		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Homeland Security and Law
			 Enforcement Improvements Act of 2008</short-title></quote>.</text>
		</section><section id="ID09ca48d976764e8d95f5c72f32455bae"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="id7F4ABA51B6EA44F4BBB0CBC4E16C6C14"><enum>(1)</enum><text>the term
			 <term>Department</term> means the Department of Homeland Security; and</text>
			</paragraph><paragraph id="id61DCFA250E0D4617AFAF498516245FF5"><enum>(2)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Homeland Security.</text>
			</paragraph></section><section id="ID02d58d1e111e44f39cef9736b5ba8037"><enum>3.</enum><header>Office for State
			 and Local Law Enforcement</header><text display-inline="no-display-inline">Section 2006 of the Homeland Security Act of
			 2002 (6 U.S.C. 607) is amended by striking subsection (b) and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id8150072B00234985B2B6759B0681A4B6" style="OLC">
				<subsection id="ID655181a301e0474ea1c2e0428f5db9af"><enum>(b)</enum><header>Office for
				State and local law enforcement</header>
					<paragraph id="IDf380045802fd4cbfbc34cbcacd25c92e"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Office of the Secretary an Office for State and Local Law
				Enforcement, which shall be headed by an Assistant Secretary for State and
				Local Law Enforcement.</text>
					</paragraph><paragraph id="IDf65bcacee42f4b659ec60fc439de7623"><enum>(2)</enum><header>Qualifications</header><text>The
				Assistant Secretary for State and Local Law Enforcement shall have an
				appropriate background with experience in law enforcement, intelligence, and
				other antiterrorist functions.</text>
					</paragraph><paragraph id="IDa1997f62938f4bc9858459f95257123b"><enum>(3)</enum><header>Assignment of
				personnel</header><text>The Secretary may assign to the Office for State and
				Local Law Enforcement permanent staff and other appropriate personnel detailed
				from other components of the Department to carry out the responsibilities under
				this subsection.</text>
					</paragraph><paragraph id="ID9b2b96f2d5ad42afbec8fc218db14167"><enum>(4)</enum><header>Responsibilities</header><text>The
				Assistant Secretary for State and Local Law Enforcement shall—</text>
						<subparagraph id="IDaf754e4bd86940778075aa42721b54cd"><enum>(A)</enum><text>lead the
				coordination of Department-wide policies relating to the role of State and
				local law enforcement in preventing, preparing for, protecting against, and
				responding to natural disasters, acts of terrorism, and other man-made
				disasters within the United States;</text>
						</subparagraph><subparagraph id="ID7dd7718efec740f88b552e820e5bec88"><enum>(B)</enum><text>serve as a
				liaison between State, local, and tribal law enforcement agencies and the
				Department;</text>
						</subparagraph><subparagraph id="ID27ecd404e5634b31b7176cd8293c3839"><enum>(C)</enum><text>work with the
				Office of Intelligence and Analysis to ensure the intelligence and information
				sharing requirements of State, local, and tribal law enforcement agencies are
				being addressed;</text>
						</subparagraph><subparagraph id="ID306cea688402493894eae466958b69f5"><enum>(D)</enum><text>work with the
				Administrator to ensure that homeland security grants to State, local, and
				tribal government agencies, including grants under sections 2003 and 2004 and
				subsection (a) of this section, the Commercial Equipment Direct Assistance
				Program, and grants to support fusion centers and other law
				enforcement-oriented programs, are adequately focused on terrorism prevention
				activities;</text>
						</subparagraph><subparagraph id="ID3fed718d72e249d889dee471e97f2af7"><enum>(E)</enum><text>coordinate, in
				cooperation with the Federal Emergency Management Agency and the Office of
				Intelligence and Analysis, information sharing and fusion center training,
				technical assistance, and other information sharing activities to ensure needs
				of State, local, and tribal law enforcement agencies and fusion centers are
				being met, including the development of a Law Enforcement Information Sharing
				Resource Center under paragraph (6);</text>
						</subparagraph><subparagraph id="id2130828556C94F90B6BB20C6F4EA78BF"><enum>(F)</enum><text>carry out, in
				coordination with the Administrator, the National Law Enforcement Deployment
				Team Program established under paragraph (5); and</text>
						</subparagraph><subparagraph id="IDa8df6e96a5c24b45b910c5dd8f509e32"><enum>(G)</enum><text>coordinate with
				the Federal Emergency Management Agency, the Department of Justice, the
				National Institute of Justice, law enforcement organizations, and other
				appropriate entities to support the development, promulgation, and updating, as
				necessary, of national voluntary consensus standards for training and personal
				protective equipment to be used in a tactical environment by law enforcement
				officers.</text>
						</subparagraph></paragraph><paragraph id="IDb7b1d5b940ef49e2b124a64960664237"><enum>(5)</enum><header>National Law
				Enforcement Deployment Team Program</header>
						<subparagraph id="idE08BA3B3B04B467B8D1310F24EE1E9AE"><enum>(A)</enum><header>Establishment</header><text>The
				Assistant Secretary for State and Local Law Enforcement shall establish a
				National Law Enforcement Deployment Team Program to develop and implement a
				series of Law Enforcement Deployment Teams comprised of State and local law
				enforcement personnel capable of providing immediate support in response to the
				threat or occurrence of a natural or man-made incident.</text>
						</subparagraph><subparagraph id="IDe733394bbebc4db9837ef7e8a6d6b775"><enum>(B)</enum><header>Activities</header><text>In
				carrying out the National Law Enforcement Deployment Team Program, the
				Assistant Secretary for State and Local Law Enforcement shall—</text>
							<clause id="IDe7af7d44fe29429d9bc9e51cb3278c15"><enum>(i)</enum><text>consult with
				State and local law enforcement and public safety agencies and other relevant
				stakeholders as to the capabilities required by a Law Enforcement Deployment
				Team;</text>
							</clause><clause id="ID395ac16a5bfc4b6f8ebda6ffe808864e"><enum>(ii)</enum><text>develop and
				implement a model Law Enforcement Deployment Team located in a region of the
				Federal Emergency Management Agency selected by the Assistant Secretary;</text>
							</clause><clause id="ID21e6e954e2d34eeea7f864c352c2bf8f"><enum>(iii)</enum><text>exercise and
				train the Law Enforcement Deployment Teams;</text>
							</clause><clause id="IDd21cde5d05eb440390eb3769c7579f04"><enum>(iv)</enum><text>create model
				policies and procedures, templates, and general policies and procedures and
				document best practices that can be applied to the development of Law
				Enforcement Deployment Teams in each region of the Federal Emergency Management
				Agency;</text>
							</clause><clause id="IDe05529c59fab476da5b80f3bce40901a"><enum>(v)</enum><text>develop an
				implementation strategy to support the development, overall management,
				equipment, infrastructure, and training needs of a National Law Enforcement
				Deployment Team Program, including the development of a technical assistance
				and training program; and</text>
							</clause><clause id="ID1c93f210030146e69d4b6aaf1c3a4dfa"><enum>(vi)</enum><text>not later than 6
				months after the date of enactment of the <short-title>Homeland Security and Law Enforcement Improvements Act of
				2008</short-title>, and before implementation of the National Law Enforcement
				Deployment Team Program in any region of the Federal Emergency Management
				Agency other than the region selected under clause (ii), submit to the
				Committee on Homeland Security and Government Affairs and the Committee on the
				Judiciary of the Senate and the Committee on Homeland Security and the
				Committee on the Judiciary of the House of Representatives a report on the
				National Law Enforcement Deployment Team Program, which shall include the
				implementation strategy described in clause (v).</text>
							</clause></subparagraph><subparagraph id="ID5287739e114a42fa8bd7d683bc0f1b1d"><enum>(C)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this paragraph—</text>
							<clause id="IDdcf73d41f00d45b587d6ece56fb2b571"><enum>(i)</enum><text>$5,000,000 for
				each of fiscal years 2009 and 2010; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID4f564ba8d49046cb9985ba83f47be16f"><enum>(ii)</enum><text>such sums as are
				necessary for each of fiscal years 2011 through 2015.</text>
							</clause></subparagraph></paragraph><paragraph id="IDb6cdb9c66a2c4c9da5b880ba098e94f5"><enum>(6)</enum><header>Law Enforcement
				Information Sharing Resource Center</header>
						<subparagraph id="ID46369b5506074a149bead036c37b4a0a"><enum>(A)</enum><header>Establishment</header><text>There
				is established within the Office for State and Local Law Enforcement, the Law
				Enforcement Information Sharing Resource Center to provide technical assistance
				relating to information sharing and intelligence with and between State, local,
				and tribal law enforcement agencies and Federal agencies.</text>
						</subparagraph><subparagraph id="ID90ec205cb06b41bfb3e65314f555210d"><enum>(B)</enum><header>Activities</header><text>In
				carrying out the Law Enforcement Information Sharing Resource Center, the
				Assistant Secretary for State and Local Law Enforcement shall—</text>
							<clause id="ID8ad925d864e141969b8c6a6c3ff8bedc"><enum>(i)</enum><text>develop a single
				repository within the Department to house all relevant guidance, templates,
				examples, best practices, data sets, analysis tools, and other fusion center
				and information sharing related items;</text>
							</clause><clause id="ID9b55e91d69914fea99f90e40ed48b2d0"><enum>(ii)</enum><text>consult with
				State and local law enforcement agencies in the development of the Law
				Enforcement Information Sharing Resource Center;</text>
							</clause><clause id="IDe2dcef9cb8704f248d5bf5d64c0f34f0"><enum>(iii)</enum><text>consolidate
				access to Department resources within the Law Enforcement Information Sharing
				Resource Center;</text>
							</clause><clause id="IDd40b16824745463d9bed9ed77753a18e"><enum>(iv)</enum><text>provide
				technical assistance to law enforcement and public safety agencies; and</text>
							</clause><clause id="ID7828c4c1638a4460b9cc61eea6f0d238"><enum>(v)</enum><text>coordinate, in
				coordination with the Federal Emergency Management Agency and the Office of
				Intelligence and Analysis, intelligence, information sharing, and fusion center
				related training, technical assistance, exercise, and other services provided
				to State and local law enforcement and other agencies developing or operating
				fusion centers and intelligence units.</text>
							</clause></subparagraph><subparagraph id="ID98106b9ee8cc44869838327d46889023"><enum>(C)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this paragraph—</text>
							<clause id="ID350c35500e0d43f9a3bd47011e94b460"><enum>(i)</enum><text>$3,000,000 for
				fiscal year 2009;</text>
							</clause><clause id="ID785563458dae420398838b52fb42e3e0"><enum>(ii)</enum><text>$3,500,000 for
				fiscal year 2010; and</text>
							</clause><clause id="ID22826790346a41278e3d30700a81a598"><enum>(iii)</enum><text>such sums as
				are necessary for each of fiscal years 2011 through 2015.</text>
							</clause></subparagraph></paragraph><paragraph id="ID9903b20f2dfb4f608a388372a73b8740"><enum>(7)</enum><header>Foreign Liaison
				Officers Against Terrorism Programs</header>
						<subparagraph id="IDd8e5fe50703c4ac08431079e28dbd4a7"><enum>(A)</enum><header>Establishment</header><text>There
				is established within the Office of State and Local Law Enforcement, the
				Foreign Liaison Officers Against Terrorism Program.</text>
						</subparagraph><subparagraph id="ID0a5deecc490f440696fa133f8f64ed78"><enum>(B)</enum><header>Duties</header><text>In
				carrying out the Foreign Liaison Officers Against Terrorism Program the
				Assistant Secretary for State and Local Law Enforcement shall—</text>
							<clause id="ID212aa66178bc47418a1f0e957c2dbbcd"><enum>(i)</enum><text>identify foreign
				cities the government of which desires a State, local, or tribal law
				enforcement agency to assign an officer to the foreign city, to share
				information with law enforcement agencies of State, local, and tribal
				governments; and</text>
							</clause><clause id="ID8a6dbe2fc101439f8f7daf5caaccdfeb"><enum>(ii)</enum><text>assign each
				foreign city identified under clause (i) to a law enforcement agency
				participating in the Foreign Liaison Officers Against Terrorism Program,
				to—</text>
								<subclause id="ID5252c3d1e3c4413e9bd58dbd9d6f151b"><enum>(I)</enum><text>obtain
				information relevant to law enforcement agencies of State, local, and tribal
				governments from each such city for information sharing purposes; and</text>
								</subclause><subclause id="IDd6fbe45bc5be4665855b654f4bbd4b65"><enum>(II)</enum><text>share
				information obtained under subclause (I) with other law enforcement agencies
				participating in the Foreign Liaison Officers Against Terrorism Program.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfedae77574514e34a4874dcd7d78b572"><enum>(C)</enum><header>Use of grant
				funds</header><text>A grant awarded under section 2003 may be used for the
				costs of participation in the Foreign Liaison Officers Against Terrorism
				Program established under subparagraph
				(A).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDc2a09b1b81ec4977ab9f9ff398dc169b"><enum>4.</enum><header>Law enforcement
			 terrorism prevention program</header>
			<subsection id="idA2F52D2D8E484216BA4CE5EE324E27B8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2006(a) of
			 the Homeland Security Act of 2002 (6 U.S.C. 607(a)) is amended—</text>
				<paragraph id="id8E542C6947E04DB7940016534158A8AC"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id3BD269398DBF49A9A3688DF374D34648" style="OLC">
						<paragraph id="id3C47BF68EE9247A38D160D649F9FFB99"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="idCC317F25D82C4ADAB05B14D2517B6091"><enum>(A)</enum><header>Grants</header><text>The
				Assistant Secretary for State and Local Law Enforcement may make grants to
				States and local governments for law enforcement terrorism prevention
				activities.</text>
							</subparagraph><subparagraph id="idF23F85527D504290B62878DC9C66018E"><enum>(B)</enum><header>Program</header><text display-inline="yes-display-inline">The Secretary shall maintain the grant
				program under this subsection as a separate program of the
				Department.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB644E5DD55E74F89AAA3BDAE72951402"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5F8E7850C47145359F3FD16DD234691B" style="OLC">
						<paragraph id="IDfacdbb3e5db0445ebfbe5acf725340c7"><enum>(4)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this subsection $500,000,000 for each of fiscal years 2009 through 2015, of
				which not less than 10 percent may be used by the Assistant Secretary for
				discretionary grants for national best practices and programs of proven
				effectiveness, including for—</text>
							<subparagraph id="ID59563a3e3bdb40d4abf98166be241d72"><enum>(A)</enum><text>national,
				regional and multi-jurisdictional projects;</text>
							</subparagraph><subparagraph id="ID510f3a589a494903b2edc99902dd9469"><enum>(B)</enum><text>development of
				model programs for replication;</text>
							</subparagraph><subparagraph id="IDc7f3b408e59343ba9855b23efc7b27e7"><enum>(C)</enum><text>guidelines and
				standards for preventing terrorism;</text>
							</subparagraph><subparagraph id="ID0c4bd21e3d034db1b01552a11966640c"><enum>(D)</enum><text>national
				demonstration projects that employ innovative or promising approaches;
				and</text>
							</subparagraph><subparagraph id="ID3c9acc7003ba4ba5bb12134159b6a6ae"><enum>(E)</enum><text>evaluation of
				programs to ensure the effectiveness of the
				programs.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idEE2A6D22587F4705B3E96B70D0B437F7"><enum>(b)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Assistant Secretary for State and Local
			 Law Enforcement of the Department shall submit to Congress and make publicly
			 available an annual report detailing the goals and recommendations for the
			 Nation’s terrorism prevention strategy.</text>
			</subsection></section><section id="ID63e0e1eae41a46c6a77a4d1b24a06dd6"><enum>5.</enum><header>Commercial
			 Equipment Direct Assistance Program</header>
			<subsection id="idB501D5177BAE4710BE38B3CFFD31B59F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title XX of the
			 Homeland Security Act of 2002 (6 U.S.C. 601 et seq.) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2E7BB1522F5D44A6995B25A4D3DE00EF" style="OLC">
					<subtitle id="id0357197E53414329B85AF6094A3674AF"><enum>C</enum><header>Other
				assistance</header>
						<section id="idF8CC2BA984B049388D8691638DDE2931"><enum>2041.</enum><header>Commercial
				Equipment Direct Assistance Program</header>
							<subsection id="ID8902c0ed2a5349a29148ee2e0edf3c06"><enum>(a)</enum><header>Establishment</header><text>There
				is established within the Office of State and Local Law Enforcement, the
				Commercial Equipment Direct Assistance Program (in this section referred to as
				the <quote>program</quote>) to make counterterrorism technology, equipment, and
				information available to local law enforcement agencies.</text>
							</subsection><subsection id="idECED783127D447939B4D156C60032DC6"><enum>(b)</enum><header>Activities</header><text>In
				carrying out the program, the Assistant Secretary for State and Local Law
				Enforcement shall—</text>
								<paragraph id="ID54028941a8b7430586bddc5e68efcc7e"><enum>(1)</enum><text>publish a
				comprehensive list of available technologies, equipment, and information
				available under the program;</text>
								</paragraph><paragraph id="IDc7ee104c69b04c1180f075bbf1d0022f"><enum>(2)</enum><text>consult with
				local law enforcement agencies and other appropriate individuals and entities,
				as determined by the Assistant Secretary for State and Local Law
				Enforcement;</text>
								</paragraph><paragraph id="IDb89ce64598ca4af1898661ef65e998ad"><enum>(3)</enum><text>accept
				applications from the heads of State and local law enforcement agencies that
				wish to acquire technologies, equipment, or information under the program to
				improve the homeland security capabilities of those agencies; and</text>
								</paragraph><paragraph id="IDe91cbdbc53ae495b8bbf969c2f8a5730"><enum>(4)</enum><text>transfer the
				approved technology, equipment, or information and provide the appropriate
				training to the State or local law enforcement agency to implement such
				technology, equipment, or information.</text>
								</paragraph></subsection><subsection id="IDe464b86e7a16477db3d3fd041b41da94"><enum>(c)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
								<paragraph id="id80105E9FA1B54634A4CD246B5E8FA054"><enum>(1)</enum><text>$75,000,000 for
				each of fiscal years 2009 and 2010; and</text>
								</paragraph><paragraph id="id4694B104AB6C4ADE8A2C9B111A2BBA1D"><enum>(2)</enum><text>such sums as are
				necessary for each of fiscal years 2011 through
				2015.</text>
								</paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
