		  external defibrillators in elementary and secondary schools.</official-title>

		<section id="HA6923BFBB4594A8A95CCE63EB211EEB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Josh Miller Helping Everyone Access
			 Responsive Treatment in Schools Act of 2008</short-title></quote> or the
			 <quote><short-title>Josh Miller HEARTS
			 Act</short-title></quote>.</text>
		</section><section id="H558D6BFC659A4F6193BAF0AEEB8C50AA"><enum>2.</enum><header>Grant program for
			 automated external defibrillators</header>
			<subsection id="HFE5D794CC8354D09AA3222F3FF9DBAC"><enum>(a)</enum><header>Program
			 required</header><text>The Secretary of Education shall carry out a program
			 under which the Secretary makes grants to local educational agencies, to be
			 used by the local educational agencies for one or both of the following:</text>
				<paragraph id="HC0A41548E4AF424BB200F5521482FBFC"><enum>(1)</enum><text>To purchase
			 automated external defibrillators for use in elementary and secondary schools
			 served by the local educational agency.</text>
				</paragraph><paragraph id="HF52ADDC5744F472AA490FEF0D7361BEF"><enum>(2)</enum><text display-inline="yes-display-inline">To provide training to enable elementary
			 and secondary schools served by the local educational agency to meet the
			 requirements of subsection (d)(1), but only if automated external
			 defibrillators are already in use at such schools or are acquired through this
			 program.</text>
				</paragraph></subsection><subsection id="H90EB8CD047CD4DE7AA70005B7B68948B"><enum>(b)</enum><header>Eligibility</header>
				<paragraph id="H368148A2BCC4478D84A39F094BBD1C9"><enum>(1)</enum><header>Local educational
			 agencies</header><text>To be eligible to receive a grant under this section, a
			 local educational agency shall submit an application to the Secretary at such
			 time, in such form, and containing such information as the Secretary may
			 require.</text>
				</paragraph><paragraph id="HC65BF07A604B40A69779DE7BE5B0893C"><enum>(2)</enum><header>Elementary and
			 secondary schools</header><text display-inline="yes-display-inline">To be
			 eligible to receive an automated external defibrillator through a grant under
			 this section, a school may be any public or private school served by the local
			 educational agency, except that an Internet- or computer-based community school
			 is not eligible.</text>
				</paragraph></subsection><subsection id="H50B3D15AB29B4D30A134EAFDF5C09F51"><enum>(c)</enum><header>Matching funds
			 required</header>
				<paragraph id="H993C4070A8034C4A837B0300C800B781"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, the
			 local educational agency must provide matching funds from non-Federal sources
			 equal to not less than 25 percent of the amount of the grant.</text>
				</paragraph><paragraph id="H914D8DAA05864A1D889C9771E983617B"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary shall waive the requirement
			 of paragraph (1) for a local educational agency if the number of children
			 counted under section 1124(c)(1)(A) of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 6333(c)(1)(A)) is 20 percent or more of the total number
			 of children aged 5 to 17, inclusive, served by the local educational
			 agency.</text>
				</paragraph></subsection><subsection id="H8FAFDDCCFC3648CF87AD29F9AD0408BD"><enum>(d)</enum><header>Training and
			 coordination required</header><text display-inline="yes-display-inline">A local
			 educational agency that receives a grant under this section shall demonstrate
			 that, for each elementary and secondary school at which the automated external
			 defibrillators are to be used—</text>
				<paragraph id="HAB37D7B730EC457DA46FCC81D873C048"><enum>(1)</enum><text display-inline="yes-display-inline">there are at least 5 individuals at the
			 school who—</text>
					<subparagraph id="H767B012A642E4BE8980414257E09F1BE"><enum>(A)</enum><text>are employees or
			 volunteers at the school;</text>
					</subparagraph><subparagraph id="H5111465B10A94B629EAA01443FE6E5FA"><enum>(B)</enum><text>are at least 18
			 years of age; and</text>
					</subparagraph><subparagraph id="H661E0513236D4C549D75518C2114256E"><enum>(C)</enum><text>have successfully
			 completed training, with the expectation that the certification shall be
			 maintained, in the use of automated external defibrillators and in
			 cardiopulmonary resuscitation, conducted by the American Heart Association, the
			 American Red Cross, the National Safety Council, or another nationally
			 recognized organization offering training programs of similar caliber;</text>
					</subparagraph></paragraph><paragraph id="H0AE91BD8598A40939300C8DE3FCE0738"><enum>(2)</enum><text display-inline="yes-display-inline">local paramedics and other emergency
			 services personnel are notified where on school grounds the automated external
			 defibrillators are to be located; and</text>
				</paragraph><paragraph id="HCAD989A2B9C34AB9AF9C73C131378EB7"><enum>(3)</enum><text>the automated
			 external defibrillator will be integrated into the school’s emergency response
			 plan or procedures.</text>
				</paragraph></subsection><subsection id="H0299AAEAAEC840C000ADB480163FF69C"><enum>(e)</enum><header>Priority</header><text>In
			 making grants under this section, the Secretary shall give priority to
			 schools—</text>
				<paragraph id="H32A7DAB9311E4FF682251416ABA17D96"><enum>(1)</enum><text display-inline="yes-display-inline">that do not already have an automated
			 external defibrillator on school grounds;</text>
				</paragraph><paragraph id="H6F298C2493274440A733EBD2C412EAD5"><enum>(2)</enum><text display-inline="yes-display-inline">at which a significant number of students,
			 staff, and visitors are present on school grounds during a typical day;</text>
				</paragraph><paragraph id="HAD24E676D9FD4ACC979D10D558EA7DFE"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to which the average time
			 required for emergency medical services (as defined in section 330J of the
			 Public Health Service Act (42 U.S.C. 254c–15(f))) to reach the school is
			 greater than the average time for emergency medical services to reach other
			 public facilities in the community; and</text>
				</paragraph><paragraph id="H08A158BAEB3543FF81901D10E2A0249D"><enum>(4)</enum><text display-inline="yes-display-inline">that have not received funds under the
			 Rural Access to Emergency Devices Act (42 U.S.C. 254c note).</text>
				</paragraph></subsection><subsection id="HCA1EBBDB3524401E9F9B4762002DE810"><enum>(f)</enum><header>ESEA
			 definitions</header><text display-inline="yes-display-inline">The terms used in
			 this section shall have the meanings given to such terms in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
			</subsection><subsection id="H0982FC6FF1AE499CB0D397DBF570A241"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section such sums as may be necessary for each of fiscal years 2008
			 through 2013.</text>
