		<section commented="no" display-inline="no-display-inline" id="idC0A9D56411AF403A8CC50B7E03AA2DBC" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Minerals Management Service</header>
			<subsection commented="no" display-inline="no-display-inline" id="idA4D285A4F40644D381C64078DF224349"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF34F45CFE39A48DE9DB034B94D3A91B7"><enum>(1)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
			 Department of the Interior.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9052C1A0CD94DF69971761E0EE695BF"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the
			 Director of the Service.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3FF125D3956D48789952C8E658FB2A06"><enum>(3)</enum><header display-inline="yes-display-inline">Royalty-in-kind program</header><text display-inline="yes-display-inline">The term <term>royalty-in-kind
			 program</term> means the program established under—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id810A0EA448894B23888158C35A3D6CB8"><enum>(A)</enum><text display-inline="yes-display-inline">section 342 of the Energy Policy Act of
			 2005 (42 U.S.C. 15902);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5FA94608FAA040F68BB4E038CCE738EA"><enum>(B)</enum><text display-inline="yes-display-inline">section 36 of the Mineral Leasing Act (30
			 U.S.C. 192);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0994C430C7A1430BB3499BEAFA475DC0"><enum>(C)</enum><text display-inline="yes-display-inline">section 27 of the Outer Continental Shelf
			 Lands Act (43 U.S.C. 1353); or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76DE796CD6F843C2B7EE1161A619252B"><enum>(D)</enum><text display-inline="yes-display-inline">any other similar provision of law.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8A56FCBFE35145EEB9C6660D0BBB76BA"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5824498B6E4B4ED988A8209FE9EB4ED1"><enum>(5)</enum><header display-inline="yes-display-inline">Service</header><text display-inline="yes-display-inline">The term <term>Service</term> means the
			 Minerals Management Service.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id322E2F9073BC489BA6EF67CA44C7CF76"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idA4F16CDB1BEE4636B07A5F7150F0217B"><enum>(1)</enum><text display-inline="yes-display-inline">establish and maintain within the
			 Department the Minerals Management Service; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48F319DF95E34037B5C22041D9D28DEB"><enum>(2)</enum><text display-inline="yes-display-inline">assign to the Service such functions as the
			 Secretary considers appropriate.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id494C858B5A2F4EDBB608C12FA927C0C5"><enum>(c)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The Service shall be headed by a Director
			 who shall be appointed by the President, by and with the advice and consent of
			 the Senate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id39B055B94603414EAFF4B594ADB4EBA7"><enum>(d)</enum><header display-inline="yes-display-inline">Audits</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDa84c55220aa945139fc482fbe9ac1d27"><enum>(1)</enum><header display-inline="yes-display-inline">Royalty
			 audits</header><text display-inline="yes-display-inline">The Director shall
			 ensure that the Service implements a comprehensive program of financial audits
			 of royalty payments and adjustments, including physical on-site audits, on the
			 basis of risk and statistical samples.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3f3abd528a7b4822a60f1f1a4f5da222"><enum>(2)</enum><header display-inline="yes-display-inline">Standards</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Director shall promulgate regulations that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB5C313F87158403BA9FEDA94203A58A2"><enum>(A)</enum><text display-inline="yes-display-inline">require that all employees of the Service
			 that conduct audits and compliance reviews meet professional auditor
			 qualifications that are consistent with the latest revision of the Government
			 Auditing Standards published by the Government Accountability Office;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6A9D08E74C934B3CBE7ECEA5E624EB6B"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that all audits conducted by the
			 Service are performed in accordance with the standards.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F1023CF2CF34542B361EB798BF12D76"><enum>(3)</enum><header display-inline="yes-display-inline">Inspector General</header><text display-inline="yes-display-inline">The Inspector General of the Department
			 shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id58BF52A223F64EAEAC95C9512DC4EDA3"><enum>(A)</enum><text display-inline="yes-display-inline">conduct, annually and as necessary, audits
			 of activities of the Service, including leasing and royalty activities;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10CC1EED8FDB46209E98DA7AC15A2C1B"><enum>(B)</enum><text display-inline="yes-display-inline">report the results of the audits of
			 activities of the Service (including leasing and royalty activities) and the
			 certifications required under subsection (e) to—</text>
						<clause commented="no" display-inline="no-display-inline" id="id8D81C6F2E9DB421E9BBD97349B63936F"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural
			 Resources of the Senate;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idE6F91958A7FE462AA02E10A4A1EFDF49"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the
			 House of Representatives; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idDA786A5AE03E4CA0AF7241A46FAA396B"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA584D6BE9B7C4C7F858BA749822D7714"><enum>(e)</enum><header display-inline="yes-display-inline">Royalties-in-kind program</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID64991c47cad64d67837e3b9675d3d901"><enum>(1)</enum><header display-inline="yes-display-inline">Initial certification</header><text display-inline="yes-display-inline">Subject to paragraph (3), not later than 60
			 days after the date of enactment of this Act, the Secretary shall submit to
			 Congress a certification that all of the recommendations made by the Office of
			 the Inspector General of the Department as the result of investigations that
			 culminated in a memorandum dated September 9, 2008, and a report dated May 2008
			 (C–EV–MMS–001–2008), with respect to the royalty-in-kind program have been
			 implemented.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4c3aebceb61a4aad822e6cf837cf80be"><enum>(2)</enum><header display-inline="yes-display-inline">Annual certifications</header><text display-inline="yes-display-inline">Subject to paragraph (3), not later than 1
			 year after the date of enactment of this Act and each year thereafter, the
			 Secretary shall submit to Congress a certification that the royalty-in-kind
			 program is in full compliance with Federal law (including regulations)
			 governing procurement and ethics.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5ca02d7b5b1b4ae1bd49762f9588282a"><enum>(3)</enum><header display-inline="yes-display-inline">Suspension</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 if the Secretary fails to make a certification required under paragraph (1) or
			 (2), the authority of the Secretary to carry out each royalty-in-kind program
			 is suspended during the period—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id62EFB78C696E4ED997A230613D226DB4"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the day after the deadline for
			 the certification under that paragraph; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2AF911DA026344558DB283F0E1C51195"><enum>(B)</enum><text display-inline="yes-display-inline">ending on the date the Secretary makes the
			 certification required under that paragraph.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
