		  reimbursement from flexible spending accounts for certain dental

		<section id="H28C656B9CA3B4D4AB6FB69ED5685E68" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dental Health Promotion Act of
			 2008</short-title></quote>.</text>
		</section><section id="H54B3A3DB427A44E6B2F958939E5960D8" section-type="subsequent-section"><enum>2.</enum><header>Reimbursement from
			 flexible spending accounts for certain dental products</header>
			<subsection id="HEDFC93E276414050A15E44335DCE504C"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/106">Section 106</external-xref> of the Internal Revenue
			 Code of 1986 (relating to contributions by employer to accident and health
			 plans) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H361860749B2C42C38696F547ECE62529" style="OLC">
					<subsection id="H381483593CF84C798230A851C891654E"><enum>(f)</enum><header>Dental care
				products under flexible spending arrangement</header><text display-inline="yes-display-inline">An arrangement shall not fail to be treated
				as a health flexible spending arrangement under this section or section 105
				merely because such arrangement provides reimbursement for products used to
				diagnose, cure, mitigate, treat, or prevent the onset of tooth decay (caries),
				periodontal diseases, and conditions ailing the teeth, gums, and mouth, or
				affecting the proper function thereof, for which reimbursement without regard
				to this subsection would not otherwise be
				allowable.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF96D886D115F4177AC024CE2F4B4C100"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to plan years beginning after the date of the
			 enactment of this Act.</text>
