		<official-title display="yes">To amend the Clean Air Act to improve motor
		  fuel supply and distribution.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Motor Fuel Supply and Distribution
			 Improvement Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID9250F05B69594068A495E2D613101FA5" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Improving motor fuel supply and
			 distribution</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDDD738834C09F4958A78A30134D2859C9"><enum>(a)</enum><header display-inline="yes-display-inline">Limiting Number of Boutique
			 Fuels</header><text display-inline="yes-display-inline">Section 211(c)(4)(C) of
			 the <act-name parsable-cite="CAA">Clean Air Act</act-name> (42 U.S.C.
			 7545(c)(4)(C)) is amended by striking the second clause (v) (as added by
			 section 1541(b) of Public Law 109–58) and inserting the following:</text>
				<quoted-block act-name="Clean Air Act" display-inline="no-display-inline" id="ID38550F9109F7491FAC2FA26D0015B8AA" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="IDDF8A5697BE36405CA3786A3FA49348B1"><enum>(vi)</enum><subclause commented="no" display-inline="yes-display-inline" id="ID0799D7F1FC40406FA3B518E561B2D786"><enum>(I)</enum><text display-inline="yes-display-inline">The Administrator shall have no authority,
				when considering a State implementation plan or a State implementation plan
				revision, to approve under this paragraph any fuel included in such plan or
				revision if the effect of such approval would be to increase the total number
				of fuels approved under this paragraph as of January 1, 2009 in all State
				implementation plans.</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6B59E3C0AD4E41E3A1AAC4210A2BA6C8" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">The Administrator, in consultation with the
				Secretary of Energy, shall determine the total number of fuels approved under
				this paragraph as of January 1, 2009, in all State implementation plans and
				shall publish a list of such fuels, including the States and Petroleum
				Administration for Defense District in which they are used, in the Federal
				Register no later than 90 days after enactment.</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="IDE39E7C6078174510BB8A7A034A57BC73" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">The Administrator shall remove a fuel from
				the list published under subclause (II) if a fuel ceases to be included in a
				State implementation plan or if a fuel in a State implementation plan is
				identical to a Federal fuel formulation implemented by the Administrator, but
				the Administrator shall not reduce the total number of fuels authorized under
				the list published under subclause (II).</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7CD29BF3906B4A7B9018D4037B5631BF" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">Subclause (I) shall not apply to approval
				by the Administrator of a control or prohibition respecting any new fuel under
				this paragraph in a State’s implementation plan or a revision to that State’s
				implementation plan after the date of enactment of this Act if the fuel, as of
				the date of consideration by the Administrator—</text>
							<item commented="no" display-inline="no-display-inline" id="ID77390F302D36443FA2818806F1516E53"><enum>(aa)</enum><text display-inline="yes-display-inline">would replace completely a fuel on the list
				published under subclause (II);</text>
							</item><item commented="no" display-inline="no-display-inline" id="IDE782B2760D004CF7A799750BB0E6D31F"><enum>(bb)</enum><text display-inline="yes-display-inline">has been approved in at least one State
				implementation plan in the applicable Petroleum Administration for Defense
				District; or</text>
							</item><item commented="no" display-inline="no-display-inline" id="ID6D0DA045D3654C62ABDDBC336A989177"><enum>(cc)</enum><text display-inline="yes-display-inline">is a fuel that differs from the Federal
				conventional gasoline specifications under subsection (k)(8) only with respect
				to the requirement of a summertime Reid Vapor Pressure of 7.0 or 7.8 pounds per
				square inch.</text>
							</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID3BB09C0DAA004921A57CD4EDE681638E" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">Nothing in this clause shall be construed
				to have any effect regarding any available authority of States to require the
				use of any fuel additive registered in accordance with subsection (b),
				including any fuel additive registered in accordance with subsection (b) after
				the enactment of this subclause.</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4F9614CDF38A4CD5B96DCBD9A1983366" indent="up1"><enum>(VI)</enum><text display-inline="yes-display-inline">In this clause:</text>
							<item commented="no" display-inline="no-display-inline" id="IDD7A473936C834A04A87B65977E90CAA1"><enum>(aa)</enum><text display-inline="yes-display-inline">The term <term>control or prohibition
				respecting a new fuel</term> means a control or prohibition on the formulation,
				composition, or emissions characteristics of a fuel that would require the
				increase or decrease of a constituent in gasoline or diesel fuel.</text>
							</item><item commented="no" display-inline="no-display-inline" id="ID1C31C5C14B914EC490AB2026D7371F85"><enum>(bb)</enum><text display-inline="yes-display-inline">The term <term>fuel</term> means gasoline,
				diesel fuel, and any other liquid petroleum product commercially known as
				gasoline and diesel fuel for use in highway and non-road motor
				vehicles.</text>
							</item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA5E840FEA8504FB0BF6A8D2B9CE8F76B"><enum>(b)</enum><header display-inline="yes-display-inline">Temporary Waivers During Supply
			 Emergencies</header><text display-inline="yes-display-inline">Section 211(c)(4)
			 of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (42 U.S.C.
			 7545(c)(4)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Clean Air Act" display-inline="no-display-inline" id="ID922F514C20EB4966A8B29B23A888E64C" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="IDCE601FAFCF7F48DC80B224C702010E90" indent="up2"><enum>(D)</enum><header display-inline="yes-display-inline">Temporary waivers during supply
				emergencies</header><text display-inline="yes-display-inline">The Administrator
				may temporarily waive a control or prohibition with respect to the use of a
				fuel or fuel additive required or regulated by the Administrator under
				subsection (c), (h), (i), (k), or (m), or prescribed in an applicable
				implementation plan under section 110 that is approved by the Administrator
				under subparagraph (c)(4)(C)(i), if, after consultation with and concurrence by
				the Secretary of Energy, the Administrator determines that—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDAED1376498B74427A0BD77F3777B7884"><enum>(i)</enum><text display-inline="yes-display-inline">an
				extreme and unusual fuel or fuel additive supply circumstance exists in a State
				or region that prevents the distribution of an adequate supply of the fuel or
				fuel additive to consumers;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID0703CEBA7F5A4D9EBD1B27272F67CD22"><enum>(ii)</enum><text display-inline="yes-display-inline">the extreme and unusual fuel or fuel
				additive supply circumstance is the result of a natural disaster, an act of
				God, a pipeline or refinery equipment failure, or another event that could not
				reasonably have been foreseen or prevented and not a lack of prudent planning
				on the part of the suppliers of the fuel or fuel additive to the State or
				region; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDB86E56F659784ECA81B84A99B9A1B7C6"><enum>(iii)</enum><text display-inline="yes-display-inline">it is in the public interest to grant the
				waiver.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6940C83E912F4163B6BD12C363A70682" indent="up2"><enum>(E)</enum><header display-inline="yes-display-inline">Requirements for waiver</header>
						<clause commented="no" display-inline="no-display-inline" id="ID73A73ADC33BC4AAE86F32A4DEFB8C98C"><enum>(i)</enum><header display-inline="yes-display-inline">Definition of motor fuel distribution
				system</header><text display-inline="yes-display-inline">In this subparagraph,
				the term <term>motor fuel distribution system</term> has the meaning given the
				term by the Administrator, by regulation.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID02D1D1796C58417AA3A656DBA84AA7AA"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A waiver under subparagraph (D) shall be
				permitted only if—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID5D0A3394EB4B442F972092EDF48FEA56"><enum>(I)</enum><text display-inline="yes-display-inline">the waiver applies to the smallest
				geographic area necessary to address the extreme and unusual fuel or fuel
				additive supply circumstance;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDFDFCDBDF3BDA424B8E98CA822A125F70"><enum>(II)</enum><text display-inline="yes-display-inline">the waiver is effective for a period of 15
				calendar days or, if the Administrator determines that a shorter or longer
				waiver period is adequate, for the shortest practicable time period necessary
				to permit the correction of the extreme and unusual fuel or fuel additive
				supply circumstances and to mitigate impact on air quality;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDA08A978358F6400C94C3D52CE491379C"><enum>(III)</enum><text display-inline="yes-display-inline">the waiver permits a transitional period,
				the duration of which shall be determined by the Administrator, after the
				termination of the temporary waiver to permit wholesalers and retailers to
				blend down wholesale and retail inventory;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDA3DC2916A09D47349D15C46EFE8DEDD5"><enum>(IV)</enum><text display-inline="yes-display-inline">the waiver applies to all persons in the
				motor fuel distribution system; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDD24D6FB0730444DCB9EDB444CADBC3E1"><enum>(V)</enum><text display-inline="yes-display-inline">the Administrator has given public notice
				regarding consideration by the Administrator of, and, if applicable, the
				granting of, a waiver to all parties in the motor fuel distribution system,
				State and local regulators, public interest groups, and consumers in the State
				or region to be covered by the waiver.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3A48BA25D06248BBAAA62B45D36822E0" indent="up2"><enum>(F)</enum><header display-inline="yes-display-inline">Affect on waiver authority</header><text display-inline="yes-display-inline">Nothing in subparagraph (D)—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID724745ACC476467EBA616E4EFAE91239"><enum>(i)</enum><text display-inline="yes-display-inline">limits or otherwise affects the application
				of any other waiver authority of the Administrator under this section or a
				regulation promulgated pursuant to this section; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID34C53D80CCCB4B67A01B4D60F6D5AE7B"><enum>(ii)</enum><text display-inline="yes-display-inline">subjects any State or person to an
				enforcement action, penalties, or liability solely arising from actions taken
				pursuant to the issuance of a waiver under subparagraph
				(D).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
