			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of Energy.</text>
		</section><title id="id708451FD209F44FDA7C0D865B129E7AD"><enum>I</enum><header>Clean technology
			 manufacturing incentive program</header>
			<section id="ID2925C0923096448DBF59FFA665D02FAA"><enum>101.</enum><header>Clean
			 technology manufacturing incentive program</header>
				<subsection id="ID7DC8D86405E34637BA0B313ED4617042"><enum>(a)</enum><header>Loans</header><text>The
			 Secretary shall provide loans to manufacturers to help finance the cost
			 of—</text>
					<paragraph id="id4ACE33ED716B452685BB8E76C90CBAD6"><enum>(1)</enum><text>reequipping,
			 expanding, or establishing (including applicable engineering costs) a
			 manufacturing facility in the United States to produce clean technology
			 products and the significant component parts of those products,
			 including—</text>
						<subparagraph id="id6E8940119DB5414BB9A0260BFAA3D939"><enum>(A)</enum><text>wind
			 turbines;</text>
						</subparagraph><subparagraph id="id336361C9132F41D987EF29B8C0C5212C"><enum>(B)</enum><text>solar energy
			 products;</text>
						</subparagraph><subparagraph id="id4607D13A92EA45AB91BE0697CE91FF60"><enum>(C)</enum><text>fuel
			 cells;</text>
						</subparagraph><subparagraph id="idB618806F2B484C3291B8772BAA94B3BC"><enum>(D)</enum><text>advanced
			 batteries and storage devices;</text>
						</subparagraph><subparagraph id="id5F606A7C4DDD4831B2EE0D41F9894CE8"><enum>(E)</enum><text>biomass
			 engines;</text>
						</subparagraph><subparagraph id="ID92e6a2b3ffc148d49f9f5576f78047e8"><enum>(F)</enum><text>geothermal
			 equipment;</text>
						</subparagraph><subparagraph id="IDc0b7a0fa50c7471bb0e264d168be8b39"><enum>(G)</enum><text>ocean energy
			 equipment;</text>
						</subparagraph><subparagraph id="IDf6fc3fb6b08e4003924658a30c58b056"><enum>(H)</enum><text>carbon capture
			 and storage;</text>
						</subparagraph><subparagraph id="id3FE21975CEBB4AA198762ACEE44CC942"><enum>(I)</enum><text>energy efficiency
			 products, including appliances and products that are used to increase energy
			 efficiency by at least 30 percent over a baseline product (and significant
			 components of the appliances and products), subject to the condition that the
			 parts shall be integral to the overall efficiency of the end product;
			 and</text>
						</subparagraph><subparagraph id="IDa56342d667ac4db790896389e3b30077"><enum>(J)</enum><text>products for
			 retrofitting a manufacturing facility to improve industrial processes and
			 create greater energy efficiency through the use of technologies,
			 including—</text>
							<clause id="IDca2dc6fb96e14927bde3793b3659d8f4"><enum>(i)</enum><text>combined heat and
			 power systems;</text>
							</clause><clause id="ID54793f643f1f4ef1801d8d88d4d449df"><enum>(ii)</enum><text>natural gas
			 pressure recovery;</text>
							</clause><clause id="ID3fd93c58b24b4131845d8c124eebfc5a"><enum>(iii)</enum><text>advanced
			 cogeneration;</text>
							</clause><clause id="IDce45fc8d24fd4513bc7f5e52859a3400"><enum>(iv)</enum><text>gasification;</text>
							</clause><clause id="IDf448174af4c5461eae122b94b080fe1e"><enum>(v)</enum><text>anaerobic
			 digestion; and</text>
							</clause><clause id="IDf7563eaaa5cb4c1b86cb1d249b47340a"><enum>(vi)</enum><text>landfill gas
			 recovery; and</text>
							</clause></subparagraph></paragraph><paragraph id="id22A5CDE1D38E4455BCF28807F3E41441"><enum>(2)</enum><text>improving the
			 energy-efficiency of the industrial processes of the manufacturers other than
			 through the production of products and component parts described in paragraph
			 (1)(J).</text>
					</paragraph></subsection><subsection id="ID566ABCCBF4AB4AE58F4897C46305CA2D"><enum>(b)</enum><header>Period of
			 availability</header><text>A loan under subsection (a) shall apply to—</text>
					<paragraph id="ID4623EA3D1F8F4F01AC65D682F717C076"><enum>(1)</enum><text>facilities and
			 equipment placed in service before December 30, 2012; and</text>
					</paragraph><paragraph id="ID008ACD80C1C74746B17C9FE25F0067A1"><enum>(2)</enum><text>clean technology
			 retooling costs, retrofitting costs, worker training costs, and other costs
			 described in subsection (a) incurred during the period beginning on the date of
			 enactment of this Act and ending on December 30, 2020.</text>
					</paragraph></subsection><subsection id="ID2D3ACCFF72AD4870814F1EBE87EAC2C2"><enum>(c)</enum><header>Direct loan
			 program</header>
					<paragraph id="IDDBCF1EEC23DA4EBBA35FEF25DC434246"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, subject to the availability of appropriated funds, the Secretary shall
			 carry out a program to provide a total of not more than $50,000,000,000 in
			 loans to eligible individuals and entities (as determined by the Secretary) for
			 the costs of activities described in subsection (a).</text>
					</paragraph><paragraph id="ID20C9FC26A715416889512B844654B910"><enum>(2)</enum><header>Application</header><text>An
			 applicant for a loan under this section shall submit to the Secretary an
			 application at such time, in such manner, and containing such information as
			 the Secretary may require, including a written assurance that the wages and
			 benefits that will be provided to each individual that is employed by the
			 applicant (including a contractor or subcontractor) in carrying out activities
			 described in subsection (a) are at least equal to the average in the area, as
			 determined by the Secretary.</text>
					</paragraph><paragraph id="IDA6193256E0F142FB8D9749CCFCB2789B"><enum>(3)</enum><header>Selection of
			 eligible projects</header><text>The Secretary shall select eligible projects to
			 receive loans under this subsection in cases in which, as determined by the
			 Secretary, the loan recipient—</text>
						<subparagraph id="ID3A064EFBF1F04894B9CB024131449BA0"><enum>(A)</enum><text>has a viable
			 market for the product or component described in subsection (a);</text>
						</subparagraph><subparagraph id="ID2B282D5F08B34A8E92B916FC6DB6C7D7"><enum>(B)</enum><text>will provide
			 sufficient information to the Secretary for the Secretary to ensure that the
			 qualified investment is expended efficiently and effectively;</text>
						</subparagraph><subparagraph id="idA08535634B014772B8B4E2797CB84899"><enum>(C)</enum><text>will provide such
			 information as the Secretary may request to demonstrate that the qualified
			 investment will preserve or create jobs; and</text>
						</subparagraph><subparagraph id="ID9D35BB5D52C741E9B8FA652524BB2A59"><enum>(D)</enum><text>has met such
			 other criteria as may be established and published by the Secretary.</text>
						</subparagraph></paragraph><paragraph id="ID83B65DDE7B444330A9AFE1F559044AF9"><enum>(4)</enum><header>Rates, terms,
			 and repayment of loans</header><text>A loan provided under this
			 subsection—</text>
						<subparagraph id="IDA038CBEE38114EA58259AF7E7226AB17"><enum>(A)</enum><text>shall have an
			 interest rate that, as of the date on which the loan is made, is equal to the
			 cost of funds to the Department of the Treasury for obligations of comparable
			 maturity;</text>
						</subparagraph><subparagraph id="ID5E32F4677DFC407696B6AEB15E5E126D"><enum>(B)</enum><text>shall have a term
			 equal to the lesser of—</text>
							<clause id="ID2BDDB543E6B44124BE864A7B6BF64364"><enum>(i)</enum><text>the
			 projected life, in years, of the eligible project to be carried out using funds
			 from the loan, as determined by the Secretary; and</text>
							</clause><clause id="ID19B1990E810C4F87A63782ADCC736351"><enum>(ii)</enum><text>25
			 years;</text>
							</clause></subparagraph><subparagraph id="ID06E1D7E70879495686C0870B6BF2EF6C"><enum>(C)</enum><text>may be subject to
			 a deferral in repayment for not more than 5 years after the date on which the
			 eligible project carried out using funds from the loan first begins operations,
			 as determined by the Secretary;</text>
						</subparagraph><subparagraph id="IDB7C846DA9E2347FDAB0B6FD8E9499973"><enum>(D)</enum><text>shall be made by
			 the Federal Financing Bank; and</text>
						</subparagraph><subparagraph id="id9993DA9B418744758645D49B1AA47B85"><enum>(E)</enum><text>shall be repaid
			 in full if the loan recipient moves production of activities described in
			 subsection (a) outside of the United States during the term of the loan.</text>
						</subparagraph></paragraph><paragraph id="IDC80710F228E44897A76F44C6C93BFCEE"><enum>(5)</enum><header>Fees</header><text>Administrative
			 costs shall be no more than $100,000 or 10 basis point of the loan.</text>
					</paragraph></subsection><subsection id="ID858716D342FE4A3796948ACE6DD2C30A"><enum>(d)</enum><header>Priority</header><text>In
			 making loans to manufacturers under this section, the Secretary—</text>
					<paragraph id="id4496F2E1388F4686963697CFE3F01169"><enum>(1)</enum><text>shall give
			 priority to those facilities that are located in regions with the highest
			 unemployment rates; and</text>
					</paragraph><paragraph id="id9AA39628D2EA4641B7639DD81D752155"><enum>(2)</enum><text>may provide
			 awards or loan to facilities that are idle.</text>
					</paragraph></subsection><subsection id="id875D45366D494D758126DAA66AE47340"><enum>(e)</enum><header>Manufacturing
			 Extension Partnership program</header><text>In carrying out this section, the
			 Secretary shall coordinate with the Secretary of Commerce in carrying out the
			 Manufacturing Extension Partnership program established under sections 25 and
			 26 of the National Institute of Standards and Technology Act (15 U.S.C. 278k,
			 278<added-phrase reported-display-style="italic">l</added-phrase>).</text>
				</subsection><subsection id="idE8B66FB984954BA2A9EB14A3443B1E3F"><enum>(f)</enum><header>Funding</header>
					<paragraph id="idB23A6E735C054F3B9204016DC3C00EA1"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, not later
			 than 30 days after the date of enactment of this Act, on October 1, 2009, and
			 on each October 1 thereafter through October 1, 2012, out of any funds in the
			 Treasury not otherwise appropriated, the Secretary of the Treasury shall
			 transfer to the Secretary for the cost of loans and loan guarantees to carry
			 out this section such sums as are necessary to provide the amount of loans
			 authorized under subsection (c)(1), to remain available until expended.</text>
					</paragraph><paragraph id="IDDDDB9AFAA4B2435EB9C6E3EA8D700BC2"><enum>(2)</enum><header>Receipt and
			 acceptance</header><text>The Secretary shall be entitled to receive, shall
			 accept, and shall use to carry out this section the funds transferred under
			 paragraph (1), without further appropriation.
			 <added-phrase reported-display-style="italic"></added-phrase></text>
					</paragraph></subsection></section></title><title id="id9FF5AAB224E94B12BB24A1D68409FD4A"><enum>II</enum><header>High-performance
			 building block grants</header>
			<section id="ID13517EA4DAC14FD1AF1C74D2A1BB063E"><enum>201.</enum><header>High-performance
			 building block grants</header>
				<subsection id="idC95367EA23D649C491FC112AA976DFEF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title V of the Energy
			 Independence and Security Act of 2007 (Public Law 110–140; 121 Stat. 1655) is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDA2A809798B44ABEB70803DC59B8A06F" style="OLC">
						<subtitle id="id8BCAD81939CC43269D8814C10F29746D"><enum>F</enum><header>High-performance
				building block grants</header>
							<section id="id4BFDD3E16452485890580B22C6EA668E"><enum>551.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
								<paragraph id="ID84EB9DB7A7744339B33DE63D0BAF35ED"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
									<subparagraph id="ID305B6E6504914787AA465C771902C315"><enum>(A)</enum><text>an eligible unit
				of local government;</text>
									</subparagraph><subparagraph id="IDBFE43A9468C84742B5AB4F071CBEE7DD"><enum>(B)</enum><text>an Indian tribe
				or Native Hawaiian community;</text>
									</subparagraph><subparagraph id="idE6B0268912024DC2BC0670AD53D2F311"><enum>(C)</enum><text>a utility system;
				or</text>
									</subparagraph><subparagraph id="id7C99E1048DD14CABAC3C5C19EFD9D563"><enum>(D)</enum><text>a public-private
				partnership.</text>
									</subparagraph></paragraph><paragraph id="ID069BBD184F52466E93CCA8EA1F8BF4B0"><enum>(2)</enum><header>Eligible unit
				of local government</header><text>The term <term>eligible unit of local
				government</term> means any political subdivision of a State.</text>
								</paragraph><paragraph id="idF466C47E628147BEBD59DE2EEED301EB"><enum>(3)</enum><header>Energy-efficient;
				energy efficiency</header><text>The terms <term>energy-efficient</term> and
				<term>energy efficiency</term> with respect to a building, facility, process,
				or other activity, mean that the building, facility, process, or other activity
				uses technology or practices to reduce energy use by at least 20
				percent.</text>
								</paragraph><paragraph id="id8CB6F109BE554F29B26B4987C798D713"><enum>(4)</enum><header>High-performance
				building</header><text>The term <term>high-performance building</term> means
				the construction or retrofitting of a facility in a manner that achieves energy
				efficiency through—</text>
									<subparagraph id="id93CD15BC0E8A4D019546B44AA73AB70E"><enum>(A)</enum><text>an energy
				efficiency retrofitting activity; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4FD629032C8D4E9BA70621993B5A11A9"><enum>(B)</enum><text>the installation
				and use of a renewable energy technology.</text>
									</subparagraph></paragraph><paragraph id="ID72864AAC7856407099122BE9F12778BA"><enum>(5)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
								</paragraph><paragraph id="ID9765B2D64D214A8799815D529EEC22D0"><enum>(6)</enum><header>Program</header><text>The
				term <term>program</term> means the High-Performance Building Block Grant
				Program established under section 552(a).</text>
								</paragraph><paragraph id="IDED20B8730F37431BA2ACEB9D194E8AA8"><enum>(7)</enum><header>State</header><text>The
				term <term>State</term> means—</text>
									<subparagraph id="IDF1A842EB733242588333C11F528743EA"><enum>(A)</enum><text>a State;</text>
									</subparagraph><subparagraph id="IDCE9F3B5EE7CD4E13B7B2B83B7F567BB6"><enum>(B)</enum><text>the District of
				Columbia;</text>
									</subparagraph><subparagraph id="ID858CA392A4804A5EBC46263A8C06E931"><enum>(C)</enum><text>the Commonwealth
				of Puerto Rico; and</text>
									</subparagraph><subparagraph id="ID5E7931B8384740C5AAFDB230DEECFCEC"><enum>(D)</enum><text>any other
				territory or possession of the United States.</text>
									</subparagraph></paragraph><paragraph id="id8DED03D953D14C82A2CFF6913BCC962F"><enum>(8)</enum><header>Utility
				system</header><text>The term <term>utility system</term> has the meaning given
				the term in section 2688(i) of title 10, United States Code.</text>
								</paragraph></section><section id="IDE157F8A9F4614E60ABDF56F7B415F59F"><enum>552.</enum><header>High-performance
				building block grant program</header>
								<subsection id="ID52F74D67A46B4B31ADAA02379C2031A8"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall establish a program, to be known as the <quote>High-Performance
				Building Block Grant Program</quote>, under which the Secretary shall provide
				grants, on a competitive basis, to eligible entities in accordance with this
				subtitle.</text>
								</subsection><subsection id="ID106A6495E1E2483C87FD208A2F8C8508"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the program shall be to assist eligible entities in implementing
				large-scale, multi-building residential and commercial projects to improve and
				provide high-performance building, green building, and renewable energy
				services and financing to homeowners and small businesses.</text>
								</subsection><subsection id="id4B85461489994CB981FCD1CCFC187F25"><enum>(c)</enum><header>Priority</header><text>In
				carrying out this section, the Secretary shall give priority for grants to
				projects that—</text>
									<paragraph id="idDC2D573393924F1995581C92DBEFDDAC"><enum>(1)</enum><text>include a cost
				recovery mechanism (such as on-bill financing);</text>
									</paragraph><paragraph id="id04A8D106E8864464B3D38025AC67A4D7"><enum>(2)</enum><text>use certified
				contractors; and</text>
									</paragraph><paragraph id="id62158531837C4012A41D10FA948DCAA2"><enum>(3)</enum><text>use products
				produced domestically.</text>
									</paragraph></subsection></section><section id="ID3C0864A6ADEE4631A6B16A5278FB079A"><enum>553.</enum><header>Use of
				funds</header><text display-inline="no-display-inline">An eligible entity may
				use a grant received under this subtitle to carry out activities to achieve the
				purposes of the program, including—</text>
								<paragraph id="ID3231C2F63A3F4A4BA4D305F74A0CC0E4"><enum>(1)</enum><text>development and
				implementation of a high-performance building strategy under section
				554(b);</text>
								</paragraph><paragraph id="IDd5a1874b61b2495a85eeb24cbc8a1771"><enum>(2)</enum><text>coordination with
				other Federal or State programs to develop and implement that strategy;</text>
								</paragraph><paragraph id="ID19D6BF8222AE47BCA10E111B47702B27"><enum>(3)</enum><text>retaining
				technical consultant services to assist the eligible entity in the development
				of such a strategy, including—</text>
									<subparagraph id="IDDA57A707E1BC435E931540F87046E008"><enum>(A)</enum><text>formulation of
				high-performance building goals;</text>
									</subparagraph><subparagraph id="IDF7754BF2EF0046B299E44C4F00A3DEB2"><enum>(B)</enum><text>identification of
				strategies to achieve those goals—</text>
										<clause id="IDA46BBF3E9A8849DFB6C874105853AF76"><enum>(i)</enum><text>through efforts
				to increase high-performance building; and</text>
										</clause><clause id="IDA3B866FEB52047F3BAA45B0C8496A93D"><enum>(ii)</enum><text>by encouraging
				behavioral changes among the population served by the eligible entity;</text>
										</clause></subparagraph><subparagraph id="IDDB96EC9CF19147818C8E36C4F16A7552"><enum>(C)</enum><text>development of
				methods to measure progress in achieving the goals;</text>
									</subparagraph><subparagraph id="ID8E600E5310E4457C8D9A728A377005F1"><enum>(D)</enum><text>development and
				publication of annual reports to the population served by the eligible entity
				describing—</text>
										<clause id="ID983E04CFD16445A193F3412DFBC6715B"><enum>(i)</enum><text>the strategies
				and goals; and</text>
										</clause><clause id="ID4237A6B88DFA49A7A2295783CB33F83F"><enum>(ii)</enum><text>the progress
				made in achieving the strategies and goals during the preceding calendar year;
				and</text>
										</clause></subparagraph><subparagraph id="ID90170A43212E473D90F05C7002EF9806"><enum>(E)</enum><text>other services to
				assist in the implementation of the high-performance building strategy;</text>
									</subparagraph></paragraph><paragraph id="IDAD0F66740A2A4ED9ACD11FCE04356B13"><enum>(4)</enum><text>conducting
				residential and commercial building energy audits;</text>
								</paragraph><paragraph id="ID5C7951E47F5845BE8CBBA0845BFF7C08"><enum>(5)</enum><text>establishment of
				cost recovery systems and other financial incentive programs for
				high-performance building improvements;</text>
								</paragraph><paragraph id="IDCD9EE6FEFFC24606AF56684E0CB1E257"><enum>(6)</enum><text>the provision of
				grants to nonprofit organizations and governmental agencies for the purpose of
				performing high-performance building retrofits;</text>
								</paragraph><paragraph id="ID94344B3D07E04D96B9E300A4520C4B99"><enum>(7)</enum><text>development and
				implementation of high-performance building programs for buildings and
				facilities within the jurisdiction of the eligible entity, including—</text>
									<subparagraph id="id03BA0AB4260E4C5498267AD3BF723F2B"><enum>(A)</enum><text>retrofitting;</text>
									</subparagraph><subparagraph id="IDC7E4A33973984E9B90A6396D11A9BE23"><enum>(B)</enum><text>design and
				operation of the programs;</text>
									</subparagraph><subparagraph id="ID9F75AE6BB8DB474A894A4A63CEB6B624"><enum>(C)</enum><text>identifying the
				most effective methods for achieving maximum participation and efficiency
				rates;</text>

				smart energy efficient technologies;</text>
									</subparagraph></paragraph><paragraph id="ID00B39A72CBA34106B972F5917C3714B8"><enum>(8)</enum><text>application and
				implementation of energy distribution technologies that significantly increase
				high-performance building, including—</text>
									<subparagraph id="ID14681465748B480C97C11C93E247FB6E"><enum>(A)</enum><text>distributed
				resources; and</text>
									</subparagraph><subparagraph id="IDF2A83EC9C95C47BDB713EF1DFD6DD169"><enum>(B)</enum><text>district heating
				and cooling systems;</text>
									</subparagraph></paragraph><paragraph id="ID76362A1923324534BB9E34270DFD4BE5"><enum>(9)</enum><text>activities to
				increase participation and efficiency rates for material conservation programs,
				including source reduction, recycling, and recycled content procurement
				programs that lead to increases in high-performance building;</text>
								</paragraph><paragraph id="ID2e4e7d6ae0384ac6b7ad1d0b863be988"><enum>(10)</enum><text>coordination of
				or cooperation with programs to train workers to participate in projects
				involving high-performance buildings;</text>
								</paragraph><paragraph id="ID7783053194864161BB0218B053CF73C5"><enum>(11)</enum><text>development,
				implementation, and installation on or in any private building within the
				jurisdiction of the eligible entity of onsite renewable energy technology that
				generates electricity from renewable resources, including—</text>
									<subparagraph id="ID9D96A8B3FB814DE5920E8EFB0A8F366C"><enum>(A)</enum><text>solar
				energy;</text>
									</subparagraph><subparagraph id="ID0400864B80174874A98D7D7DC0FA13BA"><enum>(B)</enum><text>wind
				energy;</text>
									</subparagraph><subparagraph id="IDDD0F7AECCE8C457B8C17A7B8B281DFD2"><enum>(C)</enum><text>fuel
				cells;</text>
									</subparagraph><subparagraph id="IDDB19C54CD03F46ECABD6949E6510E141"><enum>(D)</enum><text>biomass;
				and</text>
									</subparagraph><subparagraph id="id09D7F9B2F56C41E7A620364DC8FF89F1"><enum>(E)</enum><text>geothermal
				energy; and</text>
									</subparagraph></paragraph><paragraph id="ID9072B03AC0014D31B2A9EDA55292307F"><enum>(12)</enum><text>any other
				appropriate activity, as determined by the Secretary, in consultation
				with—</text>
									<subparagraph id="ID93E8AACF9DC940A2AC52401A92E478C5"><enum>(A)</enum><text>the Administrator
				of the Environmental Protection Agency;</text>
									</subparagraph><subparagraph id="IDBA11D4A2DBBC420E9F44B516882931C1"><enum>(B)</enum><text>the Secretary of
				Transportation;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E829A19C14546228E58EF31334FEE4C"><enum>(C)</enum><text>the Secretary of
				Housing and Urban Development; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4475ED06B380414A94FFDB2AA36BF4BA"><enum>(D)</enum><text>the Secretary of
				Labor.</text>
									</subparagraph></paragraph></section><section id="IDE2BAFE656EEC4D35B10B49A9839AC837"><enum>554.</enum><header>Requirements
				for grants</header>
								<subsection id="ID7B47F0AFEE5544B2AAFBF12F0D46BEC4"><enum>(a)</enum><header>Applications</header><text>To
				be eligible to receive a grant under this subtitle, an eligible entity shall
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</subsection><subsection id="ID8CBAEAFF369D45A492F0FEB009BC9A5B"><enum>(b)</enum><header>Strategy</header>
									<paragraph id="ID08508152018948D0B4EDFB22DBB6A839"><enum>(1)</enum><header>Proposed
				strategy</header>
										<subparagraph id="ID2804C34302F445ADB603A15091E3DF67"><enum>(A)</enum><header>In
				general</header><text>Before receiving a grant under this subtitle, an eligible
				entity shall submit to the Secretary a proposed high-performance building
				strategy in accordance with this paragraph.</text>
										</subparagraph><subparagraph id="IDEC163AF84D1B4A3A9888162A75D3F970"><enum>(B)</enum><header>Inclusions</header><text>The
				proposed strategy under subparagraph (A) shall include—</text>
											<clause id="ID48BEADA7BA204E91B8F83E5D3352BF75"><enum>(i)</enum><text>a
				description of the goals of the eligible entity, in accordance with the
				purposes of this subtitle, for increased high-performance building in the
				jurisdiction of the eligible entity; and</text>
											</clause><clause id="ID638424C382794E94B48145548ACDA073"><enum>(ii)</enum><text>a plan for the
				use of the grant to assist the eligible entity in achieving those goals, in
				accordance with section 553.</text>
											</clause></subparagraph><subparagraph id="ID8C62FB43CBD34F7C80062F2516A669DE"><enum>(C)</enum><header>Requirements</header><text>In
				developing the strategy under subparagraph (A), an eligible entity
				shall—</text>
											<clause id="IDBB1249294C4146979BAFD415EB6F4A5A"><enum>(i)</enum><text>take into account
				any plans for the use of funds by adjacent eligible entities that receive
				grants under the program; and</text>
											</clause><clause id="IDF230D20909FB4D5D968193CD2CBC70BB"><enum>(ii)</enum><text>coordinate and
				share information with the State in which the eligible entity is located
				regarding activities carried out using the grant to maximize the
				high-performance building benefits under this subtitle.</text>
											</clause></subparagraph></paragraph><paragraph id="IDF4B83B17C9914A888C46A3BC0F8947ED"><enum>(2)</enum><header>Approval by
				Secretary</header>
										<subparagraph id="IDB7E98F44CCD749B4B079DCE130BCA9E3"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall approve or disapprove a proposed
				strategy under paragraph (1) by not later than 120 days after the date of
				submission of the proposed strategy.</text>
										</subparagraph><subparagraph id="ID724F4792664C433CB75B6091ECD7F5A1"><enum>(B)</enum><header>Disapproval</header><text>If
				the Secretary disapproves a proposed strategy under subparagraph (A)—</text>
											<clause id="ID0B67AE80253D4794AB61C6AC5B74831E"><enum>(i)</enum><text>the Secretary
				shall provide to the eligible entity the reasons for the disapproval;
				and</text>
											</clause><clause id="IDCDC41E659ED64C85B5870FE79EF1C47A"><enum>(ii)</enum><text>the eligible
				entity may revise and resubmit the proposed strategy as many times as necessary
				until the Secretary approves a proposed strategy.</text>
											</clause></subparagraph><subparagraph id="ID88C27F5CB1FF4CE69C8A34C0946787E5"><enum>(C)</enum><header>Requirement</header><text>The
				Secretary shall not provide to an eligible entity any grant under the program
				until a proposed strategy of the eligible entity is approved by the Secretary
				under this paragraph.</text>
										</subparagraph></paragraph><paragraph id="IDA462338C4CD4479A954A51DBAB0066B3"><enum>(3)</enum><header>Limitations on
				use of funds</header><text>Of amounts provided to an eligible entity under the
				program, the eligible entity may use—</text>
										<subparagraph id="ID91D6E1E5EDB04D3AB1288407462B1E28"><enum>(A)</enum><text>10 percent for
				administrative expenses, excluding the cost of meeting the reporting
				requirements of this subtitle; and</text>
										</subparagraph><subparagraph id="IDA7E0026C0E424789BA6810D5B761F2C7"><enum>(B)</enum><text>any amount for
				the establishment of revolving loan funds to carry out activities described in
				section 553.</text>
										</subparagraph></paragraph><paragraph id="ID8F576E716869447598C2C38E3534699C"><enum>(4)</enum><header>Annual
				report</header><text>Not later than 2 years after the date on which funds are
				initially provided to an eligible entity under the program, and annually
				thereafter, the eligible entity shall submit to the Secretary a report
				describing—</text>
										<subparagraph id="IDD052AA20B852440B9A05624ADAD0E9CB"><enum>(A)</enum><text>the status of
				development and implementation of the high-performance building strategy of the
				eligible entity;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3BC8893DAD8D4944A8C98C6B0E5137C0"><enum>(B)</enum><text>as practicable,
				an assessment of high-performance building gains within the jurisdiction of the
				eligible entity; and</text>
										</subparagraph><subparagraph id="ID7f1925dc4ec149058e24d3b0ccb38487"><enum>(C)</enum><text>as practicable,
				an assessment of job training strategies and job creation relating to the
				high-performance building strategy of the eligible entity.</text>
										</subparagraph></paragraph></subsection><subsection id="IDCA9B902EF5954C41ACC5F6120C5124D6"><enum>(c)</enum><header>Construction
				requirement</header>
									<paragraph id="IDBAFBD0AAE8EF473693D51E6DA38F6049"><enum>(1)</enum><header>In
				general</header><text>To be eligible to receive a grant under the program, each
				eligible entity shall submit to the Secretary a written assurance that all
				laborers and mechanics employed by any contractor or subcontractor of the
				eligible entity during any construction, alteration, or repair activity funded,
				in whole or in part, by the grant shall be paid wages at rates not less than
				the prevailing wages for similar construction activities in the locality, as
				determined by the Secretary of Labor, in accordance with sections 3141 through
				3144, 3146, and 3147 of title 40, United States Code.</text>
									</paragraph><paragraph id="ID0FAE86ABE491419181B52791D1013A3A"><enum>(2)</enum><header>Secretary of
				labor</header><text>With respect to the labor standards referred to in
				paragraph (1), the Secretary of Labor shall have the authority and functions
				described in—</text>
										<subparagraph id="ID4642324E7E584F04B4E3FB45EE254E05"><enum>(A)</enum><text>Reorganization
				Plan Numbered 14 of 1950 (5 U.S.C. 903 note); and</text>
										</subparagraph><subparagraph id="ID4078D08374964263901FE516D21B013B"><enum>(B)</enum><text>section 3145 of
				title 40, United States Code.</text>
										</subparagraph></paragraph></subsection><subsection id="IDA42D6A5FAE9440D88F8CA67821D1D2D6"><enum>(d)</enum><header>Priority</header><text>In
				providing grants under this subtitle, the Secretary shall give priority to
				eligible entities—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID7BCA3A2302ED40108F8AD89DFEF453E9"><enum>(1)</enum><text>that plan to
				carry out projects that would result in significant high-performance building
				improvements and retrofits on a large scale; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD61191B092CC470AB8F6F518DC954E19"><enum>(2)</enum><text>in regions with
				higher rates of unemployment and housing foreclosures.</text>
									</paragraph></subsection></section><section id="ID969F78B199B5460F91D6273A2491AC4B"><enum>555.</enum><header>Review and
				evaluation</header>
								<subsection id="ID181F2EA8F39343158B00DECCC17634FD"><enum>(a)</enum><header>In
				general</header><text>The Secretary may review and evaluate the performance of
				any eligible entity that receives a grant under the program, including by
				conducting an audit, as the Secretary determines to be appropriate.</text>
								</subsection><subsection id="IDBA3B3D5C54894C91BC23AC468E0171D8"><enum>(b)</enum><header>Withholding of
				funds</header><text>The Secretary may withhold from an eligible entity any
				portion of a grant to be provided to the eligible entity under the program if
				the Secretary determines that the eligible entity has failed to achieve
				compliance with—</text>
									<paragraph id="ID8DEBD2118C244AB5B018DEF05712459F"><enum>(1)</enum><text>any applicable
				guideline or regulation of the Secretary relating to the program, including the
				misuse or misappropriation of funds provided under the program; or</text>
									</paragraph><paragraph id="IDC0C3CB7D465F44F589FC8319079AAB87"><enum>(2)</enum><text>the
				high-performance building strategy of the eligible entity.</text>
									</paragraph></subsection></section><section id="ID331F29D57B55486EBAFDA260FA56047C"><enum>556.</enum><header>Funding</header>
								<subsection id="idBF418E8ADD2741058B6E2619B3F45860"><enum>(a)</enum><header>Mandatory
				funding</header>
									<paragraph id="id11F0D4052600404E85BBA8E0E4069489"><enum>(1)</enum><header>In
				general</header><text>Not later than 30 days after the date of enactment of
				this subtitle, out of any funds in the Treasury not otherwise appropriated, the
				Secretary of the Treasury shall transfer to the Secretary to carry out this
				section $1,000,000,000 to remain available until expended.</text>
									</paragraph><paragraph id="id7B76C79909994DBCB8809DC65DC1E552"><enum>(2)</enum><header>Receipt and
				acceptance</header><text>The Secretary shall be entitled to receive, shall
				accept, and shall use to carry out this section the funds transferred under
				paragraph (1), without further appropriation.
				<added-phrase reported-display-style="italic"></added-phrase></text>
									</paragraph></subsection><subsection id="ID148D1693CF764C2F91047BD6AC12387C"><enum>(b)</enum><header>Discretionary
				funding</header><text>There is authorized to be appropriated to carry out this
				subtitle $1,000,000,000 for each of fiscal years 2010 through 2013.</text>
								</subsection><subsection id="IDDD05ABA3943B4481970E64A20EFCD595"><enum>(c)</enum><header>Maintenance of
				funding</header><text>The funding provided under this subtitle shall supplement
				(and not supplant) other Federal funding provided under—</text>
									<paragraph id="ID08FEEAEAD92B4478AC55FDE6162CC7C9"><enum>(1)</enum><text>a State energy
				conservation plan established under part D of title III of the
				<act-name parsable-cite="EPCA">Energy Policy and Conservation Act</act-name>
				(42 U.S.C. 6321 et seq.); or</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID214CB8F0348644D591447F0BA418F1F5"><enum>(2)</enum><text>the
				Weatherization Assistance Program for Low-Income Persons established under part
				A of title IV of the <act-name parsable-cite="ECPA">Energy Conservation and
				Production Act</act-name> (42 U.S.C. 6861 et
				seq.).</text>
									</paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
