		<official-title display="yes">To recognize the heritage of hunting and
		  provide opportunities for continued hunting on Federal public
		  land.</official-title>

		<section commented="no" display-inline="no-display-inline" id="IDAAF493B3CA27484F99B07CA080099EFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hunting Heritage Protection
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID48BC45A1872D42718DD4F242C4DE7BEA" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID1A515BE0A1034E918B00FFD9CB5C4B3F"><enum>(1)</enum><text display-inline="yes-display-inline">recreational hunting is an important and
			 traditional recreational activity in which 13,000,000 people in the United
			 States 16 years of age and older participate;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7110A06771B2435194ACCB707E534F54"><enum>(2)</enum><text display-inline="yes-display-inline">hunters have been and continue to be among
			 the foremost supporters of sound wildlife management and conservation practices
			 in the United States;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8848A691D863470B9063253EDFC81206"><enum>(3)</enum><text display-inline="yes-display-inline">persons who hunt and organizations relating
			 to hunting provide direct assistance to wildlife managers and enforcement
			 officers of the Federal Government and State and local governments;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60FD49B5736448559304E3D8711FB6B6"><enum>(4)</enum><text display-inline="yes-display-inline">purchases of hunting licenses, permits, and
			 stamps and excise taxes on goods used by hunters have generated billions of
			 dollars for wildlife conservation, research, and management;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEF0B6E1E5F89460CA6E8C064F4742333"><enum>(5)</enum><text display-inline="yes-display-inline">recreational hunting is an essential
			 component of effective wildlife management by—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDDB04EC236DB4403800D271A929DFD8B4"><enum>(A)</enum><text display-inline="yes-display-inline">reducing conflicts between people and
			 wildlife; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE3257B1D58C344F092E3E886F4CDB4EE"><enum>(B)</enum><text display-inline="yes-display-inline">providing incentives for the conservation
			 of—</text>
					<clause commented="no" display-inline="no-display-inline" id="IDF0B6294D0F9D4E539566C2C7E5BAF336"><enum>(i)</enum><text display-inline="yes-display-inline">wildlife; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDD25B3842B4904EEC888C8E67DBCB1EEC"><enum>(ii)</enum><text display-inline="yes-display-inline">habitats and ecosystems on which wildlife
			 depend;</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEDEDF371612E4CCE91F77FA97D6C0102"><enum>(6)</enum><text display-inline="yes-display-inline">each State has established at least 1
			 agency staffed by professionally trained wildlife management personnel that has
			 legal authority to manage the wildlife in the State; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD6388DA14EA2470EBFB834A49C067D20"><enum>(7)</enum><text display-inline="yes-display-inline">recreational hunting is an environmentally
			 acceptable activity that occurs, and can be provided for, on Federal public
			 land without adverse effects on other uses of the land.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID6AC1CC28312C4108945CB283D498D9CD" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID9A192DC090EF40B282498D8FB489D34C"><enum>(1)</enum><header>Agency
			 head</header><text display-inline="yes-display-inline">The term <term>agency
			 head</term> means the head of any Federal agency that has authority to manage a
			 natural resource or Federal public land on which a natural resource
			 depends.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22CC0AEBFA474043923D2C30FF003E08"><enum>(2)</enum><header>Federal public
			 land</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID6E1903AEB8984DEB9B040039B203E2D2"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>Federal public land</term> means any land or water that is—</text>
					<clause commented="no" display-inline="no-display-inline" id="ID3AC93023DB2048ED88433CA20098D345"><enum>(i)</enum><text display-inline="yes-display-inline">publicly accessible;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID7B4779D452DC4E8297A250824B85E8BB"><enum>(ii)</enum><text display-inline="yes-display-inline">owned by the United States; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID949F8F1B5F2A4FE7A6C6438952CA4F35"><enum>(iii)</enum><text display-inline="yes-display-inline">managed by an executive agency for purposes
			 that include the conservation of natural resources.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID38EB80B2D93946AB86AF6371D074769D"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>Federal public land</term>
			 does not include any land held in trust for the benefit of an Indian tribe or
			 member of an Indian tribe.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05D2AC55390849C2B7169C754B2EDC4B"><enum>(3)</enum><header>Hunting</header><text display-inline="yes-display-inline">The term <term>hunting</term> means the
			 lawful—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID1EC5A46DF62D40BAAFE633AFA98BDBC6"><enum>(A)</enum><text display-inline="yes-display-inline">pursuit, trapping, shooting, capture,
			 collection, or killing of wildlife; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6B4B0BD5DF634A8CAD27E2DF2880D506"><enum>(B)</enum><text display-inline="yes-display-inline">attempt to pursue, trap, shoot, capture,
			 collect, or kill wildlife.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID603B030ABA7F46E48DC5799D9083A258" section-type="subsequent-section"><enum>4.</enum><header>Recreational
			 hunting</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDDD2BA5E12CD5442A9434A21CE016CA78"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to valid
			 existing rights, Federal public land shall be open to access and use for
			 recreational hunting except as limited by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0EC5D9D8CCFF479BAFF48BB322D2B670"><enum>(1)</enum><text display-inline="yes-display-inline">the agency head with jurisdiction over the
			 Federal public land—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDD4936824674447C68540B35289B5D630"><enum>(A)</enum><text display-inline="yes-display-inline">for reasons of national security;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1AD23F07AE194AA0AD76DE8DA778586E"><enum>(B)</enum><text display-inline="yes-display-inline">for reasons of public safety; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID55B5A2C21CED4463BAD20211AEBC003F"><enum>(C)</enum><text display-inline="yes-display-inline">for any other reasons for closure
			 authorized by applicable Federal law; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F6AE5F2492646A1AF6DE4CAD0899C7C"><enum>(2)</enum><text display-inline="yes-display-inline">any law (including regulations) of the
			 State in which the Federal public land is located that is applicable to
			 recreational hunting.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID09A880261FD54741B292A760F4DA15D2"><enum>(b)</enum><header>Management</header><text display-inline="yes-display-inline">Consistent with subsection (a), to the
			 extent authorized under State law (including regulations), and in accordance
			 with applicable Federal law (including regulations), each agency head shall
			 manage Federal public land under the jurisdiction of the agency head in a
			 manner that supports, promotes, and enhances recreational hunting
			 opportunities.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID449E6D1D49DE4F3BAEA87F253F0983D6"><enum>(c)</enum><header>No net
			 loss</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID35C7F6403BE04D40B302FCF611417E8D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Federal public land
			 management decisions and actions should, to the maximum extent practicable,
			 result in no net loss of land area available for hunting opportunities on
			 Federal public land.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2E56AE20D31945158E7FD8A6DCF84856"><enum>(2)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Not later than October
			 1 of each year, each agency head with authority to manage Federal public land
			 on which recreational hunting occurs shall submit to the Committee on
			 Agriculture, Nutrition, and Forestry and the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Agriculture and the Committee on
			 Natural Resources of the House of Representatives a report that
			 describes—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID6B898A780FD64A7900FC6029325172F8"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="ID72CE1D10FF104BBB8FDB00C3A8115402"><enum>(i)</enum><text display-inline="yes-display-inline">any Federal public land administered by the
			 agency head that was closed to recreational hunting at any time during the
			 preceding year; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID3ECCC07C6E70441CB198BD14FE435CA1" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the reason for the closure; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBC38C06163A0452C8E0063A4656600A1"><enum>(B)</enum><text display-inline="yes-display-inline">areas administered by the agency head that
			 were opened to recreational hunting to compensate for the closure of the areas
			 described in subparagraph (A)(i).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB695A5BC034E475D92142C50C49079EF"><enum>(3)</enum><header>Closures of
			 5,000 or more acres</header><text display-inline="yes-display-inline">The
			 withdrawal, change of classification, or change of management status that
			 effectively closes 5,000 or more acres of Federal public land to access or use
			 for recreational hunting shall take effect only if, before the date of
			 withdrawal or change, the agency head that has jurisdiction over the Federal
			 public land submits to the Committee on Agriculture, Nutrition, and Forestry
			 and the Committee on Energy and Natural Resources of the Senate and the
			 Committee on Agriculture and the Committee on Natural Resources of the House of
			 Representatives written notice of the withdrawal or change.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID13099329F7D64CEC86F62516B15C34E7"><enum>(d)</enum><header>Areas not
			 affected</header><text display-inline="yes-display-inline">Nothing in this Act
			 compels the opening to recreational hunting of national parks or national
			 monuments under the jurisdiction of the Secretary of the Interior.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID89A7B239CD724D6196AA97718977CB78"><enum>(e)</enum><header>No
			 priority</header><text display-inline="yes-display-inline">Nothing in this Act
			 requires a Federal agency to give preference to hunting over other uses of
			 Federal public land or over land or water management priorities established by
			 Federal law.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF6094621BE9E4F169B05DD000589971F"><enum>(f)</enum><header>Authority of
			 the States</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF593380F924049DFB91B33DFBDC1995F"><enum>(1)</enum><header>Savings</header><text display-inline="yes-display-inline">Nothing in this Act affects the authority,
			 jurisdiction, or responsibility of a State to manage, control, or regulate fish
			 and wildlife under State law (including regulations) on land or water in the
			 State, including Federal public land.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCD586C3EABA1404AAE95CCC96D373FBA"><enum>(2)</enum><header>Federal
			 licenses</header><text display-inline="yes-display-inline">Nothing in this Act
			 authorizes an agency head to require a license or permit to hunt, fish, or trap
			 on land or water in a State, including on Federal public land in the
			 State.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAF9D6AA36C874131B199FAB5939CFE22"><enum>(3)</enum><header>State right of
			 action</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID9365F167A61C410AB89E376CE3B92F6D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any State aggrieved
			 by the failure of an agency head or employee to comply with this Act may bring
			 a civil action in the United States District Court for the district in which
			 the failure occurs for a permanent injunction.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID71CC58F2F48A470EAF93C9A894D3C000"><enum>(B)</enum><header>Preliminary
			 injunction</header><text display-inline="yes-display-inline">If the district
			 court determines, based on the facts, that a preliminary injunction is
			 appropriate, the district court may grant a preliminary injunction.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID14C1976481494F8F0095C7B429CB7611"><enum>(C)</enum><header>Court
			 costs</header><text display-inline="yes-display-inline">If the district court
			 issues an injunction under this paragraph or otherwise finds in favor of the
			 State, the district court shall award to the State any reasonable costs of
			 bringing the civil action (including an attorney’s fee).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
