			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Presidential Historical Records
			 Preservation Act of 2008</short-title></quote>.</text>
		</section><section id="id3A6F24B6D17246D984A7F3BAF276E2F1"><enum>2.</enum><header>Grant
			 program</header><text display-inline="no-display-inline">Section 2504 of title
			 44, United States Code, is amended by—</text>
			<paragraph id="id44862E5CA7C84E77BEF890B60682DF7A"><enum>(1)</enum><text>redesignating
			 subsection (f) as subsection (g); <added-phrase reported-display-style="italic">and</added-phrase></text>
			</paragraph><paragraph changed="deleted" id="idF96226580C3A4F1D9C07ED3EC3DAE351" reported-display-style="strikethrough"><enum>(2)</enum><text>amending
			 subsection (g)(1) (as so redesignated by paragraph (1))—</text>
				<subparagraph id="id0B3CFEBC61874B8B9EBE4EEB0EFE5633"><enum>(A)</enum><text>in subparagraph
			 (R), by striking <quote>and</quote>;</text>
				</subparagraph><subparagraph id="id0D176E381D764DA0972A43E24A60AE0C"><enum>(B)</enum><text>in subparagraph

					<subsection id="ID593fa189257240b69dc90965942a6414"><enum>(f)</enum><header>Grants for
				Presidential Centers of Historical Excellence</header>
						<paragraph id="ID5d0dd0f989c341d2ac5a47072877584f"><enum>(1)</enum><header>In
				general</header><text>The Archivist, with the recommendation of the Commission,
				<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">shall</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">may</added-phrase> make
				grants, on a competitive basis and in accordance with this subsection, to
				eligible entities to promote the historical preservation of, and public access
				to, historical records and documents relating to any
				<added-phrase committee-id="SSGA00" reported-display-style="italic">former</added-phrase> President who does not
				have a Presidential archival depository currently managed and maintained by the
				Federal Government pursuant to section 2112 (commonly known as the
				<quote>Presidential Libraries Act of 1955</quote>).</text>
						</paragraph><paragraph id="ID0c2146e6e25e414e8567c523e0f26d9a"><enum>(2)</enum><header>Eligible
				entity</header><text>For purposes of this subsection, an eligible entity
				is—</text>
							<subparagraph id="ID1c5613bd63e1478a9f918412011336b4"><enum>(A)</enum><text>an organization
				described under section 501(c)(3) of the Internal Revenue Code of 1986 and
				exempt from taxation under section 501(a) of that Code; or</text>
							</subparagraph><subparagraph id="ID0fc17cc086fd41289a3e3603a4e5499c"><enum>(B)</enum><text>a State or local
				government of the United States.</text>
							</subparagraph></paragraph><paragraph id="ID48461167da624c6582ba186636fda53a"><enum>(3)</enum><header>Use of
				funds</header><text>Amounts received by an eligible entity under paragraph (1)
				shall be used to promote the historical preservation of, and public access to,
				historical records or historical documents relating to any
				<added-phrase committee-id="SSGA00" reported-display-style="italic">former</added-phrase> President covered under
				paragraph (1).</text>
						</paragraph><paragraph id="ID6f70e2a88f6c4218a3e0aa5ff76e3ddd"><enum>(4)</enum><header>Prohibition on
				use of funds</header><text>Amounts received by an eligible entity under
				paragraph (1) may not be used for the maintenance, operating costs, or
				construction of any facility to house the historical records or historical
				documents relating to any
				<added-phrase committee-id="SSGA00" reported-display-style="italic">former</added-phrase> President covered under
				paragraph (1).</text>
						</paragraph><paragraph id="ID8e811e3209ea438e90fa2774239f5464"><enum>(5)</enum><header>Application</header>
							<subparagraph id="id9B0D116DB263461AA4502705D06BACCB"><enum>(A)</enum><header>In
				general</header><text>An eligible entity seeking a grant under this subsection
				shall submit to the Commission an application at such time, in such manner, and
				containing or accompanied by such information as the Commission may require,
				including a description of the activities for which a grant under this
				subsection is sought.</text>
							</subparagraph><subparagraph id="IDa993f8ef23744b65ad63c8a1b79c4245"><enum>(B)</enum><header>Approval of
				application</header><text>The Commission shall not consider or recommend a
				grant application submitted under subparagraph (A) unless an eligible entity
				establishes that such entity—</text>
								<clause id="IDfc2e50c5df504beca26f77b7bf010263"><enum>(i)</enum><text>possesses, with
				respect to any
				<added-phrase committee-id="SSGA00" reported-display-style="italic">former</added-phrase> President covered under
				paragraph (1), historical works and collections of historical sources that the
				Commission considers appropriate for preserving, publishing, or otherwise
				recording at the public expense;</text>
								</clause><clause id="ID774cc959d5134d28a27abe6fa60ba14c"><enum>(ii)</enum><text>has appropriate
				facilities and space for preservation of, and public access to, the historical
				works and collections of historical sources;</text>
								</clause><clause id="ID2ebb6431ca964801ac0ae260700e63e4"><enum>(iii)</enum><text>shall ensure
				preservation of, and public access to, such historical works and collections of
				historical sources at no charge to the public;</text>
								</clause><clause id="ID1d4605412734432aba745089cc9804a9"><enum>(iv)</enum><text>has educational
				programs that make the use of such documents part of the mission of such
				entity;</text>
								</clause><clause id="IDc863b8a8983d4cc1975f896d9fd78d76"><enum>(v)</enum><text>has raised funds
				from non-Federal sources in support of the efforts of the entity to promote the
				historical preservation of, and public access to, such historical works and
				collections of historical sources in an amount equal to the amount of the grant
				the entity seeks under this subsection;</text>
								</clause><clause id="IDa615a4f342e141bfa7f159c10ecb2f61"><enum>(vi)</enum><text>shall coordinate
				with any relevant Federal program or activity, including programs and
				activities relating to Presidential archival depositories;</text>
								</clause><clause id="ID1b8870999c494d3ea672ca550f9a6fd2"><enum>(vii)</enum><text>shall
				coordinate with any relevant non-Federal program or activity, including
				programs and activities conducted by State and local governments and private
				educational historical entities; and</text>
								</clause><clause id="IDf7d62414f66e4c06b437bc52492e224a"><enum>(viii)</enum><text>has a workable
				plan for preserving and providing public access to such historical works and
				collections of historical
				sources.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" id="idDCE6BD2AE04841108DE6763F8F7F5131" reported-display-style="italic"><enum>3.</enum><header>Term limits for
			 commission members; recusal</header>
			<subsection id="idF540E68F0FAF4D3696FDBA9FF4F4E6AE"><enum>(a)</enum><header>Term limits</header>
				<paragraph id="id8BFDE1A5CB30404989080C800A2EE339"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2501(b)(1) of
			 title 44, United States Code, is amended—</text>
					<subparagraph id="id0CF3814359374A90BD13E6D4BF9B1B27"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>not more than 2</quote>
			 after <quote>subsection (a) shall be appointed for</quote>; and</text>
					</subparagraph><subparagraph id="id46786FE4864D4BC49E2523461C834E6D"><enum>(B)</enum><text>in subparagraph (A), by
			 striking <quote>a term</quote> and inserting <quote>not more than 4
			 terms</quote>.</text>
					</subparagraph></paragraph><paragraph id="id6A150B2CBDEC45B8BF0D6CBBEB4F4208"><enum>(2)</enum><header>Effective
			 date</header><text>The restrictions on the terms of members of the National
			 Historical Publications and Records Commission provided in the amendments made
			 by paragraph (1) shall apply to members serving on or after the date of
			 enactment of this Act.</text>
				</paragraph></subsection><subsection id="id18A0A31A5788454E80C7F44411A2C787"><enum>(b)</enum><header>Recusal</header>
				<paragraph id="id3B5193ABCFC34BE99A3E5B74CFBB89F6"><enum>(1)</enum><header>In
			 general</header><text>Section 2501 of title 44, United States Code, is amended
			 by adding at the end the following:</text>
					<quoted-block changed="added" display-inline="no-display-inline" id="idE8150A19A9F045389EF2B189FC1511EF" reported-display-style="italic" style="OLC">
						<subsection id="id2C3B5544CE5E4B4EAE30BF42A90174BB"><enum>(d)</enum><header>Recusal</header><text>Members
				of the Commission shall recuse themselves from voting on any matter that poses,
				or could potentially pose, a conflict of interest, including a matter that
				could benefit them or an entity they
				represent.</text>
						</subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idCFED6F1EE0274142BBC030211570B837"><enum>(2)</enum><header>Effective
			 date</header><text>The requirement of recusal provided in the amendment made by
			 paragraph (1) shall apply to members of the National Historical Publications
			 and Records Commission serving on or after the date of enactment of this
			 Act.</text>
				</paragraph></subsection></section><section changed="added" id="idF25532DA25E3473CACC87E5C120D222E" reported-display-style="italic"><enum>4.</enum><header>Online access of
			 founding fathers documents; transfer of funds</header>
			<subsection id="id2848D940CA804F51B02A045843BE3316"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title 44, United
			 States Code, is amended by inserting after section 2119 the following:</text>
				<quoted-block changed="added" display-inline="no-display-inline" id="idC0C9C026CEE3436F8F619B9575C3733E" reported-display-style="italic" style="USC">
					<section id="idEF728A4F0AE041BAB2F0A9186F886AFC"><enum>2120.</enum><header>Online access of
				founding fathers documents</header><text display-inline="no-display-inline">The
				Archivist may enter into a cooperative agreement to provide online access to
				the published volumes of the papers of—</text>
						<paragraph id="IDb56ad22a82c34da984df4b24e46e2b6c"><enum>(1)</enum><text>George Washington;</text>
						</paragraph><paragraph id="ID7564f552c9de42f38e12e93b964dc75c"><enum>(2)</enum><text>Alexander
				Hamilton;</text>
						</paragraph><paragraph id="IDbaa7069d1579413f866b4bc6141ca2cb"><enum>(3)</enum><text>Thomas Jefferson;</text>
						</paragraph><paragraph id="ID067493216f7f4f58a13352e9b8dd6d5d"><enum>(4)</enum><text>Benjamin Franklin;</text>
						</paragraph><paragraph id="id62D8E5ED02EE4509BC264B171F10EDC1"><enum>(5)</enum><text>John Adams;</text>
						</paragraph><paragraph id="ID176e3edbd96242e1916550934df3ea5d"><enum>(6)</enum><text>James Madison; and</text>
						</paragraph><paragraph id="id757F34F22F7D4C5396BC6AD2B9CE52B5"><enum>(7)</enum><text>other prominent
				historical figures, as determined appropriate by the Archivist of the United
				States.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0000928D52CB46E2885C122AED735421"><enum>(b)</enum><header>Transfer of
			 funds</header>
				<paragraph id="idF073D21A4EEA463595CC84E4FC44DB87"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Archivist of the
			 United States, in the role as chairman of the National Historical Publications
			 and Records Commission may enter into cooperative agreements pursuant to
			 section 6305 of title 31, United States Code, that involve the transfer of
			 funds from the National Historical Publications and Records Commission to State
			 and local governments, tribal governments, other public entities, educational
			 institutions, or private nonprofit organizations for the public purpose of
			 carrying out section 2120 of title 44, United States Codes.</text>
				</paragraph><paragraph id="id91903C9C561D42A296A6DBF695B50FC6"><enum>(2)</enum><header>Report</header><text>Not
			 later than December 31st of each year, the Archivist of the United States shall
			 submit to the Committee on Homeland Security and Governmental Affairs of the
			 Senate and the Committee on Oversight and Government Reform of the House of
			 Representatives a report on the provisions, amount, and duration of each
			 cooperative agreement entered into as authorized by paragraph (1) during the
			 preceding fiscal year.</text>
				</paragraph></subsection><subsection id="idE10CA635186F4A4BAADE78EC0032E4A4"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(c)</added-phrase></enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 21 of
			 title 44, United States Code, is amended by adding after the item relating to
			 section 2119 the following:</text>

			</subsection></section><section changed="added" id="id5F937755C8E845139AE607DFD4B9BC76" reported-display-style="italic"><enum>5.</enum><header>Advisory
			 committee</header>
			<subsection id="id76622EFC55B04775A88090323AD64144"><enum>(a)</enum><header>Establishment</header><text>The
			 Archivist of the United States may establish an advisory committee to—</text>
				<paragraph id="IDb83b0a21a7504bcd958c01a6c4032888"><enum>(1)</enum><text>review the progress of
			 the Founding Fathers editorial projects funded by the National Historical
			 Publications and Records Commission;</text>
				</paragraph><paragraph id="IDa5bae2f245af48ac94288cb78fbee0b2"><enum>(2)</enum><text>develop, in consultation
			 with the various Founding Fathers editorial projects, appropriate completion
			 goals for the projects described in paragraph (1);</text>
				</paragraph><paragraph id="ID21ac773733b2458baccb2d17b8d9d329"><enum>(3)</enum><text>annually review such
			 goals and report to the Archivist on the progress of the various projects in
			 meeting the goals; and</text>
				</paragraph><paragraph id="ID9843af3c62de4b9a9cbade768f5d9ac9"><enum>(4)</enum><text>recommend to the
			 Archivist measures that would aid or encourage the projects in meeting such
			 goals.</text>
				</paragraph></subsection><subsection id="ID16fe1f89bb77483487a87e22ce95366e"><enum>(b)</enum><header>Reports to the advisory
			 committee</header><text>Each of the projects described in subsection (a)(1)
			 shall provide annually to the advisory committee established under subsection
			 (a) a report on the progress of the project toward accomplishing the completion
			 goals and any assistance needed to achieve such goals, including the
			 following:</text>
				<paragraph id="IDd8c10d551fcd4cd185ecbda285fb5b77"><enum>(1)</enum><text>The proportion of total
			 project funding for the funding year in which the report is submitted
			 from—</text>
					<subparagraph id="IDd0431d833b0b4c54bd23dab6c1e5b9a0"><enum>(A)</enum><text>Federal, State, and local
			 government sources;</text>
					</subparagraph><subparagraph id="IDd91396e7277a4a2890f06fc08bbcf9d5"><enum>(B)</enum><text>the host institution for
			 the project;</text>
					</subparagraph><subparagraph id="ID3ca1089f99274486bdda1ea2a59421a7"><enum>(C)</enum><text>private or public
			 foundations; and</text>
					</subparagraph><subparagraph id="IDeff3c55dfcf149eaab90b5db2f162bed"><enum>(D)</enum><text>individuals.</text>
					</subparagraph></paragraph><paragraph id="ID59a667f95bed4ba581189afac584dc9b"><enum>(2)</enum><text>Information on all
			 activities carried out using nongovernmental funding.</text>
				</paragraph><paragraph id="ID14424c85b580462d8184a3c95be478c3"><enum>(3)</enum><text>Any and all information
			 related to performance goals for the funding year in which the report is
			 submitted.</text>
				</paragraph></subsection><subsection id="id1DD47DB7F2D6413EAA8E6D5EB3FC3E14"><enum>(c)</enum><header>Composition; meetings;
			 report; sunset; action</header><text>The advisory committee established under
			 subsection (a) shall—</text>
				<paragraph id="IDc4a2253b29614341b7e83a7fd859f33c"><enum>(1)</enum><text>be comprised of 3
			 nationally recognized historians appointed for not more than 2 consecutive
			 4-year terms;</text>
				</paragraph><paragraph id="IDdb662c7f5885407ca8e8eb32b9beea32"><enum>(2)</enum><text>meet not less frequently
			 than once a year;</text>
				</paragraph><paragraph id="ID4c9e198b319042449e1026f2b4dc8124"><enum>(3)</enum><text>provide a report on the
			 information obtained under subsection (b) to the Committee on Homeland Security
			 and Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives not later than 1 year after
			 the date of enactment of this Act and annually thereafter;</text>
				</paragraph><paragraph id="ID747f3b1e6bfd41c8aaaf676feaf5b3fe"><enum>(4)</enum><text>terminate on the date
			 that is 8 years after the date of enactment of this Act; and</text>
				</paragraph><paragraph id="IDab03bfa0523643b2a5ef0eb4a18111f4"><enum>(5)</enum><text>recommend legislative or
			 executive action that would facilitate completion of the performance goals for
			 the Founding Fathers editorial projects.</text>
				</paragraph></subsection></section><section changed="added" id="idAA81393F771D461293DAFD90A2402325" reported-display-style="italic"><enum>6.</enum><header>Capital improvement plan
			 for Presidential archival depositories; report</header>
			<subsection id="id7A8CD7739B964DF7B9165BD501525999"><enum>(a)</enum><header>In general</header>
				<paragraph id="id65FA864F46CF424CAC04597B8F7BCFC0"><enum>(1)</enum><header>Provision of
			 plan</header><text display-inline="yes-display-inline">The Archivist of the
			 United States shall provide to the Committee on Appropriations of the Senate
			 and the Committee on Appropriations of the House of Representatives a 10-year
			 capital improvement plan, in accordance with paragraph (2), for all
			 Presidential archival depositories (as defined in section 2101 of title 44,
			 United States Code), which shall include—</text>
					<subparagraph id="idB5EC507C837C4993B9866B809AD630E5"><enum>(A)</enum><text>a prioritization of all
			 capital projects at Presidential archival depositories that cost more than
			 $1,000,000;</text>
					</subparagraph><subparagraph id="idAA317472B4514DB18A07454E4FE7D043"><enum>(B)</enum><text>the current estimate of
			 the cost of each capital project; and</text>
					</subparagraph><subparagraph id="idB97DE561ED2F402D90AAFFA1A92C58C2"><enum>(C)</enum><text>the basis upon which each
			 cost estimate was developed.</text>
					</subparagraph></paragraph><paragraph id="id6393989CB4E041AFA552E0515E9024C1"><enum>(2)</enum><header>Provided to
			 congress</header><text>The capital improvement plan shall be provided to the
			 committees, as described in paragraph (1), at the same time as the first Budget
			 of the United States Government after the date of enactment of this Act is
			 submitted to Congress.</text>
				</paragraph><paragraph id="id7266C76AC32349BE9CA20AD3CB7A12AD"><enum>(3)</enum><header>Annual updates and
			 explanation of changes in cost estimates</header><text>The Archivist of the
			 United States shall provide to the Committee on Appropriations of the Senate
			 and the Committee on Appropriations of the House of Representatives—</text>
					<subparagraph id="idA968979C98FE4D579014137A0FADE202"><enum>(A)</enum><text>annual updates to the
			 capital improvement plan described in paragraph (1) at the same time as each
			 subsequent Budget of the United States Government is submitted to Congress;
			 and</text>
					</subparagraph><subparagraph id="id83D5F7C9717F44C7B4C5C3CA202A5B64"><enum>(B)</enum><text>an explanation for any
			 changes in cost estimates.</text>
					</subparagraph></paragraph></subsection><subsection id="id933A78DFD8AA4FBBB97F867885B46A4F"><enum>(b)</enum><header>Amendment to minimum
			 amount of endowment</header><text display-inline="yes-display-inline">Section
			 2112(g)(5)(B) of title 44, United States Code, is amended by striking
			 <quote>40</quote> and inserting <quote>60</quote>.</text>
			</subsection><subsection id="id3B5B8D166FF748F5BE5F3E2B0AD33CAE"><enum>(c)</enum><header>Report</header><text>Not
			 later than 270 days after the date of enactment of this Act, the Archivist of
			 the United States shall provide a report to the Committee on Homeland Security
			 and Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives, that provides 1 or more
			 alternative models for presidential archival depositories that—</text>
				<paragraph id="id0A2CD55C19D14B359EF2F08152654F85"><enum>(1)</enum><text>reduce the financial
			 burden on the Federal Government;</text>
				</paragraph><paragraph id="idF99C1FB7A3D34F34853043964920F93A"><enum>(2)</enum><text>improve the preservation
			 of presidential records; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51AF3141F1124349A5350846E709F403"><enum>(3)</enum><text>reduce the delay in
			 public access to all presidential records.</text>
				</paragraph></subsection></section></legis-body>
