			 <quote><short-title>Rural Medicare Equity Act of

			 adjustment factor from geographic indices used to adjust payments under the
			 physician fee schedule</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID02C14EBE332144F700B4923B5DAFAADF"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDED512B15BB4B45B9BB791F7659722BDD"><enum>(1)</enum><text display-inline="yes-display-inline">Variations in the geographic physician work
			 adjustment factors under
			 <external-xref legal-doc="act" parsable-cite="SSA/1848(e)">section
			 1848(e)</external-xref> of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4(e)">42 U.S.C. 1395w–4(e)</external-xref>) result
			 in inequity between localities in payments under the Medicare physician fee
			 schedule.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID17ECB2EA8D6D4338B0C1B9217D7273A3"><enum>(2)</enum><text display-inline="yes-display-inline">Beneficiaries under the Medicare program
			 that reside in areas where such adjustment factors are high have relatively
			 more access to services that are paid based on such fee schedule.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1F116FF9C7194DAA962C22343902C709"><enum>(3)</enum><text display-inline="yes-display-inline">There are a number of studies indicating
			 that the market for health care professionals has become nationalized and
			 historically low labor costs in rural and small urban areas have
			 disappeared.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID69AA36ADCFB04B4FB1C1EA51ED69CC28"><enum>(4)</enum><text display-inline="yes-display-inline">Elimination of the adjustment factors
			 described in paragraph (1) would equalize the reimbursement rate for services
			 reimbursed under the Medicare physician fee schedule while remaining
			 budget-neutral.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID811CECE9683E4B2800B01500EB28D822"><enum>(b)</enum><header display-inline="yes-display-inline">Elimination</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1848(e)">Section 1848(e)</external-xref> of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4(e)">42 U.S.C.
			 1395w–4(e)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDEADB67FD5D9C4919B506FD2E0374838C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A)(iii), by striking
			 <quote>an index</quote> and inserting <quote>for services provided before
			 January 1, 2008, an index</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE2797DBB1E6344AEAB7E447DDE67445D"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>, for
			 services provided before January 1, 2008,</quote> after <quote>paragraph (4)),
			 and</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC702F24CD68A41E584B26143ACE0A5B7"><enum>(c)</enum><header display-inline="yes-display-inline">Budget neutrality adjustment for
			 elimination of geographic physician work adjustment factor</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1848(d)">Section 1848(d)</external-xref> of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4(d)">42 U.S.C.
			 1395w–4(d)</external-xref>), as amended by section 101 of the Medicare
			 Improvement and Extension Act of 2006, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0642579DA87B4BB7A4AA4F38D9C86C03"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by striking <quote>The
			 conversion</quote> and inserting <quote>Subject to paragraph (8), the
			 conversion</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID818B189B9AF14845A97091DEA7DD8EA0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="ID13A284E2569045A592D7EB9EB26D4321" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID9B54F653310C462A9955E965E8FD005F"><enum>(8)</enum><header display-inline="yes-display-inline">Budget neutrality adjustment for
				Elimination of geographic physician work adjustment factor</header><text display-inline="yes-display-inline">Before applying an update for a year under
				this subsection, the Secretary shall (if necessary) provide for an adjustment
				to the conversion factor for that year to ensure that the aggregate payments
				under this part in that year shall be equal to aggregate payments that would
				have been made under such part in that year if the amendments made by section
				2(b) of the <short-title>Rural Medicare Equity Act of
				2007</short-title> had not been
				enacted.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDD64C3DC2CFE84F17A734C3ED41099537" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Clinical rotation demonstration
			 project</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDCDDE3D9E910544FF98B008F6CE1C921B"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 enactment of this Act, the Secretary shall establish a demonstration project
			 that provides for demonstration grants designed to provide financial or other
			 incentives to hospitals to attract educators and clinical practitioners so that
			 hospitals that serve beneficiaries under the Medicare program under title XVIII
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C.
			 1395</external-xref> et seq.) who are residents of underserved areas may host
			 clinical rotations.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC756AF3CE96B400B8D2836816D943400"><enum>(b)</enum><header display-inline="yes-display-inline">Duration of project</header><text display-inline="yes-display-inline">The demonstration project shall be
			 conducted over a 5-year period.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id15B383E9307B44EEA789A4EB47DF260E"><enum>(c)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Secretary shall waive such provisions
			 of titles XI and XVIII of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42
			 U.S.C. 1301</external-xref> et seq. and 1395 et seq.) as may be necessary to
			 conduct the demonstration project under this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE6D2D6B55DE94A7AB7CA42BB389F6D47"><enum>(d)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Secretary shall submit to the
			 appropriate committees of Congress interim reports on the demonstration project
			 and a final report on such project within 6 months after the conclusion of the
			 project together with recommendations for such legislative or administrative
			 action as the Secretary determines appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id85E3BD82987C48FDA3EDA6A5137784DC"><enum>(e)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There are appropriated to the Secretary
			 $20,000,000 to carry out this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID515D86C3E87B44EAB7DCE5B7001E5866"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID06172A265EA54D7E8FFD006640534845"><enum>(1)</enum><header display-inline="yes-display-inline">Hospital</header><text display-inline="yes-display-inline">The term <term>hospital</term> means any
			 subsection (d) hospital (as defined in
			 <external-xref legal-doc="act" parsable-cite="SSA/1886(d)(1)(B)">section
			 1886(d)(1)(B)</external-xref> of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(1)(B)">42 U.S.C.
			 1395ww(d)(1)(B)</external-xref>) that had indirect or direct costs of medical
			 education during the most recent cost reporting period preceding the date of
			 enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFDC2A361554342E6AA5D9B8EB05E852E"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Health and Human Services.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID356042DC32C341819EE652DA4467A8D2"><enum>(3)</enum><header display-inline="yes-display-inline">Underserved area</header><text display-inline="yes-display-inline">The term <term>underserved area</term>
			 means such medically underserved urban areas and medically underserved rural
			 areas as the Secretary may specify.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8DA09C06382B46B5AE9716B9680D0671" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Medicare rural health care quality
			 improvement demonstration projects</header>
			<subsection commented="no" display-inline="no-display-inline" id="id93D8DE6C5E4547308FC08CD313885D4B"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0F7D48231E9946AD933ADE310343F821"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 enactment of this Act, the Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall establish not more
			 that 10 demonstration projects to provide for improvements, as recommended by
			 the Institute of Medicine, in the quality of health care provided to
			 individuals residing in rural areas.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0F729CECD0E94593BB2A9F928A2127C8"><enum>(2)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">Activities under the projects may include
			 public health surveillance, emergency room videoconferencing, virtual
			 libraries, telemedicine, electronic health records, data exchange networks, and
			 any other activities determined appropriate by the Secretary.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4EB490BC3FB47A0B99FD20646F51673"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall consult with the Rural
			 Health Quality Advisory Commission, the Office of Rural Health Policy of the
			 Health Resources and Services Administration, the Agency for Healthcare
			 Research and Quality, and the Centers for Medicare &amp; Medicaid Services in
			 carrying out the provisions of this section.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBDA07B33A71549F1998D9015F691B776"><enum>(b)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">Each demonstration project under this
			 section shall be conducted over a 4-year period.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HAC0C79CC4C07403ABA63CF4DAE14EC5C"><enum>(c)</enum><header display-inline="yes-display-inline">Demonstration project sites</header><text display-inline="yes-display-inline">The Secretary shall ensure that the
			 demonstration projects under this section are conducted at a variety of sites
			 representing the diversity of rural communities in the Nation.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8D2FF494442443999A50EE5F714E1767"><enum>(d)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Secretary shall waive such provisions
			 of titles XI and XVIII of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42
			 U.S.C. 1301</external-xref> et seq. and 1395 et seq.) as may be necessary to
			 conduct the demonstration projects under this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1D0E5DAAD75D4BD4BDBEA957C26A490"><enum>(e)</enum><header display-inline="yes-display-inline">Independent evaluation</header><text display-inline="yes-display-inline">The Secretary shall enter into an
			 arrangement with an entity that has experience working directly with rural
			 health systems for the conduct of an independent evaluation of the projects
			 conducted under this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA0E8F5E182E14E0BACF9A0294AEBF1D3"><enum>(f)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Secretary shall submit to the
			 appropriate committees of Congress interim reports on each demonstration
			 project and a final report on such project within 6 months after the conclusion
			 of the project. Such reports shall include recommendations regarding the
			 expansion of the project to other areas and recommendations for such other
			 legislative or administrative action as the Secretary determines
			 appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD5F023A68E8A443C83A577BA68A4B097"><enum>(g)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There are appropriated to the Secretary
			 $50,000,000 to carry out this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id217A3DC95214452A9AA29D3CAFC70AE9" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Ensuring proportional representation of
			 interests of rural areas on the Medicare Payment Advisory Commission</header>
			<subsection commented="no" display-inline="no-display-inline" id="id274AE1ADBDA547DB885D73613FFBAFAD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1805(c)(2) of the Social Security
			 Act (42 U.S.C. 1395b–6(c)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idFDCC5CE247BC4F34A0244D15935524E2"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting
			 <quote>consistent with subparagraph (E)</quote> after <quote>rural
			 representatives</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id258DE0B1E7FF47C697B21A7F5751D9D8"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id0C252667583549B3A80CA13163B369F7" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id4CCA1259130041FFA8AF51B0524F5AB9"><enum>(E)</enum><header display-inline="yes-display-inline">Proportional representation of interests of
				rural areas</header><text display-inline="yes-display-inline">In order to
				provide a balance between urban and rural representatives under subparagraph
				(A), the proportion of members who represent the interests of health care
				providers and Medicare beneficiaries located in rural areas shall be no less
				than the proportion, of the total number of Medicare beneficiaries, who reside
				in rural
				areas.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9265d016176c44ebb977a7b7ebcc5249"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall apply with respect to appointments made to the Medicare
			 Payment Advisory Commission after the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id0EA91E93C4AC4301B1A3D15AB071801A" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Implementation of GAO recommendations
			 regarding geographic adjustment indices under the Medicare physician fee
			 schedule</header><text display-inline="no-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary of Health and Human
			 Services shall implement the recommendations contained in the March 2005 GAO
			 report 05–119 entitled <quote>Medicare Physician Fees: Geographic Adjustment
			 Indices are Valid in Design, but Data and Methods Need
			 Refinement.</quote>.</text>
