		<official-title display="yes">To approve the settlement of the water
		  rights claims of the Shoshone-Paiute Tribes of the Duck Valley Reservation in
		  Nevada, to require the Secretary of the Interior to carry out the settlement,
		  and for other purposes.</official-title>

		<section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Shoshone-Paiute Tribes of Duck Valley
			 Water Rights Settlement Act</short-title></quote>.</text>
		</section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID9f3f940ee15348469cae2ef317abbcbc" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDfc475c0092cc419c9c3e00647d198682"><enum>(1)</enum><text display-inline="yes-display-inline">it is the policy of the United States, in
			 accordance with the trust responsibility of the United States to Indian tribes,
			 to promote Indian self-determination and economic self-sufficiency and to
			 settle Indian water rights claims without lengthy and costly litigation, if
			 practicable;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4ea4b393fbca4580b5b23990147bccd2"><enum>(2)</enum><text display-inline="yes-display-inline">quantifying rights to water and development
			 of facilities needed to use tribal water supplies is essential to the
			 development of viable Indian reservation economies and the establishment of a
			 permanent reservation homeland;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDff810da7ded744598a3ff6cdedad376c"><enum>(3)</enum><text display-inline="yes-display-inline">uncertainty concerning the extent of the
			 right to water of the Shoshone-Paiute Tribes has limited the access of the
			 Tribes to water and financial resources necessary to achieve self-determination
			 and self-sufficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id536BABF2DAEF481D9FAB2C0118C25F34"><enum>(4)</enum><text display-inline="yes-display-inline">in 2006, the Tribes, the State of Idaho,
			 the affected individual water users, and the United States resolved all tribal
			 claims to water rights in the Snake River Basin Adjudication through a consent
			 decree entered by the District Court of the Fifth Judicial District of the
			 State of Idaho, requiring no further Federal action to implement the Tribes’
			 water rights in the State of Idaho;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb586de6f8124c41a572d81644311244"><enum>(5)</enum><text display-inline="yes-display-inline">as of the date of enactment of this Act,
			 proceedings to determine the extent and nature of the water rights of the
			 Tribes are pending before the Nevada State Engineer;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID782af2c9cabe43f5bb57e1921cde49e4"><enum>(6)</enum><text display-inline="yes-display-inline">final resolution through litigation of the
			 water claims of the Tribes will—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id0DFDE864E5EE4482AC785AD3ACCB8701"><enum>(A)</enum><text display-inline="yes-display-inline">take many years;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C0412628ADB4293B4871D78D5CD4D5B"><enum>(B)</enum><text display-inline="yes-display-inline">entail great expense;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DD86A96CB5D479EA55F6CFE81CE3AC2"><enum>(C)</enum><text display-inline="yes-display-inline">continue to limit the access of the Tribes
			 to water, with economic and social consequences;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id04A719336EB64E11AF3187DAFDEA001D"><enum>(D)</enum><text display-inline="yes-display-inline">prolong uncertainty relating to the
			 availability of water supplies; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id637DFB2682C04EED9ECE48CFAECDC3B1"><enum>(E)</enum><text display-inline="yes-display-inline">seriously impair long-term economic
			 planning and development for all parties to the litigation;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75f4858dea4b43baae6a908753231063"><enum>(7)</enum><text display-inline="yes-display-inline">after many years of negotiation, the United
			 States, the Tribes, the State, and the upstream water users have entered into a
			 settlement agreement to resolve permanently all water rights of the Tribes in
			 the State; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3E309A7935045639D199A6CBF75696C"><enum>(8)</enum><text display-inline="yes-display-inline">the Tribes have certain water-related
			 claims for damages against the United States.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID6679c6da9b0749a3bc8e7a8ee4b8ee32" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDe0793553277d4adbaf205b3a145f299c"><enum>(1)</enum><text display-inline="yes-display-inline">to resolve outstanding issues with respect
			 to the East Fork of the Owyhee River in the State in such a manner as to
			 provide important benefits to—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id2A81848ED90E4A038824D2D8BFE135B5"><enum>(A)</enum><text display-inline="yes-display-inline">the United States;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id232CD15232C34E8C85D427F7D2D5933B"><enum>(B)</enum><text display-inline="yes-display-inline">the State;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE7AF2CAB41CC4C408BE6141A8CC20C4C"><enum>(C)</enum><text display-inline="yes-display-inline">the Tribes; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D8446BE79694438AC4EFACFC45E9D1C"><enum>(D)</enum><text display-inline="yes-display-inline">the upstream water users;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0d6ecf06f3c749c4ab8b8986476fd4eb"><enum>(2)</enum><text display-inline="yes-display-inline">to achieve a fair, equitable, and final
			 settlement of all claims of the Tribes, members of the Tribes, and the United
			 States on behalf of the Tribes to the East Fork of the Owyhee River in the
			 State;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52a3d51b15b048c6a8d577ffc4e8fed4"><enum>(3)</enum><text display-inline="yes-display-inline">to ratify and provide for the enforcement
			 of the Agreement among the parties to the litigation;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CD45A2499E745128CE0FF68BCE0C2C7"><enum>(4)</enum><text display-inline="yes-display-inline">to resolve the Tribes' water-related claims
			 for damages against the United States;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4491b89caa1344c1bd6c2acc50e12d6b"><enum>(5)</enum><text display-inline="yes-display-inline">to require the Secretary to perform all
			 obligations of the Secretary under the Agreement and this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5db4ebb73e6a466cb96b7084e5b42387"><enum>(6)</enum><text display-inline="yes-display-inline">to authorize the actions and appropriations
			 necessary for the United States to meet the obligations of the United States
			 under the Agreement and this Act.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="IDee0e8b1a704f48588bc1c2ab178cce33" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDe83e07dce99d497da1b854ddc43bdfe4"><enum>(1)</enum><header display-inline="yes-display-inline">Agreement</header><text display-inline="yes-display-inline">The term <term>Agreement </term> means the
			 agreement entitled the <quote>Agreement to Establish the Relative Water Rights
			 of the Shoshone-Paiute Tribes of the Duck Valley Indian Reservation and the
			 Upstream Water Users, East Fork Owyhee River</quote> (including all attachments
			 to that agreement).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe6e8ee510ba64866a2c5093cb58c94a6"><enum>(2)</enum><header display-inline="yes-display-inline">Development Fund</header><text display-inline="yes-display-inline">The term <term>Development Fund</term>
			 means the Shoshone-Paiute Tribes Water Rights Development Fund established by
			 section 7(b)(1).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc6d81a94493647d69b0a121d9736ddf3"><enum>(3)</enum><header display-inline="yes-display-inline">East Fork of the Owyhee River</header><text display-inline="yes-display-inline">The term <term>East Fork of the Owyhee
			 River</term> means the portion of the east fork of the Owyhee River that is
			 located in the State.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa4b685b35635495ea0703e3650e57f2f"><enum>(4)</enum><header display-inline="yes-display-inline">Maintenance Fund</header><text display-inline="yes-display-inline">The term <term>Maintenance Fund</term>
			 means the Shoshone-Paiute Tribes Operation and Maintenance Fund established by
			 section 7(c)(1).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f63f61b1874489babecd7e4fa09fc00"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcf335cfac60c4c4cacbb3b536c72d26e"><enum>(6)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State
			 of Nevada.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3d3228bcfd9c41e18972e14b074daf54"><enum>(7)</enum><header display-inline="yes-display-inline">Tribal water right</header><text display-inline="yes-display-inline">The term <term>tribal water right</term>
			 means a right of the Tribes described in the Agreement relating to water,
			 including groundwater, storage water, and surface water.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd43a7b24dea642d9bd6e9dc5815d212b"><enum>(8)</enum><header display-inline="yes-display-inline">Tribes</header><text display-inline="yes-display-inline">The term <term>Tribes</term> means the
			 Shoshone-Paiute Tribes of the Duck Valley Indian Reservation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1ae37d825a9e4296a44be3dd34a5bb23"><enum>(9)</enum><header display-inline="yes-display-inline">Upstream water user</header><text display-inline="yes-display-inline">The term <term>upstream water user</term>
			 means an individual water user that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idC76072D89C4E499F8BAE5C2656639BAA"><enum>(A)</enum><text display-inline="yes-display-inline">is located upstream from the Duck Valley
			 Indian Reservation on the East Fork of the Owyhee River; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88C0552D6FAA4EB59D46A132AB87714A"><enum>(B)</enum><text display-inline="yes-display-inline">is a signatory to the Agreement.</text>
				</subparagraph></paragraph></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID7a4fb6cff8534c0faa80dc7b1eb305ee" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Approval, ratification, and confirmation of
			 Agreement</header>
			<subsection commented="no" display-inline="no-display-inline" id="id349729EAD0204464B0487BD2684F8223"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in section 1f of article
			 III of the Agreement, and except to the extent that the Agreement otherwise
			 conflicts with this Act, the Agreement is approved, ratified, and
			 confirmed.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb024d0ccc9044c9995f2eba32ef7de90"><enum>(b)</enum><header display-inline="yes-display-inline">Performance of obligations</header><text display-inline="yes-display-inline">The Secretary and any other head of a
			 Federal agency obligated under the Agreement shall perform any action necessary
			 to carry out an obligation under the Agreement in accordance with this
			 Act.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID40fab92dd4684b398d9f41b16e858a92" reported-display-style="strikethrough" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Tribal water rights</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDbd26f05fc104402d8ab52cd98fe78c03"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall hold the tribal water
			 rights in trust on behalf of the United States for the benefit of the
			 Tribes.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID59c02fce60f9423eb996c66d7e671cf0"><enum>(b)</enum><header display-inline="yes-display-inline">Administration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0144b3c11a5e46af9de4621d39f05943"><enum>(1)</enum><header display-inline="yes-display-inline">Enactment of water code</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
			 enactment of this Act, the Tribes shall enact a water code to administer tribal
			 water rights.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe45a1c7c84444ec6a7002b0c9a641fbe"><enum>(2)</enum><header display-inline="yes-display-inline">Interim administration</header><text display-inline="yes-display-inline">The Secretary shall regulate the tribal
			 water rights during the period beginning on the date of enactment of this Act
			 and ending on the date on which the Tribes enact a water code under paragraph
			 (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc2fbe061e71e48fe86f21d4cb42af4a9"><enum>(c)</enum><header display-inline="yes-display-inline">Loss of tribal water rights</header><text display-inline="yes-display-inline">The tribal water rights shall not be
			 subject to loss by abandonment, forfeiture, or nonuse.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID5cec9550bde74801a7d2855437a1f2e6" reported-display-style="strikethrough" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Development and Maintenance Funds</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1369A11C758E4E8DAA762E78EBE9B910"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Funds</header><text display-inline="yes-display-inline">In this section, the term
			 <term>Funds</term> means—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID145f6ab9f79844bb883ac3563307dd86"><enum>(1)</enum><text display-inline="yes-display-inline">the Development Fund; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID55a2c6645072484dbda4c107bbc69579"><enum>(2)</enum><text display-inline="yes-display-inline">the Maintenance Fund.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7b52ba49c03f428388b064569734e3cf"><enum>(b)</enum><header display-inline="yes-display-inline">Development Fund</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idC1E94760B62C4E508FBC4D8A6B31358B"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the
			 United States a fund to be known as the <quote>Shoshone-Paiute Tribes Water
			 Rights Development Fund</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9C3422B5582490FA19315382F9437FB"><enum>(2)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">The Tribes shall use amounts in the
			 Development Fund—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id59C13D9842BD42CD8A9FD5DA0EE06908"><enum>(A)</enum><text display-inline="yes-display-inline">to pay or reimburse costs incurred by the
			 Tribes in acquiring land and water rights;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E666F5074124577A2233D3F2285BD2D"><enum>(B)</enum><text display-inline="yes-display-inline">for purposes of cultural
			 preservation;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D85F90F812B45058F575B0086A7DB95"><enum>(C)</enum><text display-inline="yes-display-inline">to restore or improve fish or wildlife
			 habitat;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF65D34D54AAA462889D35AF0A88F6D2B"><enum>(D)</enum><text display-inline="yes-display-inline">for fish or wildlife production, water
			 resource development, agricultural development, rehabilitation, and expansion
			 of the Duck Valley Irrigation Project;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id218304974B264C6E901F526D407B8B21"><enum>(E)</enum><text display-inline="yes-display-inline">for water resource planning and
			 development; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id809F051E7B8A451CBDC3B1247A901B0A"><enum>(F)</enum><text display-inline="yes-display-inline">to pay the costs of designing and
			 constructing water supply and sewer systems for tribal communities,
			 including—</text>
						<clause commented="no" display-inline="no-display-inline" id="idCAE00AACBDFC4DE2BB5602BD8A016D8D"><enum>(i)</enum><text display-inline="yes-display-inline">a water quality testing laboratory;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id390630E6A3AB430F8A139F834F1EF55A"><enum>(ii)</enum><text display-inline="yes-display-inline">other appropriate water-related projects
			 and other related economic development projects;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id0A347B135FA64936B442EF462C50BEFD"><enum>(iii)</enum><text display-inline="yes-display-inline">the development of a water code; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id4C1762FFE9EE49E6971465C9882C25F5"><enum>(iv)</enum><text display-inline="yes-display-inline">other costs of implementing the
			 Agreement.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21F1E9F6388744CD8FD3A94BA641EDCE"><enum>(3)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary for deposit in the Development
			 Fund $9,000,000 for each of fiscal years 2008 through 2012.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7CB608698FA141FEAC70AD96366241EA"><enum>(c)</enum><header display-inline="yes-display-inline">Maintenance Fund</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE3C2A14B3B0548FB8D57D8A8B319198A"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the
			 United States a fund to be known as the <quote>Shoshone-Paiute Tribes Operation
			 and Maintenance Fund</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE99EE09A641485BBD3D0CC9663C52F0"><enum>(2)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">The Tribes shall use amounts in the
			 Maintenance Fund to pay or provide reimbursement for the costs of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id431714E0B9F8462DA97D65644CFE8110"><enum>(A)</enum><text display-inline="yes-display-inline">operation and maintenance of the Duck
			 Valley Irrigation Project and other water-related projects funded under this
			 Act; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA00A284539A34823A48CBE246582D20B"><enum>(B)</enum><text display-inline="yes-display-inline">water supply and sewer systems for tribal
			 communities, including the operation and maintenance costs of a water quality
			 testing laboratory.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id702E2475CD064D6AA04D886994712BCD"><enum>(3)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary for deposit in the Maintenance
			 Fund $3,000,000 for each of fiscal years 2008 through 2012.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA1D978E1C8594249B7A968D972A7F004"><enum>(d)</enum><header display-inline="yes-display-inline">Administration of Funds</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id14C3C1EE33E34D848DC7F19FDBF37E66"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in accordance with the
			 American Indian Trust Fund Management Reform Act of 1994 (25 U.S.C. 4001 et
			 seq.), this Act, and the Agreement, shall manage the Funds, including by
			 investing amounts from the Funds in accordance with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8DE82AAA9C3D402993ACD54B019CD439"><enum>(A)</enum><text display-inline="yes-display-inline">the Act of April 1, 1880 (25 U.S.C. 161);
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD1FE07A517FC4C62BA1AE7588CB5B0A7"><enum>(B)</enum><text display-inline="yes-display-inline">the first section of the Act of June 24,
			 1938 (25 U.S.C. 162a).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8F8C6FC1BB71464A9732C9FA1E74A7A8"><enum>(2)</enum><header display-inline="yes-display-inline">Distributions</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDafe4721fec8143eb92bf41e95a94e01a"><enum>(A)</enum><header display-inline="yes-display-inline">Withdrawals</header>
						<clause commented="no" display-inline="no-display-inline" id="id55420A1648674439AB1EA0CBDA25EE59"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During any fiscal year, the Tribes may
			 withdraw amounts from the Funds if the Secretary approves a plan of the Tribes
			 to withdraw amounts under section 202 of the American Indian Trust Fund
			 Management Reform Act of 1994 (25 U.S.C. 4022).</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDc70dd304308b47baa353974b3d05072e"><enum>(ii)</enum><header display-inline="yes-display-inline">Plan to withdraw amounts</header>
							<subclause commented="no" display-inline="no-display-inline" id="idFB53F8ADE6A347DE9BCA268254F4D8B5"><enum>(I)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">In addition to any information required
			 under section 202 of the American Indian Trust Fund Management Reform Act of
			 1994 (25 U.S.C. 4022), a plan of the Tribes to withdraw amounts under this
			 subparagraph shall include a requirement that the Tribes spend the amounts
			 withdrawn from the Funds during a fiscal year for 1 or more uses described in
			 subsection (b)(2) or (c)(2).</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd38d5bb167a04d64900b290870e3bdf7"><enum>(II)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">The Secretary may take administrative or
			 judicial action to enforce a plan of the Tribes to withdraw amounts.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD75038726606455192B4C4C4B63234D7"><enum>(B)</enum><header display-inline="yes-display-inline">Remaining amounts</header>
						<clause commented="no" display-inline="no-display-inline" id="idA44FBBBED4A5467CA78CFEFB2058A577"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On approval of an expenditure plan
			 submitted by the Tribes under clause (ii), the Secretary shall distribute to
			 the Tribes amounts in the Funds not withdrawn by the Tribes during the
			 preceding fiscal year.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID55196052117c4063837a399224d7314a"><enum>(ii)</enum><header display-inline="yes-display-inline">Expenditure plan</header>
							<subclause commented="no" display-inline="no-display-inline" id="ID4690a719327e41f9afe1c81823f53000"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each fiscal year, the Tribes shall
			 submit to the Secretary for approval an expenditure plan for amounts described
			 in clause (i).</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id08FEECAA8C30421E98DAD13451461894"><enum>(II)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">An expenditure plan under subclause (I)
			 shall include—</text>
								<item commented="no" display-inline="no-display-inline" id="id6A988C561D14423AB004732AB644F01C"><enum>(aa)</enum><text display-inline="yes-display-inline">an accounting by the Tribes of any funds
			 withdrawn by the Tribes from the Funds during the preceding fiscal year,
			 including a description of any use by the Tribes of the funds and the amount
			 remaining in the Funds for the preceding fiscal year; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="idC402C086AF7A4B898DA7B37A48CDD59D"><enum>(bb)</enum><text display-inline="yes-display-inline">a description of the means by which the
			 Tribes will use any amount distributed under this subparagraph.</text>
								</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID142b6c5bc72d4dba81a29029c1462a45"><enum>(iii)</enum><header display-inline="yes-display-inline">Approval</header><text display-inline="yes-display-inline">The Secretary shall approve an expenditure
			 plan under this subparagraph if the Secretary determines that the plan
			 is—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idE51067546B8A4DDEACD102DEB0AC882C"><enum>(I)</enum><text display-inline="yes-display-inline">reasonable; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id4A0D9641908B4B4783FA062766736AFA"><enum>(II)</enum><text display-inline="yes-display-inline">consistent with this Act and the
			 Agreement.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DFC733EE977424B8C8B902EBBB661CD"><enum>(C)</enum><header display-inline="yes-display-inline">Limitations</header>
						<clause commented="no" display-inline="no-display-inline" id="id3C3874D3558A4BACB3201836B6360409"><enum>(i)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">No amount from the Funds (including any
			 interest income accruing to the Funds) shall be distributed until the waivers
			 under section 8(a) take effect.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAE8098C05B484A0BB1FDFC88C85450CF"><enum>(ii)</enum><header display-inline="yes-display-inline">No per capita distributions</header><text display-inline="yes-display-inline">No amount from the Funds (including any
			 interest income accruing to the Funds) shall be distributed to a member of the
			 Tribes on a per capita basis.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB8F69FB45FDD4B86AFAC68F3344E98E0"><enum>(3)</enum><header display-inline="yes-display-inline">Funding agreement</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 Act, on receipt of a request from the Tribes, the Secretary shall include an
			 amount appropriated under this subsection in the funding agreement of the
			 Tribes under title IV of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 458aa et seq.), for use in accordance with subsections (b)(2)
			 and (c)(2).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID288c98e7a61d452398b6c88768e857ab"><enum>(4)</enum><header display-inline="yes-display-inline">Liability</header><text display-inline="yes-display-inline">The Secretary and the Secretary of the
			 Treasury shall not retain any liability for the expenditure or investment of
			 amounts distributed to the Tribes under this subsection.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbe4b0290bb4741f4a1d340ec91d4d371"><enum>(5)</enum><header display-inline="yes-display-inline">Capital costs nonreimbursable</header><text display-inline="yes-display-inline">The capital costs associated with the Duck
			 Valley Indian Irrigation Project as of the date of enactment of this Act,
			 including any capital cost incurred with funds distributed under this
			 subsection for that project, shall be permanently nonreimbursable.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="ID19fe582795e9477c8b00b091babd5a2e" reported-display-style="strikethrough" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Tribal waiver of claims</header>
			<subsection commented="no" display-inline="no-display-inline" id="idF7ABA10A33424741A984A76EB02B1A82"><enum>(a)</enum><header display-inline="yes-display-inline">Waivers</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDbf02eae2949e435c80cfc829c24103e5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in the
			 Agreement and this Act, the Tribes, and the United States on behalf of the
			 Tribes, waive and release—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID22ac860168fd468fb7b010ab30173413"><enum>(A)</enum><text display-inline="yes-display-inline">all claims to water in the East Fork of the
			 Owyhee River and all claims to injury relating to that water; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb708369d2e6a4c9d8ecdf7c173d5730c"><enum>(B)</enum><text display-inline="yes-display-inline">all claims against the State, any agency or
			 political subdivision of the State, or any person, entity, or corporation
			 relating to injury to a right of the Tribe under any Executive order entered on
			 behalf of the Tribes, to the extent that the injury—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDe0f86fe243ee4fde8768475cbba3ea04"><enum>(i)</enum><text display-inline="yes-display-inline">resulted from a flow modification or a
			 reduction in the quantity of water available; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID0e9a1a16f2e04a3195c46df954ce9521"><enum>(ii)</enum><text display-inline="yes-display-inline">accrued on or before the effective date of
			 the Agreement.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDad4d55ff754b489d9a12b04c73903c41"><enum>(2)</enum><header display-inline="yes-display-inline">Enforcement of waivers</header><text display-inline="yes-display-inline">A waiver of a claim under this subsection
			 by the Tribes, or the United States on behalf of the Tribes, shall be
			 enforceable in the appropriate forum.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9977b66306394b31b5770b954ed1e2eb"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">A waiver by the Tribes,
			 or the United States on behalf of the Tribes, of a claim under this subsection
			 shall take effect on the date on which the Secretary publishes in the Federal
			 Register a statement of findings that includes a finding that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDb35e67c4c1234227bc25a372118b51d7"><enum>(A)</enum><text display-inline="yes-display-inline">all parties to the Agreement have executed
			 the Agreement;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1228e57bcc134b1cb2382dca987b7993"><enum>(B)</enum><text display-inline="yes-display-inline">a decree acceptable to each party to the
			 Agreement has been entered by the Fourth Judicial District Court, Elko County,
			 Nevada; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id250133E0CB184D49AD13E37F01CD719C"><enum>(C)</enum><text display-inline="yes-display-inline">the Agreement has been ratified under
			 section 5(a).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID73a3c44b6df2430fb1a58d4baa9c0a11"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver and release of claims against the
			 United States</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDbe1de362771a43de94ec57f41e6f0081"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In consideration of performance by the
			 United States of all actions required by the Agreement and this Act, including
			 the authorization of appropriations under subsections (b)(3) and (c)(3) of
			 section 7, the Tribe shall execute a waiver and release of any claim against
			 the United States for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID4d49cfab65bc44d9a516769a23a6e642"><enum>(A)</enum><text display-inline="yes-display-inline">a water right in the East Fork of the
			 Owyhee River;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53585369DB6E4E729F18B05820CCFBD8"><enum>(B)</enum><text display-inline="yes-display-inline">an injury to a right described in
			 subparagraph (A);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA8D3776300D54A40B50ADEC3F535BC96"><enum>(C)</enum><text display-inline="yes-display-inline">breach of trust—</text>
						<clause commented="no" display-inline="no-display-inline" id="idE1E13CBFC6FE4423B878301CAF0E4660"><enum>(i)</enum><text display-inline="yes-display-inline">for failure to protect, acquire, or develop
			 a water right that accrued on or before the effective date of a waiver under
			 this subsection; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id53F1244FC16746C9B592FE1DD268C5A6"><enum>(ii)</enum><text display-inline="yes-display-inline">arising out of the negotiation or adoption
			 of the Agreement; or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8AA9BE8CDE664BA0A97E4B54EB6DE13C"><enum>(D)</enum><text display-inline="yes-display-inline">a fishing right under any Executive order,
			 to the extent that an injury to such a right—</text>
						<clause commented="no" display-inline="no-display-inline" id="id159365080707425996E92204A446F4FF"><enum>(i)</enum><text display-inline="yes-display-inline">resulted from a reduction in the quantity
			 of water available in the East Fork of the Owyhee River; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id95F2CF0435BA444DBBDCE156B8B28679"><enum>(ii)</enum><text display-inline="yes-display-inline">accrued on or before the effective date of
			 a waiver under this subsection.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd53c1d941e904a6987e85498502402af"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID6db915bcf1e74f2a8b1fa6f86e9cf11b"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The waiver under paragraph (1) takes effect
			 on the date on which the amounts authorized to be appropriated under
			 subsections (b)(3) and (c)(3) of section 7 are distributed to the
			 Tribes.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4e04b5e3eaea41f08c6afb148c58325d"><enum>(B)</enum><header display-inline="yes-display-inline">Tolling of claims</header>
						<clause commented="no" display-inline="no-display-inline" id="IDf76133ee2470453bb8b6e8a7a56178da"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each applicable period of limitation and
			 time-based equitable defense relating to a claim described in paragraph (1)
			 shall be tolled for the period beginning on the date of enactment of this Act
			 and ending on the date on which the amounts authorized to be appropriated under
			 subsections (b)(3) and (c)(3) of section 7 are distributed to the
			 Tribes.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDd5402bce4eed4182b104a75dcfa3eb25"><enum>(ii)</enum><header display-inline="yes-display-inline">Effect of subparagraph</header><text display-inline="yes-display-inline">Nothing in this subparagraph revives any
			 claim or tolls any period of limitation or time-based equitable defense that
			 expired before the date of enactment of this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID94ec35346f57459585a0cc386efb0733"><enum>(c)</enum><header display-inline="yes-display-inline">Retention of rights</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDda888d4afb0e486fb78c7593a3b4b6a9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Tribes shall retain all rights not
			 waived by the Tribes, or the United States on behalf of the Tribes, in the
			 Agreement or this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID226908959f054205b9331a150541c7d1"><enum>(2)</enum><header display-inline="yes-display-inline">Claims outside reservation</header><text display-inline="yes-display-inline">Nothing in the Agreement or this Act shall
			 be considered to be a waiver by the Tribes of any claim to a right on land
			 outside the Duck Valley Indian Reservation.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc1ac14324a1a4e38bbc261757b607d7a"><enum>(3)</enum><header display-inline="yes-display-inline">Future acquisition of water
			 rights</header><text display-inline="yes-display-inline">Nothing in the
			 Agreement or this Act precludes the Tribes, or the United States as trustee for
			 the Tribes, from acquiring a water right in the State to the same extent as any
			 other entity in the State, in accordance with State law.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SLIA00" display-inline="no-display-inline" id="IDbc1d7cddd2974d1b8f7d1fc7858df685" reported-display-style="strikethrough" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Miscellaneous</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDa9217329b11a467d9b85fe76a139467e"><enum>(a)</enum><header display-inline="yes-display-inline">General disclaimer</header><text display-inline="yes-display-inline">The parties to the Agreement expressly
			 reserve all rights not specifically granted, recognized, or relinquished
			 by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idAFB53429FCA04F7F81C82C64BE6D380A"><enum>(1)</enum><text display-inline="yes-display-inline">the settlement described in the Agreement;
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61AFFFBB9D8A4643AA4B067C0FD94F0D"><enum>(2)</enum><text display-inline="yes-display-inline">this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0353f3505ffd408ab20656839a07a7ae"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation of claims and
			 rights</header><text display-inline="yes-display-inline">Nothing in this
			 Act—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDc4db8ba82c6a45018c25873fe6501b13"><enum>(1)</enum><text display-inline="yes-display-inline">establishes a standard for
			 quantifying—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id037E1EFAF2C54381881A577A458F7366"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal reserved water right;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7257CA26A864BE4801886605E39F68F"><enum>(B)</enum><text display-inline="yes-display-inline">an aboriginal claim; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id702EF966AECB42E89A19A8EF8908D53A"><enum>(C)</enum><text display-inline="yes-display-inline">any other water right claim of an Indian
			 tribe in a judicial or administrative proceeding; or</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd7627e20085f4f2b9282d5d96b39d4e6"><enum>(2)</enum><text display-inline="yes-display-inline">limits the right of a party to the
			 Agreement to litigate any issue not resolved by the Agreement or this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID76fc44d1f71149369b3faaa28f0ccdee"><enum>(c)</enum><header display-inline="yes-display-inline">Admission against interest</header><text display-inline="yes-display-inline">Nothing in this Act shall be considered to
			 be an admission against interest by a party in any legal proceeding.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDce9a349b27154e1ea7951394a628baa2"><enum>(d)</enum><header display-inline="yes-display-inline">Duck Valley Reservation</header><text display-inline="yes-display-inline">The Duck Valley Indian Reservation
			 established by the Executive order dated April 16, 1877, as adjusted pursuant
			 to the Executive order dated May 4, 1886, and Executive order numbered 1222 and
			 dated July 1, 1910, for use and occupation by the Western Shoshones and the
			 Paddy Cap Band of Paiutes shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id276D1D48F67C43FC889C478A9EA39858"><enum>(1)</enum><text display-inline="yes-display-inline">considered to be the property of the
			 Tribes; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF67836A4979442D8A8B6094911EDE00E"><enum>(2)</enum><text display-inline="yes-display-inline">permanently held in trust by the United
			 States for the sole use and benefit of the Tribes.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4b57b6070a034e14be00a6894eec26f9"><enum>(e)</enum><header display-inline="yes-display-inline">Jurisdiction</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID28330012b08c4e0eb2ca1fbfd2686b02"><enum>(1)</enum><header display-inline="yes-display-inline">Subject matter jurisdiction</header><text display-inline="yes-display-inline">Nothing in the Agreement or this Act
			 restricts, enlarges, or otherwise determines the subject matter jurisdiction of
			 any Federal, State, or tribal court.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb7eb429558a4addab2f665d852f6907"><enum>(2)</enum><header display-inline="yes-display-inline">Civil or regulatory
			 jurisdiction</header><text display-inline="yes-display-inline">Nothing in the
			 Agreement or this Act impairs or impedes the exercise of any civil or
			 regulatory authority of the United States, the State, or the Tribes.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6c684306231a446b8db46e9d3132255c"><enum>(3)</enum><header display-inline="yes-display-inline">Consent to jurisdiction</header><text display-inline="yes-display-inline">The United States consents to jurisdiction
			 in a proper forum for purposes of enforcing the provisions of the
			 Agreement.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd9cb2991ec1f45f2abb85545917b3ab2"><enum>(4)</enum><header display-inline="yes-display-inline">Effect of subsection</header><text display-inline="yes-display-inline">Nothing in this subsection confers
			 jurisdiction on any State court to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID642744ece9d945b0956354d0bb3447af"><enum>(A)</enum><text display-inline="yes-display-inline">enforce Federal environmental laws relating
			 to the duties of the United States under this Act; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc92a48c15b2f43399bf83af6b29e7958"><enum>(B)</enum><text display-inline="yes-display-inline">conduct judicial review of a Federal agency
			 action in accordance with this Act.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SLIA00" id="id8B3090849465459BBBC39231E06D2AC0" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Shoshone-Paiute Tribes of the Duck
			 Valley Reservation Water Rights Settlement Act</short-title></quote>.</text>
		</section><section changed="added" committee-id="SLIA00" id="ID43fd95ad516f41528f1e85cb612c4b3a" reported-display-style="italic"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID06edfa72925b4fc7ba65a24fe1998262"><enum>(1)</enum><text>it is the policy of the
			 United States, in accordance with the trust responsibility of the United States
			 to Indian tribes, to promote Indian self-determination and economic
			 self-sufficiency and to settle Indian water rights claims without lengthy and
			 costly litigation, if practicable;</text>
			</paragraph><paragraph id="IDb81d82482f84486c817beb66fd5b644d"><enum>(2)</enum><text>quantifying rights to
			 water and development of facilities needed to use tribal water supplies is
			 essential to the development of viable Indian reservation economies and the
			 establishment of a permanent reservation homeland;</text>
			</paragraph><paragraph id="IDd1ed924fadb240a6b8301d54a22387e5"><enum>(3)</enum><text>uncertainty concerning
			 the extent of the Shoshone-Paiute Tribes’ water rights has resulted in limited
			 access to water and inadequate financial resources necessary to achieve
			 self-determination and self-sufficiency;</text>
			</paragraph><paragraph id="ID009e70a5652b445cb01c42ceca95370a"><enum>(4)</enum><text>in 2006, the Tribes, the
			 State of Idaho, the affected individual water users, and the United States
			 resolved all tribal claims to water rights in the Snake River Basin
			 Adjudication through a consent decree entered by the District Court of the
			 Fifth Judicial District of the State of Idaho, requiring no further Federal
			 action to quantify the Tribes’ water rights in the State of Idaho;</text>
			</paragraph><paragraph id="ID196ba5160ef146898d9ecb2069d78c07"><enum>(5)</enum><text>as of the date of
			 enactment of this Act, proceedings to determine the extent and nature of the
			 water rights of the Tribes in the East Fork of the Owyhee River in Nevada are
			 pending before the Nevada State Engineer;</text>
			</paragraph><paragraph id="IDf816dac4fb78422fa503743f34da25ed"><enum>(6)</enum><text>final resolution of the
			 Tribes' water claims in the East Fork of the Owyhee River adjudication
			 will—</text>
				<subparagraph id="ID7e05abe0f0b24976a61f46bf61b8a94c"><enum>(A)</enum><text>take many years;</text>
				</subparagraph><subparagraph id="ID57eebeb0ba8748ff938ae73010348337"><enum>(B)</enum><text>entail great
			 expense;</text>
				</subparagraph><subparagraph id="IDddb5c5d516b346c0962feb0cefbfb4a5"><enum>(C)</enum><text>continue to limit the
			 access of the Tribes to water, with economic and social consequences;</text>
				</subparagraph><subparagraph id="ID892cc8586579486891b0d6a5ce7cd24a"><enum>(D)</enum><text>prolong uncertainty
			 relating to the availability of water supplies; and</text>
				</subparagraph><subparagraph id="ID304e4e21b9ab4230b37e253c28f7531a"><enum>(E)</enum><text>seriously impair
			 long-term economic planning and development for all parties to the
			 litigation;</text>
				</subparagraph></paragraph><paragraph id="IDb8e9a706b79a4149b1bf5284d97a087b"><enum>(7)</enum><text>after many years of
			 negotiation, the Tribes, the State, and the upstream water users have entered
			 into a settlement agreement to resolve permanently all water rights of the
			 Tribes in the State; and</text>
			</paragraph><paragraph id="ID313eda70a81a45ee9bb99fd49765d61b"><enum>(8)</enum><text>the Tribes also seek to
			 resolve certain water-related claims for damages against the United
			 States.</text>
			</paragraph></section><section changed="added" committee-id="SLIA00" id="ID4b1b17a4c8644d35b2a0ed7570b859d8" reported-display-style="italic"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="ID67542a1b783a44a3ae952b804ccdc7c4"><enum>(1)</enum><text>to resolve outstanding
			 issues with respect to the East Fork of the Owyhee River in the State in such a
			 manner as to provide important benefits to—</text>
				<subparagraph id="IDc0b9d000db314171ac388fea50f10104"><enum>(A)</enum><text>the United States;</text>
				</subparagraph><subparagraph id="ID60cb184d5a20417fa4010e19326003a8"><enum>(B)</enum><text>the State;</text>
				</subparagraph><subparagraph id="IDa4b88738680f4806b89b7fe2462a78b7"><enum>(C)</enum><text>the Tribes; and</text>
				</subparagraph><subparagraph id="ID2f65c0869e3541ccbf31ec4eab0b2e44"><enum>(D)</enum><text>the upstream water
			 users;</text>
				</subparagraph></paragraph><paragraph id="IDae8227f82e504774aade26dabcc96ea7"><enum>(2)</enum><text>to achieve a fair,
			 equitable, and final settlement of all claims of the Tribes, members of the
			 Tribes, and the United States on behalf of the Tribes and members of Tribes to
			 the waters of the East Fork of the Owyhee River in the State;</text>
			</paragraph><paragraph id="ID81076666857b4f269945c4418c2dc3a6"><enum>(3)</enum><text>to ratify and provide for
			 the enforcement of the Agreement among the parties to the litigation;</text>
			</paragraph><paragraph id="ID34f242f67ab34575a1394769ef3ff6ea"><enum>(4)</enum><text>to resolve the Tribes’
			 water-related claims for damages against the United States;</text>
			</paragraph><paragraph id="ID009a1b4df41f4c5aa8baa7361de8a045"><enum>(5)</enum><text>to require the Secretary
			 to perform all obligations of the Secretary under the Agreement and this Act;
			 and</text>
			</paragraph><paragraph id="ID913f16012bfc491580043274ab636484"><enum>(6)</enum><text>to authorize the actions
			 and appropriations necessary to meet the obligations of the United States under
			 the Agreement and this Act.</text>
			</paragraph></section><section changed="added" committee-id="SLIA00" id="ID9affee1b06fd4dd08a55fd83c2569949" reported-display-style="italic"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID3e853cfdeea144abaf90b0eff1ee1383"><enum>(1)</enum><header>Agreement</header><text>The
			 term <term>Agreement</term> means the agreement entitled the <quote>Agreement
			 to Establish the Relative Water Rights of the Shoshone-Paiute Tribes of the
			 Duck Valley Reservation and the Upstream Water Users, East Fork Owyhee
			 River</quote> and signed in counterpart between, on, or about September 22,
			 2006, and January 15, 2007 (including all attachments to that
			 Agreement).</text>
			</paragraph><paragraph id="IDe013bbd659784b43a69fe03c66fdafbf"><enum>(2)</enum><header>Development
			 Fund</header><text>The term <term>Development Fund</term> means the
			 Shoshone-Paiute Tribes Water Rights Development Fund established by section
			 8(b)(1).</text>
			</paragraph><paragraph id="IDd371fae0f62b4335bd0d23174ea3b739"><enum>(3)</enum><header>East fork of the Owyhee
			 River</header><text>The term <term>East Fork of the Owyhee River</term> means
			 the portion of the east fork of the Owyhee River that is located in the
			 State.</text>
			</paragraph><paragraph id="ID025a8d4cfc924a169191559f723fdb45"><enum>(4)</enum><header>Maintenance
			 fund</header><text>The term <term>Maintenance Fund</term> means the
			 Shoshone-Paiute Tribes Operation and Maintenance Fund established by section
			 8(c)(1).</text>
			</paragraph><paragraph id="ID540d80d2948e48579d0a452e8cec993e"><enum>(5)</enum><header>Reservation</header><text>The
			 term <term>Reservation</term> means the Duck Valley Reservation established by
			 the Executive order dated April 16, 1877, as adjusted pursuant to the Executive
			 order dated May 4, 1886, and Executive order numbered 1222 and dated July 1,
			 1910, for use and occupation by the Western Shoshones and the Paddy Cap Band of
			 Paiutes.</text>
			</paragraph><paragraph id="IDa8a1858b4fe24f7ab225c9dcdb167a53"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="IDe0c6d156f3cb408185a7362f4ab218db"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Nevada.</text>
			</paragraph><paragraph id="IDd2cfe859214a4b60992a2936f321d835"><enum>(8)</enum><header>Tribal water
			 rights</header><text>The term <term>tribal water rights</term> means rights of
			 the Tribes described in the Agreement relating to water, including groundwater,
			 storage water, and surface water.</text>
			</paragraph><paragraph id="IDb072c46cbc87429286eaa2fbe621d1e5"><enum>(9)</enum><header>Tribes</header><text>The
			 term <term>Tribes</term> means the Shoshone-Paiute Tribes of the Duck Valley
			 Reservation.</text>
			</paragraph><paragraph id="ID3423e7381057494b8b0d8cc7a24efbd9"><enum>(10)</enum><header>Upstream water
			 user</header><text>The term <term>upstream water user</term> means a
			 non-Federal water user that—</text>
				<subparagraph id="ID7532bd146d7d4d7c9ebf7c18ceeeb3ad"><enum>(A)</enum><text>is located upstream from
			 the Reservation on the East Fork of the Owyhee River; and</text>
				</subparagraph><subparagraph id="ID142e5229034e4bfba054af5d5dcb262b"><enum>(B)</enum><text>is a signatory to the
			 Agreement as a party to the East Fork of the Owyhee River adjudication.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SLIA00" id="ID755261994e784781bb8da13fa4f64ab8" reported-display-style="italic"><enum>5.</enum><header>Approval, ratification,
			 and confirmation of agreement; authorization</header>
			<subsection id="ID5bda08f2366f4885a2a6492cb535a65c"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (c) and except to the
			 extent that the Agreement otherwise conflicts with provisions of this Act, the
			 Agreement is approved, ratified, and confirmed.</text>
			</subsection><subsection id="id7C356727FB634584A8B72067A6E4A706"><enum>(b)</enum><header>Secretarial
			 Authorization</header><text>The Secretary is authorized and directed to execute
			 the Agreement as approved by Congress.</text>
			</subsection><subsection id="ID301000525cbe4ba3b2aaf3a0884f027a"><enum>(c)</enum><header>Exception for tribal
			 water marketing</header><text>Notwithstanding any language in the Agreement to
			 the contrary, nothing in this Act authorizes the Tribes to use or authorize
			 others to use tribal water rights off the Reservation, other than use for
			 storage at Wild Horse Reservoir or use on tribal land off the
			 Reservation.</text>
			</subsection><subsection id="IDf21e18ff695b4119a62fb982c2960f81"><enum>(d)</enum><header>Environmental
			 compliance</header><text>Execution of the Agreement by the Secretary under this
			 section shall not constitute major Federal action under the National
			 Environmental Policy Act (42 U.S.C. 4321 et seq.). The Secretary shall carry
			 out all environmental compliance required by Federal law in implementing the
			 Agreement.</text>
			</subsection><subsection id="ID2ced8e6636e2412d8ef604cfa7475516"><enum>(e)</enum><header>Performance of
			 obligations</header><text>The Secretary and any other head of a Federal agency
			 obligated under the Agreement shall perform actions necessary to carry out an
			 obligation under the Agreement in accordance with this Act.</text>
			</subsection></section><section changed="added" committee-id="SLIA00" id="ID647ba4b604d7421294dce62b5e375e9b" reported-display-style="italic"><enum>6.</enum><header>Tribal water
			 rights</header>
			<subsection id="ID66341db9ff3445f6ad587493a4eff753"><enum>(a)</enum><header>In
			 general</header><text>Tribal water rights shall be held in trust by the United
			 States for the benefit of the Tribes.</text>
			</subsection><subsection id="IDc753abc49724412886b89735d984eb11"><enum>(b)</enum><header>Administration</header>
				<paragraph id="IDeb72ad3ddd084905bb472a77e1302b21"><enum>(1)</enum><header>Enactment of water
			 code</header><text>Not later than 3 years after the date of enactment of this
			 Act, the Tribes, in accordance with provisions of the Tribes' constitution and
			 subject to the approval of the Secretary, shall enact a water code to
			 administer tribal water rights.</text>
				</paragraph><paragraph id="ID33dbea22d5704b85867d3c5f60c0120d"><enum>(2)</enum><header>Interim
			 administration</header><text>The Secretary shall regulate the tribal water
			 rights during the period beginning on the date of enactment of this Act and
			 ending on the date on which the Tribes enact a water code under paragraph
			 (1).</text>
				</paragraph></subsection><subsection id="IDb60812a37e7a4940af17b73ebfe1254d"><enum>(c)</enum><header>Tribal water rights not
			 subject to loss</header><text>The tribal water rights shall not be subject to
			 loss by abandonment, forfeiture, or nonuse.</text>
			</subsection></section><section changed="added" committee-id="SLIA00" id="ID75228520c7c04811b35f95f220652912" reported-display-style="italic"><enum>7.</enum><header>Duck Valley Indian
			 Irrigation Project</header>
			<subsection id="ID82354dd041da44eb9485510ab4295491"><enum>(a)</enum><header>Status of the Duck
			 Valley Indian Irrigation Project</header><text>Nothing in this Act shall affect
			 the status of the Duck Valley Indian Irrigation Project under Federal
			 law.</text>
			</subsection><subsection id="IDbf41568c4dbd4d50aa0615f549a9c996"><enum>(b)</enum><header>Capital costs
			 nonreimbursable</header><text>The capital costs associated with the Duck Valley
			 Indian Irrigation Project as of the date of enactment of this Act, including
			 any capital cost incurred with funds distributed under this Act for the Duck
			 Valley Indian Irrigation Project, shall be nonreimbursable.</text>
			</subsection></section><section changed="added" committee-id="SLIA00" id="ID056bba8aa00f4b589a4821df1900e82d" reported-display-style="italic"><enum>8.</enum><header>Development and
			 Maintenance Funds</header>
			<subsection id="ID2cf7ae68f1dd45198c0a8a28055c5a88"><enum>(a)</enum><header>Definition of
			 funds</header><text>In this section, the term <term>Funds</term> means—</text>
				<paragraph id="IDd54824e820854ce8b27b803c01219b2b"><enum>(1)</enum><text>the Development Fund;
			 and</text>
				</paragraph><paragraph id="ID148e307a0c77435698443f096e1e2855"><enum>(2)</enum><text>the Maintenance
			 Fund.</text>
				</paragraph></subsection><subsection id="IDd6980ad87e9044cda4d4610467c6f55f"><enum>(b)</enum><header>Development
			 Fund</header>
				<paragraph id="ID2b6d12cfa17b424a98ec3c4085b81e35"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 <quote>Shoshone-Paiute Tribes Water Rights Development Fund</quote>.</text>
				</paragraph><paragraph id="IDdc5d6d58a08548d2b5542d031b6fd967"><enum>(2)</enum><header>Use of
			 funds</header><text>The Tribes shall use amounts in the Development Fund to
			 rehabilitate and, if the Tribes choose, to expand the Duck Valley Indian
			 Irrigation Project, or for any of the following purposes:</text>
					<subparagraph id="IDcd6e6a653af44b55ad31150bb7238c74"><enum>(A)</enum><text>To pay or reimburse costs
			 incurred by the Tribes in acquiring land and water rights.</text>
					</subparagraph><subparagraph id="ID5b755f421a9c43df9d93531cb878ed70"><enum>(B)</enum><text>For purposes of cultural
			 preservation.</text>
					</subparagraph><subparagraph id="ID86ffb39175744487932399d50904f0c5"><enum>(C)</enum><text>To restore or improve
			 fish or wildlife habitat.</text>
					</subparagraph><subparagraph id="ID0c390c477fb34f10b7bf7ba44e35d765"><enum>(D)</enum><text>For fish or wildlife
			 production, water resource development, or agricultural development.</text>
					</subparagraph><subparagraph id="IDace94f2a05f446528a7bbab79d99aef8"><enum>(E)</enum><text>For water resource
			 planning and development.</text>
					</subparagraph><subparagraph id="ID51e0eb86b7e642acb360d41055f413be"><enum>(F)</enum><text>To pay the costs
			 of—</text>
						<clause id="ID7981d79ff18945838814e13b7db1d9e5"><enum>(i)</enum><text>designing and
			 constructing water supply and sewer systems for tribal communities, including a
			 water quality testing laboratory;</text>
						</clause><clause id="ID3e22298edeb0473d9e097bb4bf3e8135"><enum>(ii)</enum><text>other appropriate
			 water-related projects and other related economic development projects;</text>
						</clause><clause id="ID487fb4d65ceb4ae19a878bea05ce6727"><enum>(iii)</enum><text>the development of a
			 water code; and</text>
						</clause><clause id="ID4786ef093d1448ed8382eaabdfff697c"><enum>(iv)</enum><text>other costs of
			 implementing the Agreement.</text>
						</clause></subparagraph></paragraph><paragraph id="ID86092671a43642c1ad228fd0b5308091"><enum>(3)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary for deposit in the Development Fund $9,000,000 for each of fiscal
			 years 2008 through 2012.</text>
				</paragraph></subsection><subsection id="ID66a35c7cd4f642129ca278e560226d3f"><enum>(c)</enum><header>Maintenance
			 fund</header>
				<paragraph id="ID32de6520d52d4aeab34dedeecb537624"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 <quote>Shoshone-Paiute Tribes Operation and Maintenance Fund</quote>.</text>
				</paragraph><paragraph id="IDda246a721b8448e787557ba5b9cbc626"><enum>(2)</enum><header>Use of
			 funds</header><text>The Tribes shall use amounts in the Maintenance Fund to pay
			 or provide reimbursement for—</text>
					<subparagraph id="IDd4d967bb331f4ba8be4358cb401a39fe"><enum>(A)</enum><text>operation, maintenance,
			 and replacement costs of the Duck Valley Indian Irrigation Project and other
			 water-related projects funded under this Act; or</text>
					</subparagraph><subparagraph id="ID1164abba0ffd4e7fabda7413ac7a465e"><enum>(B)</enum><text>operation, maintenance,
			 and replacement costs of water supply and sewer systems for tribal communities,
			 including the operation and maintenance costs of a water quality testing
			 laboratory.</text>
					</subparagraph></paragraph><paragraph id="ID1a879640a96c49c7814d86127cb4fa2f"><enum>(3)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary for deposit in the Maintenance Fund $3,000,000 for each of fiscal
			 years 2008 through 2012.</text>
				</paragraph></subsection><subsection id="IDa746d427c13549338ae33f27ec2d9ab8"><enum>(d)</enum><header>Availability of amounts
			 from Fund</header><text>Amounts made available under subsections (b)(3) and
			 (c)(3) shall be available for expenditure or withdrawal only after the
			 effective date as set forth in section 9(d).</text>
			</subsection><subsection id="IDfe394e4f8c36481a9e0839a9bfd569a1"><enum>(e)</enum><header>Administration of
			 funds</header><text>The Secretary, in accordance with the American Indian Trust
			 Fund Management Reform Act of 1994 (25 U.S.C. 4001 et seq.) shall manage the
			 Funds, including by investing amounts from the Funds in accordance with the Act
			 of April 1, 1880 (25 U.S.C. 161), and the first section of the Act of June 24,
			 1938 (25 U.S.C. 162a).</text>
			</subsection><subsection id="ID260d40b7630d4c64a3aa365a3009724e"><enum>(f)</enum><header>Expenditures and
			 withdrawal</header>
				<paragraph id="ID55ce8ed84c554799a1b83a28dc089dc6"><enum>(1)</enum><header>Tribal management
			 plan</header>
					<subparagraph id="ID9dc6458133b24ddb8da505360ea2ec04"><enum>(A)</enum><header>In
			 general</header><text>The Tribes may withdraw all or part of amounts in the
			 Funds on approval by the Secretary of a tribal management plan as described in
			 the American Indian Trust Fund Management Reform Act of 1994 (25 U.S.C. 4001 et
			 seq.).</text>
					</subparagraph><subparagraph id="ID326723882bf3486d94da9a948b8dfc42"><enum>(B)</enum><header>Requirements</header><text>In
			 addition to the requirements under the American Indian Trust Fund Management
			 Reform Act of 1994 (25 U.S.C. 4001 et seq.), the tribal management plan shall
			 require that the Tribes spend any amounts withdrawn from the Funds in
			 accordance with the purposes described in subsection (b)(2) or (c)(2).</text>
					</subparagraph><subparagraph id="ID504fd33559324b75a6b04228acc05c41"><enum>(C)</enum><header>Enforcement</header><text>The
			 Secretary may take judicial or administrative action to enforce the provisions
			 of any tribal management plan to ensure that any amounts withdrawn from the
			 Funds under the plan are used in accordance with this Act and the
			 Agreement.</text>
					</subparagraph><subparagraph id="ID4aa1f9e569c543e782b55fd7c9c6cffe"><enum>(D)</enum><header>Liability</header><text>If
			 the Tribes exercise the right to withdraw amounts from the Funds, neither the
			 Secretary nor the Secretary of the Treasury shall retain any liability for the
			 expenditure or investment of the amounts.</text>
					</subparagraph></paragraph><paragraph id="ID06de39782d3e4b06aa0b45c7cb3351b4"><enum>(2)</enum><header>Expenditure
			 plan</header>
					<subparagraph id="ID14939a89e6f14c5cabe5e422cb0711d8"><enum>(A)</enum><header>In
			 general</header><text>The Tribes shall submit to the Secretary for approval an
			 expenditure plan for any portion of the amounts in the Funds that the Tribes do
			 not withdraw under the tribal management plan.</text>
					</subparagraph><subparagraph id="IDe1560444c39f4914b9166498ea15f0f9"><enum>(B)</enum><header>Description</header><text>The
			 expenditure plan shall describe the manner in which, and the purposes for
			 which, amounts of the Tribes remaining in the Funds will be used.</text>
					</subparagraph><subparagraph id="ID48b0361c904244ceb03d122854f0c511"><enum>(C)</enum><header>Approval</header><text>On
			 receipt of an expenditure plan under subparagraph (A), the Secretary shall
			 approve the plan if the Secretary determines that the plan is reasonable and
			 consistent with this Act and the Agreement.</text>
					</subparagraph><subparagraph id="ID648ffbd14c0f4763b0ec6fb27a58a25e"><enum>(D)</enum><header>Annual
			 report</header><text>For each Fund, the Tribes shall submit to the Secretary an
			 annual report that describes all expenditures from the Fund during the year
			 covered by the report.</text>
					</subparagraph></paragraph><paragraph id="ID11b0cadf77f5469fb2744003de107885"><enum>(3)</enum><header>Funding
			 agreement</header><text>Notwithstanding any other provision of this Act, on
			 receipt of a request from the Tribes, the Secretary shall include an amount
			 from funds made available under this section in the funding agreement of the
			 Tribes under title IV of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 458aa et seq.), for use in accordance with subsections (b)(2)
			 and (c)(2). No amount made available under this Act may be requested until the
			 waivers under section 9(a) take effect.</text>
				</paragraph></subsection><subsection id="IDe3d9bf78d3914554a2fd9c26e0985397"><enum>(g)</enum><header>No per capita
			 payments</header><text>No amount from the Funds (including any interest income
			 accruing to the Funds) shall be distributed to a member of the Tribes on a per
			 capita basis.</text>
			</subsection></section><section changed="added" committee-id="SLIA00" id="IDce933b4f73c84101adfe706174b2e5cb" reported-display-style="italic"><enum>9.</enum><header>Tribal waiver and
			 release of claims</header>
			<subsection id="IDd4c82744e93f4960a4af5bab2073dc16"><enum>(a)</enum><header>Waiver and release of
			 claims by Tribes and United States as trustee for Tribes</header><text>The
			 Tribes and the United States on behalf of the Tribes, are authorized to execute
			 a waiver and release of—</text>
				<paragraph id="ID8e21c59defa7495183487e662ae45f85"><enum>(1)</enum><text>all claims for water
			 rights in, or for waters of, the East Fork of the Owyhee River that the Tribes,
			 or the United States as trustee for the Tribes, asserted or could have asserted
			 in any court proceeding; and</text>
				</paragraph><paragraph id="ID93bafbe2f0be43c9bda122169341a1fa"><enum>(2)</enum><text>all claims for damages,
			 losses, or injuries to water rights in the East Fork Owyhee River, including
			 claims of interference, diversion, or taking of water that the Tribes, or the
			 United States as trustee for the Tribes, asserted or could have asserted in any
			 court proceedings.</text>
				</paragraph></subsection><subsection id="ID906b93d00dcc42f59e30bc3a21ca130d"><enum>(b)</enum><header>Waiver and release of
			 claims against the United States</header><text>The Tribes are authorized to
			 execute a waiver and release of—</text>
				<paragraph id="ID9246eef2ed66455095ae9a6236b2a160"><enum>(1)</enum><text>all claims against the
			 United States, its agencies, or employees, for water rights in, or waters of,
			 the East Fork of the Owyhee River that the United States asserted or could have
			 asserted in any court proceeding;</text>
				</paragraph><paragraph id="ID4f23ed9c701547738312f7e0d7e18a92"><enum>(2)</enum><text>all claims for damages,
			 losses, or injuries to water rights, including claims of interference,
			 diversion, or taking of water, or claims for failure to protect, acquire, or
			 develop water or water rights within the East Fork of the Owyhee River, and
			 claims for fishing rights under any Executive order to the extent that an
			 injury to such a right resulted from a reduction in the quantity of water
			 available in the East Fork Owyhee River; that accrued on or before the
			 effective date specified in subsection (d), that the Tribes have asserted or
			 could have asserted against the United States, its agencies, or employees in
			 any court proceedings; and</text>
				</paragraph><paragraph id="IDffad7cd5cdc64e1e903f880c25932808"><enum>(3)</enum><text>all claims arising out of
			 the negotiation and adoption of the Agreement.</text>
				</paragraph></subsection><subsection id="ID3a866f7f11fe4c84b47576415f929ce6"><enum>(c)</enum><header>Retention of
			 rights</header><text>Notwithstanding the waivers and releases set forth in
			 subsections (a) and (b), the Tribes and their members and the United States as
			 trustee for the Tribes and their members, shall retain—</text>
				<paragraph id="IDb24c8ddc61204ed986260927910b2de2"><enum>(1)</enum><text>all claims for
			 enforcement of the Agreement, the Final Consent Decree, or this Act, through
			 such legal and equitable remedies as may be available in any court of competent
			 jurisdiction;</text>
				</paragraph><paragraph id="IDacb11c66f5d8442d90d67b3f80144564"><enum>(2)</enum><text>all rights to use and
			 protect water rights acquired pursuant to any state law;</text>
				</paragraph><paragraph id="ID97970ce26f634375b2109090ddd7f34f"><enum>(3)</enum><text>all claims relating to
			 activities affecting the quality of water;</text>
				</paragraph><paragraph id="IDeb0a7037ca8347ddaab93e8d6c3f3819"><enum>(4)</enum><text>all rights to land
			 outside the Reservation; and</text>
				</paragraph><paragraph id="ID8ae6c0b2ea0c42eaba6e9d1c529f455c"><enum>(5)</enum><text>all rights, remedies,
			 privileges, immunities, and powers not specifically waived and released under
			 the terms of the Agreement or this Act.</text>
				</paragraph></subsection><subsection id="ID1e14c4f566344be6914f55bc63da21a9"><enum>(d)</enum><header>Effective
			 date</header><text>Notwithstanding anything in the Agreement to the contrary,
			 the waivers by the Tribes, or the United States on behalf of the Tribes, under
			 this section shall take effect on the date on which the Secretary publishes in
			 the Federal Register a statement of findings that includes a finding
			 that—</text>
				<paragraph id="IDd88d24d4652b4e8bbf29dfa06936ae05"><enum>(1)</enum><text>the Secretary has
			 executed the Agreement as approved by Congress;</text>
				</paragraph><paragraph id="IDf18845c111284cc480eb47d6698d07e8"><enum>(2)</enum><text>all parties to the
			 Agreement have executed the Agreement;</text>
				</paragraph><paragraph id="IDfe0bdedecd97472ba56d12b6b9133c4e"><enum>(3)</enum><text>the Fourth Judicial
			 District Court, Elko County, Nevada has issued a judgment and decree consistent
			 with the Agreement from which no further appeal can be taken; and</text>
				</paragraph><paragraph id="ID02a5c4cbef374229b39322155723825f"><enum>(4)</enum><text>the amounts authorized
			 under subsections (b)(3) and (c)(3) of section 8 have been appropriated.</text>
				</paragraph></subsection><subsection id="ID6bbc1e5e1a574192ba40cce021114e16"><enum>(e)</enum><header>Failure To publish
			 statement of findings</header><text>If the Secretary does not publish a
			 statement of findings under subsection (d) by December 31, 2015—</text>
				<paragraph id="ID56a03e40d2a94af6914c8420dcea5776"><enum>(1)</enum><text>the Agreement and this
			 Act shall not take effect; and</text>
				</paragraph><paragraph id="ID5f06dd1258f042df9edbd7c3a71462f9"><enum>(2)</enum><text>any funds and interest
			 accrued thereon that have been appropriated under this Act shall immediately
			 revert to the general fund of the United States Treasury.</text>
				</paragraph></subsection><subsection id="ID65154eeb86514dcf974b4a7df678dcec"><enum>(f)</enum><header>Tolling of
			 claims</header>
				<paragraph id="IDd495cab71bc04b058867b5888ac8b29c"><enum>(1)</enum><header>In
			 general</header><text>Each applicable period of limitation and time-based
			 equitable defense relating to a claim described in this section shall be tolled
			 for the period beginning on the date of enactment of this Act and ending on the
			 date on which the amounts authorized to be appropriated under subsections
			 (b)(3) and (c)(3) of section 8 are appropriated.</text>
				</paragraph><paragraph id="ID3fb5d41f705046628ad8e1f9eafc9cd9"><enum>(2)</enum><header>Effect of
			 subparagraph</header><text>Nothing in this subparagraph revives any claim or
			 tolls any period of limitation or time-based equitable defense that expired
			 before the date of enactment of this Act.</text>
				</paragraph><paragraph id="ID9b1663a16e024829912646ca19c8b758"><enum>(3)</enum><header>Future acquisition of
			 water rights</header><text display-inline="yes-display-inline">Nothing in the
			 Agreement or this Act precludes the Tribes, or the United States as trustee for
			 the Tribes, from acquiring a water right in a state to the same extent as any
			 other entity in the state, in accordance with state law.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SLIA00" id="ID98aa8677b0c64c95a8f7c8fe33814662" reported-display-style="italic"><enum>10.</enum><header>Miscellaneous</header>
			<subsection id="IDa3c4e098c3d1430dac2869bc4310bba9"><enum>(a)</enum><header>General
			 disclaimer</header><text>The parties to the Agreement expressly reserve all
			 rights not specifically granted, recognized, or relinquished by—</text>
				<paragraph id="IDad2c037b95f9485e9c37ac4d34c618dd"><enum>(1)</enum><text>the settlement described
			 in the Agreement; or</text>
				</paragraph><paragraph id="IDba71a259eb0e421ca19d17535a372481"><enum>(2)</enum><text>this Act.</text>
				</paragraph></subsection><subsection id="IDc0edc12f18474c3fac1a68bed56dfc7b"><enum>(b)</enum><header>Limitation of claims
			 and rights</header><text>Nothing in this Act—</text>
				<paragraph id="ID975028523b3742029a90cb58485e9cb8"><enum>(1)</enum><text>establishes a standard
			 for quantifying—</text>
					<subparagraph id="ID989b7ff85b5440579426e12f20128d29"><enum>(A)</enum><text>a Federal reserved water
			 right;</text>
					</subparagraph><subparagraph id="ID0e414e799e3f4ec79b22abee5a0955cd"><enum>(B)</enum><text>an aboriginal claim;
			 or</text>
					</subparagraph><subparagraph id="ID246cd1a99bf34d5cbf41f2e9af4a0c01"><enum>(C)</enum><text>any other water right
			 claim of an Indian tribe in a judicial or administrative proceeding; or</text>
					</subparagraph></paragraph><paragraph id="IDb1ddbd5741084748a6dba656466d9ca0"><enum>(2)</enum><text>limits the right of a
			 party to the Agreement to litigate any issue not resolved by the Agreement or
			 this Act.</text>
				</paragraph></subsection><subsection id="ID5c7d4bf649af4aa2bfd93aa346488725"><enum>(c)</enum><header>Admission against
			 interest</header><text>Nothing in this Act constitutes an admission against
			 interest by a party in any legal proceeding.</text>
			</subsection><subsection id="ID787ce7a86a89414dbd5a63d78537e00e"><enum>(d)</enum><header>Reservation</header><text>The
			 Reservation shall be—</text>
				<paragraph id="IDa3db04346dd742e1ba6b8adf408e3bbb"><enum>(1)</enum><text>considered to be the
			 property of the Tribes; and</text>
				</paragraph><paragraph id="ID1ff32fb93a274b729457a3d8e3987ac2"><enum>(2)</enum><text>permanently held in trust
			 by the United States for the sole use and benefit of the Tribes.</text>
				</paragraph></subsection><subsection id="ID64529a021ae14bb4a859a8567e742adf"><enum>(e)</enum><header>Jurisdiction</header>
				<paragraph id="ID819bde0593a54941b867ab42f67c9b59"><enum>(1)</enum><header>Subject matter
			 jurisdiction</header><text>Nothing in the Agreement or this Act restricts,
			 enlarges, or otherwise determines the subject matter jurisdiction of any
			 Federal, State, or tribal court.</text>
				</paragraph><paragraph id="ID7adc5a30d21744f6a3d8af387acce1aa"><enum>(2)</enum><header>Civil or regulatory
			 jurisdiction</header><text>Nothing in the Agreement or this Act impairs or
			 impedes the exercise of any civil or regulatory authority of the United States,
			 the State, or the Tribes.</text>
				</paragraph><paragraph id="ID2c5c3a1e93df4fd6ba75e624a612c460"><enum>(3)</enum><header>Consent to
			 jurisdiction</header><text>The United States consents to jurisdiction in a
			 proper forum for purposes of enforcing the provisions of the Agreement.</text>
				</paragraph><paragraph id="ID3cba4f1ed1b34b1b94c4842abf6ab5f4"><enum>(4)</enum><header>Effect of
			 subsection</header><text>Nothing in this subsection confers jurisdiction on any
			 State court to—</text>
					<subparagraph id="ID95dee17fa2e44a9e9011a23ec9be2695"><enum>(A)</enum><text>enforce Federal
			 environmental laws relating to the duties of the United States under this Act;
			 or</text>
					</subparagraph><subparagraph id="ID7ea31f3d78f94898840101875e3691bd"><enum>(B)</enum><text>conduct judicial review
			 of a Federal agency action.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
