			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Reuniting Families
			 Act</short-title></quote>.</text>
		</section><section id="ID13a94058e08144e0b642f1bde69f4911"><enum>2.</enum><header>Recapture of
			 immigrant visas lost to bureaucratic delay</header>
			<subsection id="HEAD73EDE1978469EA737D0A0DF6CEDAC"><enum>(a)</enum><header>Worldwide level
			 of employment-based immigrants</header><text>Subsection (d) of section 201 of
			 the Immigration and Nationality Act (8 U.S.C. 1151) is amended to read as
			 follows:</text>

					<subsection id="HBA9706872FB14FBA9578FC62BB76CF"><enum>(d)</enum><header>Worldwide level of
				employment-based immigrants</header>
						<paragraph id="HF75D55E258634D0DAE363B1038C4756E"><enum>(1)</enum><header>In
				general</header><text>The worldwide level of employment-based immigrants under
				this subsection for a fiscal year is equal to the sum of—</text>
							<subparagraph id="HB9C0DDDA29174AE780B1C8B436B0D441"><enum>(A)</enum><text>140,000;
				plus</text>
							</subparagraph><subparagraph id="HAA7D3C4FE3284DA0B3377E310009CBC9"><enum>(B)</enum><text>the number
				computed under paragraph (2); plus</text>
							</subparagraph><subparagraph id="HA2266DA0A5604DD084537200DFA74800"><enum>(C)</enum><text>the number
				computed under paragraph (3).</text>
							</subparagraph></paragraph><paragraph id="HF3F35ABDF56F4E10B0D3E96B89A613F4"><enum>(2)</enum><header>Unused visa
				numbers from previous fiscal year</header><text>The number computed under this
				paragraph for a fiscal year is the difference, if any, between—</text>
							<subparagraph id="H287283B8254249D0B710E8BA0FB6088"><enum>(A)</enum><text>the worldwide level
				of employment-based immigrant visas established for the previous fiscal year;
				and</text>
							</subparagraph><subparagraph id="HDDD8397BE1D44B30BF4B9283F2C5BDA7"><enum>(B)</enum><text>the number of
				visas actually issued under section 203(b), subject to this subsection, during
				the previous fiscal year.</text>
							</subparagraph></paragraph><paragraph id="H7F72C8907327480C8881E95108CAF330"><enum>(3)</enum><header>Unused visa
				numbers from fiscal years 1992 through 2007</header><text display-inline="yes-display-inline">The number computed under this paragraph is
				the difference, if any, between—</text>
							<subparagraph id="HAC7FBADF6C2C44A39F9DC27E701C72B4"><enum>(A)</enum><text display-inline="yes-display-inline">the difference, if any, between—</text>
								<clause id="H5292E600BA8547BAB29F08269D59412D"><enum>(i)</enum><text>the sum of the
				worldwide levels of employment-based immigrant visas established for each of
				fiscal years 1992 through 2007; and</text>
								</clause><clause id="H586214DCC665472192EB00F92B3B0064"><enum>(ii)</enum><text>the number of
				visas actually issued under section 203(b), subject to this subsection, during
				such fiscal years; and</text>
								</clause></subparagraph><subparagraph id="HE9B17C5E54AF4693822BA5157BC64BC3"><enum>(B)</enum><text>the number of
				unused visas from fiscal years 1992 through 2007 that were issued after fiscal
				year 2007 under section 203(b), subject to this
				subsection.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6A9284FBF92944AEBCE700C7E6043BF2"><enum>(b)</enum><header>Worldwide level
			 of family-sponsored immigrants</header><text>Subsection (c) of section 201 of
			 the Immigration and Nationality Act (8 U.S.C. 1151) is amended to read as
			 follows:</text>

				of family-sponsored immigrants</header>
						<paragraph display-inline="no-display-inline" id="H87B8C64EC1E9446DB1000704B694EFA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), the worldwide level of family-sponsored immigrants under this
				subsection for a fiscal year is equal to—</text>
							<subparagraph id="HFC63F283824A4E97855B2C4248EECD4B"><enum>(A)</enum><text>480,000;
				plus</text>
							</subparagraph><subparagraph id="H0EDF4ABE5DD14354B37B6B28F48FC615"><enum>(B)</enum><text>the sum of—</text>
								<clause id="id0DC187E189D64B028AEC200B0CA8B265"><enum>(i)</enum><text>the number
				computed under paragraph (2); plus</text>
								</clause><clause id="idCB710C8FDC054B6AB5360D219A8580E6"><enum>(ii)</enum><text>the number
				computed under paragraph (3).</text>
								</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3D183AC30DD64278B44B062473B500B0"><enum>(2)</enum><header>Unused visa
				numbers from previous fiscal year</header><text>The number computed under this
				paragraph for a fiscal year is the difference, if any, between—</text>
							<subparagraph id="H85F36C49FD6648FF82739FDF435FFA8"><enum>(A)</enum><text display-inline="yes-display-inline">the worldwide level of family-sponsored
				immigrant visas established for the previous fiscal year; and</text>
							</subparagraph><subparagraph id="HBD77641176D44CC38BDFB3DA71C9EDD1"><enum>(B)</enum><text>the number of
				visas actually issued under section 203(a), subject to this subsection, during
				the previous fiscal year.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H163E12C91758402281A1A93FDAF6D6BB"><enum>(3)</enum><header>Unused visa
				numbers from fiscal years 1992 through 2007</header><text display-inline="yes-display-inline">The number computed under this paragraph is
				the difference, if any, between—</text>
							<subparagraph id="H8DB8F72D27924D4480195B7649B5B965"><enum>(A)</enum><text display-inline="yes-display-inline">the difference, if any, between—</text>
								<clause id="H49CA65268CC1461D86734934F1DFC2F4"><enum>(i)</enum><text display-inline="yes-display-inline">the sum of the worldwide levels of
				family-sponsored immigrant visas established for fiscal years 1992 through
				2007; and</text>
								</clause><clause id="H5AD89960925046858084F4D500EC57E7"><enum>(ii)</enum><text>the number of
				visas actually issued under section 203(a), subject to this subsection, during
				such fiscal years; and</text>
								</clause></subparagraph><subparagraph id="H8F91DCAC764E48C90050E8F4002C158C"><enum>(B)</enum><text display-inline="yes-display-inline">the number of unused visas from fiscal
				years 1992 through 2007 that were issued after fiscal year 2007 under section
				203(a), subject to this
				subsection.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD417964623C64767841725A42CF8A895"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect 60 days after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="ID48bf358da6df4bda8cea01dcaa017596"><enum>3.</enum><header>Reclassification
			 of spouses and minor children of legal permanent residents as immediate
			 relatives</header>
			<subsection id="IDf8c47dc8fd3649ef954c714bad201906"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (2) of section 201(b) of the Immigration and
			 Nationality Act (8 U.S.C. 1151(b)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id6E6CB7A7E89442A082B502C33F2F02A2" style="OLC">
					<paragraph id="ID421cf3b86177417d985ce4c36b5f3d7d"><enum>(2)</enum><header>Immediate
				relative</header>
						<subparagraph id="ID5a53990a0a964dcaa55cb99ffe77dced"><enum>(A)</enum><header>In
				general</header>
							<clause id="ID7fe8ff817ebb4a6b8d8549b2bcc0ab61"><enum>(i)</enum><header>Immediate
				relative defined</header><text>In this subparagraph, the term <quote>immediate
				relative</quote> means a child, spouse, or parent of a citizen of the United
				States or a child or spouse of a lawful permanent resident (and for each family
				member of a citizen or lawful permanent resident specified under this
				subparagraph, such individual's spouse or child who is accompanying or
				following to join the individual), except that, in the case of parents, such
				citizens shall be at least 21 years of age.</text>
							</clause><clause id="ID9834c9522ac240b7b4ab04bb8d7d315e"><enum>(ii)</enum><header>Previously
				issued visa</header><text>Aliens admitted under section 211(a) on the basis of
				a prior issuance of a visa under section 203(a) to their accompanying parent
				who is an immediate relative.</text>
							</clause><clause id="ID6ef7cca99a2c4db595cab244135fd93c"><enum>(iii)</enum><header>Spouse</header><text>An
				alien who was the spouse of a citizen of the United States or lawful permanent
				resident for not less than 2 years at the time of the citizen’s or resident’s
				death or, if married for less than 2 years at the time of the citizen’s or
				resident’s death, proves by a preponderance of the evidence that the marriage
				was entered into in good faith and not solely for the purpose of obtaining an
				immigration benefit and was not legally separated from the citizen or resident
				at the time of the citizen’s or resident’s death, and each child of such alien,
				shall be considered, for purposes of this subsection, an immediate relative
				after the date of the citizen’s or resident’s death if the spouse files a
				petition under section 204(a)(1)(A)(ii) before the earlier of—</text>
								<subclause id="ID8bb895137de44028aab8bcd65ddc51c0"><enum>(I)</enum><text>2 years after
				such date; or</text>
								</subclause><subclause id="IDe88c0d7e67a5470fbc9643d42b131cea"><enum>(II)</enum><text>the date on
				which the spouse remarries.</text>
								</subclause></clause><clause id="ID31daad48e56747608a556fbe1dc5c623"><enum>(iv)</enum><header>Parents and
				children</header><text>An alien who was the child or parent of a citizen of the
				United States or a child of a lawful permanent resident at the time of the
				citizen’s or resident’s death if the alien files a petition under
				204(a)(1)(A)(ii) within 2 years after such date or prior to reaching 21 years
				of age.</text>
							</clause><clause id="ID06d1ff23d3b54d7790c1993950a40890"><enum>(v)</enum><header>Special
				rule</header><text>For purposes of this subparagraph, an alien who has filed a
				petition under clause (iii) or (iv) of section 204(a)(1)(A) remains an
				immediate relative if the United States citizen or lawful permanent resident
				spouse or parent loses United States citizenship or residence on account of the
				abuse.</text>
							</clause></subparagraph><subparagraph id="ID68f9a56a4483414bb616e1c81d5a0cd3"><enum>(B)</enum><header>Birth during
				temporary visit abroad</header><text>Aliens born to an alien lawfully admitted
				for permanent residence during a temporary visit
				abroad.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDd500b1cf89b14d669e48ff5898a3eb0c"><enum>(b)</enum><header>Allocation of
			 immigrant visas</header><text>Subsection (a) of section 203 of the Immigration
			 and Nationality Act (8 U.S.C. 1153) is amended—</text>
				<paragraph id="IDeed813d7de7b4b7383420cd7256920f5"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>23,400</quote> and inserting <quote>38,000</quote>;</text>
				</paragraph><paragraph id="ID1062bfd4f84a4dab8d2ea330ae8ec573"><enum>(2)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id40789158D52F41F4A780C4FADFA6CDA6" style="OLC">
						<paragraph id="IDc7fabba7a53a45a3937106c6dcadfec7"><enum>(2)</enum><header>Unmarried sons
				and unmarried daughters of permanent resident aliens</header><text>Qualified
				immigrants who are the unmarried sons or unmarried daughters (but are not the
				children) of an alien lawfully admitted for permanent residence shall be
				allocated visas in a number not to exceed 60,000, plus any visas not required
				for the class specified in paragraph
				(1).</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID0d91675f146345f5a466a9d562e8249f"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>23,400</quote> and inserting <quote>38,000</quote>;
			 and</text>
				</paragraph><paragraph id="ID24882a0136914ca6916eb85d0e25e65c"><enum>(4)</enum><text>in paragraph (4),
			 by striking <quote>65,000</quote> and inserting <quote>90,000</quote>.</text>
				</paragraph></subsection><subsection id="IDe859cff55aa9420aba25e9ebc8b11fc2"><enum>(c)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="IDf450d56ef9764840842eeda1a541788a"><enum>(1)</enum><header>Rules for
			 determining whether certain aliens are immediate
			 relatives</header><text>Subsection (f) of section 201 of the Immigration and
			 Nationality Act (8 U.S.C. 1151) is amended—</text>
					<subparagraph id="ID7b5637b6e68747e3888488611c4c0a75"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>paragraphs (2) and (3),</quote> and inserting
			 <quote>paragraph (2),</quote>;</text>
					</subparagraph><subparagraph id="IDfe6d047e589849a1817711544bae5ed9"><enum>(B)</enum><text>by striking
			 paragraph (2);</text>
					</subparagraph><subparagraph id="IDedbd7e6271fb4d34acaa31f1161add91"><enum>(C)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (2) and (3), respectively; and</text>
					</subparagraph><subparagraph id="id0EBBA5D081ED4BFBA64A301F4AEFE46B"><enum>(D)</enum><text>in paragraph (3),
			 as redesignated by subparagraph (C), by striking <quote>through (3)</quote> and
			 inserting <quote>and (2)</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDa5c56a0616944d38a4e8f92bcd395b85"><enum>(2)</enum><header>Numerical
			 limitation to any single foreign state</header><text>Section 202 of the
			 Immigration and Nationality Act (8 U.S.C. 1152) is amended—</text>
					<subparagraph id="IDcc1bde9b1b08449dba90811c9f9b8378"><enum>(A)</enum><text>in paragraph (4)
			 of subsection (a)—</text>
						<clause id="ID3e74c225c6e64f13ba7eec7401774d89"><enum>(i)</enum><text>by
			 striking subparagraphs (A) and (B);</text>
						</clause><clause id="ID765bc21cf82e4bfcac88c2eaf31a967f"><enum>(ii)</enum><text>by
			 redesignating subparagraphs (C) and (D) as subparagraphs (A) and (B),
			 respectively; and</text>
						</clause><clause id="ID77b43e984e3e403f9751b1e7e120c5d9"><enum>(iii)</enum><text>in subparagraph
			 (A), as redesignated by clause (ii), by striking <quote>section
			 203(a)(2)(B)</quote> and inserting <quote>section 203(a)(2)</quote>; and</text>
						</clause></subparagraph><subparagraph id="IDea6ad937c6974a6b9b51e1c61d8df2b1"><enum>(B)</enum><text>in subsection
			 (e), in the flush matter following paragraph (3), by striking <quote>, or as
			 limiting the number of visas that may be issued under section 203(a)(2)(A)

					</subparagraph></paragraph><paragraph id="ID1dfaf4812fff4f2fb3672590949b28c4"><enum>(3)</enum><header>Allocation of
			 immigration visas</header><text>Subsection (h) of section 203 of the
			 Immigration and Nationality Act (8 U.S.C. 1153) is amended—</text>
					<subparagraph id="IDca5202aa3b844f7881048ccf40c08b41"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="IDbeec409722f94bff963256403aedfe2f"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by striking <quote>subsections (a)(2)(A)
			 and (d)</quote> and inserting <quote>subsection (d)</quote>;</text>
						</clause><clause id="ID49e9a416856b4e63979f8776f0040a90"><enum>(ii)</enum><text>in
			 subparagraph (A), by striking <quote>becomes available for such alien (or, in
			 the case of subsection (d), the date on which an immigrant visa number became

			 by striking <quote>The petition</quote> and all that follows through the end
			 and inserting <quote>The petition described in this paragraph is a petition
			 filed under section 204 for classification of the alien's parent under
			 subsection (a), (b), or (c).</quote>; and</text>

			 Nationality Act (8 U.S.C. 1154) is amended—</text>

					</subparagraph></paragraph></subsection></section><section id="ID5e97d0b375c44f9ab724fdce6fbaff74"><enum>4.</enum><header>Country
			 limits</header><text display-inline="no-display-inline">Paragraph (2) of
			 section 202(a) of the Immigration and Nationality Act (8 U.S.C. 1152(a)) is
			 amended by striking <quote>7 percent (in the case of a single foreign state) or
			 2 percent</quote> and inserting <quote>10 percent (in the case of a single
			 foreign state) or 5 percent</quote>.</text>
		</section><section id="ID18b4f2ab2e6e40e4911e5d78d007a57c"><enum>5.</enum><header>Family
			 unity</header>
			<subsection id="ID7d705b97d6504c5bb0826222a848bc0f"><enum>(a)</enum><header>Exception to
			 prohibition on unlawful presence for minors</header><text>Clause (iii) of
			 section 212(a)(9)(B) of the Immigration and Nationality Act (8 U.S.C.
			 1182(a)(9)(B)) is amended—</text>
				<paragraph id="id6D0FA7A72A54450280E2C18FCC120317"><enum>(1)</enum><text>in subclause (I),
			 by striking <quote>18</quote> and inserting <quote>21</quote>;</text>
				</paragraph><paragraph id="ID246f9ac3666b4410875521bd855c7a0c"><enum>(2)</enum><text>by indenting
			 subclause (V) 8 ems from the left margin; and</text>
				</paragraph><paragraph id="id52CF9B4F7CD840868447981C97BFE58D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id894D1E4C9E6343D0AA832F8CB1818DFE" style="OLC">
						<subclause id="id7DD31A1170804E8C8B9350EEAC06DC50"><enum>(VI)</enum><text>Clause (i) shall
				not apply to an alien for whom an immigrant visa is available or was available
				on or prior to the date of enactment of the <short-title>Reuniting Families Act</short-title>, and is otherwise
				admissible to the United States for permanent
				residence.</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID65e45a30dc59436296b3242dc053616e"><enum>(b)</enum><header>Waiver of
			 prohibition on unlawful presence for children of citizens and
			 residents</header><text>Clause (v) of section 212(a)(9)(B) of the Immigration
			 and Nationality Act (8 U.S.C. 1182(a)(9)(B)) is amended—</text>
				<paragraph id="ID54baed56a5c64c5786915eb3dc6ee604"><enum>(1)</enum><text>by striking
			 <quote>spouse or son or daughter</quote> and inserting <quote>spouse, son,
			 daughter, or parent</quote>;</text>
				</paragraph><paragraph id="IDb762b264d346448e9795d9c68e239fbf"><enum>(2)</enum><text>by striking
			 <quote>extreme</quote>;</text>
				</paragraph><paragraph id="ID3de62c7bbda5418eb1485ff48f3ed9d8"><enum>(3)</enum><text>by inserting
			 <quote>, son, daughter, or</quote> after <quote>lawfully resident
			 spouse</quote>; and</text>
				</paragraph><paragraph id="ID9cf4f428e09245deb58dd041b9b2fa42"><enum>(4)</enum><text>by striking
			 <quote>alien.</quote> and inserting <quote>alien or, if the Attorney General
			 determines that a waiver is necessary for humanitarian purposes, to ensure
			 family unity or is otherwise in the public interest.</quote>.</text>
				</paragraph></subsection><subsection id="IDc3f0db4442914d4ab103df865a1c90e9"><enum>(c)</enum><header>Exceptions to
			 prohibition on unlawful presence after previous immigration
			 violation</header><text>Clause (ii) of section 212(a)(9)(C) of the Immigration
			 and Nationality Act (8 U.S.C. 212(a)(9)(C)) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id487BEEEDC27E482D93373649E70706F9" style="OLC">
					<clause id="id5F241E09F11A461A96AB06FDCD1AB709"><enum>(ii)</enum><header>Exceptions</header><text>Clause
				(i) shall not apply to an alien—</text>
						<subclause id="id581BE7E50DB2415BA9D02DC28CD826F9"><enum>(I)</enum><text>seeking admission
				more than 10 years after the date of the alien's last departure from the United
				States if, prior to the alien's reembarkation at a place outside the United
				States or attempt to be readmitted from a foreign contiguous territory, the
				Secretary of Homeland Security has consented to the alien's reapplying for
				admission; or</text>
						</subclause><subclause id="id9737C966E7B44D459E3ADA3609CBDB09"><enum>(II)</enum><text>for whom an
				immigrant visa is available or was available on or prior to the date of
				enactment of the <short-title>Reuniting Families
				Act</short-title>, and is otherwise admissible to the United States for
				permanent
				residence.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="IDF4CC65530E8D4C27845B1C49127BCC28"><enum>6.</enum><header>Relief for
			 orphans and spouses</header>
			<subsection id="ID0925EFD969B542F6B3503A4CC7D72635"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="ID57126000CB364D1CB486F3EF888DA070"><enum>(1)</enum><header>Special rule
			 for orphans and spouses</header><text>In applying clauses (iii) and (iv) of
			 section 201(b)(2)(A) of the <act-name parsable-cite="INA">Immigration and
			 Nationality Act</act-name>, as added by section 3(a), to an alien whose citizen
			 or lawful permanent resident relative died before the date of the enactment of
			 this Act, the alien relative may (notwithstanding the deadlines specified in
			 either such clause) file the classification petition under clause (ii) of
			 section 204(a)(1)(A) of such Act, as amended by section 3(c)(4)(A)(i)(II), not
			 later than 2 years after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="ID9F82419B909543B59A258E46566CA030"><enum>(2)</enum><header>Eligibility for
			 parole</header><text>If an alien was excluded, deported, removed, or departed
			 voluntarily before the date of the enactment of this Act based solely upon the
			 alien’s lack of classification as an immediate relative (as defined in clause
			 (ii) of section 201(b)(2)(A) of the <act-name parsable-cite="INA">Immigration
			 and Nationality Act</act-name>, as amended by section 3(a)) due to the death of
			 such citizen or resident—</text>
					<subparagraph id="IDCEE16B9D679441968B4BD7AF406A1079"><enum>(A)</enum><text>such alien shall
			 be eligible for parole into the United States pursuant to the Attorney
			 General’s discretionary authority under section 212(d)(5) of such Act (8 U.S.C.
			 1182(d)(5)); and</text>
					</subparagraph><subparagraph id="IDEE30A886D59A4F2D8CDC1E543344EDAC"><enum>(B)</enum><text>such alien’s
			 application for adjustment of status shall be considered notwithstanding
			 section 212(a)(9) of such Act (8 U.S.C. 1182(a)(9)).</text>
					</subparagraph></paragraph></subsection><subsection id="ID9A6C22D22D14460BB6D2CA5A79A5BE57"><enum>(b)</enum><header>Adjustment of
			 status</header><text>Section 245 of the Immigration and Nationality Act (8
			 U.S.C. 1255) is amended by adding at the end the following:</text>
				<quoted-block id="ID3AD4AD6D2E174838ACEC49C1EEE0511C" style="OLC">
					<subsection id="IDB0A13C0541BB47108A3281BCAABCD9C4"><enum>(n)</enum><header>Application for
				adjustment of status by surviving spouses, parents, and children</header>
						<paragraph id="IDEBEFC1134A1A4F7386CCA438993E484D"><enum>(1)</enum><header>In
				general</header><text>Any alien described in paragraph (2) who applies for
				adjustment of status before the death of the qualifying relative, may have such
				application adjudicated as if such death had not occurred.</text>
						</paragraph><paragraph id="ID9D355010EB184BD1AADA2C17DCE20C2A"><enum>(2)</enum><header>Alien
				described</header><text>An alien described in this paragraph is an alien
				who—</text>
							<subparagraph id="IDC7A44F691EC845B2A428BE21BC4EB312"><enum>(A)</enum><text>is an immediate
				relative (as described in section 201(b)(2)(A));</text>
							</subparagraph><subparagraph id="ID8B48FBB1099445A48A0D4763D159BCAF"><enum>(B)</enum><text>is a
				family-sponsored immigrant (as described in subsection (a) or (d) of section
				203); or</text>
							</subparagraph><subparagraph id="ID37771ED12C694D31AFA63501F72D14E8"><enum>(C)</enum><text>is a derivative
				beneficiary of an employment-based immigrant under section 203(b) (as described
				in section
				203(d)).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2279E5EDFC894C79B5A93680751FA3DF"><enum>(c)</enum><header>Transition
			 period</header>
				<paragraph id="ID4359940463C24CE09F2EECBE0678B931"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding a denial of an application for adjustment
			 of status for an alien whose qualifying relative died before the date of the
			 enactment of this Act, such application may be renewed by the alien through a
			 motion to reopen, without fee, if such motion is filed not later than 2 years
			 after such date of enactment.</text>
				</paragraph><paragraph id="ID0431E3C466924BAFB40B377216FF9CED"><enum>(2)</enum><header>Eligibility for
			 parole</header><text>If an alien described in section 245(n)(2), as amended by
			 subsection (b), was excluded, deported, removed or departed voluntarily before
			 the date of the enactment of this Act—</text>
					<subparagraph id="IDAF8AD7ADFEF141FA847D22671F4F4BEA"><enum>(A)</enum><text>such alien shall
			 be eligible for parole into the United States pursuant to the Attorney
			 General’s discretionary authority under section 212(d)(5) of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act (8 U.S.C.
			 1182(d)(5))</act-name>; and</text>
					</subparagraph><subparagraph id="IDFF505BD232244C01AB1E2B533DF67EC0"><enum>(B)</enum><text>such alien’s
			 application for adjustment of status shall be considered notwithstanding
			 section 212(a)(9) of such Act (8 U.S.C. 1182(a)(9)).</text>
					</subparagraph></paragraph></subsection><subsection id="IDD6073F1BC1464A928C255862F0F7E180"><enum>(d)</enum><header>Processing of
			 immigrant visas and derivative petitions</header>
				<paragraph id="id30E264D105324655978BF82BDC940C45"><enum>(1)</enum><header>In
			 general</header><text>Subsection (b) of section 204 of the Immigration and
			 Nationality Act (8 U.S.C. 1154) is amended—</text>
					<subparagraph id="IDC67F04CDEC044957B4FD2F2B8A369E0D"><enum>(A)</enum><text>by striking
			 <quote>After an investigation</quote> and inserting the following:</text>

							<paragraph id="IDB92C5499E89B41498FCE4365419A9926"><enum>(2)</enum><header>Death of
				qualifying relative</header>
								<subparagraph id="ID894B5B2E34E248D995D5360B9B1349B1"><enum>(A)</enum><header>In
				general</header><text>Any alien described in paragraph (2) whose qualifying
				relative died before the completion of immigrant visa processing may have an
				immigrant visa application adjudicated as if such death had not occurred. An
				immigrant visa issued before the death of the qualifying relative shall remain
				valid after such death.</text>
								</subparagraph><subparagraph id="ID5B9480FAF4764106A1240A25CA1B7F9A"><enum>(B)</enum><header>Alien
				described</header><text>An alien described in this paragraph is an alien
				who—</text>
									<clause id="ID77A3BACAEDB7496CA2F4CACA584730EE"><enum>(i)</enum><text>is an immediate
				relative, as described in section 201(b)(2)(A);</text>
									</clause><clause id="IDD091B19CFD274BA6B032442B931653F2"><enum>(ii)</enum><text>is a
				family-sponsored immigrant, as described in subsection (a) or (d) of section
				203;</text>
									</clause><clause id="ID5BC9116DB8BB47B69B52051808334B65"><enum>(iii)</enum><text>is a derivative
				beneficiary of an employment-based immigrant under section 203(b), as described
				in section 203(d); or</text>
									</clause><clause id="id54710CB6EB9D4A27A348038DF8B0FB91"><enum>(iv)</enum><text>is the spouse or
				child of a refugee, as described in section 207(c)(2) or an asylee, as
				described in section
				208(b)(3).</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDaa558257aef14d44ab8ea220b6368073"><enum>(2)</enum><header>Transition
			 period</header>
					<subparagraph id="ID85a06fab11384162a23ff96bf4c698d4"><enum>(A)</enum><header>In
			 general</header><text>Notwithstanding a denial or revocation of an application
			 for an immigrant visa for an alien whose qualifying relative died before the
			 date of the enactment of this Act, such application may be renewed by the alien
			 through a motion to reopen, without fee, if such motion is filed not later than
			 2 years after such date of enactment.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID60ccb56590ad46489a4516c8eaf91332"><enum>(B)</enum><header>Inapplicability
			 of bars to entry</header><text>In the case of an alien who was excluded,
			 deported, removed, or departed voluntarily before the date of the enactment of
			 this Act, such alien's application for an immigrant visa shall be considered
			 notwithstanding section 212(a)(9) of the Immigration and Nationality Act (8
			 U.S.C. 1182(a)(9)).</text>
					</subparagraph></paragraph></subsection><subsection id="ID255AFAE385F447BEA4AAF4FFAC5C7158"><enum>(e)</enum><header>Naturalization</header><text>Subsection
			 (a) of section 319 of the Immigration and Nationality Act (8 U.S.C. 1430) is
			 amended by inserting <quote>(or, if the spouse is deceased, the spouse was a
			 citizen of the United States)</quote> after <quote>citizen of the United
			 States</quote>.</text>
			</subsection></section><section id="id1041615183AA4ED494B916CBF8D20BB4"><enum>7.</enum><header>Exemption from
			 immigrant visa limit for certain veterans who are natives of
			 Philippines</header><text display-inline="no-display-inline">Paragraph (1) of
			 section 201(b) of the Immigration and Nationality Act (8 U.S.C. 1151(b)) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id9DF8686DA38147BD867085BF1703AF42" style="OLC">
				<subparagraph id="IDd721d9e71e904162bfd4f9d4e64117ee" indent="up1"><enum>(F)</enum><text>Aliens who are eligible for an
				immigrant visa under paragraph (1) or (3) of section 203(a) and who have a
				parent who was naturalized pursuant to section 405 of the Immigration Act of
				1990 (8 U.S.C. 1440
				note).</text>
