		<official-title>To provide for upgrading security at civilian nuclear
		  facilities and of nuclear materials that could be used to construct a dirty
		  bomb. </official-title>

		<section id="H3DB2910AA31E4928B6033354D8DD8E88" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nuclear Facility and Material Security
			 Act of 2008</short-title></quote>.</text>
		</section><section id="HD286948065524DC3A2974F00265EB9DB" section-type="subsequent-section"><enum>2.</enum><header>Nuclear reactor
			 designs regarding aircraft impact</header>
			<subsection id="H5C6E27B89460416CAB902F48E45F97C7"><enum>(a)</enum><header>Final
			 rule</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Nuclear Regulatory Commission
			 shall issue a final rule requiring all commercial nuclear power reactors
			 approved for construction after such date of enactment to be designed to
			 withstand a large commercial aircraft impact. Such rule shall address the
			 structural response, shock and vibration effects, and fire effects of the
			 impact.</text>
			</subsection><subsection id="HA55329DCD0E643958D39EF0283FB578"><enum>(b)</enum><header>Required design
			 features</header><text>Such final rule shall require design features to ensure
			 that—</text>
				<paragraph id="H58EF21C585F344819261D55CF101F251"><enum>(1)</enum><text>important safety
			 functions will operate for a sufficient period of time after the impact of a
			 large commercial aircraft so that the unit can be safely shut down and
			 maintained in safe shutdown condition; and</text>
				</paragraph><paragraph id="HD6045AD9ACB9454F85A2B2C5775635CB"><enum>(2)</enum><text display-inline="yes-display-inline">the consequences of the impact will not
			 result in a release of radioactive materials to the environment that causes a
			 member of the surrounding community to receive a dose that triggers an
			 evacuation recommendation, consistent with the levels established by the
			 Environmental Protection Agency and the Public Protection Action Guide Limit
			 for Evacuation and Shelter (EPA 400–R–92–001).</text>
				</paragraph></subsection></section><section id="H190117EB2D5B4D3A85B345FE5B9B1197"><enum>3.</enum><header>Spent fuel
			 security enhancements</header>
			<subsection id="H09D4794937BE4C998948A9F15C83007D"><enum>(a)</enum><header>Storage
			 rule</header><text display-inline="yes-display-inline">Not later than 18 months
			 after the date of enactment of this Act, the Nuclear Regulatory Commission
			 shall issue a final rule requiring—</text>
				<paragraph id="H1C5841E9C0814C36BF38007700480897"><enum>(1)</enum><text display-inline="yes-display-inline">the configuration of spent fuel assemblies
			 stored in spent fuel pools to minimize the risk of fire in the event the spent
			 fuel pools are drained during an accident or terrorist attack;</text>
				</paragraph><paragraph id="H85E052183E054CD888E58348E70BFFC"><enum>(2)</enum><text>spent nuclear fuel
			 to be transferred from a spent fuel pool into dry cask storage at the earliest
			 possible time that the heat load of the spent fuel material allows for such
			 transfer to occur safely; and</text>
				</paragraph><paragraph id="H291161EDFBD142E2BA55BCEA95C6BFBD"><enum>(3)</enum><text display-inline="yes-display-inline">mitigation features such as water-spray
			 systems to cool spent fuel in the event spent fuel pools are drained during an
			 accident or terrorist attack.</text>
				</paragraph></subsection><subsection id="H19B5417AB4604BB59866CD56C2EA2714"><enum>(b)</enum><header>Independent
			 installation security</header>
				<paragraph id="H7FB4EC7C546E4488B04CF9C1C847A709"><enum>(1)</enum><header>Rulemaking
			 requirement</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Nuclear Regulatory Commission shall issue an Independent Spent
			 Fuel Storage Installation security final rule that makes such installations
			 subject to the security evaluation requirements of section 170D of the Atomic
			 Energy Act of 1954 (42 U.S.C. 2210d).</text>
				</paragraph><paragraph id="HCE66BC313F8944BBA0BCE8ECE7851B3"><enum>(2)</enum><header>Design Basis
			 Threat</header><text>The rule issued under paragraph (1) shall provide for
			 incorporating Independent Spent Fuel Storage Installations into the design
			 basis threat rule issued under section 170E of the Atomic Energy Act of 1954
			 (42 U.S.C. 2210e).</text>
				</paragraph></subsection></section><section id="H3DBE8ADE3E384725B1DDE81100DBE357"><enum>4.</enum><header>Considering the
			 risk of acts of terrorism on nuclear facilities</header><text display-inline="no-display-inline">The Nuclear Regulatory Commission shall
			 consider the likely consequences of a potential terrorist attack in any review
			 it is required to undertake under the National Environmental Policy Act of 1969
			 (42 U.S.C. 4321 et seq.).</text>
		</section><section id="H4823D96D40394C8D00AD7F5B1CEFEFAB"><enum>5.</enum><header>Potassium
			 iodide</header>
			<subsection id="HDBF201DEEAF64375A19DBE704E5432B6"><enum>(a)</enum><header>Repeal of waiver
			 authority</header><text display-inline="yes-display-inline">Section 127(f) of
			 the Public Health Security and Bioterrorism Preparedness and Response Act of
			 2002 (42 U.S.C. 300hh–12 note) is repealed.</text>
			</subsection><subsection id="H167A961EC988408AAC346328BAAC2B1C"><enum>(b)</enum><header>Jurisdictional
			 Authority</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall exercise all Federal authority over the
			 distribution of potassium iodide as a medical prophylaxis for radiological
			 exposure in humans, including all activities under section 127 of the Public
			 Health Security and Bioterrorism Preparedness and Response Act of 2002 (42
			 U.S.C. 300hh–12 note).</text>
			</subsection><subsection commented="no" id="H89B6C2F2BD0A4906AA5018131BD16C9E"><enum>(c)</enum><header>NAS
			 Studies</header><text display-inline="yes-display-inline">Not later than June
			 30, 2011, and at least once every 5 years thereafter, the Secretary of Health
			 and Human Services shall enter into an arrangement with the National Academy of
			 Sciences for studies on appropriate emergency response plans to nonroutine
			 releases of radioactive materials, including from nuclear power plants, spent
			 fuel storage facilities, radiological dispersal devices, and improvised nuclear
			 explosive devices. Such studies shall address evacuation, sheltering, food
			 interdiction, and medical prophylaxes for radioiodine and other radioisotopes
			 that are released in such events. Such studies shall—</text>
				<paragraph id="HEF064ACE4B7B43F981FF82465CEA3CCD"><enum>(1)</enum><text>review relevant
			 evacuations and food interdictions of the preceding five-year period for
			 lessons learned;</text>
				</paragraph><paragraph id="H3A00EDA1C3AE464FA8C2C636279BD1B"><enum>(2)</enum><text>identify the
			 population that would be exposed by the release and evaluate the potential
			 consequences of such exposure;</text>
				</paragraph><paragraph id="H231A6A9674F844F08F9181E6FF00BE44"><enum>(3)</enum><text>recommend best
			 practices for emergency response to radiological releases; and</text>
				</paragraph><paragraph id="HF7B0E071537042C9AD7CA374D9130869"><enum>(4)</enum><text>evaluate new
			 research on medical prophylaxes for radioiodine and other radioisotopes
			 released in such events and recommend whether additional medical prophylaxes
			 should be procured for the Strategic National Stockpile or State and local
			 stockpiles.</text>
				</paragraph></subsection><subsection commented="no" id="HF03F248B5EF3448FA34F00AD03B63DB"><enum>(d)</enum><header>Secretary’s
			 actions</header><text>Based on the findings of the studies conducted under
			 subsection (c), the Secretary of Health and Human Services shall—</text>
				<paragraph commented="no" id="HA0B826DB02294D9BA073A65E5D616EEC"><enum>(1)</enum><text display-inline="yes-display-inline">consider the advisability of procurement
			 for the Strategic National Stockpile, and distribution to State and local
			 governments, of medical prophylaxes other than potassium iodide, against
			 radioiodine and other radiological byproducts; and</text>
				</paragraph><paragraph commented="no" id="H6C4FEF9CA7674B389F9F473D78E96BAF"><enum>(2)</enum><text display-inline="yes-display-inline">update the Federal potassium iodide
			 distribution guidelines, including with lessons learned from evacuation events,
			 as necessary.</text>
				</paragraph></subsection><subsection id="HEC4A61791D834649B18CDF03A08D354B"><enum>(e)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Section 127(c) of the Public Health
			 Security and Bioterrorism Preparedness and Response Act of 2002 (42 U.S.C.
			 300hh–12 note) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3738957FA6A64A85BB25F456888CF9AF" style="OLC">
					<subsection id="H8D4E0EF03EA44865BB2C03D728A50500"><enum>(c)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
				enactment of the <short-title>Nuclear Facility and
				Material Security Act of 2008</short-title>, the Secretary of Health and Human
				Services, in consultation with individuals representing appropriate Federal,
				State, and local agencies, shall establish guidelines for the stockpiling of
				potassium iodide tablets, and for the distribution and utilization of potassium
				iodide tablets in the event of a nuclear
				incident.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H97D6D939720148BBB7FB00EF957CB3DF"><enum>6.</enum><header>Audit of safety
			 and security analysis and review activities</header><text display-inline="no-display-inline">Title II of the Energy Reorganization Act of
			 1974 (42 U.S.C. 5841 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HE57DE268510445CA942CCFDFA800BE3B" style="traditional">
				<section id="HC3278856062E450BA4642849259FDA82"><enum>213.</enum><header>Audit of safety and security analysis and review
		  activities</header><subsection commented="no" display-inline="yes-display-inline" id="H2C908BDA35104C0D84DCD55AEAD7700"><enum>(a)</enum><text display-inline="yes-display-inline">There shall be established within the
				Office of the Inspector General of the Commission a unit with appropriate and
				adequate technical staff, including degreed engineers with nuclear power plant
				experience, which shall audit the Commission’s regulatory oversight activities
				related to safety and security of civilian nuclear facilities.</text>
					</subsection><subsection id="H5AF00E4CDFDB483680D9CBB27524C923"><enum>(b)</enum><text>There are
				authorized to be appropriated to the Commission, for carrying out this Act,
				such sums as may be
				necessary.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HFCCDFAB142E34F0DAFDE0000B1BB5430" section-type="subsequent-section"><enum>7.</enum><header>Radiation source
			 protection</header>
			<subsection id="HA581FF15BC0142099462D35DF0E8C099"><enum>(a)</enum><header>Categorization
			 of radiation sources</header><text display-inline="yes-display-inline">Section
			 170H f. of the Atomic Energy Act of 1954 (42 U.S.C. 2210h(f)) is amended by
			 adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H63BEB5F78A2B43C3A7C5BEF6718CEECD" other-style="nuclear" style="other">
					<paragraph id="HBE254415D7054621B26762A39EC65BC7" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of the
				enactment of this paragraph, the task force shall—</text>
						<subparagraph id="HE22258088AF9404FABC0AD7BEEB6CED8"><enum>(A)</enum><text>complete an evaluation of the
				materials listed in the Code of Conduct;</text>
						</subparagraph><subparagraph id="HF417A6CC12E04EFA89CD53AB06D50040"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations to amend the
				Commission’s regulatory requirements for certain radiation sources or activity
				levels of certain radiation sources to account for—</text>
							<clause id="H8EDD745F69E54CA299FDDF3B1900EDB"><enum>(i)</enum><text>risks associated with the
				deliberate dispersal of those materials from radiation sources, including
				dispersal for the purpose of causing the ingestion or inhalation of those
				materials; and</text>
							</clause><clause id="H8FAFC644BD4E497886009B10DBFEFF97"><enum>(ii)</enum><text>the radiation source’s potential
				to cause contamination of large areas, or economic and social disruption that
				could result from a terrorist attack; and</text>
							</clause></subparagraph><subparagraph id="H317E4224DA3840E994D933AE30003798"><enum>(C)</enum><text display-inline="yes-display-inline">designate additional radiation sources for
				which the risks described in subparagraph (B)(i) and (ii) are particularly high
				as high-risk radiation sources for purposes of section 2(e) of the
				<short-title>Nuclear Facility and Material Security Act of
				2008</short-title>.</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">Upon
				completion of the recommendations under this paragraph, the Commission shall
				implement those recommendations by
				regulation.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF85E63427E66439EA2C0E89D6F15CB05"><enum>(b)</enum><header>Transportation
			 of Radiation Sources</header><text display-inline="yes-display-inline">Not
			 later than 18 months after the date of enactment of this Act, the Nuclear
			 Regulatory Commission shall publish a final rule revising its regulations on
			 the security requirements for the transportation of Category 1, 2, and 3
			 sources (as defined in the Code of Conduct referred to in section 170H a.(1) of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2210h(a)(1))), including a requirement
			 that shipments of Category 1, 2, and 3 sources be equipped with covert
			 technology that would enable location tracking and recovery in the event the
			 shipments or sources are stolen or diverted.</text>
			</subsection><subsection id="H748E1158E0E64588938D1B89AF557F23"><enum>(c)</enum><header>Radiation source
			 Licensing</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of enactment of this Act, the Nuclear Regulatory
			 Commission shall issue a final rule requiring carriers and transporters
			 transporting within the United States radiation sources (as defined in section
			 170H a.(2) of the Atomic Energy Act of 1954 (42 U.S.C. 2210h(a)(2))) to be
			 licensed by the Commission.</text>
			</subsection><subsection id="H78736BC814C745B58353A1FF38060981"><enum>(d)</enum><header>National
			 radiation source tracking system</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Nuclear Regulatory Commission shall issue a final
			 rule, pursuant to its authority to promote or protect the common defense and
			 security under section 161 of the Atomic Energy Act of 1954 (42 U.S.C. 2201),
			 and in a manner that maximizes the use of appropriate State government
			 capabilities, to revise Commission regulations with respect to the National
			 Source Tracking System to require technologies and systems that can provide
			 real-time tracking and enable locating—</text>
				<paragraph id="H344C757D929441A08C54AE45B4AADD87"><enum>(1)</enum><text>Category 1, 2, and
			 3 sources (as defined in the Code of Conduct referred to in section 170H a.(1)
			 of the Atomic Energy Act of 1954 (42 U.S.C. 2210h(a)(1))); and</text>
				</paragraph><paragraph id="HCD9322A0A54F4BAD8837AA1DB906EA48"><enum>(2)</enum><text>radiation sources
			 with <fraction>1/10</fraction> or more of the activity threshold of such
			 Category 3 sources.</text>
				</paragraph></subsection><subsection id="H7836C428E3104E9E9520386728D7CBDE"><enum>(e)</enum><header>High-risk
			 radiation sources security and replacement</header>
				<paragraph id="HE30DC7E421B44C55833BF8443CF531F"><enum>(1)</enum><header>Rule</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Nuclear Regulatory Commission shall issue a final
			 rule, pursuant to its authority to promote or protect the common defense and
			 security under section 161 of the Atomic Energy Act of 1954 (42 U.S.C. 2201),
			 to establish requirements leading to the replacement of all high-risk radiation
			 sources. Such rule shall include provisions that—</text>
					<subparagraph commented="no" id="HBC00E06DD5C1480BB6001E31E8D522EC"><enum>(A)</enum><text display-inline="yes-display-inline">discontinue licensing for each application
			 of new high-risk radiation sources as soon as is practicable, but in no event
			 later than 10 years after the date of enactment of this Act, unless
			 technologically feasible alternatives are not available;</text>
					</subparagraph><subparagraph id="H0F3A4F63A98E41B387B90539B38F4EC8"><enum>(B)</enum><text display-inline="yes-display-inline">prescribe a new license fee structure, or
			 other means of guaranteeing the availability of funds, for any new licenses of
			 high-risk radiation sources to ensure that the costs of disposition of the
			 high-risk radiation sources will be covered;</text>
					</subparagraph><subparagraph id="H399936A5C2F749D2B1DEA53B3E2E668"><enum>(C)</enum><text>provide for
			 incentives for decommissioning and replacing existing high-risk radiation
			 sources;</text>
					</subparagraph><subparagraph id="H193D37360887454AAED800895273F2C2"><enum>(D)</enum><text>prohibit the
			 export of high-risk radiation sources to other countries; and</text>
					</subparagraph><subparagraph id="H9B616337FB454B399F4D7FA63FD8A36D"><enum>(E)</enum><text display-inline="yes-display-inline">prescribe enhanced security measures for
			 existing high-risk radiation sources.</text>
					</subparagraph></paragraph><paragraph id="H3492EE8EE4D94AB794D8EE7E222B151B"><enum>(2)</enum><header>Task force
			 recommendations</header><text display-inline="yes-display-inline">Not later
			 than 4 years after the initial rule is issued under paragraph (1) or any update
			 is issued under paragraph (3), the Task Force on Radiation Source Protection
			 and Security established under section 170H f. of the Atomic Energy Act of 1954
			 (42 U.S.C. 2210h(f)) shall review the rule or update and make recommendations
			 for appropriate modifications to the rule or update to account for—</text>
					<subparagraph id="H63A69FA0973E46B789ACFDC2D5832EBF"><enum>(A)</enum><text>the emergence of
			 new technologies that can be used to replace high-risk radiation sources;
			 and</text>
					</subparagraph><subparagraph id="HF72BE8261E5240CBBABBB57381E31D7F"><enum>(B)</enum><text display-inline="yes-display-inline">new security threats or intelligence
			 information regarding the risk of a deliberate attack using these radiation
			 sources.</text>
					</subparagraph></paragraph><paragraph id="HCB99C7D758D342FBBE93DFED21BBA8FD"><enum>(3)</enum><header>Nuclear
			 Regulatory Commission Review</header><text>Taking into consideration the
			 recommendations of the task force under paragraph (2), the Commission shall
			 review and update the rule issued under paragraph (1) not less frequently than
			 once every 5 years to account for—</text>
					<subparagraph id="HAAE172DA780D4BBA8ED0418C36A4A284"><enum>(A)</enum><text>the emergence of
			 new technologies that can be used to replace high-risk radiation sources;
			 and</text>
					</subparagraph><subparagraph id="HFB786051BD1F4133B22848040067F64F"><enum>(B)</enum><text display-inline="yes-display-inline">new security threats or intelligence
			 information regarding the risk of a deliberate attack using these radiation
			 sources.</text>
					</subparagraph></paragraph><paragraph id="H40AA26C2A84C4FFCAE29AD9810F000D7"><enum>(4)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Nuclear Regulatory Commission for carrying out paragraph (1)(C) such sums as
			 may be necessary for the fiscal years 2009 through 2013.</text>
				</paragraph><paragraph id="H83DC5380990A45978FCFB8CF424052E"><enum>(5)</enum><header>Department of
			 Energy Program</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary of Energy $50,000,000 for the
			 period encompassing fiscal years 2009 through 2018 for the acceptance, storage,
			 and disposition of high-risk radiation sources by the Department’s United
			 States Radiological Threat Reduction Program.</text>
				</paragraph><paragraph id="H7D6F651075194BBABE834648574F5F71"><enum>(6)</enum><header>Definition</header><text>For
			 purposes of this subsection, the term <quote>high-risk radiation source</quote>
			 means cesium chloride and any other radiation source that is designated by the
			 Task Force on Radiation Source Protection and Security under section 170H
			 f.(4)(C) of the Atomic Energy Act of 1954 (42 U.S.C. 2210h(f)(4)(C)).</text>
				</paragraph></subsection></section></legis-body>
