		<official-title>To ensure local governments have the flexibility needed
		  to enhance decision-making regarding certain mass transit
		  projects.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Transit System Flexibility
			 Protection Act of 2007</short-title></quote>.</text>
		</section><section id="id400136CFACDF4ECB86EAA38BE0429C6E"><enum>2.</enum><header>General
			 authority</header><text display-inline="no-display-inline">Section 5307(b)(1)
			 of title 49, United States Code, is amended by striking subparagraph (E) and
			 inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id41DFD6C4CAF04DD39E49AEFA18F1C72F" style="OLC">
				<subparagraph id="ID37c362476db1470f8c59ca1c381cb03d"><enum>(E)</enum><text>operating costs
				of equipment and facilities for use in public transportation in an urbanized
				area with a population of more than 200,000, if such public transportation
				system operates less than 100 buses on fixed-route service during peak service
				hours;
				and</text>
