		<official-title>To direct the Administrator of the Small Business
		  Administration to reform and improve the HUBZone program for small business
		  concerns, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>HUBZone Improvement Act of
			 2008</short-title></quote>.</text>
		</section><section id="id384780D6BBB1433781FD1C8FDE104471"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="idA62D6F60C6D24CE4BFC9C9109BB25E16"><enum>(1)</enum><text>the terms
			 <term>Administration</term> and <term>Administrator</term> mean the Small
			 Business Administration and the Administrator thereof, respectively;</text>
			</paragraph><paragraph id="id7C76DCF12E3B4D95AB227E29C5436552"><enum>(2)</enum><text>the terms
			 <term>HUBZone</term> and <term>HUBZone small business concern</term> have the
			 meanings given such terms in section 3 of the Small Business Act (15 U.S.C.
			 632); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DDA3EB3910643FCB38E39FA504C95D9"><enum>(3)</enum><text>the term
			 <term>recertification</term> means determining whether a business concern that
			 was previously determined to be a qualified HUBZone small business concern is a
			 qualified HUBZone small business concern under section 3(p)(5) of the Small
			 Business Act (15 U.S.C. 632(p)(5)).</text>
			</paragraph></section><section id="id3BA30DE28EE448DDB9989B48ACFDCF38"><enum>3.</enum><header>Purpose;
			 findings</header>
			<subsection id="ID22dd438a2b2642349f1e25a30641b479"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this Act is to reform and improve the HUBZone program of the
			 Administration.</text>
			</subsection><subsection id="id7B7FC987BAE34C51ACDD42AD46320129"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="IDb1885b3a639f444bb62862d7f6a67614"><enum>(1)</enum><text>The HUBZone
			 program was established under the HUBZone Act of 1997 (Public Law 105–135; 111
			 Stat. 2627) to stimulate economic development through increased employment and
			 capital investment by providing Federal contracting preferences to small
			 business concerns in economically distressed communities or HUBZone
			 areas.</text>
				</paragraph><paragraph id="ID7aec61b3412648be8e6b163eb9b3e03e"><enum>(2)</enum><text>According to the
			 Government Accountability Office—</text>
					<subparagraph id="id6AA5F654352D4DB9950F74CFBFE0691F"><enum>(A)</enum><text>as of February
			 2008, 12,986 certified firms have participated in the HUBZone program since its
			 inception; and</text>
					</subparagraph><subparagraph id="id48F1420172204D34B8FDC267BDF6DB86"><enum>(B)</enum><text>in fiscal year
			 2007, over 4,200 HUBZone small business concerns obtained approximately
			 $8,100,000,000 in Federal contracts.</text>
					</subparagraph></paragraph><paragraph id="ID2dac00e5e0664bf1a057a1268b5bb80f"><enum>(3)</enum><text>The Government
			 Accountability Office also identified numerous concerns with the HUBZone
			 program, including that—</text>
					<subparagraph id="IDb0b56baafa77472f91552977d7d38be5"><enum>(A)</enum><text>the
			 Administration verifies the information received by the Administration from
			 HUBZone small business concerns in limited instances and has limited assurances
			 that only eligible firms participated in the HUBZone program;</text>
					</subparagraph><subparagraph id="ID819be711e8554582b3c580d3c2972bdb"><enum>(B)</enum><text>by not obtaining
			 documentation and conducting site visits on a more routine basis during the
			 certification process, the Administration cannot be sure that only eligible
			 firms are part of the HUBZone program; and</text>
					</subparagraph><subparagraph id="ID17de281ba4d44199947f699e85091b98"><enum>(C)</enum><text>although the
			 examination process of the Administration involves a more extensive review of
			 documentation, the examination process cannot be relied upon to ensure that
			 only eligible firms participate in the HUBZone program because the examination
			 process involves only 5 percent of firms in any given year.</text>
					</subparagraph></paragraph></subsection></section><section id="id14F75EF363654CC2B2C11DE23F24C6DF"><enum>4.</enum><header>HUBZone
			 improvements</header><text display-inline="no-display-inline">The Administrator
			 shall—</text>
			<paragraph id="IDe47162e9f735410093fcace147604443"><enum>(1)</enum><text>as soon as is
			 practicable, correct and update the map that is used by the Administration to
			 identify HUBZones and implement procedures to ensure that the map is updated
			 with the most recently available data on a more frequent basis;</text>
			</paragraph><paragraph id="IDbd0de8f038c7483690627c14fbb018c8"><enum>(2)</enum><text>develop and
			 implement guidance for determining whether an applicant is a qualified HUBZone
			 small business concern under section 3(p)(5) of the Small Business Act (15
			 U.S.C. 632(p)(5)), including more routinely and consistently obtaining
			 supporting documentation from an applicant and conducting more frequent site
			 visits, as appropriate;</text>
			</paragraph><paragraph id="ID021be3c4e2ce4ea1aa68f06caea0c7c3"><enum>(3)</enum><text>establish a date
			 by which the Administrator shall eliminate the backlog of applications for
			 recertification;</text>
			</paragraph><paragraph id="idE610CB740A3947B4B72D2D681D276467"><enum>(4)</enum><text>ensure that the
			 Administration eliminates the backlog described in paragraph (3) by the date
			 established under paragraph (3), using officers and employees of the
			 Administration or by entering into a contract with a private entity;</text>
			</paragraph><paragraph id="IDc5f521a6f9bd4dd2932633d8b5717f2c"><enum>(5)</enum><text>establish and
			 implement a time period for completing a recertification; and</text>
			</paragraph><paragraph id="ID17e9196638f94b618b9b0f56432ddf4c"><enum>(6)</enum><text>develop measures
			 and implement plans to assess the effectiveness of the HUBZone program that
			 take into account—</text>
				<subparagraph id="id72DACE381CAE42E99F5DCD0FCDA74B71"><enum>(A)</enum><text>the economic
			 characteristics of the HUBZone; and</text>
				</subparagraph><subparagraph id="idF279644068BD4F9DBBE8496FB4CF2457"><enum>(B)</enum><text>contracts being
			 counted under multiple socioeconomic subcategories.</text>
				</subparagraph></paragraph></section><section id="id327F32E8AC0147049720160813FFCE2C"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 submit to the Committee on Small Business and Entrepreneurship of the Senate
			 and the Committee on Small Business of the House of Representatives a report
			 regarding the implementation of this Act.</text>
