		<official-title display="yes">To amend the Homeland Security Act of 2002
		  to establish an appeal and redress process for passengers wrongly delayed or
		  prohibited from boarding a flight, or denied a right, benefit, or privilege,

		<section id="H5DC3C7940CB1466896A2BAD423E19410" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair, Accurate, Secure, and Timely
			 Redress Act of 2008</short-title></quote> or the <quote><short-title>FAST Redress Act of 2008</short-title></quote>.</text>
		</section><section id="H50A58AE2F4474365B4809DB683CD3864"><enum>2.</enum><header>Establishment of
			 appeal and redress process for passengers wrongly delayed or prohibited from
			 boarding a flight, or denied a right, benefit, or privilege</header>
			<subsection id="H49E115A11FF9456E874268BC44A489BE"><enum>(a)</enum><header>In
			 general</header><text>Subtitle H of title VIII of the Homeland Security Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/451">6 U.S.C. 451 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="H3C4AE406B4CC4011B1EB5C7977C49A3" style="OLC">
					<section id="H686427F3076A4ECFAC703B56AE6B06A5"><enum>890.</enum><header>Appeal and
				redress process for passengers wrongly delayed or prohibited from boarding a
				flight, or denied a right, benefit, or privilege</header>
						<subsection id="H65A042AC6FD140010084E118780091D1"><enum>(a)</enum><header>Establishment</header><text>Not
				later than 30 days after the date of the enactment of this section, the
				Secretary shall establish a fair and timely process for individuals who believe
				they were delayed or prohibited from boarding a commercial aircraft or denied a
				right, benefit, or privilege because they were wrongly identified as a threat
				when screened against any terrorist watchlist or database used by the
				Transportation Security Administration or any office or component of the
				Department.</text>
						</subsection><subsection id="HAE121E0FE8A24913ACC7F2731F885E54"><enum>(b)</enum><header>Office of
				Appeals and Redress</header>
							<paragraph id="HC20531976C4C4B639E00A85E1602C3F"><enum>(1)</enum><header>Establishment</header>
								<subparagraph id="idB1B0CFF6E5924087827C72A41F11808D"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall establish in the Department an Office
				of Appeals and Redress (referred to in this section as the <term>Office</term>)
				to implement, coordinate, and execute the process established by the Secretary
				pursuant to subsection (a).</text>
								</subparagraph><subparagraph id="idBF29A1EB8AB44BCFBA0D020A224AFA68"><enum>(B)</enum><header>Representation</header><text>The
				Office shall include representatives from the Transportation Security
				Administration and such other offices and components of the Department as the
				Secretary determines appropriate.</text>
								</subparagraph></paragraph><paragraph id="H0D67B95705B04F57A51220413B93A600"><enum>(2)</enum><header>Comprehensive
				Cleared List</header><text>The process established by the Secretary pursuant to
				subsection (a) shall include the establishment of a method by which the Office,
				under the direction of the Secretary, shall maintain and appropriately
				disseminate a comprehensive list, to be known as the <term>Comprehensive
				Cleared List</term>, of individuals who—</text>
								<subparagraph id="H85F348D77C364C7195F45E726FA16BCE"><enum>(A)</enum><text>were misidentified
				as an individual on any terrorist watchlist or database;</text>
								</subparagraph><subparagraph id="H5AC29649BFAC48D09F642E8777B5A755"><enum>(B)</enum><text>completed an
				appeal and redress request approved by the Department and provided such
				additional information as required by the Department to verify the individuals'
				identities; and</text>
								</subparagraph><subparagraph id="H7563C36705724679938F957346F4E460"><enum>(C)</enum><text>permit the use of
				their personally identifiable information to be shared between multiple
				components of the Department for purposes of this section.</text>
								</subparagraph></paragraph><paragraph id="H0ABEC2494A814EEAB323E474227F07E4"><enum>(3)</enum><header>Use of
				Comprehensive Cleared List</header>
								<subparagraph id="H102D9AFB6EE54EB59C58637ED6455FE0"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (B), the Secretary shall—</text>
									<clause id="HF59684DB59234D30B867EF5600B326B6"><enum>(i)</enum><text>transmit the
				Comprehensive Cleared List and any other information the Secretary determines
				necessary to resolve misidentifications and improve the administration of the
				advanced passenger prescreening system and reduce the number of false
				positives—</text>
										<subclause id="id80EE9A7208E2489A84248D783551D326"><enum>(I)</enum><text>to the
				Transportation Security Administration or any other appropriate office or
				component of the Department;</text>
										</subclause><subclause id="idC36AB143747C482E8FC7F2E142C487F5"><enum>(II)</enum><text>other Federal,
				State, local, and tribal entities; and</text>
										</subclause><subclause id="id811DADBA2FAD4272B7C301B6616F2737"><enum>(III)</enum><text>domestic air
				carriers and foreign air carriers that use any terrorist watchlist or database;
				and</text>
										</subclause></clause><clause id="HEDA1962040EF4A0DB6AE60742607500"><enum>(ii)</enum><text>ensure that the
				Comprehensive Cleared List is taken into account by all appropriate offices or
				components of the Department when assessing the security risk of an
				individual.</text>
									</clause></subparagraph><subparagraph id="HB432F2BC5A6A47DFAAF9C27C7F084043"><enum>(B)</enum><header>Termination</header>
									<clause id="HEFC13B47799D42C68535DFE2C7F69B97"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The transmission of
				the Comprehensive Cleared List to domestic air carriers and foreign air
				carriers under subparagraph (A)(i)(III) shall terminate on the date on which
				the Federal Government assumes terrorist watchlist or database screening
				functions.</text>
									</clause><clause id="HCF5CA34ACE2F4F27A68E682BCBA5DF7F"><enum>(ii)</enum><header>Written
				notification to Congress</header><text display-inline="yes-display-inline">Not
				later than 15 days after the date described in clause (i), the Secretary shall
				submit written notification of such termination to—</text>
										<subclause id="id7CD8C2FF9767473C89A6CA06CE268972"><enum>(I)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and
				Transportation of the Senate;</text>
										</subclause><subclause id="idA47F8053B9344F99ADAB3381C76BDE43"><enum>(II)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
				Governmental Affairs of the Senate; and</text>
										</subclause><subclause id="id89534E72D1A448DE9242EA6EBB6067CA"><enum>(III)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the
				House of Representatives.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HA7BE5BB19776470E9E46C6E0EC88FA12"><enum>(4)</enum><header>Intergovernmental
				efforts</header><text>The Secretary may—</text>
								<subparagraph id="HA7A5B4A49D2B44CAB97C652C71E70122"><enum>(A)</enum><text>enter into
				memoranda of understanding with other Federal, State, local, and tribal
				agencies or entities, as necessary, to improve the appeal and redress process,
				to verify an individual’s identity and personally identifiable information, and
				for other purposes; and</text>
								</subparagraph><subparagraph id="HE270CAF2059545F19DC84CAE00D8D392"><enum>(B)</enum><text>work with other
				Federal, State, local, and tribal agencies or entities that use any terrorist
				watchlist or database to ensure, to the greatest extent practicable, that the
				Comprehensive Cleared List is considered when assessing the security risk of an
				individual.</text>
								</subparagraph></paragraph><paragraph id="H8DE186F6A9324E9B83E989FB59E62F3"><enum>(5)</enum><header>Handling of
				personally identifiable information</header><text>The Secretary, in conjunction
				with the Chief Privacy Officer of the Department, shall—</text>
								<subparagraph id="H6065DD100E324CA8A8A1EDE2BEDA3C1C"><enum>(A)</enum><text>require that
				employees of the Department handling personally identifiable information of
				individuals complete mandatory privacy and security training before being
				authorized to handle personally identifiable information of individuals;</text>
								</subparagraph><subparagraph id="H3D1DD856E3EC49DCADD1C124C276C65C"><enum>(B)</enum><text>ensure that the
				information maintained under this subsection is secured by encryption,
				including one-way hashing, data anonymization techniques, or such other
				equivalent technical security protections to the extent the Secretary
				determines necessary;</text>
								</subparagraph><subparagraph id="H901488616572427F009CB1BEB1FF54D3"><enum>(C)</enum><text>limit the
				information collected from misidentified passengers or other individuals to the
				minimum amount necessary to resolve an appeal and redress request;</text>
								</subparagraph><subparagraph id="H873B5F9C3ED74417919D5621954194C0"><enum>(D)</enum><text>ensure that the
				information maintained under this subsection is shared or transferred via an
				encrypted data network that has been audited to ensure that the anti-hacking
				and other security related software functions perform properly and are updated
				as necessary;</text>
								</subparagraph><subparagraph id="HDD57B0D4C82A49029836917BD88631DA"><enum>(E)</enum><text>ensure that any
				employee of the Department receiving the information maintained under this
				subsection handles such information in accordance with
				<external-xref legal-doc="usc" parsable-cite="usc/5/552a">section
				552a</external-xref> of title 5, United States Code, subchapter II of chapter
				35 of title 44, United States Code, section 11331 of title 40, United States
				Code, and other applicable laws;</text>
								</subparagraph><subparagraph id="HC73BD062E546484C8441DD7EDA9B5E7"><enum>(F)</enum><text>only retain the
				information maintained under this subsection for as long as needed to assist
				the individual traveler in the appeal and redress process;</text>
								</subparagraph><subparagraph commented="no" id="H11FD51B1B90C45C6BC24007C0018C269"><enum>(G)</enum><text>engage in
				cooperative agreements with appropriate Federal agencies and entities, on a
				reimbursable basis, to ensure that legal name changes are properly reflected in
				any terrorist watchlist or database and the Comprehensive Cleared List to
				improve the appeal and redress process and to ensure the most accurate lists of
				identifications possible (except that
				<external-xref legal-doc="usc" parsable-cite="usc/5/552a">section
				552a</external-xref> of title 5, United States Code, shall not prohibit the
				sharing of legal name changes among Federal agencies and entities for the
				purposes of this section); and</text>
								</subparagraph><subparagraph id="H1C88231D9EA04DD7A3721DABB520954D"><enum>(H)</enum><text>conduct and
				publish a privacy impact assessment of the appeal and redress process
				established under this section and submit the assessment to—</text>
									<clause id="id30A9BF3650054E80AEA2FF2324F8CA43"><enum>(i)</enum><text>the Committee on
				Commerce, Science, and Transportation of the Senate;</text>
									</clause><clause id="idDC2B30775ED0485F833904B668717F7A"><enum>(ii)</enum><text>the Committee on
				Homeland Security and Governmental Affairs of the Senate; and</text>
									</clause><clause id="idBD4025E7023547029E71BD46B830C290"><enum>(iii)</enum><text>the Committee
				on Homeland Security of the House of Representatives.</text>
									</clause></subparagraph></paragraph><paragraph id="HB2F0BBD1D9B34411978DA58113245EA6"><enum>(6)</enum><header>Initiation of
				appeal and redress process at airports</header>
								<subparagraph id="H176B7FF8701B4188B0C1DC3F7ED5A928"><enum>(A)</enum><header>In
				general</header><text>The Office shall provide written information to air
				carrier passengers at each airport at which the Department has a presence on
				how to begin the appeal and redress process established pursuant to subsection
				(a).</text>
								</subparagraph><subparagraph id="HD96AC1DD5245410E00331E2DE808008E"><enum>(B)</enum><header>Airports with
				significant Department presence</header><text>The Office shall ensure that a
				Transportation Security Administration supervisor who is trained in such appeal
				and redress process is available at each airport at which the Department has a
				significant presence to provide support to air carrier passengers in need of
				guidance concerning such process.</text>
								</subparagraph></paragraph></subsection><subsection id="HA505745AC78C415900D6265F43CD86D"><enum>(c)</enum><header>Terrorist
				watchlist or database defined</header><text display-inline="yes-display-inline">In this section, the term <term>terrorist
				watchlist or database</term> means any terrorist watchlist or database used by
				the Transportation Security Administration or any office or component of the
				Department or specified in Homeland Security Presidential Directive 6, in
				effect as of the date of the enactment of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H73482EE59D434462BA00C920FFD1326"><enum>(b)</enum><header>Incorporation of
			 secure flight</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/44903">Section 44903(j)(2)</external-xref> of title 49,
			 United States Code, is amended—</text>
				<paragraph id="HDBCCD36131684B14A40281024E914CDE"><enum>(1)</enum><text>in subparagraph
			 (C)(iii)—</text>
					<subparagraph id="H7CFBE96538C44B8EB93524B827B92130"><enum>(A)</enum><text>by redesignating
			 subclauses (II) through (VII) as subclauses (III) through (VIII), respectively;
			 and</text>
					</subparagraph><subparagraph id="H3E64D8DEFC024403BA536C39A1330671"><enum>(B)</enum><text>by inserting after
			 subclause (I) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H7BB572FC57AF4FF5AC09B7D5550969E5" style="OLC">
							<subclause id="HBC67BFD690034E7896CDEFA00E082E3"><enum>(II)</enum><text display-inline="yes-display-inline">ensure, not later than 30 days after the
				date of the enactment of the FAST Redress Act of 2008, that the procedure
				established under subclause (I) is incorporated into the appeals and redress
				process established under section 890 of the Homeland Security Act of
				2002;</text>
							</subclause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC8E0D5D85ACC434BAEB8B43DA500FBBC"><enum>(2)</enum><text>in subparagraph
			 (E)(iii), by inserting <quote>, in accordance with the appeals and redress
			 process established under section 890(a) of the Homeland Security Act of
			 2002</quote> before the period at the end; and</text>
				</paragraph><paragraph id="H8177869FFDC54B0B89F200187BA9D4F3"><enum>(3)</enum><text>in subparagraph
			 (G)—</text>
					<subparagraph id="H17395895E26D41A08136A123C49E15"><enum>(A)</enum><text>in clause (i), by
			 adding at the end the following: <quote>The Assistant Secretary shall
			 incorporate the process established pursuant to this clause into the appeals
			 and redress process established under section 890(a) of the Homeland Security
			 Act of 2002.</quote>; and</text>
					</subparagraph><subparagraph id="HCD31AEEAD78E4136BEBF89F284F6EF9F"><enum>(B)</enum><text>in clause (ii), by
			 adding at the end the following: <quote>The Assistant Secretary shall
			 incorporate the record established and maintained pursuant to this clause into
			 the Comprehensive Cleared List established and maintained under section
			 890(b)(2) of the Homeland Security Act of 2002.</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id48D3F05D8EB04FEC8C161C66DC298012"><enum>(c)</enum><header>Report to
			 Congress</header>
				<paragraph id="id4096CB74E81143518836434C8C1903FC"><enum>(1)</enum><header>In
			 general</header><text>Not later than 240 days after the date of the enactment
			 of this Act, the Secretary of Homeland Security shall submit to the Committee
			 on Commerce, Science, and Transportation of the Senate, the Committee on
			 Homeland Security and Governmental Affairs of the Senate, and the Committee on
			 Homeland Security of the House of Representatives a report on the status of
			 information sharing among users at the Department of Homeland Security of any
			 terrorist watchlist or database.</text>
				</paragraph><paragraph id="id53E9216017A64F7CB77764241150AA52"><enum>(2)</enum><header>Contents</header><text>The
			 report required by paragraph (1) shall include the following
			 information:</text>
					<subparagraph id="id6805760AFCD345F9A2E0E2C3A2187A5D"><enum>(A)</enum><text>A description of
			 the processes and the status of the implementation of section 890 of the
			 Homeland Security Act of 2002, as added by subsection (a), to share the
			 Comprehensive Cleared List required by section 890(b)(2) of such Act with other
			 offices and components of the Department of Homeland Security and other
			 Federal, State, local, and tribal authorities that utilize any terrorist
			 watchlist or database.</text>
					</subparagraph><subparagraph id="idBA5DB4B95782477BB3FAF1C7682EB0BD"><enum>(B)</enum><text>A description of
			 the extent to which such other offices and components of the Department of
			 Homeland Security are taking into account the Comprehensive Cleared
			 List.</text>
					</subparagraph><subparagraph id="id1D4EC776F6AA4A5F9B00476ACBFED215"><enum>(C)</enum><text>Data on the
			 number of individuals who have sought and successfully obtained redress through
			 the Office of Appeals and Redress established under section 890(b)(1) of the
			 Homeland Security Act of 2002, as added by subsection (a).</text>
					</subparagraph><subparagraph id="id6B9BD22727FA4A0298E90E687F6D6958"><enum>(D)</enum><text display-inline="yes-display-inline">Data on the number of individuals who have
			 sought and were denied redress through the Office of Appeals and
			 Redress.</text>
					</subparagraph><subparagraph id="id9121FE3425074C66BE97F67272DB1069"><enum>(E)</enum><text>An assessment of
			 what impact information sharing of the Comprehensive Cleared List has had on
			 misidentifications of individuals who have successfully obtained redress
			 through the Office of Appeals and Redress.</text>
					</subparagraph><subparagraph id="id5C0D436BB6984BEEB42BE0A744BA17CD"><enum>(F)</enum><text>An updated
			 privacy impact assessment.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id934B056314004410BFE839BE53ED5A27"><enum>(3)</enum><header display-inline="yes-display-inline">Terrorist watchlist or database
			 defined</header><text display-inline="yes-display-inline">In this subsection,
			 the term <term>terrorist watchlist or database</term> has the meaning given the
			 term in section 890(c) of the Homeland Security Act of 2002, as added by
			 subsection (a) of this section.</text>
				</paragraph></subsection><subsection id="HA593C27A78544AF1A4FD00562755AAE2"><enum>(d)</enum><header>Conforming
			 amendment</header><text>Title 49, United States Code, is amended by striking
			 section 44926 (and the item relating to such section in the analysis for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title
			 49).</text>
			</subsection><subsection id="HB2408C6A668447A9B3B09A724F20098"><enum>(e)</enum><header>Clerical
			 amendment</header><text>Section 1(b) of the Homeland Security Act of 2002
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C.
			 101(b)</external-xref>) is amended by striking the item relating to section 890
			 and inserting the following:</text>
