		<official-title>To amend the Farm Security and Rural Investment Act to
		  establish a biofuels promotion program to promote sustainable production of
		  biofuels and biomass, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Biofuels Innovation
			 Program</header><text display-inline="no-display-inline">Title IX of the Farm
			 Security and Rural Investment Act of 2002 (7 U.S.C. 8101 et seq.) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id10C2F40479AB4A37AAFE2A2D5D5D897E" style="OLC">
				<section id="id723D09BAA1AA477D8B086E0536FC922C"><enum>9012.</enum><header>Biofuels
				Innovation Program</header>
					<subsection id="idEA738A5AB7674740B3A815E21061ECBF"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section is to establish a Biofuels Innovation Program—</text>
						<paragraph id="ID7109ea8ff28448a690fc2fc98a6b0278"><enum>(1)</enum><text>to encourage
				production of dedicated energy crops in a sustainable manner that protects the
				soil, air, water, and wildlife of the United States; and</text>
						</paragraph><paragraph id="ID027abf7a1ca04c59b5072e30a7799279"><enum>(2)</enum><text>to provide
				financial and technical assistance to owners and operators of eligible cropland
				to produce dedicated energy crops and crop mixes of suitable quality and in
				sufficient quantities to support and induce development and expansion of the
				use of the crop for—</text>
							<subparagraph id="IDfcd8f986f8f04b3d95eeb0b8c02fe4f4"><enum>(A)</enum><text>biofuels;</text>
							</subparagraph><subparagraph id="IDb306c84c076b485285be9839553a3d05"><enum>(B)</enum><text>power or heat
				generation to supplement or replace nonbiobased energy sources; and</text>
							</subparagraph><subparagraph id="IDfc1d6ad0a7c348e1832e6e3a8c7507c6"><enum>(C)</enum><text>biobased products
				to supplement or replace non biobased products;</text>
							</subparagraph></paragraph><paragraph id="ID19ad5b3049294d98871fea74233c021e"><enum>(3)</enum><text>to establish
				Biofuels Innovation Program project areas; and</text>
						</paragraph><paragraph id="IDda872d811dbb4fe4860f67dc3d958020"><enum>(4)</enum><text>to provide
				financial and technical assistance to owners and operators for harvesting,
				storing, and transporting cellulosic material.</text>
						</paragraph></subsection><subsection id="id514523EF4C194B49AAE8140F1B403E50"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="idADB08F616E7A475BB1D41CA2922AE466"><enum>(1)</enum><header>Beginning
				farmer or rancher</header><text>The term <term>beginning farmer or
				rancher</term> has the meaning given the term in section 343(a) of the
				Consolidated Farm and Rural Development Act (7 U.S.C. 1991(a)).</text>
						</paragraph><paragraph id="idAB94F75763B048D9B929127F010775D7"><enum>(2)</enum><header>BIP</header><text>The
				term <term>BIP</term> means the Biofuels Innovation Program established under
				this section.</text>
						</paragraph><paragraph id="ID4dd28bb6436243f0b5aa9baf514a3b44"><enum>(3)</enum><header>BIP project
				area</header><text>The term <term>BIP project area</term> means an area
				that—</text>
							<subparagraph id="id787E56C4F79042C2B2441C8219EE7255"><enum>(A)</enum><text>has eligible
				cropland that—</text>
								<clause id="idD12435530BE642B287F06171570DAAA1"><enum>(i)</enum><text>is owned or
				operated by eligible participants; and</text>
								</clause><clause id="idBDC602447D7E48ACBA7899FB357371B3"><enum>(ii)</enum><text>has specified
				boundaries that are submitted to the Secretary by eligible participants and
				subsequently approved by the Secretary; and</text>
								</clause></subparagraph><subparagraph id="id4CD1374D8D5C4195B13C48B8FAE34DEB"><enum>(B)</enum><text>is physically
				located within a 70-mile radius of an existing or proposed biofuels facility or
				another boundary, as determined by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="id6C1D32965AD0443E8BF0705AAE5033A1"><enum>(4)</enum><header>Conservation
				reserve program</header><text>The term <term>conservation reserve
				program</term> means the conservation reserve program established under
				subchapter B of chapter 1 of subtitle D of title XII of the Food Security Act
				of 1985 (16 U.S.C. 3831 et seq.).</text>
						</paragraph><paragraph id="idACAEBD6FC6A447CDBDAD94D0A7555F5D"><enum>(5)</enum><header>Conservation
				security program</header><text>The term <term>conservation security
				program</term> means the conservation security program established under
				subchapter A of chapter 2 of subtitle D of title XII of the Food Security Act
				of 1985 (16 U.S.C. 3838 et seq.).</text>
						</paragraph><paragraph id="IDfeacda7c1f2e44ff9d37a67264782494"><enum>(6)</enum><header>Contract
				acreage</header><text>The term <term>contract acreage</term> means eligible
				cropland that is—</text>
							<subparagraph id="id28D08CB966524101BC5B48E323738DA7"><enum>(A)</enum><text>enrolled in the
				BIP by an eligible participant; and</text>
							</subparagraph><subparagraph id="id99A95B8BC41C4F9282A59BFE2E0DE909"><enum>(B)</enum><text>covered by a BIP
				contract entered into with the Secretary.</text>
							</subparagraph></paragraph><paragraph id="idB982B38243F24C9785FFCA76066AE558"><enum>(7)</enum><header>Eligible
				cropland</header>
							<subparagraph id="id95A84DC25C7F4398A8CCD6167D085770"><enum>(A)</enum><header>In
				general</header><text>The term <term>eligible cropland</term> means land that
				the applicable county committee of the Farm Service Agency determines—</text>
								<clause id="IDc2b89740547f4ac99fd8c672fadfe32c"><enum>(i)</enum><text>is currently
				being tilled for the production of a crop for harvest; or</text>
								</clause><clause id="ID1531459280a64f08a25fb9ee573652d9"><enum>(ii)</enum><text>is not currently
				being tilled but has been tilled in a prior crop year and is suitable for
				production of an eligible dedicated energy crop.</text>
								</clause></subparagraph><subparagraph id="idB1299379A4E24DACBDCD606E8F8B28BB"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>eligible cropland</term> includes—</text>
								<clause id="ID79e087ba74654e71baf31f091c90a5bc"><enum>(i)</enum><text>land that in the
				native state of the land was not forest land, if the land is planted with
				nonwoody eligible dedicated energy crops and, for at least 3 of the 5 crop
				years preceding the date of enactment of this section, the land has
				been—</text>
									<subclause id="IDd0c5676a3edf49ca85fb22355bb72d42"><enum>(I)</enum><text>devoted to
				managed pasture; or</text>
									</subclause><subclause id="IDecbd6532b9ff4a4384504ed2cba0d7c6"><enum>(II)</enum><text>enrolled in the
				conservation reserve program and the conservation reserve program contract has
				been voluntarily terminated or is expired; and</text>
									</subclause></clause><clause id="IDf8fd382da1934640ae015311803e9901"><enum>(ii)</enum><text>land that in the
				native state of land was forest land, if the land is planted with woody or
				nonwoody eligible dedicated energy crops and the land has been—</text>
									<subclause id="ID7f4a9bc603654850b05bd0506902e28e"><enum>(I)</enum><text>forest land but
				subsequently clear-cut during the 2-year period ending on the date of enactment
				of this section; or</text>
									</subclause><subclause id="ID1be25934a959411b927c48ef8d02d886"><enum>(II)</enum><text>converted from
				forest land before the 5-year period ending on the date of enactment of this
				section and—</text>
										<item id="ID1d5919ff76ab46a4bfb004139a944b88"><enum>(aa)</enum><text>has been tilled
				for the production of a crop for harvest;</text>
										</item><item id="ID31d80fad21614890abfe1b30656d270f"><enum>(bb)</enum><text>devoted to
				managed pasture; or</text>
										</item><item id="ID2948466d480e4db6beaf38f2b5ae61c6"><enum>(cc)</enum><text>enrolled in the
				conservation reserve program for at least 3 of the 5 five crop years preceding
				the date of enactment of this section and is no longer covered by a
				conservation reserve program contract.</text>
										</item></subclause></clause></subparagraph><subparagraph id="idDB6D58D49EB44B77AA837024A7757CD6"><enum>(C)</enum><header>Exclusions</header><text>The
				term <term>eligible cropland</term> does not include—</text>
								<clause id="ID073d5f47f97a4fbebf397b79f3d51d56"><enum>(i)</enum><text>Federally-owned
				land;</text>
								</clause><clause id="IDecfa51a13c774f21a942ea5c014c71e8"><enum>(ii)</enum><text>land enrolled
				in—</text>
									<subclause id="id4C0C9451D2204797BE3E9C83A802E34B"><enum>(I)</enum><text>the conservation
				reserve program;</text>
									</subclause><subclause id="idD7700A5859054D1299181AA14E952634"><enum>(II)</enum><text>the grassland
				reserve program; or</text>
									</subclause><subclause id="idCCD48699F15C48CE8E08B039227BF599"><enum>(III)</enum><text>the wetlands
				reserve program;</text>
									</subclause></clause><clause id="ID5db4af9d346d4f9c8d59ede5c004abee"><enum>(iii)</enum><text>land with
				greater than 50 percent cover of native nonwoody vegetation or forest land, as
				of the date of enactment of this section (other than land described in
				subparagraph (B)(iii)); and</text>
								</clause><clause id="ID5f59c6d4d562460eaaebc569df493268"><enum>(iv)</enum><text>land that
				historically was not native forest land, if planted to woody crops.</text>
								</clause></subparagraph></paragraph><paragraph id="ID7ded5a81a78b4251b12f663aed798ff6"><enum>(8)</enum><header>Eligible
				dedicated energy crop</header>
							<subparagraph id="ID54b2ed333a6f4987a1876d188ce764b0"><enum>(A)</enum><header>In
				general</header><text>The term <term>eligible dedicated energy crop</term>
				means any crop native to the United States, or another crop, as determined by
				the Secretary, grown specifically to provide raw materials for—</text>
								<clause id="id0634F7D4097D484497D0E8A16D824E53"><enum>(i)</enum><text>conversion to
				liquid transportation fuels or chemicals through biochemical or thermochemical
				processes; or</text>
								</clause><clause id="id99B939F4EE2B46DF92E4BE1DF5D37BB4"><enum>(ii)</enum><text>energy
				generation through combustion, pyrolysis, or cofiring.</text>
								</clause></subparagraph><subparagraph id="ID46fc210689664d86a531034bcb203801"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>eligible dedicated energy crop</term> does not include—</text>
								<clause id="ID132cc540a59c46a1bf7490953b0ea76b"><enum>(i)</enum><text>any crop that is
				eligible for payments under title I or a successor title; or</text>
								</clause><clause id="IDe5c5c15a284b4cdd829b01a131ce98f9"><enum>(ii)</enum><text>any plant that
				is invasive or noxious or has the potential to become invasive or noxious, as
				determined by—</text>
									<subclause id="idCA339D6DD243426487B64F78D703C124"><enum>(I)</enum><text>the Secretary of
				the Interior (acting through the United States Fish and Wildlife
				Service);</text>
									</subclause><subclause id="id79C567FA75B44E0E97AD13267CC0CCC6"><enum>(II)</enum><text>the Secretary;
				or</text>
									</subclause><subclause id="id4360E1CE0BB84FD29FADE8F35D23D496"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id0C0C7152B8444014BF32C8DB6C933063"><enum>(aa)</enum><text>the head of an
				applicable State department of agriculture; or</text>
										</item><item id="idF86783A1D2AB44D2A2A4BA7F0478E10B" indent="up1"><enum>(bb)</enum><text>the head of an applicable State
				conservation agency.</text>
										</item></subclause></clause></subparagraph></paragraph><paragraph id="IDc9b95dc0118f4a9ea32821823ac11054"><enum>(9)</enum><header>Eligible
				participant</header><text>The term <term>eligible participant</term> means an
				owner or operator of contract acreage that is physically located within a BIP
				project area .</text>
						</paragraph><paragraph id="ID2899e97256554f64aa3444cebb9cb084"><enum>(10)</enum><header>Federally-owned
				land</header><text>The term <term>Federally-owned land</term> means land owned
				by—</text>
							<subparagraph id="id586A67DAAA3B4B5A922CB5593BBDA35D"><enum>(A)</enum><text>the Federal
				Government (including any department, instrumentality, bureau, or agency of the
				Federal Government); or</text>
							</subparagraph><subparagraph id="idA8A33BEDCAB14DEBA0EC1474C82E834D"><enum>(B)</enum><text>any corporation
				whose stock is wholly owned by the Federal Government.</text>
							</subparagraph></paragraph><paragraph id="ID10fe47778c4a44f2b94edd0e41a3c8f8"><enum>(11)</enum><header>Forest
				land</header><text>The term <term>forest land</term> means an ecosystem that is
				at least 1 acre in size (including timberland and woodland) and that (as
				determined by the Secretary)—</text>
							<subparagraph id="IDe69454ae22274940af73f7d405b88947"><enum>(A)</enum><text>is characterized
				by dense and extensive tree cover;</text>
							</subparagraph><subparagraph id="IDd53f689aa29343c9a74c4b77e7f3759a"><enum>(B)</enum><text>contains, or once
				contained, at least 10 percent tree crown cover; and</text>
							</subparagraph><subparagraph id="IDcb0970a0798d4790ab9be62f291720a0"><enum>(C)</enum><text>is not developed
				and planned for exclusive nonforest resource use.</text>
							</subparagraph></paragraph><paragraph id="idB50B97013191426ABEF5EAD7C193461E"><enum>(12)</enum><header>Grassland
				reserve program</header><text>The term <term>grassland reserve program</term>
				means the grassland reserve program established under subchapter C of chapter 2
				of subtitle D of title XII of the Food Security Act of 1985 (16 U.S.C. 3838n et
				seq.).</text>
						</paragraph><paragraph id="ID0b452070ae21455c9ba498d12e95d60d"><enum>(13)</enum><header>Managed
				pasture</header><text>The term <term>managed pasture</term> means land
				that—</text>
							<subparagraph id="ID87a4019f5fa44761bcaa4e6e4f4f5130"><enum>(A)</enum><text>is currently
				vegetated with less than 25 percent native plant cover;</text>
							</subparagraph><subparagraph id="IDe416aebbab68433a8f330b5d76b98e1c"><enum>(B)</enum><text>has been
				converted from noncropland to cropland during the 30-year period ending on the
				date of enactment of this section; and</text>
							</subparagraph><subparagraph id="ID08ab8adfd1d34e89b5f581a200984633"><enum>(C)</enum><text>has been actively
				managed for intensive livestock grazing.</text>
							</subparagraph></paragraph><paragraph id="ID99629d7b93d1445591acef3243687ec5"><enum>(14)</enum><header>Operator</header><text>The
				term <term>operator</term> means an individual, entity, or joint operation
				that, as determined by the applicable county committee of the Farm Service
				Agency, is in general control of the farming operations on a farm during the
				applicable crop year.</text>
						</paragraph><paragraph id="IDdb79268548144fc08e9b12b35e972f63"><enum>(15)</enum><header>Owner</header>
							<subparagraph id="idFABB758B5C524414A6D9C5776F3BD691"><enum>(A)</enum><header>In
				general</header><text>The term <term>owner</term> means a person that has legal
				ownership of eligible cropland.</text>
							</subparagraph><subparagraph id="idD5AB0898C6B84BBDA10CD6F6BBFCFBE8"><enum>(B)</enum><header>Inclusion</header><text>The
				term <term>owner</term> includes—</text>
								<clause id="ID14b62774980a45d6907ff40fc10e45c5"><enum>(i)</enum><text>a
				person that is buying eligible cropland under a contract for deed;</text>
								</clause><clause id="ID3637c13590e247bbaf88bf276bbfc163"><enum>(ii)</enum><text>a person that
				has a life estate in eligible cropland; and</text>
								</clause><clause id="ID3a4e409887274bbaa6fc59ec188532bf"><enum>(iii)</enum><text>for the
				purposes of enrolling eligible cropland in the BIP, a person that has purchased
				a farm in a foreclosure proceeding and—</text>
									<subclause id="ID74912a597d0e4d5a9bd831e9078a0079"><enum>(I)</enum><text>the redemption
				period has not passed; and</text>
									</subclause><subclause id="ID4fcf3f337f064df48361b5cd6093a254"><enum>(II)</enum><text>the original
				owner has not redeemed the property.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="id9659166C4A7A4883807EF60CF81A3829"><enum>(16)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture, acting through
				the Natural Resources Conservation Service.</text>
						</paragraph><paragraph id="ID2c7ca0ffe0824a7f9790484483637e8b"><enum>(17)</enum><header>Socially
				disadvantaged farmer or rancher</header><text>The term <term>socially
				disadvantaged farmer or rancher</term> means a farmer or rancher who—</text>
							<subparagraph id="idE4519D23C2B44DECB2C74E78DB322C51"><enum>(A)</enum><text>is a member of a
				socially disadvantaged group (as defined in section 355(e) of the Consolidated
				Farm and Rural Development Act (7 U.S.C. 2003(e)));</text>
							</subparagraph><subparagraph id="idC79373D5F89A4212BB5CE6A99E746213"><enum>(B)</enum><text>has limited
				resources; or</text>
							</subparagraph><subparagraph id="id508C5EE30FB646CC8288CA549F401CF1"><enum>(C)</enum><text>is a member of a
				federally recognized Indian tribe.</text>
							</subparagraph></paragraph><paragraph id="ID4aa459515cb441a383bf66e34baa4c03"><enum>(18)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States of the United
				States.</text>
						</paragraph><paragraph id="id52E33986A61B4555ABDA0665A4A48E39"><enum>(19)</enum><header>Wetlands
				reserve program</header><text>The term <term>wetlands reserve program</term>
				means the wetlands reserve program established under subchapter C of chapter 1
				of subtitle D of title XII of the Food Security Act of 1985 (16 U.S.C. 3837 et
				seq.).</text>
						</paragraph></subsection><subsection id="id9728A2B16EC34C659C6B370E332703DF"><enum>(c)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of enactment of this section, the Secretary
				shall establish a Biofuels Innovation Program in accordance with this
				section.</text>
					</subsection><subsection id="idD1B46AF0C06644A59764F04594D25BFD"><enum>(d)</enum><header>Proposals for
				BIP project areas</header>
						<paragraph id="IDc5657777807f47de82a650c90dfe52e1"><enum>(1)</enum><header>In
				general</header><text>To be considered a BIP project area, an eligible
				applicant shall submit to the Secretary, through the Under Secretary for Rural
				Development, for approval a written proposal that—</text>
							<subparagraph id="id9E4662132D934DB1AD4611C42BD7781D"><enum>(A)</enum><text>identifies the
				eligible cropland that will be a part of the proposed BIP project area;
				and</text>
							</subparagraph><subparagraph id="id1BE7790B1B2E46DB9C5AC53ADE6916F9"><enum>(B)</enum><text>indicates a
				strong likelihood that the proposed BIP project area will generate a sufficient
				quantity of biomass from eligible dedicated energy crops and acres or other
				sources to supply an existing biofuels facility, or to attract a new biofuels
				facility to an area, to meet the purposes of the BIP.</text>
							</subparagraph></paragraph><paragraph id="IDee62c6420edb457597c7419dd139a399"><enum>(2)</enum><header>Minimum
				requirements</header><text>The written proposal for a proposed BIP project area
				shall include, at a minimum—</text>
							<subparagraph id="ID245f5c3d9ce741548c241920b49cc04e"><enum>(A)</enum><text>a description of
				the eligible cropland of each eligible participant that will participate in the
				proposed BIP project area, including—</text>
								<clause id="ID2015d8b8850f423ba1c5203fbd755a32"><enum>(i)</enum><text>the quantity of
				eligible cropland of each eligible participant;</text>
								</clause><clause id="IDbb5c52cc3c174675a608f24edd77b4d2"><enum>(ii)</enum><text>the physical
				location of the eligible cropland;</text>
								</clause><clause id="ID025dce8d69ad4e7795d30d653fea7ee9"><enum>(iii)</enum><text>the 1 or more
				eligible dedicated energy crops that will be produced on the eligible cropland;
				and</text>
								</clause><clause id="IDfb656dc62a474f62917644b8bba53f6a"><enum>(iv)</enum><text>the type of land
				use or crop that will be displaced by the eligible dedicated energy
				crop;</text>
								</clause></subparagraph><subparagraph id="IDcd76c37520734747a667b51b75bdb313"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id31AC384A349F451CB36CA31F3E10AA0C"><enum>(i)</enum><text>the name, if available,
				and type, location, and description of the existing or proposed biofuel
				facility that will use the eligible dedicated energy crops to be produced in
				the proposed BIP project area;</text>
								</clause><clause id="idD497A19248E64586B5D205A06CB3893A" indent="up1"><enum>(ii)</enum><text>a letter of commitment to build a
				proposed bioenergy facility that will use the eligible dedicated energy crops
				intended to be produced in the proposed BIP project area; or</text>
								</clause><clause id="ID13f29da44406481f8a1beffc2d5cbb22" indent="up1"><enum>(iii)</enum><text>a letter of commitment from an
				existing bioenergy facility that the facility will use the eligible dedicated
				energy crops intended to be produced in the proposed BIP project area;</text>
								</clause></subparagraph><subparagraph id="ID003480c639c5427b9fb2be0b73f8501d"><enum>(C)</enum><text>a general
				analysis of the anticipated local economic impact of the proposed BIP project;
				and</text>
							</subparagraph><subparagraph id="IDc83e4599984a42bcb300911c160eac3e"><enum>(D)</enum><text>any additional
				information needed to determine the eligibility for, and ranking of, the
				proposal, as determined by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="ID3c82b42cccb2440988aec15687e6c4db"><enum>(3)</enum><header>Eligible
				applicants</header><text>Applicants that are eligible to submit a proposal for
				a BIP project area include—</text>
							<subparagraph id="ID5cd6d87b05ee46cf87b21363ac5cfa61"><enum>(A)</enum><text>a collective
				group of owners and operators producing or proposing to produce eligible
				dedicated energy crops;</text>
							</subparagraph><subparagraph id="IDc48d27bfe47c43e7befc85cb4b9fbcba"><enum>(B)</enum><text>an energy or
				agricultural company or refinery;</text>
							</subparagraph><subparagraph id="ID532b93b1bdcf48c79bd52126a7c531de"><enum>(C)</enum><text>a Resource
				Conservation and Development council; and</text>
							</subparagraph><subparagraph id="IDdf1b31e270e24865ade1a2994a786305"><enum>(D)</enum><text>any other entity
				that submits an acceptable proposal for production and use of an eligible
				dedicated energy crop that promotes the purposes of the BIP.</text>
							</subparagraph></paragraph><paragraph id="ID49f2c82e2ae34431a0f1146e4f41cca8"><enum>(4)</enum><header>Individual
				owners and operators</header><text>An individual owner or operator may not
				submit an individual proposal to participate in the BIP.</text>
						</paragraph></subsection><subsection id="id914A1B88AD434E1585AF38DD2EFCF59D"><enum>(e)</enum><header>Eligibility
				criteria for BIP project areas</header>
						<paragraph id="IDd27edee8715146fa80b1daeb7542b8f9"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary shall establish a system for ranking BIP project areas.</text>
						</paragraph><paragraph id="IDa649cc2e9ee2403bbda6d6a955d050c5"><enum>(2)</enum><header>Criteria</header><text>The
				Secretary shall rank proposed BIP project areas on the basis of whether (in
				order of ranking)—</text>
							<subparagraph id="IDf610feabc3964d6bbbbbdb0ce96b04cd"><enum>(A)</enum><text>there is a high
				probability that the eligible dedicated energy crops proposed to be produced in
				the proposed BIP project area will be used for the purposes of the BIP;</text>
							</subparagraph><subparagraph id="IDd75dd42a011d4ccd88e4cc9580a34cff"><enum>(B)</enum><text>the proposed BIP
				project area includes applications of eligible participants that provide
				adequate potential feedstocks and suitable placement with respect to existing
				or proposed bioenergy facility;</text>
							</subparagraph><subparagraph id="ID61f93ee1c160441ea15844c9c130e3c6"><enum>(C)</enum><text>a significant
				potential for a positive economic impact exists in the proposed BIP project
				area;</text>
							</subparagraph><subparagraph id="IDc69da693695a4420bbc828e21b448589"><enum>(D)</enum><text>ownership of the
				biofuels facility in the proposed BIP project area is available to producers
				and local investors;</text>
							</subparagraph><subparagraph id="ID503d76bcad6940169cdfbad46e0821f2"><enum>(E)</enum><text>the participation
				rate by beginning farmers or ranchers or socially disadvantaged farmers or
				ranchers;</text>
							</subparagraph><subparagraph id="ID3acdd6eaef384727b7a264c7aa782944"><enum>(F)</enum><text>the proposed BIP
				project area includes applications of eligible participants that have the
				greatest potential to improve soil conservation and water quality, and enhance
				wildlife habitat, when compared to existing land uses; and</text>
							</subparagraph><subparagraph id="ID938b0d78f32d417f983da769e9fce2d3"><enum>(G)</enum><text>the proposed
				eligible dedicated energy crop harvesting practices on contract acreage
				maximize land stewardship and habitat goals.</text>
							</subparagraph></paragraph></subsection><subsection id="idF94F92C402DA401D8065A87B75C4953D"><enum>(f)</enum><header>Business
				planning and assistance grants</header>
						<paragraph id="IDc874180b42b0444781de4a74360564fd"><enum>(1)</enum><header>In
				general</header><text>The Secretary, acting through the Under Secretary for
				Rural Development, shall provide BIP business planning and assistance grants to
				eligible applicants—</text>
							<subparagraph id="ID28ea3ca9e7e343e1873f6de0ced7a0be"><enum>(A)</enum><text>for the purpose
				of—</text>
								<clause id="id8CDC630AEDD7406F8A5BE4FFEDF8D183"><enum>(i)</enum><text>establishing BIP
				project areas; and</text>
								</clause><clause id="IDbcbbc7ff7e3444939f6b4eccabefa57b"><enum>(ii)</enum><text>hiring
				consultants and technical and other relevant experts for the purpose of
				providing expert guidance and technical assistance to potential eligible
				participants; and</text>
								</clause></subparagraph><subparagraph id="ID79d6dd67e283479d8e0c4c9eccb0f1a8"><enum>(B)</enum><text>in an amount not
				to exceed $30,000 in matching funds, at a rate of $3 for every $2 provided by
				the eligible applicant.</text>
							</subparagraph></paragraph><paragraph id="ID0e322fa0d7884cc39f37a9fadca40469"><enum>(2)</enum><header>Inclusions</header><text>Funds
				provided under this subsection may be used to conduct feasibility analyses and
				planning for inclusion of—</text>
							<subparagraph id="id77CB2AE036554196ABB9FFBBEA641A95"><enum>(A)</enum><text>agricultural
				waste biomass;</text>
							</subparagraph><subparagraph id="id6EE47EF9FE104FE3826749B104D99D1A"><enum>(B)</enum><text>sustainably-harvested
				agricultural and forest residues; and</text>
							</subparagraph><subparagraph id="id73C6034AE81E40788C78F56476ED2573"><enum>(C)</enum><text>biomass produced
				on land subject to a BIP contract.</text>
							</subparagraph></paragraph><paragraph id="ID7f1c982472f845f58a1a71a9b1b3de90"><enum>(3)</enum><header>Limitation</header><text>The
				total amount of funds used to carry out this subsection shall not exceed
				$5,000,000.</text>
						</paragraph></subsection><subsection id="ID2e5d0867056443a1a2dc170af80b11ce"><enum>(g)</enum><header>Forest biomass
				planning grants</header>
						<paragraph id="idEE0449350C5D452592E9DAC923492772"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide forest biomass planning
				assistance grants to private landowners to develop forest stewardship plans
				that involve sustainable management of biomass from land of the private
				landowners that will preserve diversity, soil, water, or wildlife values of the
				land, while ensuring a steady supply of biomass material, through—</text>
							<subparagraph id="id925B9A8DD10C4D18B52105AE5880F8F6"><enum>(A)</enum><text>State forestry
				agencies, in consultation with State wildlife agencies; and</text>
							</subparagraph><subparagraph id="idD2F07050627344A1BA44CBF30D54A3E1"><enum>(B)</enum><text>technical service
				provider arrangements with third-party, independent forest sustainability
				certification programs.</text>
							</subparagraph></paragraph><paragraph id="id0C5A36843FA04A3C91BA3D860F88FC68"><enum>(2)</enum><header>Limitation</header><text>The
				total amount of funds used to carry out this subsection shall not exceed
				$5,000,000.</text>
						</paragraph></subsection><subsection id="id3DD8FCC0F6B84200947283AC30FA364A"><enum>(h)</enum><header>Maximum
				enrollment</header><text>The Secretary shall enroll not more than 5,000,000
				acres of eligible cropland in the BIP at any 1 time.</text>
					</subsection><subsection id="id75DA2DFF522A4391BC238E8D8463C7D0"><enum>(i)</enum><header>Duration of
				contract</header>
						<paragraph id="id58EF217FE74B4271936A41DA66AD1746"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for purposes of carrying out
				the BIP, the Secretary shall enter into contracts of 10 years.</text>
						</paragraph><paragraph id="idA5E2638B037248DCA99AC1A583401B9D"><enum>(2)</enum><header>Early
				termination</header><text>The Secretary may terminate a contract early if the
				Secretary determines that—</text>
							<subparagraph id="IDe1391e365a664c7d9990097aec0ce0e0"><enum>(A)</enum><text>contract acreage
				will not be used to produce an eligible dedicated energy crop (as determined
				not earlier than 5 years after entering into a contract);</text>
							</subparagraph><subparagraph id="ID290cdc7e58e74ac5a888f88cc8fd276c"><enum>(B)</enum><text>a material breach
				of the contract has occurred;</text>
							</subparagraph><subparagraph id="ID0bfc15cd1af54b2db549db0c063ce7e4"><enum>(C)</enum><text>the owner or
				operator has died; or</text>
							</subparagraph><subparagraph id="ID1dab48339af348deafee8efa4bc26277"><enum>(D)</enum><text>continuation of
				the contract will cause undue economic hardship.</text>
							</subparagraph></paragraph></subsection><subsection id="ID137f517d26f84d43b6628dfb14f053db"><enum>(j)</enum><header>Effect of
				noncompliance due to circumstances beyond control of
				producers</header><text>The Secretary shall include in each contract entered
				into under this section a provision to ensure that a producer shall not be
				considered to be in violation of the contract for failure to comply with 1 or
				more requirements of the contract due to circumstances beyond the control of
				the producer, including any disaster-related condition, as determined by the
				Secretary.</text>
					</subsection><subsection id="id3EA737CDA6A6430DA44D5F32E546ACB4"><enum>(k)</enum><header>Reserve
				acreage</header>
						<paragraph id="id0A5ACF2482574538BE941BD971DEAE42"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3), for each year of
				participation in the BIP, at least 20 percent of the contract acreage shall
				remain unharvested.</text>
						</paragraph><paragraph id="id4163FDCC5ED049BF860B925B1B4791C2"><enum>(2)</enum><header>Rotation</header><text>The
				location of the unharvested contract acreage shall rotate from
				year-to-year.</text>
						</paragraph><paragraph id="IDbf3979dbbb2d41a7ad870528ac1286ca"><enum>(3)</enum><header>Nonapplicability</header><text>Paragraph
				(1) shall not apply—</text>
							<subparagraph id="IDfd6f231701d74bbd9ed2d2ab5fb0b194"><enum>(A)</enum><text>to land that is
				used to meet any BIP requirement for diverse vegetated buffers under subsection
				(l)(3)(D); and</text>
							</subparagraph><subparagraph id="ID92eb9675de934fa3a22762de330cdcc8"><enum>(B)</enum><text>during any crop
				year in which a natural disaster is declared by the Secretary for production
				losses under section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated
				Farm and Rural Development Act</act-name> (7 U.S.C. 1961(a)) in the county in
				which the enrolled land is located.</text>
							</subparagraph></paragraph></subsection><subsection id="id0C2C02ED609243E780039B18A0912C1C"><enum>(l)</enum><header>Contract
				acreage requirements</header>
						<paragraph id="IDc60c285c90b5459d802557178f51f11a"><enum>(1)</enum><header>In
				general</header><text>On approval of a BIP project area by the Secretary, each
				eligible participant in the BIP project area shall enter into a contract with
				the Secretary that is consistent with the BIP.</text>
						</paragraph><paragraph id="id01B08AE01E59486382F4244C40605926"><enum>(2)</enum><header>Additional
				eligible participants</header><text>The Secretary may add eligible participants
				to a BIP project area after approval of the BIP project area.</text>
						</paragraph><paragraph id="ID88bd336cb8014a67a2d3ba9ae44ff357"><enum>(3)</enum><header>Conservation
				practices</header><text>To ensure the sustainability of farm operations and the
				protection of soil, air, water and wildlife, to be eligible to participate in
				the BIP, an eligible participant shall agree that—</text>
							<subparagraph id="ID4d797ef95cab4855b3ed9febdf690b97"><enum>(A)</enum><text>harvesting of
				eligible dedicated energy crops shall not occur during the primary nesting or
				brood rearing seasons of bird species nesting in the BIP project area;</text>
							</subparagraph><subparagraph id="ID012c2be835d64fdfb44ed94cd01e4382"><enum>(B)</enum><text>stubble remnants
				for nonwoody crops shall be of sufficient height to provide for wildlife cover
				and soil protection, with minimum stubble remnants that are not less than 10
				inches in height, or another minimum height as determined by—</text>
								<clause id="id8E4D5F9E998C469F9F6B2C3EA021B96E"><enum>(i)</enum><text>the Secretary of
				the Interior, acting through the United States Fish and Wildlife
				Service;</text>
								</clause><clause id="idAA479777F2144D189FCD9CD6875799C3"><enum>(ii)</enum><text>the
				Secretary;</text>
								</clause><clause id="id1E802A820933483ABB870162D9EE8D66"><enum>(iii)</enum><text>the head of
				each applicable State fish and wildlife agency; and</text>
								</clause><clause id="id19D8399DCE0D4211832D3DEE000CBE02"><enum>(iv)</enum><text>the head of each
				applicable State conservation agency;</text>
								</clause></subparagraph><subparagraph id="ID6427c591198e44df98c54a04eda0445e"><enum>(C)</enum><text>soil conservation
				plans, designed and approved by the Secretary, shall be implemented by the
				eligible participant for preventing erosion on areas planted and harvested for
				eligible dedicated energy crops;</text>
							</subparagraph><subparagraph id="ID13b9abbbcc9a4a0783e3b4963226e2c0"><enum>(D)</enum><text>diverse vegetated
				buffers, the width, characteristics, and management of which shall be
				determined by Secretary, shall be established and maintained at all times
				surrounding all water resources on contract acreage; and</text>
							</subparagraph><subparagraph id="ID90cafa7fca1f489a9568e2d53de7bb2c"><enum>(E)</enum><text>chemical inputs
				shall be minimized and properly applied to ensure protection of soil, air,
				water, and wildlife resources.</text>
							</subparagraph></paragraph><paragraph id="ID1dd87b96531b47ff9c4fc5137c43d5cf"><enum>(4)</enum><header>Purposes</header>
							<subparagraph id="idEF851D87D5C0494FAD1FEE4C3C827C8D"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), to be eligible to
				participate in the BIP, an eligible participant may use eligible dedicated
				energy crops produced on contract acreage only for the purposes described in
				subsection (a).</text>
							</subparagraph><subparagraph id="id40532299FD8B45F29A2696436C13E10F"><enum>(B)</enum><header>Personal
				use</header><text>During the period before the commercial viability of a
				bioenergy facility, an eligible participant may use eligible dedicated energy
				crops produced by the eligible participant on contract acreage for personal
				use.</text>
							</subparagraph><subparagraph id="id6656CCFD327D46B4BF8047E1B76D897D"><enum>(C)</enum><header>Seed
				production</header><text>During the period before the commercial viability of a
				bioenergy facility, an eligible participant may harvest and sell seed produced
				on contract acreage.</text>
							</subparagraph></paragraph><paragraph id="ID44278c01e64a435db5f7ed757275c2af"><enum>(5)</enum><header>Requirements</header><text>To
				be eligible to participate in the BIP, during the term of the BIP contract, an
				eligible participant shall—</text>
							<subparagraph id="ID80e6f14447164640b8b458fc63d95124"><enum>(A)</enum><text>enter into a
				contract with the Secretary to participate in the BIP and comply with the BIP
				contract;</text>
							</subparagraph><subparagraph id="ID539622a46f3243859bbe34dea565cce2"><enum>(B)</enum><text>comply
				with—</text>
								<clause id="id9CFD7B5EDBF14CCDA422922FC68F0F4F"><enum>(i)</enum><text>the highly
				erodible land conservation requirements of subtitle B of title XII of the Food
				Security Act of 1985 (16 U.S.C. 3811 et seq.); and</text>
								</clause><clause id="idD2CCD3BECAD24676A16723E57E3A082D"><enum>(ii)</enum><text>the wetland
				conservation requirements of subtitle C of title XII of that Act (16 U.S.C.
				3821 et seq.);</text>
								</clause></subparagraph><subparagraph id="IDeab7c8715ec14988b4ee0fffbc9ca11e"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8B8546EF19E74F5094EA65F1CFC9F168"><enum>(i)</enum><text>plant at least 40
				acres, or any other quantity of acres specified by the Secretary, of an
				eligible dedicated energy crop not later than 1 year after entering into a BIP
				contract or within an alternate time period specified by the Secretary;
				and</text>
								</clause><clause id="id0372C578D3464AC78C2CE2F1FC838A5C" indent="up1"><enum>(ii)</enum><text>produce an eligible dedicated
				energy crop on the contract acreage throughout the term of the BIP
				contract.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="id7DF876E22808468EA2BD2EB745F4784F"><enum>(m)</enum><header>Additional
				eligible biomass</header>
						<paragraph id="idC5F9E3BA0CD64BC8BA8483DA42423532"><enum>(1)</enum><header>In
				general</header><text>The Secretary may allow on land that is enrolled in the
				conservation reserve program and located within the BIP project area, in
				accordance with the soil-related, water-related, and wildlife conservation
				purposes of the conservation reserve program under contract terms governing
				managed haying and grazing and the harvesting of biomass—</text>
							<subparagraph id="id379DE484F5864D88AC5AE951A761B27B"><enum>(A)</enum><text>in exchange for a
				reduction of an applicable annual payment in an amount to be determined by the
				Secretary;</text>
							</subparagraph><subparagraph id="idEC363A3AE8C345B4B69D78BF1B34F947"><enum>(B)</enum><text>in accordance
				with an approved conservation reserve program plan and applicable field office
				technical guide standards;</text>
							</subparagraph><subparagraph id="id7ABD9B4A37734C848F8ED51EA4A1D588"><enum>(C)</enum><text>in a manner that
				ensures that biomass harvest activities occur outside the official nesting and
				brood rearing season for those plans;</text>
							</subparagraph><subparagraph id="id42BBCFDB8BFB4A64B943B246BA3096E5"><enum>(D)</enum><text>not more
				frequently than once every 3 years after the date on which vegetative cover has
				been established under the conservation reserve program;</text>
							</subparagraph><subparagraph id="id28B4B3283FF24DDC82C21285F254EA23"><enum>(E)</enum><text>as a result of
				forestry maintenance activities, such as pruning, thinning, and timber stand
				improvement, on land that has been converted to forestry use—</text>
								<clause id="id1154ACA64A824A728DF2A800687C256C"><enum>(i)</enum><text>in accordance
				with a conservation plan; and</text>
								</clause><clause id="idBEF97E024BF94A648C323CC5550E7274"><enum>(ii)</enum><text>in exchange for
				an applicable reduction in the annual rental payment, as determined by the
				Secretary; or</text>
								</clause></subparagraph><subparagraph id="idF7AD2BD974644B5FA38CFAE231CEA44F"><enum>(F)</enum><text>as a result of a
				midcontract management activity, such as mowing or clipping, that is conducted
				according to an approved conservation plan as determined by the
				Secretary.</text>
							</subparagraph></paragraph></subsection><subsection id="id7D666261750D4F8F925F4881DE0439E9"><enum>(n)</enum><header>Payments for
				collecting, harvesting, storing, and transporting biomass produced on BIP
				contract acreage, agricultural waste biomass, and sustainably-harvested
				agricultural and forest residues</header>
						<paragraph id="id930D383807FA49D79006AB59908BA013"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for the 2-year period beginning
				on the date on which a biofuels facility enters operation, the Secretary may
				provide matching payments at a rate of $1 for every $1 per ton provided by the
				biofuels facility, in an amount equal to not more than $45 per ton—</text>
							<subparagraph id="id5804CEEA1D43465C85AACFD09E870AD9"><enum>(A)</enum><text>to eligible
				participants for biomass produced on BIP contract acreage in exchange for a
				reduction of the annual payment issued under subsection (r)(3), as determined
				by the Secretary;</text>
							</subparagraph><subparagraph id="idCDA76D45F2254122AE1A3A10F78E1863"><enum>(B)</enum><text>to any producer
				of agricultural waste biomass or sustainably-harvested agricultural and forest
				residues in the United States for the agricultural waste or residue; and</text>
							</subparagraph><subparagraph id="idF236F667802F44588C7078B85EABAAE8"><enum>(C)</enum><text>for residue
				collected as a result of the removal of noxious and invasive species, in
				accordance with methods approved by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="id95F82EA0642F4E578E8B7AB09B277584"><enum>(2)</enum><header>Eligibility</header><text>Only
				owners of forest land acting pursuant to a forest stewardship plan shall be
				eligible to receive payments under this subsection.</text>
						</paragraph></subsection><subsection id="id7D268801809E431BA55B666B311E215B"><enum>(o)</enum><header>Duties of
				Secretary</header><text>The Secretary shall—</text>
						<paragraph id="ID6adfcfc5e59749efb3d1aa06cd6db045"><enum>(1)</enum><text>establish and
				administer the BIP;</text>
						</paragraph><paragraph id="ID0509c9420f61460db6df14603ea79631"><enum>(2)</enum><text>authorize
				establishment of BIP project areas for the purposes of the BIP described in
				subsection (a);</text>
						</paragraph><paragraph id="ID70fa003741d54bcc84e8c769c2aa09a1"><enum>(3)</enum><text>develop
				procedures—</text>
							<subparagraph id="ID578ef95e8cb54370a265f2619742c586"><enum>(A)</enum><text>to monitor the
				compliance of eligible participants that have land enrolled in the BIP with the
				requirements of the BIP;</text>
							</subparagraph><subparagraph id="IDb9a0b35a39bd45dc855398200f875640"><enum>(B)</enum><text>to measure the
				performance of the BIP; and</text>
							</subparagraph><subparagraph id="id66A73EE3FEEB485B8D1A5E49EBE6AD31"><enum>(C)</enum><text>to demonstrate
				whether the long-term eligible dedicated energy crop production goals are being
				achieved.</text>
							</subparagraph></paragraph><paragraph id="ID6dc9179352c340d0833742828f4185d1"><enum>(4)</enum><text>enter into a
				written contract with each eligible participant that elects to participate in
				the BIP in a BIP project area;</text>
						</paragraph><paragraph id="IDe1c2cf57c6b043a496d3deb6055d925a"><enum>(5)</enum><text>not enter into a
				contract under the BIP with an individual owner or operator unless the land of
				the eligible participant is physically located in an approved BIP project area;
				and</text>
						</paragraph><paragraph id="IDef130fdec2f34e88bcf605dcc4be425b"><enum>(6)</enum><text>provide all
				payments under the contract directly to the eligible participant.</text>
						</paragraph></subsection><subsection id="id8D5F35ABCD6A42B499E32C089252A2E3"><enum>(p)</enum><header>Relationship to
				other programs</header>
						<paragraph id="idE0B25B8310F542B18003E04D6E194E90"><enum>(1)</enum><header>Conservation
				security program</header><text>Land enrolled in the BIP may also be enrolled in
				the conservation security program if all of the other requirements for
				participation in the conservation security program are met.</text>
						</paragraph><paragraph id="id1F9894CB58F64B7981B5AEF18D0CFA3E"><enum>(2)</enum><header>Environmental
				credit programs</header><text>The Secretary may allow the sale of carbon
				credits, water quality credits, or other environmental credits on land enrolled
				in BIP that do not interfere with the purposes of the BIP.</text>
						</paragraph></subsection><subsection id="id99B387D443C840D8961FFCCAD2015862"><enum>(q)</enum><header>Contracts</header><text>A
				contract entered into between the Secretary and an eligible participant under
				the BIP shall include, at a minimum, terms that cover—</text>
						<paragraph id="IDab6a93f3eea442fa834e63edc178e11d"><enum>(1)</enum><text>requirements for
				the eligible participant in carrying out the contract, including requirements
				described in subsections (i), (k), and (l);</text>
						</paragraph><paragraph id="IDe152606b07874239b65273e564292328"><enum>(2)</enum><text>a maintenance
				agreement to maintain the benefits of the contract after the payment period, as
				determined by the Secretary;</text>
						</paragraph><paragraph id="ID00b322f295b5466da7616987925f7e50"><enum>(3)</enum><text>termination
				provisions;</text>
						</paragraph><paragraph id="IDbe8ebe27bdce40c880f2c054aa2fbba4"><enum>(4)</enum><text>payment terms and
				amounts to be provided on an annual basis;</text>
						</paragraph><paragraph id="IDe3bef0c6d6804b4db0e3575da3f0c180"><enum>(5)</enum><text>the sales or
				transfer of contract acreage;</text>
						</paragraph><paragraph id="ID149f3e2616bf4711b844add45db1da48"><enum>(6)</enum><text>the modification
				of the contract;</text>
						</paragraph><paragraph id="IDd41eae34043b4818bbfbed8278c241eb"><enum>(7)</enum><text>penalties in
				cases of a breach of the contract or other situations;</text>
						</paragraph><paragraph id="ID0277e8ea31b6496da0c30c3f1138381e"><enum>(8)</enum><text>the maximum
				quantity of contract acreage and an estimated schedule for how much eligible
				cropland will be enrolled each contract year; and</text>
						</paragraph><paragraph id="ID9cdbdca88b464bbb94815518754b220a"><enum>(9)</enum><text>any additional
				terms the Secretary considers appropriate.</text>
						</paragraph></subsection><subsection id="idE2152CDA2C274C1191B6F4FAA80DF079"><enum>(r)</enum><header>Payments</header>
						<paragraph id="idB203CC40FA1144CA9F31C2AB96F6ADEF"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide payments directly to eligible
				participants who enter into contracts described in subsection (q) in accordance
				with the subsection.</text>
						</paragraph><paragraph id="idBBE801B906754B999A3347502CF07871"><enum>(2)</enum><header>Cost-share
				payments</header>
							<subparagraph id="id4B4B6E8A171C4326A6FD07292D9D37A0"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the Secretary
				shall provide to an eligible participant who enters into a BIP contract a
				cost-share payment in an amount equal to 50 percent of the costs of
				establishing an eligible dedicated energy crop on the contract acreage covered
				by the contract.</text>
							</subparagraph><subparagraph id="id5F8A9EF4494444DE97678B71A6A0A897"><enum>(B)</enum><header>Exceptions</header>
								<clause id="ID51d76b308c834594869d7c9fecd693be"><enum>(i)</enum><header>Beginning and
				social disadvantaged farmers or ranchers</header><text>The amount of cost-share
				payments made to beginning farmers or ranchers and socially disadvantaged
				farmers or ranchers shall be equal to 75 percent of the costs of establishing
				an eligible dedicated energy crop on the contract acreage.</text>
								</clause><clause id="IDa91f48926e104c96bc36d9dec8d44272"><enum>(ii)</enum><header>Polyculture
				crop mixes</header><text>The amount of cost-share payments made to any eligible
				participant who establishes a polyculture crop mix of at least 3 species of
				eligible dedicated energy crops shall be equal to 90 percent of the costs of
				establishing an eligible dedicated energy crop on the contract acreage.</text>
								</clause></subparagraph><subparagraph id="id03DD212C48A74ACAA35252BEB045DCBE"><enum>(C)</enum><header>Eligible
				cost-share payments</header><text>The costs for which an eligible owner may
				receive a cost-share payment under this paragraph include—</text>
								<clause id="ID9576dc656f7548a0838d989530ca62c6"><enum>(i)</enum><text>the cost of seeds
				and stock; and</text>
								</clause><clause id="IDf464dbbd8bd14276806bab88c85415fa"><enum>(ii)</enum><text>the cost of
				planting field buffer strips, unless the owner and operator is eligible for
				payments for those practices under the continuous conservation reserve
				program.</text>
								</clause></subparagraph></paragraph><paragraph id="id8C906FCF1F334505B8E5B5342B793716"><enum>(3)</enum><header>Rental
				payments</header>
							<subparagraph id="ID94312a3888c246c5a85e6db1166ca08a"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall make annual rental payments to an
				eligible participant who enters into a BIP contract in an amount equal to the
				average agricultural rental rate for land of similar characteristics in the BIP
				project area during the preceding 2-year period, as determined by the Secretary
				using National Agricultural Statistic Services data or another source (as
				determined by the Secretary).</text>
							</subparagraph><subparagraph id="ID2be43f2b44bb4723b3c2f5eab01e1013"><enum>(B)</enum><header>Period</header>
								<clause id="id3A476DAE901F4D33BA9B7E6F73187DBD"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), an eligible
				participant shall receive rental payments for a period of not more than 5 years
				after entering into a BIP contract with the Secretary on contract
				acreage.</text>
								</clause><clause id="id3864DA8E3FF74A23B53EC309244A059D"><enum>(ii)</enum><header>Disasters</header><text>If
				the Secretary declares a natural disaster for production losses under section
				321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural
				Development Act</act-name> (7 U.S.C. 1961(a)) in the county in which contract
				acreage is located for a crop year that immediately follows the period
				described in clause (i), the Secretary may provide rental payments to eligible
				participants under this paragraph for that crop year for contract acreage that
				is located in the county.</text>
								</clause></subparagraph><subparagraph id="IDd8cf22e364ce4a7a965f838ea1fc182d"><enum>(C)</enum><header>Reduction</header><text>The
				Secretary shall reduce rental payments under (A) by an amount determined to be
				appropriate by the Secretary, if an eligible dedicated energy crop is harvested
				in accordance with subsection (l)(4).</text>
							</subparagraph></paragraph><paragraph id="ID094f5315bd4c41a8badeda7bda7a9509"><enum>(4)</enum><header>Bonus
				payments</header><text>The Secretary shall provide bonus payments to an
				eligible participant who enters into a BIP contract if—</text>
							<subparagraph id="idA441F6D4E0A349448E93755E30FD2F77"><enum>(A)</enum><text>the production of
				an eligible dedicated energy crop under the contract maximizes wildlife
				diversity on the contract acreage; or</text>
							</subparagraph><subparagraph id="id1D87B959E9A240048FB3DCF7FAC759D0"><enum>(B)</enum><text>the farming
				operation of the eligible participant is modified to address the needs of
				wildlife species identified in a State wildlife management plan.</text>
							</subparagraph></paragraph><paragraph id="IDacfc5ec30b014b798bf33265419438a2"><enum>(5)</enum><header>Timing of
				payments</header>
							<subparagraph id="IDae3092cf775b4cd7b672edfc07e9c718"><enum>(A)</enum><header>Cost-share
				payments</header><text>The Secretary shall provide cost-share payments to
				eligible participants who enter into BIP contracts on the implementation of the
				covered practices.</text>
							</subparagraph><subparagraph id="IDb64cd25e670346fd9dd1da8ada4aa6da"><enum>(B)</enum><header>Rental and
				bonus payments</header><text>The Secretary shall make rental and bonus payments
				to eligible participants who enter into BIP contracts on an annual basis, based
				on the number of contract acres covered by BIP contracts.</text>
							</subparagraph></paragraph><paragraph id="IDa0142dc3a68b4b0d970ea08cb2dadcc6"><enum>(6)</enum><header>Enrolled land
				ineligible for commodity payments</header><text>Land enrolled in the BIP shall
				not be eligible to be used for direct or counter-cyclical payments or any other
				payments under title I or a successor title.</text>
						</paragraph></subsection><subsection id="id0959B429B180497AA6CC2080316F8CB8"><enum>(s)</enum><header>Eligibility</header>
						<paragraph id="idF2EB5A7B9A22460C8114F20B7652B453"><enum>(1)</enum><header>In
				general</header><text>As a condition of entering into a bioenergy crop
				transition assistance contract, the owners and operators of a farm shall agree,
				as determined by the Secretary, to make available to the Secretary, or to an
				institution of higher education designated by the Secretary, such information
				as the Secretary considers to be appropriate——</text>
							<subparagraph id="idB2CF481BF6FF4D08823B017BEA9B04C4"><enum>(A)</enum><text>to promote the
				production of bioenergy crops and the development of biorefinery technology;
				and</text>
							</subparagraph><subparagraph id="id34CBEE560A694482BC3DB09FCBD88CCE"><enum>(B)</enum><text>to evaluate the
				bioenergy transition assistance.</text>
							</subparagraph></paragraph><paragraph id="idB662635C68414DC3A9AE69D4FF9F50C0"><enum>(2)</enum><header>Best practices
				database</header><text>Subject to section 1770 of the Food Security Act of 1985
				(7 U.S.C. 2276), the Secretary shall make available to the public in a database
				format the best practices information developed by the Secretary in providing
				bioenergy assistance under this section.</text>
						</paragraph></subsection><subsection id="id0850DE387DF640B4A58A98E5C2CAA30C"><enum>(t)</enum><header>Technical
				assistance</header><text>An eligible participant who enters into a BIP contract
				shall be eligible for conservation technical assistance for conservation
				planning and implementation through the Secretary or a qualified non-Federal
				entity that is approved by the Secretary.</text>
					</subsection><subsection id="id123398F68A784A62A555B69ACB3C6FBE"><enum>(u)</enum><header>Training</header><text>The
				Secretary shall establish training programs for employees of the Cooperative
				Extension Service and other interested entities and individuals on how to
				develop viable proposals for participation in the BIP, including—</text>
						<paragraph id="id9F406C98194D4ECBBF6F7D64B6817559"><enum>(1)</enum><text>business plan
				development;</text>
						</paragraph><paragraph id="idE5E5BE56A276448181EFF1F84816E2DE"><enum>(2)</enum><text>recruitment and
				organization of eligible participants; and</text>
						</paragraph><paragraph id="id1FAFB612FEC34B46A2A49FFA117BEDFA"><enum>(3)</enum><text>the status of,
				and trends in, of the bioenergy industry.</text>
						</paragraph></subsection><subsection id="idF01ABE35CAAC4A18870210F147A398F9"><enum>(v)</enum><header>Funding</header><text>Of
				the funds of the Commodity Credit Corporation, the Secretary shall use to carry
				out this section such sums as are necessary for each of fiscal years 2008
				through
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id8274399874154BE5905B8B0D1EAD142A"><enum>2.</enum><header>Research,
			 extension, and educational programs on biobased energy technologies and
			 products</header><text display-inline="no-display-inline">Section 9011 of the
			 Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8109) is amended to
			 read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id1702E6E3ADF944BD9DC99A7F624BBADB" style="OLC">
				<section id="idC42746E2ACC742C08BBBE30DBEC115C5"><enum>9011.</enum><header>Research,
				extension, and educational programs on biobased energy technologies and
				products</header>
					<subsection id="id0F902B56B2064489B824C1A881B1C76A"><enum>(a)</enum><header>Purposes</header><text>The
				purposes of the programs established under this section are—</text>
						<paragraph id="ID0d2c9fb70dd84c718c0694546d3c4245"><enum>(1)</enum><text>to enhance
				national energy security through the development, distribution, and
				implementation of biobased energy technologies;</text>
						</paragraph><paragraph id="ID55f50a084f5149579d4d1d97ab66652d"><enum>(2)</enum><text>to promote
				diversification in, and the environmental sustainability of, agricultural
				production in the United States through biobased energy and product
				technologies;</text>
						</paragraph><paragraph id="ID85c3a021c1fe4029963baf3cc9f7d515"><enum>(3)</enum><text>to promote
				economic diversification in rural areas of the United States through biobased
				energy and product technologies; and</text>
						</paragraph><paragraph id="ID5bc69e9cc6b1498bb696f3aa2f272c23"><enum>(4)</enum><text>to enhance the
				efficiency of bioenergy and biomass research and development programs through
				improved coordination and collaboration between the Department of Agriculture,
				the Department of Energy, and the land-grant colleges and universities.</text>
						</paragraph></subsection><subsection id="id518DD3CDD4EA4A1F9E2733B525AE3D4D"><enum>(b)</enum><header>Definition of
				land-grant colleges and universities</header><text>In this section, the term
				<term>land-grant colleges and universities</term> means—</text>
						<paragraph id="id023DDD54893F4318B725A908B1246795"><enum>(1)</enum><text>1862 Institutions
				(as defined in section 2 of the Agricultural Research, Extension, and Education
				Reform Act of 1998 (7 U.S.C. 7601));</text>
						</paragraph><paragraph id="idEF020C9429DC48579A373517A69B8D50"><enum>(2)</enum><text>1890 Institutions
				(as defined in section 2 of that Act) and West Virginia State College;
				and</text>
						</paragraph><paragraph id="id9614EFF63A19426D8B9B5A37ABEA6ACF"><enum>(3)</enum><text>1994 Institutions
				(as defined in section 2 of that Act).</text>
						</paragraph></subsection><subsection id="id0B2A49315A3748F3B42979B72FF73442"><enum>(c)</enum><header>Establishment</header><text>To
				carry out the purposes described in subsection (a), the Secretary shall
				establish programs under which—</text>
						<paragraph id="ID2a14758a8d7d4a779663e4c2d172296e"><enum>(1)</enum><text>the Secretary
				shall provide grants to sun grant centers specified in subsection (d);
				and</text>
						</paragraph><paragraph id="ID6f1b17dc5a2041468ef8024a3bc246e9"><enum>(2)</enum><text>the sun grant
				centers shall use the grants in accordance with this section.</text>
						</paragraph></subsection><subsection id="id2137DE198BE3480D85250ADBAF857DCD"><enum>(d)</enum><header>Grants to
				centers</header><text>The Secretary shall use amounts made available for a
				fiscal year under subsection (j) to provide a grants in equal amounts to each
				of the following sun grant centers:</text>
						<paragraph id="idA6FB2AB7CC7E43F5B310A149CEB4D6E3"><enum>(1)</enum><header>North-central
				center</header><text>A north-central sun grant center at South Dakota State
				University for the region composed of the States of Illinois, Indiana, Iowa,
				Minnesota, Montana, Nebraska, North Dakota, South Dakota, Wisconsin, and
				Wyoming.</text>
						</paragraph><paragraph id="idFE68011C08B14B77880F045E9623FDFD"><enum>(2)</enum><header>Southeastern
				center</header><text>A southeastern sun grant center at the University of
				Tennessee at Knoxville for the region composed of—</text>
							<subparagraph id="ID041376ae31b04957a4c7a78a941c6f52"><enum>(A)</enum><text>the States of
				Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South
				Carolina, Tennessee, and Virginia;</text>
							</subparagraph><subparagraph id="ID71de5456107043ca9a53cf33012be005"><enum>(B)</enum><text>the Commonwealth
				of Puerto Rico; and</text>
							</subparagraph><subparagraph id="ID7db09a964a29408f8c6e2e0d88b40ce6"><enum>(C)</enum><text>the United States
				Virgin Islands.</text>
							</subparagraph></paragraph><paragraph id="id73EBF91BD75B43958EB2DC0B756B4E64"><enum>(3)</enum><header>South-central
				center</header><text>A south-central sun grant center at Oklahoma State
				University for the region composed of the States of Arkansas, Colorado, Kansas,
				Louisiana, Missouri, New Mexico, Oklahoma, and Texas.</text>
						</paragraph><paragraph id="id35FF30A6EB8448AD947B2C4C75F9039A"><enum>(4)</enum><header>Western
				center</header><text>A western sun grant center at Oregon State University for
				the region composed of—</text>
							<subparagraph id="ID66552ffb04304297a6ba29d0ce3b0258"><enum>(A)</enum><text>the States of
				Alaska, Arizona, California, Hawaii, Idaho, Nevada, Oregon, Utah, and
				Washington; and</text>
							</subparagraph><subparagraph id="ID7c352d86e70642d589d7fc0d0cdde68e"><enum>(B)</enum><text>territories and
				possessions of the United States (other than the territories referred to in
				subparagraphs (B) and (C) of paragraph (2)).</text>
							</subparagraph></paragraph><paragraph id="id8C6BFF397DFE4C38A114A23FE4F02D42"><enum>(5)</enum><header>Northeastern
				center</header><text>A northeastern sun grant center at Cornell University for
				the region composed of the States of Connecticut, Delaware, Massachusetts,
				Maryland, Maine, Michigan, New Hampshire, New Jersey, New York, Ohio,
				Pennsylvania, Rhode Island, Vermont, and West Virginia.</text>
						</paragraph></subsection><subsection id="idEDCE3109620948C4955BF08394D12A50"><enum>(e)</enum><header>Use of
				funds</header>
						<paragraph id="idCDDA169A2F8E41E5B75B8CAB7DB59111"><enum>(1)</enum><header>Centers of
				excellence</header><text>Of the amount of funds that are made available for a
				fiscal year to a sun grant center under subsection (d), the center shall use
				not more than 25 percent of the amount for administration to support excellence
				in science, engineering, and economics at the center to promote the purposes
				described in subsection (a) through the State agricultural experiment station,
				cooperative extension services, and relevant educational programs of the
				university.</text>
						</paragraph><paragraph id="id76911C4C3F0A458A81B771648FFCF84D"><enum>(2)</enum><header>Grants to
				land-grant colleges and universities</header>
							<subparagraph id="idEBA5C1B3C0D24C6EB8C57726E2290F21"><enum>(A)</enum><header>In
				general</header><text>The sun grant center established for a region shall use
				the funds that remain available for a fiscal year after expenditures made under
				paragraph (1) to provide competitive grants to land-grant colleges and
				universities in the region of the sun grant center to conduct, consistent with
				the purposes described in subsection (a), multi-institutional and
				multi-State—</text>
								<clause id="IDbdc78e8b526a441585add52a392e0171"><enum>(i)</enum><text>research,
				extension, and educational programs on technology development; and</text>
								</clause><clause id="ID8f41d4fedd494233a13535fefa78dacd"><enum>(ii)</enum><text>integrated
				research, extension, and educational programs on technology
				implementation.</text>
								</clause></subparagraph><subparagraph id="id431E1519B5304AC6B8F80919D38B67FA"><enum>(B)</enum><header>Programs</header><text>Of
				the amounts that are used to provide grants for a fiscal year under
				subparagraph (A), the center shall use—</text>
								<clause id="IDb396a290eb394d5ca48b8d467f2e449e"><enum>(i)</enum><text>not less than 30
				percent of the funds to carry out programs described in subparagraph (A)(i);
				and</text>
								</clause><clause id="ID415e96c204ec4d3288cb583e96974f6a"><enum>(ii)</enum><text>not less than 30
				percent of the funds to carry out programs described in subparagraph
				(A)(ii).</text>
								</clause></subparagraph></paragraph><paragraph id="id6F2405C2FC9145CD9D5B821A7A5CA27F"><enum>(3)</enum><header>Indirect
				costs</header><text>A sun grant center may not recover the indirect costs of
				making grants under paragraph (2) to other land-grant colleges and
				universities.</text>
						</paragraph></subsection><subsection id="id1FC26806F40E4BA998F82A45C8EEA9C5"><enum>(f)</enum><header>Plan</header>
						<paragraph id="idCD5DA2FC09AA41908D250F1E33C99F68"><enum>(1)</enum><header>In
				general</header><text>Subject to the availability of funds under subsection
				(j), in cooperation with other land-grant colleges and universities and private
				industry in accordance with paragraph (2), the sun grant centers shall jointly
				develop and submit to the Secretary, for approval, a plan for addressing at the
				State and regional levels the bioenergy, biomass, and gasification research
				priorities of the Department of Agriculture and the Department of Energy for
				the provision of grants under paragraphs (1) and (2) of subsection (e).</text>
						</paragraph><paragraph id="ID62672f17976a46bd80a7cba17a873f35"><enum>(2)</enum><header>Gasification
				coordination</header>
							<subparagraph id="idE81D50B09F52450D8B6822B84DBDFC57"><enum>(A)</enum><header>In
				general</header><text>In developing the plan under paragraph (1) with respect
				to gasification research, the sun grant centers identified in paragraphs (1)
				and (2) of subsection (d) shall coordinate with land grant colleges and
				universities in their respective regions that have ongoing research activities
				with respect to the research.</text>
							</subparagraph><subparagraph id="id2FC52299E90147C8BBD728D49B2C3078"><enum>(B)</enum><header>Funding</header><text>Funds
				made available under subsection (d) to the sun grant center identified in
				subsection (e)(2) shall be available to carry out planning coordination under
				paragraph (1).</text>
							</subparagraph></paragraph></subsection><subsection id="id5E3FF7FD8A5E406288278BA00DCC4BBD"><enum>(g)</enum><header>Grants to other
				land-grant colleges and universities</header>
						<paragraph id="id1C5F80FE0D76466E9007B54C0D2FDBCA"><enum>(1)</enum><header>Priority</header><text>In
				making grants under subsection (e)(2), a sun grant center shall give a higher
				priority to programs that are consistent with the plan approved by the
				Secretary under subsection (f).</text>
						</paragraph><paragraph id="idEC11500010FC48D6999C64A5691E6611"><enum>(2)</enum><header>Term</header><text>The
				term of a grant provided by a sun grant center under subsection (e)(2) shall
				not exceed 5 years.</text>
						</paragraph></subsection><subsection id="id0C5BE33D035A434080624386B8956E5E"><enum>(h)</enum><header>Sun grant
				biobased energy and products information analysis center</header><text>The sun
				grant centers shall maintain a Sun Grant Biobased Energy and Products
				Information Analysis Center at the sun grant center specified in subsection
				(d)(1) to provide analysis and data management support to sun grant centers,
				including—</text>
						<paragraph id="id0E4EECE7FD754DE89AE7537B5F508FFE"><enum>(1)</enum><text>regional-scale
				geographic information systems and associated decision tools for biomass
				resource assessment;</text>
						</paragraph><paragraph id="idF38B988FA8D5426087E0A05DAC7A1AF6"><enum>(2)</enum><text>regional-scale
				experimental design for bioenergy feedstock production;</text>
						</paragraph><paragraph id="idD264CFD4DA70475EAA5B38F062AA029A"><enum>(3)</enum><text>bioenergy
				research and education accountability systems; and</text>
						</paragraph><paragraph id="id38661AC3EBE141D49C4F751E60B18B63"><enum>(4)</enum><text>the Sun Grant
				BioWeb, an online educational biomass encyclopedia.</text>
						</paragraph></subsection><subsection id="id7F327227BB664386A6AD273458D905FB"><enum>(i)</enum><header>Annual
				reports</header><text>Not later than 90 days after the end of a year for which
				a sun grant center receives a grant under subsection (d), the sun grant center
				shall submit to the Secretary a report that describes the policies, priorities,
				and operations of the program carried out by the center during the year,
				including a description of progress made in facilitating the priorities
				described in subsection (f).</text>
					</subsection><subsection id="idD8A1CE26A00C477B86BCDFC25148AF56"><enum>(j)</enum><header>Authorization
				of appropriations</header>
						<paragraph id="idB313AA90D9214D33B83F74D8F9D0EA76"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out this
				section $100,000,000 for each of fiscal years 2008 through 2012.</text>
						</paragraph><paragraph id="id61C26BFD760E4FBC9B16D940635C923E"><enum>(2)</enum><header>Grant
				information analysis center</header><text>Of amounts made available under
				paragraph (1), not more than $5,000,000 for each fiscal year shall be made
				available to carry out subsection
				(h).</text>
