		<official-title>To enhance after-school programs in rural areas of the
		  United States by establishing a pilot program to help communities establish and
		  improve rural after-school programs.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Investment in After-School
			 Programs Act of 2008</short-title></quote>.</text>
		</section><section id="idB684BED30B8749C880CB75DA8CC83148"><enum>2.</enum><header>After-school
			 programs</header><text display-inline="no-display-inline">Subtitle D of the
			 Consolidated Farm and Rural Development Act is amended by inserting after
			 section 365 (7 U.S.C. 2008) the following:</text>
			<quoted-block display-inline="no-display-inline" id="id7B43002C462649E9AE207064E5B29F72" style="OLC">
				<section id="idF2958831F39F4D8C80E373C21804797B"><enum>366.</enum><header>After-school
				Programs</header>
					<subsection id="idDFB2080C11764F8E8C1AAB19CECABFF9"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section is to enhance after-school programs in rural areas by
				helping communities—</text>
						<paragraph id="id6F40691C3B834965837E0A08DECD3C05"><enum>(1)</enum><text>to establish
				after-school programs; and</text>
						</paragraph><paragraph id="id492CB9B3383340FEA5A4F015E0DC57F5"><enum>(2)</enum><text>to improve
				existing programs by overcoming barriers to service.</text>
						</paragraph></subsection><subsection id="id6E18A55B49DA412393BF348D1BB5801C"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="id8758BB032387408FBDC12D4FB1F0545E"><enum>(1)</enum><header>After-school
				program</header><text>The term <quote>after-school program</quote> means a
				program that carries out a broad array of activities during periods when school
				is not in session (such as before school, after school, or during summer recess
				and other vacation periods) that advance student academic achievement and
				promote positive youth development.</text>
						</paragraph><paragraph id="idD9056878EB2E420897402F771AE96D20"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <quote>eligible entity</quote> means a local
				educational agency (as such term is defined in section 9101 of the Elementary
				and Secondary Education Act of 1965 (20 U.S.C. 7801)), community-based
				organization, another public or private entity, or a consortium of 2 or more
				such agencies, organizations, or entities.</text>
						</paragraph><paragraph id="id15BD112E6DCB4765A189F29201F97B8F"><enum>(3)</enum><header>Rural
				area</header><text>The term <quote>rural area</quote> means an area that is
				served by an elementary or secondary school that is designated with a school
				locale code of Distant Town, Remote Town, Fringe Rural, Distant Rural, or
				Remote Rural, as determined by the Secretary of Education.</text>
						</paragraph></subsection><subsection id="id868914C75DB34DDD9ABA832365CE0B9B"><enum>(c)</enum><header>Grants</header>
						<paragraph id="idBB937DE94F0C4F87BD8211785CD178E7"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall make grants to eligible entities to
				improve, expand, or establish after-school programs in rural areas.</text>
						</paragraph><paragraph id="id62781B2F9C784BDCB9E029DEEE6686CC"><enum>(2)</enum><header>Requirement</header><text>Each
				grant under this section shall be in an amount of not less than $50,000.</text>
						</paragraph></subsection><subsection id="idCB265817737C4C5DBCE862A7F9319D5D"><enum>(d)</enum><header>Duration</header>
						<paragraph id="idF63417DB124441F9903367095D560192"><enum>(1)</enum><header>Term of
				grant</header><text>The term of a grant under this section may not be for less
				than 3 years.</text>
						</paragraph><paragraph id="id1A2DB69E374D49F9A32A4CC7F87354DC"><enum>(2)</enum><header>Renewal</header><text>The
				Secretary may renew a grant under this section for a period of not less than 3
				years, based on the performance of the eligible entity during the previous
				grant term.</text>
						</paragraph></subsection><subsection id="idF6DF1137CF9E4D1BAA6C81BA1A4818F4"><enum>(e)</enum><header>Uses</header><text>As
				a condition of the receipt of a grant under this section, an eligible entity
				shall use the grant to fund projects and activities described in subsection
				(c), including transportation, professional development, training, recruitment
				and retention of staff, increasing access to technology, and planning.</text>
					</subsection><subsection id="id56FA5426516B402CB363EB0F8FEC8DBE"><enum>(f)</enum><header>Evaluation</header><text>The
				Secretary may use not more than 1 percent of the funds under this
				section—</text>
						<paragraph id="idBC55E61E63D94362B6A12CB2DEB7FA6D"><enum>(1)</enum><text>to conduct
				evaluations of the effectiveness of programs and activities assisted under
				subsection (c); and</text>
						</paragraph><paragraph id="idC41556C7066D4DF2B8E43C388B2CB7C2"><enum>(2)</enum><text>to disseminate
				the results of those evaluations for the purpose of refining, improving, and
				strengthening programs.</text>
						</paragraph></subsection><subsection id="id00A99DF76B894D5182385B5BEC47FC8B"><enum>(g)</enum><header>Outreach,
				training, and technical assistance</header><text>The Secretary may use not more
				than 3 percent of the funds made available to carry out this section—</text>
						<paragraph id="idBEAB0FDF605041599DF2A5DEBBC46530"><enum>(1)</enum><text>to conduct
				outreach, including bidders' conferences, to ensure widespread knowledge of the
				availability of resources described in subsection (c);</text>
						</paragraph><paragraph id="idD496BD07600F4B9FAF483799DEBF595B"><enum>(2)</enum><text>to disseminate
				information on best practices and successful program models for serving
				children and youth in rural areas; and</text>
						</paragraph><paragraph id="id215D3BA6FCD0414DAEF3C03ACA89B989"><enum>(3)</enum><text>to provide
				capacity building, training, and technical assistance to afterschool programs
				and providers in rural areas.</text>
						</paragraph></subsection><subsection id="idCEED4927CF2C46C0931D6FC003764B8B"><enum>(h)</enum><header>Application</header>
						<paragraph id="id5A73DCF5E5F741EC8F9D415D91E38E3E"><enum>(1)</enum><header>In
				general</header><text>To be considered for a grant under this section, each
				eligible entity shall submit to the Secretary an application at such time, in
				such manner, and accompanied by such information as the Secretary may
				require.</text>
						</paragraph><paragraph id="idCC5D446939CC4D388EB5C464C626A965"><enum>(2)</enum><header>Contents</header><text>An
				application submitted pursuant to paragraph (1) shall include—</text>
							<subparagraph id="id06060DF02FDF4C5192EAA0941AFA0B5E"><enum>(A)</enum><text>a description of
				the after-school program to be funded, including—</text>
								<clause id="idCA35918D41254E81BCB7C9569249F61B"><enum>(i)</enum><text>an assurance that
				the program will take place in a safe and easily accessible facility;</text>
								</clause><clause id="id02D5A80AD05947009702359AA25D205B"><enum>(ii)</enum><text>a description of
				how children and youth participating in the program will travel safely between
				the program site and home;</text>
								</clause><clause id="id71F26E9CDF334DB2A472E5564E703C3E"><enum>(iii)</enum><text>a description
				of how the eligible entity will disseminate information about the program,
				including the location of the program, to the community in a manner that is
				understandable and accessible; and</text>
								</clause><clause id="id88170AB3604F4317BEC1AA52B600E08F"><enum>(iv)</enum><text>a description of
				the services to be provided to children and youth, the roles and
				responsibilities of the partners in providing the services, and how the
				services enhance an existing after-school program;</text>
								</clause></subparagraph><subparagraph id="id55221ED599A847A68C081DBF51989FDC"><enum>(B)</enum><text>an assurance that
				the proposed program was developed, and will be carried out, in active
				collaboration with the schools the students attend;</text>
							</subparagraph><subparagraph id="id5B6AC0B1665945C8B24222688162F460"><enum>(C)</enum><text>an assurance that
				funds provided under this section will be used to increase the level of State,
				local, and other non-Federal funds that would, in the absence of funds under
				this section, be made available for programs and activities authorized under
				this section, and in no case supplant Federal, State, local, or non-Federal
				funds;</text>
							</subparagraph><subparagraph id="id01644B0AC35B471BA881EE17D2898217"><enum>(D)</enum><text>a description of
				the partnership between a local educational agency, a community-based
				organization, or another public entity or private entity, if applicable;
				and</text>
							</subparagraph><subparagraph id="idB97F03C4AD57473F9B8B6958874484DA"><enum>(E)</enum><text>such additional
				assurances as the Secretary determines to be necessary to ensure compliance
				with this section.</text>
							</subparagraph></paragraph></subsection><subsection id="idDF68CF7FE739416EA78C4A7A3D1A0831"><enum>(i)</enum><header>Priority</header><text>The
				Secretary shall give priority to applications that propose partnerships between
				2 or more eligible entities.</text>
					</subsection><subsection id="idA7CAC54BAD6749D9872BBE860A3F8F2F"><enum>(j)</enum><header>Authorization
				of Appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
						<paragraph id="idE8248F83D373473F8E12E4972FC20113"><enum>(1)</enum><text>$50,000,000 for
				fiscal year 2009;</text>
						</paragraph><paragraph id="id3B10A5E1C50E4F22B45E0EB26FF4E718"><enum>(2)</enum><text>$75,000,000 for
				fiscal year 2010;</text>
						</paragraph><paragraph id="idEB8A7FA51D2A418A8F3ED86ED3C36AA1"><enum>(3)</enum><text>$100,000,000 for
				fiscal year 2011;</text>
						</paragraph><paragraph id="idD512A42ED7F84E2D97CE4B0F283E8E9A"><enum>(4)</enum><text>$125,000,000 for
				fiscal year 2012; and</text>
						</paragraph><paragraph id="id0EFD1A1530254AC09903A12DA3432B14"><enum>(5)</enum><text>$150,000,000 for
				fiscal year
				2013.</text>
