		<official-title display="yes">To combat predatory lending practices and
		  to provide access to capital to those living in low-income and traditionally
		  underserved communities, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="id73C91024718D4C43A58EFC66DB183BEC" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fostering American Independence from
			 Regressive and Abusive Credit Transactions Act of 2008</short-title></quote> or
			 the <quote>FAIR Act</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idAACF93F74EAE4229B79E5B56621BCD1F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Maximum interest rates; prohibition on
			 payday lending</header><text display-inline="no-display-inline">Chapter 2 of
			 the Truth in Lending Act (15 U.S.C. 1631 et seq.) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idBC0FA16B2B5D408F9F301DC5F593B086" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id8C08CBEA799743469FFF6FF457D3CA79" section-type="subsequent-section"><enum>140.</enum><header display-inline="yes-display-inline">Maximum rate of interest; prohibition on
				payday lending</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID84e38c5cf7d6448f9e322befeae0a777"><enum>(a)</enum><header display-inline="yes-display-inline">Interest
				limit</header><text display-inline="yes-display-inline">No covered creditor may
				make an extension of credit to a consumer with respect to which the annual
				percentage rate, as defined in subsection (b), exceeds 36 percent, or such
				lower limit as is provided under otherwise applicable State or Federal law,
				including section 207 of the Servicemembers Civil Relief Act (50 U.S.C. App.
				527).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idCBBFFC0B223B44C0B89DF4AD2FD02B49"><enum>(b)</enum><header display-inline="yes-display-inline">Payday loan prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				no covered creditor may—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id716A1759565A4F9EAC47CB51C1078A73"><enum>(1)</enum><text display-inline="yes-display-inline">cash or advance money for a post-dated
				check in exchange for a fee or other payment of interest, other than as
				otherwise authorized for the payment of a preexisting debt; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B59EADCE1324CBE8DFE3A1AE340007B"><enum>(2)</enum><text display-inline="yes-display-inline">hold a check, require electronic access to
				an account at a financial institution, or hold title to personal property
				(except in connection with the purchase or rental of such personal property) as
				collateral for a loan or other extension of credit.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbc647da351934d93bb06eecd12619264"><enum>(c)</enum><header display-inline="yes-display-inline">Definition of annual percentage credit rate
				and covered creditor</header><text display-inline="yes-display-inline">For
				purposes of this section—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idB863922F3A8E49E29F8521E4E02066FA"><enum>(1)</enum><text display-inline="yes-display-inline">the <quote>annual percentage rate</quote>
				includes all charges payable directly or indirectly incident to, ancillary to,
				or as a condition of the extension of credit, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID9bb5322effe0483386b7386fa607cfcb"><enum>(A)</enum><text display-inline="yes-display-inline">any payment compensating a creditor or
				prospective creditor for an extension of credit or making available a line of
				credit, or any default or breach by a borrower of a condition upon which credit
				was extended, including fees connected with credit extension or availability,
				such as numerical periodic rates, late fees, creditor-imposed not sufficient
				funds fees charged when a borrower tenders payment on a debt with a check drawn
				on insufficient funds, over limit fees, annual fees, cash advance fees, and
				membership fees;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID35d6ceb1c226469a9ef6c593721be4be"><enum>(B)</enum><text display-inline="yes-display-inline">all fees which constitute a finance charge,
				as defined by rules of the Board in accordance with this title;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91c535ae73b048e8a4e7f15c80959c5c"><enum>(C)</enum><text display-inline="yes-display-inline">credit insurance premiums, whether optional
				or required; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9908322cb8004f8a9903462a380a1794"><enum>(D)</enum><text display-inline="yes-display-inline">all charges and costs for ancillary
				products sold in connection with or incidental to the credit transaction;
				and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B3AA0CDAD354F6FA0515939840AB0A9"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>covered creditor</quote>
				means a creditor other than an insured depository institution (as defined in
				section 3 of the Federal Deposit Insurance Act (12 U.S.C. 1813)) or an insured
				credit union (as defined in section 101 of the Federal Credit Union Act (12
				U.S.C. 1752)).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA1C4318FB96C4F93B28860B35B9E0B45"><enum>(d)</enum><header display-inline="yes-display-inline">Mandatory disclosures</header><text display-inline="yes-display-inline">In addition to any other disclosures
				required by this title, a covered creditor shall, with respect to an extension
				of consumer credit, provide to the consumer in writing, at or before the
				issuance of such credit—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idE912739BFA074C349CA03E423BC61120"><enum>(1)</enum><text display-inline="yes-display-inline">a statement of the annual percentage rate
				applicable to the extension of credit; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFAFF9953678549FCA0C6856F0E986850"><enum>(2)</enum><text display-inline="yes-display-inline">a clear description of the payment
				obligations of the consumer.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe8934689c07a40ac9407ee729b7a8d1a"><enum>(e)</enum><header display-inline="yes-display-inline">Relation to State law</header><text display-inline="yes-display-inline">Nothing in this section may be construed to
				preempt any provision of State law that provides greater protection to
				consumers than is provided in this section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4d3dad3306314d4da4ef1721a2e278bf"><enum>(f)</enum><header display-inline="yes-display-inline">Civil liability and
				enforcement</header><text display-inline="yes-display-inline">In addition to
				remedies available to the consumer under section 130(a), any consumer credit
				transaction made in violation of this section shall be null and void, and not
				enforceable by any party in any court or alternative dispute resolution forum,
				and the creditor or any subsequent holder shall promptly return to the consumer
				any principal, interest, charges, and fees, and any security interest
				associated with such transaction. Notwithstanding any statute of limitations or
				repose, a violation of this section may be raised as a matter of defense by
				recoupment or set off to an action to collect such debt or repossess related
				security at any time.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2184f30161f84cb792121fdf7febc39e"><enum>(g)</enum><header display-inline="yes-display-inline">Violations</header><text display-inline="yes-display-inline">Any person that violates this section, or
				seeks to enforce an agreement made in violation of this section, shall be
				subject to, for each such violation, 1 year in prison and a fine in an amount
				equal to the greater of—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDa6921f9660644a2dba0c8d0b725cce28"><enum>(1)</enum><text display-inline="yes-display-inline">3 times the amount of the total accrued
				debt associated with the subject transaction; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf34c6d3c5d6c4d298894dc0fef9f6e5d"><enum>(2)</enum><text display-inline="yes-display-inline">$50,000.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID85ca05fb501e415dbf6a23f122793747"><enum>(h)</enum><header display-inline="yes-display-inline">State attorneys general</header><text display-inline="yes-display-inline">An action to enforce this section may be
				brought by the appropriate State attorney general in any United States district
				court or any other court of competent jurisdiction, not later than 3 years
				after the date of the violation, and may obtain injunctive
				relief.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="idCC82BA48BADC45B380CD5F20A3749173" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Small-dollar loan program</header>
			<subsection commented="no" display-inline="no-display-inline" id="idDC3E401CF6C044FDBA2E1EB4FD509BC8"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Federal Deposit Insurance Corporation
			 (in this Act referred to as the <quote>Corporation</quote>) shall establish, by
			 rule, a program to encourage insured depository institutions to incorporate
			 small consumer loans into their regular banking services.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id881DACDF812544E1BDCB5CF17315B2E4"><enum>(b)</enum><header display-inline="yes-display-inline">Program components</header><text display-inline="yes-display-inline">The loan program established under this
			 section shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id3368C075F9454D29A9E916F8E7364C99"><enum>(1)</enum><text display-inline="yes-display-inline">be voluntary in nature;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DC5E4FB30E04C2D815FC663B9A6BFD8"><enum>(2)</enum><text display-inline="yes-display-inline">allow for loan amounts of $1,000 or
			 less;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id143BBDDA1E37454C9FCD9B1DFB89661C"><enum>(3)</enum><text display-inline="yes-display-inline">provide for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3AC0C52F0CE04F5081E41A17A9C6DE44"><enum>(A)</enum><text display-inline="yes-display-inline">amortization periods of not longer than 36
			 months, in the case of closed end credit plans; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75E81B38D4EE4437BD96CDCDB73CF4F6"><enum>(B)</enum><text display-inline="yes-display-inline">minimum regular payments that are designed
			 to reduce outstanding principal amounts, in the case of loans under an open end
			 credit plan;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1400237F23B8428B80915B8DBF970530"><enum>(4)</enum><text display-inline="yes-display-inline">prohibit the imposition of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB2A1DF1E25344778872AB75C6F5E8362"><enum>(A)</enum><text display-inline="yes-display-inline">prepayment penalties; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4B94FEE53A64553ADB0607E88C23756"><enum>(B)</enum><text display-inline="yes-display-inline">origination or maintenance fees that exceed
			 the true cost of the loan to the financial institution; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8E8BA110BCE54ADB987D8418C2F67A4C"><enum>(5)</enum><text display-inline="yes-display-inline">provide for an automatic savings
			 component.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB92E9B1506C14EC6A7B46F351DC80993"><enum>(c)</enum><header display-inline="yes-display-inline">Community reinvestment act
			 treatment</header><text display-inline="yes-display-inline">Participation in
			 the loan program established under this Act shall be a factor in the
			 determination by the appropriate Federal financial supervisory agency of
			 whether an insured depository institution is meeting the credit needs of its
			 community for purposes of the Community Reinvestment Act of 1977.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id297E329B9FED4574AB6F7E5CA9D5B40A"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id2E1EB1B936F5418DB76B52A2F42F59D6"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>appropriate Federal
			 financial supervisory agency</term> has the same meaning as in section 803 of
			 the Community Reinvestment Act of 1977 (12 U.S.C. 2902);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2ADF78211EC447F81EB40F858FC3877"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>closed end credit
			 plan</term> means an extension of credit for a fixed period of time, other than
			 an extension of credit that is secured by a dwelling or other real
			 property;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3841220AB2F4F9289DDFF2C9E5C66E9"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>insured depository
			 institution</term> has the same meaning as in section 3 of the Federal Deposit
			 Insurance Act (12 U.S.C. 1813); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id753ED5BFF9A94BF39A0016DA806B0440"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term> open end credit plan</term>
			 has the same meaning as in section 103 of the Truth in Lending Act (15 U.S.C.
			 1602).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4C1E9E805C4840228536E77DE49C1471"><enum>(e)</enum><header display-inline="yes-display-inline">Regulatory actions</header><text display-inline="yes-display-inline">The Corporation shall issue such
			 regulations as may be necessary to carry out this section, including with
			 respect to the definition of terms (other than as provided in subsection
			 (d)).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8DC5A91559ED4A558148F3A0AD6DD457" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Study and report on best practices</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD0A16AE150D342BDA7FB22A622B96B96"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Federal Deposit Insurance Corporation
			 and the National Credit Union Administration shall each conduct a study of best
			 practices to provide incentives for mainstream financial institutions to
			 provide small dollar amount loans to consumers, including innovative State and
			 local programs, private sector, and not-for-profit initiatives.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idF7739ABBD6DC4C1AB806B7E126109C2F"><enum>(b)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Federal Deposit Insurance Corporation and the
			 National Credit Union Administration shall each submit a report to Congress on
			 the results of the study conducted under subsection (a).</text>
