		<official-title>To amend the Atomic Energy Act of 1954 to provide for
		  thorium fuel cycle nuclear power generation.</official-title>

	<legis-body>
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Thorium Energy Independence and
			 Security Act of 2008</short-title></quote>.</text>
		</section><section id="idEF1D3B9648A34E089D462E76F2B0EA22"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID4f13bea98d41427994a70dd21558f000"><enum>(1)</enum><text>the United States
			 and foreign countries will require massive and increasing quantities of energy
			 during the 20-year period beginning on the date of enactment of this Act to
			 support economic growth;</text>
			</paragraph><paragraph id="ID4f180c72106444408b21ffbe3d0c18bb"><enum>(2)</enum><text>nuclear power
			 provides energy without generating unacceptable quantities of greenhouse
			 gasses;</text>
			</paragraph><paragraph id="ID2f152d9c2f434b49b0ded51f45047407"><enum>(3)</enum><text>the generation of
			 nuclear power in the United States and many foreign countries has been
			 discouraged by concerns regarding—</text>
				<subparagraph id="id6391BF11C78E42CCBFFF8999347397C0"><enum>(A)</enum><text>the proliferation
			 of weapons-useable material; and</text>
				</subparagraph><subparagraph id="idEE0F8BF09E284BF0987F3E3F83FD86DB"><enum>(B)</enum><text>the proper
			 disposal of spent nuclear fuel;</text>
				</subparagraph></paragraph><paragraph id="IDaeec37cf2d77465197724bd3a3b2fb8d"><enum>(4)</enum><text>nuclear power
			 plants operating on an advanced thorium fuel cycle to generate nuclear
			 energy—</text>
				<subparagraph id="ID277cbce616ab4e6888305b476e38e046"><enum>(A)</enum><text>could potentially
			 produce fewer weapons-useable materials than uranium-fueled plants; and</text>
				</subparagraph><subparagraph id="id8352B9D19A82400FB248F2B393CAE115"><enum>(B)</enum><text>would produce
			 less long-term waste as compared to other nuclear power plants;</text>
				</subparagraph></paragraph><paragraph id="ID5ae2a76686564320bb4c908893f11881"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1ADFD319CFD8497EB9DA4CEE59F2354B"><enum>(A)</enum><text>thorium is more
			 abundant than uranium; and</text>
				</subparagraph><subparagraph id="id56C648FFA11C414792AF6F61F62B41C6" indent="up1"><enum>(B)</enum><text>the United States possesses
			 significant domestic quantities of thorium to ensure energy
			 independence;</text>
				</subparagraph></paragraph><paragraph id="IDec7bfea811984ff991bb0bf0dc108562"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF8D067544BDB430F9D92A7ED2A9A27E0"><enum>(A)</enum><text>thorium fuel cycle
			 technology was originally developed in the United States; and</text>
				</subparagraph><subparagraph id="idF734AF523786470297D189780C1C1A17" indent="up1"><enum>(B)</enum><text>cutting-edge research relating to
			 thorium fuel cycle technology continues to be carried out by entities in the
			 United States; and</text>
				</subparagraph></paragraph><paragraph id="IDee5753b75bf14145be6c5d4b83f68301"><enum>(7)</enum><text>it is in the
			 national security and foreign policy interest of the United States that foreign
			 countries seeking to establish or expand generation and use of nuclear power
			 should be provided—</text>
				<subparagraph id="id2E4E76CCC47649B1AE7216DEA1F7152C"><enum>(A)</enum><text>access to
			 advanced thorium fuel cycle technology; and</text>
				</subparagraph><subparagraph id="idC2D580A6BC994DD78097F82236EDBB1B"><enum>(B)</enum><text>incentives to
			 reduce the risk of nuclear proliferation.</text>
				</subparagraph></paragraph></section><section id="idF7BE48CF3D7144BC938913DB9A30E523"><enum>3.</enum><header>Thorium fuel
			 cycle nuclear power generation</header><text display-inline="no-display-inline">Chapter 19 of title I of the Atomic Energy
			 Act of 1954 (42 U.S.C. 2015 et seq.) is amended by inserting after section 244
			 the following:</text>

				<section id="id80F5B68E2D464F4E93DEFB574641D351"><enum>251.</enum><header>Thorium fuel
				cycle nuclear power generation</header>
					<subsection id="id8A1640F4ADA44245807AFA84A313AA89"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="id87068C4A63EF42099F4CC399C774AAE8"><enum>(1)</enum><header>Chairman</header><text>The
				term <term>Chairman</term> means the Chairman of the Nuclear Regulatory
				Commission.</text>
						</paragraph><paragraph id="id098A937D9CF241C2A43FFA7020DCA2C3"><enum>(2)</enum><header>Office</header><text>The
				term <term>Office</term> means an office established under subsection
				(b)(1).</text>
						</paragraph><paragraph id="id9DB6592654A948FCAA6EFC9E2A649303"><enum>(3)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Energy.</text>
						</paragraph></subsection><subsection id="idA1103705EB4146CBB704F0575C18D0FB"><enum>(b)</enum><header>Offices for
				regulation of thorium fuel cycle nuclear power generation</header>
						<paragraph id="idF09D2294CF20490C8578CA48845851A8"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary, in consultation with the Chairman, shall establish, and provide
				funds to, an office for the regulation of thorium fuel cycle nuclear power
				generation in each of—</text>
							<subparagraph id="id9B96CBF6AD934AAB89502D2C389048D0"><enum>(A)</enum><text>the Office of
				Nuclear Energy, Science and Technology of the Department of Energy; and</text>
							</subparagraph><subparagraph id="id46C677DB88DD4D27B484980BFA13BE74"><enum>(B)</enum><text>the Nuclear
				Regulatory Commission.</text>
							</subparagraph></paragraph><paragraph id="id6A1765278D734F14B2CFBE5FD2E9FF88"><enum>(2)</enum><header>Regulations</header><text>Not
				later than December 31, 2012, the Chairman, in cooperation with the heads of
				the Offices, shall promulgate regulations for facilities and materials used in
				thorium fuel cycle nuclear power generation.</text>
						</paragraph><paragraph id="idD533E8E1005B4781A427B7FB6A911FD1"><enum>(3)</enum><header>Demonstration
				projects</header><text>The heads of the Offices, in cooperation with the head
				of the Idaho National Engineering Laboratory, shall carry out demonstration
				projects for thorium fuel cycle nuclear power generation at the Idaho National
				Engineering Laboratory.</text>
						</paragraph><paragraph id="id04B9B4FC64EA4BDEBB3D44F05EEFD8B1"><enum>(4)</enum><header>International
				partnerships and incentives</header><text>The heads of the Offices shall
				provide recommendations to the Secretary with respect to methods of—</text>
							<subparagraph id="id64460D0DB05A461FA4D85612DFF22A27"><enum>(A)</enum><text>strengthening
				international partnerships to advance nuclear nonproliferation through the
				design and deployment of thorium fuel cycle nuclear power generation;
				and</text>
							</subparagraph><subparagraph id="id8F3F199446FD4F9E8D9FD1A61055CEEB"><enum>(B)</enum><text>providing
				incentives to nuclear reactor operators in the United States and foreign
				countries to use proliferation-resistant, low-waste thorium fuels in lieu of
				other fuels.</text>
							</subparagraph></paragraph></subsection><subsection id="id7B8CB7DB65154E8A947AD194C94B116F"><enum>(c)</enum><header>Report</header><text>Not
				later than 1 year after the date of enactment of the
				<short-title>Thorium Energy Independence and Security Act
				of 2008</short-title>, and annually thereafter, the Secretary shall submit to
				Congress a report describing, with respect to the preceding calendar
				year—</text>
						<paragraph id="idC37CB28C88EC4D39A1E1BB04291AA607"><enum>(1)</enum><text>progress made in
				implementing this section; and</text>
						</paragraph><paragraph id="id2A14AEFBB317492EA8F42CF67EB74915"><enum>(2)</enum><text>activities
				carried out by the Offices pursuant to this section.</text>
						</paragraph></subsection><subsection id="id33B718AEA60C4664A7CAC39888745524"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to the
				Secretary to carry out this section $250,000,000 for the period of fiscal years
				2009 through
				2013.</text>
