		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Drill Now Act of
			 2008</short-title></quote>.</text>
		</section><section id="IDe4f72821ce4548b8b150b5e7d37ee5b5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDa4a72520a74b4d13b5fb7c2309114ed7"><enum>(1)</enum><header>Opened
			 area</header><text>The term <term>opened area</term> means any area of the
			 outer Continental shelf that—</text>
				<subparagraph id="id05455D28E93949BE99AFAF9D3D6DDE1D"><enum>(A)</enum><text>before the date
			 of enactment of this Act, was closed to oil or gas leasing; and</text>
				</subparagraph><subparagraph id="id2FE45D0DB5444765B00BA097D496AFB6"><enum>(B)</enum><text>as of the date of
			 enactment of this Act, is made available for leasing pursuant to section 3(a)
			 and the amendments made by that section.</text>
				</subparagraph></paragraph><paragraph id="ID8fc9ca553dd646e99bbffd18dc607f3d"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="id9032417781C64F9799277C47C32B2AB7"><enum>3.</enum><header>Leasing on outer
			 Continental Shelf</header>
			<subsection id="ID0cc2c6f8d2db478392a30becce3ee917"><enum>(a)</enum><header>Opening new
			 offshore areas to oil and gas development</header>
				<paragraph id="ID5ef6c351ebf946eda94f6ff1b5af3d78"><enum>(1)</enum><header>In
			 general</header><text>Sections 104 and 105 of the Department of the Interior,
			 Environment, and Related Agencies Appropriations Act, 2008 (Public Law 110–161;
			 121 Stat. 2118) are repealed.</text>
				</paragraph><paragraph id="ID3e0ddb6059c64297b20c4aa61637d340"><enum>(2)</enum><header>Eastern Gulf of
			 Mexico</header><text>Section 104 of the Gulf of Mexico Energy Security Act of
			 2006 (43 U.S.C. 1331 note; Public Law 109–432) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="idA4A8853EA825455EB64863B25C4E6D04" style="OLC">
						<section id="id37FC20D5C5414BD99EBD2629D0C1E37F"><enum>104.</enum><header>Designation of
				National Defense Areas</header><text display-inline="no-display-inline">The
				United States reserves the right to designate by and through the Secretary of
				Defense, with the approval of the President, national defense areas on the
				outer Continental Shelf pursuant to section 12(d) of the Outer Continental
				Shelf Lands Act (43 U.S.C.
				1341(d)).</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDd32d4545bfb84fc083f3095b01e019bc"><enum>(b)</enum><header>Expedited
			 leasing</header><text display-inline="yes-display-inline">The Secretary may
			 conduct leasing, preleasing, and related activities for any opened area before
			 June 30, 2012, notwithstanding the omission of the opened area from the Outer
			 Continental Shelf leasing program developed pursuant to section 18 of the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1344) for the period ending June 30,
			 2012.</text>
			</subsection><subsection id="ID38c20e8938b6420389a8daf50f699ff8"><enum>(c)</enum><header>No surface
			 occupancy</header><text display-inline="yes-display-inline">Any lease issued by
			 the Secretary pursuant to section 8 of the Outer Continental Shelf Lands Act
			 (43 U.S.C. 1337) for any submerged land of the outer Continental Shelf in any
			 opened area lying within 25 miles of the coastline of any State shall include a
			 provision prohibiting permanent surface occupancy under that lease within that
			 25-mile area.</text>
			</subsection><subsection id="IDc3bac2b1fbc14065bdbd2fe622542104"><enum>(d)</enum><header>Disposition of
			 revenues from outer Continental Shelf areas opened under this section</header>
				<paragraph id="IDa95a3de908184ee08600d941954fe4ed"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding section 9 of the Outer Continental Shelf
			 Lands Act (43 U.S.C. 1338) and subject to the other provisions of this section,
			 the Secretary of the Treasury shall deposit rentals, royalties, bonus bids, and
			 other sums due and payable from any leased tract within an opened area, and
			 from all other leased tracts in any other area for which leases are entered
			 into after the date of enactment of this Act, as follows:</text>
					<subparagraph id="ID09b2416f6e924f10ba136faae6bc495f"><enum>(A)</enum><text>50 percent in the
			 general fund of the Treasury.</text>
					</subparagraph><subparagraph id="IDf8a6173e770e4735b5fb6e7e607144a1"><enum>(B)</enum><text>50 in a special
			 account in the Treasury, for allocation by the Secretary among the States in
			 accordance with paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="ID7ac1403232aa493390de3ad9ea016c67"><enum>(2)</enum><header>Allocation</header>
					<subparagraph id="id422554BBDD2F41F8A3A7C46969529DDF"><enum>(A)</enum><header>In
			 general</header><text>For fiscal year 2009 and each fiscal year thereafter, the
			 amount made available under paragraph (1)(B) shall be allocated among States in
			 amounts (based on a formula established by the Secretary by regulation) that
			 are inversely proportional to the respective distances between—</text>
						<clause id="id87E917CF37184875BA1766CA7B3D11F0"><enum>(i)</enum><text>the
			 point on the coastline of each State that is closest to the geographical center
			 of the applicable leased tract; and</text>
						</clause><clause id="id63531838FAC945A490DD9FEA6BFFAF13"><enum>(ii)</enum><text>the geographical
			 center of the leased tract.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB04EF8AB3384663A597DC68323524DA"><enum>(B)</enum><header>Prohibition on
			 receipt of amounts</header><text>No State shall receive any amount under this
			 paragraph from a leased tract if the geographical center of that leased tract
			 is more than 200 nautical miles from the coastline of that State.</text>
					</subparagraph></paragraph><paragraph id="id71121BC5266144F6BB86E220C5DA4904"><enum>(3)</enum><header>Administration</header><text>Amounts
			 made available under paragraph (1)(B) shall—</text>
					<subparagraph id="ID84bdbd6e220d46fdaf650144c6d58736"><enum>(A)</enum><text>be made
			 available, without further appropriation, in accordance with this
			 section;</text>
					</subparagraph><subparagraph id="IDe5a623b6ca9648d4a24caa5c0ca38b97"><enum>(B)</enum><text>remain available
			 until expended; and</text>
					</subparagraph><subparagraph id="IDea9fabfb9e354bf39af103f4fa282278"><enum>(C)</enum><text>be in addition to
			 any amounts appropriated under—</text>
						<clause id="IDe6e9f89343ec4e448e2732c159d99a4e"><enum>(i)</enum><text>the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1331 et seq.);</text>
						</clause><clause id="ID76a9f5bdbd9b4f97a796c9f8393ce383"><enum>(ii)</enum><text>the Land and
			 Water Conservation Fund Act of 1965 (16 U.S.C. 460l–4 et seq.); or</text>
						</clause><clause id="IDec4386e8d3194743aedb12094bb60faf"><enum>(iii)</enum><text>any other
			 provision of law.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID3d47f9775ac24389a7fe1a1427316fd5"><enum>(e)</enum><header>Judicial
			 review</header>
				<paragraph id="IDb20fbec805e34574966f382b23413209"><enum>(1)</enum><header>Filing of
			 complaint</header>
					<subparagraph id="idAB4BBCB6A4274479BB18A88B5FFE9277"><enum>(A)</enum><header>Deadline</header><text>Subject
			 to subparagraph (B), any complaint seeking judicial review of any provision of
			 this section or any action of the Secretary under this section or relating to
			 areas opened under the amendments made by subsection (a) shall be filed in any
			 appropriate United States district court—</text>
						<clause id="ID816a4a66d58643ff811e40da2d1f9414"><enum>(i)</enum><text>except as
			 provided in clause (ii), not later than the end of the 90-day period beginning
			 on the date of the action being challenged; or</text>
						</clause><clause id="IDb330f23519ff41e8acfc9f8a35dffcfd"><enum>(ii)</enum><text>in
			 the case of a complaint based solely on grounds arising after that period, not
			 later than 90 days after the date on which the complainant knew or reasonably
			 should have known of the grounds for the complaint.</text>
						</clause></subparagraph><subparagraph id="ID4dbb1ae000ac48a494bd288503fe6e77"><enum>(B)</enum><header>Venue</header><text>Any
			 complaint seeking judicial review of an action of the Secretary under this
			 section or relating to areas opened under subsection (a) may be filed only in
			 the United States Court of Appeals for the District of Columbia.</text>
					</subparagraph><subparagraph id="ID023da32684434253a19873755788bb6d"><enum>(C)</enum><header>Limitation on
			 scope of certain review</header>
						<clause id="id366F2A378597456C9B4CF0E0A8988919"><enum>(i)</enum><header>In
			 general</header><text>Judicial review of a decision of the Secretary to conduct
			 a lease sale for areas opened under the amendments made by subsection (a),
			 including the environmental analysis relating to such a decision, shall
			 be—</text>
							<subclause id="id6E57CA4364CF4F3998A506C31C0D7F97"><enum>(I)</enum><text>limited to
			 whether the Secretary has complied with the terms of this section and the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1331 et seq.); and</text>
							</subclause><subclause id="idFEF45C7D287B4B97BFC96585BE6BDA1C"><enum>(II)</enum><text>based upon the
			 administrative record of that decision.</text>
							</subclause></clause><clause id="idED465C2E2E414A409F7B927F4C02CBF8"><enum>(ii)</enum><header>Presumption</header><text>In
			 any judicial review described in clause (i), the identification by the
			 Secretary of a preferred course of action to enable leasing to proceed, and the
			 analysis of the Secretary of any environmental effects of that course of
			 action, shall be presumed to be correct unless shown otherwise by clear and
			 convincing evidence to the contrary.</text>
						</clause></subparagraph></paragraph><paragraph id="IDae811ee4d65143ecbca23a0553a9202c"><enum>(2)</enum><header>Limitation on
			 other review</header><text>Actions of the Secretary with respect to which
			 review could have been obtained under this section shall not be subject to
			 judicial review in any civil or criminal proceeding for enforcement.</text>
				</paragraph></subsection><subsection id="IDb24c53bf1d4d4675a8caadea2b255b9b"><enum>(f)</enum><header>Repeal of
			 restriction on oil shale leasing</header><text display-inline="yes-display-inline">Section 433 of the Department of the
			 Interior, Environment, and Related Agencies Appropriations Act, 2008 (Public
			 Law 110–161; 121 Stat. 2152) is repealed.</text>
