		<official-title>To amend the Federal Food, Drug, and Cosmetic Act to
		  provide for the establishment of a traceability system for food, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Food Tracking Improvement
			 Act</short-title></quote>.</text>
		</section><section id="IDb43d2ad01edd4e0697effd10db7ed8b0"><enum>2.</enum><header>Traceability of
			 food</header><text display-inline="no-display-inline">The Federal Food, Drug,
			 and Cosmetic Act (21 U.S.C. 301 et seq.) is amended—</text>
			<paragraph id="IDc47ea7e252dc4da7a9dbaed48cc29413"><enum>(1)</enum><text>in section 301,
			 by inserting at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id194AEAA0222A4DF3A4D3A6A4164D800B" style="OLC">
					<subsection id="IDdbc9439101c24cada4f43494efdf2e17"><enum>(jj)</enum><text>The failure to
				comply with any requirement of section 414A (relating to the traceability of
				food).</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID7da746a6c2404fdc9216d5529edc399d"><enum>(2)</enum><text>in chapter IV, by
			 inserting after section 414 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2C5E6EB76B59435A92007F23FA63B70D" style="OLC">
					<section id="IDfcd29dbee854443e8481c2ccac8d686b"><enum>414A.</enum><header>Traceability
				of food</header>
						<subsection id="IDf0652c78ebec42b787fff41009e88d4c"><enum>(a)</enum><header>Establishment
				of system</header><text>Not later than 3 years after the date of the enactment
				of this section, the Secretary shall establish a traceability system described
				in subsection (b) for all stages of manufacturing, processing, packaging, and
				distribution of food.</text>
						</subsection><subsection id="IDe8aec247544a4e5ab464e4ad4408e0f0"><enum>(b)</enum><header>Description of
				system</header><text>The traceability system required by subsection (a) shall
				require each article of food shipped in interstate commerce to be identified in
				a manner that enables the Secretary to retrieve the history, use, and location
				of the article through a recordkeeping and audit system, a secure, online
				database, or registered identification.</text>
						</subsection><subsection id="IDb7fe57549967403eacce2095a1e762d1"><enum>(c)</enum><header>Records</header>
							<paragraph id="ID26ee20a93e104c899299e07bdceb7699"><enum>(1)</enum><header>In
				general</header><text>The Secretary may require that each person required to
				identify an article of food pursuant to subsection (b) maintain accurate
				records, as prescribed by the Secretary, regarding the purchase, sale, and
				identification of the article.</text>
							</paragraph><paragraph id="ID643018fed3054093932eb7d95a6d3984"><enum>(2)</enum><header>Access</header><text>Each
				person described in paragraph (1) shall, at all reasonable times, on notice by
				a duly authorized representative of the Secretary, allow the representative to
				access to each place of business of the person to examine and copy the records
				described in paragraph (1).</text>
							</paragraph><paragraph id="ID49b100e14168402e91d96a4206b2cd5e"><enum>(3)</enum><header>Duration</header><text>Each
				person described in paragraph (1) shall maintain records as required under this
				subsection for such period of time as the Secretary prescribes.</text>
							</paragraph></subsection><subsection id="ID65213ad39c3a4c79863cfe1d7dff7676"><enum>(d)</enum><header>False
				information</header><text>No person shall falsify or misrepresent to any other
				person or to the Secretary, any information as to any location at which any
				article of food was held.</text>
						</subsection><subsection id="ID4b4b9d9f0aad4eea99519e2968057d74"><enum>(e)</enum><header>Alteration or
				destruction of records</header><text>No person shall, without authorization
				from the Secretary, alter, detach, or destroy any records or other means of
				identification prescribed by the Secretary for use in determining the location
				at which any article of food was held.</text>
						</subsection><subsection id="IDeaa2e657191b47f0a8ae94e9b338d6b3"><enum>(f)</enum><header>Advisory
				committee</header>
							<paragraph id="id4956FEEFA0D04C70B4C9D4F89C39042E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to assist
				the Secretary in implementing the traceability system under subsection (a), the
				Secretary shall convene an advisory committee (referred to in this subsection
				as the <quote>Committee</quote>).</text>
							</paragraph><paragraph id="idB650163E0277437285DDACF94F3135B5"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The Committee shall consist of 13 members
				appointed by the Secretary which shall include—</text>
								<subparagraph id="id1B8583CD80D0409FB310DBB140D566EE"><enum>(A)</enum><text display-inline="yes-display-inline">an equitable number of food safety and
				tracking technology experts, representatives of the food industry, and consumer
				advocates; and</text>
								</subparagraph><subparagraph id="id85A38563C608495B8CC8F0ABF3866859"><enum>(B)</enum><text display-inline="yes-display-inline">officials from the Center for Food Safety
				and Applied Nutrition and the Office of Regulatory Affairs of the Food and Drug
				Administration and the Agriculture Marketing Service of the Department of
				Agriculture.</text>
								</subparagraph></paragraph><paragraph id="id545B0A775C3F4FBE87D9941CA34AD784"><enum>(3)</enum><header>Chairperson</header><text>The
				Secretary shall appoint a Chairperson of the Committee.</text>
							</paragraph><paragraph id="id3E45AF85FA6C4693BD0E713C4ACD7733"><enum>(4)</enum><header>Meeting</header><text display-inline="yes-display-inline">The Committee shall convene not later than
				180 days after the date of enactment of this section and periodically
				thereafter at the call of the Chairperson.</text>
							</paragraph><paragraph id="id05E0A15E6EB24438AD2B2CE38ADA0D2C"><enum>(5)</enum><header>Report of
				Committee</header>
								<subparagraph id="id0C137148DE004F689D9EB5DBAA69273F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 1 year
				after the date of enactment of this section, the Committee shall submit to the
				Secretary and the Office of the Commissioner a report that describes the
				recommendations regarding the most practicable approach to providing for the
				traceability of food, including the most efficient means of implementing the
				traceback of contaminated foods.</text>
								</subparagraph><subparagraph id="id1CAED96047364EA1B79E1C9ACF04FBEA"><enum>(B)</enum><header>Considerations</header><text>In
				developing the report under subparagraph (A), the Committee shall consider the
				following approaches to providing for the traceability of food:</text>
									<clause id="ID1fece3a5df2244ca98965b53cd16a4e7"><enum>(i)</enum><text>A
				national database or registry operated by the Food and Drug
				Administration.</text>
									</clause><clause id="ID01d6e2c33ba14f5688bf2af97dba2b6c"><enum>(ii)</enum><text>Electronic
				records identifying each prior sale, purchase, or trade of the food and its
				ingredients, and establishing that the food and its ingredients were grown,
				prepared, handled, manufactured, processed, distributed, shipped, warehoused,
				imported, and conveyed under conditions to ensure the safety of the food. The
				records would include an electronic statement with the date of, and the names
				and addresses of all parties to, each prior sale, purchase, or trade, and any
				other information as appropriate.</text>
									</clause><clause id="ID65384edd83e54f22875bfd85faf7844a"><enum>(iii)</enum><text>Standardized
				tracking numbers on all shipments. These numbers would identify the country of
				origin, the unique facility registration number, date of production, and lot
				number (if applicable).</text>
									</clause><clause id="IDac5040ccd45a4d01a805feef823b6550"><enum>(iv)</enum><text>Recall
				performance standards for each food or commodity type.</text>
									</clause><clause id="ID052e30551dbe4254a2c4e61458ecbc01"><enum>(v)</enum><text>Safeguards for
				the combining, repacking, or otherwise mixing of items of food, particularly
				fresh produce.</text>
									</clause><clause id="ID126c1e04af8445229d12f86bf5c73dd4"><enum>(vi)</enum><text>Other approaches
				that enable the reliable tracking of food and food products.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="idD4C97566B65D49D9A4FFD50B64FA1777"><enum>(g)</enum><header>Authorization
				of appropriations</header><text>For the purpose of carrying out this section,
				there is authorized to be appropriated $40,000,000 for the period of fiscal
				years 2009 through
				2011.</text>
