		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Court Security Improvement Act of
			 2007</short-title></quote>.</text>
		</section><title commented="no" id="H6389BB1535F646488674CC2123AE8460" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Judicial security improvements and
			 funding</header>
			<section commented="no" display-inline="no-display-inline" id="HE49FAF95DB514BD2A9ACCA3D6EF37C1B" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Judicial branch security
			 requirements</header>
				<subsection commented="no" display-inline="no-display-inline" id="H6CB927AC8EA44589B3AB3B1CE37B00C0"><enum>(a)</enum><header display-inline="yes-display-inline">Ensuring consultation with the
			 judiciary</header><text display-inline="yes-display-inline">Section 566 of
			 title 28, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H5490065BDE224F0300B4D8FD278E842" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="H91B23CB62FAE4748A4426C5B3196F8A5"><enum>(i)</enum><text display-inline="yes-display-inline">The Director of the United States Marshals
				Service shall consult with the Judicial Conference of the United States on a
				continuing basis regarding the security requirements for the judicial branch of
				the United States Government, to ensure that the views of the Judicial
				Conference regarding the security requirements for the judicial branch of the
				Federal Government are taken into account when determining staffing levels,
				setting priorities for programs regarding judicial security, and allocating
				judicial security resources. In this paragraph, the term <term>judicial
				security</term> includes the security of buildings housing the judiciary, the
				personal security of judicial officers, the assessment of threats made to
				judicial officers, and the protection of all other judicial personnel. The
				United States Marshals Service retains final authority regarding security
				requirements for the judicial branch of the Federal
				Government.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H0E9EF7B7D3FA458AB002BE806481DBE2"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 331 of title 28, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="HD9FC8E89CC0F4D4582001C6FED99D5E" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="HA1FF79FB3D034106A937F9C779E8A7A"><enum></enum><text display-inline="yes-display-inline">The Judicial Conference shall consult with
				the Director of United States Marshals Service on a continuing basis regarding
				the security requirements for the judicial branch of the United States

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HB0CCEF299D9F4D99B1EB636E98C87CEB" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Protection of family members</header><text display-inline="no-display-inline">Section 105(b)(3) of the Ethics in
			 Government Act of 1978 (5 U.S.C. App.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HAFE1D01AC2AF44ECADC396DC217F3221"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or
			 a family member of that individual</quote> after <quote>that
			 individual</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CF01EF2FFD6461DBD837DCE87E61156"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by inserting
			 <quote>or a family member of that individual</quote> after <quote>the
			 report</quote>.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H2D67AEB6D24049F30020A9F0322707B0" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Financial disclosure reports</header>
				<subsection commented="no" display-inline="no-display-inline" id="H4CEECD9B584E48A5B21554C98B61F8D3"><enum>(a)</enum><header display-inline="yes-display-inline">Extension of authority</header><text display-inline="yes-display-inline">Section 105(b)(3) of the Ethics in
			 Government Act of 1978 (5 U.S.C. App) is amended by striking
			 <quote>2005</quote> each place that term appears and inserting
			 <quote>2009</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H315A0D093C74456AA470615CE482EFD0"><enum>(b)</enum><header display-inline="yes-display-inline">Report contents</header><text display-inline="yes-display-inline">Section 105(b)(3)(C) of the Ethics in
			 Government Act of 1978 (5 U.S.C. App) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H535A1C9296B54F63B03F434304B3DDC5"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>and</quote> at the end;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDAD8AB6FF5E5405083442EEAAB523982"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), by striking the period at

				to
				redaction.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HAB7EAC7CEC244C7697CB3939C000DE8" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Protection of United States Tax
			 Court</header>
				<subsection commented="no" display-inline="no-display-inline" id="H6A020BB1A07148B9B44F1CBF7EBB1D6C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 566(a) of title 28, United States
			 Code, is amended by striking <quote>and the Court of International
			 Trade</quote> and inserting <quote>, the Court of International Trade, and any
			 other court, as provided by law</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H53BE60A690A5401291001420592365B3"><enum>(b)</enum><header display-inline="yes-display-inline">Internal Revenue Code</header><text display-inline="yes-display-inline">Section 7456(c) of the Internal Revenue
			 Code of 1986 (relating to incidental powers of the Tax Court) is amended in the
			 matter following paragraph (3), by striking the period at the end, and
			 inserting <quote>and may otherwise provide for the security of the Tax Court,
			 including the personal protection of Tax Court judges, court officers,
			 witnesses, and other threatened person in the interests of justice, where
			 criminal intimidation impedes on the functioning of the judicial process or any
			 other official proceeding.</quote>.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H4726778C54A840298E77CCC1646EC804" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Additional amounts for United States
			 Marshals Service to protect the judiciary</header><text display-inline="no-display-inline">In addition to any other amounts authorized
			 to be appropriated for the United States Marshals Service, there are authorized
			 to be appropriated for the United States Marshals Service to protect the
			 judiciary, $20,000,000 for each of fiscal years 2007 through 2011 for—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H81124EC8A13E474FBF61E369F740170"><enum>(1)</enum><text display-inline="yes-display-inline">hiring entry-level deputy marshals for
			 providing judicial security;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E77C9C0B56C4398883B1B08DBF4FCFE"><enum>(2)</enum><text display-inline="yes-display-inline">hiring senior-level deputy marshals for
			 investigating threats to the judiciary and providing protective details to
			 members of the judiciary and assistant United States attorneys; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H94C44B2EE00E49C69648C6581B9E4D92"><enum>(3)</enum><text display-inline="yes-display-inline">for the Office of Protective Intelligence,
			 for hiring senior-level deputy marshals, hiring program analysts, and providing
			 secure computer systems.</text>
				</paragraph></section></title><title commented="no" id="HF66D4E7219184E4D8D0017D809F97E37" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Criminal law enhancements to protect
			 judges, family members, and witnesses</header>
			<section commented="no" display-inline="no-display-inline" id="H6FFAEDFE0E3842889C139E606542F13B" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Protections against malicious recording of
			 fictitious liens against Federal judges and Federal law enforcement
			 officers</header>
				<subsection commented="no" display-inline="no-display-inline" id="H9097E455A07B42239EB353DA75E6EB00"><enum>(a)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline">Chapter 73 of title 18, United States Code,
			 is amended by adding at the end the following:</text>

						<section commented="no" display-inline="no-display-inline" id="H56A7AF1B9FFB4F24A20076BC7205FD1" section-type="subsequent-section"><enum>1521.</enum><header display-inline="yes-display-inline">Retaliating against a Federal judge or
				Federal law enforcement officer by false claim or slander of title</header>
							<subsection commented="no" display-inline="no-display-inline" id="H79F7AEE0738C47A8A8EA243F02EFEB9D"><enum></enum><text display-inline="yes-display-inline">Whoever files, attempts to file, or
				conspires to file, in any public record or in any private record which is
				generally available to the public, any false lien or encumbrance against the
				real or personal property of an individual described in section 1114, on
				account of the performance of official duties by that individual, knowing or
				having reason to know that such lien or encumbrance is false or contains any
				materially false, fictitious, or fraudulent statement or representation, shall
				be fined under this title or imprisoned for not more than 10 years, or
				both.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9113EEEE55D34454AA565BE9BA805743"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The chapter analysis for chapter 73 of
			 title 18, United States Code, is amended by adding at the end the following new
			 item:</text>

				certain official duties</header>
							<subsection commented="no" display-inline="no-display-inline" id="H7B0FCC93F0EE4BA0BA5C8224002851EB"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Whoever knowingly makes restricted personal
				information about a covered official, or a member of the immediate family of
				that covered official, publicly available—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7c6117a81fcb4f35a4ec41d615ef0502"><enum>(1)</enum><text display-inline="yes-display-inline">with the intent to threaten, intimidate, or
				incite the commission of a crime of violence against that covered official, or
				a member of the immediate family of that covered official; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83033d1edf8343b798c925afe3890d44"><enum>(2)</enum><text display-inline="yes-display-inline">with the intent and knowledge that the
				restricted personal information will be used to threaten, intimidate, or
				facilitate the commission of a crime of violence against that covered official,
				or a member of the immediate family of that covered official,</text>
								</paragraph><continuation-text commented="no" continuation-text-level="subsection">shall be fined under this title,
				imprisoned not more than 5 years, or both.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="HE9AFB29965E34B50AAA73C15182DB100"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H491A8732FD874B3CBD78D3104913926D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>restricted personal
				information</term> means, with respect to an individual, the Social Security
				number, the home address, home phone number, mobile phone number, personal
				email, or home fax number of, and identifiable to, that individual;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDD4BE229FBE34F978205E470581B1F2C"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered official</term>
				means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HE01EA1D1159745E39600FFAFAB798EA"><enum>(A)</enum><text display-inline="yes-display-inline">an individual designated in section 1114;
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDAC25121DBC74971A8F46704A98D7B07"><enum>(B)</enum><text display-inline="yes-display-inline">a grand or petit juror, witness, or other
				officer in or of, any court of the United States, or an officer who may be
				serving at any examination or other proceeding before any United States
				magistrate judge or other committing magistrate;</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7086BB7621B4F63BB9DD88534BD1F88"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>crime of violence</term> has
				the meaning given the term in section 16; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39D0EA5B7F844D4EB2D22C5D00BA68D6"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>immediate family</term> has
				the meaning given the term in section
				115(c)(2).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HDAE56561FDB74AE09469C0B262D32898"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of

			 Code, is amended by inserting <quote>or other dangerous weapon</quote> after
			 <quote>firearm</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H6C8CE5E58B5547F6A9ABC02D2F00A300" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Clarification of venue for retaliation
			 against a witness</header><text display-inline="no-display-inline">Section 1513
			 of title 18, United States Code, is amended by adding at the end the
			 following:</text>

				about to be instituted, or completed) was intended to be affected, or in which
				the conduct constituting the alleged offense

			</section><section commented="no" display-inline="no-display-inline" id="H4F48F37F8E9642BABA668E4D582DD5B2" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Modification of tampering with a witness,
			 victim, or an informant offense</header>
				<subsection commented="no" display-inline="no-display-inline" id="HB9870CA8685848D291A851FD4696CE77"><enum>(a)</enum><header display-inline="yes-display-inline">Changes in Penalties</header><text display-inline="yes-display-inline">Section 1512 of title 18, United States
			 Code, is amended—</text>

			<section commented="no" display-inline="no-display-inline" id="HEF209D8BB8194C59AD16D1F43CD696CD" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Report on security of Federal
			 prosecutors</header>
				<subsection commented="no" display-inline="no-display-inline" id="HA513DE22882547F1A1F6E35F337D42B5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Attorney General shall submit to the Committee on
			 the Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives a report on the security of assistant United States attorneys
			 and other Federal attorneys arising from the prosecution of terrorists, violent
			 criminal gangs, drug traffickers, gun traffickers, white supremacists, those
			 who commit fraud and other white-collar offenses, and other criminal
			 cases.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HB66E258C211B4C23A11464BB11A327A6"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (a)
			 shall describe each of the following:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H18A752A5867C4BF8BDB695AF4E708878"><enum>(1)</enum><text display-inline="yes-display-inline">The number and nature of threats and
			 assaults against attorneys handling prosecutions described in subsection (a)
			 and the reporting requirements and methods.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H989EF70F0DF944D6BD1F05CEA0C2E861"><enum>(2)</enum><text display-inline="yes-display-inline">The security measures that are in place to
			 protect the attorneys who are handling prosecutions described in subsection
			 (a), including threat assessments, response procedures, availability of
			 security systems and other devices, firearms licensing (deputations), and other
			 measures designed to protect the attorneys and their families.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83374172426A446DB8A659C3F4F6CB52"><enum>(3)</enum><text display-inline="yes-display-inline">The firearms deputation policies of the
			 Department of Justice, including the number of attorneys deputized and the time
			 between receipt of threat and completion of the deputation and training
			 process.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1161EF92A458473E8204948B4F2100EF"><enum>(4)</enum><text display-inline="yes-display-inline">For each requirement, measure, or policy
			 described in paragraphs (1) through (3), when the requirement, measure, or
			 policy was developed and who was responsible for developing and implementing
			 the requirement, measure, or policy.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H996B25F9F5C44F41A766771775C7A44C"><enum>(5)</enum><text display-inline="yes-display-inline">The programs that are made available to the
			 attorneys for personal security training, including training relating to
			 limitations on public information disclosure, basic home security, firearms
			 handling and safety, family safety, mail handling, counter-surveillance, and
			 self-defense tactics.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E1F1068F45348AB8C5552F3AA27B2F"><enum>(6)</enum><text display-inline="yes-display-inline">The measures that are taken to provide
			 attorneys handling prosecutions described in subsection (a) with secure parking
			 facilities, and how priorities for such facilities are established—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H4C464F5CE04F4E95BEB654BDAAFD3517"><enum>(A)</enum><text display-inline="yes-display-inline">among Federal employees within the
			 facility;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8850A32D08A846ED89AA7B8C76B68500"><enum>(B)</enum><text display-inline="yes-display-inline">among Department of Justice employees
			 within the facility; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H95E58AC648CF4C718D4E7EDFC7660726"><enum>(C)</enum><text display-inline="yes-display-inline">among attorneys within the facility.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H72A874C68FA74A7E84E13F1FABB8FB99"><enum>(7)</enum><text display-inline="yes-display-inline">The frequency attorneys handling
			 prosecutions described in subsection (a) are called upon to work beyond
			 standard work hours and the security measures provided to protect attorneys at
			 such times during travel between office and available parking
			 facilities.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19E64C04D474407597E9B1E629F5100"><enum>(8)</enum><text display-inline="yes-display-inline">With respect to attorneys who are licensed
			 under State laws to carry firearms, the policy of the Department of Justice as
			 to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H21303D283A504124BB4F70C880B36FE3"><enum>(A)</enum><text display-inline="yes-display-inline">carrying the firearm between available
			 parking and office buildings;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H263C3C5BF1694D31BF85A95B118DE2BD"><enum>(B)</enum><text display-inline="yes-display-inline">securing the weapon at the office
			 buildings; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDFD0D223E45B4667A88B23CF98F47408"><enum>(C)</enum><text display-inline="yes-display-inline">equipment and training provided to
			 facilitate safe storage at Department of Justice facilities.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0EB8C388F074EC89F2C9C20FF76F47C"><enum>(9)</enum><text display-inline="yes-display-inline">The offices in the Department of Justice
			 that are responsible for ensuring the security of attorneys handling
			 prosecutions described in subsection (a), the organization and staffing of the
			 offices, and the manner in which the offices coordinate with offices in
			 specific districts.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H60F93A96C8724BF7A464D733B0B295E"><enum>(10)</enum><text display-inline="yes-display-inline">The role, if any, that the United States
			 Marshals Service or any other Department of Justice component plays in
			 protecting, or providing security services or training for, attorneys handling
			 prosecutions described in subsection (a).</text>
					</paragraph></subsection></section></title><title commented="no" id="H93B29386DD3547A4835B8C00E5003D9B" level-type="subsequent"><enum>V</enum><header display-inline="yes-display-inline">Miscellaneous provisions</header>
			<section commented="no" display-inline="no-display-inline" id="HFB491670173E4203A2B03EC5651777BF" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">Expanded procurement authority for the
			 United States Sentencing Commission</header>
				<subsection commented="no" display-inline="no-display-inline" id="H43F917CFF1EF4249A363D093E4592CBE"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 995 of title 28, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H773A8CE740FA482B987B6BF5F0100044" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="H71E61E11E0E241AEB029B7764D049753"><enum>(f)</enum><text display-inline="yes-display-inline">The Commission may—</text>

				acquisition of property or services to the same extent as executive agencies
				may enter into such contracts under the authority of section 304B of the

				<subsection commented="no" display-inline="no-display-inline" id="id5676011488544A8EA5C540BB722B2884"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 604(a)(5) of title 28, United
			 States Code, is amended by inserting after <quote>hold office during good
			 behavior,</quote> the following: <quote>bankruptcy judges appointed under
			 section 152 of this title, magistrate judges appointed under section 631 of
			 this title, and territorial district court judges appointed under section 24 of
			 the Organic Act of Guam (48 U.S.C. 1424b), section 1(b) of the Act of November
			 8, 1877 (48 U.S.C. 1821), or section 24(a) of the Revised Organic Act of the
			 Virgin Islands (48 U.S.C. 1614(a)),</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idF15BE98176BC492B8D06C9A35D0BF0DE"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply with respect to any payment made on or after the
			 first day of the first applicable pay period beginning on or after the date of
			 enactment of this Act.</text>
