		<section commented="no" display-inline="no-display-inline" id="id8E97F6505DD44D70BD0C04A220E2B4FF" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Lending Market
			 Stabilization Act of 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id65378E487B7D414B8C1C31A84DAB1CE4" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Small business lending market
			 stabilization</header>
			<subsection commented="no" display-inline="no-display-inline" id="idC40549576291403DBB3EA15D03EEF202"><enum>(a)</enum><header display-inline="yes-display-inline">Fees</header><text display-inline="yes-display-inline">To the extent the cost of such reduction in
			 fees is offset by appropriations—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4643C90C47B946B3A20C402289334308"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to each loan guaranteed under
			 section 7(a) of the Small Business Act (15 U.S.C. 636(a)) for which the
			 application is approved on or after the date of enactment of this Act, the
			 Administrator shall, in lieu of the fees otherwise applicable under paragraphs
			 (23)(A) and (18)(A) of section 7(a) of the Small Business Act (15 U.S.C.
			 636(a)), collect no fee;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id077CA5AB206543D89C406F8A0A06D249"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator shall, in lieu of the
			 fees otherwise applicable under section 5(b)(14) of the Small Business Act (15
			 U.S.C. 634(b)(14)), collect no fee;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfccfd96173e94164ae10025fa7c0a575"><enum>(3)</enum><text display-inline="yes-display-inline">the Administrator shall, in lieu of the fee
			 otherwise applicable under section 503(d)(2) of the Small Business Investment
			 Act of 1958 (15 U.S.C. 697(d)(2)) for an institution described in subclause
			 (I), (II), or (III) of section 502(3)(B)(i) of that Act (15 U.S.C.
			 696(3)(B)(i)), for any loan guarantee or project subject to such subsection for
			 which the application is pending approval on or after the date of enactment of
			 this Act, collect no fee;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6d552cce9f28430babf68ba7af9247cd"><enum>(4)</enum><text display-inline="yes-display-inline">a development company shall, in lieu of the
			 mandatory 0.625 servicing fee under section 120.971(a)(3) of title 13, Code of
			 Federal Regulations, (relating to fees paid by borrowers), collect no fee;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20D9C786FB22407F92D9C566D4637E23"><enum>(5)</enum><text display-inline="yes-display-inline">the Administrator shall, in lieu of the fee
			 otherwise applicable under section 503(d)(3) of the Small Business Investment
			 Act (15 U.S.C. 697(d)(3)), collect no fee.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id685D6728287C44E9AE374B71A5C03F37"><enum>(b)</enum><header display-inline="yes-display-inline">Reimbursement for waived fees</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id5E6A669BC9C3468A9C8573C7EFE69E59"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the extent the cost of such payments is
			 offset by appropriations, the Administrator shall reimburse each development
			 company that does not collect a servicing fee pursuant to subsection
			 (a)(4).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C25950BB8FF447E8694C7035C2DC6CF"><enum>(2)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The payment to a development company under
			 paragraph (1) shall be in an amount equal to 0.5 percent of the outstanding
			 principal balance of any guaranteed debenture for which the development company
			 does not collect a servicing fee pursuant to subsection (a)(4).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID56942798862c4ac8963a49680ba2da94"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Administrator for fiscal year 2009—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id131906AC5B5F4941BD18002CE13A267A"><enum>(1)</enum><text display-inline="yes-display-inline">$600,000,000 for loan subsidies and for
			 loan modifications for loans to small business concerns authorized under
			 subsection (a)(1);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08C6F42441654AC5BCB1805F598D4AAD"><enum>(2)</enum><text display-inline="yes-display-inline">$15,000,000 for lender oversight under
			 section 5(b)(14) of the Small Business Act (15 U.S.C. 634(b)(14));</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID294792258fa84c6abfff6f6144efd2a9"><enum>(3)</enum><text display-inline="yes-display-inline">$50,000,000 for the elimination of fees
			 under subsection (a)(3);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE6E84284D984B28940B0E2B0650AA8E"><enum>(4)</enum><text display-inline="yes-display-inline">$40,000,000 for payments under subsection
			 (b) to offset the elimination of fees under subsection (a)(4); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2aa88c4b3ce8415087164508c5138602"><enum>(5)</enum><text display-inline="yes-display-inline">$10,000,000 for the elimination of fees
			 under subsection (a)(5).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDADD2D97012241ECB83CAD80DB0D9913"><enum>(d)</enum><header display-inline="yes-display-inline">Application of fee changes</header><text display-inline="yes-display-inline">If funds are made available to carry out
			 subsections (a) and (b), the Administrator shall eliminate the fees under
			 subsection (a) for any loan guarantee or project subject to such subsection for
			 which the application is approved on or after the date of enactment of this Act
			 and make payments under subsection (b) until the amount provided for such
			 purpose is expended.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD24E9D3364E4CB58E5E2E82875B9BAF"><enum>(e)</enum><header display-inline="yes-display-inline">Maximum loan amount</header><text display-inline="yes-display-inline">Section 7(a)(3)(A) of the Small Business
			 Act (15 U.S.C. 636(a)(3)(A)) is amended by striking <quote>$1,500,000 (or if
			 the gross loan amount would exceed $2,000,000)</quote> and inserting
			 <quote>$2,250,000 (or if the gross loan amount would exceed
			 $3,000,000)</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDde6aecf18ae84cf5a152961a96bc526a"><enum>(f)</enum><header display-inline="yes-display-inline">Main street incentives</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe79653fb68a14034b31369ff37e3694f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 502 of the Small Business
			 Investment Act of 1958 (15 U.S.C. 696) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDd80d8bb350f74d46beb083e95dc3a470"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraphs (4) and (5) and
			 inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2DF342F34F3848FBB5961ED24590DFCE" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="IDda5727ee91cc4836af19acdeb8dc6ae1"><enum>(4)</enum><header display-inline="yes-display-inline">Limitation on leasing</header><text display-inline="yes-display-inline">If the use of a loan under this section
				includes the acquisition of a facility or the construction of a new facility,
				the small business concern assisted—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDa1f34845432c47ff979d90a9861d429a"><enum>(A)</enum><text display-inline="yes-display-inline">shall permanently occupy and use not less
				than a total of 50 percent of the space in the facility; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd4ce34b9bf5e4b3e8e364cd3a59a1f59"><enum>(B)</enum><text display-inline="yes-display-inline">may, on a temporary or permanent basis,
				lease to others not more than 50 percent of the space in the
				facility.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe1a5daa15f5c47398238f81f3ad91535"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (6) as paragraph
			 (5).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID69ee61373e214f3abd10ba4222ccc31a"><enum>(2)</enum><header display-inline="yes-display-inline">Policy for
			 <enum-in-header>7(a)</enum-in-header> loans</header><text display-inline="yes-display-inline">Section 7(a)(28) of the Small Business Act
			 (15 U.S.C. 636(a)(28)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id1B6132B18A8748EB825CA9ECDCB015AB" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID6cd186d1114a4a56bc259688205a13a8"><enum>(28)</enum><header display-inline="yes-display-inline">Limitation on leasing</header><text display-inline="yes-display-inline">If the use of a loan under this subsection
				includes the acquisition of a facility or the construction of a new facility,
				the small business concern assisted—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID213447f3f69e446a8110ac14376e2a65"><enum>(A)</enum><text display-inline="yes-display-inline">shall permanently occupy and use not less
				than a total of 50 percent of the space in the facility; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa31e821c11df4f0b9812ac1e2afd13cb"><enum>(B)</enum><text display-inline="yes-display-inline">may, on a temporary or permanent basis,
				lease to others not more than 50 percent of the space in the
				facility.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd2a002a2ff654f4581e6b7bdb5a42f16"><enum>(g)</enum><header display-inline="yes-display-inline">Low-interest refinancing</header><text display-inline="yes-display-inline">Section 502 of the Small Business
			 Investment Act of 1958 (15 U.S.C. 696), as amended by subsection (e)(1) of this
			 section, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBA6F4C40EE40426E97EE43FB3695A7D6" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDf078de2b52b54b1187b47de318bcf97f"><enum>(6)</enum><header display-inline="yes-display-inline">Permissible debt refinancing</header><text display-inline="yes-display-inline">A financing under this title may include
				refinancing of existing indebtedness, in an amount not to exceed 50 percent of
				the projected cost of the project financed under this title, if—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID376cd51ad90a416d8661e19d3e154f7f"><enum>(A)</enum><text display-inline="yes-display-inline">the project financed under this title
				involves the expansion of a small business concern;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9c80513aa95f49efb81269190ced9d1e"><enum>(B)</enum><text display-inline="yes-display-inline">the existing indebtedness is collateralized
				by fixed assets;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID26ef86883adc47bc811be7ab8ad2fb07"><enum>(C)</enum><text display-inline="yes-display-inline">the existing indebtedness was incurred for
				the benefit of the small business concern;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41bd5916ad7746739b8e381df452fe22"><enum>(D)</enum><text display-inline="yes-display-inline">the proceeds of the existing indebtedness
				were used to acquire land (including a building situated thereon), to construct
				or expand a building thereon, or to purchase equipment;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc3de59f5aee147cdaa09263a1f6e1ec6"><enum>(E)</enum><text display-inline="yes-display-inline">the borrower has been current on all
				payments due on the existing indebtedness for not less than 1 year preceding
				the proposed date of refinancing;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID78baab49f9084b1abf214a87a6a6fb9d"><enum>(F)</enum><text display-inline="yes-display-inline">the financing under this title will provide
				better terms or a better rate of interest than exists on the existing
				indebtedness on the proposed date of refinancing;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4da65ecdbf074702bef78afaa6fcae6a"><enum>(G)</enum><text display-inline="yes-display-inline">the financing under this title is not being
				used to refinance any debt guaranteed by the Government; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5dda45a057f64eb88b8c544498f7b142"><enum>(H)</enum><text display-inline="yes-display-inline">the financing under this title will be used
				only for—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID622f5de8b8e14727a0f7239bf159c61b"><enum>(i)</enum><text display-inline="yes-display-inline">refinancing existing indebtedness;
				or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDcffb25c95db84956874ca909fa96b1c1"><enum>(ii)</enum><text display-inline="yes-display-inline">costs relating to the project financed
				under this
				title.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa7b8e834d7c4498a938f58cb651e09e5"><enum>(h)</enum><header display-inline="yes-display-inline">Updated job creation
			 requirements</header><text display-inline="yes-display-inline">Section 501(e)
			 of the Small Business Investment Act of 1958 (15 U.S.C. 695(e)) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID513808cee0014dd4b825afafbb2d531f"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>$50,000</quote> and inserting <quote>$65,000</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26e8cfb8c0fd4c1799a11d4c072f28d6"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>$50,000</quote> and inserting <quote>$65,000</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa92818ea6c594699b5516bb76a73f512"><enum>(i)</enum><header display-inline="yes-display-inline">Size standard simplification</header><text display-inline="yes-display-inline">Section 3(a) of the Small Business Act (15
			 U.S.C. 632(a)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFA8B7243E71D4B0ABF180A0D4DF9D1C1" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID6336c677b5344506aa5cd8d650013ea3"><enum>(5)</enum><header display-inline="yes-display-inline">Optional size standard</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID8a04b85c2cc2488c83ac2171d1d2163e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish an
				optional size standard for business loan applicants under section 7(a) and
				development company loan applicants under title V of the Small Business
				Investment Act of 1958, which uses maximum tangible net worth and average net
				income as an alternative to the use of industry standards.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6916200c4b034a95b5927da629a1b158"><enum>(B)</enum><header display-inline="yes-display-inline">Interim rule</header><text display-inline="yes-display-inline">Until the date on which the optional size
				standard established under subparagraph (A) is in effect, the alternative size
				standard in section 121.301(b) of title 13, Code of Federal Regulations (or any
				successor thereto) may be used by business loan applicants under section 7(a)
				and development company loan applicants under title V of the Small Business
				Investment Act of
				1958.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID02b5f6e1bfb74c048c10cc7e92a7f02d"><enum>(j)</enum><header display-inline="yes-display-inline">Maximum loan size</header><text display-inline="yes-display-inline">Section 502(2)(A) of the Small Business
			 Investment Act of 1958 (15 U.S.C. 696(2)(A)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID93880d480e3c43d890196908e5417f07"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking
			 <quote>$1,500,000</quote> and inserting <quote>$3,000,000</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID292ce15da6ab48159331b7efb4aab382"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>$2,000,000</quote> and inserting <quote>$3,500,000</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID126A20902B744D27965F40A33DEF136E"><enum>(k)</enum><header display-inline="yes-display-inline">Loan pooling</header><text display-inline="yes-display-inline">Section 5(g)(1) of the Small Business Act
			 (15 U.S.C. 634(g)(1)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDC3C13227FB86417086F75A93B7CC24BF"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> before
			 <quote>The Administration</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0834AC4F2DC84743B240379E89CC6FAC"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the colon and all that follows
			 and inserting a period; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC96D696AEFBF4F0EAD27BD836E5B3207"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID2D843E7D485146C9B9CEAEE2FB757397" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID476F3A27FB054E4BB7FA75F7D21A0335" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">A
				trust certificate issued under subparagraph (A) shall be based on, and backed
				by, a trust or pool approved by the Administrator and composed solely of the
				guaranteed portion of such loans.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD8E846CBD8844915AE8CE7F743275102" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The interest rate on a trust certificate
				issued under subparagraph (A) shall be either—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDC1ACA95B045B4A24B9FB399D5519E0C4"><enum>(i)</enum><text display-inline="yes-display-inline">the lowest interest rate on any individual
				loan in the pool; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID24E64D18CB054816A2068163B91A1AE4"><enum>(ii)</enum><text display-inline="yes-display-inline">the weighted average interest rate of all
				loans in the pool, subject to such limited variations in loan characteristics
				as the Administrator determines appropriate to enhance marketability of the
				pool
				certificates.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDACF9AEF68D4C48149E8A84C4AC4D1972"><enum>(l)</enum><header display-inline="yes-display-inline">Alternative variable interest rate</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID81146C8AF2DB44ECB40BFBB2560B4018"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7(a)(4)(A) of the Small Business
			 Act (15 U.S.C. 636(a)(4)(A)) is amended by striking <quote>prescribed by the
			 Administration,</quote> and inserting: <quote>prescribed by the Administration,
			 including, on variable rate loans, a nationally recognized prime rate of
			 interest and at least 1 other index as an alternative thereto at the option of
			 the participating lender,</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7779E4C85BC14C269D823C014B8A5140"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Administrator shall select not less than 1
			 alternative index under section 7(a)(4)(A) of the Small Business Act, as
			 amended by paragraph (1) of this subsection, and make such index available for
			 use by participating lenders.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD8E4252649DF46049BB281B03ECAB84C"><enum>(m)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idCAC90354C79C4575B035978007AED80B"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>Administration</term> and
			 <term>Administrator</term> mean the Small Business Administration and the
			 Administrator thereof, respectively;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1AF018050AE94550B9229ABAC827C7BC"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>development company</term>
