		  Code, to improve the dispute resolution process at the Federal Aviation
		  Administration, and for other purposes.</official-title>

		<section id="id088467F243ED464D981BA2A34C7DB9A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Aviation Administration
			 Employee Retention Act</short-title></quote>.</text>
		</section><section id="idA258DA493A9F47AB97952857C492AE09" section-type="subsequent-section"><enum>2.</enum><header>Dispute
			 resolution</header>
			<subsection id="idAC38CE35A5774F949CEB8CA5AC730803"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 40122(a) of
			 title 49, United States Code, is amended—</text>
				<paragraph id="IDfea472ec59ad4d78b56756f6057fcc09"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (5) and (6), respectively; and</text>
				</paragraph><paragraph id="idF2AE076ED90D43D1A2A6A838F1F69209"><enum>(2)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5562085A2E8A462DA2513268C03B5940" style="OLC">
						<paragraph id="ID6edc2fc8ba5142bc9c65d8add0d39058"><enum>(2)</enum><header>Dispute
				resolution</header>
							<subparagraph id="IDe87b3f7b39f441f5a741c3f51d153e2a"><enum>(A)</enum><header>Mediation</header><text>If
				the Administrator does not reach an agreement under paragraph (1) or the
				provisions referred to in subsection (g)(2)(C) with the exclusive bargaining
				representative of the employees, the Administrator and the bargaining
				representative—</text>
								<clause id="IDe47148a9352f4465943e8af50bd3ad7b"><enum>(i)</enum><text>shall use the
				services of the Federal Mediation and Conciliation Service to attempt to reach
				such agreement, in accordance with part 1425 of title 29, Code of Federal
				Regulations; or</text>
								</clause><clause id="IDdc64ea8817164d6085bcd963c6dbd180"><enum>(ii)</enum><text>may, by mutual
				agreement, adopt alternative procedures for the resolution of disputes or
				impasses arising in the negotiation of the collective-bargaining
				agreement.</text>
								</clause></subparagraph><subparagraph id="ID9cddf2db74c04850b60c2f6fe594d260"><enum>(B)</enum><header>Binding
				arbitration</header>
								<clause id="ID9d7e0f31584942b69a6087e776035726"><enum>(i)</enum><header>Assistance from
				Federal service impasses panel</header><text>If the services of the Federal
				Mediation and Conciliation Service under subparagraph (A)(i) do not lead to an
				agreement, the Administrator and the exclusive bargaining representative of the
				employees (referred to in this subparagraph as the <term>parties</term>) shall
				submit their issues in controversy to the Federal Service Impasses Panel, which
				shall assist the parties in resolving the impasse by asserting jurisdiction and
				ordering binding arbitration by a private arbitration board appointed pursuant
				to clause (ii).</text>
								</clause><clause id="ID9405a36fb0d443df84682a4894fceeb7"><enum>(ii)</enum><header>Appointment of
				arbitration board</header>
									<subclause id="idE8A32E508E904026A63190C99E9BC5DD"><enum>(I)</enum><header>List of
				arbitrators</header><text>The Executive Director of the Federal Service
				Impasses Panel shall provide for the appointment of 3 members to the private
				arbitration board described in clause (i) by requesting the Director of the
				Federal Mediation and Conciliation Service to prepare a list of not fewer than
				15 names of arbitrators with Federal sector experience and by providing the
				list to the parties.</text>
									</subclause><subclause id="id52ECB9B81BE140C6A3D3DDB7568B9E71"><enum>(II)</enum><header>Selection of
				arbitrators</header><text>Not later than 10 days after receiving the list
				described in subclause (I), each party shall select 1 arbitrator from the list.
				Not later than 7 days after these 2 arbitrators are selected by the parties,
				the arbitrators shall select a third arbitrator from the list.</text>
									</subclause><subclause id="idA689174182CD466DB05BFCBF3A8A9D4B"><enum>(III)</enum><header>Alternative
				selection of arbitrators</header><text>If either party fails to select an
				arbitrator or if the 2 selected arbitrators are unable to agree on the
				selection of the third arbitrator within 7 days, the parties shall make the
				selection by alternately striking names off the list until 1 arbitrator
				remains.</text>
									</subclause></clause><clause id="IDeaef9b5f0d924a00a5386aee753524a0"><enum>(iii)</enum><header>Framing
				issues in controversy</header><text>If the parties do not agree on the framing
				of the issues to be submitted for arbitration, the arbitration board shall
				frame the issues.</text>
								</clause><clause id="ID2b51adfd26ef4681a8ed4431ba408b08"><enum>(iv)</enum><header>Hearings</header><text>The
				arbitration board shall give the parties a full and fair hearing, including an
				opportunity for each party to—</text>
									<subclause id="idA93C1BF0AE794030A8BE62F93F4E37C2"><enum>(I)</enum><text>present evidence
				in support of the party’s claims; and</text>
									</subclause><subclause id="idB89B703B3B2A4F8FBE0FA578F93CA914"><enum>(II)</enum><text>present the case
				in person, by counsel, or by other representative selected by the party.</text>
									</subclause></clause><clause id="ID6b2bc07d16f64b7d98187ed93c3dcd09"><enum>(v)</enum><header>Decisions</header><text>The
				arbitration board shall render its decision not later than 90 days after the
				date on which its final member is appointed. Decisions of the arbitration board
				shall be conclusive and binding upon the parties.</text>
								</clause><clause id="ID4ef92b652ced41ccaba00bfc909c51b1"><enum>(vi)</enum><header>Costs</header><text>The
				parties shall equally share the costs of the arbitration.</text>
								</clause></subparagraph></paragraph><paragraph id="ID535d3532d7e0446b96a34d65add55af0"><enum>(3)</enum><header>Ratification of
				agreements</header><text>Upon reaching a voluntary agreement or at the
				conclusion of the binding arbitration under paragraph (2)(B), the final
				agreement, except for those matters decided by the arbitration board, shall be
				subject to—</text>
							<subparagraph id="id7BF0F4D813E8405E838B2383436520D6"><enum>(A)</enum><text>ratification by
				the exclusive bargaining representative of the employees, if so requested by
				the bargaining representative; and</text>
							</subparagraph><subparagraph id="id582591ADE0E64F419AAC85857EA3BD9A"><enum>(B)</enum><text>approval by the
				head of the agency, in accordance with the provisions referred to in subsection
				(g)(2)(C).</text>
							</subparagraph></paragraph><paragraph id="ID8b756426a7ad488c99a21299563f64e7"><enum>(4)</enum><header>Enforcement</header>
							<subparagraph id="ID8889c4749f534a4fab7351d9e6c95b9e"><enum>(A)</enum><header>Enforcement
				actions in United States courts</header>
								<clause id="idD4E2B7B7E3AD4374A9EF3F5E81748E6E"><enum>(i)</enum><header>Jurisdiction</header><text>Each
				United States district court and each United States court of a place subject to
				the jurisdiction of the United States shall have jurisdiction to adjudicate
				enforcement actions brought under this section.</text>
								</clause><clause id="id72AA4ACA1ACD41FFAC0542EC3BD7B725"><enum>(ii)</enum><header>Judicial
				district</header><text>An enforcement action may be brought under this section
				in—</text>
									<subclause id="idEFD0EA5FD6E9446884EEC63CAEDFB1BD"><enum>(I)</enum><text>any judicial
				district in the State in which the violation of this section is alleged to have
				been committed;</text>
									</subclause><subclause id="id6C8FC7318AD94742B2FB6D2B8D598EA0"><enum>(II)</enum><text>the judicial
				district in which the Federal Aviation Administration has its principal office;
				or</text>
									</subclause><subclause id="id0B21790BD0DF4E8E9B744D7D5758B0EE"><enum>(III)</enum><text>the District of
				Columbia.</text>
									</subclause></clause></subparagraph><subparagraph id="ID5e2c36ccc7d34d4c8b9227e2f14dc0b3"><enum>(B)</enum><header>Attorney
				fees</header><text>The court may assess against the Federal Aviation
				Administration reasonable attorney fees and other litigation costs reasonably
				incurred in any case under this section in which the complainant has
				substantially
				prevailed.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id020CBB1EE29846E79903DE00116A4056"><enum>(b)</enum><header>Effect of
			 changes; negotiations</header><text>Any changes to the personnel management
			 system implemented by the Administrator of the Federal Aviation Administration
			 on or after July 10, 2005, under section 40122(a) of title 49, United States
			 Code (as in effect on the day before the date of the enactment of this Act),
			 without the agreement of the exclusive bargaining representative of the
			 employees of the Federal Aviation Administration certified under section 7111
			 of title 5, United States Code, shall be null and void. The Administrator and
			 the bargaining representative shall resume negotiations promptly, and, subject
			 to subsection (d), the last mutual agreement before the implementation of such
			 changes shall be in effect until a new contract is adopted by the Administrator
			 and the bargaining representative.</text>
			</subsection><subsection id="id0B10F59122E24247AE034F9C74FF8E2F"><enum>(c)</enum><header>Arbitration</header><text>If
			 a new agreement is not reached 45 days after the date on which negotiations
			 resume under subsection (b), the Administrator and the bargaining
			 representative shall submit their issues in controversy to the Federal Service
			 Impasses Panel, in accordance with section 7119 of title 5, United States Code,
			 for binding arbitration in accordance with paragraphs (2)(B), (3), and (4) of
			 section 40122(a) of title 49, United States Code.</text>
			</subsection><subsection id="ID38ed0568d96e44d0a725c6388230c19c"><enum>(d)</enum><header>Interim
			 agreement</header><text>If the Administrator and the exclusive bargaining
			 representative of the employees subject to the changes referred to in
			 subsection (b) reach a final and binding agreement with respect to such changes
			 before the date of the enactment of this Act,—</text>
				<paragraph id="idFD04ED972398468FB21FF597657C9543"><enum>(1)</enum><text>such agreement
			 shall supersede any changes implemented by the Administrator under section
			 40122(a) of title 49, United States Code (as in effect on the day before such
			 date of enactment) without the agreement of the bargaining representative;
			 and</text>
				</paragraph><paragraph id="id9511768443B94B1F823E6C24D7B74C93"><enum>(2)</enum><text>subsections (b)
			 and (c) shall not take effect.</text>
				</paragraph></subsection></section></legis-body>
