			 verification of ballots</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID78C4D2B28807486A92BC0817CB3F1D76"><enum>(a)</enum><header>In
			 general</header><text>Clause (i) of section 301(a)(1)(A) of the Help America
			 Vote Act of 2002 (42 U.S.C. 15481(a)(1)(A)(i)) is amended by inserting
			 <quote>and, in the case of any voting system other than a voting system which
			 uses paper ballots that are personally marked by the voter, in the manner
			 provided in paragraph (7),</quote> after <quote>(in a private and independent
			 manner</quote>.</text>
			</subsection><subsection id="IDEACAC6CE99C04449808D8EA5F564F8CE"><enum>(b)</enum><header>Method of
			 verification for certain voting systems</header>
				<paragraph id="id959FD32D84714655BCF81C58672716FF"><enum>(1)</enum><header>In
			 general</header><text>Section 301(a) of the Help America Vote Act of 2002 (42
			 U.S.C. 15481(a)) is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block id="ID1DE5A93431A247F8B27F0F2F7624B21D" style="OLC">
						<paragraph id="ID97A7BFFB8F304D2C9A32ADA6959DB288"><enum>(7)</enum><header>Method of
				independent verification</header><text>In order to meet the requirements of
				paragraph (1)(A)(i) with respect to any voting system to which this paragraph
				applies:</text>
							<subparagraph id="idE8628C8DFE6D4B4D8E907CD16B07008D"><enum>(A)</enum><header>In
				general</header><text>The voting system shall provide for verification of the
				votes selected by the voter by a means that—</text>
								<clause id="id19B9724C1A8C40CEB2826E3C5F13F683"><enum>(i)</enum><text>is independent of
				the device on which the vote is cast; and</text>
								</clause><clause id="idBBA95F82D08D4E1C9D81C9804A783ECE"><enum>(ii)</enum><text>permits
				verification through the use of—</text>
									<subclause id="ID2697DB03A7FB4C71AC315C23634FABD0"><enum>(I)</enum><text>a paper
				record;</text>
									</subclause><subclause id="id8A47D2129CF6496690B7424C56D75B91"><enum>(II)</enum><text>an electronic
				record;</text>
									</subclause><subclause id="ID9705359AA71149BA85A0BD028F65DC7B"><enum>(III)</enum><text>an audio
				record;</text>
									</subclause><subclause id="id39A83C9E21D349049D4940E17D06D0A2"><enum>(IV)</enum><text>a video
				record;</text>
									</subclause><subclause id="idD918C02E49464538A3E304A6258046F6"><enum>(V)</enum><text>a pictorial
				record; or</text>
									</subclause><subclause id="id037A57E6447C4F0186273B3CBB507AA7"><enum>(VI)</enum><text>another
				independently produced record.</text>
									</subclause></clause></subparagraph><subparagraph id="idB77D1EF0DE4F4874A7A6B7BFA4AD3663"><enum>(B)</enum><header>Audit
				capacity</header><text>The final record used for independent verification under
				subparagraph (A) for each voter shall be auditable.</text>
							</subparagraph><subparagraph id="idC4FB4C23ACB746AD8C55AAF126FC439A"><enum>(C)</enum><header>Accessibility
				for individuals with disabilities and language minorities</header><text>Any
				method of independent verification under subparagraph (A) shall—</text>
								<clause id="idB34D02EA94B040B78534D226290CC0FC"><enum>(i)</enum><text>be accessible for
				individuals with disabilities, including nonvisual accessibility for the blind
				and visually impaired, in a manner that provides the same opportunity for
				access and participation (including privacy and independence) as for other
				voters; and</text>
								</clause><clause id="idC95DE1402CF843C4AF47B3C45857997A"><enum>(ii)</enum><text>provide
				alternative language accessibility pursuant to the requirements of section 203
				of the Voting Rights Act of 1965 (42 U.S.C. 1973aa–1a).</text>
								</clause></subparagraph><subparagraph commented="no" id="ID37C145C746C047E8BB98CBA53A332995"><enum>(D)</enum><header>Voting systems
				to which this paragraph applies</header><text>The requirements of this
				paragraph apply to any voting system other than—</text>
								<clause commented="no" id="idC34AD44A06824E4183CF7AEAE28B7997"><enum>(i)</enum><text>a voting system
				which uses paper ballots that are personally marked by the voter; and</text>
								</clause><clause commented="no" id="idEE21E2C993C2418E86C15E0BAC6E4C64"><enum>(ii)</enum><text>a voting system
				purchased before January 1, 2009, in order to meet the requirements of
				paragraph (3)(B).</text>
								</clause></subparagraph><subparagraph commented="no" id="id255D1036D80843D4AAD7BA54FB14DB4C"><enum>(E)</enum><header>Clarification</header><text>For
				purposes of this paragraph, a paper record which is produced by the device on
				which a vote is cast shall be considered independent of such
				device.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id745ED7B216BE4F83AC3E919740E665C9"><enum>(2)</enum><header>Innovative
			 approaches to vote verification</header>
					<subparagraph id="id984A7B29E32A4CE18F05D912E87F4479"><enum>(A)</enum><header>Recommendations</header><text>Section
			 221 of such Act (42 U.S.C. 15361) is amended—</text>
						<clause id="idCCC08667A23C41C89C1477554C411B12"><enum>(i)</enum><text>by
			 redesignating subsection (f) as subsection (g); and</text>
						</clause><clause id="id20BD6331C6FB4ECD83DC9896D80803EC"><enum>(ii)</enum><text>by
			 inserting after subsection (e) the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="idE4645D875F7E44AEB311FAD18CB3E13E" style="OLC">
								<subsection id="id6FCC17D8B1A64FF5953C0CC5DC9E3C5C"><enum>(f)</enum><header>Innovative
				approaches to vote verification</header>
									<paragraph id="idBCEEE131636F40B596EAF4724885ACA0"><enum>(1)</enum><header>Development of
				recommendations</header><text>The Development Committee, with technical support
				provided by the National Institute of Standards and Technology under subsection
				(e), shall develop recommendations for the use of innovative approaches for the
				verification of votes under section 301(a)(7)(A)(ii).</text>
									</paragraph><paragraph id="id618DA1E814954443ACF3D810BF07EA5A"><enum>(2)</enum><header>Considerations</header><text>In
				developing recommendations under this subsection, the Development Committee may
				consider—</text>
										<subparagraph id="id8F27BA12884E4B57BCD864285328EDA7"><enum>(A)</enum><text>best scientific
				practices and technical knowledge; and</text>
										</subparagraph><subparagraph id="id48B9D0CE0F194CF395A35A63AD93A51E"><enum>(B)</enum><text>the results of
				any development, testing, or analysis conducted under a grant made under
				section 248 or 249.</text>
										</subparagraph></paragraph><paragraph id="id535BACD4B27E4148AFB65BFD362C388A"><enum>(3)</enum><header>Deadline for
				initial set of recommendations</header><text>The Development Committee shall
				provide its first set of recommendations under this subsection to the Executive
				Director of the Commission not later than 2 years after the date of enactment
				of the <short-title>Bipartisan Electronic Voting Reform
				Act of 2008</short-title>.</text>
									</paragraph><paragraph id="idA47E41D9E6B84AF685E00163A2E5A62C"><enum>(4)</enum><header>Annual
				reports</header><text>Not later than 1 year after such date of enactment, and
				annually thereafter, the Commission shall submit a report to Congress on the
				process, progress, and the costs of implementation of innovative approaches for
				the verification of votes under section
				301(a)(7)(A)(ii).</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idC413722D7DD944FD99E40AB8BA4544EF"><enum>(B)</enum><header>Process for
			 adoption</header><text>Section 222(b)(1) of such Act (42 U.S.C. 15362(b)(1)) is
			 amended by inserting <quote>, including any recommendations provided by the
			 Technical Guidelines Development Committee under section 221(f)</quote> before
			 the period at the end.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEBE5DF3D33BA4293B2DEED3473C048F5"><enum>(c)</enum><header>Effective
			 date</header><text>Subsection (d) of section 301 of such Act (42 U.S.C.
			 15481(d)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id117D8EF439A0429089C4EFE2579E4EA3"><enum>(1)</enum><text>by striking
			 <quote>Each State</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id02498756C8EC4DC49AB9C566AE76214F" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id266E1D1D35794B32910E944B73DC2A63"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), each

				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26EB19B316D748F3A2F29818335CCE56"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id910353FF42A84341A47AF9A4671EC5F1" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id021EE55B61CF4DEF95F3762F4B643110"><enum>(2)</enum><header>Independent
				verification provisions</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idFDCB0F80C45945BE8566D2036905D2E7"><enum>(A)</enum><header>In
				general</header><text>Each State and jurisdiction shall be required to comply
				with the requirements of paragraph (7) of subsection (a) on and after January
				1, 2013.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id009A7576F5484437B96BA3ED18835ECA"><enum>(B)</enum><header>Waiver</header><text>In
				the case of a State or jurisdiction which is granted a waiver by the Election
				Assistance Commission pursuant to this subparagraph, subparagraph (A) shall be
				applied by substituting <quote>2015</quote> for
				<quote>2013</quote>.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idAFE6222A065A417D9508BE3AC4C67F39"><enum>3.</enum><header>Audits</header>
			<subsection commented="no" id="idFA89D5DE70AB49EEB8138C218CA8DB31"><enum>(a)</enum><header>Purpose</header><text>The
			 purposes of this section are—</text>
				<paragraph commented="no" id="idBBA87CDBF62D47F4B590D379488C0A77"><enum>(1)</enum><text>to ensure that
			 each certificate of election awarded under State law is justified by the vote
			 totals;</text>
				</paragraph><paragraph commented="no" id="idE69DD7A787EF4D6BA5D2F484DA9EA615"><enum>(2)</enum><text>to ensure that,
			 even in elections where the results are not close, individual votes are counted
			 correctly; and</text>
				</paragraph><paragraph commented="no" id="idBC85D5A9BD10439AB0373B2AA840EFAC"><enum>(3)</enum><text>to provide
			 information to election officials for the improvement of election processes and
			 technologies.</text>
				</paragraph></subsection><subsection commented="no" id="idBE86CAE730474533B8F6D0B8F1656BB1"><enum>(b)</enum><header>Mandatory
			 audits</header>
				<paragraph commented="no" id="id93AED282D00B442EA80522EBF314F783"><enum>(1)</enum><header>In
			 general</header><text>Subtitle A of title III of the Help America Vote Act of
			 2002 (42 U.S.C. 15481 et seq.) is amended by redesignating sections 304 and 305
			 as sections 305 and 306, respectively, and by inserting after section 303 the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="id8F68B24F75CB4290B1104AA946285C0A" style="OLC">
						<section id="idF68E2A2F6A264B61BB1869DBAE66D691"><enum>304.</enum><header>Election
				audits</header>
							<subsection id="idB04486580F6C4AB799C13733B5CB70E6"><enum>(a)</enum><header>Audits</header>
								<paragraph id="id2686EFA23F6E415BA7B4733410E8701A"><enum>(1)</enum><header>In
				general</header><text>With respect to each election for Federal office, each
				State shall conduct an audit.</text>
								</paragraph><paragraph id="idEF92A8FD25B744379FFC01466D36CA66"><enum>(2)</enum><header>Public
				participation</header><text>Each audit under this section shall be conducted in
				a public and transparent manner.</text>
								</paragraph><paragraph id="id4F2DA4CDCE3E4D2EA7DD89B5CDB70052"><enum>(3)</enum><header>Audit
				reports</header>
									<subparagraph id="idA255B9B1F935499CAB9C61E625B131C0"><enum>(A)</enum><header>State
				submission of report</header><text>Each State shall submit to the Commission a
				report, in such form as provided by the Commission, on the results of the audit
				conducted under this section.</text>
									</subparagraph><subparagraph id="id09D39E3057074CE5A683964781B746EF"><enum>(B)</enum><header>Publication</header><text>The
				Commission shall publish each report submitted under subparagraph (A) upon
				receipt.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id050DC8626BF741C8BF12178CA976E93A"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
				date</header><text display-inline="yes-display-inline">Each State shall be
				required to comply with the requirements of this section on and after the date
				such State is required to comply with the requirements under section
				301(a)(7).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCD4E574216724F28B8878D7C55A6967C"><enum>(2)</enum><header>Availability of
			 enforcement under Help America Vote Act of 2002</header><text>Section 401 of
			 such Act (42 U.S.C. 15511) is amended by striking <quote>and 303</quote> and
			 inserting <quote>303, and 304</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B9AF99386B8499488ECE8A86AB2BA01"><enum>(3)</enum><header>Clerical

			 guidelines</header>
				<paragraph id="idD40554644A3A460FB9E566ADA02BF3F7"><enum>(1)</enum><header>In
			 general</header><text>Subtitle A of title II of the Help America Vote Act of
			 2002 (42 U.S.C. 15321 et seq.) is amended by adding at the end the following
			 new part:</text>
					<quoted-block display-inline="no-display-inline" id="id2BDDAC4798224FD4A9E994ADF74A88DE" style="OLC">
						<part id="idBAA92BA5EA494897ACB44D2B51964A03"><enum>4<?LEXA-Enum 4?></enum><header>Model audit guidelines.</header>
							<section id="idDAF4399211A342378613854248327A08"><enum>223.</enum><header>Audit
				guidelines development task force</header>
								<subsection id="id1F0199D9076F452D83033BF6FB85D966"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Commission shall establish an Audit
				Guidelines Development Task Force (hereafter in this part referred to as the
				<quote>Task Force</quote>).</text>
								</subsection><subsection id="id409D3972A7C24C3286162D4C54E0E30E"><enum>(b)</enum><header>Membership</header>
									<paragraph id="id7869532C7C854F79A2C9B4CDF506223A"><enum>(1)</enum><header>In
				general</header><text>The Task Force shall be composed of individuals who are
				experts in such fields as election audits, physical security of ballots,
				recounts, computer technology, and election management. The composition of the
				Task Force shall (to the extent possible) reflect the demographic composition
				of the voting age population of the United States.</text>
									</paragraph><paragraph id="idE728D77950474971BBE151858E91B236"><enum>(2)</enum><header>Consultation</header><text>The
				Commission shall consult with the Director of the National Institute of
				Standards and Technology on—</text>
										<subparagraph id="idD3BF6659DFDD4462AF6BBC219FA68D73"><enum>(A)</enum><text>the composition
				of the Task Force; and</text>
										</subparagraph><subparagraph id="id5057652D1B30410C9504C341CD97C269"><enum>(B)</enum><text>the appointment
				of members to the Task Force.</text>
										</subparagraph></paragraph></subsection><subsection id="id320D0E4FAB36417E909E0C727492B910"><enum>(c)</enum><header>Duties</header>
									<paragraph id="idC1A075406A2B4DA39A2B954C006ED674"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Task Force shall
				assist the Commission in developing model audit guidelines for administrative
				and procedural practices to ensure efficient, transparent, and accurate audits
				of Federal elections. Such guidelines shall include best practices with respect
				to auditing Federal elections using the following independently verified
				records under section 301(a)(7):</text>
										<subparagraph id="idA1F70E2DEBE947EBB71112BFDDFD97D1"><enum>(A)</enum><text>Paper
				records.</text>
										</subparagraph><subparagraph id="id765B96C868CB4955AB88C2A4C7FF5AE4"><enum>(B)</enum><text>Electronic
				records.</text>
										</subparagraph><subparagraph id="id890F57555D14419D927E4F7306AF0357"><enum>(C)</enum><text>Audio
				records.</text>
										</subparagraph><subparagraph id="id6A7BAF8637534F27BA466F43C3C4802B"><enum>(D)</enum><text>Video
				records.</text>
										</subparagraph><subparagraph id="id7D6424F776754984BEA1CFEBF15F996A"><enum>(E)</enum><text>Pictorial
				records.</text>
										</subparagraph><subparagraph id="idE7BA2D771CC54989B8CA76F29799AE8F"><enum>(F)</enum><text>Other
				independently produced records.</text>
										</subparagraph></paragraph><paragraph id="idC1F07595B8434879B0887EC957350171"><enum>(2)</enum><header>Deadline for
				initial set of recommendations</header><text>The Task Force shall provide its
				first set of recommendations under this section to the Executive Director of
				the Commission not later than 1 year after the Task Force is
				established.</text>
									</paragraph></subsection><subsection id="idD78E80C294D246278F8E5F465AC67E38"><enum>(d)</enum><header>Considerations</header><text>In
				developing the model audit guidelines under subsection (c), the Task Force
				shall consider—</text>
									<paragraph id="idA6C9271883DF48B2961FA52ACA208F64"><enum>(1)</enum><text>the time, place,
				and manner for conducting audits;</text>
									</paragraph><paragraph id="idA447B722247044D39401D1D62C5248BC"><enum>(2)</enum><text>processes for
				completing manual audits of independently verified records under section
				301(a)(7) comparing such records with vote tallies;</text>
									</paragraph><paragraph id="idC29AD6301F3B482AB9D677290E9F7C11"><enum>(3)</enum><text>the cost and
				burden on local election officials of conducting an audit;</text>
									</paragraph><paragraph id="id8A532B8C0EDD47A59D8A1F2C2C3D46FC"><enum>(4)</enum><text>the personnel and
				management requirements of conducting audits;</text>
									</paragraph><paragraph id="idBA1546C8C8264F90B6AEB8F0F48A79BD"><enum>(5)</enum><text>recommended
				protocols for auditing the security of elections, including chain of custody
				protocols, the maintenance, security, and accuracy of voter registration lists,
				and other procedures; and</text>

				technologies, and other innovations used in connection with voting systems for
				independent verification and for other voting processes and purposes (including
				ballots and independently verified records under section 301(a)(7)) is
				documented by State election officials, under standards developed by the State,
				and made available to the Commission upon request.</text>
							</subparagraph><subparagraph id="id6E6AC66565B942959ECF94EEE53F8C7E"><enum>(B)</enum><header>Consideration
				of relevant guidance</header><text>The Commission shall encourage States to
				take into consideration any relevant voluntary guidance adopted by the
				Commission under subtitle B in developing standards under subparagraph
				(A).</text>
							</subparagraph></paragraph><paragraph commented="no" id="idFDAEEDFB802946A9AD1B7AFDD3771992"><enum>(9)</enum><header>Disclosure</header>
							<subparagraph commented="no" id="id0EDA08A18B2544A9AB9442A1AC68C434"><enum>(A)</enum><header>Disclosure of
				election-dedicated software</header><text>No voting system used in an election
				for Federal office shall at any time contain or use any software unless the
				State using such voting system discloses a State-certified copy of the software
				(including executable code and source code) to the Commission. The software
				shall be disclosed in a form and manner prescribed by the Commission, except
				that, in the case of software additions or patches which are necessary for the
				secure and proper functioning of the voting system and the disclosure of which
				cannot be made in adequate time prior to the election, such disclosure shall be
				made in a reasonable period of time after the election.</text>
							</subparagraph><subparagraph commented="no" id="id9D27B2F585354A6AABD44CDE1722D8F1"><enum>(B)</enum><header>Storage of
				software</header><text display-inline="yes-display-inline">The Commission shall
				provide for the storage of software disclosed under this paragraph.</text>
							</subparagraph><subparagraph commented="no" id="IDac4e2696715e418ea4a2ce93594748d0"><enum>(C)</enum><header>Use of
				information</header><text>Software disclosed to the Commission under this
				paragraph may only be provided to—</text>
								<clause commented="no" id="idC45B73E7E299400DB15AE2CAC89C8DF3"><enum>(i)</enum><text>the National
				Institute of Standards and Technology; and</text>
								</clause><clause commented="no" id="id69F8056B12EA47E0A01C3A96CC63DFAD"><enum>(ii)</enum><text>the Voting
				System Software Review Committee established under subparagraph (D), for
				purposes of conducting reviews under such subparagraph.</text>
								</clause></subparagraph><subparagraph commented="no" id="idC75BE5DE68DD45B1B3B108AA6253BCC9"><enum>(D)</enum><header>Voting System
				Software Review Committee</header>
								<clause commented="no" id="id6C3DA495A6E943B0A4B2F48AA9B9E8F7"><enum>(i)</enum><header>Establishment</header><text>The
				National Institute of Standards and Technology shall establish a Voting System
				Software Review Committee (hereinafter in this subparagraph referred to as the
				<quote>committee</quote>), which shall review voting system software that has
				not been certified by the Commission under section 231.</text>
								</clause><clause commented="no" id="id8543C6D419BB484FB02E81D27DA384BB"><enum>(ii)</enum><header>Members</header><text>The
				committee shall be composed of members appointed by the Director of the
				National Institute of Standards and Technology, in consultation with the
				Commission, from among academic and industry experts.</text>
								</clause><clause id="IDF9EBBD586A6D43A2814C9D7D8FAF76A8"><enum>(iii)</enum><header>Vacancies</header><text>A
				vacancy on the committee—</text>
									<subclause id="IDA9631872155B4CE58B499962B1D0217B"><enum>(I)</enum><text>shall not affect
				the powers of the committee; and</text>
									</subclause><subclause id="ID22AE9E5E9568490B908023D1C2BCBD2E"><enum>(II)</enum><text>shall be filled
				in the same manner as the original appointment was made.</text>
									</subclause></clause><clause commented="no" id="id4A3FA0F215634CEEB50D1FBD0FCEC231"><enum>(iv)</enum><header>Appointment</header><text>Members
				of the committee shall be appointed as special Government employees for
				purposes of section 202(a) of title 18, United States Code.</text>
								</clause><clause commented="no" id="id7539D21608F0412FB85C0D203197EB0F"><enum>(v)</enum><header>Status as
				permanent committee</header><text>Section 14 of the Federal Advisory Committee

										</item></subclause><subclause commented="no" id="id87B4CAE401B54A09845D16105E300EF4"><enum>(II)</enum><header>Scope of
				review</header><text>The review conducted under subclause (I) shall be
				sufficient to address any issues raised by the chief State election official or
				the Commission, as applicable.</text>
									</subclause><subclause commented="no" id="id5CD393AF5CDA4979B058399A4516EF85"><enum>(III)</enum><header>Access to
				information</header><text>The Commission shall provide software disclosed by
				States under subparagraph (A) to the National Institute of Standards and
				Technology and, upon request by the committee, to the committee. The committee
				may request and use such software solely for purposes of conducting reviews
				under this subparagraph. The committee may, through the National Institute of
				Standards and Technology, request that a State provide the committee with
				access to voting system hardware as necessary for purposes of conducting such
				reviews.</text>
									</subclause><subclause commented="no" id="idD4EE0E0CA3F94D51A779477AB547BC2E"><enum>(IV)</enum><header>Petition for
				reviews</header><text>The committee may petition the Commission to request a
				review under subclause (I)(bb).</text>
									</subclause></clause><clause commented="no" id="id1AEC1380E7674ADCA12AFC8256EB742D"><enum>(vii)</enum><header>Reports</header>
									<subclause commented="no" id="id6EF8A413945D43D38D8ACADD7F5C4C5A"><enum>(I)</enum><header>In
				general</header><text>The committee shall submit a report to the Commission and
				to the National Institute of Standards and Technology containing the results of
				any review conducted under this subparagraph, including the findings of the
				committee with respect to the issues raised by the chief State election
				official or the Commission, as applicable.</text>
									</subclause><subclause commented="no" id="idC8ED1A1E5E1042358E4F19659E91920F"><enum>(II)</enum><header>Publication</header><text>The
				National Institute of Standards and Technology shall publish each report
				submitted under subclause (I), together with any comments of the National
				Institute of Standards and Technology with respect to the findings in each such
				report.</text>
									</subclause></clause><clause id="ID40CD19C2755743E0A877328695537261"><enum>(viii)</enum><header>Compensation
				of members</header>
									<subclause id="ID1A40196105E04287A11950D7E5282201"><enum>(I)</enum><header>Non-federal
				employees</header><text>A member of the committee who is not an officer or
				employee of the Federal Government may be compensated at a rate equal to the
				daily equivalent of the annual rate of basic pay prescribed for level IV of the
				Executive Schedule under section 5315 of title 5, United States Code, for each
				day (including travel time) during which the member is engaged in the
				performance of the duties of the committee.</text>
									</subclause><subclause id="IDF170DB3F2EB24A4DA5FE6C27B54F1CFD"><enum>(II)</enum><header>Federal
				employees</header><text>A member of the committee who is an officer or employee
				of the Federal Government shall serve without compensation in addition to the
				compensation received for the services of the member as an officer or employee
				of the Federal Government.</text>
									</subclause></clause><clause id="ID2806C7831D624B0282FF382049442273"><enum>(ix)</enum><header>Travel
				expenses</header><text>A member of the committee shall be allowed travel
				expenses, including per diem in lieu of subsistence, at rates authorized for an
				employee of an agency under subchapter I of chapter 57 of title 5, United
				States Code, while away from the home or regular place of business of the
				member in the performance of the duties of the committee.</text>
								</clause><clause id="id633B581A4A384359A5AF9DCFDBB377CE"><enum>(x)</enum><header>Experts and
				consultants</header><text>The National Institute of Standards and Technology
				may procure temporary and intermittent services under section 3109(b) of title
				5, United States Code, on behalf of the committee.</text>
								</clause></subparagraph><subparagraph commented="no" id="ID336ee5dde6ad42759d50ed962543e3c5"><enum>(E)</enum><header>Protection of
				software provided through disclosure</header><text>Any recipient of software
				disclosed under this paragraph—</text>
								<clause commented="no" id="id6403674ADF584E708476328C5C85145E"><enum>(i)</enum><text>shall not
				compromise the integrity of the software;</text>
								</clause><clause commented="no" id="idF862E075BB904CA3AB1FDAEB8DA77DC9"><enum>(ii)</enum><text>shall not
				disclose any trade secrets or other confidential commercial information with
				respect to the software; and</text>
								</clause><clause commented="no" id="id52561EF6303248569E9F24CA65858C33"><enum>(iii)</enum><text>shall not
				violate any intellectual property rights in the
				software.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DA5E6C904384A72B61074DBE22B09DA"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 301(d)(2)(A) of such Act, as added by section
			 2(c), is amended by striking <quote>paragraph (7)</quote> and inserting
			 <quote>paragraphs (7), (8), and (9)</quote>.</text>

				integrity of the voting process at the polling place on Election Day (which may
				include standards with respect to chain of custody, parallel testing of voting
				systems, routine inspections of polling places for the use of appropriate
				polling procedures, and other processes); and</text>
						</subparagraph><subparagraph id="ID09a14ce83fd647b19bde23515e9bc0bd"><enum>(B)</enum><text>the education and
				training of poll workers (which may include standards with respect to Federal
				and State law requirements, voting systems, the provision of contact
				information, and other
				processes).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2096233893df41508b582dc5aef70008"><enum>(c)</enum><header>Contingency
			 plans</header><text>Section 254(a) of such Act (42 U.S.C. 15404(a)), as amended
			 by subsection (b), is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id20DB453249ED44979DB70A192D4869D3" style="OLC">
					<paragraph id="id6719FE1533F94CAEBA05AA97C0CEC313"><enum>(16)</enum><text>How the State
				will provide for contingency plans in the event of voting system failures and
				other events, such as national or State emergencies, that may impact the
				results of an election for Federal office, including—</text>
						<subparagraph id="idDFB24F5BA9A242FFB55897DE9F468CCF"><enum>(A)</enum><text>how the State
				will ensure the integrity of the voting process on election day—</text>
							<clause id="id0C1A542793264AF0B52B835ABE3694A6"><enum>(i)</enum><text>at the polling
				place (which may include the use of emergency ballots by means of a paper
				record, an electronic record, an audio record, a video record, a pictorial
				record, or another independently produced record); and</text>
							</clause><clause id="id30A22D633B8442BFA799189BF1EDCBE3"><enum>(ii)</enum><text>at any place
				other than the polling place;</text>
							</clause></subparagraph><subparagraph id="id4EBCC1631BF948D58794F2E663F1C75C"><enum>(B)</enum><text>if the State
				provides for the use of emergency paper ballots, how the State will comply with
				the accessibility requirements for individuals with disabilities under section
				301(a)(3)(A) and the alternative language accessibility requirements under
				section 301(a)(4); and</text>
						</subparagraph><subparagraph id="idE85A1AC62E574615B6A3C64F785CE3FE"><enum>(C)</enum><text>the selection of
				polling locations that are best able to manage voting system failures and other
				events that may impact the
				election.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="IDbea29bd4e79447c28f7e8b3679ccf09a"><enum>(d)</enum><header>Voluntary
			 voting system guidelines</header><text>Section 222 of such Act (42 U.S.C.
			 15362) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id190348FB8FF346CF88D3CCDE7F6E6B0A" style="OLC">
					<subsection commented="no" id="idD2E742E860EC45B5BEE8304274E9895B"><enum>(f)</enum><header>Guidelines</header><text>The
				voluntary voting system guidelines referred to in this Act shall be the most
				recent version of the guidelines adopted by the Commission under subsection (d)
				after the guidelines effective in
				2007.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID3dc3e6b76ac04381a2aa592cf7a5341c"><enum>5.</enum><header>Testing and
			 certification</header>
			<subsection id="HA6E0FA8381644467A43B91FC00916D07"><enum>(a)</enum><header>In
			 general</header><text>Section 231(b) of the Help America Vote Act of 2002
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/15371">42 U.S.C.
			 15371(b)</external-xref>) is amended by adding at the end the following new
			 paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="H9542AB70ECB948098D2001A316B7C447" style="OLC">
					<paragraph commented="no" id="HE06563F071194AC99DC6038FD73B42FA"><enum>(3)</enum><header>Prohibiting
				conflicts of interest and ensuring testing independence</header>
						<subparagraph commented="no" id="HE43CA07F9CE344B18CF04362BB532763"><enum>(A)</enum><header>Prohibiting
				conflicts of interest</header>
							<clause commented="no" id="id818525FCFA4B4649BBFA78ECBEF1954C"><enum>(i)</enum><header>In
				general</header><text>A laboratory may not be accredited by the Commission for
				purposes of this section unless—</text>
								<subclause commented="no" id="H32664A25B6B0406380283400261C80E3"><enum>(I)</enum><text>the laboratory
				certifies that the only compensation it receives for the testing carried out in
				connection with the certification, decertification, and recertification of the
				manufacturer’s voting system hardware and software is the payment made from the
				Election Assistance Commission Voting System Testing Revolving Fund under
				paragraph (4);</text>
								</subclause><subclause commented="no" id="H985E5387D1714D8FA1A400699C48C5DA"><enum>(II)</enum><text>the laboratory
				meets such standards as the Commission shall establish (after notice and
				opportunity for public comment) to prevent the existence or appearance of any
				conflict of interest in the testing carried out by the laboratory under this
				section, including standards to ensure that the laboratory does not have a
				financial interest in the manufacture, sale, and distribution of voting system
				hardware and software, and is sufficiently independent from other persons with
				such an interest;</text>
								</subclause><subclause commented="no" id="H217AE8048FE14C3692A88705A2D1ED8F"><enum>(III)</enum><text display-inline="yes-display-inline">the laboratory certifies that it will
				permit an expert designated by the Commission to observe any testing the
				laboratory carries out under this section; and</text>
								</subclause><subclause commented="no" id="H469CAE23DC5C4DE98844274F55765F35"><enum>(IV)</enum><text>the laboratory,
				upon completion of any testing carried out under this section, discloses the
				test protocols, results, and all communication between the laboratory and the
				manufacturer to the Commission.</text>
								</subclause></clause><clause commented="no" id="H0C3E88E3DC0545F8AF1C7D393E506B7F"><enum>(ii)</enum><header>Availability of
				results</header><text>Upon receipt of information under clause (i), the
				Commission shall make the information available promptly to election officials
				and the public. The Commission shall ensure such disclosure does not include
				any trade secrets or confidential information and does not violate intellectual
				property rights.</text>
							</clause><clause commented="no" id="idB7CEF3307AFF47FCB8DEDAEDCAF7040F"><enum>(iii)</enum><header>Additional
				requirements</header><text>The Commission may establish—</text>
								<subclause commented="no" id="id794DBA45F3C74674ACF42C72A73588D1"><enum>(I)</enum><text>requirements for
				the governance of accredited laboratories; and</text>
								</subclause><subclause commented="no" id="idA38459AAD07C453288461B3C9295D8B4"><enum>(II)</enum><text>such additional
				requirements as the Commission determines are necessary to improve the ethical,
				effective, and independent testing of voting system hardware and software under
				this section.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" id="id8D305F3E092B461E83268C877CB0AEFA"><enum>(B)</enum><header>Testing
				independence</header><text>The Commission shall establish procedures to ensure
				that all testing of voting system hardware and software under this section by
				accredited laboratories is conducted in a manner that is independent from the
				influence and control of the manufacturer of such hardware or software.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HD497A3AB533C4287A0EC5841A061CA62"><enum>(4)</enum><header>Establishment of
				a revolving fund to provide for the independent testing of voting systems by
				the commission</header>
						<subparagraph id="ID28f21e1790844340b030e845a008f822"><enum>(A)</enum><header>In
				general</header><text>There is hereby established in the treasury of the United
				States a revolving fund, to be known as the <quote>Election Assistance
				Commission Voting System Testing Revolving Fund</quote> (hereinafter in this
				paragraph referred to as the <quote>Fund</quote>), consisting of—</text>
							<clause id="IDee15e6a24b0d43b5a00a4a0374ad3b69"><enum>(i)</enum><text>such amounts as
				are collected pursuant to subparagraph (B); and</text>
							</clause><clause id="id59F1CEDCA33F46289480443A3365416E"><enum>(ii)</enum><text>such amounts as
				are appropriated to the Fund pursuant to the authorization under subparagraph
				(F).</text>
							</clause></subparagraph><subparagraph id="idDB2AFD9C84B549FF9D75A45E7C375B48"><enum>(B)</enum><header>Collection of
				fees</header>
							<clause id="idC0891AA4C99F495290A333FFB6D09CBE"><enum>(i)</enum><header>In
				general</header><text>The Commission shall establish fees for testing carried
				out in connection with the certification, decertification, and recertification
				of voting system hardware and software under this section.</text>
							</clause><clause id="id301E6FD2F4DA47768A1F710DECA63735"><enum>(ii)</enum><header>Determination
				of fee amount</header><text>The amount of the fee established under clause (i)
				shall be equal to the sum of—</text>
								<subclause id="id95EB086A2A8841249C7D66B525DF95B5"><enum>(I)</enum><text>the costs to an
				accredited laboratory of conducting the testing of such hardware or software
				(as estimated by the Commission); and</text>
								</subclause><subclause id="id19EA034909FD4837B5D6AF7874B146CA"><enum>(II)</enum><text>an appropriate
				percentage of the costs of the Commission which are associated with
				administering, overseeing, and operating the Fund (as determined by the
				Commission).</text>
								</subclause></clause></subparagraph><subparagraph id="IDce959f7866d5409397da267072f3368a"><enum>(C)</enum><header>Use of
				funds</header><text>Amounts in the Fund may be used for the following
				purposes:</text>
							<clause id="ID0e5c6ea3d5ab43c89a30b4dae6e944ce"><enum>(i)</enum><text>To provide
				payments to accredited laboratories for the testing of voting system hardware
				and software by such laboratories in connection with the certification,
				decertification, and recertification of the hardware and software under this
				section.</text>
							</clause><clause id="IDb8505d5f9e0d4dc9b27a3698ae200619"><enum>(ii)</enum><text>To administer,
				oversee, and operate the Fund, except such amounts may not be used for the
				hiring or payment of personnel.</text>
							</clause><clause commented="no" id="ID3086f36896e4494e90f1dd400463cd68"><enum>(iii)</enum><text>To return any
				unused portion of fees collected under subparagraph (B) in the case where such
				fees exceeded the actual costs of the testing conducted or an appropriate
				percentage of the actual costs associated with administering, overseeing, and
				operating the Fund.</text>
							</clause></subparagraph><subparagraph id="ID5dd5ae0fdcc7499997f3e2b266fa3b6e"><enum>(D)</enum><header>Availability of
				funds</header><text>Amounts in the Fund shall be available to the Commission
				without fiscal year limitation.</text>
						</subparagraph><subparagraph id="IDb99c3dd19c984dedb8904ae93fce93ed"><enum>(E)</enum><header>Annual report
				to congress</header><text>Not later than June 30 of each year (beginning with
				2010), the Commission shall submit to Congress a report on the Fund established
				under this paragraph. Such report shall include the following
				information:</text>
							<clause id="IDb3479afc46214481b1f9ffa029e5c458"><enum>(i)</enum><text>During the
				preceding calendar year, the number of instances where voting system hardware
				and software was—</text>
								<subclause id="idC203F91089D542DEA4B73DAC3DC8A247"><enum>(I)</enum><text>submitted to an
				accredited laboratory for testing under this section;</text>
								</subclause><subclause id="IDbce664872b144ec3828bad5e6f24e57b"><enum>(II)</enum><text>tested by each
				accredited laboratory under this section; and</text>
								</subclause><subclause id="ID4c6607b397e94dc3810066f96a6bbb9c"><enum>(III)</enum><text>certified,
				decertified, or recertified by an accredited laboratory as a result of such
				testing.</text>
								</subclause></clause><clause id="ID8cb94af636d84d64ba5f21bfbcddd3b3"><enum>(ii)</enum><text>The balance
				remaining in the Fund on September 30 of the preceding fiscal year.</text>
							</clause><clause id="IDea5162708d3b474f835a2cb1e51e2f8b"><enum>(iii)</enum><text>The total
				amount of fees collected under subparagraph (B) during the preceding fiscal
				year.</text>
							</clause><clause id="ID1b18fa4b49ff4127b0c581c2f51ecca9"><enum>(iv)</enum><text>The total amount
				disbursed from the Fund during the preceding fiscal year.</text>
							</clause><clause id="ID3d0b653ff764408488384e284fdbb00a"><enum>(v)</enum><text>A
				description of how fees collected under subparagraph (B) were used during the
				preceding fiscal year.</text>
							</clause></subparagraph><subparagraph commented="no" id="IDc59c0a7f8b604633a5fb8615263341e8"><enum>(F)</enum><header>Authorization
				of appropriations</header>
							<clause commented="no" id="idE7989D7AFE664A93887A690A6A82C576"><enum>(i)</enum><header>In
				general</header><text>There are authorized to be appropriated such sums as are
				necessary to carry out this paragraph.</text>
							</clause><clause commented="no" id="id0B3E84E4CA4B4EDCAB74BF81DE9671CF"><enum>(ii)</enum><header>Availability
				of funds</header><text>Any amounts appropriated pursuant to the authority of
				clause (i) shall remain available without fiscal year limitation until
				expended.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" id="H3E23F83148E1482B9B5BCE4BEEB5653C"><enum>(5)</enum><header>Dissemination of
				additional information on accredited laboratories</header>
						<subparagraph commented="no" id="H71BE2079687846118701ECEE9631A928"><enum>(A)</enum><header>Information on
				testing</header><text display-inline="yes-display-inline">The Commission shall
				disseminate to the public the identification of the laboratory which carried
				out the testing.</text>
						</subparagraph><subparagraph commented="no" id="H2DE881F903C84D74B1C468CE29A36E78"><enum>(B)</enum><header>Laboratories
				with accreditation revoked or suspended</header><text>If the Commission
				revokes, terminates, or suspends the accreditation of a laboratory under this
				section, or if the Commission has credible evidence of significant security
				failures at accredited laboratories, the Commission shall promptly notify
				Congress, the chief State election official of each State, and the
				public.</text>
						</subparagraph></paragraph><paragraph commented="no" id="id10BE23F837D04C35908573F7F658D947"><enum>(6)</enum><header>GAO
				audits</header>
						<subparagraph commented="no" id="id4B0F3FD86D924471A6EA7AB7783EC9F7"><enum>(A)</enum><header>In
				general</header><text>The Comptroller General of the United States (in this
				paragraph referred to as the <quote>Comptroller General</quote>) shall conduct
				audits of—</text>
							<clause commented="no" id="id87FF46EA141B4905B49B4F972ACB9FA0"><enum>(i)</enum><text>the process for
				testing voting system hardware and software under this section; and</text>
							</clause><clause commented="no" id="id3FCBE79827654B6F9E9BC0860485482A"><enum>(ii)</enum><text>the Election
				Assistance Commission Voting System Testing Revolving Fund established under
				paragraph (4).</text>
							</clause></subparagraph><subparagraph commented="no" id="id86E9F745C5B14ED688C749D81ADA66D6"><enum>(B)</enum><header>Reports</header><text>The
				Comptroller General shall submit reports to Congress containing the results of
				each audit conducted under subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H17EDCCAE96704C2486C4A219192285C3"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 231 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15371">42 U.S.C. 15371</external-xref>)
			 is further amended—</text>
				<paragraph id="HA8AE81333A6D4A0E9483D9907320F299"><enum>(1)</enum><text>in subsection
			 (a)(1), by striking <quote>testing, certification,</quote> and all that follows
			 and inserting the following: <quote>testing of voting system hardware and
			 software by accredited laboratories in connection with the certification,
			 decertification, and recertification of the hardware and software for purposes
			 of this Act.</quote>;</text>
				</paragraph><paragraph id="H5FBEA5FD0A494CE3A2B05863ECE0EDA9"><enum>(2)</enum><text>in subsection
			 (a)(2), by striking <quote>testing, certification,</quote> and all that follows
			 and inserting the following: <quote>testing of its voting system hardware and
			 software by the laboratories accredited by the Commission under this section in
			 connection with certifying, decertifying, and recertifying such
			 hardware.</quote>;</text>
				</paragraph><paragraph id="H8CC4EA81779D4398A6A4E9461614C3AD"><enum>(3)</enum><text>in subsection
			 (b)(1), by striking <quote>testing, certification, decertification, and
			 recertification</quote> and inserting <quote>testing</quote>; and</text>
				</paragraph><paragraph id="H0986E5BBB24E4A3A8353A0491BCAAAFD"><enum>(4)</enum><text>by striking
			 subsection (d).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC4EA827D6EDE4F09952EE113B0B317C1"><enum>(c)</enum><header>Deadline for
			 establishment of standards and procedures and escrow account</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idD46BCC81E6F2430A8F6AFA9DF0B910A0"><enum>(1)</enum><header>In
			 general</header><text>The Election Assistance Commission shall establish the
			 standards described in section 231(b)(3)(A) of the Help America Vote Act of
			 2002, the procedures described in section 231(b)(3)(B) of such Act, and the
			 Election Assistance Commission Voting System Testing Revolving Fund under
			 section 231(b)(4) of such Act (as added by subsection (a)) not later than 12
			 months after the date of the enactment of this Act. Until such time as the
			 Commission establishes such standards, procedures, and Fund, the accreditation
			 of laboratories and the procedure for testing of voting system hardware and
			 software used as of the date of the enactment of this Act shall remain in
			 effect.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA9B0AA4F2BA476EA29D2EA5458C0D16"><enum>(2)</enum><header>Clarification</header><text>The
			 amendments made by this section shall not apply to any voting system hardware
			 or software submitted for testing under section 231 of the Help America Vote
			 Act of 2002 (42 U.S.C. 15371) prior to the date on which the Secretary
			 establishes such standards, procedures, and Fund.</text>
				</paragraph></subsection></section><section id="ID6a391410b78248789482a43a0198df10"><enum>6.</enum><header>Research and
			 development</header>
			<subsection id="IDa6cc33577abe49d688e015fd4e6d87f2"><enum>(a)</enum><header>Grants for the
			 development and testing of new voting systems, technologies, and
			 innovations</header>
				<paragraph id="idEB53BE6798A344DEB2C02B46DEB4CCE5"><enum>(1)</enum><header>In
			 general</header><text>Subtitle C of title II of the Help America Vote Act of
			 2002 (42 U.S.C. 15321 et seq.) is amended by adding at the end the following
			 new section:</text>
					<quoted-block display-inline="no-display-inline" id="id33B0C4376484405BB3A6AD40B06CA84B" style="OLC">
						<section id="idCF00BEE247C44228B00F55A101739EDB"><enum>248.</enum><header>Grants for the
				development and testing of new voting systems, technologies, and

							<subsection id="id12AE653892634CC6907FAB21BB83DE5D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall,
				in consultation with the National Institute of Standards and Technology, make
				grants to qualified academic and research institutions for the development and
				testing of new voting systems, technologies, and innovations for purposes of
				meeting the independent verification requirements under section
				301(a)(7).</text>
							</subsection><subsection id="id318D5605031643D5AC91690BEAE7CC7F"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">An academic and research institution is
				eligible to receive a grant under this section if it submits an application to
				the Commission at such time, in such form, and containing such information and
				certifications as the Commission may require.</text>
							</subsection><subsection id="idB28707DD237F4A36A40815590F01B4ED"><enum>(c)</enum><header>Peer review
				prior to conduct of grant activities</header><text>The Commission shall conduct
				peer review of any activities proposed to be conducted under a grant made under
				this section prior to the conduct of such activities.</text>
							</subsection><subsection id="idC6D2536CA5404D6BB86DA44B1DAC577B"><enum>(d)</enum><header>Applicability
				of regulations governing patent rights in inventions made with Federal
				assistance</header><text>Any invention made by the recipient of a grant under
				this section using funds provided under this section shall be subject to
				chapter 18 of title 35, United States Code (relating to patent rights in
				inventions made with Federal assistance).</text>
							</subsection><subsection id="id352A8C11EEB4470F94055F73628CAD8A"><enum>(e)</enum><header>Report</header>
								<paragraph id="idF7AC0E73C51144B1B31D5F15D4710F0D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each academic and
				research institution which receives a grant under this section shall submit to
				the Commission a report describing the activities carried out with the funds
				provided under the grant.</text>
								</paragraph><paragraph id="id50EA4650DD9B40ADA2259F4795493CAA"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">An academic and research institution shall
				submit a report required under paragraph (1) not later than 6 months after the
				end of the fiscal year for which the entity received the grant which is the
				subject of the report.</text>
								</paragraph></subsection><subsection id="id4ADBCBFBBDCE4BDFA4165FEF447FBEC6"><enum>(f)</enum><header>Authorization
				of appropriations</header>
								<paragraph id="idDA242E380D2A4856B96D94E4C64B3C1A"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated for grants under
				this section $15,000,000 for fiscal year 2009 and such sums as may be necessary

				part (hereafter in this part referred to as the <quote>Task

							</subsection><subsection id="idCB0AF4CE677E480DA9D00A7D32F37C99"><enum>(b)</enum><header>Membership</header><text>The
				Task Force shall be composed of members selected by the Commission, in
				consultation with the Technical Guidelines Development Committee, the Standards
				Board, and the Board of Advisors.</text>
							</subsection><subsection id="idF110EE61E8284A149F7112582A212E5D"><enum>(c)</enum><header>Reports</header><text>The
				Task Force shall submit, not less frequently than annually, to the Committee on
				Rules and Administration of the Senate and the Committee on House
				Administration of the House of Representatives reports on the recommendations
				developed under subsection
				(a).</text>

			 amounts to fund requirements payments under part 1 of subtitle D of title II of
			 the Help America Vote Act of 2002 (42 U.S.C. 15401 et seq.), Congress
			 should—</text>
				<paragraph id="id3FCFDB13BD9943C8AAFF0E613122CA9A"><enum>(1)</enum><text>appropriate
			 amounts sufficient to ensure that States and jurisdictions are able to meet the
			 requirements of title III of such Act (42 U.S.C. 15481 et seq.); and</text>
				</paragraph><paragraph id="id83CEEA86C51443D68EFFFE6F2C53A2D5"><enum>(2)</enum><text>take into
			 consideration the funding levels recommended by the task force on requirements
			 payments under section 259 of such Act (as added by subsection (a)).</text>
				</paragraph></subsection><subsection id="idF70422CF9683474AA3B8A702B0A285F2"><enum>(c)</enum><header>Reauthorization</header><text>Section
			 257(a) of the Help America Vote Act of 2002 (42 U.S.C. 15407(a)) is amended by
			 adding at the end the following new paragraph:</text>

				Congress</header><text>The Commission shall submit to the Committee on Rules of
				the Senate and the Committee on House Administration of the House of
				Representatives an annual report summarizing the expenditures, receipts, and
				activities reported by each State under subsection
				(a).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID450f48c9e4b44d588cc021f68579f583"><enum>8.</enum><header>Technical
			 guidelines development committee</header><text display-inline="no-display-inline">Section 221(c)(1) of the Help America Vote
			 Act of 2002 (42 U.S.C. 15361(c)(1)) is amended—</text>
			<paragraph id="idCDECE884DBDF4763AE365FF9C41205F9"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by striking <quote>14</quote> and inserting <quote>16</quote>;</text>
			</paragraph><paragraph id="id01C85100AB15483B926092E7DAB19D80"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (E) as
			 subparagraph (G); and</text>

			</paragraph></section><section id="id43649FFE5BF44C499F8521D1C34C2C45"><enum>9.</enum><header>Prohibiting
			 refusal to accept voter registration and absentee ballot applications and
			 Federal write-in absentee ballots for failure to meet nonessential
			 requirements</header>
			<subsection id="idBF5CAFAAFB264526981DAB8E357CFC31"><enum>(a)</enum><header>Voter
			 Registration and Absentee Ballot Applications</header><text>Section 102 of the
			 Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C. 1973ff–1) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id48B840B68B4842DCBBF1AE21DA1D3111" style="OLC">
					<subsection id="id6A364DD4F6C2464E938EB826F8DF206C"><enum>(e)</enum><header>Prohibiting
				Refusal To Accept Applications for Failure To Meet Nonessential
				Requirements</header><text>A State shall accept and process any otherwise valid
				voter registration application or absentee ballot application (including the
				official post card form prescribed under section 101) submitted in any manner
				by an absent uniformed services voter or overseas voter that contains the
				information required on the official post card form prescribed under section
				101 (other than information which the Presidential designee, in consultation
				with the Election Assistance Commission, determines, under regulations
				promulgated by the Presidential designee, is not clearly necessary to prevent
				fraud in the conduct of
				elections).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id6F5CC1A65A584F989458BE0E67F268EA"><enum>(b)</enum><header>Federal
			 Write-In Absentee Ballot</header><text>Section 103 of such Act (42 U.S.C.
			 1973ff–2) is amended—</text>
				<paragraph id="idB09C723E390B4E6CAEB6F20E22954771"><enum>(1)</enum><text>by redesignating
			 subsection (f) as subsection (g); and</text>
				</paragraph><paragraph id="idC69BCEF3AB0240F1B395B673D2DE0669"><enum>(2)</enum><text>by inserting
			 after subsection (e) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="id1FCA7E8491BA4EBE916E4AC1B29A2F1C" style="OLC">
						<subsection id="idF416C01F4B1F416DB9112431C8007955"><enum>(f)</enum><header>Prohibiting
				Refusal To Accept Ballot for Failure To Meet Nonessential
				Requirements</header><text>A State shall accept and process any otherwise valid
				Federal write-in absentee ballot submitted in any manner by an absent uniformed
				services voter or overseas voter that contains the information required to be
				submitted with such ballot by the Presidential designee (other than information
				which the Presidential designee, in consultation with the Election Assistance
				Commission, determines, under regulations promulgated by the Presidential
				designee, is not clearly necessary to prevent fraud in the conduct of
				elections).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id11BAB538E2C341E3980DEB6932AA6FA9"><enum>10.</enum><header>Ballot layout
			 design</header><text display-inline="no-display-inline">Section 254(a) of the
			 Help America Vote Act of 2002 (42 U.S.C. 15404(a)), as amended by section 4, is
			 amended by adding at the end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="id79AEC0661F194D709F4E79CD058194F5" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="id264949842C4742DF9D82B6BF1D03C974"><enum>(17)</enum><text>A description of
				the efforts the State will make to assist State and local election officials in
				improving ballot design, taking into consideration best practices, including
				best practices developed by the
				Commission.</text>
