			<section id="ID72c3a236c4aa4bee941143dbb8907065"><enum>101.</enum><header>Technical
			 assistance for rural small treatment works and medium treatment works</header>
				<subsection id="IDca3faed7f89a4c548f6750489eed152c"><enum>(a)</enum><header>In
			 general</header><text>Title II of the Federal Water Pollution Control Act (33
			 U.S.C. 1281 et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8D007525647D40008936CDDB67D9CD83" style="OLC">
						<section id="IDfe83b3cbe1b844dd87d2260f78e07441"><enum>222.</enum><header>Technical
				assistance for rural small treatment works and medium treatment works</header>
							<subsection id="ID8cb32898ccea4b1798d33f56cc7b9468"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="IDe25f3076f4744731aac83bfdc0cb9322"><enum>(1)</enum><header>Decentralized
				wastewater system</header>
									<subparagraph id="IDa8a6d86b83ca4530bfe5ede69a05a681"><enum>(A)</enum><header>In
				general</header><text>The term <term>decentralized wastewater system</term>
				means a wastewater treatment system that is at or near a site at which
				wastewater is generated.</text>
									</subparagraph><subparagraph id="ID4e6205b8ff01417191de03abefd8b697"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>decentralized wastewater system</term> includes a system that
				provides for—</text>
										<clause id="ID4efd685997794007811e9747e6ab961c"><enum>(i)</enum><text>nonpotable reuse
				of treated effluent; or</text>
										</clause><clause id="ID8d86d1ab99a243549cfc7a5950886b0c"><enum>(ii)</enum><text>energy and
				nutrient recovery from wastewater constituents.</text>
										</clause></subparagraph></paragraph><paragraph id="IDce6be5c506c742a78b637f2315f8ccef"><enum>(2)</enum><header>Medium
				treatment works</header><text>The term <term>medium treatment works</term>
				means a publicly owned treatment works serving more than 10,000 but fewer than
				100,000 individuals.</text>
								</paragraph><paragraph id="ID14f12406fcb64899acd5e2ecac3cfd79"><enum>(3)</enum><header>Qualified
				nonprofit technical assistance provider</header><text>The term <term>qualified
				nonprofit technical assistance provider</term> means a qualified nonprofit
				technical assistance provider of water and wastewater services to small or
				medium-sized communities that provides technical assistance (including circuit
				rider, multi-State regional assistance programs, and training and preliminary
				engineering evaluations) to owners and operators of small treatment works or
				medium treatment works that may include State agencies.</text>
								</paragraph><paragraph id="ID2700999643964d1dbf6159eb41f37e28"><enum>(4)</enum><header>Small treatment
				works</header><text>The term <term>small treatment works</term> means a
				publicly owned treatment works serving not more than 10,000 individuals.</text>
								</paragraph></subsection><subsection id="ID85bd8016d23e4365b9b38054a2f62ea3"><enum>(b)</enum><header>Grant
				program</header>
								<paragraph id="ID1a4a03a613904905872ff3895fd44578"><enum>(1)</enum><header>In
				general</header><text>The Administrator may make grants on a competitive basis
				to qualified nonprofit technical assistance providers that are qualified to
				provide assistance on a broad range of wastewater and stormwater
				approaches—</text>
									<subparagraph id="ID90d8da21362a410a8cb641d3efb06ec3"><enum>(A)</enum><text>to assist owners
				and operators of small treatment works and medium treatment works to plan,
				develop, and obtain financing for eligible projects described in section 603(c)
				or 518(c);</text>
									</subparagraph><subparagraph id="ID6d18196463d1478ea1609c39e9a63ca9"><enum>(B)</enum><text>to provide
				financial assistance, in consultation with the State in which the assistance is
				provided, to owners and operators of small treatment works and medium treatment
				works for predevelopment costs (including costs for planning, design, and
				associated preconstruction activities, such as activities relating directly to
				the siting of the facility and related elements) associated with stormwater or
				wastewater infrastructure projects or short-term costs incurred for equipment
				replacement that is not part of regular operation and maintenance activities
				for existing stormwater or wastewater systems, if the amount of assistance for
				any single project does not exceed $50,000;</text>
									</subparagraph><subparagraph id="IDbce32609a67c4f659b645439f4876126"><enum>(C)</enum><text>to provide
				technical assistance and training for owners and operators of small treatment
				works and medium treatment works to enable those treatment works and systems to
				protect water quality and achieve and maintain compliance with this Act;
				and</text>
									</subparagraph><subparagraph id="ID4a99e2a924ed41818a5799d0a0a7354f"><enum>(D)</enum><text>to disseminate
				information to owners and operators of small treatment works and medium
				treatment works, with respect to planning, design, construction, and operation
				of treatment works, small municipal separate storm sewer systems, and
				decentralized wastewater treatment systems.</text>
									</subparagraph></paragraph><paragraph id="ID0186ad668ab042948fbac1cf3984d327"><enum>(2)</enum><header>Distribution of
				grant</header><text>In carrying out this subsection, the Administrator shall
				ensure, to the maximum extent practicable, that technical assistance provided
				using funds from a grant under paragraph (1) is made available in each
				State.</text>
								</paragraph><paragraph id="ID7e8ef0b34436400db27b0fa3db8b5583"><enum>(3)</enum><header>Consultation</header><text>As
				a condition of receiving a grant under this subsection, a qualified nonprofit
				technical assistance provider shall agree to consult with each State in which
				grant funds are to be expended before the grant funds are expended in the
				State.</text>
								</paragraph><paragraph id="IDd28a08d0d37f44e89e164ec4feb865a0"><enum>(4)</enum><header>Annual
				report</header><text>Not later than 60 days after the end of each fiscal year,
				a qualified nonprofit technical assistance provider that receives a grant under
				this subsection shall submit to the Administrator a report that—</text>
									<subparagraph id="IDf00556ff1090432e89a300c8ff62402e"><enum>(A)</enum><text>describes the
				activities of the qualified nonprofit technical assistance provider using grant
				funds received under this subsection for the fiscal year; and</text>
									</subparagraph><subparagraph id="IDee4474fe0b884a40bb87d1a24ff9ee3e"><enum>(B)</enum><text>specifies—</text>
										<clause id="ID8ec988f4bfe2454d9d4c744cb21d4539"><enum>(i)</enum><text>the number of
				communities served;</text>
										</clause><clause id="IDc1807f7ff1a640f1bbd45e2e2201a34e"><enum>(ii)</enum><text>the sizes of
				those communities; and</text>
										</clause><clause id="IDa8e04a532779458aa36a86b06d770ff6"><enum>(iii)</enum><text>the type of
				assistance provided by the qualified nonprofit technical assistance
				provider.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="IDb175192b57654171a3950eacaee76f1f"><enum>(c)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
								<paragraph id="idF7D38E49382B4ACB98F45F8D93FB56CF"><enum>(1)</enum><text>for grants for
				small treatment works, $25,000,000 for each of fiscal years 2009 through 2013;
				and</text>
								</paragraph><paragraph id="ID67d0943ea8c5491580e59ea8aec53af7"><enum>(2)</enum><text>for grants for
				medium treatment works, $15,000,000 for each of fiscal years 2009 through
				2013.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDa4cdc4a3f1264a8f87873016e3cc9c5e"><enum>(b)</enum><header>Guidance for
			 small systems</header><text>Section 602 of the Federal Water Pollution Control
			 Act (33 U.S.C. 1382) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1DD64BD562D446B8A451AC5166C121D6" style="OLC">
						<subsection id="ID9b130a2546f0403bb692367edd6421a8"><enum>(c)</enum><header>Guidance for
				small systems</header>
							<paragraph id="ID8a6a855e4bd14808bb64cfb63fbaa75f"><enum>(1)</enum><header>Definition of
				small system</header><text>In this subsection, the term <term>small
				system</term> means a system—</text>
								<subparagraph id="ID2192bceea50c42ae87d869eba08b81ef"><enum>(A)</enum><text>for which a
				municipality or intermunicipal, interstate, or State agency seeks assistance
				under this title; and</text>
								</subparagraph><subparagraph id="IDf78b96d798964906a6c8964a8c6ed4d9"><enum>(B)</enum><text>that serves a
				population of not more than 10,000 individuals.</text>
								</subparagraph></paragraph><paragraph id="ID3abb06843dd84472b2e72136fd3ed5da"><enum>(2)</enum><header>Simplified
				procedures</header><text>Not later than 1 year after the date of enactment of
				this subsection, the Administrator shall assist the States in establishing
				simplified procedures for small systems to obtain assistance under this
				title.</text>
							</paragraph><paragraph id="IDc95b9720f291410eba2390328efcba72"><enum>(3)</enum><header>Publication of
				manual</header><text>Not later than 1 year after the date of enactment of this
				subsection, after providing notice and opportunity for public comment, the
				Administrator shall publish—</text>
								<subparagraph id="ID85de0b9622f84211af913fed046bbe01"><enum>(A)</enum><text>a manual to
				assist small systems in obtaining assistance under this title; and</text>
								</subparagraph><subparagraph id="ID718246972b7f4c3485b240863a0ae566"><enum>(B)</enum><text>in the Federal
				Register, notice of the availability of the
				manual.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="ID1e4bfced16134d39820660b65a392fa3"><enum>102.</enum><header>Projects
			 eligible for assistance</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) is amended by striking subsection (c) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id03B02D8719784434B9D59FA99303FABC" style="OLC">
					<subsection commented="no" id="IDe7c1b3b393aa4a0e87c3ec049716f6f9"><enum>(c)</enum><header>Projects
				eligible for assistance</header><text>Funds in each State water pollution
				control revolving fund shall be used only by a municipality or an
				intermunicipal, interstate, or State agency (or, for the purpose of paragraph
				(1), by either of those entities or a private treatment works or decentralized
				wastewater system that principally treats municipal wastewater or domestic
				sewage)—</text>
						<paragraph commented="no" id="IDa7d9ecff3e574196b1c2ab5f92fe8e68"><enum>(1)</enum><text>to provide
				financial assistance for construction activities (such as expansion to meet
				needs of existing development), including planning design, and associated
				preconstruction planning activities (as defined in section 212)—</text>
							<subparagraph commented="no" id="ID41043af0dc634d7aa96ecb16a7f313a5"><enum>(A)</enum><text>to implement a
				management program established under section 319; and</text>
							</subparagraph><subparagraph commented="no" id="ID6fe2df2ca204447d9220996926c9ea59"><enum>(B)</enum><text>to develop and
				implement a conservation and management plan under section 320;</text>
							</subparagraph></paragraph><paragraph commented="no" id="ID3015945e3822440cb36739a3458ec2a0"><enum>(2)</enum><text>to increase the
				security of wastewater treatment works (excluding any expenditure for
				operations or maintenance);</text>
						</paragraph><paragraph commented="no" id="ID356e6ea788ff4661b72cd2452f1136f0"><enum>(3)</enum><text>to implement
				measures to control, manage, reduce, treat, infiltrate, or reuse municipal
				stormwater, the primary purpose of which is the protection, preservation, or
				enhancement of water quality to support public purposes, including procurement
				and use of equipment to support minimum measures such as street sweeping and
				storm drain system cleaning;</text>
						</paragraph><paragraph commented="no" id="IDd381e1cf910c4816925a03f7c94403d5"><enum>(4)</enum><text>to carry out
				water conservation or efficiency projects, the primary purpose of which is the
				protection, preservation, or enhancement of water quality to support public
				purposes;</text>
						</paragraph><paragraph commented="no" id="IDf3e28b2ceb1141e9b64c5d0e37c57230"><enum>(5)</enum><text>to implement
				measures to integrate water resource management planning and
				implementation;</text>
						</paragraph><paragraph commented="no" id="ID65dca9799f7b48e09fab56b4f38b9e26"><enum>(6)</enum><text>to carry out
				water and wastewater reuse, reclamation, and recycling projects, the primary
				purpose of which is the protection, preservation, or enhancement of water
				quality to support public purposes; and</text>
						</paragraph><paragraph commented="no" id="ID2845176530ba4440badb7194c9731d9e"><enum>(7)</enum><text>for capital costs
				associated with monitoring equipment for combined or sanitary sewer
				overflows.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID7ccd6f9894164ec8b7fb4a66d94cfa7c"><enum>103.</enum><header>Affordability</header>
				<subsection id="ID1373fe5e687f46d58ed7bf75d2bc88de"><enum>(a)</enum><header>In
			 General</header><text>Section 603 of the Federal Water Pollution Control Act
			 (33 U.S.C. 1383) is amended—</text>
					<paragraph id="ID7fc0a26ed7f14122af42a464a6c7961a"><enum>(1)</enum><text>by redesignating
			 subsections (e) through (h) as subsections (g) through (j),
			 respectively;</text>
					</paragraph><paragraph id="IDb2d49f1c65924457a943edfe7dc759ea"><enum>(2)</enum><text>in subsection
			 (d)—</text>
						<subparagraph id="id9C90A85DCDB54385B6D21BAB52347E8A"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
							<clause id="IDbe0c88fd9f004d33a9b480ac50b2baa9"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>20 years</quote> and inserting <quote>the
			 lesser of 30 years or the design life of the project to be financed with the
			 proceeds of the loan</quote>; and</text>
							</clause><clause id="IDe892d2613cab4cb6bf5da785a7265437"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>not later than 20 years after project
			 completion</quote> and inserting <quote>upon the expiration of the term of the
			 loan</quote>;</text>
							</clause></subparagraph><subparagraph id="idEA9F0F8C8412482DB4C7C8E3035578BC"><enum>(B)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> at the end; and</text>
						</subparagraph><subparagraph id="id1B0709E0F8A24EACB479A3389F19C7EB"><enum>(C)</enum><text>in paragraph (7),
			 by striking <quote>title, except that</quote> and all that follows and
			 inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="idA9FED405B8714AADAC3FD3AA7C5766C0" style="OLC">
								<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">title,
				except that—</quoted-block-continuation-text><subparagraph id="id28DE2D0592F54873B0DE958341801135"><enum>(A)</enum><text>such amounts
				shall not exceed 6 percent of all grant awards to the fund under this title;
				and</text>
								</subparagraph><subparagraph id="idB24BF7960F4242FB8E37D0B471D3EEB9"><enum>(B)</enum><text display-inline="yes-display-inline">if there is no appropriation for a fiscal
				year, the total amount of the reasonable cost of administering the fund and
				conducting activities under this title shall not exceed 6 percent of all grant
				awards made by the State for that fiscal year; and</text>
								</subparagraph><paragraph id="idF507894DDE964C1BAE2EACD0DC5D57E0"><enum>(8)</enum><text>as a source of
				revenue (restricted solely to interest earnings of the fund) or security for
				payment of the principal and interest on revenue or general obligation bonds
				issued by the State to provide matching funds under section 602(b)(2), if the
				proceeds of the sale of the bonds will be deposited in the
				fund.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="IDb45d741e82a44015aaa37951448ec4c8"><enum>(3)</enum><text>by inserting
			 after subsection (d) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id85898A0BB22945F9A7DEA9E2AB145E94" style="OLC">
							<subsection id="ID4c61fe362b9f47e19d6295abbc614732"><enum>(e)</enum><header>Additional
				assistance for disadvantaged communities</header>
								<paragraph id="ID13e6e7a7e059464cba1a6f42ceb6448d"><enum>(1)</enum><header>Definition of
				disadvantaged community</header><text>In this subsection, the term
				<term>disadvantaged community</term> means a community with a service area, or
				portion of a service area, of a treatment works that meets affordability
				criteria established after public review and comment by the State in which the
				treatment works is located.</text>
								</paragraph><paragraph id="ID6631c2c21534406e912cf53061b23224"><enum>(2)</enum><header>Loan
				subsidy</header><text>Notwithstanding any other provision of this section, in a
				case in which the State makes a loan from the water pollution control revolving
				loan fund in accordance with subsection (c) to a disadvantaged community or a
				community that the State expects to become a disadvantaged community as the
				result of a proposed project, the State may provide additional subsidization,
				including—</text>
									<subparagraph id="IDd36bd2104ba44650a225c075007e5a7c"><enum>(A)</enum><text>the forgiveness
				of all or a portion of the principal of the loan; and</text>
									</subparagraph><subparagraph id="IDabd42bc95f524e699d09c9556243c4ed"><enum>(B)</enum><text>a negative
				interest rate on the loan.</text>
									</subparagraph></paragraph><paragraph id="ID34aa6970dab0491c9343170f706d9f0c"><enum>(3)</enum><header>Total amount of
				subsidies</header><text>For each fiscal year, the total amount of loan
				subsidies made by the State pursuant to this subsection may not exceed 30
				percent of the amount of the capitalization grant received by the State for the
				fiscal year.</text>
								</paragraph><paragraph id="ID2c06733b9d724576ab19cc89fd036d11"><enum>(4)</enum><header>Information</header><text>The
				Administrator may publish information to assist States in establishing
				affordability criteria described in paragraph (1).</text>
								</paragraph></subsection><subsection id="ID5fbfd9793fb947f997b015474a9a6de1"><enum>(f)</enum><header>Cost-saving
				water treatment and efficiency improvements</header><text>Subject to subsection
				(e)(3), in providing a loan for a project under this section, a State may
				forgive repayment of such portion of the loan amount, not to exceed 5 percent,
				as is equal to the percentage of the project that is devoted to alternative
				approaches to wastewater and stormwater controls (including nonstructural
				methods) such as projects that treat or minimize sewage or urban stormwater
				discharges using—</text>
								<paragraph id="IDfafca122886040e5ae318347bdcb506f"><enum>(1)</enum><text>decentralized or
				distributed stormwater controls;</text>
								</paragraph><paragraph id="ID1fb52bcc821a4f289e633300c324d295"><enum>(2)</enum><text>decentralized
				wastewater treatment;</text>
								</paragraph><paragraph id="ID4343a2a30c4e4a6b9451034e3a276ce8"><enum>(3)</enum><text>low-impact
				development technologies and nonstructural approaches;</text>
								</paragraph><paragraph id="IDb7eb962e5f184052b90ff769e30b7404"><enum>(4)</enum><text>stream
				buffers;</text>
								</paragraph><paragraph id="ID06fd4da1c12a4001bef34b7b8360124a"><enum>(5)</enum><text>wetland
				restoration and enhancement;</text>
								</paragraph><paragraph id="ID8a8d868a19e242c68c00adb27a66301e"><enum>(6)</enum><text>actions to
				minimize the quantity of and direct connections to impervious surfaces;</text>
								</paragraph><paragraph id="ID1c42459e5abd4d77947d9bd0c0fefafa"><enum>(7)</enum><text>soil and
				vegetation, or other permeable materials;</text>
								</paragraph><paragraph id="ID0afdf97922564123b0953e138e041485"><enum>(8)</enum><text>actions that
				increase efficient water use, water conservation, or water
				reuse.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID26432e10273e418b98c282defe619c91"><enum>(b)</enum><header>Conforming
			 Amendment</header><text display-inline="yes-display-inline">Section 221(d) of
			 the Federal Water Pollution Control Act (33 U.S.C. 1301(d)) is amended in the
			 second sentence by striking <quote>603(h)</quote> and inserting
			 <quote>603(j)</quote>.</text>
				</subsection></section><section id="ID7c4f909ab15d44d48c66a8d3d163e8c9"><enum>104.</enum><header>Water
			 pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) is amended by striking subsection (i) (as
			 redesignated by section 103(a)(1)) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id483CFCFCD7E4430D8877551E6DB0E8D9" style="OLC">
					<subsection id="IDab063797db4d40d8a60a0e98972ec1c5"><enum>(i)</enum><header>Priority system
				requirement</header>
						<paragraph id="ID70e4752064da4ed8b259299f4ce8a60b"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="IDaf810c367c444ee3a279a96bab3bff3e"><enum>(A)</enum><header>Restructuring</header><text>The
				term <term>restructuring</term> means—</text>
								<clause id="ID1a4bb8c517e34864adf0298e88d1f31d"><enum>(i)</enum><text>the consolidation
				of management functions or ownership with another facility; or</text>
								</clause><clause id="IDe9dd259cf75b453aa99d96fa9d8f1c8f"><enum>(ii)</enum><text>the formation of
				cooperative partnerships.</text>
								</clause></subparagraph><subparagraph id="IDab021ea2237c46aa9773b96563596af4"><enum>(B)</enum><header>Traditional
				wastewater approach</header><text>The term <term>traditional wastewater
				approach</term> means a managed system used to collect and treat wastewater
				from an entire service area consisting of—</text>
								<clause id="ID146d7395ce10404db38184967e56b1c0"><enum>(i)</enum><text>collection
				sewers;</text>
								</clause><clause id="ID2fd4e5fa15f141f9b8e87987ed4ab55c"><enum>(ii)</enum><text>a centralized
				treatment plant using biological, physical, or chemical treatment processes;
				and</text>
								</clause><clause id="ID55d468ec26e2406db78381fa5b6720a8"><enum>(iii)</enum><text>a direct point
				source discharge to surface water.</text>
								</clause></subparagraph></paragraph><paragraph id="IDd618629533dd4d1c91106ac36bc05f5c"><enum>(2)</enum><header>Priority
				system</header><text>In providing financial assistance from the water pollution
				control revolving fund of the State, the State shall establish a priority
				system that—</text>
							<subparagraph id="ID7dba08929bee4de29b2dfb9e4fccc806"><enum>(A)</enum><text>gives greater
				weight to an application for assistance by the owner or operator of a treatment
				works if the application includes—</text>
								<clause id="ID2af4bb71b6904c6087074ae8378654c5"><enum>(i)</enum><text>an inventory of
				assets, including a description of the condition of those assets;</text>
								</clause><clause id="ID354a83eb54124cd5b21c38e3689b4096"><enum>(ii)</enum><text>a schedule for
				replacement of the assets;</text>
								</clause><clause id="IDc3383d6cc6fc41bfbf20a8dc94e8bfa4"><enum>(iii)</enum><text>a financing
				plan that factors in all lifecycle costs indicating sources of revenue from
				ratepayers, grants, bonds, other loans, and other sources to meet the
				costs;</text>
								</clause><clause id="IDd2b344ef36bb4777b2b2dd43d0724716"><enum>(iv)</enum><text>a review of
				options for restructuring the treatment works; or</text>
								</clause><clause id="ID767254ff1e884832a561c961c6901245"><enum>(v)</enum><text>approaches other
				than a traditional wastewater approach that treat or minimize sewage or urban
				stormwater discharges using—</text>
									<subclause id="IDcaabb661d0734493bfe4f185505fa8a0"><enum>(I)</enum><text>decentralized or
				distributed stormwater controls;</text>
									</subclause><subclause id="ID88d861a3cc1f482bb307480901e0edcf"><enum>(II)</enum><text>decentralized
				wastewater treatment;</text>
									</subclause><subclause id="ID2be0a530cd5a4405a2e5a750191b3ad5"><enum>(III)</enum><text>low-impact
				development technologies and nonstructural approaches;</text>
									</subclause><subclause id="IDcfbe64fb442449d58a508195fdb8e03c"><enum>(IV)</enum><text>stream
				buffers;</text>
									</subclause><subclause id="ID5df0f2ff79354568aef692b95b964a42"><enum>(V)</enum><text>wetland
				restoration and enhancement;</text>
									</subclause><subclause id="ID0c5a3c79e5b140c894002ad3247e9217"><enum>(VI)</enum><text>actions to
				minimize the quantity of and direct connections to impervious surfaces;</text>
									</subclause><subclause id="ID2bc3960af4cf43b29889d6cf79e7b533"><enum>(VII)</enum><text>soil and
				vegetation, or other permeable materials; or</text>
									</subclause><subclause id="IDb779d8006ea247a6a4e24396dd884e13"><enum>(VIII)</enum><text>actions that
				increase efficient water use, water conservation, or water reuse;</text>
									</subclause></clause><clause id="ID2256bc25371a415aae2d6ccf81f26318"><enum>(vi)</enum><text>a demonstration
				of consistency with State, regional, and municipal watershed plans, water
				conservation and efficiency plans, or integrated water resource management
				plans;</text>
								</clause><clause id="IDac8e092548794fddac72c3a49b2825eb"><enum>(vii)</enum><text>a proposal by
				the applicant demonstrating flexibility through alternative means to carry out
				responsibilities under Federal regulations, that may include watershed
				permitting and other innovative management approaches, while achieving results
				that—</text>
									<subclause id="IDc61ebb685dd8404797535ebdb5e96941"><enum>(I)</enum><text>the State, in the
				case of a permit program approved under section 402, determines will meet
				permit requirements; or</text>
									</subclause><subclause id="IDa7555d1ffb4641009912d9fa1bcf7d59"><enum>(II)</enum><text>the
				Administrator determines are measurably superior when compared to regulatory
				standards;</text>
									</subclause></clause></subparagraph><subparagraph id="ID89f4d267c4b4413088d2b5c46b65961f"><enum>(B)</enum><text>takes into
				consideration appropriate chemical, physical, and biological data relating to
				water quality that the State considers reasonably available and of sufficient
				quality;</text>
							</subparagraph><subparagraph id="ID99e2bc4d92134f36a861437a33888b4f"><enum>(C)</enum><text>provides for
				public notice and opportunity to comment on the establishment of the priority
				system and the summary under subparagraph (D);</text>
							</subparagraph><subparagraph id="ID3b180867d52140f4bc430d69b655a58b"><enum>(D)</enum><text>provides for the
				publication, not less than biennially in summary form, of a description of
				projects in the State that are eligible for assistance under this title that
				indicates—</text>
								<clause id="ID9297a1e357b749fba923816cde202317"><enum>(i)</enum><text>the priority
				assigned to each project under the priority system of the State; and</text>
								</clause><clause id="IDa1d0fc036bc94fd4b39845d2e50b9c19"><enum>(ii)</enum><text>the funding
				schedule for each project, to that extent the information is available;
				and</text>
								</clause></subparagraph><subparagraph id="IDd44ce1031e96410b8a31bb86baae9b5d"><enum>(E)</enum><text>ensures that
				projects undertaken with assistance under this title are designed to achieve,
				as determined by the State, the optimum water quality management, consistent
				with the public health and water quality goals and requirements of this
				Act.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDbc485661389a40bc977e8fbb5c1a7bd6"><enum>105.</enum><header>Transferability
			 of funds</header><text display-inline="no-display-inline">Section 603 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1383) (as amended by section
			 103(a)(1)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA7C1636DF46D429FB89C0250AF726553" style="OLC">
					<subsection id="ID5124d7150f5a417bb765c34bb4e96710"><enum>(k)</enum><header>Transfer of
				funds</header>
						<paragraph id="ID749a6d1acd3a43d384d54e0dce34fbcf"><enum>(1)</enum><header>In
				general</header><text>The Governor of a State may—</text>
							<subparagraph id="ID82f239e99ebf4905b09299a07373bdff"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id7886095475B14CE481F56293ECF1404B"><enum>(i)</enum><text>reserve not more than
				33 percent of a capitalization grant made under this title; and</text>
								</clause><clause id="id74D877B17A6D4720BFE6AF3CB8B09FAF" indent="up1"><enum>(ii)</enum><text>add the funds reserved to any
				funds provided to the State under section 1452 of the Safe Drinking Water Act
				(42 U.S.C. 300j–12); and</text>
								</clause></subparagraph><subparagraph id="IDf6b86f060bb14e52bbc2af60dc52b192"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id17F584DDF4AE458C92E34FA4C3D8B254"><enum>(i)</enum><text>reserve for any year an
				amount that does not exceed the amount that may be reserved under subparagraph
				(A) for that year from capitalization grants made under section 1452 of that
				Act (42 U.S.C. 300j–12); and</text>
								</clause><clause id="idC88C956788F1486FB0C8537FFFDC3703" indent="up1"><enum>(ii)</enum><text>add the reserved funds to any
				funds provided to the State under this title.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfac179a605c348aaabcefeb59716104d"><enum>(2)</enum><header>State
				match</header><text>Funds reserved under this subsection shall not be
				considered to be a State contribution for a capitalization grant required under
				this title or section 1452(b) of the Safe Drinking Water Act (42 U.S.C.
				300j–12(b)).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDa7156d963f964c58bd5d7947226360d6"><enum>106.</enum><header>Noncompliance</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383) (as amended by section 105) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8D46DE09147C4F38A4A991C896EF4F12" style="OLC">
					<subsection id="ID5c8ae0132765421ea45bc34e254a4160"><enum>(l)</enum><header>Noncompliance</header>
						<paragraph id="ID08807cf4f5924b50b9310935bd72061f"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), no assistance (other
				than assistance that is to be used by a treatment works solely for planning,
				design, or security purposes) shall be provided under this title to the owner
				or operator of a treatment works that has been in significant noncompliance
				with any requirement of this Act for any of the 4 quarters during the preceding
				8 quarters, unless the treatment works is in compliance with an enforceable
				administrative order to effect compliance with the requirement.</text>
						</paragraph><paragraph id="IDc9baedfa0ed8423dbbc3fd6adc19cd26"><enum>(2)</enum><header>Exception</header><text>An
				owner or operator of a treatment works that is determined under paragraph (1)
				to be in significant noncompliance with a requirement described in that
				paragraph may receive assistance under this title if the Administrator and the
				State providing the assistance determine that—</text>
							<subparagraph id="ID90e7d5d23654411e82f2c27d6b91a456"><enum>(A)</enum><text>the entity
				conducting the enforcement action on which the determination of significant
				noncompliance is based has determined that the use of assistance would enable
				the owner or operator of the treatment works to take corrective action toward
				resolving the violations; or</text>
							</subparagraph><subparagraph id="IDe07122bbc97a4c77b87964ea75c4d64f"><enum>(B)</enum><text>the entity
				conducting the enforcement action on which the determination of significant
				noncompliance is based has determined that the assistance would be used by the
				owner or operator of the treatment works in order to assist owners and
				operators in making progress towards
				compliance.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID8b5d17c6c6c5409bbd499d64b5e0fb2b"><enum>107.</enum><header>Negotiation of
			 contracts</header><text display-inline="no-display-inline">Section 603 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1383) (as amended by section
			 106) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3F6892C901B64220836CA51FA114B80A" style="OLC">
					<subsection id="id331CE771096A43CFBC23CF5F71FCA851"><enum>(m)</enum><header>Negotiation of
				contracts</header><text display-inline="yes-display-inline">A contract to be
				carried out using funds directly made available by a capitalization grant under
				this section for program management, construction management, feasibility
				studies, preliminary engineering, design, engineering, surveying, mapping, or
				architectural or related services shall be negotiated in the same manner
				as—</text>
						<paragraph id="ID9258c2ec8948440cb4ee9ec003fa809d"><enum>(1)</enum><text>a contract for
				architectural and engineering services is negotiated under chapter 11 of title
				40, United States Code; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDabec8f6532a9409cbcc27b9401b1150f"><enum>(2)</enum><text>an equivalent
				State qualifications-based requirement (as determined by the Governor of the
				State).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDdd65ee1bb7d744bcb5caeddd40b8cd2c"><enum>108.</enum><header>Allotment of
			 funds</header><text display-inline="no-display-inline">Section 604 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1384) is amended by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id29CE609B623F4377B0B35A5F89DDC404" style="OLC">
					<subsection id="ID27f11977d6ca498fba516c99a39c1302"><enum>(b)</enum><header>Reservation of

				State may reserve for each fiscal year the greater of 2 percent of the sums
				allotted to the State under this section for the fiscal year, or $100,000, to

						</paragraph><paragraph id="ID09aa5dbd724e40d4a61268ce021c6388"><enum>(2)</enum><header>Indian
				tribes</header><text display-inline="yes-display-inline">Of the total amount of
				funds made available under paragraph (1), 1.5 percent shall be allocated to
				Indian tribes (as defined in section
				518(h)).</text>

						</subsection><subsection id="ID566ba85b61f44120bf213c6c541e8be0"><enum>(c)</enum><header>Reservation for
				needs surveys</header><text>Of the amount made available under subsection (a)
				to carry out this title for a fiscal year, the Administrator may reserve not
				more than $1,000,000 for the fiscal year, to remain available until expended,
				to pay the costs of conducting needs surveys under section
				516(b)(1)(B).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID442803f4a86c4bddb177e4752b6008b1"><enum>110.</enum><header>Sewer overflow
			 control grants</header>
				<subsection id="ID0d8938d2326d47a6b6fd60b0b46df7ac"><enum>(a)</enum><header>Sewer Overflow
			 Control Grants</header><text>Section 221 of the Federal Water Pollution Control
			 Act (33 U.S.C. 1301) is amended—</text>
					<paragraph id="IDf2892981792e46509f1b742f0ef8f963"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote><header-in-text level="subsection" style="OLC">In
			 general</header-in-text></quote> and all that follows through <quote>(2)
			 subject to subsection (g), the Administrator may</quote> and inserting the
			 following:</text>

				subsection (g),</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="ID497b8b43623a41188776a91dd8745dcd"><enum>(2)</enum><text>by striking
			 subsections (e) through (g) and inserting the following:</text>

				assistance under subsection (a) shall be carried out subject to the same
				requirements as a project that receives assistance from a State water pollution
				control revolving fund established pursuant to title VI.</text>
								</paragraph><paragraph id="idE7612EB8BA954A86BD655CD7574A1D22"><enum>(2)</enum><header>Determination
				of Governor</header><text>The requirement described in paragraph (1) shall not
				apply to a project that receives grant assistance under subsection (a) to the
				extent that the Governor of the State in which the project is located
				determines that a requirement described in title VI is inconsistent with the
				purposes of this section.</text>
								</paragraph></subsection><subsection id="ID9a0208b0ff7a4bdc8fd603a2285f4d24"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section, to remain available until expended—</text>

				Funds</header>
								<paragraph id="ID6d6ff457fb5e403595781a1b2590de3c"><enum>(1)</enum><header>Fiscal year
				2008 and 2009</header><text>For each of fiscal years 2008 and 2009, subject to
				subsection (h), the Administrator shall use the amounts made available to carry
				out this section to provide grants to municipalities and municipal entities
				under subsection (a)(2)—</text>
									<subparagraph id="id52E5B4E884354FF19DA830B50E6AACF1"><enum>(A)</enum><text>in accordance
				with the priority criteria described in subsection (b); and</text>
									</subparagraph><subparagraph id="id4A6DB7A7DFAF4EB8A7FF70812FB5F477"><enum>(B)</enum><text>with additional
				priority given to proposed projects that involve the use of—</text>
										<clause id="idE9E4079327F7483E8EB175817F682767"><enum>(i)</enum><text>nonstructural,
				low-impact development;</text>
										</clause><clause id="id7CD4C76EEFAC42BBA4C82B71B8EF9AA1"><enum>(ii)</enum><text>water
				conservation, efficiency, or reuse; or</text>
										</clause><clause id="id956761017A0848D6929C36D7DB6AD152"><enum>(iii)</enum><text>other
				decentralized stormwater or wastewater approaches to minimize flows into the
				sewer systems.</text>
										</clause></subparagraph></paragraph><paragraph id="ID082fd9a2287c4017a4cc36b812463e4b"><enum>(2)</enum><header>Fiscal year
				2010 and thereafter</header><text>For fiscal year 2010 and each fiscal year
				thereafter, subject to subsection (h), the Administrator shall use the amounts
				made available to carry out this section to provide grants to States under
				subsection (a)(1) in accordance with a formula that—</text>
									<subparagraph id="ID64067679f2474dff96ee85c38426e4eb"><enum>(A)</enum><text>shall be
				established by the Administrator, after providing notice and an opportunity for
				public comment; and</text>
									</subparagraph><subparagraph id="ID6694f2fbbfe74588a2039dcaab3c1d0f"><enum>(B)</enum><text>allocates to each
				State a proportional share of the amounts based on the total needs of the State
				for municipal combined sewer overflow controls and sanitary sewer overflow
				controls, as identified in the most recent survey—</text>
										<clause id="ID69f6b3858cf74d51b988bea926fb8837"><enum>(i)</enum><text>conducted under
				section 210; and</text>
										</clause><clause id="ID49bfd9b21bae4473a327602ba9aac4ac"><enum>(ii)</enum><text>included in a
				report required under section
				516(b)(1)(B).</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID136e3746bd92457ca17f9a366020e432"><enum>(b)</enum><header>Reports</header><text>Section
			 221(i) of the Federal Water Pollution Control Act (33 U.S.C. 1301(i)) is
			 amended in the first sentence by striking <quote>2003</quote> and inserting
			 <quote>2010</quote>.</text>
				</subsection></section><section id="ID03822dfede984c0f8f8087e809986b6f"><enum>111.</enum><header>Critical water
			 infrastructure projects</header>
				<subsection id="IDdad94aea304a4606989d792151616fad"><enum>(a)</enum><header>Establishment</header><text>The
			 Administrator of the Environmental Protection Agency (referred to in this
			 section as the <term>Administrator</term>) shall establish a program under
			 which grants are provided to eligible entities for use in carrying out projects
			 and activities the primary purpose of which is watershed restoration through
			 the protection or improvement of water quality.</text>
				</subsection><subsection id="ID5448ebdb38fa4df5943462fa7d50a9d6"><enum>(b)</enum><header>Project
			 selection</header>
					<paragraph id="ID4d543c3f715141a794d40883ba7d67ea"><enum>(1)</enum><header>In
			 general</header><text>The Administrator may provide funds under this section to
			 an eligible entity to carry out an eligible project described in paragraph
			 (3).</text>
					</paragraph><paragraph id="IDf1dad441e8664bcb833fa027a00622da"><enum>(2)</enum><header>Equitable
			 distribution</header><text>The Administrator shall ensure an equitable
			 distribution of projects under this section, taking into account cost and
			 number of requests for each category listed in paragraph (3).</text>
					</paragraph><paragraph id="ID5c4cd4ad1c21407db9340e40b543ba05"><enum>(3)</enum><header>Eligible
			 projects</header><text>A project that is eligible to be carried out using funds
			 provided under this section may include projects that are included in the
			 intended use plan of the State developed in accordance with section 606(c) of
			 the Federal Water Pollution Control Act (33 U.S.C. 1386(c)).</text>
					</paragraph></subsection><subsection id="IDb261e3f44b3942b5a40ba5d3cbc63c71"><enum>(c)</enum><header>Local
			 Participation</header><text>In prioritizing projects for implementation under
			 this section, the Administrator shall consult with, and consider the priorities
			 of—</text>
					<paragraph id="ID4e078b7cb6c5472e922c5653592802f5"><enum>(1)</enum><text>affected State
			 and local governments; and</text>
					</paragraph><paragraph id="ID8694e5048f974442a29621793ebd94c4"><enum>(2)</enum><text>public and
			 private entities that are active in watershed planning and restoration.</text>
					</paragraph></subsection><subsection id="ID11f8a50b05ab4ed492a61445c83a0b2d"><enum>(d)</enum><header>Cost
			 Sharing</header><text>Before carrying out any project under this section, the
			 Administrator shall enter into an agreement with 1 or more non-Federal
			 interests that shall require the non-Federal interests—</text>
					<paragraph id="IDe6b400bec46647db90cd08484dbb2257"><enum>(1)</enum><text>to pay 45 percent
			 of the total costs of the project, which may include services, materials,
			 supplies, or other in-kind contributions;</text>
					</paragraph><paragraph id="IDb3a0db31b6cc49c889e94168ea0f81ad"><enum>(2)</enum><text>to provide any
			 land, easements, rights-of-way, and relocations necessary to carry out the
			 project; and</text>
					</paragraph><paragraph id="ID58a2b9a393124a3b9351df296a07bda0"><enum>(3)</enum><text>to pay 100
			 percent of any operation, maintenance, repair, replacement, and rehabilitation
			 costs associated with the project.</text>
					</paragraph></subsection><subsection id="IDd637b9e4048d4369b98b8f0d2632aacc"><enum>(e)</enum><header>Waiver</header><text>The
			 Administrator may waive the requirement to pay the non-Federal share of the
			 cost of carrying out an eligible activity using funds from a grant provided
			 under this section if the Administrator determines that an eligible entity is
			 unable to pay, or would experience significant financial hardship if required
			 to pay, the non-Federal share.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd328fa14375b477a92112bb7d6de7921"><enum>(f)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $50,000,000 for each of fiscal years 2008 through 2012.</text>
				</subsection></section></title><title id="idC7355108BF634F45ACD173A8C2B3D808"><enum>II</enum><header>Safe drinking
			 water infrastructure</header>
			<section id="ID046bdc480a6241bc815450de7a098185"><enum>201.</enum><header>Contaminant
			 prevention, detection, and response</header><text display-inline="no-display-inline">Section 1434 of the Safe Drinking Water Act
			 (42 U.S.C. 300i–3) is amended by striking subsection (b) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id95F521175AB74A0FAECADEE513CA9C9B" style="OLC">
					<subsection id="ID7687d484d03b436d89a8eebc5db0faeb"><enum>(b)</enum><header>Report</header><text>Not
				later than 180 days after the date of enactment of the Water Infrastructure
				Financing Act, the Administrator shall submit to Congress a report that
				includes—</text>
						<paragraph id="IDf0b6d637fecb4bb1897433cbeca3896c"><enum>(1)</enum><text>a description of
				the progress made as of that date in implementing this section; and</text>
						</paragraph><paragraph id="ID0bfa9dbe7c09492ba6cc227a6925b8f8"><enum>(2)</enum><text>a description of
				any impediments to that implementation identified by the Administrator,
				including—</text>
							<subparagraph id="ID5faa110117054f8799a7f61fd2c7af03"><enum>(A)</enum><text>difficulty in
				coordinating the implementation with other Federal, State, or local agencies or
				organizations;</text>
							</subparagraph><subparagraph id="ID77fc7ec879ae4c4abe321c4f53c191fa"><enum>(B)</enum><text>insufficient
				funding for effective implementation;</text>
							</subparagraph><subparagraph id="ID6448131735d046b88b69b9cf4a9f871d"><enum>(C)</enum><text>a lack of
				authorization to take certain actions (including the authority to hire
				necessary personnel) required to carry out the implementation; and</text>
							</subparagraph><subparagraph id="ID2a9cb5dab27d405a9770238581c981b6"><enum>(D)</enum><text>technological
				impediments to developing the methods, means, and equipment specified in
				subsection (a)(1).</text>
							</subparagraph></paragraph></subsection><subsection id="IDe5d6be809ee54401a9adcf791ccd4279"><enum>(c)</enum><header>Implementation
				Plan</header><text>The Administrator shall develop and carry out an
				implementation plan for this section consistent with actions taken to date and
				incorporating the results of the report under subsection (b).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID878a3e2815e5422497dc40456e9f6899"><enum>(d)</enum><header>Funding</header><text>There
				is authorized to be appropriated to carry out this section $7,500,000 for each
				of fiscal years 2008 through
				2012.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idF02D67DAA4964CD38278CB3B34069562"><enum>202.</enum><header>Drinking water
			 technical assistance for communities</header><text display-inline="no-display-inline">Section 1442(e) of the Safe Drinking Water
			 Act (42 U.S.C. 300j–1(e)) is amended—</text>
				<paragraph id="ID353803ebdde4463d968781dce9499667"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>The Administrator may provide</quote> and

				small systems organizations that, as determined by the Administrator, are
				qualified and will be the most effective at assisting those small systems that
				have the greatest need (or a majority of need) in the States.</text>
						</paragraph><paragraph id="id8703FB43F7574A589D1F91E48B1C30BD"><enum>(6)</enum><header>Wells and well
				systems</header>
							<subparagraph id="id708EF96DF86A4D7285C7E012876700A0"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall provide grants to nonprofit
				organizations to provide technical assistance to communities and individuals
				regarding the design, operation, construction, and maintenance of household
				wells and small shared well-systems that provide drinking water.</text>
							</subparagraph><subparagraph id="idCDBC800969AC442FBB4E1366789B7825"><enum>(B)</enum><header>Form of
				assistance</header><text>Technical assistance referred to in subparagraph (A)
				may include—</text>
								<clause id="idBF949013F5184B89826F8086F52B944C"><enum>(i)</enum><text>training and
				education;</text>
								</clause><clause id="idD552DD0162A348218C33F4574135DF92"><enum>(ii)</enum><text>operation of a
				hotline; and</text>
								</clause><clause id="id3D941E3FF92B4A8684B4E1084F4359E7"><enum>(iii)</enum><text>the conduct of
				other activities relating to the design and construction of household, shared,
				and small water well systems in rural areas.</text>
								</clause></subparagraph><subparagraph id="id4856AC85C01F4DD7989379E3DCD0FB2F"><enum>(C)</enum><header>Priority</header><text>Subject
				to paragraph (5), in providing grants under this section, the Administrator
				shall give priority to applicants that, as determined by the
				Administrator—</text>
								<clause id="id33BD5C90F4D446199A31362711DBCD4F"><enum>(i)</enum><text>are qualified;
				and</text>
								</clause><clause id="idFAFA3209528C4CC5AB8FCC6FA42E8B78"><enum>(ii)</enum><text>have
				demonstrated experience in providing similar technical assistance and in
				developing similar projects.</text>
								</clause></subparagraph><subparagraph id="id0607EF027AF1409AA39AB5EE24E0882E"><enum>(D)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this paragraph $7,500,000 for each of fiscal years 2009 through
				2013.</text>
							</subparagraph></paragraph><paragraph id="id97DFE72A60B94E178D7ABA9D064D5AB9"><enum>(7)</enum><header>Funding</header>
							<subparagraph id="idA2E1EF744606421BA9E87EE967CF676C"><enum>(A)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to the
				Administrator to carry out this subsection (other than paragraph (6))
				$35,000,000 for each of fiscal years 2009 through 2013.</text>
							</subparagraph><subparagraph id="idCDF8F081261348EC9FD1EAC68B5230EB"><enum>(B)</enum><header>Lobbying
				expenses</header><text>No portion of any State loan fund established under
				section 1452 and no portion of any funds made available under this subsection
				may be used for lobbying expenses.</text>
							</subparagraph><subparagraph id="id3EE4D09B3A9845D4A162285E7D71B4B8"><enum>(C)</enum><header>Indian
				Tribes</header><text>Of the total amount made available under this section for
				each fiscal year, 3 percent shall be used for technical assistance to public
				water systems owned or operated by Indian
				tribes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID114d517118494dcdaa2f36ca31f3b7a8"><enum>203.</enum><header>Preconstruction
			 work</header><text display-inline="no-display-inline">Section 1452(a)(2) of the
			 Safe Drinking Water Act (42 U.S.C. 300j–12(a)(2)) is amended—</text>
				<paragraph id="id7736279622D64AF7BB6372439FDD9282"><enum>(1)</enum><text>by designating
			 the first, second, third, fourth, and fifth sentences as subparagraphs (A),
			 (B), (D), (E), and (F), respectively;</text>
				</paragraph><paragraph id="idEBE2DDC0AA0E4EEF97F49028BEAEDE5D"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B) (as designated by
			 paragraph (1))—</text>
					<subparagraph id="IDbb3ac41e146049a7b05f407c62eea6e6"><enum>(A)</enum><text>by striking
			 <quote>(not</quote> and inserting <quote>(including expenditures for planning,
			 design, and associated preconstruction activities, including activities
			 relating to the siting of the facility, but not</quote>; and</text>

			 before the period at the end the following: <quote>or to replace or

					</subparagraph></paragraph><paragraph id="idD24DE9F77AA04CB4B215E409EA76C293"><enum>(3)</enum><text>by inserting
			 after subparagraph (B) (as designated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC9EE39DA560E485EBDAFE913B8C4BDEE" style="OLC">
						<subparagraph id="id965F6046E8704A46B8180C8A91DE6AF2"><enum>(C)</enum><header>Sale of
				bonds</header><text>Funds may also be used by a public water system to increase
				security at the public water system (excluding any expenditure for operations
				and maintenance), or as a source of revenue (restricted solely to interest
				earnings of the applicable State loan fund) or security for payment of the
				principal and interest on revenue or general obligation bonds issued by the
				State to provide matching funds under subsection (e), if the proceeds of the
				sale of the bonds will be deposited in the State loan
				fund.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID3f26a81e249f4aa58fd79f645b5fd741"><enum>204.</enum><header>Priority
			 system requirements</header><text display-inline="no-display-inline">Section
			 1452(b)(3) of the Safe Drinking Water Act (42 U.S.C. 300j–12(b)(3)) is
			 amended—</text>
				<paragraph id="IDe0a1d97f77b047dcb0f1be0dba4a0caf"><enum>(1)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (D);</text>
				</paragraph><paragraph id="IDa5e6d5e773c94c15a390acc56a7bd58d"><enum>(2)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5E843AB4E10F44E18D69AA621EC6C266" style="OLC">
						<subparagraph id="IDc29f5c8334504e1f9c43ba34bfe60594"><enum>(A)</enum><header>Definition of
				restructuring</header><text>In this paragraph, the term
				<term>restructuring</term> means changes in operations (including ownership,
				cooperative partnerships, asset management, consolidation, and alternative
				water supply).</text>
						</subparagraph><subparagraph id="ID0f5d732c62f8401e8731c8565ca44f62"><enum>(B)</enum><header>Priority
				system</header><text>An intended use plan shall provide, to the maximum extent
				practicable, that priority for the use of funds be given to projects
				that—</text>
							<clause id="IDd6220097fe524a2ca7143f3c5cf8b7f3"><enum>(i)</enum><text>address the most
				serious risk to human health;</text>
							</clause><clause id="ID15f09ed5b4e4435fba00c8095aa0d7b1"><enum>(ii)</enum><text>are necessary to
				ensure compliance with this title (including requirements for filtration);
				and</text>
							</clause><clause id="IDc0d9f7d8f3294fc19667cb9b441a4bbb"><enum>(iii)</enum><text>assist systems
				most in need on a per-household basis according to State affordability
				criteria.</text>
							</clause></subparagraph><subparagraph id="ID4df4532345e54462ba61da3e650d909e"><enum>(C)</enum><header>Weight given to
				applications</header><text>After determining project priorities under
				subparagraph (B), an intended use plan shall further provide that the State
				shall give greater weight to an application for assistance by a community water
				system if the application includes such information as the State determines to
				be necessary, including—</text>
							<clause id="IDb8b7a87c8a894375aa5c87052cd89bac"><enum>(i)</enum><text>an inventory of
				assets, including a description of the condition of the assets;</text>
							</clause><clause id="IDe0e96a5a39bb450e9767270388afbaa6"><enum>(ii)</enum><text>a schedule for
				replacement of assets;</text>
							</clause><clause id="IDcc6805c4be324a4b8c62e2a5f0b65c88"><enum>(iii)</enum><text>a financing
				plan that factors in all life-cycle costs indicating sources of revenue from
				ratepayers, grants, bonds, other loans, and other sources to meet the
				costs;</text>
							</clause><clause id="ID21409ba18eb946ae90c8525f9d29dc22"><enum>(iv)</enum><text>a review of
				options for restructuring the public water system;</text>
							</clause><clause id="ID97ae29d1f8b545e4bd8987b47908aedf"><enum>(v)</enum><text>demonstration of
				consistency with State, regional, and municipal watershed plans; and</text>
							</clause><clause id="ID89bafee011cf4f6997cb115d998c94da"><enum>(vi)</enum><text>a water
				conservation plan consistent with guidelines developed for those plans by the
				Administrator under section 1455(a).</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf6f5c3f6312e48f1a051b2b773f4400e"><enum>(3)</enum><text>in subparagraph
			 (D) (as redesignated by paragraph (1)), by striking <quote>periodically</quote>
			 and inserting <quote>at least biennially</quote>.</text>
				</paragraph></section><section id="ID932d0917b65447caab2d56b40fd4a4d8"><enum>205.</enum><header>Affordability</header><text display-inline="no-display-inline">Section 1452(d)(3) of the Safe Drinking
			 Water Act (42 U.S.C. 300j–12(d)(3)) is amended in the first sentence by
			 inserting <quote>, or portion of a service area,</quote> after <quote>service
			 area</quote>.</text>
			</section><section id="IDa36f3b761c25406ea0f1249637b18095"><enum>206.</enum><header>Safe drinking
			 water revolving loan funds</header><text display-inline="no-display-inline">Section 1452(g) of the Safe Drinking Water
			 Act (42 U.S.C. 300j–12(g)) is amended—</text>

			 (2)—</text>

				year an amount that does not exceed the amount that may be reserved under
				clause (i)(I) for that year from capitalization grants made under section 601
				of that Act (33 U.S.C. 1381); and</text>
									</subclause><subclause id="id28612C72817E4CB88300C43C4752ACD4" indent="up1"><enum>(II)</enum><text>add the reserved funds to any funds
				provided to the State under this section.</text>

				match</header><text>Funds reserved under this paragraph shall not be considered
				to be a State match of a capitalization grant required under this section or

			 contracts</header><text display-inline="no-display-inline">Section 1452 of the
			 Safe Drinking Water Act (42 U.S.C. 300j–12) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idB53E6B58F713463C961562910D052A73" style="OLC">
					<subsection id="ID1e430de57fa14d5e9613bd297771eccc"><enum>(s)</enum><header>Negotiation of
				contracts</header><text>A contract to be carried out using funds directly made
				available by a capitalization grant under this section for program management,
				construction management, feasibility studies, preliminary engineering, design,
				engineering, surveying, mapping, or architectural or related services shall be
				negotiated in the same manner as—</text>
						<paragraph id="id139C1BBA06DD4212A7D94DCF4B93291E"><enum>(1)</enum><text>a contract for
				architectural and engineering services is negotiated under chapter 11 of title
				40, United States Code; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2499CF9B71CC4539BBEF9DF9FBEE5A35"><enum>(2)</enum><text>an equivalent
				State qualifications-based requirement (as determined by the Governor of the
				State).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID839a4ee54498456e8437bb28f81bf975"><enum>210.</enum><header>Critical
			 drinking water infrastructure projects</header>
				<subsection id="ID20aff68e80a04b05a67ff399b375f913"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Administrator
			 of the Environmental Protection Agency shall establish a program under which
			 grants are provided to eligible entities for use in carrying out projects and
			 activities the primary purpose of which is to assist community water systems in
			 meeting the requirements of the Safe Drinking Water Act (42 U.S.C. 300f et
			 seq.).</text>
				</subsection><subsection id="ID9a90d471ced14611abe4c2c718e0886f"><enum>(b)</enum><header>Project
			 selection</header><text>A project that is eligible to be carried out using
			 funds provided under this section may include projects that—</text>
					<paragraph id="ID6f6d5fc131304be489622f31e3f530a9"><enum>(1)</enum><text>develop
			 alternative water sources;</text>
					</paragraph><paragraph id="ID05c9c155f7ee4dd49788647a0d372f43"><enum>(2)</enum><text>provide
			 assistance to small systems; or</text>
					</paragraph><paragraph id="ID09a67ff376be4f71a84c07d91bb13d4a"><enum>(3)</enum><text>assist a
			 community water system—</text>
						<subparagraph id="ID87453dad94394a4c9b0e9beb202c9fb6"><enum>(A)</enum><text>to comply with a
			 national primary drinking water regulation; or</text>
						</subparagraph><subparagraph id="IDc857d02d22d3497bb090171c89b26570"><enum>(B)</enum><text>to mitigate
			 groundwater contamination, including saltwater intrusion.</text>
						</subparagraph></paragraph></subsection><subsection id="IDf7765366f0024c10a7a8192fc4b12dff"><enum>(c)</enum><header>Eligible
			 entities</header><text>An entity eligible to receive a grant under this section
			 is—</text>
					<paragraph id="IDe608564c3ad340adb663036b6ff8f880"><enum>(1)</enum><text>a community water
			 system as defined in section 1401 of the Safe Drinking Water Act (42 U.S.C.
			 300f); or</text>
					</paragraph><paragraph id="IDd1942bd114c64155ac7142f8ca10dbe1"><enum>(2)</enum><text>a system that is
			 located in an area governed by an Indian tribe (as defined in section 1401 of
			 the Safe Drinking Water Act (42 U.S.C. 300f));</text>
					</paragraph></subsection><subsection id="IDc78c5d89ed864bd0bd002e3f06038656"><enum>(d)</enum><header>Priority</header><text>In
			 prioritizing projects for implementation under this section, the Administrator
			 shall give priority to community water systems that—</text>
					<paragraph id="ID36aa82c1ff344e69aec189788ef5b5f6"><enum>(1)</enum><text>serve a community
			 that, under affordability criteria established by the State under section
			 1452(d)(3) of the Safe Drinking Water Act (42 U.S.C. 300j–12), is determined by
			 the State to be—</text>
						<subparagraph id="ID5d1ca328af0e46798b7aead3af3684da"><enum>(A)</enum><text>a disadvantaged
			 community; or</text>
						</subparagraph><subparagraph id="IDc028331e7cdd4fc891a5e4d917932a37"><enum>(B)</enum><text>a community that
			 may become a disadvantaged community as a result of carrying out an eligible
			 activity; or</text>
						</subparagraph></paragraph><paragraph id="ID3a505d7469af4468a3183be026c0c87e"><enum>(2)</enum><text>serve a community
			 with a population of less than 10,000 individuals.</text>
					</paragraph></subsection><subsection id="ID315f3c6bc92246f0911eb230c957f9b0"><enum>(e)</enum><header>Local
			 participation</header><text>In prioritizing projects for implementation under
			 this section, the Administrator shall consult with, and consider the priorities
			 of, affected States, Indian tribes, and local governments.</text>
				</subsection><subsection id="IDf3f490512b08403eb769dac0e5f6b0fc"><enum>(f)</enum><header>Cost-sharing</header><text>Before
			 carrying out any project under this section, the Administrator shall enter into
			 a binding agreement with 1 or more non-Federal interests that shall require the
			 non-Federal interests—</text>
					<paragraph id="IDea232590e2154344bf99c02a5cacf281"><enum>(1)</enum><text>to pay 45 percent
			 of the total costs of the project, which may include services, materials,
			 supplies, or other in-kind contributions;</text>
					</paragraph><paragraph id="ID7e87c3d2bbb343a0b85ec532160765b7"><enum>(2)</enum><text>to provide any
			 land, easements, rights-of-way, and relocations necessary to carry out the
			 project; and</text>
					</paragraph><paragraph id="ID5469226bf7f645c2a42951c7780685a3"><enum>(3)</enum><text>to pay 100
			 percent of any operation, maintenance, repair, replacement, and rehabilitation
			 costs associated with the project.</text>
					</paragraph></subsection><subsection id="ID598831a71b84422a86c932f9a294c23c"><enum>(g)</enum><header>Waiver</header><text>The
			 Administrator may waive the requirement to pay the non-Federal share of the
			 cost of carrying out an eligible activity using funds from a grant provided
			 under this section if the Administrator determines that an eligible entity is
			 unable to pay, or would experience significant financial hardship if required
			 to pay, the non-Federal share.</text>
				</subsection><subsection id="ID38363c0047164940a07925e7ba404311"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $300,000,000 for each of fiscal years 2008 through
			 2012.</text>
				</subsection></section><section id="ID289aeb8fdcb041afa42b464904fdffa7"><enum>211.</enum><header>District of
			 Columbia lead service line replacement</header>
				<subsection id="IDc550233a59d9474e8f2d5f121788b8f5"><enum>(a)</enum><header>Service line
			 replacement</header>
					<paragraph id="idF07A83880FF04712B15C7AED5D99BD8B"><enum>(1)</enum><header>Galvanic
			 effects</header><text>In carrying out lead service line replacement in the
			 District of Columbia, the galvanic effects of replacement of the service lines
			 shall be addressed prior to replacement.</text>
					</paragraph><paragraph id="id93B1D3A4FEE945B5840B6DA4BFB34F11"><enum>(2)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out lead service line replacement in the District of Columbia $30,000,000 for
			 each of fiscal years 2008 through 2012.</text>
					</paragraph></subsection><subsection id="ID53f227942d9c4426b2d2f91631b6ca6d"><enum>(b)</enum><header>Lead service
			 line replacement assistance fund</header>
					<paragraph id="idDED9E0B94BBC460DB4F2A88B07E247D6"><enum>(1)</enum><header>Definition of
			 low-income</header><text>In this subsection, the term <term>low-income</term>
			 shall be defined by the District of Columbia.</text>
					</paragraph><paragraph id="ID413d593a20b84d858ae34c3e044d7924"><enum>(2)</enum><header>Grants</header><text>Of
			 the funds provided under subsection (a)(2), not more than $2,000,000 per year
			 may be allocated for water service line replacement grants to provide
			 assistance to low-income residents to replace the privately-owned portion of
			 lead service lines.</text>
					</paragraph><paragraph id="ID5b921f62b5454a6b9e873cf3541a6355"><enum>(3)</enum><header>Limitation</header><text>An
			 individual grant provided under paragraph (2) shall not exceed $5,000.</text>
					</paragraph></subsection></section></title><title id="id67BDDCD375B544C990E61D45960D3257"><enum>III</enum><header>Miscellaneous</header>
			<section id="ID7328abaaf6264d18928ad4389431c579"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="IDb4b84a3b21ea4ce396917ae1eadfc85e"><enum>(1)</enum><header>Academy</header><text>The
			 term <term>Academy</term> means the National Academy of Sciences.</text>
				</paragraph><paragraph id="ID2b00ebd545db4b2aa18c50c27d7b1c18"><enum>(2)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph id="IDa224df6f422246fabbeaf09269d8352a"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means—</text>
					<subparagraph id="IDf0c96e90f5fa4d14af96292dca7abacd"><enum>(A)</enum><text>as used in
			 section 303, the Secretary of Agriculture; and</text>
					</subparagraph><subparagraph id="ID108b88e7fe374b9580ba71f674ae2c5d"><enum>(B)</enum><text>as used in
			 section 306, the Secretary of the Interior, acting through the Director of the
			 United States Geological Survey.</text>
					</subparagraph></paragraph></section><section id="IDc2356c6dcbdd418fa12af7ec0aab150a"><enum>302.</enum><header>Program for
			 water quality enhancement and management</header>
				<subsection id="ID6bc53a3a5dc545d6b41219fe74086786"><enum>(a)</enum><header>Initial grant
			 program</header>
					<paragraph id="IDf1f3d03f69c345c498479627761f8f5d"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Administrator shall establish a program to award grants and enter
			 into contracts and cooperative agreements with research institutions,
			 institutions of higher education, and other appropriate entities (including
			 consortia of such institutions and entities), through a competitive process,
			 for research on and development of the use of innovative and alternative
			 technologies to improve water quality or drinking water supply.</text>
					</paragraph><paragraph id="ID9b774cf59f7144c2a6bf8f0c5cff9ae4"><enum>(2)</enum><header>Types of
			 projects</header><text>In carrying out this subsection, the Administrator may
			 select projects relating to such matters as innovative or alternative
			 technologies, approaches, practices, or methods—</text>
						<subparagraph id="ID5c28f71f7deb445dbc317905013842e3"><enum>(A)</enum><text>to increase the
			 effectiveness and efficiency of water and wastewater infrastructure through the
			 use of integrated water resource management;</text>
						</subparagraph><subparagraph id="IDc4d6c17478e145fb8b73fe65d6078429"><enum>(B)</enum><text>to increase the
			 effectiveness and efficiency of public water systems, including—</text>
							<clause id="ID698b3878a96044b9a7cfdbf619310909"><enum>(i)</enum><text>source water
			 protection;</text>
							</clause><clause id="ID91742fc8026f4305933bf54fda88f11a"><enum>(ii)</enum><text>water use
			 reduction;</text>
							</clause><clause id="ID9e865e9dff13423c828e2abea2753bc8"><enum>(iii)</enum><text>water
			 reuse;</text>
							</clause><clause id="IDa0422bb0482541aa97e3e4162c6a6785"><enum>(iv)</enum><text>water
			 treatment;</text>
							</clause><clause id="ID7a4a5d592ac74e93aca1883a02cd2338"><enum>(v)</enum><text>water
			 distribution and wastewater collection systems; and</text>
							</clause><clause id="ID7da8a4ecf7344b099a717ed1b2eebd8f"><enum>(vi)</enum><text>water
			 security;</text>
							</clause></subparagraph><subparagraph id="IDf8d1b6cc937d4917a5125a9a46fffa2d"><enum>(C)</enum><text>to encourage the
			 use of innovative or alternative technologies or approaches relating to water
			 supply or availability;</text>
						</subparagraph><subparagraph id="IDa7a355e534784f6a99fce05029420df9"><enum>(D)</enum><text>to increase the
			 effectiveness and efficiency of new and existing treatment works,
			 including—</text>
							<clause id="ID39c5d32268b34381b65dd1192ab7f89d"><enum>(i)</enum><text>methods of
			 collecting, treating, dispersing, reusing, reclaiming, and recycling
			 wastewater;</text>
							</clause><clause id="ID20987554fab04990814c4906cd0998b6"><enum>(ii)</enum><text>system
			 design;</text>
							</clause><clause id="ID098bcc1e211644eb85c86555bef0a8b2"><enum>(iii)</enum><text>nonstructural
			 alternatives;</text>
							</clause><clause id="IDfd43815099b9416d8924b9c7ee15a1fb"><enum>(iv)</enum><text>decentralized
			 approaches;</text>
							</clause><clause id="ID3ab92fe33982416c920c48879730264e"><enum>(v)</enum><text>stormwater and
			 wastewater reuse;</text>
							</clause><clause id="ID15b386d9918841a6a643627ee5811d83"><enum>(vi)</enum><text>water efficiency
			 and conservation; and</text>
							</clause><clause id="ID5e256ffef6ba423badffa2488a4902cd"><enum>(vii)</enum><text>wastewater
			 security;</text>
							</clause></subparagraph><subparagraph id="ID13e0fc8739b0417cb28e1cf612a26a48"><enum>(E)</enum><text>to increase the
			 effectiveness and efficiency of municipal separate storm sewer systems and
			 combined sewer systems, including through the use of soil and vegetation or
			 other permeable materials;</text>
						</subparagraph><subparagraph id="IDf6ec65bf35424b5fb5fb5204c86634b0"><enum>(F)</enum><text>to promote new
			 water treatment technologies and management approaches, including
			 commercialization and dissemination strategies for adoption of innovative
			 water, wastewater, and stormwater technologies and management approaches or
			 low-impact development technologies in the homebuilding industry; or</text>
						</subparagraph><subparagraph id="ID90f476ff8ea64071893f370f73ae18a5"><enum>(G)</enum><text>to maintain a
			 clearinghouse of technologies and management approaches developed under this
			 subsection and subsection (b) at a research consortium or institute.</text>
						</subparagraph></paragraph><paragraph id="ID6f8f25e55fb544c0bbcc59410b49a6c7"><enum>(3)</enum><header>Report</header><text>Not
			 later than 2 years after the date on which the program is established under
			 paragraph (1), the Administrator shall publish a report that details the
			 findings of each recipient of a grant under the program with respect to the
			 identification of any potential new technologies or management approaches
			 developed in accordance with this section.</text>
					</paragraph></subsection><subsection id="IDc82eb91f52674274bbdcb06ad8cef493"><enum>(b)</enum><header>Nationwide
			 grant program</header>
					<paragraph id="IDbfa8d086fe604ecfa0adfe3c1231a0e0"><enum>(1)</enum><header>Definition of
			 municipality</header><text>In this subsection, the term
			 <term>municipality</term> means—</text>
						<subparagraph id="id41E0AD223B3B468EB1B154073F1FC6D6"><enum>(A)</enum><text>a city, town,
			 borough, county, parish, district, association, or other public body created by
			 or pursuant to State law; or</text>
						</subparagraph><subparagraph id="id6C691E60CA614A90A39773AE1FB4BA86"><enum>(B)</enum><text>an Indian tribe
			 (as defined in section 4 of the <act-name parsable-cite="ISDA">Indian
			 Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
			 450b)).</text>
						</subparagraph></paragraph><paragraph id="idC44422112DA946E7BF479871E2117A3E"><enum>(2)</enum><header>Establishment</header><text>Not
			 later than 90 days after the date of publication of the report under subsection
			 (a)(3), the Administrator shall establish a nationwide demonstration grant
			 program—</text>
						<subparagraph id="IDefe86006fc4d4066a2c3294665d1e8a6"><enum>(A)</enum><text>to promote
			 innovations in technology and alternative approaches to water quality
			 management or water supply developed under subsection (a); and</text>
						</subparagraph><subparagraph id="ID89ed18e637e64ed4842db6d4278fdcff"><enum>(B)</enum><text>to reduce costs
			 to municipalities incurred in complying with the Federal Water Pollution
			 Control Act (33 U.S.C. 1251 et seq.) and the Safe Drinking Water Act (42 U.S.C.
			 300f et seq.) through the approaches and technologies developed under
			 subsection (a).</text>
						</subparagraph></paragraph><paragraph id="IDd8cfa13576814767ada371d97d1a9420"><enum>(3)</enum><header>Scope</header><text>The
			 demonstration grant program shall consist of up to 10 projects each year, to be
			 carried out in municipalities selected by the Administrator under paragraph
			 (4).</text>
					</paragraph><paragraph id="IDbbd3c1ef88fc4793885dcf45362f522d"><enum>(4)</enum><header>Selection of
			 municipalities</header>
						<subparagraph id="IDb85ef5971e494e41ba7258dad52f4a53"><enum>(A)</enum><header>Application</header><text>A
			 municipality that seeks to participate in the demonstration grant program
			 established under paragraph (2) shall submit to the Administrator a plan
			 that—</text>
							<clause id="IDbaa3b8dcb6564751bcb46d2bd304ab17"><enum>(i)</enum><text>is
			 developed in coordination with—</text>
								<subclause id="ID0aefdc4ba0e548e9b36840e943865fc5"><enum>(I)</enum><text>the agencies of
			 the State having jurisdiction over water quality and water supply matters;
			 and</text>
								</subclause><subclause id="ID4a7867dace394815b1626f54f766df3b"><enum>(II)</enum><text>interested
			 stakeholders, including institutions of higher education and related research
			 institutions;</text>
								</subclause></clause><clause id="IDaeaaf69c0afc46e0bc3119f3929efdc7"><enum>(ii)</enum><text>describes water
			 impacts specific to urban or rural areas;</text>
							</clause><clause id="IDbe0e4c4e871f4e2493177b1590922a31"><enum>(iii)</enum><text>includes a
			 strategy under which the municipality, through participation in the
			 demonstration grant program, could effectively—</text>
								<subclause id="ID77d630564cb045cb9cfe4d6f58d33650"><enum>(I)</enum><text>address water
			 quality or water supply problems; and</text>
								</subclause><subclause id="IDa2a5f73480f94a80b6245aa1ef174387"><enum>(II)</enum><text>achieve the
			 water quality goals that—</text>
									<item id="ID364e8e1c49f1490b90ad00ff4fd2bcd8"><enum>(aa)</enum><text>could be
			 achieved using more traditional methods; and</text>
									</item><item id="ID7d5321b942d8401097e622df4ad7cdf5"><enum>(bb)</enum><text>are
			 required under the Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.)
			 or the Safe Drinking Water Act (42 U.S.C. 300f et seq.); and</text>
									</item></subclause></clause><clause id="ID43a1bdcd02a345bca392c2a6ef4200f3"><enum>(iv)</enum><text>includes a
			 schedule for achieving the water quality or water supply goals of the
			 municipality.</text>
							</clause></subparagraph><subparagraph id="IDe1b1f3875f7d4e6286509c218bce7410"><enum>(B)</enum><header>Categories of
			 projects</header><text>In carrying out the demonstration grant program, the
			 Administrator shall provide grants for projects relating to water supply or
			 water quality matters described in subsection (a)(2)(A).</text>
						</subparagraph><subparagraph id="IDa2132a55f24745d89b47930d2c080995"><enum>(C)</enum><header>Responsibilities
			 of Administrator</header><text>In providing grants for projects under this
			 subsection, the Administrator shall—</text>
							<clause id="ID85075a50dcd449bcbb8c479c45f5eb68"><enum>(i)</enum><text>ensure, to the
			 maximum extent practicable, that—</text>
								<subclause id="ID3363060b3d264d8b91aca5ec9841e6d1"><enum>(I)</enum><text>the demonstration
			 grant program under this subsection includes a variety of projects with respect
			 to—</text>
									<item id="IDc9a28c669b5b4f73b9e7cbed24af5ca6"><enum>(aa)</enum><text>geographical
			 distribution;</text>
									</item><item id="ID70d66fcd9718448699778eace83eacef"><enum>(bb)</enum><text>innovative
			 technologies used for the projects; and</text>
									</item><item id="ID4738823c4c9842f0a3b9d1dfdd4da23c"><enum>(cc)</enum><text>nontraditional
			 approaches (including low-impact development technologies) used for the
			 projects; and</text>
									</item></subclause><subclause id="ID64cc68ea714e47bc870bb693758926d7"><enum>(II)</enum><text>each category of
			 project described in subparagraph (B) is adequately represented;</text>
								</subclause></clause><clause id="ID0703d265a36f4afa94343738ceca236b"><enum>(ii)</enum><text>give higher
			 priority to projects that—</text>
								<subclause id="IDb0ed111d30fb4c079370b986757352fe"><enum>(I)</enum><text>address multiple
			 problems; and</text>
								</subclause><subclause id="IDffdf1260c51244699f09e543bcf0dd85"><enum>(II)</enum><text>are regionally
			 applicable;</text>
								</subclause></clause><clause id="ID977d9f6fc7a447079b51990fc5c4e480"><enum>(iii)</enum><text>ensure, to the
			 maximum extent practicable, that at least 1 community having a population of
			 10,000 or fewer individuals receives a grant for each fiscal year; and</text>
							</clause><clause id="IDc8b13e64fd7b476cb3d523badf30be0d"><enum>(iv)</enum><text>ensure that, for
			 each fiscal year, no municipality receives more than 25 percent of the total
			 amount of funds made available for the fiscal year to provide grants under this
			 subsection.</text>
							</clause></subparagraph><subparagraph id="ID044848f65e1845b2a534a4909046fa28"><enum>(D)</enum><header>Cost
			 sharing</header>
							<clause id="ID7b1901bcd8bf4ba685f943f5d34bddf6"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), the non-Federal share
			 of the total cost of a project funded by a grant under this subsection shall be
			 not less than 20 percent.</text>
							</clause><clause id="IDd3f4f3bddb734e999d5170395871c180"><enum>(ii)</enum><header>Waiver</header><text>The
			 Administrator may reduce or eliminate the non-Federal share of the cost of a
			 project for reasons of affordability.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDfad1b2bf5f9a48f9a17804caf5c910a0"><enum>(c)</enum><header>Reports</header>
					<paragraph id="ID1b44ecf467ca4012a988318b8ce7e99d"><enum>(1)</enum><header>Reports from
			 grant recipients</header><text>A recipient of a grant under this section shall
			 submit to the Administrator, on the date of completion of a project of the
			 recipient and on each of the dates that is 1, 2, and 3 years after that date, a
			 report that describes the effectiveness of the project.</text>
					</paragraph><paragraph id="ID87489c2c8182454ab8c69c90f5aeae93"><enum>(2)</enum><header>Reports to
			 congress</header><text>Not later than 2 years after the date of enactment of
			 this Act, and every 2 years thereafter, the Administrator shall submit to the
			 Committee on Environment and Public Works of the Senate and the Committee on
			 Transportation and Infrastructure and the Committee on Energy and Commerce of
			 the House of Representatives a report that describes the status and results of
			 the grant programs under this section.</text>
					</paragraph></subsection><subsection id="IDfba4b2d1792e412693eb44d81b10f830"><enum>(d)</enum><header>Incorporation
			 of Results and Information</header><text>To the maximum extent practicable, the
			 Administrator shall incorporate the results of, and information obtained from,
			 successful projects under this section into programs administered by the
			 Administrator.</text>
				</subsection><subsection id="IDd14b6f0ef8fe45048ad0d5e464f5d360"><enum>(e)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $20,000,000 for each of fiscal years 2008 through 2012.</text>
				</subsection></section><section id="IDe7572630dd1a4386921a6041f2d68d18"><enum>303.</enum><header>Agricultural
			 pollution control technology grant program</header>
				<subsection id="ID4a3028028bf04bb09faeb83e52debeb9"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="IDfdcd0fa28e8b42f38b97140ba6b9ccbe"><enum>(1)</enum><header>Agricultural
			 commodity</header><text>The term <term>agricultural commodity</term>
			 means—</text>
						<subparagraph id="ID8be3eff9291a438ea88095271d7fc2c6"><enum>(A)</enum><text>agricultural,
			 horticultural, viticultural, and dairy products;</text>
						</subparagraph><subparagraph id="ID6fc0e734e5874d8cb37af950b301c27b"><enum>(B)</enum><text>livestock and the
			 products of livestock;</text>
						</subparagraph><subparagraph id="ID353c8e3c3c1b4156baa9ba98e30da0c4"><enum>(C)</enum><text>the products of
			 poultry and bee raising;</text>
						</subparagraph><subparagraph id="IDcd4c6b25a7b848c7a0e7b229ed20b464"><enum>(D)</enum><text>the products of
			 forestry; and</text>
						</subparagraph><subparagraph id="ID3bea97cabbdf4b31b7bf1b1634443c99"><enum>(E)</enum><text>other commodities
			 raised or produced on agricultural sites, as determined to be appropriate by
			 the Secretary.</text>
						</subparagraph></paragraph><paragraph id="IDb74e462484c34910b39ca88cb2721632"><enum>(2)</enum><header>Agricultural
			 project</header><text>The term <term>agricultural project</term> means an
			 agricultural pollution control technology pilot project that, as determined by
			 the Administrator—</text>
						<subparagraph id="ID27e722a466ca4fda91dcc115ae6382ec"><enum>(A)</enum><text>is carried out at
			 an agricultural site;</text>
						</subparagraph><subparagraph id="ID16aecf69b4fb47e98c24333ef33987df"><enum>(B)</enum><text>achieves
			 demonstrable reductions in water pollution or water use that meet or exceed
			 those mandated by statutory or regulatory requirements; and</text>
						</subparagraph><subparagraph id="ID875f27a5c9e04cf59bc619a9f60e9b45"><enum>(C)</enum><text>will not
			 substantially adversely affect any other long-term environmental medium,
			 including air and groundwater resources.</text>
						</subparagraph></paragraph><paragraph id="ID7a5c339a6f0549d79ea5958bc38540cd"><enum>(3)</enum><header>Agricultural
			 site</header><text>The term <term>agricultural site</term> means a farming or
			 ranching operation of a producer.</text>
					</paragraph><paragraph id="ID51117ab673b84a43a2d1278811222c9a"><enum>(4)</enum><header>Producer</header><text>The
			 term <term>producer</term> means any person who is engaged in the production
			 and sale of an agricultural commodity in the United States and who owns, or
			 shares the ownership and risk of loss of, the agricultural commodity.</text>
					</paragraph><paragraph id="IDc2935cb75a804ac18bc4f8be6681a4ac"><enum>(5)</enum><header>Revolving
			 fund</header><text>The term <term>revolving fund</term> means an agricultural
			 pollution control technology State revolving fund established by a State using
			 amounts provided under subsection (b)(1).</text>
					</paragraph></subsection><subsection id="ID5caf424f0d5f4e3395877330ad96e18c"><enum>(b)</enum><header>Grants for
			 agricultural State revolving funds</header>
					<paragraph id="ID3a73ccb73fae48f8885aae6ddbf14c18"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this section, the Administrator shall provide to each eligible State described
			 in paragraph (2) 1 or more capitalization grants, that cumulatively equal no
			 more than $1,000,000 per State, for use in establishing, within an agency of
			 the State having jurisdiction over agriculture or environmental quality, an
			 agricultural pollution control technology State revolving fund.</text>
					</paragraph><paragraph id="ID078509334bfb4d16b9b2673d1cf37741"><enum>(2)</enum><header>Eligible
			 States</header><text>An eligible State referred to in paragraph (1) is a State
			 that agrees, prior to receipt of a capitalization grant under paragraph
			 (1)—</text>
						<subparagraph id="ID01ccbf2a407c4209a07c3e86ed88dea3"><enum>(A)</enum><text>to establish, and
			 deposit the funds from the grant in, a revolving fund;</text>
						</subparagraph><subparagraph id="ID9228a80f995f41aba247d351925a4127"><enum>(B)</enum><text>to provide, at a
			 minimum, a State share in an amount equal to 20 percent of the capitalization
			 grant;</text>
						</subparagraph><subparagraph id="IDb881a725488345e49a7ad48ee17369ee"><enum>(C)</enum><text>to use amounts in
			 the revolving fund to make loans to producers in accordance with subsection
			 (c); and</text>
						</subparagraph><subparagraph id="IDe3b147f7f45547a7b02d6dc476945b66"><enum>(D)</enum><text>to return amounts
			 in the revolving fund if no loan applications are granted within 2 years of the
			 receipt of the initial capitalization grant.</text>
						</subparagraph></paragraph></subsection><subsection id="ID14fbba5c24d24619918d8e341ad11c10"><enum>(c)</enum><header>Loans to
			 producers</header>
					<paragraph id="ID9272f9a3948c40c5ba9f4c8f2a9e9ed4"><enum>(1)</enum><header>Use of
			 funds</header><text>A State that establishes a revolving fund under subsection
			 (b)(2) shall use amounts in the revolving fund to provide loans to producers
			 for use in designing and constructing agricultural projects.</text>
					</paragraph><paragraph id="ID4e4b243e11d94b57b27249801b59fa95"><enum>(2)</enum><header>Maximum amount
			 of loan</header><text>The amount of a loan made to a producer using funds from
			 a revolving fund shall not exceed $250,000, in the aggregate, for all
			 agricultural projects serving an agricultural site of the producer.</text>
					</paragraph><paragraph id="ID6b875b3e577e4b8daad160c0ba8708f3"><enum>(3)</enum><header>Conditions on
			 loans</header><text>A loan made to a producer using funds from a revolving fund
			 shall—</text>
						<subparagraph id="ID2b2a506390ce4a399fc7577292093714"><enum>(A)</enum><text>have an interest
			 rate that is not more than the market interest rate, including an interest-free
			 loan; and</text>
						</subparagraph><subparagraph id="ID52c4c179697543ccb2d3535d991ee2c2"><enum>(B)</enum><text>be repaid to the
			 revolving fund not later than 20 years after the date on which the loan is
			 made.</text>
						</subparagraph></paragraph></subsection><subsection id="ID5fc61e773cfd4f188050610d0b500ce7"><enum>(d)</enum><header>Requirements
			 for producers</header>
					<paragraph id="ID36dccfc5e20844858de1b6e5d4072c55"><enum>(1)</enum><header>In
			 general</header><text>A producer that seeks to receive a loan from a revolving
			 fund shall—</text>
						<subparagraph id="ID1b3845bba65d4f22839aefff6178e164"><enum>(A)</enum><text>submit to the
			 State in which the agricultural site of the producer is located an application
			 that—</text>
							<clause id="ID9126b867eae446b6a49d13d14ac0cfc9"><enum>(i)</enum><text>contains such
			 information as the State may require; and</text>
							</clause><clause id="IDc18e82f10f034ed2a35df403f02eede9"><enum>(ii)</enum><text>demonstrates, to
			 the satisfaction of the State, that each project proposed to be carried out
			 with funds from the loan is an agricultural project; and</text>
							</clause></subparagraph><subparagraph id="IDb157e65753f44a61aceabae69d74e097"><enum>(B)</enum><text>agree to expend
			 all funds from a loan in an expeditious and timely manner, as determined by the
			 State.</text>
						</subparagraph></paragraph><paragraph id="ID9845b73c6c344cf8a44f355b8fc2724b"><enum>(2)</enum><header>Maximum
			 percentage of agricultural project cost</header><text>Subject to subsection
			 (c)(2), a producer that receives a loan from a revolving fund may use funds
			 from the loan to pay up to 100 percent of the cost of carrying out an
			 agricultural project.</text>
					</paragraph></subsection><subsection id="ID92d08b056e734d28a5669b1a20d44d07"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $50,000,000.</text>
				</subsection></section><section id="ID41edf3fdfe5642c9a6b7f66a7ed1f788"><enum>304.</enum><header>State
			 revolving fund review process</header><text display-inline="no-display-inline">As soon as practicable after the date of
			 enactment of this Act, the Administrator shall—</text>
				<paragraph id="IDbeec2f4cb4d04b5f8d9b1cf212514a44"><enum>(1)</enum><text>consult with
			 States, utilities, nonprofit organizations, and other Federal agencies
			 providing financial assistance to identify ways to expedite and improve the
			 application and review process, for the provision of assistance from—</text>
					<subparagraph id="IDfdffd4db713d44ff89f98596f7d6d8ce"><enum>(A)</enum><text>the State water
			 pollution control revolving funds established under title VI of the Federal
			 Water Pollution Control Act (33 U.S.C. 1381 et seq.); and</text>
					</subparagraph><subparagraph id="ID3e37516ba1564b209d4e0f0c3e7b61eb"><enum>(B)</enum><text>the State
			 drinking water treatment revolving loan funds established under section 1452 of
			 the Safe Drinking Water Act (42 U.S.C. 300j–12);</text>
					</subparagraph></paragraph><paragraph id="IDf40d4e90fef341c5b29af24429ab62ad"><enum>(2)</enum><text>in carrying out
			 this section, the Administrator shall consider the needs of small treatment
			 works (as defined by section 222 of the Federal Water Pollution Control Act and
			 small public water systems (as described in section 1433(d) of the Safe
			 Drinking Water Act (42 U.S.C. 300i–2(d));</text>
				</paragraph><paragraph id="ID2c7dbb898c3b4a58a99e6dc6e7312b46"><enum>(3)</enum><text>take such
			 administrative action as is necessary to expedite and improve the process as
			 the Administrator has authority to take under existing law;</text>
				</paragraph><paragraph id="ID545727ca786642948a9799937154020f"><enum>(4)</enum><text>collect
			 information relating to innovative approaches taken by any State to simplify
			 the application process of the State, and provide the information to each
			 State; and</text>
				</paragraph><paragraph id="IDd9eaf9829bad4ab2bf20afa9e2403282"><enum>(5)</enum><text>submit to
			 Congress a report that, based on the information identified under paragraph
			 (1), contains recommendations for legislation to facilitate further
			 streamlining and improvement of the process.</text>
				</paragraph></section><section id="IDb6cc56658510467486fb8108a4806c5b"><enum>305.</enum><header>Cost of
			 service study</header>
				<subsection id="ID56c64c39da6b45448703a65057d7bd7d"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Administrator shall enter an arrangement with the Academy under
			 which the Academy shall complete and provide to the Administrator the results
			 of a study of the means by which public water systems and treatment works
			 selected by the Academy in accordance with subsection (c) meet the costs
			 associated with operations, maintenance, capital replacement, and regulatory
			 requirements.</text>
				</subsection><subsection id="ID36ea78d890c24d9b9ade68414401270b"><enum>(b)</enum><header>Required
			 elements</header>
					<paragraph id="ID74b61d10bb6f46d79b126ce282b05604"><enum>(1)</enum><header>Affordability</header><text>The
			 study shall, at a minimum—</text>
						<subparagraph id="IDb7631b755823414eb119cf1590e16a0d"><enum>(A)</enum><text>determine whether
			 the rates at public water systems and treatment works for communities included
			 in the study were established using a full-cost pricing model;</text>
						</subparagraph><subparagraph id="IDe9dcc3f7eabb46ac8ef0de3ddffbc176"><enum>(B)</enum><text>if a full-cost
			 pricing model was not used, identify any incentive rate systems that have been
			 successful in significantly reducing—</text>
							<clause id="IDf72846f39ee74beb8fc28db3fc37da6c"><enum>(i)</enum><text>per
			 capita water demand;</text>
							</clause><clause id="ID07279479f8f34c27bca25bf4a8110ee0"><enum>(ii)</enum><text>the volume of
			 wastewater flows;</text>
							</clause><clause id="ID0ae0060c945b4fa588f4e0ee3f64354f"><enum>(iii)</enum><text>the volume of
			 stormwater runoff; or</text>
							</clause><clause id="IDe71afac24d514a96b6e10a871a1fcfcd"><enum>(iv)</enum><text>the quantity of
			 pollution generated by stormwater;</text>
							</clause></subparagraph><subparagraph id="IDa4ff36247bbc4d37ad1df756f6a220c7"><enum>(C)</enum><text>identify a set of
			 best industry practices that public water systems and treatment works may use
			 in establishing a rate structure that—</text>
							<clause id="ID6d33516bc0d04b3686e3265464b90c05"><enum>(i)</enum><text>adequately
			 addresses the true cost of services provided to consumers by public water
			 systems and treatment works, including infrastructure replacement;</text>
							</clause><clause id="ID726c17abe19f47ed9119a4926fff0ede"><enum>(ii)</enum><text>encourages water
			 conservation; and</text>
							</clause><clause id="ID54dc3be5ec5b4e73a0b60e23c74f73cd"><enum>(iii)</enum><text>takes into
			 consideration the needs of disadvantaged individuals and communities, as
			 identified by the Administrator;</text>
							</clause></subparagraph><subparagraph id="IDf334763c03aa44e58c119d97e8d4ef7f"><enum>(D)</enum><text>identify existing
			 standards for affordability and the manner in which those standards are
			 determined and defined;</text>
						</subparagraph><subparagraph id="ID5b7800f0c1c54e9da50b7e8fd6fde70c"><enum>(E)</enum><text>determine the
			 manner in which affordability varies with respect to communities of different
			 sizes and in different regions; and</text>
						</subparagraph><subparagraph id="IDbf479ab322324461b7305ced13ffe067"><enum>(F)</enum><text>determine the
			 extent to which affordability affects the decision of a community to increase
			 public water system and treatment works rates (including the decision relating
			 to the percentage by which those rates should be increased).</text>
						</subparagraph></paragraph><paragraph id="ID00fef5094ce845eca5f31f0b37623a55"><enum>(2)</enum><header>Disadvantaged
			 communities</header><text>The study shall, at a minimum—</text>
						<subparagraph id="ID071154dc3e9c4218a8a1f557a85f84b8"><enum>(A)</enum><text>survey a
			 cross-section of States representing different sizes, demographics, and
			 geographical regions;</text>
						</subparagraph><subparagraph id="ID183e97f6f9234f21bcaf689a39b91e25"><enum>(B)</enum><text>describe, for
			 each State described in subparagraph (A), the definition of
			 <quote>disadvantaged community</quote> used in the State in carrying out
			 projects and activities under the Safe Drinking Water Act (42 U.S.C. 300f et
			 seq.);</text>
						</subparagraph><subparagraph id="IDa7bb803cd3fc40e38426ef6b37c3fac5"><enum>(C)</enum><text>review other
			 means of identifying the meaning of the term <quote>disadvantaged</quote>, as
			 that term applies to communities;</text>
						</subparagraph><subparagraph id="IDf9888909fa804cadbb5b56d35a049e4b"><enum>(D)</enum><text>determine which
			 factors and characteristics are required for a community to be considered
			 <quote>disadvantaged</quote>; and</text>
						</subparagraph><subparagraph id="IDcbd4c3eb7e48441fa059ae7f5eb550e9"><enum>(E)</enum><text>evaluate the
			 degree to which factors such as a reduction in the tax base over a period of
			 time, a reduction in population, the loss of an industrial base, and the
			 existence of areas of concentrated poverty are taken into account in
			 determining whether a community is a disadvantaged community.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd93b80dde07b47e0b5259ef99c34574c"><enum>(c)</enum><header>Selection of
			 communities</header><text>The Academy shall select communities, the public
			 water system and treatment works rate structures of which are to be studied
			 under this section, that include a cross-section of communities representing
			 various populations, income levels, demographics, and geographical
			 regions.</text>
				</subsection><subsection id="IDbf14d0cb056e4e3caf44574925dc756e"><enum>(d)</enum><header>Use of Results
			 of Study</header><text>On receipt of the results of the study, the
			 Administrator shall—</text>
					<paragraph id="IDad2015ba0d544d8795d2f2fe88adf04f"><enum>(1)</enum><text>submit the study
			 to Congress;</text>
					</paragraph><paragraph id="ID3df0d62ebd8643bf925a16ef8023fdfc"><enum>(2)</enum><text>submit a report
			 that describes the results of the study; and</text>
					</paragraph><paragraph id="ID640e49ae1ac145239d9d3acd73b07d37"><enum>(3)</enum><text>make the results
			 available to treatment works and public water systems for use by the publicly
			 owned treatment works and public water systems, on a voluntary basis, in
			 determining whether 1 or more new approaches may be implemented at facilities
			 of the publicly owned treatment works and public water systems.</text>
					</paragraph></subsection><subsection id="IDacd3fc08971f4f66a1d23a42521c5a48"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $1,000,000 for each of fiscal years 2008 and 2009.</text>
				</subsection></section><section id="ID0900f55728da4c28ae75ee72117c111d"><enum>306.</enum><header>Water
			 management study</header>
				<subsection id="IDf1fab32d0f53448b9263fbf52b2adf9a"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Administrator shall enter into an arrangement with the Academy
			 under which the Academy shall conduct a study, during the 26-month period
			 beginning on the date of enactment of this Act, of innovative, effective, and
			 systematic approaches for the management of water supply, wastewater, and
			 stormwater in urban areas and surrounding communities (including greenfield
			 developments) in the United States and other countries.</text>
				</subsection><subsection id="ID6ef057b5f73440dda2ac30d1e534efd4"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out the study under this section, the Academy shall—</text>
					<paragraph id="ID12a4960b6c8e45bbbe6b99ac88d4b2e4"><enum>(1)</enum><text>pay particular
			 attention to soft-path or low-impact approaches to the management described in
			 subsection (a); and</text>
					</paragraph><paragraph id="IDb0f62a0944834895bcc3a24efb7ef755"><enum>(2)</enum><text>consider the
			 costs of approaches that are analyzed.</text>
					</paragraph></subsection><subsection id="IDbf6ba5758aac43a1bc0bd40504dd9fc5"><enum>(c)</enum><header>Funding</header><text>The
			 Administrator shall provide to the Academy a grant in the amount of $1,000,000
			 for the period of fiscal years 2009 through 2011 for use in carrying out the
			 study under this section.</text>
				</subsection></section></title></legis-body>
