		<section id="idD8354C900F7D44B5A1138BF066F2AD9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tribal Colleges and Universities
			 Faculty Loan Forgiveness Act</short-title></quote>.</text>
		</section><section id="ID33DBA9FD80234AABA79E3DCAF242D9E8"><enum>2.</enum><header>Loan repayment
			 or cancellation for individuals who teach in Tribal Colleges or
			 Universities</header>
			<subsection id="ID230714DAD9E7461684B2EBA69CE2D586"><enum>(a)</enum><header>Perkins
			 Loans</header>
				<paragraph id="IDB25CF3B8AD944DCEB7D0A6A44E67FFFD"><enum>(1)</enum><header>Amendment</header><text>Section
			 465(a) of the <act-name parsable-cite="HEA65">Higher Education Act of
			 1965</act-name> (20 U.S.C. 1087ee(a)) is amended—</text>
					<subparagraph id="IDB866149B22F84A2A9688F7F86E25711C"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="ID48E862BBBAF84AB9AF30A44BDADDF5F5"><enum>(i)</enum><text>in
			 subparagraph (H), by striking <quote>or</quote> after the semicolon;</text>
						</clause><clause id="ID62E7A55D3270451B9092DDE762E4E861"><enum>(ii)</enum><text>in
			 subparagraph (I), by striking the period and inserting <quote>; or</quote>;
			 and</text>
						</clause><clause id="IDE066E483D8EC470DAFBFA9E5FEFC0BA0"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
							<quoted-block id="IDD8B2A906461945878B7C9652E50063C1" style="OLC">
								<subparagraph id="ID71A61FB6AF8F44E48495885B32959ECC" indent="up1"><enum>(J)</enum><text>as a full-time faculty member at a
				Tribal College or University as defined in section
				316(b).</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="ID86728A98ED7D4BF7BCDC05DD1DD7C338"><enum>(B)</enum><text>in paragraph
			 (3)(A)(i), by striking <quote>or (I)</quote> and inserting <quote>(I), or
			 (J)</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDD4608AC3D12342BE823E1F7D34B6037C"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall be effective for
			 service performed during academic year 2005–2006 and succeeding academic years,
			 notwithstanding any contrary provision of the promissory note under which a
			 loan under part E of title IV of the <act-name parsable-cite="HEA65">Higher
			 Education Act of 1965</act-name> (20 U.S.C. 1087aa et seq.) was made.</text>
				</paragraph></subsection><subsection id="ID240089A43F1E447983672B0D3ABE4B47"><enum>(b)</enum><header>FFEL and Direct
			 Loans</header><text>Part G of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20 U.S.C. 1088
			 et seq.) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" id="ID959EFC7E280A4D4D86157C8029ADFAAA" style="OLC">
					<section id="ID428EBD1748DE4AFBB95B08777E7454C3"><enum>493C.</enum><header>Loan
				repayment or cancellation for individuals who teach in Tribal Colleges or
				Universities</header>
						<subsection id="IDEA62974206694D66BAA7FEA1A332D884"><enum>(a)</enum><header>Program
				Authorized</header><text>The Secretary shall carry out a program, through the
				holder of a loan, of assuming or canceling the obligation to repay a qualified
				loan amount, in accordance with subsection (b), for any new borrower on or
				after the date of enactment of the Tribal Colleges and Universities Faculty
				Loan Forgiveness Act, who—</text>
							<paragraph id="ID8F0BAED9507B457E9A559E0FAF084CA1"><enum>(1)</enum><text>has been employed
				as a full-time faculty member at a Tribal College or University as defined in
				section 316(b); and</text>
							</paragraph><paragraph id="IDD6A66219F6014E50B72480B63C0F5E11"><enum>(2)</enum><text>is not in default
				on a loan for which the borrower seeks repayment or cancellation.</text>
							</paragraph></subsection><subsection id="ID69CE18A27EAA47B185569D0AE4BF777A"><enum>(b)</enum><header>Qualified Loan
				Amounts</header>
							<paragraph id="ID170378A2A88F4336B598034E40E35342"><enum>(1)</enum><header>Percentages</header><text>Subject
				to paragraph (2), the Secretary shall assume or cancel the obligation to repay
				under this section—</text>
								<subparagraph id="ID4425AE8045DE4ED19A8FE49D424896B1"><enum>(A)</enum><text>15 percent of the
				amount of all loans made, insured, or guaranteed after the date of enactment of
				the Tribal Colleges and Universities Faculty Loan Forgiveness Act to a student
				under part B or D, for the first or second year of employment described in
				subsection (a)(1);</text>
								</subparagraph><subparagraph id="ID0D8DD8FCC1AD4ACA8E0A1BAE7CBA05A5"><enum>(B)</enum><text>20 percent of
				such total amount, for the third or fourth year of such employment; and</text>
								</subparagraph><subparagraph id="IDFC61D6CADBA04C66BB385FD4E1669136"><enum>(C)</enum><text>30 percent of
				such total amount, for the fifth year of such employment.</text>
								</subparagraph></paragraph><paragraph id="IDB88D6BED24414E6DB3C2C25D8D38C2DA"><enum>(2)</enum><header>Maximum</header><text>The
				Secretary shall not repay or cancel under this section more than $15,000 in the
				aggregate of loans made, insured, or guaranteed under parts B and D for any
				student.</text>
							</paragraph><paragraph id="ID11BFD267CBCE453CAD15E877D87F0E59"><enum>(3)</enum><header>Treatment of
				consolidation loans</header><text>A loan amount for a loan made under section
				428C may be a qualified loan amount for the purposes of this subsection only to
				the extent that such loan amount was used to repay a loan made, insured, or
				guaranteed under part B or D for a borrower who meets the requirements of
				subsection (a), as determined in accordance with regulations prescribed by the
				Secretary.</text>
							</paragraph></subsection><subsection id="ID0DF6B46E7F7A46DAAA50A6E2CBE7713B"><enum>(c)</enum><header>Regulations</header><text>The
				Secretary is authorized to issue such regulations as may be necessary to carry
				out the provisions of this section.</text>
						</subsection><subsection id="IDB8C81461A9784AF9827FCC6F424224F6"><enum>(d)</enum><header>Effect on
				Section</header><text>Nothing in this section shall be construed to authorize
				any refunding of any repayment of a loan.</text>
						</subsection><subsection id="IDF39E4D1177864CC99B11DF31FCA63178"><enum>(e)</enum><header>Prevention of
				Double Benefits</header><text>No borrower may, for the same service, receive a
				benefit under both this section and subtitle D of title I of the National and
				Community Service Act of 1990 (42 U.S.C. 12601 et seq.).</text>
						</subsection><subsection id="ID19291C61B7B342278F47F810CF1F8BA2"><enum>(f)</enum><header>Definition</header><text>For
				purposes of this section, the term <term>year</term>, when applied to
				employment as a faculty member, means an academic year as defined by the
				Secretary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID21F0A8949A84491DBEDEAE6200A4D92B"><enum>3.</enum><header>Loan repayment
			 for nursing instructors at Tribal Colleges or Universities</header><text display-inline="no-display-inline">Section 846(a)(3) of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 297n(a)(3)) is amended—</text>
			<paragraph id="IDE0D5925B5E674507B93CCD4F35D62F42"><enum>(1)</enum><text>by striking
			 <quote>(3)</quote> and inserting <quote>(3)(A)</quote>;</text>
			</paragraph><paragraph id="ID32CD26E43D6F439C8DF42470C31F3065"><enum>(2)</enum><text>by inserting
			 <quote>or</quote> after the semicolon; and</text>
			</paragraph><paragraph id="ID8AB8455534934388BAAE3E8B0AB89943"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="IDC603BCDFBD9D4587B5DF01540E71A8F3" style="OLC">
					<subparagraph id="ID32B00779E0E04CD9B3B41727E0FFA852" indent="up1"><enum>(B)</enum><text>who is a nursing instructor at a
				tribally controlled college or university (as such term is defined in section 2
				of the Tribally Controlled College or University Assistance Act of 1978 (25
				U.S.C. 1801), or any institution listed in section 532 of the Equity in
				Educational Land-Grant Status Act of 1994 (7 U.S.C. 301
				note));</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID0B09EC7536BE43299A3AAE97D9C7ED08"><enum>4.</enum><header>Amounts forgiven
			 not treated as gross income</header><text display-inline="no-display-inline">The amount of any loan that is assumed or
			 canceled under an amendment made by this Act shall not, consistent with section
			 108(f) of the Internal Revenue Code of 1986, be treated as gross income for
			 Federal income tax purposes.</text>
