			<section commented="no" display-inline="no-display-inline" id="IDc7f56cbda16746388b11326d2190428a" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Specified unlawful activity</header><text display-inline="no-display-inline">Section 1956(c)(7) of title 18, United
			 States Code, is amended to read as follows:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="idEB93AC13BA8A4F388E023AD3B198DB22" style="USC">
					<paragraph commented="no" display-inline="no-display-inline" id="id3CFB4328B67C43A39F38AE6A1EE031E7"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>specified unlawful
				activity</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID3e47490bfc934f62b00664707d617132"><enum>(A)</enum><text display-inline="yes-display-inline">any act or activity constituting an offense
				in violation of the laws of the United States or any State punishable by
				imprisonment for a term exceeding 1 year; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0346a65851334674b6680137dd3970b2"><enum>(B)</enum><text display-inline="yes-display-inline">any act or activity occurring outside of
				the United States that would constitute an offense covered under subparagraph
				(A) if the act or activity had occurred within the jurisdiction of the United
				States or any
				State;</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id3C6DE551DAE04FE088157A26A1BD227F" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Making the domestic money laundering
			 statute apply to <quote>reverse money laundering</quote> and interstate
			 transportation</header>
				<subsection commented="no" display-inline="no-display-inline" id="id1087E2435E944ECEB30EFBDE28081F7B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1957 of title 18, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idC7C52E8B041048D0A63491638461A2BA"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting
			 <quote><header-in-text level="section" style="USC">or in support of criminal
			 activity</header-in-text></quote> after <quote><header-in-text level="section" style="USC">specified unlawful activity</header-in-text></quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID717398d2122a4907852cf3546402322b"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>Whoever</quote> and inserting the following:</text>

				any of the circumstances set forth in subsection (d)—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD684CCBC875A4875A41C6167C4046DE7"><enum>(i)</enum><text display-inline="yes-display-inline">conducts or attempts to conduct a monetary
				transaction involving property of a value that is greater than $10,000;
				or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id98446AC926C34260B378BE983CB6675A"><enum>(ii)</enum><text display-inline="yes-display-inline">transports, attempts to transport, or
				conspires to transport property of a value that is greater than $10,000;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id932F2E2FA70146B08B24D9A312AA640D"><enum>(B)</enum><text display-inline="yes-display-inline">in
				or affecting interstate commerce; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBC8B0476A204ECC83424013FDA9F3EF"><enum>(C)</enum><text display-inline="yes-display-inline">either—</text>
									<clause commented="no" display-inline="no-display-inline" id="id3EDBF8EF55334D3BA88711E27B4ACF10"><enum>(i)</enum><text display-inline="yes-display-inline">knowing that the property was derived from
				some form of unlawful activity; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id6B48B93DC50646BE9D071B361FC05411"><enum>(ii)</enum><text display-inline="yes-display-inline">with the intent to promote the carrying on
				of specified unlawful activity;</text>
									</clause></subparagraph><continuation-text commented="no" continuation-text-level="paragraph" indent="subsection">shall be fined under this title, imprisoned for a
				term of years not to exceed the statutory maximum for the unlawful activity
				from which the property was derived or the unlawful activity being promoted, or
				both.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5AB58A880A614DA5974C700E1645DB05"><enum>(b)</enum><header display-inline="yes-display-inline">Chapter Analysis</header><text display-inline="yes-display-inline">The item relating to section 1957 in the
			 table of sections for chapter 95 of title 18, United States Code, is amended to
			 read as follows:</text>

			 laundering cases</header>
				<subsection commented="no" display-inline="no-display-inline" id="id50E8E9A470904E3C98898F34AF5DE8AA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 986 of title 18, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="id3D4D7D08C99B4730B9A15DF98896B858" style="USC">
						<subsection commented="no" display-inline="no-display-inline" id="ID3c006b9a1b2243358fedad14c1f38353"><enum>(e)</enum><header display-inline="yes-display-inline">Procedure for Issuing
				Subpoenas</header><text display-inline="yes-display-inline">The Attorney
				General, the Secretary of the Treasury, or the Secretary of Homeland Security
				may issue a subpoena in any investigation of a violation of sections 1956, 1957
				or 1960, or sections 5316, 5324, 5331 or 5332 of title 31, United States Code,
				in the manner set forth under section
				3486.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDaa2c307491a6484a9449b07176ae7550"><enum>(b)</enum><header display-inline="yes-display-inline">Grand jury and trial
			 subpoenas</header><text display-inline="yes-display-inline">Section
			 5318(k)(3)(A)(i) of title 31, United States Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD3195AF5AF5044668F881422F02B95B8"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>related to such
			 correspondent account</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1AF98DE370884280AC7C21723E32A97F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>or the Attorney
			 General</quote> and inserting <quote>, the Attorney General, or the Secretary
			 of Homeland Security</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc0d49f545a5a4345a35029476912318e"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

			 amendment</header><text display-inline="yes-display-inline">Section 604(a)(1)
			 of the Fair Credit Reporting Act (15 U.S.C. 1681b(a)(1)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idAAAB83066AED48089FFD45415D0D1383"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id052F63306F2A40E99F082A417960D09F"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before the period the

			 act</header><text display-inline="yes-display-inline">Section 1120 of the Right
			 to Financial Privacy Act of 1978 (12 U.S.C. 3420) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID4c7f2659d4d34b12a989a2d6acdc2a94"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by inserting
			 <quote>or to the Government</quote> after <quote>to the grand jury</quote>;
			 and</text>

			 checks in bearer form</header><text display-inline="no-display-inline">Section
			 5316 of title 31, United States Code, is amended by adding at the end the
			 following:</text>

					<subsection commented="no" display-inline="no-display-inline" id="IDd4641c79806b4ebbb407ed3b50c096a2"><enum>(e)</enum><header display-inline="yes-display-inline">Monetary instruments with amount left
				blank</header><text display-inline="yes-display-inline">For purposes of this
				section, a monetary instrument in bearer form that has the amount left blank,
				such that the amount could be filled in by the bearer, shall be considered to
				have a value equal to the highest value of the funds in the account on which
				the monetary instrument is drawn during the time period the monetary instrument
				was being transported or the time period it was negotiated or was intended to
				be
				negotiated.</text>

			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idA369CF91DC414EE1800C43400584141E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking <quote>5
			 years</quote> and inserting <quote>10 years</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa9a498f2a724e3782f8ead5bd4819f3"><enum>(2)</enum><text display-inline="yes-display-inline">by adding the end the following:</text>

			 structured transactions</header><text display-inline="no-display-inline">Section 1957(f) of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id9043FBDD611341C4BEA75B6F17649568"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB1B6BAA3EFB9421A9A30052D7FAB5BAD"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period
			 and inserting a semicolon; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCD6D2BEB9FA1403C918F368E43B0A69B"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="id93B69C7C795248F1A5C3655563EB42F3" style="USC">
						<paragraph commented="no" display-inline="no-display-inline" id="IDded93f3b3adc4a548baa458ac932f57d"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>monetary transaction in
				criminally derived property that is of a value greater than $10,000</term>
				includes—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID66352e07fcbf49499b59959cb2d9fd38"><enum>(A)</enum><text display-inline="yes-display-inline">a monetary transaction involving the
				transfer, withdrawal, encumbrance or other disposition of more than $10,000
				from a bank account in which more than $10,000 in proceeds of specified
				unlawful activity have been commingled with other funds;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6971943ebb3b40fa8241e74370b83154"><enum>(B)</enum><text display-inline="yes-display-inline">a series of monetary transactions in
				amounts under $10,000 that exceed $10,000 in the aggregate and that are closely
				related to each other in terms of such factors as time, the identity of the
				parties involved, the nature and purpose of the transactions, and the manner in
				which they are conducted; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9a20405d80fe4316b626cd9db4c8aad6"><enum>(C)</enum><text display-inline="yes-display-inline">any financial transaction covered under
				section 1956(j) that involves more than $10,000 in proceeds of specified
				unlawful activity; and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7727350bed7741faa68d99b19a28b932"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>monetary transaction
				involving property of a value that is greater than $10,000</term> includes a
				series of monetary transactions in amounts under $10,000 that exceed $10,000 in
				the aggregate and that are closely related to each other in terms of such
				factors as time, the identity of the parties involved, the nature and purpose
				of the transactions, and the manner in which they are
				conducted.</text>

				<subsection commented="no" display-inline="no-display-inline" id="IDbc88ec0395ba412988fd28b0733b666e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1956 of title 18, United States
			 Code, is amended by adding at the end the following:</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idA23CDF42220846BBA9501B505D6A108E" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Use of proceeds derived from criminal
			 investigations</header>
				<subsection commented="no" display-inline="no-display-inline" id="idB27B0B8D802B4A17A9CEF11C6AF37485"><enum>(a)</enum><header display-inline="yes-display-inline">Authority of Secret Service</header><text display-inline="yes-display-inline">During fiscal years 2008 through 2010, with
			 respect to any undercover investigative operation of the United States Secret
			 Service (in this section referred to as the <quote>Secret Service</quote>)
			 which is necessary for the detection and prosecution of crimes against the
			 United States—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idFF18A644E6DA4F35BA3D9CA84D2337B9"><enum>(1)</enum><text display-inline="yes-display-inline">sums authorized in any such fiscal year to
			 be appropriated for the Secret Service, including any unobligated balances
			 available from prior fiscal years, may be used to purchase property, buildings,
			 and other facilities, and to lease space, within the United States, the
			 District of Columbia, and the territories and possessions of the United States,
			 without regard to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC8677B65B9224781A80FF157958958FC"><enum>(A)</enum><text display-inline="yes-display-inline">sections 1341 and 3324 of title 31 of the
			 United States Code;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id716F6396A0DA4B26B36EBB2901114CEA"><enum>(B)</enum><text display-inline="yes-display-inline">section 8141 of title 40 of the United
			 States Code;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3168E7D893304FD1A1EE1290B51C45C8"><enum>(C)</enum><text display-inline="yes-display-inline">sections 3732(a) and 3741 of the Revised
			 Statutes of the United States (41 U.S.C. 11(a) and 22); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF7FAD6380072479889AE2ABEB9AC3DA7"><enum>(D)</enum><text display-inline="yes-display-inline">sections 304(a) and 305 of the Federal
			 Property and Administrative Services Act of 1949 (41 U.S.C. 254(a) and
			 255);</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49822F7C77E04E38B43780BBB1AF494D"><enum>(2)</enum><text display-inline="yes-display-inline">sums authorized in any such fiscal year to
			 be appropriated for the Secret Service, including any unobligated balances
			 available from prior fiscal years, may be used—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id15728E567D56454DB8A4CB7C9318057C"><enum>(A)</enum><text display-inline="yes-display-inline">to establish or to acquire proprietary
			 corporations or business entities as part of an undercover investigative
			 operation; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD99CE432F8074181AFD02277089F8830"><enum>(B)</enum><text display-inline="yes-display-inline">to operate such corporations or business
			 entities on a commercial basis, without regard to sections 9102 and 9103 of
			 title 31 of the United States Code;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFDD486FD3444DD280E8C80ACDAF9541"><enum>(3)</enum><text display-inline="yes-display-inline">sums authorized in any such fiscal year to
			 be appropriated for the Secret Service, including any unobligated balances
			 available from prior fiscal years, and the proceeds seized, earned, or
			 otherwise accrued from any such undercover investigative operation, may be
			 deposited in banks or other financial institutions, without regard to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idB10A57C367834D408CD46E3005C3E08E"><enum>(A)</enum><text display-inline="yes-display-inline">section 648 of title 18 of the United
			 States Code; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F77DF1348A6434B8C00244CB30A3D91"><enum>(B)</enum><text display-inline="yes-display-inline">section 3302 of title 31 of the United
			 States Code; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF3BCF87269D440CA4C1C8FA47EA222F"><enum>(4)</enum><text display-inline="yes-display-inline">proceeds seized, earned, or otherwise
			 accrued from any such undercover investigative operation may be used to offset
			 the necessary and reasonable expenses incurred in such operation, without
			 regard to section 3302 of title 31 of the United States Code.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCEDA8F5337B642E8937287156AE86BA9"><enum>(b)</enum><header display-inline="yes-display-inline">Written certification of Director
			 required</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id81911C7FBFF34723975EFA3A46FB3996"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authority granted under subsection (a)
			 may be exercised only upon the written certification of the Director of the
			 Secret Service or the Director's designee.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0EADD831FC64175871A5C4883A41542"><enum>(2)</enum><header display-inline="yes-display-inline">Content of certification</header><text display-inline="yes-display-inline">Each certification issued under paragraph
			 (1) shall state that any action authorized under paragraph (1), (2), (3), or
			 (4) of subsection (a) is necessary to conduct the undercover investigative
			 operation.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7E7E3EE09E474DCCB76D7B700A083333"><enum>(3)</enum><header display-inline="yes-display-inline">Duration of certification</header><text display-inline="yes-display-inline">Each certification issued under paragraph
			 (1) shall continue in effect for the duration of the undercover investigative
			 operation, without regard to fiscal years.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB6B4F55C79D1460EBAA81832969DA0E9"><enum>(c)</enum><header display-inline="yes-display-inline">Transfer of proceeds to
			 Treasury</header><text display-inline="yes-display-inline">As soon as
			 practicable after the proceeds from an undercover investigative operation with
			 respect to which an action is authorized and carried out under paragraphs (3)
			 and (4) of subsection (a) are no longer necessary for the conduct of such
			 operation, such proceeds, or the balance of such proceeds, remaining at the
			 time shall be deposited in the Treasury of the United States as miscellaneous
			 receipts.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id313CAB8830CF430E8BDD71E99577DBE5"><enum>(d)</enum><header display-inline="yes-display-inline">Corporations with a high net value</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id7B083853E13B43E5905F60F847B03588"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a corporation or business entity
			 established or acquired as part of an undercover investigative operation under
			 subsection (a)(2) having a net value of over $50,000 is to be liquidated, sold,
			 or otherwise disposed of, the Secret Service, as much in advance as the
			 Director of the Secret Service or the Director's designee determines is
			 practicable, shall report the circumstances of such liquidation, sale, or other
			 disposition to the Secretary of Homeland Security.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id116CC0E0DE544EF79AEDE3FFCD23D855"><enum>(2)</enum><header display-inline="yes-display-inline">Transfer of proceeds to
			 Treasury</header><text display-inline="yes-display-inline">The proceeds of any
			 liquidation, sale, or other disposition of any corporation or business entity
			 under paragraph (1) shall, after all other obligations are met, be deposited in
			 the Treasury of the United States as miscellaneous receipts.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE47089FFE42D4F5C9F8741D6D29A8EE1"><enum>(e)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">The Secret Service shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id538D144785404F6792AD475A64B38A9C"><enum>(1)</enum><text display-inline="yes-display-inline">conduct, on a quarterly basis, a detailed
			 financial audit of each completed undercover investigative operation where a
			 written certification was issued pursuant to this section; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB04D3CB4F7FB46BFB36AA90554859E4C"><enum>(2)</enum><text display-inline="yes-display-inline">report the results of each such audit in
			 writing to the Secretary of Homeland Security.</text>
					</paragraph></subsection></section></title><title commented="no" id="id40900C99111644408C7B9FDDE95B7A04" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Technical amendments</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID30229B44A69247EBA987D6AE66A0E88B"><enum>(a)</enum><header display-inline="yes-display-inline">Unlawful activity</header><text display-inline="yes-display-inline">Section 1956(c) of title 18, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD5D57DDE8DDE426BB8E901AAF6AB1E5E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote><term>conducts</term></quote> and inserting
			 <quote><term>conduct</term></quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE60E79BB9B0C466AB078D2CD76A2EA00"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (7)(F), by inserting <quote>,
			 as defined in section 24(a)</quote> before the semicolon.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC357B56C0D8344AE8ECFC39488BFE7C6"><enum>(b)</enum><header display-inline="yes-display-inline">Property from unlawful
			 activity</header><text display-inline="yes-display-inline">Section 1957 of
			 title 18, United States Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDB4028EF628E343E9BA5D002E4D8C6BF0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>engages or attempts to engage in</quote> and inserting <quote>conducts
			 or attempts to conduct</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2826443FECB64BE8B08F30CB7FE9BE6B"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idEABC03A73190402BA983E2AD6BDBC75B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>and</quote> at the end;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46CBDFD5EFB343BEB3E6BB79EF9C3442"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period
			 and inserting <quote>; and</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7DB3E0DE82F54A8AB20EE20A28A0569C"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
