosure of the financial
			 interest; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H445DE8A162994789A85CCE7B381900B5"><enum>(C)</enum><text display-inline="yes-display-inline">before the proceeding concerning the matter
			 presenting the conflict of interest, receives a written determination by the
			 Authority that the interest is not so substantial as to be likely to affect the
			 integrity of the services that the Authority may expect from the State member,
			 alternate, officer, or employee.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H64AE5B8650794670A1359EDA2F3CA696"><enum>(3)</enum><header display-inline="yes-display-inline">Violation</header><text display-inline="yes-display-inline">Any person that violates this subsection
			 shall be fined not more than $10,000, imprisoned not more than 2 years, or
			 both.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H498CE060E24841F286D7842335772311"><enum>(j)</enum><header display-inline="yes-display-inline">Validity of contracts, loans, and
			 grants</header><text display-inline="yes-display-inline">The Authority may
			 declare void any contract, loan, or grant of or by the Authority in relation to
			 which the Authority determines that there has been a violation of any provision
			 under subsection (h)(4), subsection (i), or sections 202 through 209 of title
			 18, United States Code.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HC3214A55350E47258844A92519510562" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Economic and community development
			 grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB0F56F3D62604AD6A7FE0040D7F2CDEF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Authority may approve grants to States
			 and public and nonprofit entities for projects, approved in accordance with
			 section 10—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H31E0AC8E09BB4823B58FC39D1B128B32"><enum>(1)</enum><text display-inline="yes-display-inline">to develop the infrastructure of the region
			 for the purpose of facilitating economic development in the region (except that
			 grants for this purpose may only be made to a State or local
			 government);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H06BF7598FA4E486A87AC1CD8FFE70851"><enum>(2)</enum><text display-inline="yes-display-inline">to assist the region in obtaining job
			 training, employment-related education, and business development;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA326FC2090F947FDAD146221883F6C4D"><enum>(3)</enum><text display-inline="yes-display-inline">to provide assistance to severely
			 distressed and underdeveloped areas; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB719F7DB17B546AE82859C6841FEE31F"><enum>(4)</enum><text display-inline="yes-display-inline">to otherwise achieve the purposes of this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H91A8013CEC2E4AC58807464EC49F6424"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H05F8CCE095BA4DE6B607CE000399DABE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Funds for grants under subsection (a) may
			 be provided—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HB9DC06DE45114F80B5135B3F5D2E9897"><enum>(A)</enum><text display-inline="yes-display-inline">entirely from appropriations to carry out
			 this section;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD2F8BD77D6CC409B8D5784D93CEC1886"><enum>(B)</enum><text display-inline="yes-display-inline">in combination with funds available under
			 another State or Federal grant program; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BF1061A2C7944BC82B6282144AF7D4D"><enum>(C)</enum><text display-inline="yes-display-inline">from any other source.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D3587B1548F43DBA34BD5C8CFB99081"><enum>(2)</enum><header display-inline="yes-display-inline">Funding priority</header><text display-inline="yes-display-inline">Not less than 50 percent of the amount of
			 expenditures approved by the Authority shall support activities or projects
			 that benefit severely and persistently distressed counties and areas.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H96728B877A74495E8366ED445F0054FE"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible projects</header><text display-inline="yes-display-inline">The Authority may provide assistance, make
			 grants, enter into contracts, or otherwise provide funds to eligible entities
			 in the region for projects that promote—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H85D3396BA9394B7297D0759B132345C"><enum>(A)</enum><text display-inline="yes-display-inline">business development;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F3879A76BCD449AAC444BDAD77DC710"><enum>(B)</enum><text display-inline="yes-display-inline">job training or employment-related
			 education;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3B62F55A63FA498696DFCC9312523D37"><enum>(C)</enum><text display-inline="yes-display-inline">local planning and leadership
			 development;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H05DAB6FDE04F4911946DBAF4801EC409"><enum>(D)</enum><text display-inline="yes-display-inline">basic public infrastructure, including
			 high-tech infrastructure, in distressed counties and isolated areas of
			 distress; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H422254D13B254B86A0CC55A6288143FE"><enum>(E)</enum><text display-inline="yes-display-inline">any other project facilitating economic
			 development in the region.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2C58DEC816D046A8A488D0F174B2620"><enum>(4)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">Notwithstanding any provision of law
			 limiting the Federal share in any grant program, funds appropriated to carry
			 out this section may be used to increase a Federal share in a grant program, as
			 the Authority determines appropriate.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB9628E36AE4244A7A7B5E5D0E08D9264" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Supplements to Federal grant
			 programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDCF72FA01B4049B2A4FAA262302000AF"><enum>(a)</enum><header display-inline="yes-display-inline">Federal grant program funding</header><text display-inline="yes-display-inline">In accordance with subsection (b), the
			 Federal cochairperson may use amounts made available to carry out this Act,
			 without regard to any limitations on areas eligible for assistance or
			 authorizations for appropriation under any other Act, to fund all or any
			 portion of the basic Federal contribution to a project or activity under a
			 Federal grant program in the region in an amount that is above the fixed
			 maximum portion of the cost of the project otherwise authorized by applicable
			 law, but not to exceed 80 percent of the costs of the project.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2B5DFDD5D8DC451083E2DFCCBED62E64"><enum>(b)</enum><header display-inline="yes-display-inline">Certification</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H22D544DE4E5442CDBEA1B6768243407B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of any program or project for
			 which all or any portion of the basic Federal contribution to the project under
			 a Federal grant program is proposed to be made under this section, no Federal
			 contribution shall be made until the Federal official administering the Federal
			 law authorizing the contribution certifies that the program or project—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF5726B3A0B7D44348143ECE5B021B38B"><enum>(A)</enum><text display-inline="yes-display-inline">meets the applicable requirements of the
			 applicable Federal grant law; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F944D9D947F4AF09DC180009FCCA917"><enum>(B)</enum><text display-inline="yes-display-inline">could be approved for Federal contribution
			 under the law if funds were available under the law for the program or
			 project.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC569822A17F14572B2AD8975884EC4D"><enum>(2)</enum><header display-inline="yes-display-inline">Certification by Authority</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC54DB8ADE8C945B8B300D3284013451B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The certifications and determinations
			 required to be made by the Authority for approval of projects under this Act in
			 accordance with section 10—</text>
						<clause commented="no" display-inline="no-display-inline" id="H39E40B09BB474AE586292E413DB27400"><enum>(i)</enum><text display-inline="yes-display-inline">shall be controlling; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H9C4A6DF2F8B244CE8F5E2E047ECFBA1"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be accepted by the Federal
			 agencies.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H53BFD2EB7FD241C5846171FF8D34FF5F"><enum>(B)</enum><header display-inline="yes-display-inline">Acceptance by Federal
			 cochairperson</header><text display-inline="yes-display-inline">Any finding,
			 report, certification, or documentation required to be submitted to the head of
			 the department, agency, or instrumentality of the Federal Government
			 responsible for the administration of any Federal grant program shall be
			 accepted by the Federal cochairperson with respect to a supplemental grant for
			 any project under the program.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB4D671F9E7A3490DA67FC958C8881E2" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Local development districts; certification
			 and administrative expenses</header>
			<subsection commented="no" display-inline="no-display-inline" id="H6EC2001EA1C043B0A800D81839110700"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of local development
			 district</header><text display-inline="yes-display-inline">In this section, the
			 term <term>local development district</term> means an entity designated by the
			 State that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HC34677884AE943EC97C737C2772F20DC"><enum>(1)</enum><text display-inline="yes-display-inline">is—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H68E0D35D6B4141D78D2BADA390CCAEF3"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H09844611B05648CE00623FFF8263B1B"><enum>(i)</enum><text display-inline="yes-display-inline">a planning district in existence on the
			 date of enactment of this Act that is recognized by the Economic Development
			 Administration of the Department of Commerce; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HBC540F56117E46428073F6A3B0641F20" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a development district recognized by the
			 State; or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE73DDB3BDC7D46C7B0A33700C8143B20"><enum>(B)</enum><text display-inline="yes-display-inline">if an entity described in subparagraph
			 (A)(i) or (A)(ii) does not exist, an entity designated by the Authority that
			 satisfies the criteria developed by the Economic Development Administration for
			 a local development district; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEFE16E480264ACFBDAFDF031BA5B142"><enum>(2)</enum><text display-inline="yes-display-inline">has not, as certified by the Federal
			 cochairperson—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H0705439EBCE24B6100C3B1F5A02DE9B"><enum>(A)</enum><text display-inline="yes-display-inline">inappropriately used Federal grant funds
			 from any Federal source; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H82A8E651390045EEA83320B35370D43F"><enum>(B)</enum><text display-inline="yes-display-inline">appointed an officer who, during the period
			 in which another entity inappropriately used Federal grant funds from any
			 Federal source, was an officer of the other entity.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEA3B2B1ED45543A7ABD273D48D70B1FA"><enum>(b)</enum><header display-inline="yes-display-inline">Grants to local development
			 districts</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H6E10771791124742BCE7F402DB12AC32"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Authority may make grants for
			 administrative expenses under this section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB6FF9CFD95C04E37AB5E8307E9777CB5"><enum>(2)</enum><header display-inline="yes-display-inline">Conditions for grants</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5271CA3F6D74482D99BF6B526741CFAF"><enum>(A)</enum><header display-inline="yes-display-inline">Maximum
			 amount</header><text display-inline="yes-display-inline">The amount of any
			 grant awarded under paragraph (1) shall not exceed 80 percent of the
			 administrative expenses of the local development district receiving the
			 grant.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H934EAE6740A148FA96A565E747BA3D6"><enum>(B)</enum><header display-inline="yes-display-inline">Local share</header><text display-inline="yes-display-inline">The contributions of a local development
			 district for administrative expenses may be in cash or in kind, fairly
			 evaluated, including space, equipment, and services.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H055FF088C9644B63979EB5F5421D4634"><enum>(c)</enum><header display-inline="yes-display-inline">Duties of local development
			 districts</header><text display-inline="yes-display-inline">A local development
			 district shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF98237D5441C49E8BE00839E00C90187"><enum>(1)</enum><text display-inline="yes-display-inline">operate as a lead organization serving
			 multicounty areas in the region at the local level; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF4C0B40C0F549069EFBEBF6F6E62023"><enum>(2)</enum><text display-inline="yes-display-inline">serve as a liaison between State and local
			 governments, nonprofit organizations (including community-based groups and
			 educational institutions), the business community, and citizens that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2D45EFBC47AD44AABF647DA38F60C0C2"><enum>(A)</enum><text display-inline="yes-display-inline">are involved in multijurisdictional
			 planning;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11E69337546940540052F6E07695CA9"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to local
			 jurisdictions and potential grantees; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3557224C9DE0413499046002275F19AD"><enum>(C)</enum><text display-inline="yes-display-inline">provide leadership and civic development
			 assistance.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HF21A71BB230342AC9DB610021A3F04B" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Distressed counties and areas and
			 nondistressed counties</header><text display-inline="no-display-inline">Not
			 later than 90 days after the date of enactment of this Act, and annually
			 thereafter, the Authority, in accordance with such criteria as the Authority
			 establishes, may designate—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H78CAC7C9A2934D1F9D668B169C976901"><enum>(1)</enum><text display-inline="yes-display-inline">as distressed counties, counties in the
			 region that are the most severely and persistently distressed and
			 underdeveloped and have high rates of poverty, low per capita income, or high
			 rates of unemployment; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9F256506C7A643AC993393C518F5E4D"><enum>(2)</enum><text display-inline="yes-display-inline">as isolated areas of distress, areas
			 located in nondistressed counties in the region that are severely and
			 persistently distressed as documented by comparable statistical
			 measures.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HA0D1846D690C4F15859FA584C333BB00" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Development planning process</header>
			<subsection commented="no" display-inline="no-display-inline" id="H7D5317E96E0B46029E15D17FA906AA20"><enum>(a)</enum><header display-inline="yes-display-inline">State development plan</header><text display-inline="yes-display-inline">In accordance with policies established by
			 the Authority, each State member shall submit a development plan for the area
			 of the region represented by the State member.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7786ACFAF62E4FB58C82A7455236D777"><enum>(b)</enum><header display-inline="yes-display-inline">Content of plan</header><text display-inline="yes-display-inline">A State development plan submitted under
			 subsection (a) shall reflect the goals, objectives, and priorities identified
			 in the regional development plan developed under section 3(d)(2).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H52240B33691B43259019A5C337098582"><enum>(c)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In carrying out the development planning
			 process, a State shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H98A784F0C67C4A03BF2C008DC500E9D8"><enum>(1)</enum><text display-inline="yes-display-inline">consult with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5F12203A80634077A802111CFBD98E2C"><enum>(A)</enum><text display-inline="yes-display-inline">local development districts;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF02D6196DE3941B4B3267CC068DBA8E"><enum>(B)</enum><text display-inline="yes-display-inline">local units of government; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF34BFEC7E0E8484F9276D0252B217843"><enum>(C)</enum><text display-inline="yes-display-inline">institutions of higher learning; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71D81F65F30A459E82002B2CB0BBF5B9"><enum>(2)</enum><text display-inline="yes-display-inline">take into consideration the goals,
			 objectives, priorities, and recommendations of the entities described in
			 paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H134D6C72ACF6475DA081F1F51E941900"><enum>(d)</enum><header display-inline="yes-display-inline">Public participation</header><text display-inline="yes-display-inline">The Authority and applicable State and
			 local development districts shall encourage and assist, to the maximum extent
			 practicable, public participation in the development, revision, and
			 implementation of all plans and programs under this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HFEF6D5E9FF3045259714E02697F558B1" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Program development criteria</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC365E132E1ED456BAA031124FA1F1D6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In considering programs and projects to be
			 provided assistance under this Act, and in establishing a priority ranking of
			 the requests for assistance provided by the Authority, the Authority shall
			 follow procedures that ensure, to the maximum extent practicable, consideration
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA971EC34B2404823BBD99EB78FA7DFA"><enum>(1)</enum><text display-inline="yes-display-inline">the relationship of the project to overall
			 regional development;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H996156311A8F444BBE22F8250B911C"><enum>(2)</enum><text display-inline="yes-display-inline">the per capita income and poverty and
			 unemployment rates and other socioeconomic indicators in an area;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE2F98D8B8DE4BF79758C892505BE5C7"><enum>(3)</enum><text display-inline="yes-display-inline">the financial resources available to the
			 applicants for assistance seeking to carry out the project, with emphasis on
			 ensuring that projects are adequately financed to maximize the probability of
			 successful economic development;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47D6BF75C05443A3AC2798AD2809A1E0"><enum>(4)</enum><text display-inline="yes-display-inline">the importance of the project in relation
			 to other projects that may be in competition for the same funds;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9B9372337A054A51A2E6E4149F3991C5"><enum>(5)</enum><text display-inline="yes-display-inline">the prospects that the project for which
			 assistance is sought will improve, on a continuing rather than a temporary
			 basis, the opportunities for employment, the average level of income, or the
			 economic development of the area served by the project; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25A3BFFA141A423CB7FD984DDDB2CCEF"><enum>(6)</enum><text display-inline="yes-display-inline">the extent to which the project design
			 provides for detailed outcome measurements by which grant expenditures and the
			 results of the expenditures may be evaluated.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H666963F77F6C431D908D468800ACAF00"><enum>(b)</enum><header display-inline="yes-display-inline">No relocation assistance</header><text display-inline="yes-display-inline">No financial assistance authorized by this
			 Act shall be used to assist an establishment in relocating from 1 area to
			 another.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H49F971D7A6944DD2BD7275E275C0A244"><enum>(c)</enum><header display-inline="yes-display-inline">Reduction of funds</header><text display-inline="yes-display-inline">Funds may be provided for a program or
			 project in a State under this Act only if the Authority determines that the
			 level of Federal or State financial assistance provided under a law other than
			 this Act, for the same type of program or project in the same area of the State
			 within the region, will not be reduced as a result of funds made available by
			 this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H1D7578B693D1451E84DAB0E7FC143E8" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Approval of development plans and
			 projects</header>
			<subsection commented="no" display-inline="no-display-inline" id="H96E51DF1902F4DD4939BA401CE36F3BD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State or regional development plan or any
			 multistate subregional plan that is proposed for development under this Act
			 shall be reviewed by the Authority.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4BD04827135E401CB236A467E9563DB1"><enum>(b)</enum><header display-inline="yes-display-inline">Evaluation by State member</header><text display-inline="yes-display-inline">An application for a grant or any other
			 assistance for a project under this Act shall be made through and evaluated for
			 approval by the State member of the Authority representing the
			 applicant.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H65488FC53EB14498BE476BE0B5312BE0"><enum>(c)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">An application for a grant or other
			 assistance for a project shall be approved only on certification by the State
			 member and Federal cochairperson that the application for the project—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H2C26613EA4C849F2B70024EB002D6F27"><enum>(1)</enum><text display-inline="yes-display-inline">describes ways in which the project
			 complies with any applicable State development plan;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB653179690044D1AA5C37B24D6A39E3E"><enum>(2)</enum><text display-inline="yes-display-inline">meets applicable criteria under section
			 9;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H124FE818099B4D92A2E57545E39DD25B"><enum>(3)</enum><text display-inline="yes-display-inline">provides adequate assurance that the
			 proposed project will be properly administered, operated, and maintained;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CF3B9A3D5564D148728227F023102E6"><enum>(4)</enum><text display-inline="yes-display-inline">otherwise meets the requirements of this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H05D4DC423D734427BB4163B06FE93BD1"><enum>(d)</enum><header display-inline="yes-display-inline">Votes for decisions</header><text display-inline="yes-display-inline">Upon certification of an application for a
			 grant or other assistance for a specific project under this section, an
			 affirmative vote of the Authority under section 3(c) shall be required for
			 approval of the application.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H6833C537CEBC4E5AB3810034A4B49978" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Consent of States</header><text display-inline="no-display-inline">Nothing in this Act requires any State to
			 engage in or accept any program under this Act without the consent of the
			 State.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HAF0169DC020E4D24BCF4D6B3EE88CEC" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Records</header>
			<subsection commented="no" display-inline="no-display-inline" id="H8BCA770E768B42F1BB502EEFAE7D64"><enum>(a)</enum><header display-inline="yes-display-inline">Records of the Authority</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HB972E9ACD80B47C09DCCC2B4096D6FD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Authority shall maintain accurate and
			 complete records of all transactions and activities of the Authority.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C474DB5E20B4318B4900674C016BA38"><enum>(2)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">All records of the Authority shall be
			 available for audit and examination by the Comptroller General of the United
			 States (including authorized representatives of the Comptroller
			 General).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEB9C35A028674E67988BAAC5D4B14ED"><enum>(b)</enum><header display-inline="yes-display-inline">Records of recipients of Federal
			 assistance</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA665A1BDFB2441059160786905665903"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A recipient of Federal funds under this Act
			 shall, as required by the Authority, maintain accurate and complete records of
			 transactions and activities financed with Federal funds and report on the
			 transactions and activities to the Authority.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22013CC9BCA845A70025BB03EC651CF5"><enum>(2)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">All records required under paragraph (1)
			 shall be available for audit by the Comptroller General of the United States
			 and the Authority (including authorized representatives of the Comptroller
			 General and the Authority).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H98A74D3C57B94BF881A2E3762D3C7240" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="no-display-inline">Not later than 180 days after the end of
			 each fiscal year, the Authority shall submit to the President and to Congress a
			 report describing the activities carried out under this Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H90755CBA71D041FA8FEB6FA35912DCDF" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB131B87BEEE34048A400ACD0212CC5C3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to
			 the Authority to carry out this Act $40,000,000 for each of fiscal years 2008
			 through 2012, to remain available until expended.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H448AC83C9C6E4002B3FFA24204A6E557"><enum>(b)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Not more than 5 percent of the amount
			 appropriated under subsection (a) for a fiscal year shall be used for
			 administrative expenses of the Authority.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE681226472554905A0006070ABA17356" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Termination of Authority</header><text display-inline="no-display-inline">This Act shall have no force or effect on or
			 after October 1, 2012.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H7DCBBDE225F04934B6D8B798AF93B9ED" section-type="subsequent-section"><enum>16.</enum><header display-inline="yes-display-inline">Area covered by SouthEast Crescent
			 Authority</header><text display-inline="no-display-inline">SouthEast Crescent
			 Authority region shall include all parts of the States of Virginia, North
			 Carolina, South Carolina, Georgia, Alabama, Mississippi, and Florida that are
			 not eligible for assistance from the Appalachian Regional Commission or the
			 Delta Regional Authority.</text>
