			 treatment works and medium treatment works</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDca3faed7f89a4c548f6750489eed152c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title II of the Federal Water Pollution
			 Control Act (33 U.S.C. 1281 et seq.) is amended by adding at the end the
			 following:</text>

				treatment works and medium treatment works</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID8cb32898ccea4b1798d33f56cc7b9468"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDe25f3076f4744731aac83bfdc0cb9322"><enum>(1)</enum><header display-inline="yes-display-inline">Decentralized wastewater system</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDa8a6d86b83ca4530bfe5ede69a05a681"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>decentralized wastewater
				system</term> means a wastewater treatment system that is at or near a site at
				which wastewater is generated.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4e6205b8ff01417191de03abefd8b697"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>decentralized wastewater
				system</term> includes a system that provides for—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID4efd685997794007811e9747e6ab961c"><enum>(i)</enum><text display-inline="yes-display-inline">nonpotable reuse of treated effluent;
				or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID8d86d1ab99a243549cfc7a5950886b0c"><enum>(ii)</enum><text display-inline="yes-display-inline">energy and nutrient recovery from
				wastewater constituents.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce6be5c506c742a78b637f2315f8ccef"><enum>(2)</enum><header display-inline="yes-display-inline">Medium treatment works</header><text display-inline="yes-display-inline">The term <term>medium treatment
				works</term> means a publicly owned treatment works serving more than 10,000
				but fewer than 100,000 individuals.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14f12406fcb64899acd5e2ecac3cfd79"><enum>(3)</enum><header display-inline="yes-display-inline">Qualified nonprofit technical assistance
				provider</header><text display-inline="yes-display-inline">The term
				<term>qualified nonprofit technical assistance provider</term> means a
				qualified nonprofit technical assistance provider of water and wastewater
				services to small or medium-sized communities that provides technical
				assistance (including circuit rider, multi-State regional assistance programs,
				and training and preliminary engineering evaluations) to owners and operators
				of small treatment works or medium treatment works that may include State
				agencies.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2700999643964d1dbf6159eb41f37e28"><enum>(4)</enum><header display-inline="yes-display-inline">Small treatment works</header><text display-inline="yes-display-inline">The term <term>small treatment works</term>
				means a publicly owned treatment works serving not more than 10,000
				individuals.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID85bd8016d23e4365b9b38054a2f62ea3"><enum>(b)</enum><header display-inline="yes-display-inline">Grant program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID1a4a03a613904905872ff3895fd44578"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may make grants on a
				competitive basis to qualified nonprofit technical assistance providers that
				are qualified to provide assistance on a broad range of wastewater and
				stormwater approaches—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID90d8da21362a410a8cb641d3efb06ec3"><enum>(A)</enum><text display-inline="yes-display-inline">to assist owners and operators of small
				treatment works and medium treatment works to plan, develop, and obtain
				financing for eligible projects described in section 603(c) or 518(c);</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6d18196463d1478ea1609c39e9a63ca9"><enum>(B)</enum><text display-inline="yes-display-inline">to provide financial assistance, in
				consultation with the State in which the assistance is provided, to owners and
				operators of small treatment works and medium treatment works for
				predevelopment costs (including costs for planning, design, and associated
				preconstruction activities, such as activities relating directly to the siting
				of the facility and related elements) associated with stormwater or wastewater
				infrastructure projects or short-term costs incurred for equipment replacement
				that is not part of regular operation and maintenance activities for existing
				stormwater or wastewater systems, if the amount of assistance for any single
				project does not exceed $50,000;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbce32609a67c4f659b645439f4876126"><enum>(C)</enum><text display-inline="yes-display-inline">to provide technical assistance and
				training for owners and operators of small treatment works and medium treatment
				works to enable those treatment works and systems to protect water quality and
				achieve and maintain compliance with this Act; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4a99e2a924ed41818a5799d0a0a7354f"><enum>(D)</enum><text display-inline="yes-display-inline">to disseminate information to owners and
				operators of small treatment works and medium treatment works, with respect to
				planning, design, construction, and operation of treatment works, small
				municipal separate storm sewer systems, and decentralized wastewater treatment
				systems.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0186ad668ab042948fbac1cf3984d327"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution of grant</header><text display-inline="yes-display-inline">In carrying out this subsection, the
				Administrator shall ensure, to the maximum extent practicable, that technical
				assistance provided using funds from a grant under paragraph (1) is made
				available in each State.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7e8ef0b34436400db27b0fa3db8b5583"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">As a condition of receiving a grant under
				this subsection, a qualified nonprofit technical assistance provider shall
				agree to consult with each State in which grant funds are to be expended before
				the grant funds are expended in the State.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd28a08d0d37f44e89e164ec4feb865a0"><enum>(4)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than 60 days after the end of
				each fiscal year, a qualified nonprofit technical assistance provider that
				receives a grant under this subsection shall submit to the Administrator a
				report that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDf00556ff1090432e89a300c8ff62402e"><enum>(A)</enum><text display-inline="yes-display-inline">describes the activities of the qualified
				nonprofit technical assistance provider using grant funds received under this
				subsection for the fiscal year; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDee4474fe0b884a40bb87d1a24ff9ee3e"><enum>(B)</enum><text display-inline="yes-display-inline">specifies—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID8ec988f4bfe2454d9d4c744cb21d4539"><enum>(i)</enum><text display-inline="yes-display-inline">the number of communities served;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDc1807f7ff1a640f1bbd45e2e2201a34e"><enum>(ii)</enum><text display-inline="yes-display-inline">the sizes of those communities; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDa8e04a532779458aa36a86b06d770ff6"><enum>(iii)</enum><text display-inline="yes-display-inline">the type of assistance provided by the
				qualified nonprofit technical assistance provider.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb175192b57654171a3950eacaee76f1f"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idF7D38E49382B4ACB98F45F8D93FB56CF"><enum>(1)</enum><text display-inline="yes-display-inline">for grants for small treatment works,
				$25,000,000 for each of fiscal years 2009 through 2013; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67d0943ea8c5491580e59ea8aec53af7"><enum>(2)</enum><text display-inline="yes-display-inline">for grants for medium treatment works,
				$15,000,000 for each of fiscal years 2009 through
				2013.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa4cdc4a3f1264a8f87873016e3cc9c5e"><enum>(b)</enum><header display-inline="yes-display-inline">Guidance for small systems</header><text display-inline="yes-display-inline">Section 602 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1382) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id1DD64BD562D446B8A451AC5166C121D6" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID9b130a2546f0403bb692367edd6421a8"><enum>(c)</enum><header display-inline="yes-display-inline">Guidance for small systems</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8a6a855e4bd14808bb64cfb63fbaa75f"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of small system</header><text display-inline="yes-display-inline">In this subsection, the term <term>small
				system</term> means a system—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID2192bceea50c42ae87d869eba08b81ef"><enum>(A)</enum><text display-inline="yes-display-inline">for which a municipality or intermunicipal,
				interstate, or State agency seeks assistance under this title; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf78b96d798964906a6c8964a8c6ed4d9"><enum>(B)</enum><text display-inline="yes-display-inline">that serves a population of not more than
				10,000 individuals.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3abb06843dd84472b2e72136fd3ed5da"><enum>(2)</enum><header display-inline="yes-display-inline">Simplified procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this subsection, the Administrator shall assist the States in
				establishing simplified procedures for small systems to obtain assistance under
				this title.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc95b9720f291410eba2390328efcba72"><enum>(3)</enum><header display-inline="yes-display-inline">Publication of manual</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this subsection, after providing notice and opportunity for public
				comment, the Administrator shall publish—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID85de0b9622f84211af913fed046bbe01"><enum>(A)</enum><text display-inline="yes-display-inline">a manual to assist small systems in
				obtaining assistance under this title; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID718246972b7f4c3485b240863a0ae566"><enum>(B)</enum><text display-inline="yes-display-inline">in the Federal Register, notice of the
				availability of the
				manual.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1e4bfced16134d39820660b65a392fa3" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Projects eligible for
			 assistance</header><text display-inline="no-display-inline">Section 603 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1383) is amended by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD92C6C60A9EF4DD4B675CB0DA0FBA292" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idAA6FCA9451144814A4955FB8944EA951"><enum>(c)</enum><header display-inline="yes-display-inline">Projects eligible for
				assistance</header><text display-inline="yes-display-inline">Funds in each
				State water pollution control revolving fund shall be used only by a
				municipality or an intermunicipal, interstate, or State agency (or, for the
				purpose of paragraph (1), by either of those entities or a private treatment
				works or decentralized wastewater system that principally treats municipal
				wastewater or domestic sewage)—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idD1CC56CD86894EAD9DECEF66D1479892"><enum>(1)</enum><text display-inline="yes-display-inline">to provide financial assistance for
				construction activities (including expansion to meet needs of existing
				development), including planning, design, associated preconstruction planning
				activities (as defined in section 212) and implementation measures to control,
				manage, reduce, treat, infiltrate, or reuse municipal stormwater, the primary
				purpose of which is the protection, preservation, or enhancement of water
				quality to support public purposes (including the procurement and use of
				equipment to support minimum measures, such as street sweeping and storm drain
				system cleaning, and acquisition of other land and interests in land to meet
				the needs of existing development that are necessary for those activities and
				measures);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5B518D7CC9C34D54B8806C6DE4862267"><enum>(2)</enum><text display-inline="yes-display-inline">to implement a management program
				established under section 319;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95C83599F0FB40E2AE5AE64D7C28D2B3"><enum>(3)</enum><text display-inline="yes-display-inline">to develop and implement a conservation and
				management plan under section 320;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D93F0452BEF4704B5774654B4FC42FC"><enum>(4)</enum><text display-inline="yes-display-inline">to increase the security of wastewater
				treatment works (excluding any expenditure for operations or
				maintenance);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17C5E7F1C6D84BE087699B58F4C5DD02"><enum>(5)</enum><text display-inline="yes-display-inline">to carry out water conservation or
				efficiency projects, the primary purpose of which is the protection,
				preservation, or enhancement of water quality to support public
				purposes;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0DC9EF50ECD45CDA5FAB775152531A7"><enum>(6)</enum><text display-inline="yes-display-inline">to implement measures to integrate water
				resource management planning and implementation;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50C20FCC161F4B12A95F2F915CFE5288"><enum>(7)</enum><text display-inline="yes-display-inline">to carry out water and wastewater reuse,
				reclamation, and recycling projects, the primary purpose of which is the
				protection, preservation, or enhancement of water quality to support public
				purposes; and</text>

				<subsection commented="no" display-inline="no-display-inline" id="ID1373fe5e687f46d58ed7bf75d2bc88de"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID7fc0a26ed7f14122af42a464a6c7961a"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (e) through
			 (h) as subsections (g) through (j), respectively;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb2d49f1c65924457a943edfe7dc759ea"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>

								</subparagraph><paragraph commented="no" display-inline="no-display-inline" id="idF507894DDE964C1BAE2EACD0DC5D57E0"><enum>(8)</enum><text display-inline="yes-display-inline">as a source of revenue (restricted solely
				to interest earnings of the fund) or security for payment of the principal and
				interest on revenue or general obligation bonds issued by the State to provide
				matching funds under section 602(b)(2), if the proceeds of the sale of the
				bonds will be deposited in the fund.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb45d741e82a44015aaa37951448ec4c8"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id85898A0BB22945F9A7DEA9E2AB145E94" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="ID4c61fe362b9f47e19d6295abbc614732"><enum>(e)</enum><header display-inline="yes-display-inline">Additional assistance for disadvantaged
				communities</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID13e6e7a7e059464cba1a6f42ceb6448d"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of disadvantaged
				community</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>disadvantaged community</term> means a community with a service
				area, or portion of a service area, of a treatment works that meets
				affordability criteria established after public review and comment by the State
				in which the treatment works is located.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6631c2c21534406e912cf53061b23224"><enum>(2)</enum><header display-inline="yes-display-inline">Loan subsidy</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, in a case in which the State makes a loan from the water pollution
				control revolving loan fund in accordance with subsection (c) to a
				disadvantaged community or a community that the State expects to become a
				disadvantaged community as the result of a proposed project, the State may
				provide additional subsidization, including—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDd36bd2104ba44650a225c075007e5a7c"><enum>(A)</enum><text display-inline="yes-display-inline">the forgiveness of all or a portion of the
				principal of the loan; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDabd42bc95f524e699d09c9556243c4ed"><enum>(B)</enum><text display-inline="yes-display-inline">a negative interest rate on the
				loan.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34aa6970dab0491c9343170f706d9f0c"><enum>(3)</enum><header display-inline="yes-display-inline">Total amount of subsidies</header><text display-inline="yes-display-inline">For each fiscal year, the total amount of
				loan subsidies made by the State pursuant to this subsection may not exceed 30
				percent of the amount of the capitalization grant received by the State for the
				fiscal year.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c06733b9d724576ab19cc89fd036d11"><enum>(4)</enum><header display-inline="yes-display-inline">Information</header><text display-inline="yes-display-inline">The Administrator may publish information
				to assist States in establishing affordability criteria described in paragraph
				(1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5fbfd9793fb947f997b015474a9a6de1"><enum>(f)</enum><header display-inline="yes-display-inline">Cost-saving water treatment and efficiency
				improvements</header><text display-inline="yes-display-inline">Subject to
				subsection (e)(3), in providing a loan for a project under this section, a
				State may forgive repayment of such portion of the loan amount, not to exceed 5
				percent, as is equal to the percentage of the project that is devoted to
				alternative approaches to wastewater and stormwater controls (including
				nonstructural methods) such as projects that treat or minimize sewage or urban
				stormwater discharges using—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDfafca122886040e5ae318347bdcb506f"><enum>(1)</enum><text display-inline="yes-display-inline">decentralized or distributed stormwater
				controls;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1fb52bcc821a4f289e633300c324d295"><enum>(2)</enum><text display-inline="yes-display-inline">decentralized wastewater treatment;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4343a2a30c4e4a6b9451034e3a276ce8"><enum>(3)</enum><text display-inline="yes-display-inline">low-impact development technologies and
				nonstructural approaches;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb7eb962e5f184052b90ff769e30b7404"><enum>(4)</enum><text display-inline="yes-display-inline">stream buffers;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06fd4da1c12a4001bef34b7b8360124a"><enum>(5)</enum><text display-inline="yes-display-inline">wetland restoration and enhancement;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8a8d868a19e242c68c00adb27a66301e"><enum>(6)</enum><text display-inline="yes-display-inline">actions to minimize the quantity of and
				direct connections to impervious surfaces;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1c42459e5abd4d77947d9bd0c0fefafa"><enum>(7)</enum><text display-inline="yes-display-inline">soil and vegetation, or other permeable
				materials;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0afdf97922564123b0953e138e041485"><enum>(8)</enum><text display-inline="yes-display-inline">actions that increase efficient water use,
				water conservation, or water
				reuse.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID26432e10273e418b98c282defe619c91"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming Amendment</header><text display-inline="yes-display-inline">Section 221(d) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1301(d)) is amended in the second sentence by
			 striking <quote>603(h)</quote> and inserting <quote>603(j)</quote>.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID7c4f909ab15d44d48c66a8d3d163e8c9" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Water pollution control revolving loan
			 funds</header><text display-inline="no-display-inline">Section 603 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1383) is amended by striking
			 subsection (i) (as redesignated by section 103(a)(1)) and inserting the
			 following:</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDaf810c367c444ee3a279a96bab3bff3e"><enum>(A)</enum><header display-inline="yes-display-inline">Restructuring</header><text display-inline="yes-display-inline">The term <term>restructuring</term>
				means—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID1a4bb8c517e34864adf0298e88d1f31d"><enum>(i)</enum><text display-inline="yes-display-inline">the consolidation of management functions
				or ownership with another facility; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDe9dd259cf75b453aa99d96fa9d8f1c8f"><enum>(ii)</enum><text display-inline="yes-display-inline">the formation of cooperative
				partnerships.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDab021ea2237c46aa9773b96563596af4"><enum>(B)</enum><header display-inline="yes-display-inline">Traditional wastewater
				approach</header><text display-inline="yes-display-inline">The term
				<term>traditional wastewater approach</term> means a managed system used to
				collect and treat wastewater from an entire service area consisting of—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID146d7395ce10404db38184967e56b1c0"><enum>(i)</enum><text display-inline="yes-display-inline">collection sewers;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID2fd4e5fa15f141f9b8e87987ed4ab55c"><enum>(ii)</enum><text display-inline="yes-display-inline">a centralized treatment plant using
				biological, physical, or chemical treatment processes; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID55d468ec26e2406db78381fa5b6720a8"><enum>(iii)</enum><text display-inline="yes-display-inline">a direct point source discharge to surface
				water.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd618629533dd4d1c91106ac36bc05f5c"><enum>(2)</enum><header display-inline="yes-display-inline">Priority system</header><text display-inline="yes-display-inline">In providing financial assistance from the
				water pollution control revolving fund of the State, the State shall establish
				a priority system that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID7dba08929bee4de29b2dfb9e4fccc806"><enum>(A)</enum><text display-inline="yes-display-inline">gives greater weight to an application for
				assistance by the owner or operator of a treatment works if the application
				includes—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID2af4bb71b6904c6087074ae8378654c5"><enum>(i)</enum><text display-inline="yes-display-inline">an inventory of assets, including a
				description of the condition of those assets;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID354a83eb54124cd5b21c38e3689b4096"><enum>(ii)</enum><text display-inline="yes-display-inline">a schedule for replacement of the
				assets;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDc3383d6cc6fc41bfbf20a8dc94e8bfa4"><enum>(iii)</enum><text display-inline="yes-display-inline">a financing plan that factors in all
				lifecycle costs indicating sources of revenue from ratepayers, grants, bonds,
				other loans, and other sources to meet the costs;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDd2b344ef36bb4777b2b2dd43d0724716"><enum>(iv)</enum><text display-inline="yes-display-inline">a review of options for restructuring the
				treatment works; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID767254ff1e884832a561c961c6901245"><enum>(v)</enum><text display-inline="yes-display-inline">approaches other than a traditional
				wastewater approach that treat or minimize sewage or urban stormwater
				discharges using—</text>
									<subclause commented="no" display-inline="no-display-inline" id="IDcaabb661d0734493bfe4f185505fa8a0"><enum>(I)</enum><text display-inline="yes-display-inline">decentralized or distributed stormwater
				controls;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID88d861a3cc1f482bb307480901e0edcf"><enum>(II)</enum><text display-inline="yes-display-inline">decentralized wastewater treatment;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2be0a530cd5a4405a2e5a750191b3ad5"><enum>(III)</enum><text display-inline="yes-display-inline">low-impact development technologies and
				nonstructural approaches;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDcfbe64fb442449d58a508195fdb8e03c"><enum>(IV)</enum><text display-inline="yes-display-inline">stream buffers;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5df0f2ff79354568aef692b95b964a42"><enum>(V)</enum><text display-inline="yes-display-inline">wetland restoration and enhancement;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0c5a3c79e5b140c894002ad3247e9217"><enum>(VI)</enum><text display-inline="yes-display-inline">actions to minimize the quantity of and
				direct connections to impervious surfaces;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2bc3960af4cf43b29889d6cf79e7b533"><enum>(VII)</enum><text display-inline="yes-display-inline">soil and vegetation, or other permeable
				materials; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDb779d8006ea247a6a4e24396dd884e13"><enum>(VIII)</enum><text display-inline="yes-display-inline">actions that increase efficient water use,
				water conservation, or water reuse;</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID2256bc25371a415aae2d6ccf81f26318"><enum>(vi)</enum><text display-inline="yes-display-inline">a demonstration of consistency with State,
				regional, and municipal watershed plans, water conservation and efficiency
				plans, or integrated water resource management plans;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDac8e092548794fddac72c3a49b2825eb"><enum>(vii)</enum><text display-inline="yes-display-inline">a proposal by the applicant demonstrating
				flexibility through alternative means to carry out responsibilities under
				Federal regulations, that may include watershed permitting and other innovative
				management approaches, while achieving results that—</text>
									<subclause commented="no" display-inline="no-display-inline" id="IDc61ebb685dd8404797535ebdb5e96941"><enum>(I)</enum><text display-inline="yes-display-inline">the State, in the case of a permit program
				approved under section 402, determines will meet permit requirements; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa7555d1ffb4641009912d9fa1bcf7d59"><enum>(II)</enum><text display-inline="yes-display-inline">the Administrator determines are measurably
				superior when compared to regulatory standards;</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID89f4d267c4b4413088d2b5c46b65961f"><enum>(B)</enum><text display-inline="yes-display-inline">takes into consideration appropriate
				chemical, physical, and biological data relating to water quality that the
				State considers reasonably available and of sufficient quality;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID99e2bc4d92134f36a861437a33888b4f"><enum>(C)</enum><text display-inline="yes-display-inline">provides for public notice and opportunity
				to comment on the establishment of the priority system and the summary under
				subparagraph (D);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3b180867d52140f4bc430d69b655a58b"><enum>(D)</enum><text display-inline="yes-display-inline">provides for the publication, not less than
				biennially in summary form, of a description of projects in the State that are
				eligible for assistance under this title that indicates—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID9297a1e357b749fba923816cde202317"><enum>(i)</enum><text display-inline="yes-display-inline">the priority assigned to each project under
				the priority system of the State; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDa1d0fc036bc94fd4b39845d2e50b9c19"><enum>(ii)</enum><text display-inline="yes-display-inline">the funding schedule for each project, to
				that extent the information is available; and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd44ce1031e96410b8a31bb86baae9b5d"><enum>(E)</enum><text display-inline="yes-display-inline">ensures that projects undertaken with
				assistance under this title are designed to achieve, as determined by the
				State, the optimum water quality management, consistent with the public health
				and water quality goals and requirements of this
				Act.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="IDbc485661389a40bc977e8fbb5c1a7bd6" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Transferability of funds</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) (as amended by section 103(a)(1)) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA7C1636DF46D429FB89C0250AF726553" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID5124d7150f5a417bb765c34bb4e96710"><enum>(k)</enum><header display-inline="yes-display-inline">Transfer of funds</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID749a6d1acd3a43d384d54e0dce34fbcf"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Governor of a State may—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID82f239e99ebf4905b09299a07373bdff"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id7886095475B14CE481F56293ECF1404B"><enum>(i)</enum><text display-inline="yes-display-inline">reserve not more than 33 percent of a
				capitalization grant made under this title; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id74D877B17A6D4720BFE6AF3CB8B09FAF" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">add the funds reserved to any funds
				provided to the State under section 1452 of the Safe Drinking Water Act (42
				U.S.C. 300j–12); and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6b86f060bb14e52bbc2af60dc52b192"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id17F584DDF4AE458C92E34FA4C3D8B254"><enum>(i)</enum><text display-inline="yes-display-inline">reserve for any year an amount that does
				not exceed the amount that may be reserved under subparagraph (A) for that year
				from capitalization grants made under section 1452 of that Act (42 U.S.C.
				300j–12); and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idC88C956788F1486FB0C8537FFFDC3703" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">add the reserved funds to any funds
				provided to the State under this title.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfac179a605c348aaabcefeb59716104d"><enum>(2)</enum><header display-inline="yes-display-inline">State match</header><text display-inline="yes-display-inline">Funds reserved under this subsection shall
				not be considered to be a State contribution for a capitalization grant
				required under this title or section 1452(b) of the Safe Drinking Water Act (42
				U.S.C.
				300j–12(b)).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="IDa7156d963f964c58bd5d7947226360d6" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Noncompliance</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) (as amended by section 105) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8D46DE09147C4F38A4A991C896EF4F12" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID5c8ae0132765421ea45bc34e254a4160"><enum>(l)</enum><header display-inline="yes-display-inline">Noncompliance</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID08807cf4f5924b50b9310935bd72061f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), no
				assistance (other than assistance that is to be used by a treatment works
				solely for planning, design, or security purposes) shall be provided under this
				title to the owner or operator of a treatment works that has been in
				significant noncompliance with any requirement of this Act for any of the 4
				quarters during the preceding 8 quarters, unless the treatment works is in
				compliance with an enforceable administrative order to effect compliance with
				the requirement.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9baedfa0ed8423dbbc3fd6adc19cd26"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">An owner or operator of a treatment works
				that is determined under paragraph (1) to be in significant noncompliance with
				a requirement described in that paragraph may receive assistance under this
				title if the Administrator and the State providing the assistance determine
				that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID90e7d5d23654411e82f2c27d6b91a456"><enum>(A)</enum><text display-inline="yes-display-inline">the entity conducting the enforcement
				action on which the determination of significant noncompliance is based has
				determined that the use of assistance would enable the owner or operator of the
				treatment works to take corrective action toward resolving the violations;
				or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe07122bbc97a4c77b87964ea75c4d64f"><enum>(B)</enum><text display-inline="yes-display-inline">the entity conducting the enforcement
				action on which the determination of significant noncompliance is based has
				determined that the assistance would be used by the owner or operator of the
				treatment works in order to assist owners and operators in making progress
				towards
				compliance.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="ID8b5d17c6c6c5409bbd499d64b5e0fb2b" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Negotiation of contracts</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) (as amended by section 106) is amended by adding
			 at the end the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id4B5E95FE6652425A82AA8D975CAEC986"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A contract to be carried out using funds
				directly made available by a capitalization grant under this section for
				program management, construction management, feasibility studies, preliminary
				engineering, design, engineering, surveying, mapping, or architectural or
				related services shall be negotiated in the same manner as—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idBD5ED4F535F84596A406656E2CBCD63D"><enum>(A)</enum><text display-inline="yes-display-inline">a contract for architectural and
				engineering services is negotiated under chapter 11 of title 40, United States
				Code; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D3D93F6924A4A8196EB03BBB1C39063"><enum>(B)</enum><text display-inline="yes-display-inline">an equivalent State qualifications-based
				requirement (as determined by the Governor of the State).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DCAD10682A34F1A9DC9DDB8EFA57568"><enum>(2)</enum><header display-inline="yes-display-inline">Exemption for small
				communities</header><text display-inline="yes-display-inline">Paragraph (1)
				shall not apply to a contract described in that paragraph for program
				management, construction management, feasibility studies, preliminary

				related services for a community of 10,000 or fewer

			 Control Act (33 U.S.C. 1384) is amended by striking subsection (b) and
			 inserting the following:</text>

				<subsection commented="no" display-inline="no-display-inline" id="ID0d8938d2326d47a6b6fd60b0b46df7ac"><enum>(a)</enum><header display-inline="yes-display-inline">Sewer Overflow Control Grants</header><text display-inline="yes-display-inline">Section 221 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1301) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf2892981792e46509f1b742f0ef8f963"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote><header-in-text level="subsection" style="OLC">In
			 general</header-in-text></quote> and all that follows through <quote>(2)
			 subject to subsection (g), the Administrator may</quote> and inserting the

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7612EB8BA954A86BD655CD7574A1D22"><enum>(2)</enum><header display-inline="yes-display-inline">Determination of Governor</header><text display-inline="yes-display-inline">The requirement described in paragraph (1)
				shall not apply to a project that receives grant assistance under subsection
				(a) to the extent that the Governor of the State in which the project is
				located determines that a requirement described in title VI is inconsistent
				with the purposes of this section.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9a0208b0ff7a4bdc8fd603a2285f4d24"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section, to remain available
				until expended—</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id908F4474518649A79D174DCCEC1F1DB6"><enum>(g)</enum><header display-inline="yes-display-inline">Allocation of Funds</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID6d6ff457fb5e403595781a1b2590de3c"><enum>(1)</enum><header display-inline="yes-display-inline">Fiscal year 2008 and 2009</header><text display-inline="yes-display-inline">For each of fiscal years 2008 and 2009,
				subject to subsection (h), the Administrator shall use the amounts made
				available to carry out this section to provide grants to municipalities and
				municipal entities under subsection (a)(2)—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id52E5B4E884354FF19DA830B50E6AACF1"><enum>(A)</enum><text display-inline="yes-display-inline">in accordance with the priority criteria
				described in subsection (b); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4A6DB7A7DFAF4EB8A7FF70812FB5F477"><enum>(B)</enum><text display-inline="yes-display-inline">with additional priority given to proposed
				projects that involve the use of—</text>
										<clause commented="no" display-inline="no-display-inline" id="idE9E4079327F7483E8EB175817F682767"><enum>(i)</enum><text display-inline="yes-display-inline">nonstructural, low-impact
				development;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id7CD4C76EEFAC42BBA4C82B71B8EF9AA1"><enum>(ii)</enum><text display-inline="yes-display-inline">water conservation, efficiency, or reuse;
				or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id956761017A0848D6929C36D7DB6AD152"><enum>(iii)</enum><text display-inline="yes-display-inline">other decentralized stormwater or
				wastewater approaches to minimize flows into the sewer systems.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID082fd9a2287c4017a4cc36b812463e4b"><enum>(2)</enum><header display-inline="yes-display-inline">Fiscal year 2010 and
				thereafter</header><text display-inline="yes-display-inline">For fiscal year
				2010 and each fiscal year thereafter, subject to subsection (h), the
				Administrator shall use the amounts made available to carry out this section to
				provide grants to States under subsection (a)(1) in accordance with a formula
				that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID64067679f2474dff96ee85c38426e4eb"><enum>(A)</enum><text display-inline="yes-display-inline">shall be established by the Administrator,
				after providing notice and an opportunity for public comment; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6694f2fbbfe74588a2039dcaab3c1d0f"><enum>(B)</enum><text display-inline="yes-display-inline">allocates to each State a proportional
				share of the amounts based on the total needs of the State for municipal
				combined sewer overflow controls and sanitary sewer overflow controls, as
				identified in the most recent survey—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID69f6b3858cf74d51b988bea926fb8837"><enum>(i)</enum><text display-inline="yes-display-inline">conducted under section 210; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID49bfd9b21bae4473a327602ba9aac4ac"><enum>(ii)</enum><text display-inline="yes-display-inline">included in a report required under section
				516(b)(1)(B).</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID136e3746bd92457ca17f9a366020e432"><enum>(b)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Section 221(i) of the Federal Water

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id58D75521451149F797E7FB57C3829067" section-type="subsequent-section"><enum>111.</enum><header display-inline="yes-display-inline">Capitalization grant
			 agreements</header><text display-inline="no-display-inline">Section 602(b) of
			 the Federal Water Pollution Control Act (33 U.S.C. 1382(b)) is amended by
			 striking paragraph (6) and inserting the following:</text>

				603(c) that are constructed, in whole or in part, using funds made available by
				a State loan fund under this title shall meet the requirements of section 513
				in the same manner as treatment works constructed using assistance provided
				under title
				II;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="ID03822dfede984c0f8f8087e809986b6f" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Critical water infrastructure
			 projects</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDdad94aea304a4606989d792151616fad"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency (referred to in this section as the
			 <term>Administrator</term>) shall establish a program under which grants are
			 provided to eligible entities for use in carrying out projects and activities
			 the primary purpose of which is watershed restoration through the protection or
			 improvement of water quality.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5448ebdb38fa4df5943462fa7d50a9d6"><enum>(b)</enum><header display-inline="yes-display-inline">Project selection</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID4d543c3f715141a794d40883ba7d67ea"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may provide funds under
			 this section to an eligible entity to carry out an eligible project described
			 in paragraph (3).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf1dad441e8664bcb833fa027a00622da"><enum>(2)</enum><header display-inline="yes-display-inline">Equitable distribution</header><text display-inline="yes-display-inline">The Administrator shall ensure an equitable
			 distribution of projects under this section, taking into account cost and
			 number of requests for each category listed in paragraph (3).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5c4cd4ad1c21407db9340e40b543ba05"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible projects</header><text display-inline="yes-display-inline">A project that is eligible to be carried
			 out using funds provided under this section may include projects that are
			 included in the intended use plan of the State developed in accordance with
			 section 606(c) of the Federal Water Pollution Control Act (33 U.S.C.
			 1386(c)).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb261e3f44b3942b5a40ba5d3cbc63c71"><enum>(c)</enum><header display-inline="yes-display-inline">Local Participation</header><text display-inline="yes-display-inline">In prioritizing projects for implementation
			 under this section, the Administrator shall consult with, and consider the
			 priorities of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID4e078b7cb6c5472e922c5653592802f5"><enum>(1)</enum><text display-inline="yes-display-inline">affected State and local governments;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8694e5048f974442a29621793ebd94c4"><enum>(2)</enum><text display-inline="yes-display-inline">public and private entities that are active
			 in watershed planning and restoration.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID11f8a50b05ab4ed492a61445c83a0b2d"><enum>(d)</enum><header display-inline="yes-display-inline">Cost Sharing</header><text display-inline="yes-display-inline">Before carrying out any project under this
			 section, the Administrator shall enter into an agreement with 1 or more
			 non-Federal interests that shall require the non-Federal interests—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDe6b400bec46647db90cd08484dbb2257"><enum>(1)</enum><text display-inline="yes-display-inline">to pay 45 percent of the total costs of the
			 project, which may include services, materials, supplies, or other in-kind
			 contributions;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb3a0db31b6cc49c889e94168ea0f81ad"><enum>(2)</enum><text display-inline="yes-display-inline">to provide any land, easements,
			 rights-of-way, and relocations necessary to carry out the project; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58a2b9a393124a3b9351df296a07bda0"><enum>(3)</enum><text display-inline="yes-display-inline">to pay 100 percent of any operation,
			 maintenance, repair, replacement, and rehabilitation costs associated with the
			 project.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd637b9e4048d4369b98b8f0d2632aacc"><enum>(e)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Administrator may waive the requirement
			 to pay the non-Federal share of the cost of carrying out an eligible activity
			 using funds from a grant provided under this section if the Administrator
			 determines that an eligible entity is unable to pay, or would experience
			 significant financial hardship if required to pay, the non-Federal
			 share.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd328fa14375b477a92112bb7d6de7921"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $50,000,000 for each of
			 fiscal years 2008 through 2012.</text>
				</subsection></section></title><title commented="no" id="idC7355108BF634F45ACD173A8C2B3D808" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Safe drinking water infrastructure</header>
			<section commented="no" display-inline="no-display-inline" id="ID046bdc480a6241bc815450de7a098185" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Contaminant prevention, detection, and
			 response</header><text display-inline="no-display-inline">Section 1434 of the
			 Safe Drinking Water Act (42 U.S.C. 300i–3) is amended by striking subsection
			 (b) and inserting the following:</text>

				enactment of the Water Infrastructure Financing Act, the Administrator shall
				submit to Congress a report that includes—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDf0b6d637fecb4bb1897433cbeca3896c"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the progress made as of
				that date in implementing this section; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0bfa9dbe7c09492ba6cc227a6925b8f8"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any impediments to that
				implementation identified by the Administrator, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5faa110117054f8799a7f61fd2c7af03"><enum>(A)</enum><text display-inline="yes-display-inline">difficulty in coordinating the
				implementation with other Federal, State, or local agencies or
				organizations;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77fc7ec879ae4c4abe321c4f53c191fa"><enum>(B)</enum><text display-inline="yes-display-inline">insufficient funding for effective
				implementation;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6448131735d046b88b69b9cf4a9f871d"><enum>(C)</enum><text display-inline="yes-display-inline">a lack of authorization to take certain
				actions (including the authority to hire necessary personnel) required to carry
				out the implementation; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2a9cb5dab27d405a9770238581c981b6"><enum>(D)</enum><text display-inline="yes-display-inline">technological impediments to developing the
				methods, means, and equipment specified in subsection (a)(1).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe5d6be809ee54401a9adcf791ccd4279"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation Plan</header><text display-inline="yes-display-inline">The Administrator shall develop and carry
				out an implementation plan for this section consistent with actions taken to
				date and incorporating the results of the report under subsection (b).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID878a3e2815e5422497dc40456e9f6899"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There is authorized to be appropriated to
				carry out this section $7,500,000 for each of fiscal years 2008 through
				2012.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="idF02D67DAA4964CD38278CB3B34069562" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Drinking water technical assistance for
			 communities</header><text display-inline="no-display-inline">Section 1442(e) of
			 the Safe Drinking Water Act (42 U.S.C. 300j–1(e)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID353803ebdde4463d968781dce9499667"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking

				Administrator shall give priority to small systems organizations that, as
				determined by the Administrator, are qualified and will be the most effective
				at assisting those small systems that have the greatest need (or a majority of
				need) in the States.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8703FB43F7574A589D1F91E48B1C30BD"><enum>(6)</enum><header display-inline="yes-display-inline">Wells and well systems</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id708EF96DF86A4D7285C7E012876700A0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall provide grants to
				nonprofit organizations to provide technical assistance to communities and
				individuals regarding the design, operation, construction, and maintenance of
				household wells and small shared well-systems that provide drinking
				water.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCDBC800969AC442FBB4E1366789B7825"><enum>(B)</enum><header display-inline="yes-display-inline">Form of assistance</header><text display-inline="yes-display-inline">Technical assistance referred to in
				subparagraph (A) may include—</text>
								<clause commented="no" display-inline="no-display-inline" id="idBF949013F5184B89826F8086F52B944C"><enum>(i)</enum><text display-inline="yes-display-inline">training and education;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idD552DD0162A348218C33F4574135DF92"><enum>(ii)</enum><text display-inline="yes-display-inline">operation of a hotline; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id3D941E3FF92B4A8684B4E1084F4359E7"><enum>(iii)</enum><text display-inline="yes-display-inline">the conduct of other activities relating to
				the design and construction of household, shared, and small water well systems
				in rural areas.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4856AC85C01F4DD7989379E3DCD0FB2F"><enum>(C)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">Subject to paragraph (5), in providing
				grants under this section, the Administrator shall give priority to applicants
				that, as determined by the Administrator—</text>
								<clause commented="no" display-inline="no-display-inline" id="id33BD5C90F4D446199A31362711DBCD4F"><enum>(i)</enum><text display-inline="yes-display-inline">are qualified; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idFAFA3209528C4CC5AB8FCC6FA42E8B78"><enum>(ii)</enum><text display-inline="yes-display-inline">have demonstrated experience in providing
				similar technical assistance and in developing similar projects.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0607EF027AF1409AA39AB5EE24E0882E"><enum>(D)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this paragraph $7,500,000 for each
				of fiscal years 2009 through 2013.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97DFE72A60B94E178D7ABA9D064D5AB9"><enum>(7)</enum><header display-inline="yes-display-inline">Funding</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA2E1EF744606421BA9E87EE967CF676C"><enum>(A)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Administrator to carry out this subsection
				(other than paragraph (6)) $35,000,000 for each of fiscal years 2009 through
				2013.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCDF8F081261348EC9FD1EAC68B5230EB"><enum>(B)</enum><header display-inline="yes-display-inline">Lobbying expenses</header><text display-inline="yes-display-inline">No portion of any State loan fund
				established under section 1452 and no portion of any funds made available under
				this subsection may be used for lobbying expenses.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3EE4D09B3A9845D4A162285E7D71B4B8"><enum>(C)</enum><header display-inline="yes-display-inline">Indian Tribes</header><text display-inline="yes-display-inline">Of the total amount made available under
				this section for each fiscal year, 3 percent shall be used for technical
				assistance to public water systems owned or operated by Indian
				Tribes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idACEFA1733D1C47948673483CA08C81A9" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Preservation of employee labor
			 standards</header><text display-inline="no-display-inline">Section 1450 of the
			 Safe Drinking Water Act (42 U.S.C. 300j–9) is amended by striking subsection
			 (e) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0C164C7EC2C64FDF8F6549DE3C661C31" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="IDb13c468250e240538158864c9ea6ac27"><enum>(e)</enum><header display-inline="yes-display-inline">Labor standards</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID4ad615c9fc0f41faaf0a3458a12d370a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall take such action as
				the Administrator determines to be necessary to ensure that each laborer and
				mechanic employed by a contractor or subcontractor of a construction project
				financed, in whole or in part, by a grant, loan, loan guarantee, refinancing,
				or any other form of financial assistance provided under this Act (including
				assistance provided by a State loan fund established under section 1452) is
				paid wages at a rate of not less than the wages prevailing for the same type of
				work on similar construction in the immediate locality, as determined by the
				Secretary of Labor in accordance with subchapter IV of chapter 31 of title 40,
				United States Code.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE91430FE0824C2CB2062B54852298D3"><enum>(2)</enum><header display-inline="yes-display-inline">Authority of Secretary of
				Labor</header><text display-inline="yes-display-inline">With respect to the
				labor standards specified in this subsection, the Secretary of Labor shall have
				the authority and functions established in Reorganization Plan Numbered 14 of
				1950 (5 U.S.C. App.) and section 3145 of title 40, United States
				Code.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="ID114d517118494dcdaa2f36ca31f3b7a8" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Preconstruction work</header><text display-inline="no-display-inline">Section 1452(a)(2) of the Safe Drinking
			 Water Act (42 U.S.C. 300j–12(a)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7736279622D64AF7BB6372439FDD9282"><enum>(1)</enum><text display-inline="yes-display-inline">by designating the first, second, third,
			 fourth, and fifth sentences as subparagraphs (A), (B), (D), (E), and (F),
			 respectively;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBE2DDC0AA0E4EEF97F49028BEAEDE5D"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B) (as designated by
			 paragraph (1))—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDbb3ac41e146049a7b05f407c62eea6e6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(not</quote> and
			 inserting <quote>(including expenditures for planning, design, and associated
			 preconstruction activities, including activities relating to the siting of the
			 facility, but not</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID313789d70a7f4028a3cfdf0a7fe2a699"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before the period at the end
			 the following: <quote>or to replace or rehabilitate aging treatment, storage
			 (including reservoirs), or distribution facilities of public water systems or
			 provide for capital projects to upgrade the security of public water
			 systems</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD24DE9F77AA04CB4B215E409EA76C293"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (B) (as
			 designated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC9EE39DA560E485EBDAFE913B8C4BDEE" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id965F6046E8704A46B8180C8A91DE6AF2"><enum>(C)</enum><header display-inline="yes-display-inline">Sale of bonds</header><text display-inline="yes-display-inline">Funds may also be used by a public water
				system to increase security at the public water system (excluding any
				expenditure for operations and maintenance), or as a source of revenue
				(restricted solely to interest earnings of the applicable State loan fund) or
				security for payment of the principal and interest on revenue or general
				obligation bonds issued by the State to provide matching funds under subsection
				(e), if the proceeds of the sale of the bonds will be deposited in the State
				loan
				fund.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID3f26a81e249f4aa58fd79f645b5fd741" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Priority system requirements</header><text display-inline="no-display-inline">Section 1452(b)(3) of the Safe Drinking
			 Water Act (42 U.S.C. 300j–12(b)(3)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe0a1d97f77b047dcb0f1be0dba4a0caf"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as
			 subparagraph (D);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5e6d5e773c94c15a390acc56a7bd58d"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5E843AB4E10F44E18D69AA621EC6C266" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDc29f5c8334504e1f9c43ba34bfe60594"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of restructuring</header><text display-inline="yes-display-inline">In this paragraph, the term
				<term>restructuring</term> means changes in operations (including ownership,
				cooperative partnerships, asset management, consolidation, and alternative
				water supply).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0f5d732c62f8401e8731c8565ca44f62"><enum>(B)</enum><header display-inline="yes-display-inline">Priority system</header><text display-inline="yes-display-inline">An intended use plan shall provide, to the
				maximum extent practicable, that priority for the use of funds be given to
				projects that—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDd6220097fe524a2ca7143f3c5cf8b7f3"><enum>(i)</enum><text display-inline="yes-display-inline">address the most serious risk to human
				health;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID15f09ed5b4e4435fba00c8095aa0d7b1"><enum>(ii)</enum><text display-inline="yes-display-inline">are necessary to ensure compliance with
				this title (including requirements for filtration); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDc0d9f7d8f3294fc19667cb9b441a4bbb"><enum>(iii)</enum><text display-inline="yes-display-inline">assist systems most in need on a
				per-household basis according to State affordability criteria.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4df4532345e54462ba61da3e650d909e"><enum>(C)</enum><header display-inline="yes-display-inline">Weight given to applications</header><text display-inline="yes-display-inline">After determining project priorities under
				subparagraph (B), an intended use plan shall further provide that the State
				shall give greater weight to an application for assistance by a community water
				system if the application includes such information as the State determines to
				be necessary, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDb8b7a87c8a894375aa5c87052cd89bac"><enum>(i)</enum><text display-inline="yes-display-inline">an inventory of assets, including a
				description of the condition of the assets;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDe0e96a5a39bb450e9767270388afbaa6"><enum>(ii)</enum><text display-inline="yes-display-inline">a schedule for replacement of
				assets;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDcc6805c4be324a4b8c62e2a5f0b65c88"><enum>(iii)</enum><text display-inline="yes-display-inline">a financing plan that factors in all
				life-cycle costs indicating sources of revenue from ratepayers, grants, bonds,
				other loans, and other sources to meet the costs;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID21409ba18eb946ae90c8525f9d29dc22"><enum>(iv)</enum><text display-inline="yes-display-inline">a review of options for restructuring the
				public water system;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID97ae29d1f8b545e4bd8987b47908aedf"><enum>(v)</enum><text display-inline="yes-display-inline">demonstration of consistency with State,
				regional, and municipal watershed plans; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID89bafee011cf4f6997cb115d998c94da"><enum>(vi)</enum><text display-inline="yes-display-inline">a water conservation plan consistent with
				guidelines developed for those plans by the Administrator under section
				1455(a).</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf6f5c3f6312e48f1a051b2b773f4400e"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (D) (as redesignated by
			 paragraph (1)), by striking <quote>periodically</quote> and inserting <quote>at
			 least biennially</quote>.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID932d0917b65447caab2d56b40fd4a4d8" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Affordability</header><text display-inline="no-display-inline">Section 1452(d)(3) of the Safe Drinking
			 Water Act (42 U.S.C. 300j–12(d)(3)) is amended in the first sentence by
			 inserting <quote>, or portion of a service area,</quote> after <quote>service
			 area</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="IDa36f3b761c25406ea0f1249637b18095" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Safe drinking water revolving loan
			 funds</header><text display-inline="no-display-inline">Section 1452(g) of the
			 Safe Drinking Water Act (42 U.S.C. 300j–12(g)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID42e70441882549f6babef051f3c0bec1"><enum>(1)</enum><text display-inline="yes-display-inline">paragraph (2)—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDad437ae4b75e4deb951c67e01aefa570"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Governor of a State may—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDb9213b09e8a9469ba9dd5715739c116d"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idFDC1470FA994426C9A61C322FD8E4E3D"><enum>(I)</enum><text display-inline="yes-display-inline">reserve not more than 33 percent of a
				capitalization grant made under this section; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idF7499A12944849A7BCBCA6541079FE0B" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">add the funds reserved to any funds
				provided to the State under section 601 of the Federal Water Pollution Control
				Act (33 U.S.C. 1381); and</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id11A4ACA73CFF4D57A6048F35D747DAC5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A contract to be carried out using funds
				directly made available by a capitalization grant under this section for
				program management, construction management, feasibility studies, preliminary
				engineering, design, engineering, surveying, mapping, or architectural or
				related services shall be negotiated in the same manner as—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idC977F74E8BBD4870B5CD619FF8B21D3D"><enum>(A)</enum><text display-inline="yes-display-inline">a contract for architectural and
				engineering services is negotiated under chapter 11 of title 40, United States
				Code; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2EE3F16D61B45B38212F31B4F1AFFF8"><enum>(B)</enum><text display-inline="yes-display-inline">an equivalent State qualifications-based
				requirement (as determined by the Governor of the State).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCDD41886971F4D93800565500CCFB3F0"><enum>(2)</enum><header display-inline="yes-display-inline">Exemption for small
				communities</header><text display-inline="yes-display-inline">Paragraph (1)
				shall not apply to a contract described in that paragraph for program

			</section><section commented="no" display-inline="no-display-inline" id="ID839a4ee54498456e8437bb28f81bf975" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline">Critical drinking water infrastructure
			 projects</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID20aff68e80a04b05a67ff399b375f913"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Administrator of the Environmental Protection Agency
			 shall establish a program under which grants are provided to eligible entities
			 for use in carrying out projects and activities the primary purpose of which is
			 to assist community water systems in meeting the requirements of the Safe
			 Drinking Water Act (42 U.S.C. 300f et seq.).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9a90d471ced14611abe4c2c718e0886f"><enum>(b)</enum><header display-inline="yes-display-inline">Project selection</header><text display-inline="yes-display-inline">A project that is eligible to be carried
			 out using funds provided under this section may include projects that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID6f6d5fc131304be489622f31e3f530a9"><enum>(1)</enum><text display-inline="yes-display-inline">develop alternative water sources;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05c9c155f7ee4dd49788647a0d372f43"><enum>(2)</enum><text display-inline="yes-display-inline">provide assistance to small systems;
			 or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID09a67ff376be4f71a84c07d91bb13d4a"><enum>(3)</enum><text display-inline="yes-display-inline">assist a community water system—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID87453dad94394a4c9b0e9beb202c9fb6"><enum>(A)</enum><text display-inline="yes-display-inline">to comply with a national primary drinking
			 water regulation; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc857d02d22d3497bb090171c89b26570"><enum>(B)</enum><text display-inline="yes-display-inline">to mitigate groundwater contamination,
			 including saltwater intrusion.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf7765366f0024c10a7a8192fc4b12dff"><enum>(c)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">An entity eligible to receive a grant under
			 this section is—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDe608564c3ad340adb663036b6ff8f880"><enum>(1)</enum><text display-inline="yes-display-inline">a community water system as defined in
			 section 1401 of the Safe Drinking Water Act (42 U.S.C. 300f); or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd1942bd114c64155ac7142f8ca10dbe1"><enum>(2)</enum><text display-inline="yes-display-inline">a system that is located in an area
			 governed by an Indian Tribe (as defined in section 1401 of the Safe Drinking
			 Water Act (42 U.S.C. 300f));</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc78c5d89ed864bd0bd002e3f06038656"><enum>(d)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In prioritizing projects for implementation
			 under this section, the Administrator shall give priority to community water
			 systems that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID36aa82c1ff344e69aec189788ef5b5f6"><enum>(1)</enum><text display-inline="yes-display-inline">serve a community that, under affordability
			 criteria established by the State under section 1452(d)(3) of the Safe Drinking
			 Water Act (42 U.S.C. 300j–12), is determined by the State to be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID5d1ca328af0e46798b7aead3af3684da"><enum>(A)</enum><text display-inline="yes-display-inline">a disadvantaged community; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc028331e7cdd4fc891a5e4d917932a37"><enum>(B)</enum><text display-inline="yes-display-inline">a community that may become a disadvantaged
			 community as a result of carrying out an eligible activity; or</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3a505d7469af4468a3183be026c0c87e"><enum>(2)</enum><text display-inline="yes-display-inline">serve a community with a population of less
			 than 10,000 individuals.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID315f3c6bc92246f0911eb230c957f9b0"><enum>(e)</enum><header display-inline="yes-display-inline">Local participation</header><text display-inline="yes-display-inline">In prioritizing projects for implementation
			 under this section, the Administrator shall consult with, and consider the
			 priorities of, affected States, Indian Tribes, and local governments.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf3f490512b08403eb769dac0e5f6b0fc"><enum>(f)</enum><header display-inline="yes-display-inline">Cost-sharing</header><text display-inline="yes-display-inline">Before carrying out any project under this
			 section, the Administrator shall enter into a binding agreement with 1 or more
			 non-Federal interests that shall require the non-Federal interests—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDea232590e2154344bf99c02a5cacf281"><enum>(1)</enum><text display-inline="yes-display-inline">to pay 45 percent of the total costs of the
			 project, which may include services, materials, supplies, or other in-kind
			 contributions;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7e87c3d2bbb343a0b85ec532160765b7"><enum>(2)</enum><text display-inline="yes-display-inline">to provide any land, easements,
			 rights-of-way, and relocations necessary to carry out the project; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5469226bf7f645c2a42951c7780685a3"><enum>(3)</enum><text display-inline="yes-display-inline">to pay 100 percent of any operation,
			 maintenance, repair, replacement, and rehabilitation costs associated with the
			 project.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID598831a71b84422a86c932f9a294c23c"><enum>(g)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Administrator may waive the requirement
			 to pay the non-Federal share of the cost of carrying out an eligible activity
			 using funds from a grant provided under this section if the Administrator
			 determines that an eligible entity is unable to pay, or would experience
			 significant financial hardship if required to pay, the non-Federal
			 share.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID38363c0047164940a07925e7ba404311"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $300,000,000 for each
			 of fiscal years 2008 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID289aeb8fdcb041afa42b464904fdffa7" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">District of Columbia lead service line
			 replacement</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDc550233a59d9474e8f2d5f121788b8f5"><enum>(a)</enum><header display-inline="yes-display-inline">Service line replacement</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idF07A83880FF04712B15C7AED5D99BD8B"><enum>(1)</enum><header display-inline="yes-display-inline">Galvanic effects</header><text display-inline="yes-display-inline">In carrying out lead service line
			 replacement in the District of Columbia, the galvanic effects of replacement of
			 the service lines shall be addressed prior to replacement.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93B1D3A4FEE945B5840B6DA4BFB34F11"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out lead service line replacement in the
			 District of Columbia $30,000,000 for each of fiscal years 2008 through
			 2012.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID53f227942d9c4426b2d2f91631b6ca6d"><enum>(b)</enum><header display-inline="yes-display-inline">Lead service line replacement assistance
			 fund</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idDED9E0B94BBC460DB4F2A88B07E247D6"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of low-income</header><text display-inline="yes-display-inline">In this subsection, the term
			 <term>low-income</term> shall be defined by the District of Columbia.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID413d593a20b84d858ae34c3e044d7924"><enum>(2)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">Of the funds provided under subsection
			 (a)(2), not more than $2,000,000 per year may be allocated for water service
			 line replacement grants to provide assistance to low-income residents to
			 replace the privately-owned portion of lead service lines.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5b921f62b5454a6b9e873cf3541a6355"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">An individual grant provided under
			 paragraph (2) shall not exceed $5,000.</text>

			<section commented="no" display-inline="no-display-inline" id="ID7328abaaf6264d18928ad4389431c579" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>

			 management</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID6bc53a3a5dc545d6b41219fe74086786"><enum>(a)</enum><header display-inline="yes-display-inline">Initial grant program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf1f3d03f69c345c498479627761f8f5d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Administrator shall establish a program to award
			 grants and enter into contracts and cooperative agreements with research
			 institutions, institutions of higher education, and other appropriate entities
			 (including consortia of such institutions and entities), through a competitive
			 process, for research on and development of the use of innovative and
			 alternative technologies to improve water quality or drinking water
			 supply.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9b774cf59f7144c2a6bf8f0c5cff9ae4"><enum>(2)</enum><header display-inline="yes-display-inline">Types of projects</header><text display-inline="yes-display-inline">In carrying out this subsection, the
			 Administrator may select projects relating to such matters as innovative or
			 alternative technologies, approaches, practices, or methods—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID5c28f71f7deb445dbc317905013842e3"><enum>(A)</enum><text display-inline="yes-display-inline">to increase the effectiveness and
			 efficiency of water and wastewater infrastructure through the use of integrated
			 water resource management;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc4d6c17478e145fb8b73fe65d6078429"><enum>(B)</enum><text display-inline="yes-display-inline">to increase the effectiveness and
			 efficiency of public water systems, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID698b3878a96044b9a7cfdbf619310909"><enum>(i)</enum><text display-inline="yes-display-inline">source water protection;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID91742fc8026f4305933bf54fda88f11a"><enum>(ii)</enum><text display-inline="yes-display-inline">water use reduction;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6ec65bf35424b5fb5fb5204c86634b0"><enum>(F)</enum><text display-inline="yes-display-inline">to promote new water treatment technologies
			 and management approaches, including commercialization and dissemination
			 strategies for adoption of innovative water, wastewater, and stormwater
			 technologies and management approaches or low-impact development technologies
			 in the homebuilding industry; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID90f476ff8ea64071893f370f73ae18a5"><enum>(G)</enum><text display-inline="yes-display-inline">to maintain a clearinghouse of technologies
			 and management approaches developed under this subsection and subsection (b) at
			 a research consortium or institute.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6f8f25e55fb544c0bbcc59410b49a6c7"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on
			 which the program is established under paragraph (1), the Administrator shall
			 publish a report that details the findings of each recipient of a grant under
			 the program with respect to the identification of any potential new
			 technologies or management approaches developed in accordance with this
			 section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc82eb91f52674274bbdcb06ad8cef493"><enum>(b)</enum><header display-inline="yes-display-inline">Nationwide grant program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDbfa8d086fe604ecfa0adfe3c1231a0e0"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of municipality</header><text display-inline="yes-display-inline">In this subsection, the term
			 <term>municipality</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id41E0AD223B3B468EB1B154073F1FC6D6"><enum>(A)</enum><text display-inline="yes-display-inline">a city, town, borough, county, parish,
			 district, association, or other public body created by or pursuant to State
			 law; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C691E60CA614A90A39773AE1FB4BA86"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian tribe (as defined in section 4 of
			 the <act-name parsable-cite="ISDA">Indian Self-Determination and Education
			 Assistance Act</act-name> (25 U.S.C. 450b)).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC44422112DA946E7BF479871E2117A3E"><enum>(2)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 publication of the report under subsection (a)(3), the Administrator shall
			 establish a nationwide demonstration grant program—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDefe86006fc4d4066a2c3294665d1e8a6"><enum>(A)</enum><text display-inline="yes-display-inline">to promote innovations in technology and
			 alternative approaches to water quality management or water supply developed
			 under subsection (a); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID89ed18e637e64ed4842db6d4278fdcff"><enum>(B)</enum><text display-inline="yes-display-inline">to reduce costs to municipalities incurred
			 in complying with the Federal Water Pollution Control Act (33 U.S.C. 1251 et
			 seq.) and the Safe Drinking Water Act (42 U.S.C. 300f et seq.) through the
			 approaches and technologies developed under subsection (a).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd8cfa13576814767ada371d97d1a9420"><enum>(3)</enum><header display-inline="yes-display-inline">Scope</header><text display-inline="yes-display-inline">The demonstration grant program shall
			 consist of up to 10 projects each year, to be carried out in municipalities
			 selected by the Administrator under paragraph (4).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbbd3c1ef88fc4793885dcf45362f522d"><enum>(4)</enum><header display-inline="yes-display-inline">Selection of municipalities</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDb85ef5971e494e41ba7258dad52f4a53"><enum>(A)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A municipality that seeks to participate in
			 the demonstration grant program established under paragraph (2) shall submit to
			 the Administrator a plan that—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDbaa3b8dcb6564751bcb46d2bd304ab17"><enum>(i)</enum><text display-inline="yes-display-inline">is developed in coordination with—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID0aefdc4ba0e548e9b36840e943865fc5"><enum>(I)</enum><text display-inline="yes-display-inline">the agencies of the State having
			 jurisdiction over water quality and water supply matters; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4a7867dace394815b1626f54f766df3b"><enum>(II)</enum><text display-inline="yes-display-inline">interested stakeholders, including
			 institutions of higher education and related research institutions;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDaeaaf69c0afc46e0bc3119f3929efdc7"><enum>(ii)</enum><text display-inline="yes-display-inline">describes water impacts specific to urban
			 or rural areas;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDbe0e4c4e871f4e2493177b1590922a31"><enum>(iii)</enum><text display-inline="yes-display-inline">includes a strategy under which the
			 municipality, through participation in the demonstration grant program, could
			 effectively—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID77d630564cb045cb9cfe4d6f58d33650"><enum>(I)</enum><text display-inline="yes-display-inline">address water quality or water supply
			 problems; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa2a5f73480f94a80b6245aa1ef174387"><enum>(II)</enum><text display-inline="yes-display-inline">achieve the water quality goals
			 that—</text>
									<item commented="no" display-inline="no-display-inline" id="ID364e8e1c49f1490b90ad00ff4fd2bcd8"><enum>(aa)</enum><text display-inline="yes-display-inline">could be achieved using more traditional
			 methods; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="ID7d5321b942d8401097e622df4ad7cdf5"><enum>(bb)</enum><text display-inline="yes-display-inline">are required under the Federal Water
			 Pollution Control Act (33 U.S.C. 1251 et seq.) or the Safe Drinking Water Act
			 (42 U.S.C. 300f et seq.); and</text>
									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID43a1bdcd02a345bca392c2a6ef4200f3"><enum>(iv)</enum><text display-inline="yes-display-inline">includes a schedule for achieving the water
			 quality or water supply goals of the municipality.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe1b1f3875f7d4e6286509c218bce7410"><enum>(B)</enum><header display-inline="yes-display-inline">Categories of projects</header><text display-inline="yes-display-inline">In carrying out the demonstration grant
			 program, the Administrator shall provide grants for projects relating to water
			 supply or water quality matters described in subsection (a)(2)(A).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa2132a55f24745d89b47930d2c080995"><enum>(C)</enum><header display-inline="yes-display-inline">Responsibilities of
			 Administrator</header><text display-inline="yes-display-inline">In providing
			 grants for projects under this subsection, the Administrator shall—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID85075a50dcd449bcbb8c479c45f5eb68"><enum>(i)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable,
			 that—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID3363060b3d264d8b91aca5ec9841e6d1"><enum>(I)</enum><text display-inline="yes-display-inline">the demonstration grant program under this
			 subsection includes a variety of projects with respect to—</text>
									<item commented="no" display-inline="no-display-inline" id="IDc9a28c669b5b4f73b9e7cbed24af5ca6"><enum>(aa)</enum><text display-inline="yes-display-inline">geographical distribution;</text>
									</item><item commented="no" display-inline="no-display-inline" id="ID70d66fcd9718448699778eace83eacef"><enum>(bb)</enum><text display-inline="yes-display-inline">innovative technologies used for the
			 projects; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="ID4738823c4c9842f0a3b9d1dfdd4da23c"><enum>(cc)</enum><text display-inline="yes-display-inline">nontraditional approaches (including
			 low-impact development technologies) used for the projects; and</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID64cc68ea714e47bc870bb693758926d7"><enum>(II)</enum><text display-inline="yes-display-inline">each category of project described in
			 subparagraph (B) is adequately represented;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID0703d265a36f4afa94343738ceca236b"><enum>(ii)</enum><text display-inline="yes-display-inline">give higher priority to projects
			 that—</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDb0ed111d30fb4c079370b986757352fe"><enum>(I)</enum><text display-inline="yes-display-inline">address multiple problems; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDffdf1260c51244699f09e543bcf0dd85"><enum>(II)</enum><text display-inline="yes-display-inline">are regionally applicable;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID977d9f6fc7a447079b51990fc5c4e480"><enum>(iii)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable,
			 that at least 1 community having a population of 10,000 or fewer individuals
			 receives a grant for each fiscal year; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDc8b13e64fd7b476cb3d523badf30be0d"><enum>(iv)</enum><text display-inline="yes-display-inline">ensure that, for each fiscal year, no
			 municipality receives more than 25 percent of the total amount of funds made
			 available for the fiscal year to provide grants under this subsection.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID044848f65e1845b2a534a4909046fa28"><enum>(D)</enum><header display-inline="yes-display-inline">Cost sharing</header>
							<clause commented="no" display-inline="no-display-inline" id="ID7b1901bcd8bf4ba685f943f5d34bddf6"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the
			 non-Federal share of the total cost of a project funded by a grant under this
			 subsection shall be not less than 20 percent.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDd3f4f3bddb734e999d5170395871c180"><enum>(ii)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Administrator may reduce or eliminate
			 the non-Federal share of the cost of a project for reasons of
			 affordability.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfad1b2bf5f9a48f9a17804caf5c910a0"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID1b44ecf467ca4012a988318b8ce7e99d"><enum>(1)</enum><header display-inline="yes-display-inline">Reports from grant recipients</header><text display-inline="yes-display-inline">A recipient of a grant under this section
			 shall submit to the Administrator, on the date of completion of a project of
			 the recipient and on each of the dates that is 1, 2, and 3 years after that
			 date, a report that describes the effectiveness of the project.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID87489c2c8182454ab8c69c90f5aeae93"><enum>(2)</enum><header display-inline="yes-display-inline">Reports to congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, and every 2 years thereafter, the Administrator shall
			 submit to the Committee on Environment and Public Works of the Senate and the
			 Committee on Transportation and Infrastructure and the Committee on Energy and
			 Commerce of the House of Representatives a report that describes the status and
			 results of the grant programs under this section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfba4b2d1792e412693eb44d81b10f830"><enum>(d)</enum><header display-inline="yes-display-inline">Incorporation of Results and
			 Information</header><text display-inline="yes-display-inline">To the maximum
			 extent practicable, the Administrator shall incorporate the results of, and
			 information obtained from, successful projects under this section into programs
			 administered by the Administrator.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd14b6f0ef8fe45048ad0d5e464f5d360"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $20,000,000 for each of
			 fiscal years 2008 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDe7572630dd1a4386921a6041f2d68d18" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Agricultural pollution control technology
			 grant program</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID4a3028028bf04bb09faeb83e52debeb9"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDfdcd0fa28e8b42f38b97140ba6b9ccbe"><enum>(1)</enum><header display-inline="yes-display-inline">Agricultural commodity</header><text display-inline="yes-display-inline">The term <term>agricultural
			 commodity</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID8be3eff9291a438ea88095271d7fc2c6"><enum>(A)</enum><text display-inline="yes-display-inline">agricultural, horticultural, viticultural,
			 and dairy products;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6fc0e734e5874d8cb37af950b301c27b"><enum>(B)</enum><text display-inline="yes-display-inline">livestock and the products of
			 livestock;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID353c8e3c3c1b4156baa9ba98e30da0c4"><enum>(C)</enum><text display-inline="yes-display-inline">the products of poultry and bee
			 raising;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcd4c6b25a7b848c7a0e7b229ed20b464"><enum>(D)</enum><text display-inline="yes-display-inline">the products of forestry; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3bea97cabbdf4b31b7bf1b1634443c99"><enum>(E)</enum><text display-inline="yes-display-inline">other commodities raised or produced on
			 agricultural sites, as determined to be appropriate by the Secretary.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb74e462484c34910b39ca88cb2721632"><enum>(2)</enum><header display-inline="yes-display-inline">Agricultural project</header><text display-inline="yes-display-inline">The term <term>agricultural project</term>
			 means an agricultural pollution control technology pilot project that, as
			 determined by the Administrator—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID27e722a466ca4fda91dcc115ae6382ec"><enum>(A)</enum><text display-inline="yes-display-inline">is carried out at an agricultural
			 site;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID16aecf69b4fb47e98c24333ef33987df"><enum>(B)</enum><text display-inline="yes-display-inline">achieves demonstrable reductions in water
			 pollution or water use that meet or exceed those mandated by statutory or
			 regulatory requirements; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID875f27a5c9e04cf59bc619a9f60e9b45"><enum>(C)</enum><text display-inline="yes-display-inline">will not substantially adversely affect any
			 other long-term environmental medium, including air and groundwater
			 resources.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7a5c339a6f0549d79ea5958bc38540cd"><enum>(3)</enum><header display-inline="yes-display-inline">Agricultural site</header><text display-inline="yes-display-inline">The term <term>agricultural site</term>
			 means a farming or ranching operation of a producer.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID51117ab673b84a43a2d1278811222c9a"><enum>(4)</enum><header display-inline="yes-display-inline">Producer</header><text display-inline="yes-display-inline">The term <term>producer</term> means any
			 person who is engaged in the production and sale of an agricultural commodity
			 in the United States and who owns, or shares the ownership and risk of loss of,
			 the agricultural commodity.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc2935cb75a804ac18bc4f8be6681a4ac"><enum>(5)</enum><header display-inline="yes-display-inline">Revolving
			 fund</header><text display-inline="yes-display-inline">The term <term>revolving
			 fund</term> means an agricultural pollution control technology State revolving
			 fund established by a State using amounts provided under subsection
			 (b)(1).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5caf424f0d5f4e3395877330ad96e18c"><enum>(b)</enum><header display-inline="yes-display-inline">Grants for agricultural State revolving
			 funds</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID3a73ccb73fae48f8885aae6ddbf14c18"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 enactment of this section, the Administrator shall provide to each eligible
			 State described in paragraph (2) 1 or more capitalization grants, that
			 cumulatively equal no more than $1,000,000 per State, for use in establishing,
			 within an agency of the State having jurisdiction over agriculture or
			 environmental quality, an agricultural pollution control technology State
			 revolving fund.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID078509334bfb4d16b9b2673d1cf37741"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible States</header><text display-inline="yes-display-inline">An eligible State referred to in paragraph
			 (1) is a State that agrees, prior to receipt of a capitalization grant under
			 paragraph (1)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID01ccbf2a407c4209a07c3e86ed88dea3"><enum>(A)</enum><text display-inline="yes-display-inline">to establish, and deposit the funds from
			 the grant in, a revolving fund;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9228a80f995f41aba247d351925a4127"><enum>(B)</enum><text display-inline="yes-display-inline">to provide, at a minimum, a State share in
			 an amount equal to 20 percent of the capitalization grant;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb881a725488345e49a7ad48ee17369ee"><enum>(C)</enum><text display-inline="yes-display-inline">to use amounts in the revolving fund to
			 make loans to producers in accordance with subsection (c); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe3b147f7f45547a7b02d6dc476945b66"><enum>(D)</enum><text display-inline="yes-display-inline">to return amounts in the revolving fund if
			 no loan applications are granted within 2 years of the receipt of the initial
			 capitalization grant.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID14fbba5c24d24619918d8e341ad11c10"><enum>(c)</enum><header display-inline="yes-display-inline">Loans to producers</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID9272f9a3948c40c5ba9f4c8f2a9e9ed4"><enum>(1)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">A State that establishes a revolving fund
			 under subsection (b)(2) shall use amounts in the revolving fund to provide
			 loans to producers for use in designing and constructing agricultural
			 projects.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4e4b243e11d94b57b27249801b59fa95"><enum>(2)</enum><header display-inline="yes-display-inline">Maximum amount of loan</header><text display-inline="yes-display-inline">The amount of a loan made to a producer
			 using funds from a revolving fund shall not exceed $250,000, in the aggregate,
			 for all agricultural projects serving an agricultural site of the
			 producer.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6b875b3e577e4b8daad160c0ba8708f3"><enum>(3)</enum><header display-inline="yes-display-inline">Conditions on loans</header><text display-inline="yes-display-inline">A loan made to a producer using funds from
			 a revolving fund shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2b2a506390ce4a399fc7577292093714"><enum>(A)</enum><text display-inline="yes-display-inline">have an interest rate that is not more than
			 the market interest rate, including an interest-free loan; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID52c4c179697543ccb2d3535d991ee2c2"><enum>(B)</enum><text display-inline="yes-display-inline">be repaid to the revolving fund not later
			 than 20 years after the date on which the loan is made.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5fc61e773cfd4f188050610d0b500ce7"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements for producers</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID36dccfc5e20844858de1b6e5d4072c55"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A producer that seeks to receive a loan
			 from a revolving fund shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID1b3845bba65d4f22839aefff6178e164"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the State in which the
			 agricultural site of the producer is located an application that—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID9126b867eae446b6a49d13d14ac0cfc9"><enum>(i)</enum><text display-inline="yes-display-inline">contains such information as the State may
			 require; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDc18e82f10f034ed2a35df403f02eede9"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrates, to the satisfaction of the
			 State, that each project proposed to be carried out with funds from the loan is
			 an agricultural project; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb157e65753f44a61aceabae69d74e097"><enum>(B)</enum><text display-inline="yes-display-inline">agree to expend all funds from a loan in an
			 expeditious and timely manner, as determined by the State.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9845b73c6c344cf8a44f355b8fc2724b"><enum>(2)</enum><header display-inline="yes-display-inline">Maximum percentage of agricultural project
			 cost</header><text display-inline="yes-display-inline">Subject to subsection
			 (c)(2), a producer that receives a loan from a revolving fund may use funds
			 from the loan to pay up to 100 percent of the cost of carrying out an
			 agricultural project.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID92d08b056e734d28a5669b1a20d44d07"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $50,000,000.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID41edf3fdfe5642c9a6b7f66a7ed1f788" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">State revolving fund review
			 process</header><text display-inline="no-display-inline">As soon as practicable
			 after the date of enactment of this Act, the Administrator shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDbeec2f4cb4d04b5f8d9b1cf212514a44"><enum>(1)</enum><text display-inline="yes-display-inline">consult with States, utilities, nonprofit
			 organizations, and other Federal agencies providing financial assistance to
			 identify ways to expedite and improve the application and review process, for
			 the provision of assistance from—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDfdffd4db713d44ff89f98596f7d6d8ce"><enum>(A)</enum><text display-inline="yes-display-inline">the State water pollution control revolving
			 funds established under title VI of the Federal Water Pollution Control Act (33
			 U.S.C. 1381 et seq.); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3e37516ba1564b209d4e0f0c3e7b61eb"><enum>(B)</enum><text display-inline="yes-display-inline">the State drinking water treatment
			 revolving loan funds established under section 1452 of the Safe Drinking Water
			 Act (42 U.S.C. 300j–12);</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf40d4e90fef341c5b29af24429ab62ad"><enum>(2)</enum><text display-inline="yes-display-inline">in carrying out this section, the
			 Administrator shall consider the needs of small treatment works (as defined by
			 section 222 of the Federal Water Pollution Control Act and small public water
			 systems (as described in section 1433(d) of the Safe Drinking Water Act (42
			 U.S.C. 300i–2(d));</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c7dbb898c3b4a58a99e6dc6e7312b46"><enum>(3)</enum><text display-inline="yes-display-inline">take such administrative action as is
			 necessary to expedite and improve the process as the Administrator has
			 authority to take under existing law;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID545727ca786642948a9799937154020f"><enum>(4)</enum><text display-inline="yes-display-inline">collect information relating to innovative
			 approaches taken by any State to simplify the application process of the State,
			 and provide the information to each State; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd9eaf9829bad4ab2bf20afa9e2403282"><enum>(5)</enum><text display-inline="yes-display-inline">submit to Congress a report that, based on
			 the information identified under paragraph (1), contains recommendations for
			 legislation to facilitate further streamlining and improvement of the
			 process.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDb6cc56658510467486fb8108a4806c5b" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Cost of service study</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID56c64c39da6b45448703a65057d7bd7d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Administrator shall enter an arrangement with the
			 Academy under which the Academy shall complete and provide to the Administrator
			 the results of a study of the means by which public water systems and treatment
			 works selected by the Academy in accordance with subsection (c) meet the costs
			 associated with operations, maintenance, capital replacement, and regulatory
			 requirements.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID36ea78d890c24d9b9ade68414401270b"><enum>(b)</enum><header display-inline="yes-display-inline">Required elements</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID74b61d10bb6f46d79b126ce282b05604"><enum>(1)</enum><header display-inline="yes-display-inline">Affordability</header><text display-inline="yes-display-inline">The study shall, at a minimum—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDb7631b755823414eb119cf1590e16a0d"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the rates at public water
			 systems and treatment works for communities included in the study were
			 established using a full-cost pricing model;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe9dcc3f7eabb46ac8ef0de3ddffbc176"><enum>(B)</enum><text display-inline="yes-display-inline">if a full-cost pricing model was not used,
			 identify any incentive rate systems that have been successful in significantly
			 reducing—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDf72846f39ee74beb8fc28db3fc37da6c"><enum>(i)</enum><text display-inline="yes-display-inline">per capita water demand;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID07279479f8f34c27bca25bf4a8110ee0"><enum>(ii)</enum><text display-inline="yes-display-inline">the volume of wastewater flows;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID0ae0060c945b4fa588f4e0ee3f64354f"><enum>(iii)</enum><text display-inline="yes-display-inline">the volume of stormwater runoff; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDe71afac24d514a96b6e10a871a1fcfcd"><enum>(iv)</enum><text display-inline="yes-display-inline">the quantity of pollution generated by
			 stormwater;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa4ff36247bbc4d37ad1df756f6a220c7"><enum>(C)</enum><text display-inline="yes-display-inline">identify a set of best industry practices
			 that public water systems and treatment works may use in establishing a rate
			 structure that—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID6d33516bc0d04b3686e3265464b90c05"><enum>(i)</enum><text display-inline="yes-display-inline">adequately addresses the true cost of
			 services provided to consumers by public water systems and treatment works,
			 including infrastructure replacement;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID726c17abe19f47ed9119a4926fff0ede"><enum>(ii)</enum><text display-inline="yes-display-inline">encourages water conservation; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID54dc3be5ec5b4e73a0b60e23c74f73cd"><enum>(iii)</enum><text display-inline="yes-display-inline">takes into consideration the needs of
			 disadvantaged individuals and communities, as identified by the
			 Administrator;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf334763c03aa44e58c119d97e8d4ef7f"><enum>(D)</enum><text display-inline="yes-display-inline">identify existing standards for
			 affordability and the manner in which those standards are determined and
			 defined;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5b7800f0c1c54e9da50b7e8fd6fde70c"><enum>(E)</enum><text display-inline="yes-display-inline">determine the manner in which affordability
			 varies with respect to communities of different sizes and in different regions;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbf479ab322324461b7305ced13ffe067"><enum>(F)</enum><text display-inline="yes-display-inline">determine the extent to which affordability
			 affects the decision of a community to increase public water system and
			 treatment works rates (including the decision relating to the percentage by
			 which those rates should be increased).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID00fef5094ce845eca5f31f0b37623a55"><enum>(2)</enum><header display-inline="yes-display-inline">Disadvantaged communities</header><text display-inline="yes-display-inline">The study shall, at a minimum—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID071154dc3e9c4218a8a1f557a85f84b8"><enum>(A)</enum><text display-inline="yes-display-inline">survey a cross-section of States
			 representing different sizes, demographics, and geographical regions;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID183e97f6f9234f21bcaf689a39b91e25"><enum>(B)</enum><text display-inline="yes-display-inline">describe, for each State described in
			 subparagraph (A), the definition of <quote>disadvantaged community</quote> used
			 in the State in carrying out projects and activities under the Safe Drinking
			 Water Act (42 U.S.C. 300f et seq.);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa7bb803cd3fc40e38426ef6b37c3fac5"><enum>(C)</enum><text display-inline="yes-display-inline">review other means of identifying the
			 meaning of the term <quote>disadvantaged</quote>, as that term applies to
			 communities;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf9888909fa804cadbb5b56d35a049e4b"><enum>(D)</enum><text display-inline="yes-display-inline">determine which factors and characteristics
			 are required for a community to be considered <quote>disadvantaged</quote>;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcbd4c3eb7e48441fa059ae7f5eb550e9"><enum>(E)</enum><text display-inline="yes-display-inline">evaluate the degree to which factors such
			 as a reduction in the tax base over a period of time, a reduction in
			 population, the loss of an industrial base, and the existence of areas of
			 concentrated poverty are taken into account in determining whether a community
			 is a disadvantaged community.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd93b80dde07b47e0b5259ef99c34574c"><enum>(c)</enum><header display-inline="yes-display-inline">Selection of communities</header><text display-inline="yes-display-inline">The Academy shall select communities, the
			 public water system and treatment works rate structures of which are to be
			 studied under this section, that include a cross-section of communities
			 representing various populations, income levels, demographics, and geographical
			 regions.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDbf14d0cb056e4e3caf44574925dc756e"><enum>(d)</enum><header display-inline="yes-display-inline">Use of Results of Study</header><text display-inline="yes-display-inline">On receipt of the results of the study, the
			 Administrator shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDad2015ba0d544d8795d2f2fe88adf04f"><enum>(1)</enum><text display-inline="yes-display-inline">submit the study to Congress;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3df0d62ebd8643bf925a16ef8023fdfc"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report that describes the results
			 of the study; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID640e49ae1ac145239d9d3acd73b07d37"><enum>(3)</enum><text display-inline="yes-display-inline">make the results available to treatment
			 works and public water systems for use by the publicly owned treatment works
			 and public water systems, on a voluntary basis, in determining whether 1 or
			 more new approaches may be implemented at facilities of the publicly owned
			 treatment works and public water systems.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDacd3fc08971f4f66a1d23a42521c5a48"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $1,000,000 for each of
			 fiscal years 2008 and 2009.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID0900f55728da4c28ae75ee72117c111d" section-type="subsequent-section"><enum>306.</enum><header display-inline="yes-display-inline">Water management study</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDf1fab32d0f53448b9263fbf52b2adf9a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 enactment of this Act, the Administrator shall enter into an arrangement with
			 the Academy under which the Academy shall conduct a study, during the 26-month
			 period beginning on the date of enactment of this Act, of innovative,
			 effective, and systematic approaches for the management of water supply,
			 wastewater, and stormwater in urban areas and surrounding communities
			 (including greenfield developments) in the United States and other
			 countries.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6ef057b5f73440dda2ac30d1e534efd4"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out the study under this
			 section, the Academy shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID12a4960b6c8e45bbbe6b99ac88d4b2e4"><enum>(1)</enum><text display-inline="yes-display-inline">pay particular attention to soft-path or
			 low-impact approaches to the management described in subsection (a); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb0f62a0944834895bcc3a24efb7ef755"><enum>(2)</enum><text display-inline="yes-display-inline">consider the costs of approaches that are
			 analyzed.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbf6ba5758aac43a1bc0bd40504dd9fc5"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Administrator shall provide to the
			 Academy a grant in the amount of $1,000,000 for the period of fiscal years 2009
			 through 2011 for use in carrying out the study under this section.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idA3362CF644C64172916406625A3FD58D" section-type="subsequent-section"><enum>307.</enum><header display-inline="yes-display-inline">Reduction in authorization of
			 appropriations</header><text display-inline="no-display-inline">Notwithstanding
			 any other provision of this Act, each amount authorized to be appropriated
			 under this Act shall be reduced by 2 percent.</text>
