		<official-title display="yes">To limit or deny civil service protection
		  for a Federal employee if the appointment of that employee is a prohibited
		  personnel practice that was made on the basis of political affiliation as
		  prohibited under any law, rule, or regulation.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Political Independence of the Civil
			 Service Act of 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id87A3B092689B4EADAB8E1AB53EF833CC" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Political independence of the Civil
			 Service</header>
			<subsection commented="no" display-inline="no-display-inline" id="id3E324CA551E742D0B4B73762B6D3EFE3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 75 of title 5, United States Code,
			 is amended by adding at the end the following:</text>

					<subchapter commented="no" id="idC0AA9819324A4B11AE396F44C1477A98" level-type="subsequent"><enum>VI</enum><header display-inline="yes-display-inline">Civil service protection for employee
				appointed on prohibited basis of political affiliation</header>
						<section commented="no" display-inline="no-display-inline" id="idD50DEB31487343938B3A2EE41BE0BF76" section-type="subsequent-section"><enum>7551.</enum><header display-inline="yes-display-inline">Civil service protection for employee
				appointed on prohibited basis of political affiliation</header>
							<subsection commented="no" display-inline="no-display-inline" id="id601B3B2527304ADBA7A9F7875A751917"><enum>(a)</enum><text display-inline="yes-display-inline">In this section—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id590749231B55427D8F025178CB7D36EA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the
				meaning given under section 2302(a)(2)(C);</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA452F3507CF74621801D04B69DD2D68B"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered employee</term>
				means an employee whose appointment to an agency is a prohibited appointment;
				and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBEDA034B05848FEB3BC28220DD10222"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>prohibited
				appointment</term> means any appointment of an employee to an agency which is a
				prohibited personnel practice that violates section 2302 (b)(1)(E) because such
				appointment was made on the basis of political affiliation as prohibited under
				any law, rule, or regulation.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFCFBC545FAC94E2895EEE53FC650F579"><enum>(b)</enum><text display-inline="yes-display-inline">The protections under subchapters I through
				V of this chapter shall not apply to a covered
				employee.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFCECAFB129BA4A8C951B3914270FFD42"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 75 of title 5, United States Code, is amended by adding at
			 the end the following:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id51F2AB8743734E51B70A5B962EBBCC62" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on the date of enactment of this Act and apply to
			 any appointment made before, on, or after that date.</text>
