		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>OLC Reporting Act of
			 2008</short-title></quote>.</text>
		</section><section id="id29EE2BF5D9DD49669E0472A82CD75F0D"><enum>2.</enum><header>Reporting</header><text display-inline="no-display-inline">Section 530D of title 28, United States
			 Code, is amended—</text>
			<paragraph id="id7F70EAB4835A4B2FBEE07355A7D784A7"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="id1B91AACEB791421AB15004BD05EBD22A"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="idB454D1B8C9E04991A30C2EFF635863B2"><enum>(i)</enum><text>in
			 subparagraph (B), by striking <quote>or</quote> at the end;</text>
					</clause><clause id="id2B3FB3F862E54BDFABECBE52A405B52A"><enum>(ii)</enum><text>by
			 redesignating subparagraph (C) as subparagraph (D); and</text>
					</clause><clause id="idFF121EA9EBE642B1A8F26B8B991178BB"><enum>(iii)</enum><text>by inserting
			 after subparagraph (B) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id3DA09C06598848619B10D3607E63AB1E" style="OLC">
							<subparagraph id="ID8e5ce2cc91d7407c84c0bbf2f940ff91"><enum>(C)</enum><text>except as
				provided in paragraph (3), issues an authoritative legal interpretation
				(including an interpretation under section 511, 512, or 513 by the Attorney
				General or by an officer, employee, or agency of the Department of Justice
				pursuant to a delegation of authority under section 510) of any provision of
				any Federal statute—</text>
								<clause id="IDa68c6eb611f34f6a8b4545374d1d38b6"><enum>(i)</enum><text>that concludes
				that the provision is unconstitutional or would be unconstitutional in a
				particular application;</text>
								</clause><clause id="ID94f2844927b44508a491bdaf77303937"><enum>(ii)</enum><text>that relies for
				the conclusion of the authoritative legal interpretation, in whole or in the
				alternative, on a determination that an interpretation of the provision other
				than the authoritative legal interpretation would raise constitutional concerns
				under article II of the Constitution of the United States or separation of
				powers principles;</text>
								</clause><clause id="IDc09ee69bd120431990f54f675d34678d"><enum>(iii)</enum><text>that relies for
				the conclusion of the authoritative legal interpretation, in whole or in the
				alternative, on a legal presumption against applying the provision, whether
				during a war or otherwise, to—</text>
									<subclause id="ID71b00a89e7c4401a95c9ac12bd16db60"><enum>(I)</enum><text>any department or
				agency established in the executive branch of the Federal Government, including
				the Executive Office of the President and the military departments (as defined
				in section 101(8) of title 10); or</text>
									</subclause><subclause id="ID1c985b20ed9f4a2c9526d73adfa7e86a"><enum>(II)</enum><text>any officer,
				employee, or member of any department or agency established in the executive
				branch of the Federal Government, including the President and any member of the
				Armed Forces; or</text>
									</subclause></clause><clause id="ID9ae7ad30a6cf4482b1751b54c7d563fb"><enum>(iv)</enum><text>that concludes
				the provision has been superseded or deprived of effect in whole or in part by
				a subsequently enacted statute where there is no express statutory language
				stating an intent to supersede the prior provision or deprive it of effect;
				or</text>
								</clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="id68936548D75644BBA506F4B409A6C9DD"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>For the purposes</quote> and all that follows through
			 <quote>if the report</quote> and inserting <quote>Except as provided in
			 paragraph (4), a report shall be considered to be submitted to the Congress for
			 the purposes of paragraph (1) if the report</quote>; and</text>
				</subparagraph><subparagraph id="id79C7242FCEE84ACE9D1FA4236E634648"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3DFF9EC629A141DCAAC5C1DE520DC3F3" style="OLC">
						<paragraph id="ID559c58bed6154fbfa6c891208c11fa70"><enum>(3)</enum><header>Direction
				regarding interpretation</header><text>The submission of a report to Congress
				based on the issuance of an authoritative legal interpretation described in
				paragraph (1)(C) shall be discretionary on the part of the Attorney General or
				an officer described in subsection (e) if—</text>
							<subparagraph id="id6AC7EBF550234316885766FEEFD3EDE2"><enum>(A)</enum><text>the President or
				other responsible officer of a department or agency established in the
				executive branch of the Federal Government, including the Executive Office of
				the President and the military departments (as defined in section 101(8) of
				title 10), expressly directs that no action be taken or withheld or policy
				implemented or stayed on the basis of the authoritative legal interpretation;
				and</text>
							</subparagraph><subparagraph id="id2DF1CD42CA014DDBA6D5FAB3AAAAD0C4"><enum>(B)</enum><text>the directive
				described in subparagraph (A) is in effect.</text>
							</subparagraph></paragraph><paragraph id="id7253295FA05C4AB8826FCFA1DD88DEAB"><enum>(4)</enum><header>Classified
				information</header>
							<subparagraph id="ID4b6141da234c443ebe9b5bd6842eb4cf"><enum>(A)</enum><header>Submission of
				report containing classified information regarding intelligence
				activities</header><text>Except as provided in subparagraph (B), if the
				Attorney General submits a report relating to an instance described in
				paragraph (1) that includes a classified annex containing information relating
				to intelligence activities, the report shall be considered to be submitted to
				the Congress for the purposes of paragraph (1) if—</text>
								<clause id="ID50c7ed857f7446a7860a21c8b1556cfa"><enum>(i)</enum><text>the unclassified
				portion of the report is submitted to each officer specified in paragraph (2);
				and</text>
								</clause><clause id="IDe5ff6727f0e24ba2b118beaeaa78c7b9"><enum>(ii)</enum><text>the classified
				annex is submitted to the Select Committee on Intelligence and the Committee on
				the Judiciary of the Senate and the Permanent Select Committee on Intelligence
				and the Committee on the Judiciary of the House of Representatives.</text>
								</clause></subparagraph><subparagraph id="IDa5a70be1cadd4131a170a21b8a43f589"><enum>(B)</enum><header>Submission of
				report containing certain classified information about covert actions</header>
								<clause id="idE01994187DEA4A2995D308B27799EDF4"><enum>(i)</enum><header>In
				general</header><text>In a circumstance described in clause (ii), a report
				described in that clause shall be considered to be submitted to the Congress
				for the purposes of paragraph (1) if—</text>
									<subclause id="idA6F79D88910C466F92880D23E9EB87B0"><enum>(I)</enum><text>the unclassified
				portion of the report is submitted to each officer specified in paragraph (2);
				and</text>
									</subclause><subclause id="IDa6ad49f60b474c4f9a2634384dec4a6a"><enum>(II)</enum><text>the classified
				annex is submitted to—</text>
										<item id="id542B413168C84FF09FE58F15DD25F8F3"><enum>(aa)</enum><text>the chairman and
				ranking minority member of the Select Committee on Intelligence of the
				Senate;</text>
										</item><item id="idFA3528D6325F4A32B0695725D9467F4B"><enum>(bb)</enum><text>the chairman and
				ranking minority member of the Committee on the Judiciary of the Senate;</text>
										</item><item id="idD9973AFC7BA24DDEB8D58878E56FCC83"><enum>(cc)</enum><text>the chairman and
				ranking minority member of the Permanent Select Committee on Intelligence of
				the House of Representatives;</text>
										</item><item id="id2B7D71888C7A45B0B72B705783232FF0"><enum>(dd)</enum><text>the chairman and
				ranking minority member of the Committee on the Judiciary of the House of
				Representatives;</text>
										</item><item id="id9F37DF73674C4197BF7FB9D550B31B6E"><enum>(ee)</enum><text>the Speaker and
				minority leader of the House of Representatives; and</text>
										</item><item id="id8104196083264B0697753575052C338F"><enum>(ff)</enum><text>the majority
				leader and minority leader of the Senate.</text>
										</item></subclause></clause><clause id="idEF4084F27F72420DB311831A8829900F"><enum>(ii)</enum><header>Circumstances</header><text>A
				circumstance described in this clause is a circumstance in which—</text>
									<subclause id="idBB67699993F54990831ECD324F2BABF1"><enum>(I)</enum><text>the Attorney
				General submits a report relating to an instance described in paragraph (1)
				that includes a classified annex containing information relating to a
				Presidential finding described in section 503(a) of the National Security Act
				of 1947 (50 U.S.C. 413b(a)); and</text>
									</subclause><subclause id="idAFC9D0D001504B7BB6D0A96EF93D234B"><enum>(II)</enum><text>the President
				determines that it is essential to limit access to the information described in
				subclause (I) to meet extraordinary circumstances affecting vital interests of
				the United States.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id78AE11925DA6469F81307DB04C8BECF8"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="idCE68C9422BE14723AB1D72F6107BB78A"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="idD086EB50D21C49FDA7F977FEB24F4EDE"><enum>(B)</enum><text>by redesignating
			 paragraph (3) as paragraph (4);</text>
				</subparagraph><subparagraph id="id30C6AD558C0D45FB941E736C2C0EBE69"><enum>(C)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7515DEA9CD564EA8A1D3F6AA9057BDFF" style="OLC">
						<paragraph id="IDbfa1062273c34430bb23f35d895779e3"><enum>(3)</enum><text>under subsection
				(a)(1)(C)—</text>
							<subparagraph id="id9BAE7816248D4228B08A5F6189ECBDCC"><enum>(A)</enum><text>not later than 30
				days after the date on which the Attorney General, the Office of Legal Counsel,
				or any other officer of the Department of Justice issues the authoritative
				legal interpretation of the Federal statutory provision; or</text>
							</subparagraph><subparagraph id="id283DC410492640AABC89D271C5B10E41"><enum>(B)</enum><text>if the President
				or other responsible officer of a department or agency established in the
				executive branch of the Federal Government, including the Executive Office of
				the President and the military departments (as defined in section 101(8) of
				title 10), issues a directive described in subsection (a)(3) and the directive
				is subsequently rescinded, not later than 30 days after the date on which the
				President or other responsible officer rescinds that directive;
				and</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idA11B699B3EFF4B7982E4E3D06B9BA82E"><enum>(D)</enum><text>in paragraph (4),
			 as so redesignated, by striking <quote>subsection (a)(1)(C)</quote> and
			 inserting <quote>subsection (a)(1)(D)</quote>;</text>
				</subparagraph></paragraph><paragraph id="idB9C2B8EC89A94FC29C7E20D2A9E0F369"><enum>(3)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="idEFAC4DF656324B77AF73DB7870508565"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>or of each approval described in subsection
			 (a)(1)(C)</quote> and inserting <quote>of the issuance of the authoritative
			 legal interpretation described in subsection (a)(1)(C), or of each approval
			 described in subsection (a)(1)(D)</quote>;</text>
				</subparagraph><subparagraph id="ID54e14d73022c4e76a33f8074321a9f93"><enum>(B)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text>
				</subparagraph><subparagraph id="id55A9BB576B054D6FA36E009B099F6BC9"><enum>(C)</enum><text>by inserting
			 after paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id488266493D264756B610E14759EAEEF2" style="OLC">
						<paragraph id="ID9e53c14ce3cf47268ea508b1d99e79dd"><enum>(2)</enum><text>with respect to a
				report required under subparagraph (A), (B), or (C) of subsection (a)(1),
				specify the Federal statute, rule, regulation, program, policy, or other law at
				issue, and the paragraph and clause of subsection (a)(1) that describes the
				action of the Attorney General or other officer of the Department of
				Justice;</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id1F911BB902FF432296F75F8EF6D8FDD0"><enum>(D)</enum><text>in paragraph (3),
			 as so redesignated—</text>
					<clause id="idF29E72B7005541C99824878259DCD492"><enum>(i)</enum><text>by
			 striking <quote>reasons for the policy or determination</quote> and inserting
			 <quote>reasons for the policy, authoritative legal interpretation, or
			 determination</quote>;</text>
					</clause><clause id="idB4596E5E47254422A7881C2DE871FC41"><enum>(ii)</enum><text>by
			 inserting <quote>issuing such authoritative legal interpretation,</quote> after
			 <quote>or implementing such policy,</quote>;</text>
					</clause><clause id="idC826E8B2F6904CB6B445A07CEE324ADA"><enum>(iii)</enum><text>by striking
			 <quote>except that</quote> and inserting <quote>provided that</quote>;</text>
					</clause><clause id="idC2D0CA48BC194B9F97ED7EB4E45820D5"><enum>(iv)</enum><text>by
			 redesignating subparagraphs (A) and (B) as subparagraphs (B) and (C),
			 respectively;</text>
					</clause><clause id="idB3CF8B32C07B4C058ACA46FAD17BFC98"><enum>(v)</enum><text>by
			 inserting before subparagraph (B), as so redesignated, the following:</text>
						<quoted-block display-inline="no-display-inline" id="idF8B3DAB4CA4046209754160153659D62" style="OLC">
							<subparagraph id="ID0356626359be4671ae28914fe8058fd4"><enum>(A)</enum><text>any classified
				information shall be provided in a classified annex, which shall be handled in
				accordance with the security procedures established under section 501(d) of the
				National Security Act of 1947 (50 U.S.C.
				413(d));</text>
							</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</clause><clause id="id82747C73DDE5431584A0409A795614C1"><enum>(vi)</enum><text>in
			 subparagraph (B), as so redesignated—</text>
						<subclause id="id694B2B034B57419FBCAB3FE6BFC69DFD"><enum>(I)</enum><text>by inserting
			 <quote>except for information described in paragraph (1) or (2),</quote> before
			 <quote>such details may be omitted</quote>;</text>
						</subclause><subclause id="id3E13986E4A1C46A082E9F23ECF05D8D4"><enum>(II)</enum><text>by striking
			 <quote>national-security- or classified information, of any</quote>; and</text>
						</subclause><subclause id="id2F27A94A5FA24E329F0C9DFD1804E87A"><enum>(III)</enum><text>by striking
			 <quote>or other law</quote> and inserting <quote>or other
			 statute</quote>;</text>
						</subclause></clause><clause id="idBA720E2909184E90BF01174D95AA4331"><enum>(vii)</enum><text>in subparagraph
			 (C), as so redesignated—</text>
						<subclause id="id71022F2512C548E98E961297D14E7B91"><enum>(I)</enum><text>by redesignating
			 clauses (i) and (ii) as clauses (ii) and (iii), respectively;</text>
						</subclause><subclause id="id9818BC256D3E487299BFC2372C699793"><enum>(II)</enum><text>by inserting
			 before clause (ii), as so redesignated, the following:</text>

			 inserting <quote>subsection (a)(1)(D)(i)</quote>; and</text>
