		<official-title display="yes">To amend the Water Resources Development
		  Act of 1999 to direct the Secretary of the Army to provide assistance to design
		  and construct a project to provide a continued safe and reliable municipal
		  water supply system for Devils Lake, North Dakota.</official-title>

			<subsection commented="no" display-inline="no-display-inline" id="ID81439D8E453C43C997BCF4D24FC7DF96"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Water Resources
			 Development Act of 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/106/53">Public Law 106–53</external-xref>;
			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/113/269">113
			 Stat. 269</external-xref>) is amended by inserting after section 597 the
			 following:</text>

					<section commented="no" display-inline="no-display-inline" id="ID82AC0DC744FF44A7A3741B147ABAFF99" section-type="subsequent-section"><enum>598.</enum><header>Devils lake, North
				Dakota</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDC1798E37041A4ED78717EDC1D3A86659"><enum>(a)</enum><header>Definition of
				project</header><text display-inline="yes-display-inline">In this section, the
				term <term>project</term> means a project to provide a continued safe and
				reliable municipal water supply system for Devils Lake, North Dakota.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4D39B44F836342A6A8C15AB1417DC598"><enum>(b)</enum><header>Local
				cooperation agreement</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDD4C3BEA6FDF84833B39EF4B935C642BA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to paragraph
				(2), the Secretary shall enter into a local cooperation agreement with the
				non-Federal interest to provide assistance in designing and constructing the
				project.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF01C0EA943944AE69A214942CF7C6F70"><enum>(2)</enum><header>Responsibility
				for design work</header><text display-inline="yes-display-inline">At the option
				of the non-Federal interest, the non-Federal interest may complete the design
				work for the project.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2527C9F95E824304A210ED5A25EBA19A"><enum>(3)</enum><header>NEPA</header><text display-inline="yes-display-inline">The Secretary shall comply with all
				applicable requirements under the <act-name parsable-cite="NEPA69">National
				Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) before
				beginning construction on the project.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD7B97D7EB0B14B068017BAC203EFC4E1"><enum>(4)</enum><header>Requirements</header><text display-inline="yes-display-inline">The local cooperation agreement entered
				into under this subsection shall provide for—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID946DE03F4CF84E3E84513210112A10BA"><enum>(A)</enum><text display-inline="yes-display-inline">the development by local officials of a
				water supply project and related facilities, including appropriate engineering
				plans and specifications; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6794D1235A2E40D58A63C1D9F8876536"><enum>(B)</enum><text display-inline="yes-display-inline">the establishment of such legal and
				institutional structures as are necessary to ensure the effective long-term
				operation of the project by the non-Federal interest.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID562FE58F2E124EA19C080B449F8FA157"><enum>(5)</enum><header>Cost
				sharing</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDE7919C05A6B2483CAA28DA8088976B02"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The local cooperation
				agreement shall provide that the Federal share of the cost of the
				project—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID92F59259ED1B4C6384CAF3C28BB29D79"><enum>(i)</enum><text display-inline="yes-display-inline">shall be 75 percent; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID84759B82D0D54E61AF4130FC6E2CE420"><enum>(ii)</enum><text display-inline="yes-display-inline">may be in the form of grants or
				reimbursements of project costs.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID341D73BDE4E84BC880D65612380F20F1"><enum>(B)</enum><header>Credit for
				design and engineering work</header><text display-inline="yes-display-inline">The non-Federal interest shall receive
				credit, not to exceed 6 percent of the total construction costs of the project,
				for the reasonable costs of design and engineering work completed by the
				non-Federal interest before entering into a local cooperation agreement with
				the Secretary under this subsection for the project.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6D290761982E4631AC8CF5D2CED10A18"><enum>(C)</enum><header>Credit for
				interest</header><text display-inline="yes-display-inline">In case of a delay
				in the funding of the Federal share of the project costs, the non-Federal
				interest shall receive credit for reasonable interest incurred in providing the
				Federal share of the cost of the project.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6504E927A9C24B6293062D1AAE2E9C34"><enum>(D)</enum><header>Credit for
				land, easements, and rights-of-way</header><text display-inline="yes-display-inline">The non-Federal interest shall receive
				credit, not to exceed 25 percent of the total cost of the project, for land,
				easements, rights-of-way, and relocations toward the non-Federal share of
				project costs (including all reasonable costs associated with obtaining permits
				necessary for the construction, operation, and maintenance of the project on
				publicly owned or controlled land).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB4A2811E65AC43AB830E6824CF3131A1"><enum>(E)</enum><header>Operation and
				maintenance</header><text display-inline="yes-display-inline">The non-Federal
				share of operation and maintenance costs for the project shall be 100
				percent.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID24F6CDFF0C744DEAB16F35DF57A314D8"><enum>(c)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section $15,000,000, to remain
				available until
				expended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4C8FF049133745FA93B20638C424A908"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents of the Water Resources Development Act of 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/106/53">Public Law
			 106–53</external-xref>;
			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/113/269">113
			 Stat. 269</external-xref>) is amended by inserting after the item relating to
			 section 597 the following:</text>
