		  ensure coordination among criminal justice agencies, adult protective services
		  agencies, victim assistance programs, and other agencies or organizations
		  providing services to individuals with disabilities in the investigation and
		  response to abuse of or crimes committed against such
		  individuals.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Crime Victims with Disabilities
			 Act of 2008</short-title></quote>.</text>
		</section><section id="IDae85ab9a340d49dd9024d43dc69c4090"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID9c799128b5ea43c2b5ed0cb95f0fd1a1"><enum>(1)</enum><text>Adults with
			 disabilities experience violence or abuse at least twice as often as people
			 without disabilities, and adults with developmental disabilities are at risk of
			 being physically or sexually assaulted at rates four to ten times greater than
			 other adults.</text>
			</paragraph><paragraph id="ID3741d43b9eb34328b9a9f2069152e4b1"><enum>(2)</enum><text>Individuals with
			 disabilities suffer from additional <quote>victimization</quote> within the
			 justice system, due to lack of physical, programmatic, and communications
			 accommodations needed for equal access.</text>
			</paragraph><paragraph id="IDa735b564a6e54825b4c9ee50e9ce8364"><enum>(3)</enum><text>Women with
			 disabilities are more likely to be victimized, to experience more severe and
			 prolonged violence, and to suffer more serious and chronic effects from that
			 violence, than women without such disabilities.</text>
			</paragraph><paragraph id="ID05cf737159f742a1b805265ea76e9ff1"><enum>(4)</enum><text>Sixty-eight to 83
			 percent of women with developmental disabilities will be sexually assaulted in
			 their lifetime.</text>
			</paragraph><paragraph id="id71ECD1B626A54ADC84850700A5B2FA16"><enum>(5)</enum><text>An estimated
			 5,000,000 crimes are committed against individuals with developmental
			 disabilities annually.</text>
			</paragraph><paragraph id="ID8a2bb94efd1e4135a1a351092ace1104"><enum>(6)</enum><text>Over 70 percent
			 of crimes committed against individuals with developmental disabilities are not
			 reported.</text>
			</paragraph><paragraph id="ID251a45b132d545988a9fce4ccabc69b7"><enum>(7)</enum><text>Studies in the
			 United States, Canada, Australia, and Great Britain consistently show that
			 victims with developmental disabilities suffer repeated victimization because
			 so few of the crimes against them are reported.</text>
			</paragraph><paragraph id="IDfb43eba3cdf444c692da6213dbced83a"><enum>(8)</enum><text>The National
			 Crime Victims Survey conducted annually by the Bureau of Justice Statistics of
			 the Department of Justice, does not specifically collect data relating to
			 crimes against individuals with developmental disabilities, nor do they use
			 disability as a demographic variable as they use other important demographic
			 variables, such as gender, age, and racial and ethnic membership.</text>
			</paragraph></section><section id="IDea0649fb43564693ad1c7fce49a5da9a"><enum>3.</enum><header>Purpose</header>
			<subsection id="id8AB85936200A4A85B942DA9D66957F4F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The purpose of this
			 Act is to increase the awareness, investigation, prosecution, and prevention of
			 crimes against individuals with a disability, including developmental
			 disabilities, and improve services to those who are victimized, by facilitating
			 collaboration among the criminal justice system and a range of agencies and
			 other organizations that provide services to individuals with
			 disabilities.</text>
			</subsection><subsection id="id1D9DAD1F90754BC1B33CB188C231CD49"><enum>(b)</enum><header>Need for
			 collaboration</header><text display-inline="yes-display-inline">Collaboration
			 among the criminal justice system and agencies and other organizations that
			 provide services to individuals with disabilities is needed to—</text>
				<paragraph id="IDea699742d8644e268111d6fa36fee5a8"><enum>(1)</enum><text>protect
			 individuals with disabilities by ensuring that crimes are reported, and that
			 reported crimes are actively investigated by both law enforcement agencies and
			 agencies and other organizations that provide services to individuals with
			 disabilities;</text>
				</paragraph><paragraph id="ID9527b9e71c33449a90f24931171076cc"><enum>(2)</enum><text>provide
			 prosecutors and victim assistance organizations with adequate training to
			 ensure that crimes against individuals with disabilities are appropriately and
			 effectively addressed in court;</text>
				</paragraph><paragraph id="IDdfaf0a21f4ae48418fd602c5edf724ad"><enum>(3)</enum><text>identify and
			 ensure that appropriate reasonable accommodations are provided to individuals
			 with disabilities in a safe and conducive environment, allowing crimes to be
			 reported accurately to law enforcement agencies; and</text>
				</paragraph><paragraph id="ID699f75e6c11348ca9bc949e8c949f139"><enum>(4)</enum><text>promote
			 communication among criminal justice agencies, and agencies and other
			 organizations that provide services to individuals with disabilities, including
			 Victim Assistance Organizations, to ensure that the needs of crime victims with
			 disabilities are met.</text>
				</paragraph></subsection></section><section id="ID8df60a87ecc749b5bfa4c81a629972e8"><enum>4.</enum><header>Department of
			 Justice Crime Victims With Disabilities Collaboration Program</header><text display-inline="no-display-inline">The Omnibus Crime Control and Safe Streets
			 Act of 1968 (42 U.S.C. 3711 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idF3946E9107134FBBB7645354E67084B4" style="OLC">
				<part id="id6079E239320C4A2BB2862AE9E16528BF"><enum>JJ</enum><header>Grants to
				respond to crimes against individuals with disabilities</header>
					<section id="idE09BF3BBC46F47E8BBA58B60E7BBA42D"><enum>3001.</enum><header>Crime Victims
				with Disabilities Collaboration Program grants</header>
						<subsection id="id184D9424CB364289BDC05076224CCB0E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="ID442592fb8dab4e108e2ce53cd567dfca"><enum>(1)</enum><header>Applicant</header><text>The
				term <term>applicant</term> means a State, unit of local government, Indian
				tribe, or tribal organization that applies for a grant under this
				section.</text>
							</paragraph><paragraph id="IDc1031b3c05424cc19226928d5f83b122"><enum>(2)</enum><header>Collaboration
				program</header><text>The term <term>collaboration program</term> means a
				program to ensure coordination between or among a criminal justice agency, an
				adult protective services agency, a victim assistance organization, and an
				agency or other organization that provides services to individuals with
				disabilities, including but not limited to individuals with developmental
				disabilities, to address crimes committed against individuals with disabilities
				and to provide services to individuals with disabilities who are victims of
				crimes.</text>
							</paragraph><paragraph id="ID738908fe38084429b8c12901886b8250"><enum>(3)</enum><header>Criminal
				justice agency</header><text>The term <term>criminal justice agency</term>
				means an agency of a State, unit of local government, Indian tribe, or tribal
				organization that is responsible for detection, investigation, arrest,
				enforcement, adjudication, or incarceration relating to the violation of the
				criminal laws of that State, unit of local government, Indian tribe, or tribal
				organization, or an agency contracted to provide such services.</text>
							</paragraph><paragraph id="idD07E1B72A8A74DAAB921A26018440F76"><enum>(4)</enum><header>Adult
				protective services agency</header><text>The term <term>adult protective
				services agency</term> means an agency that provides adult protective services
				to adults with disabilities, such as the protection and advocacy systems
				established under section 143 of the Developmental Disabilities Assistance and
				Bill of Rights Act of 2000 (42 U.S.C. 15043), including—</text>
								<subparagraph id="ID7d57cb39c61a4bd8bc0542ecdaa2d5b7"><enum>(A)</enum><text>receiving reports
				of abuse, neglect, or exploitation;</text>
								</subparagraph><subparagraph id="ID74b2f340970d4f6d9e0b204507b6a0db"><enum>(B)</enum><text>investigating the
				reports described in subparagraph (A);</text>
								</subparagraph><subparagraph id="ID576cb5cbe916478db0deec2915db3477"><enum>(C)</enum><text>case planning,
				monitoring, evaluation, and other casework and services; and</text>
								</subparagraph><subparagraph id="ID652c09bc1b7941aebf2ff15439f94628"><enum>(D)</enum><text>providing,
				arranging for, or facilitating the provision of medical, social service,
				economic, legal, housing, law enforcement, or other protective, emergency, or
				support services for adults with disabilities.</text>
								</subparagraph></paragraph><paragraph id="id2CE8B383DCFF4262BB092A7213747573"><enum>(5)</enum><header>Day
				program</header><text>The term <term>day program</term> means a government or
				privately funded program that provides care, supervision, social opportunities,
				or jobs to individuals with disabilities.</text>
							</paragraph><paragraph id="idEAD36FCE22F04D739481FAB74EB0FB9E"><enum>(6)</enum><header>Implementation
				grant</header><text>The term <term>implementation grant</term> means a grant
				under subsection (e).</text>
							</paragraph><paragraph id="id37F702BB8D604AAF8C3EBAEF812D7138"><enum>(7)</enum><header>Individuals
				with disabilities</header><text>The term <term>individuals with
				disabilities</term> means individuals—</text>
								<subparagraph id="ID97c6d5c62d734f8d909b3030e612f931"><enum>(A)</enum><text>18 years of age
				or older; and</text>
								</subparagraph><subparagraph id="idC66154086A9846BFAD87D252A3B374FE"><enum>(B)</enum><text>who have a
				developmental, cognitive, physical, or other disability that results in
				substantial functional limitations in one or more of the following areas of
				major life activity:</text>
									<clause id="id78B03A49F2EE4F6C8A852F444E114FDF"><enum>(i)</enum><text>Self-care.</text>
									</clause><clause id="id17B19AD8448A4652B65CB6625DEFA769"><enum>(ii)</enum><text>Receptive and
				expressive language.</text>
									</clause><clause id="id036882B2612B43FD97C88D0AA2BC4C2E"><enum>(iii)</enum><text>Learning.</text>
									</clause><clause id="id5078B2D6F3834CDB8C2D3384D552C2AA"><enum>(iv)</enum><text>Mobility.</text>
									</clause><clause id="id6A35E8ECEC8146FC8DAAAFC7B8629A9A"><enum>(v)</enum><text>Self-direction.</text>
									</clause><clause id="idB7A46977F889448CB726CAA055820E88"><enum>(vi)</enum><text>Capacity for
				independent living.</text>
									</clause><clause id="idB6E88B0DDAC34821A5A18331D78C4515"><enum>(vii)</enum><text>Economic
				self-sufficiency.</text>
									</clause><clause id="id923B09F510014B40A6BEC276ACA4A09C"><enum>(viii)</enum><text>Cognitive
				functioning.</text>
									</clause><clause id="id27B496FABD9448A99A394642B48A2839"><enum>(ix)</enum><text>Emotional
				adjustment.</text>
									</clause></subparagraph></paragraph><paragraph id="id7B68212DF67E43A3A0C1986A1E1B3F8B"><enum>(8)</enum><header>Planning
				grant</header><text>The term <term>planning grant</term> means a grant under
				subsection (f).</text>
							</paragraph><paragraph id="ID54b12985430a400c82de73164a0ff2a5"><enum>(9)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Health and Human
				Services.</text>
							</paragraph><paragraph id="IDfcbd311e35864e999123937d8f10f0e2"><enum>(10)</enum><header>Unit of local
				government</header><text>The term <term>unit of local government</term> means
				any city, county, township, town, borough, parish, village, or other general
				purpose political subdivision of a State.</text>
							</paragraph></subsection><subsection id="ID619d1a99d36041edbbe520fab01f11cc"><enum>(b)</enum><header>Authorization</header><text>In
				consultation with the Secretary, the Attorney General may make grants to
				applicants to prepare a comprehensive plan for or to implement a collaboration
				program that provides for—</text>
							<paragraph id="id28AA816200534F2DBA4EF2518A5F3C2C"><enum>(1)</enum><text>the investigation
				and remediation of instances of abuse of or crimes committed against
				individuals with disabilities; or</text>
							</paragraph><paragraph id="id95CA95BAC3834DF58B8ECBC78B6BDB02"><enum>(2)</enum><text>the provision of
				services to individuals with disabilities who are the victims of a crime or
				abuse.</text>
							</paragraph></subsection><subsection id="IDee5a274702e4465e8830852bde796746"><enum>(c)</enum><header>Use of
				funds</header><text>A grant under this section shall be used for a
				collaborative program that—</text>
							<paragraph id="IDf0be872f3d6c444b90c8c4a02ab87a62"><enum>(1)</enum><text>receives reports
				of abuse of individuals with disabilities or crimes committed against such
				individuals;</text>
							</paragraph><paragraph id="ID6dad84a487eb4c8b89107f684ea98f99"><enum>(2)</enum><text>investigates and
				evaluates reports of abuse of or crimes committed against individuals with
				disabilities;</text>
							</paragraph><paragraph id="ID6accccd6723b442692c1b42a37e422ed"><enum>(3)</enum><text>visits the homes
				or other locations of abuse, and, if applicable, the day programs of
				individuals with disabilities who have been victims of abuse or a crime for
				purposes of, among other things, assessing the scene of the abuse and
				evaluating the condition and needs of the victim;</text>
							</paragraph><paragraph id="IDeb66a2eed7c24d439da11c84c2556171"><enum>(4)</enum><text>identifies the
				individuals responsible for the abuse of or crimes committed against
				individuals with disabilities;</text>
							</paragraph><paragraph id="IDc5063a9615124c069cd1eb64b80f1429"><enum>(5)</enum><text>remedies issues
				identified during an investigation described in paragraph (2);</text>
							</paragraph><paragraph id="ID38eea30c25a845d2ada8bc248d7fd0ed"><enum>(6)</enum><text>prosecutes the
				perpetrator, where appropriate, of any crime identified during an investigation
				described in paragraph (2);</text>
							</paragraph><paragraph id="id0273934EDCCD49618787FFCA3FEFDC65"><enum>(7)</enum><text>provides services
				to and enforces statutory rights of individuals with disabilities who are the
				victims of a crime; and</text>
							</paragraph><paragraph id="ID2a7c841138464fb6b55f6d22787369b2"><enum>(8)</enum><text>develops
				curricula and provides interdisciplinary training for prosecutors, criminal
				justice agencies, protective service agencies, victims assistance agencies,
				educators, community based providers and health, mental health, and allied
				health professionals in the area of disabilities, including developmental
				disabilities.</text>
							</paragraph></subsection><subsection id="IDe22a332f73174c9a9194d97d2756713d"><enum>(d)</enum><header>Applications</header>
							<paragraph id="ID3f230321fb6d4a57a907f2381206a9d0"><enum>(1)</enum><header>In
				general</header><text>To receive a planning grant or an implementation grant,
				an applicant shall submit an application to the Attorney General at such time,
				in such manner, and containing such information as the Attorney General, in
				consultation with the Secretary, may reasonably require, in addition to the
				information required by subsection (e)(1) or (f)(1), respectively.</text>
							</paragraph><paragraph id="ID8072ba3c56ff457ba9dfa9957f7d1043"><enum>(2)</enum><header>Combined
				planning and implementation grant application</header>
								<subparagraph id="id81DA12CBA31743AAA4CF6A7F9088210A"><enum>(A)</enum><header>In
				general</header><text>The Attorney General, in consultation with the Secretary,
				shall develop a procedure allowing an applicant to submit a single application
				requesting both a planning grant and an implementation grant.</text>
								</subparagraph><subparagraph id="id9D3A6EB290EC46349ED6E0735C086151"><enum>(B)</enum><header>Conditional
				grant</header><text>The award of an implementation grant to an applicant
				submitting an application under subparagraph (A) shall be conditioned on
				successful completion of the activities funded under the planning grant, if
				applicable.</text>
								</subparagraph></paragraph></subsection><subsection id="ID8bf677dc71c34792a73e3233e2055acb"><enum>(e)</enum><header>Planning
				grants</header>
							<paragraph id="id328E2F6CEC684F72956C17337912461F"><enum>(1)</enum><header>Applications</header><text>An
				application for a planning grant shall include, at a minimum—</text>
								<subparagraph id="idDBE22412EC0940939D5697A248C5F823"><enum>(A)</enum><text>a budget;</text>
								</subparagraph><subparagraph id="id12080EA774CE4349A9E699FFED3F1AFE"><enum>(B)</enum><text>a budget
				justification;</text>
								</subparagraph><subparagraph id="id8F6BDFB7535D45CCB3678737DAB7D4A8"><enum>(C)</enum><text>a description of
				the outcome measures that will be used to measure the effectiveness of the
				program;</text>
								</subparagraph><subparagraph id="id28C1C643D89A47F7B0E3AB67001C26E6"><enum>(D)</enum><text>a schedule for
				completing the activities proposed in the application;</text>
								</subparagraph><subparagraph id="id8651D458655B4008B87E0D61D60E76CF"><enum>(E)</enum><text>a description of
				the personnel necessary to complete activities proposed in the application;
				and</text>
								</subparagraph><subparagraph id="idB00E760FC50640108F78A1016A18CEBA"><enum>(F)</enum><text>provide
				assurances that program activities and locations are and will be in compliance
				with section 504 of the Rehabilitation Act of 1973 throughout the grant
				period.</text>
								</subparagraph></paragraph><paragraph id="IDd7a99b0113f64ec39df860cb022b3a85"><enum>(2)</enum><header>Period of
				grant</header><text>A planning grant shall be made for a period of 1 year,
				beginning on the first day of the month in which the planning grant is
				made.</text>
							</paragraph><paragraph id="IDf5750a9a76c046b0b5a57ae272a5f1bf"><enum>(3)</enum><header>Amount</header><text>The
				amount of planning grant shall not exceed $50,000, except that the Attorney
				General may, for good cause, approve a grant in a higher amount.</text>
							</paragraph><paragraph id="idA1E241ED63B44952B4FC13EBBA5562F6"><enum>(4)</enum><header>Limit on
				number</header><text>The Attorney General, in consultation with the Secretary,
				shall not make more than one such planning grant to any State, unit of local
				government, Indian tribe, or tribal organization.</text>
							</paragraph></subsection><subsection id="IDc57c115d098646fda4b53a8d4b2dfaa8"><enum>(f)</enum><header>Implementation
				grants</header>
							<paragraph id="idAAC6549CA94B413C8076A5EE205EDDDD"><enum>(1)</enum><header>Implementation
				grant applications</header><text>An application for an implementation grant
				shall include the following:</text>
								<subparagraph commented="no" id="IDed34c6e8692c457cac3b7827f9d88a5e"><enum>(A)</enum><header>Collaboration</header><text>An
				application for an implementation grant shall—</text>
									<clause commented="no" id="ID3716c9cf5c3c42689b9dcfe77938895f"><enum>(i)</enum><text>identify not
				fewer than one criminal justice enforcement agency or adult protective services
				organization and not fewer than one agency, crime victim assistance program, or
				other organization that provides services to individuals with disabilities,
				such as the protection and advocacy systems established under section 143 of
				the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42
				U.S.C. 15043), that will participate in the collaborative program; and</text>
									</clause><clause commented="no" id="ID198939293cef4f78923f5000cb26c6c5"><enum>(ii)</enum><text>describe the
				responsibilities of each participating agency or organization, including how
				each agency or organization will use grant funds to facilitate improved
				responses to reports of abuse and crimes committed against individuals with
				disabilities.</text>
									</clause></subparagraph><subparagraph commented="no" id="IDdac29e4068094346ac5791af74cd8c6b"><enum>(B)</enum><header>Guidelines</header><text>An
				application for an implementation grant shall describe the guidelines that will
				be developed for personnel of a criminal justice agency, adult protective
				services organization, crime victim assistance program, and agencies or other
				organizations responsible for services provided to individuals with
				disabilities to carry out the goals of the collaborative program.</text>
								</subparagraph><subparagraph id="ID9290d459b2df4a1dab13dfb3f240f3e2"><enum>(C)</enum><header>Financial</header><text>An
				application for an implementation grant shall—</text>
									<clause id="IDda5793fcd806441cbec3da686e46cc4b"><enum>(i)</enum><text>explain why the
				applicant is unable to fund the collaboration program adequately without
				Federal funds;</text>
									</clause><clause id="IDd6b222fe18e442e4917daa81c18115f4"><enum>(ii)</enum><text>specify how the
				Federal funds provided will be used to supplement, and not supplant, the
				funding that would otherwise be available from the State, unit of local
				government, Indian tribe, or tribal organization; and</text>
									</clause><clause id="ID3a10edf9e4234639a2d39155ffa2befc"><enum>(iii)</enum><text>outline plans
				for obtaining necessary support and continuing the proposed collaboration
				program following the conclusion of the grant under this section.</text>
									</clause></subparagraph><subparagraph id="ID58224a2224904e79b9d1c6d4b9721226"><enum>(D)</enum><header>Outcomes</header><text>An
				application for an implementation grant shall—</text>
									<clause id="ID076eb3e1bf9b4a5c9af29a56775c3a98"><enum>(i)</enum><text>identify the
				methodology and outcome measures, as required by the Attorney General, in
				consultation with the Secretary, for evaluating the effectiveness of the
				collaboration program, which may include—</text>
										<subclause id="id593DC2C8B75442B58A33EB48B112272A"><enum>(I)</enum><text>the number and
				type of agencies participating in the collaboration;</text>
										</subclause><subclause id="ID64507c7900284ab2b97a50b215878a59"><enum>(II)</enum><text>any trends in
				the number and type of cases referred for multidisciplinary case review;</text>
										</subclause><subclause id="ID2162c3db2d9c43cf9e5e543ab1d054dc"><enum>(III)</enum><text>any trends in
				the timeliness of law enforcement review of reported cases of violence against
				individuals with a disability; and</text>
										</subclause><subclause id="IDdd37bdb325a14a9d8e92c99f2af570f5"><enum>(IV)</enum><text>the number of
				persons receiving training by type of agency;</text>
										</subclause></clause><clause id="IDdf70415f1dda4b828e4ebb0acbd20095"><enum>(ii)</enum><text>describe the
				mechanisms of any existing system to capture data necessary to evaluate the
				effectiveness of the collaboration program, consistent with the methodology and
				outcome measures described in clause (i) and including, where possible, data
				regarding—</text>
										<subclause id="id21DB55C11781478C95581403F9345DDF"><enum>(I)</enum><text>the number of
				cases referred by the adult protective services agency, or other relevant
				agency, to law enforcement for review;</text>
										</subclause><subclause id="IDc77fc5d08a194e1891bdfd4d9481ec04"><enum>(II)</enum><text>the number of
				charges filed and percentage of cases with charges filed as a result of such
				referrals;</text>
										</subclause><subclause id="IDdbec85b96dbe4b15bfbea288b6ccb6e4"><enum>(III)</enum><text>the period of
				time between reports of violence against individuals with disabilities and law
				enforcement review; and</text>
										</subclause><subclause id="id09561C25FFAA4F5DB52FDC0C971E0BA7"><enum>(IV)</enum><text>the number of
				cases resulting in criminal prosecution, and the result of each such
				prosecution; and</text>
										</subclause></clause><clause id="ID3d4226c10af947fbbb23dd99fa0b2cdb"><enum>(iii)</enum><text>include an
				agreement from any participating or affected agency or organization to provide
				the data described in clause (ii).</text>
									</clause></subparagraph><subparagraph id="idF01B00AC8F0C4245A4FC6FE5A7D1E471"><enum>(E)</enum><header>Form of
				data</header><text>The Attorney General, in consultation with the Secretary,
				shall promulgate and supply a common electronic reporting form or other
				standardized mechanism for reporting of data required under this
				section.</text>
								</subparagraph><subparagraph id="ID2f754dafc6fe49c6894459debe25f9dc"><enum>(F)</enum><header>Collaboration
				set aside</header><text>Not less than 5 percent and not more than 10 percent of
				the funds provided under an implementation grant shall be set aside to procure
				technical assistance from any recognized State model program or from a
				recognized national organization, as determined by the Attorney General (in
				consultation with the Secretary), including the National District Attorneys
				Association and the National Adult Protective Services Association.</text>
								</subparagraph><subparagraph id="ID1fa88362d8c54faa8c8aa3748496a254"><enum>(G)</enum><header>Other
				programs</header><text>An applicant for an implementation grant shall describe
				the relationship of the collaboration program to any other program of a
				criminal justice agency or other agencies or organizations providing services
				to individuals with disabilities of the State, unit of local government, Indian
				tribe, or tribal organization applying for an implementation grant.</text>
								</subparagraph></paragraph><paragraph id="id19FE1741061A47AB9EDCB5AFDE77D342"><enum>(2)</enum><header>Period of
				grant</header>
								<subparagraph id="id9DDABC9C3B734BFF9973C023D0F0F37B"><enum>(A)</enum><header>In
				general</header><text>An implementation grant shall be made for a period of 2
				years, beginning on the first day of the month in which the implementation
				grant is made.</text>
								</subparagraph><subparagraph id="id62FACA8016824FA79A0F7EC1B43DB18C"><enum>(B)</enum><header>Renewal</header><text>An
				implementation grant may be renewed for one additional period of 2 years, if
				the applicant submits to the Attorney General and the Secretary a detailed
				explanation of why additional funds are necessary.</text>
								</subparagraph></paragraph><paragraph id="id06C48849F1DB47A8B7233787E9DF664B"><enum>(3)</enum><header>Amount</header><text>An
				implementation grant shall not exceed $300,000.</text>
							</paragraph></subsection><subsection id="ID11498bff520343f18c206a3217c19f59"><enum>(g)</enum><header>Evaluation of
				program efficacy</header>
							<paragraph id="id38870E3C386641ABA2E26F399F7CDCAD"><enum>(1)</enum><header>Establishment</header><text>The
				Attorney General, in consultation with the Secretary, shall establish a
				national center to evaluate the overall effectiveness of the collaboration
				programs funded under this section.</text>
							</paragraph><paragraph id="idF80EA73A8B454C33BF39ECC36BDC4FFB"><enum>(2)</enum><header>Responsibilities</header><text>The
				national center established under paragraph (1) shall—</text>
								<subparagraph id="idD231FB84E59D4E35899972AFB5CB3555"><enum>(A)</enum><text>analyze
				information and data supplied by grantees under this section; and</text>
								</subparagraph><subparagraph id="id288FE949FA0440C08FF0FD7B8D8EC49B"><enum>(B)</enum><text>submit an annual
				report to the Attorney General and the Secretary that evaluates the number and
				rate of change of reporting, investigation, and prosecution of charges of a
				crime or abuse against individuals with disabilities.</text>
								</subparagraph></paragraph><paragraph id="id19A9ACD1EB1F4D79B82F71A3CD914E85"><enum>(3)</enum><header>Authorization</header><text>The
				Attorney General may use not more than $500,000 of amounts made available under
				subsection (h) to carry out this subsection.</text>
							</paragraph></subsection><subsection id="IDa0c8863981e24a2e9feeeb3a8ba5efef"><enum>(h)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to the
				Department of Justice to carry out this section—</text>
							<paragraph id="idEC88244CE30C4B1E85CB10D46E38DE44"><enum>(1)</enum><text>$10,000,000 for
				fiscal year 2009; and</text>
							</paragraph><paragraph id="IDd8f26b4f46594e93bfc74354dad64736"><enum>(2)</enum><text>such sums as are
				necessary for each of fiscal years 2010 through
				2015.</text>
							</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idA630D1E732474C5D81AB795A27106440"><enum>5.</enum><header>Research grant
			 and report</header>
			<subsection id="IDe4bf65a615dc426e9e2f65b49705f4bf"><enum>(a)</enum><header>In
			 general</header><text>The purpose of this section is to provide for research to
			 assist the Attorney General in collecting valid, reliable national data
			 relating to crimes against individuals with developmental and related
			 disabilities for the National Crime Victims Survey conducted by the Bureau of
			 Justice Statistics of the Department of Justice as required by the Crime
			 Victims with Disabilities Awareness Act.</text>
			</subsection><subsection id="IDae03aee51a264ee5bab6051d75dddbfa"><enum>(b)</enum><header>National
			 interdisciplinary advisory council</header>
				<paragraph id="ID524f31b0eb1c4f52ac1ae6e91039a7bd"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary of Health and Human Services shall establish a national
			 interdisciplinary advisory council (referred to in this section as the
			 <quote>advisory council</quote>), that includes individuals with disabilities,
			 which shall provide input into the methodologies used to collect valid,
			 reliable national data on crime victims with developmental and related
			 disabilities, participate in reviewing the data collected through the research
			 grant program, and assist in writing the final report.</text>
				</paragraph><paragraph id="ID0a7fb7ca76de47edad2bcd958cfcf907"><enum>(2)</enum><header>Recommended
			 methodology</header><text>Not later than 6 months after the establishment of
			 the advisory council, the advisory council shall provide to the Secretary of
			 Health and Human Services its recommended methodology for collecting incidence
			 data on violence against people with developmental and related
			 disabilities.</text>
				</paragraph></subsection><subsection id="ID8d3d5b4b8fd44b4fb7c3c773edaa9c41"><enum>(c)</enum><header>Research grant
			 program</header><text>Not later than 12 months after the date of the enactment
			 of this Act, the Secretary of Health and Human Services shall—</text>
				<paragraph id="id2E73AE7AEDC74827AC2177C1D35950C6"><enum>(1)</enum><text>review the
			 methodology developed by the advisory council related to collecting incidence
			 data on violence against people with developmental and related disabilities;
			 and</text>
				</paragraph><paragraph id="id371CB1D476454978A47D4526F71D98E1"><enum>(2)</enum><text>based on such
			 review, shall award grants in accordance with this section to eligible
			 recipients, to collect valid, reliable national data on crime victims with
			 developmental and related disabilities that can be validly compared to data
			 from the National Crime Victims Survey.</text>
				</paragraph></subsection><subsection id="ID1168e89d26e5436db581d8148b8e264d"><enum>(d)</enum><header>Report</header><text>Not
			 later than 12 months after the Secretary of Health and Human Services awards
			 the research grants under subsection (c), the advisory council shall review the
			 data eligible recipients of the grants collected and write a report to be
			 presented to the Secretary of Health and Human Services, the Attorney General,
			 and the Bureau of Justice Statistics.</text>
			</subsection><subsection id="IDae1c7d70f5614c6ea51b2d9191169dd2"><enum>(e)</enum><header>Definitions</header>
				<paragraph id="ID2091a97c53b84c5b9d1a200b50db02a4"><enum>(1)</enum><header>Eligible
			 recipient</header><text>The term <term>eligible recipient</term> means—</text>
					<subparagraph id="ID75f066af9ba349abb888cbcd5d26bc83"><enum>(A)</enum><text>a State
			 agency;</text>
					</subparagraph><subparagraph id="IDa07f12e051d047a4af4e5d34341e377e"><enum>(B)</enum><text>a private,
			 nonprofit organization;</text>
					</subparagraph><subparagraph id="ID099cd3ad71cf465abb78d0f3d99b3cb8"><enum>(C)</enum><text>a University
			 Center for Excellence in Developmental Disabilities; or</text>
					</subparagraph><subparagraph id="ID11daa29942a84ea4b1d4442ccf872b63"><enum>(D)</enum><text>any public entity
			 that has a demonstrated ability to—</text>
						<clause id="IDb1dbf89e9b2c47a199921f2fccffd78e"><enum>(i)</enum><text>collaborate with
			 criminal justice, child welfare, and other agencies and organizations that
			 provide services to individuals with disabilities, including victim assistance
			 and violence prevention organizations, to ensure that incidence data can be
			 aggregated to accurately show the incidence of abuse of individuals with
			 disabilities nationally; and</text>
						</clause><clause id="IDb23d78fc6ee844389b14a70dfb400f04"><enum>(ii)</enum><text>conduct research
			 and collect data to measure the extent of the problem of crimes against
			 individuals with developmental and related disabilities, including—</text>
							<subclause id="ID8c93b7e69a4d407584448cb3b5c0eb3e"><enum>(I)</enum><text>understanding the
			 nature and extent of crimes against individuals with developmental and related
			 disabilities, including domestic violence and all types of abuse;</text>
							</subclause><subclause id="ID9f7c65b0dd884e0aa89a07af36765202"><enum>(II)</enum><text>describing the
			 manner in which the justice system responds to crimes against individuals with
			 developmental and related disabilities; and</text>
							</subclause><subclause id="ID97e9c7404745490a8da946eda6e7771f"><enum>(III)</enum><text>identifying
			 programs, policies, or laws that hold promises for making the justice system
			 more responsive to crimes against individuals with developmental and related
			 disabilities.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="IDd728f55fc9044664937af28d68928c8b"><enum>(2)</enum><header>Developmental
			 disabilities</header><text>The term <term>developmental disabilities</term> has
			 the meaning given that term in section 102(8) of the Developmental Disabilities
			 Assistance and Bill of Rights Act of 2000 (42 U.S.C. 15002(8)).</text>
				</paragraph><paragraph id="ID59a4dcf010bb4e1c8fd651c6110e4557"><enum>(3)</enum><header>Related
			 disabilities</header><text>The term <term>related disabilities</term> means
			 autism spectrum disorders, cerebral palsy, spina bifida, epilepsy, traumatic
			 brain injury, or other lifelong disabilities that are acquired prior to the age
			 of 21.</text>
				</paragraph></subsection><subsection id="ID4ad11c5515414bc691ef5534872f61d9"><enum>(f)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to
			 carry out this section $1,000,000 for each of fiscal years 2009 through
			 2012.</text>
