		  employment-based immigrant visas lost to bureaucratic delays and to prevent
		  losses of family-sponsored and employment-based immigrant visas in the future,

		<section commented="no" display-inline="no-display-inline" id="HA6A82DC8FDEB448EB6B48D97E95DFB90" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Visa Efficiency and E-Verify Extension
			 Act of 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id906ACEC3E305437C995EBA8FECFF33C0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Recapture of immigrant visas lost to
			 bureaucratic delay</header>
			<subsection commented="no" display-inline="no-display-inline" id="HEAD73EDE1978469EA737D0A0DF6CEDAC"><enum>(a)</enum><header display-inline="yes-display-inline">Worldwide level of employment-based
			 immigrants</header><text display-inline="yes-display-inline">Section 201(d) of
			 the Immigration and Nationality Act (8 U.S.C. 1151(d)) is amended to read as
			 follows:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="HF75D55E258634D0DAE363B1038C4756E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The worldwide level of employment-based
				immigrants under this subsection for a fiscal year is equal to the sum
				of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HB9C0DDDA29174AE780B1C8B436B0D441"><enum>(A)</enum><text display-inline="yes-display-inline">140,000, plus</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA7D3C4FE3284DA0B3377E310009CBC9"><enum>(B)</enum><text display-inline="yes-display-inline">the number computed under paragraph (2),
				plus</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2266DA0A5604DD084537200DFA74800"><enum>(C)</enum><text display-inline="yes-display-inline">the number computed under paragraph
				(3).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3F35ABDF56F4E10B0D3E96B89A613F4"><enum>(2)</enum><header display-inline="yes-display-inline">Unused visa numbers from previous fiscal
				year</header><text display-inline="yes-display-inline">The number computed
				under this paragraph for a fiscal year is the difference, if any,
				between—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H287283B8254249D0B710E8BA0FB6088"><enum>(A)</enum><text display-inline="yes-display-inline">the worldwide level of employment-based
				immigrant visas established for the previous fiscal year; and</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H6A9284FBF92944AEBCE700C7E6043BF2"><enum>(b)</enum><header display-inline="yes-display-inline">Worldwide level of family-sponsored
			 immigrants</header><text display-inline="yes-display-inline">Section 201(c) of
			 the Immigration and Nationality Act (8 U.S.C. 1151(c)) is amended to read as
			 follows:</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="H67294BBA1A464257A767FED0AB7CD612"><enum>(A)</enum><header display-inline="yes-display-inline">Base level</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the worldwide
				level of family-sponsored immigrants under this subsection for a fiscal year is
				equal to—</text>

				direct numerical limitations</header><text display-inline="yes-display-inline">The number computed under this paragraph
				for a fiscal year is the number of aliens described in subparagraph (A) or (B)
				of subsection (b)(2) who were issued immigrant visas or who otherwise acquired
				the status of an alien lawfully admitted to the United States for permanent
				residence in the previous fiscal year.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3D183AC30DD64278B44B062473B500B0"><enum>(3)</enum><header display-inline="yes-display-inline">Unused visa numbers from previous fiscal
				year</header><text display-inline="yes-display-inline">The number computed
				under this paragraph for a fiscal year is the difference, if any,
				between—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H85F36C49FD6648FF82739FDF435FFA8"><enum>(A)</enum><text display-inline="yes-display-inline">the worldwide level of family-sponsored
				immigrant visas established for the previous fiscal year; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBD77641176D44CC38BDFB3DA71C9EDD1"><enum>(B)</enum><text display-inline="yes-display-inline">the number of visas actually issued under
				section 203(a), subject to this subsection, during the previous fiscal
				year.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H163E12C91758402281A1A93FDAF6D6BB"><enum>(4)</enum><header display-inline="yes-display-inline">Unused visa numbers from fiscal years 1992

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD417964623C64767841725A42CF8A895"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect 60 days after the date of the enactment of this
			 Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDa6dd27bf93304ec1bb52b042b61e9bc0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Extension of the Conrad State 30
			 Program</header><text display-inline="no-display-inline">Subsection (c) of
			 section 220 of the Immigration and Nationality Technical Corrections Act of
			 1994 (Public Law 103–416; 8 U.S.C. 1182 note) is amended by striking
			 <quote>June 1, 2008</quote> and inserting <quote>June 1, 2013</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id97D05C644A064809A72AD90806228E00" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Special immigrant nonminister religious
			 worker program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2C91217E72404BD899263068FFBE8FF6"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than December 31, 2008, the
			 Secretary of Homeland Security shall issue final regulations to eliminate or
			 reduce fraud related to the granting of special immigrant status for special
			 immigrants described in subclause (II) or (III) of section 101(a)(27)(C)(ii) of
			 the Immigration and Nationality Act (8 U.S.C. 1101(a)(27)(C)(ii)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6103BCEBFA5340458C2B274BC1B84A98"><enum>(b)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">Subclause (II) and subclause (III) of
			 section 101(a)(27)(C)(ii) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(27)(C)(ii)) are amended by striking <quote>October 1, 2008,</quote>
			 both places such term appears and inserting <quote>October 1,
			 2011,</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB9BFA038FAEF4888B9B9167B0544D559"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than September 30, 2010, the
			 Inspector General of the Department of Homeland Security shall submit to
			 Congress a report on the effectiveness of the regulations described in
			 subsection (a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HFAC1C4D113C94D7C8F6F4F15F1835242" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Extension of the Basic Pilot
			 Program</header><text display-inline="no-display-inline">Section 401(b) of the
			 Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.
			 1324a note) is amended by striking <quote>11-year period</quote> and inserting
			 <quote>16-year period</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H8F439451ABB54CBF9D60F58DE5C087F" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Protection of Social Security
			 Administration programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE0791048B720408883D5AAEFFC0076F7"><enum>(a)</enum><header display-inline="yes-display-inline">Funding under agreement</header><text display-inline="yes-display-inline">Effective for fiscal years beginning on or
			 after October 1, 2008, the Commissioner of Social Security and the Secretary of
			 Homeland Security shall enter into and maintain an agreement which
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE93D17BF5FFE4E7E9266E8AF9F526D84"><enum>(1)</enum><text display-inline="yes-display-inline">provide funds to the Commissioner for the
			 full costs of the responsibilities of the Commissioner under section 404 of the
			 Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.
			 1324a note), including (but not limited to)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3C52ECC019504C89BDC1001F8087AD32"><enum>(A)</enum><text display-inline="yes-display-inline">acquiring, installing, and maintaining
			 technological equipment and systems necessary for the fulfillment of the
			 responsibilities of the Commissioner under such section 404, but only that
			 portion of such costs that are attributable exclusively to such
			 responsibilities; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D36D6C9ECF4435EAC49CB5D61D46903"><enum>(B)</enum><text display-inline="yes-display-inline">responding to individuals who contest a
			 tentative nonconfirmation provided by the basic pilot confirmation system
			 established under such section;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H892B0E2DEC5D4CD6B7C81B32DD069C19"><enum>(2)</enum><text display-inline="yes-display-inline">provide such funds quarterly in advance of
			 the applicable quarter based on estimating methodology agreed to by the
			 Commissioner and the Secretary (except in such instances where the delayed
			 enactment of an annual appropriation may preclude such quarterly payments);
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA973A0973ED644E79BCD11F2D793424"><enum>(3)</enum><text display-inline="yes-display-inline">require an annual accounting and
			 reconciliation of the actual costs incurred and the funds provided under the
			 agreement, which shall be reviewed by the Office of Inspector General of the
			 Social Security Administration and the Department of Homeland Security.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDC9D3D4AE0FA410BB519CE3309FF824F"><enum>(b)</enum><header display-inline="yes-display-inline">Continuation of employment verification in
			 absence of timely agreement</header><text display-inline="yes-display-inline">In any case in which the agreement required
			 under subsection (a) for any fiscal year beginning on or after October 1, 2008,
			 has not been reached as of October 1 of such fiscal year, the latest agreement
			 between the Commissioner and the Secretary of Homeland Security providing for
			 funding to cover the costs of the responsibilities of the Commissioner under
			 section 404 of the Illegal Immigration Reform and Immigrant Responsibility Act
			 of 1996 (8 U.S.C. 1324a note) shall be deemed in effect on an interim basis for
			 such fiscal year until such time as an agreement required under subsection (a)
			 is subsequently reached, except that the terms of such interim agreement shall
			 be modified by the Director of the Office of Management and Budget to adjust
			 for inflation and any increase or decrease in the volume of requests under the
			 basic pilot confirmation system. In any case in which an interim agreement
			 applies for any fiscal year under this subsection, the Commissioner and the
			 Secretary shall, not later than October 1 of such fiscal year, notify the
			 Committee on Ways and Means, the Committee on the Judiciary, and the Committee
			 on Appropriations of the House of Representatives and the Committee on Finance,
			 the Committee on the Judiciary, and the Committee on Appropriations of the
			 Senate of the failure to reach the agreement required under subsection (a) for
			 such fiscal year. Until such time as the agreement required under subsection
			 (a) has been reached for such fiscal year, the Commissioner and the Secretary
			 shall, not later than the end of each 90-day period after October 1 of such
			 fiscal year, notify such Committees of the status of negotiations between the
			 Commissioner and the Secretary in order to reach such an agreement.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H70D566EF095147E5BB99F4E8B594ABF8" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">GAO study of basic pilot confirmation
			 system</header>
			<subsection commented="no" display-inline="no-display-inline" id="H230541F842694AD68508D900C532921D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Comptroller General of the United States shall
			 conduct a study regarding erroneous tentative nonconfirmations under the basic
			 pilot confirmation system established under section 404(a) of the Illegal
			 Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a
			 note).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H209F106FD292435499D34DEE8D06DEA5"><enum>(b)</enum><header display-inline="yes-display-inline">Matters To be studied</header><text display-inline="yes-display-inline">In the study required under subsection (a),
			 the Comptroller General shall determine and analyze—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H13511A6A86F74E9398BF21F36015114"><enum>(1)</enum><text display-inline="yes-display-inline">the causes of erroneous tentative
			 nonconfirmations under the basic pilot confirmation system;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD23581B5841E4B739D4DE2A4CA12D3DD"><enum>(2)</enum><text display-inline="yes-display-inline">the processes by which such erroneous
			 tentative nonconfirmations are remedied; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0558F889A9ED4C37AFA27BD64A78F74"><enum>(3)</enum><text display-inline="yes-display-inline">the effect of such erroneous tentative
			 nonconfirmations on individuals, employers, and Federal agencies.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1395146837A84A5FB4A571F80258E300"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Comptroller General shall submit the results of
			 the study required under subsection (a) to the Committee on Ways and Means and
			 the Committee on the Judiciary of the House of Representatives and the
			 Committee on Finance and the Committee on the Judiciary of the Senate.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE2D363E53D204DAEA2526925002890C8" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">GAO study of effects of basic pilot program
			 on small entities</header>
			<subsection commented="no" display-inline="no-display-inline" id="H868877415F314CAABED87F1122B8C942"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Comptroller General of the United States shall
			 submit to the Committees on the Judiciary of the United States House of
			 Representatives and the Senate a report containing the Comptroller General’s
			 analysis of the effects of the basic pilot program described in section 403(a)
			 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8
			 U.S.C. 1324a note) on small entities (as defined in section 601 of title 5,
			 United States Code). The report shall detail—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H7EAAB06F80D54C5396774889BF85CAE3"><enum>(1)</enum><text display-inline="yes-display-inline">the costs of compliance with such program
			 on small entities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8647517D5F74C98950392BE2400BE61"><enum>(2)</enum><text display-inline="yes-display-inline">a description and an estimate of the number
			 of small entities enrolled and participating in such program or an explanation
			 of why no such estimate is available;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE403BE00858B41B7BFA856580263B0ED"><enum>(3)</enum><text display-inline="yes-display-inline">the projected reporting, recordkeeping and
			 other compliance requirements of such program on small entities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8E3529F50ECF4AEE8C8BDD62CE46CA77"><enum>(4)</enum><text display-inline="yes-display-inline">factors that impact small entities’
			 enrollment and participation in such program, including access to appropriate
			 technology, geography, entity size, and class of entity; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71E69D6C15ED4DE1BA222E82DC739000"><enum>(5)</enum><text display-inline="yes-display-inline">the steps, if any, the Secretary of
			 Homeland Security has taken to minimize the economic impact of participating in

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HECB76B911EE84D149ED2A0AD752DDE38"><enum>(b)</enum><header display-inline="yes-display-inline">Direct and indirect effects</header><text display-inline="yes-display-inline">The report shall cover, and treat
			 separately, direct effects (such as wages, time, and fees spent on compliance)
			 and indirect effects (such as the effect on cash flow, sales, and
			 competitiveness).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7E6D7EEDB29E41CD9953F129F2E898EF"><enum>(c)</enum><header display-inline="yes-display-inline">Specific contents</header><text display-inline="yes-display-inline">The report shall provide specific and
			 separate details with respect to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEB963CD249404F7BA3436B727F758222"><enum>(1)</enum><text display-inline="yes-display-inline">small businesses (as defined in section 601
			 of title 5, United States Code) with fewer than 50 employees; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC018862B3C144A509E113C523B35A865"><enum>(2)</enum><text display-inline="yes-display-inline">small entities operating in States that
			 have mandated use of the basic pilot program.</text>
