			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Economic Development
			 Revitalization Act of 2008</short-title></quote>.</text>
		</section><section id="idCA0B75D583084DB7B3A4829BE654B329" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3(8) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3122(8)) is amended—</text>
			<paragraph id="id18D9668E68E74FC4B81413FAA60ACB72"><enum>(1)</enum><text>in subparagraph
			 (C), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="idF43BB40DCCD145129FDF9B32701D9C19"><enum>(2)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="id2AAB4F667517449F9D7A848C02391A06"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE7988AAA2A2943E8B37D75DDD76EE28B" style="OLC">
					<subparagraph id="idC941019EE55E44748ACF9FFF50BB6591"><enum>(E)</enum><text>the Southeast
				Crescent Regional Commission, Northern Border Regional Commission, and
				Southwest Border Regional Commission established by section 15301(a) of title
				40, United States
				Code.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idEAD3EC1FB5A54BA4B5075BC83DBE39D0" section-type="subsequent-section"><enum>3.</enum><header>Economic development
			 partnerships</header><text display-inline="no-display-inline">Section 101 of
			 the Public Works and Economic Development Act of 1965 (42 U.S.C. 3131) is
			 amended—</text>
			<paragraph id="idCD505464BF81415598D3189FC525959A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph id="idB5241D58D37B40C3844A529FC921E533"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by
			 inserting <quote>economic development districts, university centers,</quote>
			 after <quote>multi-State regional organizations,</quote>; and</text>
				</subparagraph><subparagraph id="idC1AFA7DE3C044EC19F13F238D409E504"><enum>(B)</enum><text>in paragraph (3),
			 by inserting <quote>, innovation, entrepreneurship, sustainable
			 development,</quote> after <quote>infrastructure</quote>;</text>
				</subparagraph></paragraph><paragraph id="id2F2F9CDCF0AE4BA0A149A290B81C0262"><enum>(2)</enum><text>in subsection
			 (c), by inserting <quote>(including economic development districts)</quote>
			 after <quote>local government agencies</quote>; and</text>
			</paragraph><paragraph id="id0F46236FD21C4142A8EBFB3E5BD5CED0"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB64136E93C7044FF9EA74417EDFFC73F" style="OLC">
					<subsection id="ID595c13b4604844e59df69bf06fa08dc2"><enum>(e)</enum><header>Excellence in
				economic development awards</header>
						<paragraph id="id2C186FA8C61C4F78B7C4547B986A816E"><enum>(1)</enum><header>Establishment
				of program</header><text>To recognize innovative economic development
				strategies of national significance, the Secretary may establish and carry out
				a program, to be known as the <quote>Excellence in Economic Development Award
				Program</quote> (referred to in this subsection as the
				<term>program</term>).</text>
						</paragraph><paragraph id="idE0C240A3908349D493E00A925AEF9E60"><enum>(2)</enum><header>Eligible
				entities</header><text>To be eligible for recognition under the program, an
				entity shall be an eligible recipient that is not a for-profit organization or
				institution.</text>
						</paragraph><paragraph id="id167C93E790394097820A4A81C678F486"><enum>(3)</enum><header>Nominations</header><text>Before
				making an award under the program, the Secretary shall solicit nominations
				publicly, in accordance with such selection and evaluation procedures as the
				Secretary may establish in the solicitation.</text>
						</paragraph><paragraph id="idDFCF006A0779426CA957A8C8EDC3C659"><enum>(4)</enum><header>Categories</header><text>The
				categories of awards under the program shall include awards for—</text>
							<subparagraph id="ID025b2bb9d4e64a1cbcfdbf53b6aa2fab"><enum>(A)</enum><text>urban or suburban
				economic development;</text>
							</subparagraph><subparagraph id="ID674e534c8ff24f489ff205da595b324c"><enum>(B)</enum><text>rural economic
				development;</text>
							</subparagraph><subparagraph id="ID67d7665b97424dcd94ff1dfbacc3edbb"><enum>(C)</enum><text>environmental or
				energy economic development;</text>
							</subparagraph><subparagraph id="ID1621926c43384848acf602bd78c39695"><enum>(D)</enum><text>economic
				diversification strategies that respond to economic dislocations, including
				economic dislocations caused by natural disasters and military base realignment
				and closure actions;</text>
							</subparagraph><subparagraph id="IDcca593eef7104c1ba842c7b7a79527d7"><enum>(E)</enum><text>university-led
				strategies to enhance economic development;</text>
							</subparagraph><subparagraph id="IDe88925a23e5f46639f79800cc4b6fed5"><enum>(F)</enum><text>community
				entrepreneurship;</text>
							</subparagraph><subparagraph id="IDdce6a7dfd1d8495abad90efd485ff160"><enum>(G)</enum><text>historic
				preservation-led strategies to enhance economic development; and</text>
							</subparagraph><subparagraph id="ID71e9d7add42545ef80bbaac2c451fca4"><enum>(H)</enum><text>such other
				categories as the Secretary determines to be appropriate.</text>
							</subparagraph></paragraph><paragraph id="id6078A86BE39249EDB5AE5F1E7C2F27A2"><enum>(5)</enum><header>Provision of
				awards</header><text>The Secretary may provide to each entity selected to
				receive an award under this subsection a plaque, bowl, or similar article to
				commemorate the accomplishments of the entity.</text>
						</paragraph><paragraph id="id80BD7969535F47F2B0847E26B9702BC2"><enum>(6)</enum><header>Funding</header><text>Of
				amounts made available to carry out this Act, the Secretary may use not more
				than $2,000 for each fiscal year to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id228DAFFC0B894C208FCB6C1CF429C999"><enum>4.</enum><header>Grants for
			 planning and grants for administrative expenses</header><text display-inline="no-display-inline">Section 203 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3143) is amended—</text>
			<paragraph id="idC5853DE6A3BD4C9F97781A1227D2D318"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="id3B6F1AC9F94043AFBECCA64FCC9ACB6B"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="idE7F41CC8D93F4BBD8E24EB7BDD6DA11F"><enum>(B)</enum><text>in paragraph (4),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</subparagraph><subparagraph id="id551B5E59AC7047AEAFA6C30F0BCA157F"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id9C411EBCDFB64B19949CE28F0D27D44C" style="OLC">
						<paragraph id="IDa230d637d831412ca234e3459c67a88f"><enum>(5)</enum><text>fostering
				regional collaboration among local jurisdictions and
				organizations.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id3FFEF4A3924548B19AD3E0CE43430622"><enum>(2)</enum><text>in subsection
			 (d)(5), by striking <quote>subsection shall</quote> and all that follows
			 through the end of the paragraph and inserting the following: “subsection
			 shall—</text>
				<quoted-block display-inline="no-display-inline" id="idB95CD06DBA274A0FA4E37253BC9CD2F6" style="OLC">
					<subparagraph id="id61C094278FF94DA1991E0F83177F856C"><enum>(A)</enum><text>submit to the
				Secretary an annual report on the planning process assisted under this
				subsection; and</text>
					</subparagraph><subparagraph id="IDaf746f96006441d19e982cd54d4a5bce"><enum>(B)</enum><text>provide a copy of
				each annual report to each economic development district within the
				State.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idBBC1FFF9077A49B9A311F0C7C917A166"><enum>5.</enum><header>Cost
			 sharing</header>
			<subsection id="id911981B749374DA3BFFF68E54CECA790"><enum>(a)</enum><header>Federal
			 share</header><text>Section 204(a) of the Public Works and Economic Development
			 Act of 1965 (42 U.S.C. 3144(a)) is amended by striking <quote>shall not
			 exceed—</quote> and all that follows through the end of the subsection and
			 inserting <quote>shall not exceed 50 percent.</quote>.</text>
			</subsection><subsection id="idF3C30FF781624A3393B36A4B0D706539"><enum>(b)</enum><header>Increase in
			 Federal share</header><text display-inline="yes-display-inline">Section 204(c)
			 of the Public Works and Economic Development Act of 1965 (42 U.S.C. 3144(c)) is
			 amended—</text>
				<paragraph id="idF0C8893F651C495B9455B9200692FC10"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (3)
			 as paragraphs (2) through (4), respectively;</text>
				</paragraph><paragraph id="id3A0B67C7A542428889A624FE70D590DF"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB151CE1A285248418266F1E0586493B2" style="OLC">
						<paragraph id="ID67de1eb18b464112817011fcb1a08f45"><enum>(1)</enum><header>Relative needs
				of an area</header>
							<subparagraph id="ID129cf28193114a7ab440b786ad65b101"><enum>(A)</enum><header>150-percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 150 percent of the
				national average or the per capita income is not more than 70 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 60 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="ID4d7379060c3d412d833e4a8a7b2156a6"><enum>(B)</enum><header>175-percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 175 percent of the
				national average or the per capita income is not more than 60 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 70 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="IDb4331b3d35b04313a5ecb7597b81d1c5"><enum>(C)</enum><header>200-percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 200 percent of the
				national average or the per capita income is not more than 50 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 80 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="IDc48f030f5c2442c8ad93332078c52035"><enum>(D)</enum><header>Additional
				criteria</header><text>The Secretary may establish eligibility criteria in
				addition to the criteria described in this paragraph to address areas impacted
				by severe outmigration, sudden and severe economic dislocations, and other
				related economic
				circumstances.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDb61c57d3b82844a5a5c52629fad328b0"><enum>(3)</enum><text>in paragraph (2)
			 (as redesignated by paragraph (1))—</text>
					<subparagraph id="idA32280B9C0ED4FACB7423960A1891F6B"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph id="id8A36D6DA3D3242C5BF0C260383C62B8E"><enum>(B)</enum><text>by inserting
			 <quote>to 75 percent of the cost of the project, and may increase</quote> after
			 <quote>subsection (a)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="idE56AB8F34A964F0DBDD6B42A615D892E"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2AC3F2B2D0FB44FFA321BE4C34389B10" style="OLC">
						<paragraph id="ID4ef1088f0a1d45caa60fc566da475597"><enum>(5)</enum><header>Federally
				declared disaster areas</header><text>In the case of a grant for an area with
				respect to which a major disaster or emergency has been declared under the
				Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121
				et seq.) during the 18-month period ending on the date on which the Federal
				share is determined, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 100 percent of the cost of the
				project.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idDC18B7884D434145B5198E1CCA7C66A8"><enum>6.</enum><header>Grants for
			 training, research, and technical assistance</header><text display-inline="no-display-inline">Section 207(a) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3147(a)) is amended—</text>
			<paragraph id="id622DDF3E1A7249D38415214C3D343B78"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>, outmigration,</quote> after <quote>unemployment</quote>;
			 and</text>
			</paragraph><paragraph id="idBB0A375DD7BD4861BD853EBDE594FCFF"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="idA4FCA3878E704353B4AF7C45C944B78F"><enum>(A)</enum><text>in subparagraph
			 (H), by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="id4125E64476774027B6C1FF82FC64EAA7"><enum>(B)</enum><text>by redesignating
			 subparagraph (I) as subparagraph (J); and</text>
				</subparagraph><subparagraph id="id67F2BB302B084BE29DEFE4914F936B79"><enum>(C)</enum><text>by inserting
			 after subparagraph (H) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3161E15736D246F8AA01B4CCFA59ABC5" style="OLC">
						<subparagraph id="idD9DA739FD11F4BB99EADF11DDEFC2A57"><enum>(I)</enum><text>a peer exchange
				program to promote industry-leading practices and innovations relating to the
				organizational development, program delivery, and regional initiatives of
				economic development districts;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="idC5F3DEE706804720B6E3F2D906492243"><enum>7.</enum><header>Enhancement of
			 recipient flexibility to deal with project assets</header>
			<subsection id="id8CC719D568AB4D959C4F82430B041304"><enum>(a)</enum><header>Particular
			 community assistance</header><text>Section 209(c)(5) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3149(c)(5)) is amended by inserting
			 <quote>, natural resource-based, agricultural, or service sector</quote> after
			 <quote>manufacturing</quote>.</text>
			</subsection><subsection id="id7DAC9C4D31904CB98F8A58127B0C1ECE"><enum>(b)</enum><header>Revolving loan
			 fund program flexibility</header><text>Section 209(d) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3149(d)) is amended—</text>
				<paragraph id="id302ECDA5741949729FFB16140646CEAE"><enum>(1)</enum><text>by redesignating
			 paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text>
				</paragraph><paragraph id="id3FCD23DCA2C14CEEAD974CFC9295365C"><enum>(2)</enum><text>by inserting
			 after paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id85A6521375EF4436A03B17031F5E51EE" style="OLC">
						<paragraph id="ID707c60c1ba854f918368e53fe36d703e"><enum>(2)</enum><header>Comments</header>
							<subparagraph id="id9061E96A955B4DF5B7CA3EECF81C609C"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall periodically solicit from the
				individuals and entities described in subparagraph (B)—</text>
								<clause id="id8CA65DDDA22148C180CF9BD6F1F82ADF"><enum>(i)</enum><text>comments
				regarding the guidelines and performance requirements for the revolving loan
				fund program; and</text>
								</clause><clause id="id669A184D17DF4961A6CBC025EA30B0C9"><enum>(ii)</enum><text>recommendations
				for improving the performance of the program and grantees under the
				program.</text>
								</clause></subparagraph><subparagraph id="id0DE1C0BC27F0497DA7CEA986789D83F6"><enum>(B)</enum><header>Description of
				individuals and entities</header><text>The individuals and entities referred to
				in subparagraph (A) are—</text>
								<clause id="id5A239CC0E6034AB1A618990E4C49DF41"><enum>(i)</enum><text>the public;
				and</text>
								</clause><clause id="id118DA8EF635444239D71B89467012DEA"><enum>(ii)</enum><text>in particular,
				revolving loan fund grantees, national experts, and employees of Federal
				agencies with knowledge of international, national, regional, and statewide
				trends, innovations, and noteworthy practices relating to business development
				finance, including public and private lending and technical assistance
				intermediaries.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id79981E29F66E4E61B3BBD35EC102A4CE"><enum>(3)</enum><text>in subparagraph
			 (A) of paragraph (5) (as redesignated by paragraph (1)), by striking
			 <quote>paragraph (2)(C)</quote> and inserting <quote>paragraph (3)(C)</quote>;
			 and</text>
				</paragraph><paragraph id="id7DE2B7E39D2546FD919691C9A26A1C3A"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id06E1DCDB5135437596F0C099E38BF943" style="OLC">
						<paragraph id="ID612b7646830648c19d52932b32f53768"><enum>(6)</enum><header>Conversion of
				project assets</header>
							<subparagraph id="id3A11E82D6CB247F89EF5AE68AE38A861"><enum>(A)</enum><header>Request</header><text>If
				a recipient determines that a revolving loan fund established using assistance
				provided under this section is no longer needed, or that the recipient could
				make better use of the assistance in light of the current economic development
				needs of the recipient if the assistance was made available to carry out any
				other project that meets the requirements of this Act, the recipient may submit
				to the Secretary a request to approve the conversion of the assistance.</text>
							</subparagraph><subparagraph id="idE07C0F948AD548ADAD945538C88256F8"><enum>(B)</enum><header>Methods of
				conversion</header><text>A recipient the request to convert assistance of which
				is approved under subparagraph (A) may accomplish the conversion by—</text>
								<clause id="id989C397759274388BAE0D59ED437F7A7"><enum>(i)</enum><text>selling to a
				third party any assets of the applicable revolving loan fund; or</text>
								</clause><clause id="id9D962209831A49CBAB3F550F47499B3D"><enum>(ii)</enum><text>retaining
				repayments of principal and interest amounts on loans provided through the
				applicable revolving loan fund.</text>
								</clause></subparagraph><subparagraph id="idC5616F4FE5484358A64D6EA648D9F8F0"><enum>(C)</enum><header>Requirements</header>
								<clause id="id789123DCE31F4213841233532B540DF9"><enum>(i)</enum><header>Sale</header>
									<subclause id="id1778BB62F6914864A0CDEB7596FCED7E"><enum>(I)</enum><header>In
				general</header><text>Subject to subclause (II), a recipient shall use the net
				proceeds from a sale of assets under subparagraph (B)(i) to pay any portion of
				the costs of 1 or more projects that meet the requirements of this Act.</text>
									</subclause><subclause id="idD6F9B88B84FC4EF0BA9285A352878D00"><enum>(II)</enum><header>Treatment</header><text>For
				purposes of subclause (I), a project described in that subclause shall be
				considered to be eligible under section 301.</text>
									</subclause></clause><clause id="idFF428736EDCC4BB480F6A4839E732A99"><enum>(ii)</enum><header>Retention of
				repayments</header><text>Retention by a recipient of any repayment under
				subparagraph (B)(ii) shall be carried out in accordance with a strategic reuse
				plan approved by the Secretary that provides for the increase of capital over
				time until sufficient amounts (including interest earned on the amounts) are
				accumulated to fund other projects that meet the requirements of this
				Act.</text>
								</clause></subparagraph><subparagraph id="id557A7FCE57EF4281B11FD21A3629ABD1"><enum>(D)</enum><header>Terms and
				conditions</header><text>The Secretary may require such terms and conditions
				regarding a proposed conversion of the use of assistance under this paragraph
				as the Secretary determines to be appropriate.</text>
							</subparagraph><subparagraph id="id8FC002B06C974E449B04BF789E4DE7EC"><enum>(E)</enum><header>Expediency
				requirement</header><text>The Secretary shall ensure that any assistance
				intended to be converted for use pursuant to this paragraph is used in an
				expeditious manner.</text>
							</subparagraph></paragraph><paragraph id="ID896cb854dd6e4d279823a5a2a3b0b23f"><enum>(7)</enum><header>Program
				administration</header><text>The Secretary may allocate not more than 2 percent
				of the amounts made available for grants under this section for the development
				and maintenance of an automated tracking and monitoring system to ensure the
				proper operation and financial integrity of the revolving loan program
				established under this
				section.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idA54ED25F1E064B52B4857B59335EC2AD"><enum>8.</enum><header>Brightfields
			 demonstration program</header><text display-inline="no-display-inline">Section
			 218(d) of the Public Works and Economic Development Act of 1965 (42 U.S.C.
			 3154d(d)) is amended by striking <quote>2004 through 2008</quote> and inserting
			 <quote>2009 through 2013</quote>.</text>
		</section><section id="idC8939FDBD3424BF3B207C32B2B50F84E"><enum>9.</enum><header>Designation of
			 economic development districts</header><text display-inline="no-display-inline">Section 401 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3171) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idF3E6807E545E46A6AF1DE6CF443D771F" style="OLC">
				<subsection id="ID2034b81cc0534a9d967d993237804b93"><enum>(c)</enum><header>Operations</header>
					<paragraph id="ID0a70c6ea3f894d3599dc1df39a2e0c64"><enum>(1)</enum><header>In
				general</header><text>Each economic development district shall engage in the
				full range of economic development activities included in the list contained in
				the comprehensive economic development strategy of the economic development
				district that has been approved by the Economic Development Administration,
				including—</text>
						<subparagraph id="IDd7e79a02fe264ff8908debd845462e6f"><enum>(A)</enum><text>coordinating and
				implementing economic development activities in the economic development
				district;</text>
						</subparagraph><subparagraph id="ID2411ae1ffb97476b8dd1efa909ef4d56"><enum>(B)</enum><text>carrying out
				economic development research, planning, implementation, and advisory functions
				identified in the comprehensive economic development strategy; and</text>
						</subparagraph><subparagraph id="ID1dc61568b7834de1b5076d78ad89308a"><enum>(C)</enum><text>coordinating the
				development and implementation of the comprehensive economic development
				strategy with other local, State, Federal, and private organizations.</text>
						</subparagraph></paragraph><paragraph id="IDbf5f4c5bb23545e7bca8e0403f6d2aa1"><enum>(2)</enum><header>Contracts</header><text>An
				economic development district may elect to enter into contracts for services to
				accomplish the activities described in paragraph
				(1).</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idC288408DF5C3409E9C28C5F51ACF5131"><enum>10.</enum><header>Consultation
			 with other persons and agencies</header><text display-inline="no-display-inline">Section 503(a) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3193(a)) is amended by inserting
			 <quote>, outmigration,</quote> after <quote>regional
			 unemployment</quote>.</text>
		</section><section id="idB88C4E33755945BF8A846D26FF3FD10C"><enum>11.</enum><header>Notification of
			 reorganization</header><text display-inline="no-display-inline">Section 507 of
			 the Public Works and Economic Development Act of 1965 (42 U.S.C. 3197) is
			 amended—</text>
			<paragraph id="idD7586EEA9ECB4844B78347488DFA46B5"><enum>(1)</enum><text>by striking
			 <quote>Not later than</quote> and inserting the following:</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id6DDDBE74A1E0428C9EDE422240415962"><enum>12.</enum><header>Maintenance of
			 effort</header><text display-inline="no-display-inline">Title VI of the Public
			 Works and Economic Development Act of 1965 (42 U.S.C. 3211 et seq.) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idF3215D8EC2D14C3AB535586F0EC1074D" style="OLC">
				<section id="id45F5B469BD844877AAED36D4DC4C6399"><enum>613.</enum><header>Maintenance of
				effort</header>
					<subsection id="idF609C38CDD9A407FB70499A1E908DB91"><enum>(a)</enum><header>Expected period
				of best efforts</header>
						<paragraph id="id71EAED524DBC489C9C9BF6630F0050B9"><enum>(1)</enum><header>Establishment</header><text>To
				carry out the purposes of this Act, before providing investment assistance for
				a construction project under this Act, the Secretary shall establish the
				expected period during which the recipient of the assistance shall make best
				efforts to achieve the economic development objectives of the
				assistance.</text>
						</paragraph><paragraph id="idFF4FFF48123A42C3A339921E2F7123B3"><enum>(2)</enum><header>Treatment of
				property</header><text>To obtain the best efforts of a recipient during the
				period established under paragraph (1), during that period—</text>
							<subparagraph id="id4E1FFDB0DDD74522832DBDB7027CF329"><enum>(A)</enum><text>any property that
				is acquired or improved, in whole or in part, using investment assistance under
				this Act shall be held in trust by the recipient for the benefit of the
				project; and</text>
							</subparagraph><subparagraph id="id9F5AEF5E7B6646019433451415BA2E31"><enum>(B)</enum><text>the Secretary
				shall retain an undivided equitable reversionary interest in the
				property.</text>
							</subparagraph></paragraph><paragraph id="id22E72E0E7E1849C7BF5D943FC69FC900"><enum>(3)</enum><header>Termination of
				Federal interest</header>
							<subparagraph id="idB0D46EF5A8104F148BF980A664540C44"><enum>(A)</enum><header>In
				general</header><text>Beginning on the date on which the Secretary determines
				that a recipient has fulfilled the obligations of the recipient for the
				applicable period under paragraph (1), taking into consideration the economic
				conditions existing during that period, the Secretary may terminate the
				reversionary interest of the Secretary in any applicable property under
				paragraph (2)(B).</text>
							</subparagraph><subparagraph id="id6090C5DA47FE49A6A8F29AF2D10DE4FE"><enum>(B)</enum><header>Alternative
				method of termination</header>
								<clause id="id67F1A5DCCC154FAD9D3386E3304827B8"><enum>(i)</enum><header>In
				general</header><text>On a determination by a recipient that the economic
				development needs of the recipient have changed during the period beginning on
				the date on which investment assistance for a construction project is provided
				under this Act and ending on the expiration of the expected period established
				for the project under paragraph (1), the recipient may submit to the Secretary
				a request to terminate the reversionary interest of the Secretary in property
				of the project under paragraph (2)(B) before the date described in subparagraph
				(A).</text>
								</clause><clause id="id4D23FC5DAF744FD4BA2DD6644A95837A"><enum>(ii)</enum><header>Approval</header><text>The
				Secretary may approve a request of a recipient under clause (i) if—</text>
									<subclause id="id812850BFC97F4818A012AF036FC2F7AB"><enum>(I)</enum><text>in any case in
				which the request is submitted during the 10-year period beginning on the date
				on which assistance is initially provided under this Act for the applicable
				project, the recipient repays to the Secretary an amount equal to 100 percent
				of the fair market value of the pro rata Federal share of the project;
				or</text>
									</subclause><subclause id="id1A79B73F94C84012B78389215C31D1D0"><enum>(II)</enum><text>in any case in
				which the request is submitted after the expiration of the 10-year period
				described in subclause (I), the recipient repays to the Secretary an amount
				equal to the fair market value of the pro rata Federal share of the project as
				if that value had been amortized over the period established under paragraph
				(1), based on a straight-line depreciation of the project throughout the
				estimated useful life of the project.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="id0ACF52746AD9480798674D38628F4CA0"><enum>(b)</enum><header>Terms and
				conditions</header><text>The Secretary may establish such terms and conditions
				under this section as the Secretary determines to be appropriate, including by
				extending the period of a reversionary interest of the Secretary under
				subsection (a)(2)(B) in any case in which the Secretary determines that the
				performance of a recipient is unsatisfactory.</text>
					</subsection><subsection id="id7874D17F7721428C908712CA3FDDCA4B"><enum>(c)</enum><header>Previously
				extended assistance</header><text>With respect to any recipient to which the
				term of provision of assistance was extended under this Act before the date of
				enactment of this section, the Secretary may approve a request of the recipient
				under subsection (a) in accordance with the requirements of this section to
				ensure uniform administration of this Act, notwithstanding any estimated useful
				life period that otherwise relates to the assistance.</text>
					</subsection><subsection id="id4D0C2BD3F346465FB430DAD2D5029F3E"><enum>(d)</enum><header>Conversion of
				use</header><text>If a recipient of assistance under this Act demonstrates to
				the Secretary that the intended use of the project for which assistance was
				provided under this Act no longer represents the best use of the property used
				for the project, the Secretary may approve a request by the recipient to
				convert the property to a different use for the remainder of the term of the
				Federal interest in the property, subject to the condition that the new use
				shall be consistent with the purposes of this Act.</text>
					</subsection><subsection id="ID7bbebcaf090d4738953b085ca8bc2b37"><enum>(e)</enum><header>Status of
				authority</header><text>The authority of the Secretary under this section is in
				addition to any authority of the Secretary pursuant to any law or grant
				agreement in effect on the date of enactment of this
				section.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1EEC45AD14A34319B9AE757C9571D046"><enum>13.</enum><header>Extension of
			 authorization of appropriations</header><text display-inline="no-display-inline">Section 701(a) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3231(a)) is amended—</text>
			<paragraph id="ID0a347ece8ee34cb1a8ecc1ef6d314b2a"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>2004</quote> and inserting <quote>2009</quote>;</text>
			</paragraph><paragraph id="ID161fc6f60d8d4f2c93e87a489c9817a8"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>2005</quote> and inserting <quote>2010</quote>;</text>
			</paragraph><paragraph id="ID52ef65e3c0b64a21b301247c49e7456f"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>2006</quote> and inserting <quote>2011</quote>;</text>
			</paragraph><paragraph id="ID8f6c6beaca494427a0f7c00c0bd4f72d"><enum>(4)</enum><text>in paragraph (4),
			 by striking <quote>2007</quote> and inserting <quote>2012</quote>; and</text>

			</paragraph></section><section id="id51785380E2D64368B3957D4FFD165972"><enum>14.</enum><header>Funding for
			 grants for planning and grants for administrative expenses</header><text display-inline="no-display-inline">Section 704 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3234) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id042BE1AB5BA74D7A842DA0D340B76CDA" style="OLC">
				<section id="idFA1081975B934C37965ED465FF6CC474"><enum>704.</enum><header>Funding for
				grants for planning and grants for administrative expenses</header>
					<subsection id="IDb088189efaae46be9f44668a96a566ed"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), of the amounts made available
				under section 701 for each fiscal year, not less than $27,000,000 shall be made
				available to provide grants under section 203.</text>
					</subsection><subsection id="IDa521c230500a4a23829d97be1a6b1e53"><enum>(b)</enum><header>Subject to
				total appropriations</header><text>For any fiscal year, the amount made
				available pursuant to subsection (a) shall be increased to—</text>
						<paragraph id="ID172814c845e74b84ad4f38d60116bcf1"><enum>(1)</enum><text>$28,000,000, if
				the total amount made available under subsection 701(a) for the fiscal year is
				equal to or greater than $280,000,000;</text>
						</paragraph><paragraph id="ID2c05f959d37746248754d56d31fbafba"><enum>(2)</enum><text>$29,500,000, if
				the total amount made available under subsection 701(a) for the fiscal year is
				equal to or greater than $320,000,000;</text>
						</paragraph><paragraph id="IDc7c10964486d49bdad2cfcf78d8ab3da"><enum>(3)</enum><text>$31,000,000, if
				the total amount made available under subsection 701(a) for the fiscal year is
				equal to or greater than $350,000,000;</text>
						</paragraph><paragraph id="IDa9a1b4f922bb41c79ccf56b714e2bf77"><enum>(4)</enum><text>$32,500,000, if
				the total amount made available under subsection 701(a) for the fiscal year is
				equal to or greater than $380,000,000; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID113d7e34e1a548efb70970e94c3622ab"><enum>(5)</enum><text>$34,500,000, if
				the total amount made available under subsection 701(a) for the fiscal year is
				equal to or greater than
				$420,000,000.</text>
