		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keeping the Internet Devoid of Sexual
			 Predators Act of 2008</short-title></quote> or the <quote><short-title>KIDS Act of 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id5FAEDE95D3AA4D32A888DFE9E0CD8EB1" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Registration of online identifiers of sex
			 offenders</header>
			<subsection commented="no" display-inline="no-display-inline" id="id14CD6F8AB74B4B2A9B03E23F7B84D431"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 114(a) of the Sex Offender
			 Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16914">42 U.S.C. 16914(a)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id486E6C9A1F7C4FB89499BB0DE1121FBE"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) through (7)
			 as paragraphs (5) through (8); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id793725B3F9D24A88B44CF72C71365062"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idF986F0141E774A82AF6E6D1568C82F65" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id1A6AB25E3D8840E0AC315B5E57780B3D"><enum>(4)</enum><text display-inline="yes-display-inline">Any electronic mail address or other
				designation the sex offender uses or will use for self-identification or
				routing in Internet communication or
				posting.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id9BEF2950FE9E490EA753D319F1908D27"><enum>(b)</enum><header>Updating of
			 information</header><text>Section 113(c) of the Sex Offender Registration and
			 Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16913">42 U.S.C. 16913(c)</external-xref>) is amended by adding at the end the
			 following: <quote>The Attorney General shall have the authority to specify the
			 time and manner for reporting of other changes in registration information,
			 including any addition or change of an electronic mail address or other
			 designation used for self-identification or routing in Internet communication
			 or posting.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1001BDDDA674433D9ADC5F7F1342330F"><enum>(c)</enum><header display-inline="yes-display-inline">Failure To register online
			 identifiers</header><text display-inline="yes-display-inline">Section 2250 of
			 title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id108DFF87A75B43BA9A11EB6CABAF40D6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or
			 (d)</quote> after <quote>subsection (a)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF00D1929D4984AC3B6A0340CD7A84ABA"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC4657CC47D314B35B996BE228F5CF567" style="OLC">
						<subsection id="id484D50B791CC4EDF8FBAC373FACEE18B"><enum>(d)</enum><header>Knowing failure
				To register online identifiers</header><text>Whoever—</text>
							<paragraph id="idDC4895DB89064259BA412F9BF1925750"><enum>(1)</enum><text>is required to
				register under the Sex Offender Registration and Notification Act (42 U.S.C.
				16901 et seq.); and</text>
							</paragraph><paragraph id="idEF232CCA4F794B72BDDB2221782962F8"><enum>(2)</enum><text>uses an email
				address or any other designation used for self-identification or routing in
				Internet communication or posting which the individual knowingly failed to
				provide for inclusion in a sex offender registry as required under that
				Act;</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be
				fined under this title or imprisoned not more than 10 years, or
				both.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id0FE43F3286AA4F2DAE0B1737D555D1B9"><enum>(d)</enum><header>Conforming
			 amendment; Directive to United States Sentencing Commission</header><text display-inline="yes-display-inline">Section 141(b) of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/248">Public Law 109–248</external-xref>; 120 Stat. 602) is
			 amended by striking <quote>offense specified in subsection (a)</quote> and
			 inserting <quote>offenses specified in subsections (a) and (d) of section 2250
			 of title 18, United States Code</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id1E8291DD194F4CD4861EC957F852DFDB" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Checking of online identifiers against sex
			 offender registration information</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1270CF97A6C443CE99071521711588DF"><enum>(a)</enum><header display-inline="yes-display-inline">Public access</header><text display-inline="yes-display-inline">Section 118(b) of the Sex Offender
			 Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16918">42 U.S.C. 16918(b)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID977b0c10eabb4e2e803f57b1958c2080"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd5c2deac5f5042f7b43593d09fd911a0"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph
			 (5); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB019833F37C840F7A74D6CA521A396F0"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idA0813CB75C52452FA6DA00BCC011554D" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID760dc58931794ff4b9894a4e15ceeae9"><enum>(4)</enum><text display-inline="yes-display-inline">any electronic mail address or designation
				used for self-identification or routing in Internet communication or posting;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idF0030CE3C84F49B282DFD4A6D401CB3E"><enum>(b)</enum><header>Online
			 identifier checking system for social networking websites</header><text>Section
			 121 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16921">42 U.S.C. 16921</external-xref>) is
			 amended by adding at the end the following:</text>
			</subsection><subsection id="idF6F0C5B41A4F4828AA022A20CACFBCE6"><enum>“(d)</enum><header>Checking
			 system for social networking websites</header>
				<paragraph id="id3614304143E64C1FB8D0095F509E2504"><enum>“(1)</enum><header>In
			 general</header><text>The Attorney General shall maintain a system available to
			 social networking websites that permits the automated comparison of lists or
			 databases of the electronic mail addresses and other designations used for
			 self-identification or routing in Internet communication or posting of the
			 registered users of such websites, to the corresponding information contained
			 in or derived from sex offender registries.</text>
				</paragraph><paragraph id="idDBC48DF985884F3D877F53CC840E93EE"><enum>“(2)</enum><header>Qualification
			 for use of system</header><text>A social networking website seeking to use the
			 system established under paragraph (1) shall submit an application to the
			 Attorney General which provides—</text>
					<subparagraph id="id2D05AFEC81AF41C5BA4D9DA3BFE5F168"><enum>“(A)</enum><text>the name and
			 legal status of the website;</text>
					</subparagraph><subparagraph id="id7BFC2D7CF34B4888A07F6B601DB3BDEA"><enum>“(B)</enum><text>the contact
			 information for the website;</text>
					</subparagraph><subparagraph id="id8E4240A023AF44F8A2166D8919CB2DD6"><enum>“(C)</enum><text>a description of
			 the nature and operations of the website;</text>
					</subparagraph><subparagraph id="id6613E22107E746909BDED80947141037"><enum>“(D)</enum><text>a statement
			 explaining why the website seeks to use the system; and</text>
					</subparagraph><subparagraph id="id722442BD14FB45E09D73D1D74B2F6788"><enum>“(E)</enum><text>such other
			 information or attestations as the Attorney General may require to ensure that
			 the website will use the system—</text>
						<clause id="id7AEE0B7B5BBA4D75AE1143317EE4C3BB"><enum>“(i)</enum><text>to
			 protect the safety of the users of such website; and</text>
						</clause><clause id="idD72F73EE74E84EAAAA812F093931945A"><enum>“(ii)</enum><text>not for any
			 unlawful or improper purpose.</text>
						</clause></subparagraph></paragraph><paragraph id="idCBD63135E5F94427A4AD9A8ACEA0C75C"><enum>“(3)</enum><header>Searches
			 against the system</header>
					<quoted-block display-inline="no-display-inline" id="id4438E23AD8BC44218602697D9192E60E" style="OLC">
						<subparagraph id="idF5574FEC971C4D718A4F40BF8F1C73A5"><enum>(A)</enum><header>In
				general</header><text>A social networking website approved to use the system
				established under paragraph (1) shall—</text>
							<clause id="idAF725599A56848EDAFD8258BE9D80796"><enum>(i)</enum><text>submit the
				information to be compared in a form satisfying the technical requirements for
				searches against the system; and</text>
							</clause><clause id="id3BB44749913D47ABA99E2369FA7CD3C6"><enum>(ii)</enum><text>pay any fee
				established by the Attorney General for use of the system.</text>
							</clause></subparagraph><subparagraph id="idDA378B389F4242969F7140CA47A93604"><enum>(B)</enum><header>Frequency of
				use of the system</header><text>A social networking website approved by the
				Attorney General to use the system established under paragraph (1) may conduct
				searches under the system as frequently as the Attorney General may
				allow.</text>
						</subparagraph><subparagraph id="idBA16C60777C44EAABD36DF8BB3C0A2E7"><enum>(C)</enum><header>Authority of AG
				to suspend use</header><text>The Attorney General may deny, suspend, or
				terminate use of the system by a social networking website that—</text>
							<clause id="id15678C4632CF4D8097AB9485B185316A"><enum>(i)</enum><text>provides false
				information in its application for use of the system; or</text>
							</clause><clause id="id295614A349CC4E48BE4BD52A328E7E8A"><enum>(ii)</enum><text>may be using or
				seeks to use the system for any unlawful or improper purpose.</text>
							</clause></subparagraph><paragraph id="id50882348EC89443AA1455CB8A91B0833"><enum>(4)</enum><header>Limitation on
				release of internet identifiers</header>
							<subparagraph id="idCF4ACAB6511A4A5B86733291D9FEE08F"><enum>(A)</enum><header>No public
				release</header><text>Neither the Attorney General nor a social networking
				website approved to use the system established under paragraph (1) may release
				to the public any list of the e-mail addresses or other designations used for
				self-identification or routing in Internet communication or posting of sex
				offenders contained in the system.</text>
							</subparagraph><subparagraph id="id50E75576A97C49999C3819BF5508A256"><enum>(B)</enum><header>Additional
				limitations</header><text>The Attorney General shall limit the release of
				information obtained through the use of the system established under paragraph
				(1) by social networking websites approved to use such system.</text>
							</subparagraph><subparagraph id="id9837186CB1054100B84D784B2BD65A6B"><enum>(C)</enum><header>Strict
				adherence to limitation</header><text>The use of the system established under
				paragraph (1) by a social networking website shall be conditioned on the
				website's agreement to observe the limitations required under this
				paragraph.</text>
							</subparagraph><subparagraph id="id5F1955E7B90F441287E1FA676D5C2006"><enum>(D)</enum><header>Rule of
				construction</header><text>This subsection shall not be construed to limit the
				authority of the Attorney General under any other provision of law to conduct
				or to allow searches or checks against sex offender registration
				information.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5BF494728F044B31B310CE713FFB5B41"><enum>(5)</enum><header display-inline="yes-display-inline">Limitation on Liability</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA24920C9ED95481CA7084F44259FF9F8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A civil claim against a social networking
				website, including any director, officer, employee, parent, or agent of that
				social networking website, arising from the use by such website of the National
				Sex Offender Registry, may not be brought in any Federal or State court.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96E97DE7685C491A82FA77D0084C102A"><enum>(B)</enum><header display-inline="yes-display-inline">Intentional, reckless, or other
				misconduct</header><text display-inline="yes-display-inline">Subsection (a)
				shall not apply to a claim if the social networking website, or a director,
				officer, employee, or agent of that social networking website—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID83a90a30f6ae4cb2b8e323db077b41a6"><enum>(i)</enum><text display-inline="yes-display-inline">engaged in intentional misconduct;
				or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID6bc08dfea54d424c9d0517ec71fe3616"><enum>(ii)</enum><text display-inline="yes-display-inline">acted, or failed to act—</text>
									<subclause commented="no" display-inline="no-display-inline" id="IDae7a8506c12d4732a5e0266aba3d90a3"><enum>(I)</enum><text display-inline="yes-display-inline">with actual malice;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8030272d01134ae7a7a348a3c546f064"><enum>(II)</enum><text display-inline="yes-display-inline">with reckless disregard to a substantial
				risk of causing injury without legal justification; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2ade2b828fc142748ce16cb425d88a21"><enum>(III)</enum><text display-inline="yes-display-inline">for a purpose unrelated to the performance
				of any responsibility or function described in paragraph (3).</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8457717893E8478A9E7C8ED024F6B65A"><enum>(C)</enum><header display-inline="yes-display-inline">Ordinary business activities</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an act or
				omission to act relating to an ordinary business activity of any social
				networking website, including to any acts related to the general administration
				or operations of such website, the use of motor vehicles by employees or agents
				of such website, or any personnel management decisions of such websites.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8744029E2A1E484CB0A3C134A05E5CF4"><enum>(D)</enum><header display-inline="yes-display-inline">Minimizing access</header><text display-inline="yes-display-inline">A social networking website shall minimize
				the number of employees that are provided access to the list of electronic mail
				addresses, and other designations used for self-identification or routing in
				Internet communication or posting by persons in the National Sex Offender
				Registry.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93688DA3407F489CBC57E34DC7FB61BC"><enum>(6)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing is this section shall be construed
				to require any Internet website, including a social networking website, to
				compare its database of registered users with the list of electronic mail
				addresses and other designations used for self-identification or routing in
				Internet communication or posting by persons in the National Sex Offender
				Registry, and no Federal or State liability, or any other actionable adverse
				consequence, shall be imposed on such website based on its decision not to
				compare its database with such
				list.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF72B16C1C50D4AB18DA0E6974999A4AD" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 111 of the Sex Offender Registration
			 and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idF811241B7D74458FB7E2859411992572" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="ID6a19efcd01ab4989a7dadadf9d96bcd1"><enum>(15)</enum><text display-inline="yes-display-inline">The term <term>social networking
				website</term> means an Internet website that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDd29f7de6403e425d805547591c27cf63"><enum>(A)</enum><text display-inline="yes-display-inline">allows users, through the creation of web
				pages or profiles or by other means, to provide information about themselves
				that is available publicly or to other users; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdf2cd376c37546d7bdbd68a6c755a5ef"><enum>(B)</enum><text display-inline="yes-display-inline">offers a mechanism for communication with
				other users.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID148e668eb3a74bc6a1e5510ce090eb89"><enum>(16)</enum><text display-inline="yes-display-inline">The term <term>Internet</term> has the
				meaning given that term in section 1101 of the Internet Tax Freedom Act (47
				U.S.C. 151 note).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf82203313aa648a7880842ffa29966b7"><enum>(17)</enum><text display-inline="yes-display-inline">The term <term>electronic mail
				address</term> has the meaning given that term in section 3 of the Controlling
				the Assault of Non-Solicited Pornography and Marketing Act of 2003 (15 U.S.C.
				7702).</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="IDd254dc06ee4541c6b3b764671484e2ff" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Criminalization of age misrepresentation in
			 connection with online solicitation of a minor</header>
		</section><section display-inline="yes-display-inline" id="id5EE60D441C804E49B545C512E4E56124" section-type="undesignated-section"><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2422">Section 2422</external-xref> of title 18, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id90A2180F7C8D40C7AD184D271857D9BB" style="OLC">
				<subsection id="id33E8A133014248F5A42CBBB7F2DF6D48"><enum>(c)</enum><header>Misrepresentation
				of age</header><text>Whoever knowingly misrepresents his or her age using the
				Internet or any other facility or means of interstate or foreign commerce or
				the mail, with the intent to further or facilitate a violation of this section,
				shall be fined under this title and imprisoned not more than 20 years. A
				sentence imposed under this subsection shall be in addition and consecutive to
				any sentence imposed for the offense the age misrepresentation was intended to
				further or
				facilitate.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H1E653E6E73B440828888F8A9ADDD8E4F" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Knowingly accessing child pornography with
			 the intent to view child pornography</header>
			<subsection commented="no" display-inline="no-display-inline" id="idB730089D7E8048A49BE3CFC05715B1E9"><enum>(a)</enum><header display-inline="yes-display-inline">Materials involving sexual exploitation of
			 minors</header><text display-inline="yes-display-inline">Section 2252(a)(4)
			 of title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H9650FE6E012644E58200E59D7ECD6C2D"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>,
			 or knowingly accesses with intent to view,</quote> after
			 <quote>possesses</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40D17FE8EBC8493DB0DF00CC09FF1992"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>,
			 or knowingly accesses with intent to view,</quote> after
			 <quote>possesses</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC3AF12706CA64364AF0D04E606977E56"><enum>(b)</enum><header display-inline="yes-display-inline">Materials constituting or containing child
			 pornography</header><text display-inline="yes-display-inline">Section 2252A(a)(5)
			 of title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id18F52F39A9B4430183AF0868C5F2B2E5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>,
			 or knowingly accesses with intent to view,</quote> after
			 <quote>possesses</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC9837FF6E52945B2B8A0AFEF1736134B"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>,
			 or knowingly accesses with intent to view,</quote> after
			 <quote>possesses</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id75159F5551FC455CB254CD08EDF27C73" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Clarifying ban of child
			 pornography</header>
			<subsection commented="no" display-inline="no-display-inline" id="id6A83FD05BDC348EE92D330FECE3D87F9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF0EC21A678EF487AAC702ED7556D09BE"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2251—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id31B11D2E16ED47499157D51643E43EC9"><enum>(A)</enum><text display-inline="yes-display-inline">in each of subsections (a), (b), and (d),
			 by inserting <quote>using any means or facility of interstate or foreign
			 commerce or</quote> after <quote>be transported</quote>;</text>

			 constituting or containing child pornography</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2252A">Section 2252A(a)(6)(C)</external-xref> of title 18, United
			 States Code, is amended by striking <quote>or by transmitting</quote> and all
