		<official-title>To establish requirements for lenders and institutions of
		  higher education in order to protect students and other borrowers receiving
		  educational loans.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Student Loan Sunshine
			 Act</short-title></quote>.</text>
		</section><section id="idBB2F609FE55A44F38FE91F031B406871"><enum>2.</enum><header>Institution and
			 lender reporting and disclosure requirements</header><text display-inline="no-display-inline">Title I of the Higher Education Act of 1965
			 (20 U.S.C. 1001 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE24F7124D6554524A5BCFF31D305FAEB" style="OLC">
				<part id="id9F4546B578AC46D3B4D83B1D8800FB36"><enum>E</enum><header>Lender and
				institution requirements relating to educational loans</header>
					<section id="idFB4370DA2B4044F698C30FFEEE2ADE1B"><enum>151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
						<paragraph id="idBEF0A7F06E904977AC8457A12C37EE52"><enum>(1)</enum><header>Covered
				institution</header><text>The term <term>covered institution</term>—</text>
							<subparagraph id="id3449FCF5911B4A69BE14FA358123D982"><enum>(A)</enum><text>means any
				educational institution that offers a postsecondary educational degree,
				certificate, or program of study (including any institution of higher
				education, as such term is defined in section 102) and receives any Federal
				funding or assistance; and</text>
							</subparagraph><subparagraph id="id4F8A2425E50E4106960DFA5980A68F98"><enum>(B)</enum><text>includes an agent
				of the educational institution (including an alumni association, booster club,
				or other organization directly or indirectly associated with such institution)
				or employee of such institution.</text>
							</subparagraph></paragraph><paragraph id="id3543FEC7CA1945119C3D01F6344B8F84"><enum>(2)</enum><header>Educational
				loan</header><text>The term <term>educational loan</term> (except when used as
				part of the term <term>private educational loan</term>) means—</text>
							<subparagraph id="id55EBDE6668634F688D74C2C8A409F508"><enum>(A)</enum><text>any loan made,
				insured, or guaranteed under title IV; or</text>
							</subparagraph><subparagraph commented="no" id="idD9EE7DFCE2C14F3491FD447C6F1A9521"><enum>(B)</enum><text>a private
				educational loan (as defined in paragraph (5)).</text>
							</subparagraph></paragraph><paragraph id="id6BC5B5B348404C14932209D14D900E4E"><enum>(3)</enum><header>Educational
				loan arrangement</header>
							<subparagraph id="id752D81626C6C44A59C583AE6092CE3F5"><enum></enum><text>The term
				<term>educational loan arrangement</term> means an arrangement or agreement
				between a lender and a covered institution—</text>
							</subparagraph><subparagraph id="id4C2B861D9C874359958DAA3F034A297E"><enum>(A)</enum><text>under which
				arrangement or agreement a lender provides or otherwise issues educational
				loans to the students attending the covered institution or the parents of such
				students; and</text>
							</subparagraph><subparagraph id="idB78B0C6C0E1944B9B43A32F948DA45F9"><enum>(B)</enum><text>which arrangement
				or agreement—</text>
								<clause id="idB8D8D34A0B4247E3A58E9A4DAA3961C4"><enum>(i)</enum><text>relates to the
				covered institution recommending, promoting, endorsing, or using the loan
				product of the lender; and</text>
								</clause><clause id="id92ECB9BF33D945BBB8F7AEC54C33F5D2"><enum>(ii)</enum><text>involves the
				payment of any fee or provision of other material benefit by the lender to the
				institution or to groups of students who attend the institution.</text>
								</clause></subparagraph></paragraph><paragraph id="idC716CB4971224D35A5EB3E3DCEF28C1D"><enum>(4)</enum><header>Lender</header>
							<subparagraph id="id50E98835A1B645A4A1A451C2E212C905"><enum>(A)</enum><header>In
				general</header><text>The term <term>lender</term>—</text>
								<clause id="id3A3E017F1AE74BE09AF7C88D7982988F"><enum>(i)</enum><text>means a creditor,
				except that such term shall not include an issuer of credit under a residential
				mortgage transaction; and</text>
								</clause><clause id="id2CE4E50004E744CEB46349A797D36C9B"><enum>(ii)</enum><text>includes an
				agent of a lender.</text>
								</clause></subparagraph><subparagraph id="id5E67ED1161D145638E9BCB214621543E"><enum>(B)</enum><header>Incorporation
				of TILA definitions</header><text>The terms <term>creditor</term> and
				<term>residential mortgage transaction</term> have the meanings given such
				terms in section 103 of the Truth in Lending Act (15 U.S.C. 1602).</text>
							</subparagraph></paragraph><paragraph id="id217440B78A25489D91EAC8984FFA9EB7"><enum>(5)</enum><header>Private
				educational loan</header><text>The term <term>private educational loan</term>
				means a private loan provided by a lender that—</text>
							<subparagraph id="idFF9CE44DAEA34657AC5F1A978D2983E7"><enum>(A)</enum><text>is not made,
				insured, or guaranteed under title IV; and</text>
							</subparagraph><subparagraph id="idA308D92E647949E8B0ABBB771A71874B"><enum>(B)</enum><text>is issued by a
				lender for postsecondary educational expenses to a student, or the parent of
				the student, regardless of whether the loan is provided through the educational
				institution that the student attends or directly to the student or parent from
				the lender.</text>
							</subparagraph></paragraph><paragraph commented="no" id="id5C406A49C05B4AF8A86BDAB1D7765400"><enum>(6)</enum><header>Postsecondary
				educational expenses</header><text>The term <term>postsecondary educational
				expenses</term> means any of the expenses that are included as part of a
				student's cost of attendance, as defined under section 472.</text>
						</paragraph></section><section id="id4945FCF303484C608E5811065043F0D0"><enum>152.</enum><header>Requirements
				for lenders and institutions participating in educational loan
				arrangements</header>
						<subsection id="idC0A2FB9E6D054F6F983A71330A240F8B"><enum>(a)</enum><header>Reporting for
				lenders</header><text display-inline="yes-display-inline">In addition to any
				other disclosure required under Federal law, each lender that participates in 1
				or more educational loan arrangements shall prepare and submit to the Secretary
				(at a time to be determined by the Secretary) an annual report that includes,
				with respect to each educational loan arrangement, the following:</text>
							<paragraph id="id61C8603829284E9581775E95BF2ECC60"><enum>(1)</enum><text display-inline="yes-display-inline">The date on which the arrangement was
				entered into and the period for which the arrangement applies.</text>
							</paragraph><paragraph id="idB99E82D15638450FBF37AFF2745A5304"><enum>(2)</enum><text display-inline="yes-display-inline">A summary of the terms of the arrangement
				related to the marketing, recommending, endorsing, or use of, the loans.</text>
							</paragraph><paragraph id="idFBEBED259FE54F77BC467955C19F6FA0"><enum>(3)</enum><text display-inline="yes-display-inline">The full details of any aspect of the
				arrangement relating to the covered institution issuing loans and the lender
				(or a financial partner of the lender) servicing or purchasing such
				loans.</text>
							</paragraph><paragraph id="id90243C33373E417D951DDF33742ADBA2"><enum>(4)</enum><text display-inline="yes-display-inline">A summary of any direct or indirect benefit
				provided or paid to any party in connection with the arrangement.</text>
							</paragraph></subsection><subsection id="id03628D4F8CFF4F77B45153BE6461DAFF"><enum>(b)</enum><header>Provision of
				loan information</header><text>A lender may not provide a private educational
				loan to a student attending a covered institution with which the lender has an
				educational loan arrangement, or the parent of such student, until the covered
				institution has informed the student or parent of their remaining options for
				borrowing under title IV, including information on any terms and conditions of
				available loans under such title that are more favorable to the
				borrower.</text>
						</subsection><subsection id="id15E8CCB6A3F04928B5360B070CA21BC2"><enum>(c)</enum><header>Use of
				institution name</header>
							<paragraph id="idD40D5818A75D464692235664EE174258"><enum>(1)</enum><header>In
				general</header><text>A covered institution that has entered into an
				educational loan arrangement with a lender regarding private educational loans
				shall not allow the lender to use the name, emblem, mascot, or logo of the
				institution, or other words, pictures, or symbols readily identified with the
				institution, in the marketing of private educational loans to the students
				attending the institution in any way that implies that the institution endorses
				the private educational loans offered by the lender.</text>
							</paragraph><paragraph id="id9EF5C4DE0C6A406DA37BCA7C4340A65A"><enum>(2)</enum><header>Applicability</header><text>Paragraph
				(1) shall apply to any educational loan arrangement, or extension of such
				arrangement, entered into or renewed after the date of enactment of the
				<short-title>Student Loan Sunshine
				Act</short-title>.</text>
							</paragraph></subsection></section><section id="id33A0E8037E024EA69B606D752FFF3C25"><enum>153.</enum><header>Interest rate
				report for institutions and lenders participating in educational loan
				arrangements</header>
						<subsection id="idDE605E8B81ED46C4A75119F0C6C0CE51"><enum>(a)</enum><header>Secretary
				duties</header>
							<paragraph id="id388F9C521CED452F901ADBE1EFB6B3F7"><enum>(1)</enum><header>Report and
				model format</header><text>Not later than 180 days after the date of enactment
				of the Student Loan Sunshine Act, the Secretary shall—</text>
								<subparagraph id="idE260D2237A034E2FA4F5CF7A013FB102"><enum>(A)</enum><text>prepare a report
				on the adequacy of the information provided to students and the parents of such
				students about educational loans (including loans made, insured, or guaranteed
				under title IV and private educational loans), after consulting with students,
				representatives of covered institutions (including financial aid
				administrators, registrars, and business officers), lenders (including lenders
				of private educational loans), loan servicers, and guaranty agencies;</text>
								</subparagraph><subparagraph id="ID1c0ae2b1b09e4c1ea257b08990e0e748"><enum>(B)</enum><text>include in the
				report a model format, based on the report's findings, to be used by lenders
				and covered institutions in carrying out subsections (b) and (c)—</text>
									<clause id="id2D473A9F541D4D1085C5E7B17CEF92D5"><enum>(i)</enum><text>that provides
				information on the applicable interest rates and other terms and conditions of
				the educational loans provided by a lender to students attending the
				institution, or the parents of such students, disaggregated by each type of
				educational loans provided to such students or parents by the lender,
				including—</text>
										<subclause id="id5A8D96AC95334741864FE1E295D82129"><enum>(I)</enum><text>the interest rate
				and terms and conditions of the loans offered by the lender for the upcoming
				academic year;</text>
										</subclause><subclause id="id623A99192C414EAC955B30560517287C"><enum>(II)</enum><text>with respect to
				such loans, any benefits that are contingent on the repayment behavior of the
				borrower;</text>
										</subclause><subclause id="idB65838DEB8834A59933FBEAA30D94C44"><enum>(III)</enum><text>the annual
				percentage rate for such loans, based on the actual disbursed amount of the
				loan;</text>
										</subclause><subclause id="id7DC4B53CD31B4D04A3A551CE132E432D"><enum>(IV)</enum><text>the average
				amount borrowed from the lender by students enrolled in the institution who
				obtain loans of such type from the lender for the preceding academic year;
				and</text>
										</subclause><subclause id="id5E6C90A6B9BF48E78582F3E8F9188934"><enum>(V)</enum><text>the average
				interest rate on such loans provided to such students for the preceding
				academic year; and</text>
										</subclause></clause><clause id="idD8C154929CD6451997AFC07B87468C81"><enum>(ii)</enum><text>which format
				shall be easily usable by lenders, institutions, guaranty agencies, and loan
				servicers; and</text>
									</clause></subparagraph><subparagraph id="ID3fa4f70e547c447fad0812cd756aa01d"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idA04D8D30037A4E249DEA5FFC2B33F51C"><enum>(i)</enum><text>submit the report and
				model format to the Committee on Health, Education, Labor, and Pensions of the
				Senate and the Committee on Education and Labor of the House of
				Representatives; and</text>
									</clause><clause id="id5589CE9351E74224B3991380B484565A" indent="up1"><enum>(ii)</enum><text>make the report and model format
				available to covered institutions, lenders, and the public.</text>
									</clause></subparagraph></paragraph><paragraph id="IDc605eff1edc9449583563a17d0cf117e"><enum>(2)</enum><header>Format
				update</header><text>Not later than 1 year after the submission of the report
				and model format described in paragraph (1), the Secretary shall—</text>
								<subparagraph id="id9932FFB3F1414657BBEB8C00D8FEC958"><enum>(A)</enum><text>assess the
				adequacy of the model format included in the report;</text>
								</subparagraph><subparagraph id="id3CD350F7159E4EDFBABF888CBB7A284E"><enum>(B)</enum><text>after consulting
				with students, representatives of covered institutions (including financial aid
				administrators, registrars, and business officers), lenders (including lenders
				of private educational loans), loan servicers, and guaranty agencies—</text>
									<clause id="id512EED0697D94A57AC651993D69B1E34"><enum>(i)</enum><text>prepare a list of
				any improvements to the model format that have been identified as beneficial to
				borrowers; and</text>
									</clause><clause id="idB7F865011B95448B8097EC7F3F4FA5E3"><enum>(ii)</enum><text>update the model
				format after taking such improvements into consideration; and</text>
									</clause></subparagraph><subparagraph id="idEF5C59B4737145FA80DDA4740D2BFC90"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id61C1F59B6AFC4047A24C124907D0D1B1"><enum>(i)</enum><text>submit the list of
				improvements and updated model format to the Committee on Health, Education,
				Labor, and Pensions of the Senate and the Committee on Education and Labor of
				the House of Representatives; and</text>
									</clause><clause id="idB81CF594C0DA425794D7BD3A8176ADBE" indent="up1"><enum>(ii)</enum><text>make the list of improvements and
				updated model format available to covered institutions, lenders, and the
				public.</text>
									</clause></subparagraph></paragraph><paragraph id="id22B06113178446968221BD3D62D3F7E3"><enum>(3)</enum><header>Use of
				form</header><text>The Secretary shall take such steps as necessary to make the
				model format, and any updated model format, available to covered institutions
				and to encourage—</text>
								<subparagraph id="id9CF942C3496A4A5EA0D606B4B269A9BF"><enum>(A)</enum><text>lenders subject
				to subsection (b) to use the model format or updated model format (if
				available) in providing the information required under subsection (b);
				and</text>
								</subparagraph><subparagraph id="id278E2AACD2734528B08A33AE2C58D3BA"><enum>(B)</enum><text>covered
				institutions to use such format in preparing the information report under
				subsection (c).</text>
								</subparagraph></paragraph></subsection><subsection id="idFA6ED8D187054DB585E62EB3C996B500"><enum>(b)</enum><header>Lender
				duties</header><text>Each lender that has an educational loan arrangement with
				a covered institution shall annually, by a date determined by the Secretary,
				provide to the covered institution and to the Secretary the information
				included on the model format or an updated model format (if available) for each
				type of educational loan provided by the lender to students attending the
				covered institution, or the parents of such students, for the preceding
				academic year.</text>
						</subsection><subsection id="id85ADDFC05B9B4AEA961C6CBD13E8537C"><enum>(c)</enum><header>Covered
				institution duties</header><text>Each covered institution shall—</text>
							<paragraph id="idDF52A101DF884044A7963A0AB6F94751"><enum>(1)</enum><text>prepare and
				submit to the Secretary an annual report, by a date determined by the
				Secretary, that includes, for each lender that has an educational loan
				arrangement with the covered institution and that has submitted to the
				institution the information required under subsection (b)—</text>
								<subparagraph id="id4715ABFA4EA74CD2AC5AABD89458980B"><enum>(A)</enum><text>the information
				included on the model format or updated model format (if available) for each
				type of educational loan provided by the lender to students attending the
				covered institution, or the parents of such students; and</text>
								</subparagraph><subparagraph id="id1DD412B092FC4B1BA60293B69000D7BD"><enum>(B)</enum><text>a detailed
				explanation of why the covered institution believes the terms and conditions of
				each type of educational loan provided pursuant to the agreement are beneficial
				for students attending the covered institution, or the parents of such
				students; and</text>
								</subparagraph></paragraph><paragraph id="id685B996CE6F54F6FBE557F9F0DB69769"><enum>(2)</enum><text>ensure that the
				report required under paragraph (1) is made available to the public and
				provided to students attending or planning to attend the covered institution,
				and the parents of such students, in time for the student or parent to take
				such information into account before applying for or selecting an educational
				loan.</text>
							</paragraph></subsection></section><section id="idDD53C3773FF541FFB83843CA0083E90C"><enum>154.</enum><header>Private
				educational loan disclosure requirements for covered institutions</header><text display-inline="no-display-inline">A covered institution that provides
				information to any student, or the parent of such student, regarding a private
				educational loan from a lender shall, prior to or concurrent with such
				information—</text>
						<paragraph id="id2E506FA91BDB4838BE2EAF7C1C4D3934"><enum>(1)</enum><text>inform the
				student or parent of—</text>
							<subparagraph id="id0D5CCDBAD6C24030A95E337213DFB51A"><enum>(A)</enum><text>the student or
				parent's eligibility for assistance and loans under title IV; and</text>
							</subparagraph><subparagraph id="idD4A01A2D92DC478584A86F189611226B"><enum>(B)</enum><text>the terms and
				conditions of such private educational loan that are less favorable than the
				terms and conditions of educational loans for which the student or parent is
				eligible, including interest rates, repayment options, and loan forgiveness;
				and</text>
							</subparagraph></paragraph><paragraph id="id06F29BF496704D599145EC8C2BEC60B2"><enum>(2)</enum><text>ensure that
				information regarding such private educational loans is presented in such a
				manner as to be distinct from information regarding loans that are made,
				insured, or guaranteed under title IV.</text>
						</paragraph></section><section id="id15C7EBE91B284D2A8FF17EA5F7C354F9"><enum>155.</enum><header>Gift ban for
				employees of institutions</header>
						<subsection id="id0851A738889840F386D3B87C162DD4BF"><enum>(a)</enum><header>Gift
				ban</header><text>A lender or guarantor of educational loans shall not offer
				any gift to an employee or agent of a covered institution.</text>
						</subsection><subsection id="id6FFB1130F854421BB69471F011EC5EC8"><enum>(b)</enum><header>Reports of gift
				ban violations</header>
							<paragraph id="idB4D61F80D8214250BC031F48343AAAE9"><enum>(1)</enum><header>Employee
				report</header><text display-inline="yes-display-inline">Each employee or agent
				of a covered institution shall report to the Inspector General of the
				Department of Education any instance of a lender or guarantor of educational
				loans (including an agent of the lender or guarantor) that attempts to give a
				gift to the employee or agent in violation of subsection (a).</text>
							</paragraph><paragraph id="id520E68DD55724721B943FE2CE20DE4B8"><enum>(2)</enum><header>Inspector
				General report</header><text>The Inspector General of the Department of
				Education shall investigate any reported violation of this subsection and shall
				annually submit a report to the Committee on Health, Education, Labor, and
				Pensions of the Senate and the Committee on Education and Labor of the House of
				Representatives identifying all reported violations of the gift ban under
				subsection (a), including the lenders involved in each such violation, for the
				preceding year.</text>
							</paragraph></subsection><subsection id="ID6c7eccd51e2f4ddca9c674d15810f94c"><enum>(c)</enum><header>Definition of
				gift</header>
							<paragraph id="id747C02167F67436EAFF3AD6836434C1A"><enum>(1)</enum><header>In
				general</header><text>In this section, the term <term>gift</term> means any
				gratuity, favor, discount, entertainment, hospitality, loan, or other item
				having a monetary value of more than $10. The term includes a gift of services,
				transportation, lodging, or meals, whether provided in kind, by purchase of a
				ticket, payment in advance, or reimbursement after the expense has been
				incurred.</text>
							</paragraph><paragraph id="id37A5D5724A394BA08A3BA758289CA200"><enum>(2)</enum><header>Exceptions</header><text>The
				term <term>gift</term> shall not include any of the following:</text>
								<subparagraph id="id1D7C47830F474BA2B4EE2AE1C049DE91"><enum>(A)</enum><text>Standard
				informational material related to a loan, such as a brochure.</text>
								</subparagraph><subparagraph id="id601EA5ABEF7C4AF09905DEB8679B978A"><enum>(B)</enum><text>Food,
				refreshments, training, or informational material furnished to an employee or
				agent of an institution as an integral part of a training session or through
				participation in an advisory council that is designed to improve the lender's
				service to the covered institution, if such training or participation
				contributes to the professional development of the employee or agent of the
				institution.</text>
								</subparagraph><subparagraph id="id9FF8D783F6454F7D914131C289B504DB"><enum>(C)</enum><text>Favorable terms,
				conditions, and borrower benefits on an educational loan provided to a student
				employed by the covered institution.</text>
								</subparagraph></paragraph><paragraph id="ID8b4093f3f0854a42bc7574cce66c7ffc"><enum>(3)</enum><header>Rule for gifts
				to family members</header><text>For purposes of this section, a gift to a
				family member of an employee or an agent of a covered institution, or a gift to
				any other individual based on that individual’s relationship with the employee
				or agent, shall be considered a gift to the employee or agent if—</text>
								<subparagraph id="idAC86FF6BDAFD438394F61C29D6F7134E"><enum>(A)</enum><text>the gift is given
				with the knowledge and acquiescence of the employee or agent; and</text>
								</subparagraph><subparagraph id="idF2F1FC8031B14C96B23E0725C3E80FB4"><enum>(B)</enum><text>the employee or
				agent has reason to believe the gift was given because of the official position
				of the employee or agent.</text>
								</subparagraph></paragraph></subsection></section><section id="id9255D7D0DDE44ECDA490D5E91B98B8E2"><enum>156.</enum><header>Compliance and
				enforcement</header>
						<subsection id="idCB056A5D0EE6486CA8814EC0C23A932F"><enum>(a)</enum><header>Condition of
				any Federal assistance</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				a covered institution or lender shall comply with this part as a condition of
				receiving Federal funds or assistance provided after the date of enactment of
				the Student Loan Sunshine Act.</text>
						</subsection><subsection id="id93B1B66435134ADDB158599CD35209C0"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				if the Secretary determines, after providing notice and an opportunity for a
				hearing for a covered institution or lender, that the covered institution or
				lender has violated subsection (a)—</text>
							<paragraph id="IDcd4df98f9ab54e2ca3b0f6317407ada0"><enum>(1)</enum><text>in the case of a
				covered institution, or a lender that does not participate in a loan program
				under title IV, the Secretary may impose a civil penalty in an amount of not
				more than $25,000; and</text>
							</paragraph><paragraph id="IDa8b99a06f8944bd29aef3cbfa0e498cc"><enum>(2)</enum><text>in the case of a
				lender that does participate in a program under title IV, the Secretary may
				limit, terminate or suspend the lender’s participation in such program.</text>
							</paragraph></subsection><subsection id="IDf05be64951fe44ecab07a60792b053a0"><enum>(c)</enum><header>Considerations</header><text>In
				taking any action against a covered institution or lender under subsection (b),
				the Secretary shall take into consideration the nature and severity of the
				violation of subsection (a).</text>
						</subsection></section><section id="idFF7E73DA3B77473BA536C70C9B4F2F49"><enum>157.</enum><header>GAO study and
				reports</header>
						<subsection id="idE9DEC73A100949E784B366EF975A30E4"><enum>(a)</enum><header>Study</header><text>The
				Comptroller General of the United States shall conduct a study on—</text>
							<paragraph id="idE80A247079834CF99AD5AC0390251B25"><enum>(1)</enum><text>the gifts or
				financial or other material benefits that are provided by lenders to covered
				institutions to secure, or as part of an effort to secure, the covered
				institutions' educational loan business;</text>
							</paragraph><paragraph id="id60858C5F523248E3A7FDA83BBF18C0AC"><enum>(2)</enum><text>the extent to
				which lenders issuing private educational loans may be inappropriately using
				inducements to secure, or as part of an effort to secure, educational loan
				arrangements with covered institutions; and</text>
							</paragraph><paragraph id="idD8EC7CFE9BFD4816BBE29345367D3067"><enum>(3)</enum><text>whether
				educational loans made to students attending a covered institution in
				connection with an educational loan arrangement, and private educational loans
				made directly to students, provide competitive interest rates, terms, and
				conditions to students who obtain such loans.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id612288D781144A2D8E6CC575CACAD959"><enum>(b)</enum><header>Reports</header><text>The
				Comptroller General of the United States shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id427D45D9DCFE40DD8988C9A6D09860E0"><enum>(1)</enum><text>not later than 1
				year after the date of enactment of the Student Loan Sunshine Act, submit to
				Congress a preliminary report regarding the findings of the study described in
				subsection (a); and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EB8FFC9E2FD461EA2CFCAB0E002B5B5"><enum>(2)</enum><text>not later than 2
				years after such date of enactment, submit to Congress a final report regarding
				such
				findings.</text>
							</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id475891D7C5EF42D3981BA34A2B751D76"><enum>3.</enum><header>Program
			 participation agreements</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act
			 of 1965 (20 U.S.C. 1094(a)) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idB68E0235C3D04B53A711A65021DC81AD" style="OLC">
				<paragraph id="id9587D02DE90B4EB7A22FE8E234EBF5F9"><enum>(24)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3575091D1DEC44F18824AC344B3F3F8D"><enum>(A)</enum><text>In the case of an
				institution (including an employee or agent of an institution) that maintains a
				preferred lender list, in print or any other medium, through which the
				institution recommends 1 or more specific lenders for loans made under part B
				to the students attending the institution (or the parents of such students),
				the institution will—</text>
						<clause id="idD2DBD650A8654918827B96D2D157925C" indent="up1"><enum>(i)</enum><text>clearly and fully disclose on the
				preferred lender list—</text>
							<subclause id="idCEF65BAF3144401E879E2F7280651410"><enum>(I)</enum><text>why the institution has included each
				lender as a preferred lender, especially with respect to terms and conditions
				favorable to the borrower; and</text>
							</subclause><subclause id="ID64538e6397274ea79747017cd50c1477"><enum>(II)</enum><text>that the students attending the
				institution (or the parents of such students) do not have to borrow from a
				lender on the preferred lender list;</text>
							</subclause></clause><clause id="IDfee56a6e279b4a7a989f0757f5a30c5b" indent="up1"><enum>(ii)</enum><text>ensure, through the use of the
				list provided by the Secretary under subparagraph (C), that—</text>
							<subclause id="idDCE295EDF53E4CE99C1529EA48FCFB3C"><enum>(I)</enum><text>there are not less than 3 lenders named
				on the preferred lending list that are not affiliates of each other; and</text>
							</subclause><subclause id="idCCE381A4A7B14D3D9EEBF10A93D475F1"><enum>(II)</enum><text>the preferred lender list—</text>
								<item id="id069F5E7D4CEA45F6B0A832F176535B91"><enum>(aa)</enum><text>specifically indicates, for each
				lender on the list, whether the lender is or is not an affiliate of each other
				lender on the list; and</text>
								</item><item id="id2C331565AE5C4674B319A15F7EF44367"><enum>(bb)</enum><text>if the lender is an affiliate of
				another lender on the list, describes the specifics of such affiliation;
				and</text>
								</item></subclause></clause><clause id="id16CBC84CFD564079B3D493930D7737AF" indent="up1"><enum>(iii)</enum><text>establish a process to ensure
				that lenders are placed upon the preferred lender list on the basis of the
				benefits provided to borrowers, including —</text>
							<subclause id="idDAC3785C0DA643CFA94296991EF1ED60"><enum>(I)</enum><text>highly competitive interest rates, terms,
				or conditions for loans made under part B;</text>
							</subclause><subclause id="id4CC788057F9949009ED2416ADCB46029"><enum>(II)</enum><text>high-quality servicing for such loans;
				or</text>
							</subclause><subclause id="idF56B65D6192449A1900A6C9D35F14729"><enum>(III)</enum><text>additional benefits beyond the standard
				terms and conditions for such loans.</text>
							</subclause></clause></subparagraph><subparagraph id="id2D509166D83142BAA31DFAF2FD8C2C15" indent="up1"><enum>(B)</enum><text>For the purposes of subparagraph
				(A)(ii)—</text>
						<clause id="id051568640F21423A97CE7D8CF158EB7C"><enum>(i)</enum><text>the term <quote>affiliate</quote>
				means a person that controls, is controlled by, or is under common control with
				another person; and</text>
						</clause><clause id="id677B86F951FB4B229B1A0093F4334999"><enum>(ii)</enum><text>a person has control over another
				person if—</text>
							<subclause id="idE06B1679B2444F2DB6E3FF33AC2EC113"><enum>(I)</enum><text>the person directly or indirectly, or
				acting through 1 or more others, owns, controls, or has the power to vote 5
				percent or more of any class of voting securities of such other person;</text>
							</subclause><subclause id="id77E525A964DA47E797E00086CEB925A4"><enum>(II)</enum><text>the person controls, in any manner, the
				election of a majority of the directors or trustees of such other person;
				or</text>
							</subclause><subclause id="id5ADB15A9FE474F6581753B191292ECF2"><enum>(III)</enum><text>the Secretary determines (after notice
				and opportunity for a hearing) that the person directly or indirectly exercises
				a controlling interest over the management or policies of such other
				person.</text>
							</subclause></clause></subparagraph><subparagraph id="id2606F685182047A2BC48A0BB34C8FDB4" indent="up1"><enum>(C)</enum><text>The Secretary shall maintain and
				update a list of lender affiliates of all eligible lenders, and shall provide
				such list to the eligible institutions for use in carrying out subparagraph
				(A).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idC6DF30F36FCA432C9CA90B973BB350A7"><enum>4.</enum><header>Notice of
			 availability of funds from Federal sources</header><text display-inline="no-display-inline">Section 128 of the Truth in Lending Act (15
			 U.S.C. 1638) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE1A6F2FE045C494AB988F59E80421E55" style="OLC">
				<subsection id="id97C7D8BA1779423EA908F1920FB701B9"><enum>(e)</enum><header>Disclosures
				relating to private educational loans</header>
					<paragraph id="idD626CDAB78B947FAAEBF2FDEC4B257A1"><enum>(1)</enum><header>In
				general</header><text>In the case of an extension of credit that is a private
				educational loan, other than a residential mortgage transaction, the creditor
				shall provide in every application for such extensions of credit and together
				with any solicitation, marketing, or advertisement of such extensions of
				credit, written, electronic, or otherwise, the disclosures described in
				paragraph (2).</text>
					</paragraph><paragraph id="id5F186E1E3C42463CA5EE26900EACE6D1"><enum>(2)</enum><header>Disclosures</header><text>Disclosures
				required by this subsection shall include a clear and prominent
				statement—</text>
						<subparagraph id="id470F458A7C544D5AA208A592FFC120BF"><enum>(A)</enum><text>that the borrower
				may qualify for Federal financial assistance through a program under title IV
				of the Higher Education Act of 1965, in lieu of or in addition to a loan from a
				non-Federal source;</text>
						</subparagraph><subparagraph id="idAC49C5B53BED457A8F57110522F64E87"><enum>(B)</enum><text>of the interest
				rates available with respect to such Federal financial assistance;</text>
						</subparagraph><subparagraph id="id4FE015C5AD9E4381B84E9A1AB730880A"><enum>(C)</enum><text>describing how
				the applicable interest rate is determined, including whether it is based on
				the credit score of the borrower;</text>
						</subparagraph><subparagraph id="id70F981F87D35452289F85A2306063B4F"><enum>(D)</enum><text>showing sample
				loan costs, disaggregated by type;</text>
						</subparagraph><subparagraph id="id0FE364F4949A4683816A982DDEC4EB50"><enum>(E)</enum><text>of the types of
				repayment plans that are available;</text>
						</subparagraph><subparagraph id="idD710ED4791874E309C9E60C77105CDBD"><enum>(F)</enum><text>of whether, and
				under what conditions, early repayment may be made without penalty;</text>
						</subparagraph><subparagraph id="idF810EADB7EC8486DB405E75D2ABA9721"><enum>(G)</enum><text>of when and how
				often the loan would be recapitalized;</text>
						</subparagraph><subparagraph id="idBEF6F121B77B42D2B3068B4AD894AB86"><enum>(H)</enum><text>describing all
				fees, deferments, or forbearance;</text>
						</subparagraph><subparagraph id="id8429A7DE87DD483582A10E9085E11AA1"><enum>(I)</enum><text>describing all
				available repayment benefits, and the percentage of all borrowers who qualify
				for such benefits;</text>
						</subparagraph><subparagraph id="idFED6C236FFF84488B9A97E480236E178"><enum>(J)</enum><text>describing
				collection practices in the case of default;</text>
						</subparagraph><subparagraph id="id1442ECB073C0413C8AE22DE97ACEA8B9"><enum>(K)</enum><text>describing late
				payment penalties and associated fees;</text>
						</subparagraph><subparagraph id="id7DB1C3EC11674B54BABBC379634B5608"><enum>(L)</enum><text>of any complaints
				(and their resolution) filed with any State or private consumer protection
				agency (including the Better Business Bureau); and</text>
						</subparagraph><subparagraph id="id03B92D648B684B1CB6C85E39BE5B0991"><enum>(M)</enum><text>such other
				information as the Board may require.</text>
						</subparagraph></paragraph><paragraph id="id6667111C59A84C8AA2FF413CA82E07CE"><enum>(3)</enum><header>Provision of
				information</header><text>Before a creditor may issue any funds with respect to
				an extension of credit described in paragraph (1) for an amount equal to more
				than $1,000—</text>
						<subparagraph id="idE4290E8C48C24C8882D0BDB6DA0CD93D"><enum>(A)</enum><text>the creditor
				shall notify the relevant postsecondary educational institution, in writing, of
				the proposed extension of credit and the amount thereof; and</text>
						</subparagraph><subparagraph id="id1A7F353EF3F94B99BE91B6B05210AB11"><enum>(B)</enum><text>if such relevant
				institution is a covered institution, the institution shall, in an expedient
				manner, notify the prospective borrower, in accordance with procedures
				established by rule of the Board, whether and to what extent the proposed
				extension of credit exceeds the cost of attendance (as defined in section 472
				of the Higher Education Act of 1965) for the student at that institution, after
				consideration of the Federal and State grant and loan aid and institutional aid
				that the student has or is eligible to receive.</text>
						</subparagraph></paragraph><paragraph id="idB0BE79DC3ADE4D2AB4C8515C038C718C"><enum>(4)</enum><header>Regulatory
				authority</header><text>The Board—</text>
						<subparagraph id="id2CF1CFDE49424F108FC230B35953788D"><enum>(A)</enum><text>shall issue such
				rules and regulations as may be necessary to implement this subsection;
				and</text>
						</subparagraph><subparagraph id="idC3B2354E5A50403ABDB9BF646A30A33D"><enum>(B)</enum><text>may, by rule,
				establish appropriate exceptions to the disclosures required by this
				subsection.</text>
						</subparagraph></paragraph><paragraph commented="no" id="id4EC7DC5B890B431C9EF243AFA4FC90AE"><enum>(5)</enum><header>Definitions</header><text>As
				used in this subsection, the terms <term>private educational loan</term> and
				<term>covered institution</term> have the same meanings as in section 151 of
				the Higher Education Act of
				1965.</text>
