			 <quote><short-title>Information Technology Investment
			 Oversight Enhancement and Waste Prevention Act of
			 2008</short-title></quote>.</text>

			 gross deviations</header><text>Section 11317 of title 40, United States Code,
			 is amended to read as follows:</text>

				and gross deviations</header>
						<subsection id="id4EE38096BA074DB6B099B8A8A4BC9973"><enum>(a)</enum><header>Definitions</header><text>In
				this subchapter:</text>
							<paragraph id="idBEF7B7D992AE4FDABFD8D7245DBEEEBF"><enum>(1)</enum><header>Agency
				head</header><text>The term <term>Agency Head</term> means the head of the
				Federal agency that is primarily responsible for the IT investment project
				under review.</text>
							</paragraph><paragraph commented="no" id="id0CFB3DB441674FDEB6025385CCEA82A6"><enum>(2)</enum><header>ANSI EIA–748
				standard</header><text>The term <term>ANSI EIA–748 Standard</term> means the
				measurement tool jointly developed by the American National Standards Institute
				and the Electronic Industries Alliance to analyze earned value management
				systems.</text>
							</paragraph><paragraph id="ID4200d19fe4ac4a20b5ef2b772e82fd45"><enum>(3)</enum><header>Appropriate
				congressional committees</header><text>The term <quote>appropriate
				congressional committees</quote> means—</text>
								<subparagraph id="idDA8F46B8E3124F94AE00B26431693553"><enum>(A)</enum><text>the
				<committee-name committee-id="SSGA00">Committee on Homeland Security and
				Governmental Affairs of the Senate</committee-name>;</text>
								</subparagraph><subparagraph id="id16BB61A987AB42169ADD3851B9716810"><enum>(B)</enum><text>the
				<committee-name committee-id="">Committee on Oversight and Government Reform of
				the House of Representatives</committee-name>;</text>
								</subparagraph><subparagraph id="id32CE2B5AF9B44BE9A4FD3F9340E22A12"><enum>(C)</enum><text>the
				<committee-name committee-id="SSAP00">Committee on Appropriations of the
				Senate</committee-name>;</text>
								</subparagraph><subparagraph id="id5B1DC38C64DC42D5A0B8C0EEA114BAB9"><enum>(D)</enum><text>the
				<committee-name committee-id="">Committee on Appropriations of the House of
				Representatives</committee-name>; and</text>
								</subparagraph><subparagraph id="id4B4A7A59D087448B92DAAA9CBB398221"><enum>(E)</enum><text>any other relevant
				congressional committee with jurisdiction over an agency required to take
				action under this section.</text>
								</subparagraph></paragraph><paragraph id="idD3E1BFF241F34F9A8B5774EBB3DA15F7"><enum>(4)</enum><header>Chief
				information officer</header><text>The term <term>Chief Information
				Officer</term> means the Chief Information Officer designated under section
				3506(a)(2) of title 44 of the Federal agency that is primarily responsible for
				the IT investment project under review.</text>
							</paragraph><paragraph id="idCE106DCCDE224244B6199655E1D39F19"><enum>(5)</enum><header>Core IT
				investment project</header><text>The terms <term>core IT investment
				project</term> and <term>core project</term> mean a mission critical IT
				investment project jointly designated as such by the Agency Head and the
				Director under subsection (b).</text>
							</paragraph><paragraph id="ID815b7d3151ff4257ad25a675ce03b9de"><enum>(6)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Office of Management and
				Budget.</text>
							</paragraph><paragraph id="ID451a6628edbc401e952e683cbcebe7af"><enum>(7)</enum><header>Grossly
				deviated</header><text>The term <term>grossly deviated</term> means cost,
				schedule, or performance variance that is at least 40 percent from the Original
				Baseline.</text>
							</paragraph><paragraph id="IDf8c7419fc47d432e806d64c8a78985d7"><enum>(8)</enum><header>Independent cost
				estimate</header><text>The term <term>independent cost estimate</term> means a
				pragmatic and neutral analysis, assessment, and quantification of all costs and
				risks associated with the acquisition of an IT investment project,
				which—</text>
								<subparagraph id="IDaeb6ae191d34467eb1e787e8364ea80d"><enum>(A)</enum><text>is based on
				programmatic and technical specifications provided by the office within the
				agency with primary responsibility for the development, procurement, and
				delivery of the project;</text>
								</subparagraph><subparagraph id="ID1fca96a0dee843068b3bba2f222cf178"><enum>(B)</enum><text>is formulated and
				provided by an entity other than the office within the agency with primary
				responsibility for the development, procurement, and delivery of the
				project;</text>
								</subparagraph><subparagraph id="ID4d26109887944b55928b283d5d8bb025"><enum>(C)</enum><text>contains
				sufficient detail to inform the selection of a baseline benchmark measure under
				the ANSI EIA–748 standard; and</text>
								</subparagraph><subparagraph id="ID4f81bfe4706d4857affdf8cad3d40f21"><enum>(D)</enum><text>accounts for the
				full life cycle cost plus associated operations and maintenance expenses over
				the usable life of the project’s deliverables.</text>
								</subparagraph></paragraph><paragraph id="id3244D5D02C2940BF98FCA115970788C4"><enum>(9)</enum><header>IT investment
				project</header><text>The terms <term>IT investment project</term> and
				<term>project</term> mean an information technology system or acquisition
				that—</text>
								<subparagraph id="id9D568DC5B6C24CFAB5DEFFAE5FD81738"><enum>(A)</enum><text>requires special
				management attention because of its importance to the mission or function of
				the agency, a component of the agency, or another organization;</text>
								</subparagraph><subparagraph id="id74611CAECF45487AB0C8DC95CBA5D14C"><enum>(B)</enum><text>is for financial
				management and obligates more than $500,000 annually;</text>
								</subparagraph><subparagraph id="id7C26E21DA11C4B0089295C3C7A81EA84"><enum>(C)</enum><text>has significant
				program or policy implications;</text>
								</subparagraph><subparagraph id="id9ED4E52F99A748D1B55A4D4346620993"><enum>(D)</enum><text>has high executive
				visibility;</text>
								</subparagraph><subparagraph id="id352515DE9E394CC9958BE11B51666A5A"><enum>(E)</enum><text>has high
				development, modernization, or enhancement costs;</text>
								</subparagraph><subparagraph id="idF1DB685C00E24D8CADB5A71E8964FC1C"><enum>(F)</enum><text>is funded through
				other than direct appropriations; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0DCDEF58C2DE4326B9F9EA22744E6C80"><enum>(G)</enum><text>is defined as
				major by the agency’s capital planning and investment control process.</text>
								</subparagraph></paragraph><paragraph id="id43FD854D449C481CB5D3F723CA660E7D"><enum>(10)</enum><header>Life cycle
				cost</header><text>The term <term>life cycle cost</term> means the total cost
				of an IT investment project for planning, research and development,
				modernization, and enhancement.</text>
							</paragraph><paragraph id="IDbd516b7fc8d14a6887a1995b8eb1f54f"><enum>(11)</enum><header>Original
				baseline</header>
								<subparagraph id="id9A1C7FA015E54E31AF1EB9079CC5D4D9"><enum>(A)</enum><header>In
				general</header><text>Except as provided under subparagraph (B), the term
				<term>Original Baseline</term> means the ANSI EIA–748 Standard-compliant cost,
				schedule, and performance benchmark established at the commencement of an IT
				investment project contract.</text>
								</subparagraph><subparagraph id="idB48439A294854FA381BA9BA52741E76F"><enum>(B)</enum><header>Grossly deviated
				project</header><text>If an IT investment project grossly deviates from its
				Original Baseline (as defined in subparagraph (A)), the term <term>Original
				Baseline</term> means the ANSI EIA–748 Standard-compliant cost, schedule, and
				performance benchmark established under subsection (e)(3)(C).</text>
								</subparagraph></paragraph><paragraph id="ID9b6453122ea540dfb8645727896152a9"><enum>(12)</enum><header>Significantly
				deviated</header><text>The term <term>significantly deviated</term> means cost,
				schedule, or performance variance that is at least 20 percent from the Original
				Baseline.</text>
							</paragraph></subsection><subsection id="ID49f314933d5d4f69919d23efb7e6e9d3"><enum>(b)</enum><header>Core IT
				investment projects</header>
							<paragraph id="idF42B6ACEA76D41CE88A983323AFFCA4C"><enum>(1)</enum><header>Designation</header><text>Except
				as provided under paragraph (2), each Agency Head and the Director shall
				jointly designate not fewer than 5 of the agency’s most mission critical IT
				investment projects as <quote>core IT investment projects</quote> or
				<quote>core projects</quote>, after considering, among other factors—</text>
								<subparagraph id="IDa0a900e4aaec4fd78af710cde19a26b3"><enum>(A)</enum><text>whether the
				project represents a high-dollar value relative to the average IT investment
				project in the agency’s portfolio;</text>
								</subparagraph><subparagraph id="ID7ecc3e2dc29847f6b595e4ce50da6aac"><enum>(B)</enum><text>whether the
				project delivers a capability critical to the successful completion of the
				agency mission, or a portion of such mission; and</text>
								</subparagraph><subparagraph id="IDe5e57bf34c344be2b6c43c6bd899fd97"><enum>(C)</enum><text>whether the
				project incorporates unproven or previously undeveloped technology to meet
				primary project technical requirements.</text>
								</subparagraph></paragraph><paragraph id="ID37117aa8f3c448ca9ee0d7974bb2e4d4"><enum>(2)</enum><header>Exception</header><text>If
				the Agency Head and the Director jointly determine that fewer than 5 IT
				investment projects meet the criteria described in paragraph (1), the
				Director—</text>
								<subparagraph id="id93F3D27C329D413AB868F23E95DE3262"><enum>(A)</enum><text>may provide the
				agency with written authorization to designate fewer than 5 projects;
				and</text>
								</subparagraph><subparagraph id="idE7D8938AEDBD453A8286A7DAF9032416"><enum>(B)</enum><text>shall submit a
				report to the appropriate congressional committees that contains notice of, and
				justification for, any such authorization.</text>
								</subparagraph></paragraph></subsection><subsection id="idC2CD014019F8469B9BD6B8FC02FD1230"><enum>(c)</enum><header>Cost, schedule,
				and performance reports</header>
							<paragraph id="id1DA03426886A4DADA308E12BD900061F"><enum>(1)</enum><header>Quarterly
				reports</header><text>Not later than 7 days after the end of each fiscal
				quarter, the project manager for an IT investment project shall submit a
				written report to the Chief Information Officer that includes, as of the last
				day of the applicable quarter—</text>
								<subparagraph id="idC82112A8E24E4AD4BF5BF7957169D01A"><enum>(A)</enum><text>a description of
				the cost, schedule, and performance of all projects under the project manager’s
				supervision;</text>
								</subparagraph><subparagraph id="ID7ea5273926094fe4aad0a82dbef076b7"><enum>(B)</enum><text>the original and
				current project cost, schedule, and performance benchmarks for each project
				under the project manager’s supervision;</text>
								</subparagraph><subparagraph id="ID9bd2b555f26e4292abad1efb1e4cc412"><enum>(C)</enum><text>the cost,
				schedule, or performance variance related to each IT investment project under
				the project manager’s supervision since the commencement of the
				contract;</text>
								</subparagraph><subparagraph id="ID807ebe4cafef4f9c819313dfcbdd8ae5"><enum>(D)</enum><text>for each project
				under the project manager’s supervision, any known, expected, or anticipated
				changes to project schedule milestones or project performance benchmarks
				included as part of the original or current baseline description; and</text>
								</subparagraph><subparagraph id="id7C58EA72EF4441A3BAC0B6F48797447A"><enum>(E)</enum><text>the current cost,
				schedule, and performance status of all projects under supervision that were
				previously identified as significantly deviated or grossly deviated.</text>
								</subparagraph></paragraph><paragraph id="ID7107a716aee74c22b24c0c7b85278afd"><enum>(2)</enum><header>Interim
				reports</header><text>If the project manager for an IT investment project
				determines that there is reasonable cause to believe that an IT investment
				project has significantly deviated or grossly deviated since the issuance of
				the latest quarterly report, the project manager shall submit to the Chief
				Information Officer, not later than 7 days after such determination, a report
				on the project that includes, as of the date of the report—</text>
								<subparagraph id="ID9e789c6944f34c6b914ab6113c92be90"><enum>(A)</enum><text>a description of
				the original and current program cost, schedule, and performance
				benchmarks;</text>
								</subparagraph><subparagraph id="ID6d3029d04389472b9526ad7950a01e0b"><enum>(B)</enum><text>the cost,
				schedule, or performance variance related to the IT investment project since
				the commencement of the contract;</text>
								</subparagraph><subparagraph id="IDe7980db307fb49d4bf141bcb7ac5c255"><enum>(C)</enum><text>any known,
				expected, or anticipated changes to the project schedule milestones or project
				performance benchmarks included as part of the original or current baseline
				description; and</text>
								</subparagraph><subparagraph id="ID3b6ec101d47d49e38de1594a7048f7b2"><enum>(D)</enum><text>the major reasons
				underlying the significant or gross deviation of the project.</text>
								</subparagraph></paragraph></subsection><subsection id="ID5a1afbc4afa54978a25a33be41cd5321"><enum>(d)</enum><header>Determination of
				significant deviation</header>
							<paragraph id="id6E67C6646CBE4506A6CE4AF390F70E2D"><enum>(1)</enum><header>Chief
				information officer</header><text>Upon receiving a report under subsection (c),
				the Chief Information Officer shall—</text>
								<subparagraph id="id216C9B161D364CA28417D61D66F4CB9C"><enum>(A)</enum><text>determine if any
				IT investment project has significantly deviated; and</text>
								</subparagraph><subparagraph id="id3F715F87413B457292A3AD8590BBA53F"><enum>(B)</enum><text>report such
				determination to the Agency Head.</text>
								</subparagraph></paragraph><paragraph id="id4921711611E44AD0ACB22DBC0A6D6EBF"><enum>(2)</enum><header>Congressional
				notification</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has significantly deviated and the
				Agency Head has not issued a report to the appropriate congressional committees
				of a significant deviation for that project under this section since the
				project was last required to be re-baselined under this section, the Agency
				Head shall submit a report to the appropriate congressional committees and to
				the Government Accountability Office that includes—</text>
								<subparagraph id="id8EDFFFA4274445B4B17A393E187F814D"><enum>(A)</enum><text>written
				notification of such determination;</text>
								</subparagraph><subparagraph id="idE10C9FCDD9024DA687240FEE743690AD"><enum>(B)</enum><text>the date on which
				such determination was made;</text>
								</subparagraph><subparagraph id="id88D6525ADB20459C87A4AB1F4B7F661C"><enum>(C)</enum><text>the amount of the
				cost increases and the extent of the schedule delays with respect to such
				project;</text>
								</subparagraph><subparagraph id="IDab021dbc73f44279b7fe236658e7ad7b"><enum>(D)</enum><text>any requirements
				that—</text>
									<clause id="idF84EAAF4EF9E45DA8E71616AB1396C89"><enum>(i)</enum><text>were added
				subsequent to the original contract; or</text>
									</clause><clause id="id6B79C43A6E7A45EA997996B6921A8E61"><enum>(ii)</enum><text>were originally
				contracted for, but were changed by deferment or deletion from the original
				schedule, or were otherwise no longer included in the requirements contracted
				for;</text>
									</clause></subparagraph><subparagraph id="ID3726fe71197e40c2befa8bfc1ef7904a"><enum>(E)</enum><text>an explanation of
				the differences between—</text>
									<clause id="id91AA421B227F487D8393AC5F59B43A70"><enum>(i)</enum><text>the estimate at
				completion between the project manager, any contractor, and any independent
				analysis; and</text>
									</clause><clause id="id22A088A6D972435F96E15D7EA3AB1540"><enum>(ii)</enum><text>the original
				budget at completion;</text>
									</clause></subparagraph><subparagraph id="ID479d5398ae9c47a0807fe99af998e4fa"><enum>(F)</enum><text>the rough order of
				magnitude of the costs of any reasonable alternative system, or reasonable
				alternative approach to establishing an equivalent outcome or
				capability;</text>
								</subparagraph><subparagraph id="ID4495d2537564403bb0cb4629b18e49bd"><enum>(G)</enum><text>a statement of the
				reasons underlying the project’s significant deviation;</text>
								</subparagraph><subparagraph id="ID384e537bf69448c3942ef32b0de1035b"><enum>(H)</enum><text>the identities of
				the project managers responsible for program management and cost control of the
				program; and</text>
								</subparagraph><subparagraph id="ID47e1564f6bf74d2ca2ebe9a950421fad"><enum>(I)</enum><text>a summary of the
				plan of action to remedy the significant deviation.</text>
								</subparagraph></paragraph><paragraph id="idE6A80D5A59AC4EAF9B7AA8579E0D55E5"><enum>(3)</enum><header>Deadline</header>
								<subparagraph id="id70B87B2230DF4FCBB03361A8BA2427C6"><enum>(A)</enum><header>Notification
				based on quarterly report</header><text>If the determination of significant
				deviation is based on a report submitted under subsection (b)(1), the Agency
				Head shall notify Congress in accordance with paragraph (2) not later than 14
				days after the end of the quarter upon which such report is based.</text>
								</subparagraph><subparagraph id="idBA9FA9955069471DAB53EA4BC33E63C0"><enum>(B)</enum><header>Notification
				based on interim report</header><text>If the determination of significant
				deviation is based on a report submitted under subsection (b)(2), the Secretary
				shall notify Congress in accordance with paragraph (2) not later than 14 days
				after the submission of such report.</text>
								</subparagraph></paragraph></subsection><subsection id="IDe76bf0e165e14c709234e3726233af4a"><enum>(e)</enum><header>Determination of
				gross deviation</header>
							<paragraph id="IDf50be4304ad349dab343a01c5a3e1ade"><enum>(1)</enum><header>Chief
				information officer</header><text>Upon receiving a report under subsection (c),
				the Chief Information Officer shall—</text>
								<subparagraph id="id2EA11EFD1E0142FFAE1FB4C8CFC4733E"><enum>(A)</enum><text>determine if any
				IT investment project has grossly deviated; and</text>
								</subparagraph><subparagraph id="id3613DE4B6A7149E88EB71E9D9ABB8A69"><enum>(B)</enum><text>report any such
				determination to the Agency Head.</text>
								</subparagraph></paragraph><paragraph id="ID30532495a5a44ce4b03c61e2e2f60271"><enum>(2)</enum><header>Congressional
				notification</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has grossly deviated and the Agency
				Head has not issued a report to the appropriate congressional committees of a
				gross deviation for that project under this section since the project was last
				required to be re-baselined under this section, the Agency Head shall submit a
				report to the appropriate congressional committees and to the Government
				Accountability Office that includes—</text>
								<subparagraph id="ID57dc7dbab3c84c84a15c369ca6b11127"><enum>(A)</enum><text>written
				notification of such determination, which states—</text>
									<clause id="id72A4853134AA4821A0A02CC3066C17D2"><enum>(i)</enum><text>the date on which
				such determination was made; and</text>
									</clause><clause id="id7DA8F83FEDA44CD5AEEFFA35FBC31093"><enum>(ii)</enum><text>an indication of
				whether or not the project has been previously reported as a significant or
				gross deviation by the Chief Information Officer, and the date of any such
				report;</text>
									</clause></subparagraph><subparagraph id="ID3a055063229b421bba3c1c0e5f63fa51"><enum>(B)</enum><text>incorporations by
				reference of all prior reports to Congress on the project required under this
				section;</text>
								</subparagraph><subparagraph id="ID5a145e013a6e4ef1b4179acfb5d460ea"><enum>(C)</enum><text>updated accounts
				of the items described in subparagraphs (C) through (H) of subsection
				(d)(2);</text>
								</subparagraph><subparagraph id="ID903bf8d55b03448da962ac90b3815a42"><enum>(D)</enum><text>the original
				estimate at completion for the project manager, any contractor, and any
				independent analysis;</text>
								</subparagraph><subparagraph id="ID67d3b44f998d4f339a4d07c2aeb1e2d6"><enum>(E)</enum><text>a graphical
				depiction of actual cost variance since the commencement of the
				contract;</text>
								</subparagraph><subparagraph id="ID4af56787b067468bb9051f325530d885"><enum>(F)</enum><text>the amount, if
				any, of incentive award fees any contractor has received since the commencement
				of the contract and the reasons for receiving such award fees;</text>
								</subparagraph><subparagraph id="ID5bf0f187d9764ca88856bfc115ce5fd3"><enum>(G)</enum><text>the project
				manager’s estimated cost at completion and estimated completion date for the
				project if current requirements are not modified;</text>
								</subparagraph><subparagraph id="ID6da3f87534f547f6b62a14bb2f9e86a0"><enum>(H)</enum><text>the project
				manager’s estimated cost at completion and estimated completion date for the
				project based on reasonable modification of such requirements;</text>
								</subparagraph><subparagraph id="ID7b0924d5b7fa44e7a0e9a9d04e3537cf"><enum>(I)</enum><text>an explanation of
				the most significant occurrence contributing to the variance identified,
				including cost, schedule, and performance variances, and the effect such
				occurrence will have on future project costs and program schedule;</text>
								</subparagraph><subparagraph id="IDad26b465efe043d28414b57b85127217"><enum>(J)</enum><text>a statement
				regarding previous or anticipated re-baselining or re-planning of the project
				and the names of the individuals responsible for approval;</text>
								</subparagraph><subparagraph id="ID6ff5fb789861459cbdb9a48bdd5d7fcd"><enum>(K)</enum><text>the original life
				cycle cost of the investment and the expected life cycle cost of the investment
				expressed in constant base year dollars and in current dollars; and</text>
								</subparagraph><subparagraph id="IDc67b21025ae9433aab48e2695ab5989f"><enum>(L)</enum><text>a comprehensive
				plan of action to remedy the gross deviation, and milestones established to
				control future cost, schedule, and performance deviations in the future.</text>
								</subparagraph></paragraph><paragraph id="ID04c950b727194a799959c0dab97d65e6"><enum>(3)</enum><header>Remedial
				action</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has grossly deviated, the Agency
				Head, in consultation with the Chief Information Officer, shall ensure
				that—</text>
								<subparagraph id="ID720056d67a084965bb764db5353e35d3"><enum>(A)</enum><text>a report is
				submitted to the appropriate congressional committees that—</text>
									<clause id="IDc708f911741448fc985705b3f7e1e517"><enum>(i)</enum><text>describes the
				primary business case and key functional requirements for the project;</text>
									</clause><clause id="ID31e4bf68de0d4df79ab89d2d4b6dcb2d"><enum>(ii)</enum><text>describes any
				portions of the project that have technical requirements of sufficient clarity
				that such portions may be feasibly procured under firm, fixed-price
				contract;</text>
									</clause><clause id="ID8bdd349e8ff64e9c914a9e27542b3fcf"><enum>(iii)</enum><text>includes a
				certification by the Agency Head, after consultation with the Chief Information
				Officer, that all technical requirements have been reviewed and validated to
				ensure alignment with the reported business case;</text>
									</clause><clause id="ID73462e389b364a9f8102ef2c00649d7b"><enum>(iv)</enum><text>describes any
				changes to the primary business case or key functional requirements which have
				occurred since project inception; and</text>
									</clause><clause id="ID2ff88807f3864f5398afb4358474f3d8"><enum>(v)</enum><text>includes an
				independent cost estimate for the project conducted by an entity approved by
				the Director;</text>
									</clause></subparagraph><subparagraph id="ID3e9436f53cbf4c1bb600a97e627257aa"><enum>(B)</enum><text>an analysis is
				submitted to the appropriate congressional committees that—</text>
									<clause id="ID3edcb6f5ed3e43f2818a29bd3359a76d"><enum>(i)</enum><text>describes agency
				business goals that the project was originally designed to address;</text>
									</clause><clause id="IDffbb3a67d59940e0b3a9ccb4659888dd"><enum>(ii)</enum><text>includes a gap
				analysis of what project deliverables remain in order for the agency to
				accomplish the business goals referred to in clause (i);</text>
									</clause><clause id="IDa76f3bcbab564156a191d3bc2509d4e6"><enum>(iii)</enum><text>identifies the 3
				most cost-effective alternative approaches to the project which would achieve
				the business goals referred to in clause (i); and</text>
									</clause><clause id="ID9756c2c7b2ad49c8a44dffc8638a3b8c"><enum>(iv)</enum><text>includes a
				cost-benefit analysis, which compares—</text>
										<subclause id="id251CE865F33E45EC9EBDF43F63EECAB6"><enum>(I)</enum><text>the completion of
				the project with the completion of each alternative approach, after factoring
				in future costs associated with the termination of the project; and</text>
										</subclause><subclause id="id4383138107114B22B863BB5D15B6947A"><enum>(II)</enum><text>the termination
				of the project without pursuit of alternatives, after factoring in foregone
				benefits; and</text>
										</subclause></clause></subparagraph><subparagraph id="ID36f90aa908b94da98f92428511d9d10d"><enum>(C)</enum><text>a new baseline of
				the project is established that is consistent with the independent cost
				estimate required under subparagraph (A)(v); and</text>
								</subparagraph><subparagraph id="ID275733c1f38448f7a4d34b6e01fff46a"><enum>(D)</enum><text>the project is
				designated as a core IT investment project and subjected to the requirements
				under subsection (f).</text>
								</subparagraph></paragraph><paragraph id="ID8a788f3ac9ac4718a3913b7ca63fb630"><enum>(4)</enum><header>Deadline and
				funding contingency</header>
								<subparagraph id="ID125d6207d3f64b2394812da161341feb"><enum>(A)</enum><header>Notification and
				remedial action based on quarterly report</header>
									<clause id="id41D9AFD3E1754907BB1C8E7CE1CE00E3"><enum>(i)</enum><header>In
				general</header><text>If the determination of gross deviation is based on a
				report submitted under subsection (c)(1), the Agency Head shall—</text>
										<subclause id="idB5D7B49A1D4E4EFF92BF01D293E03F6B"><enum>(I)</enum><text>not later than 45
				days after the end of the quarter upon which such report is based, notify the
				appropriate congressional committees in accordance with paragraph (2);
				and</text>
										</subclause><subclause id="id0767E50284454D83A2696A86D3DECB18"><enum>(II)</enum><text>not later than
				180 days after the end of the quarter upon which such report is based, ensure
				the completion of remedial action under paragraph (3).</text>
										</subclause></clause><clause id="id9327DCD47E6F461F9140A130D914824E"><enum>(ii)</enum><header>Failure to meet
				deadlines</header><text>If the Agency Head fails to meet the deadlines
				described in clause (i)(II), additional funds may not be obligated to support
				expenditures associated with the project until the requirements of this
				subsection have been fulfilled.</text>
									</clause></subparagraph><subparagraph id="IDc9ba9ae5a358434c903f11b1295a2631"><enum>(B)</enum><header>Notification and
				remedial action based on interim report</header>
									<clause id="idC710825CAC04480A936470674CB1408A"><enum>(i)</enum><header>In
				general</header><text>If the determination of gross deviation is based on a
				report submitted under subsection (c)(2), the Secretary shall—</text>
										<subclause id="id436F40AA02754932A369E9E4FDDB5499"><enum>(I)</enum><text>not later than 45
				days after the submission of such report, notify the appropriate congressional
				committees in accordance with paragraph (2); and</text>
										</subclause><subclause id="id2B7FC3D8F8C145B59019C089AFB2A8D4"><enum>(II)</enum><text>not later than
				180 days after the submission of such report, ensure the completion of remedial
				action in accordance with paragraph (3).</text>
										</subclause></clause><clause id="idD2F44AB93A5741DEB51772138B90FEC5"><enum>(ii)</enum><header>Failure to meet
				deadlines</header><text>If the Agency Head fails to meet the deadlines
				described in clause (i)(II), additional funds may not be obligated to support
				expenditures associated with the project until the requirements of this
				subsection have been fulfilled.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID4d9d3ac1f3f34dcb85e2afb198607213"><enum>(f)</enum><header>Additional
				requirements for core IT investment project reports</header>
							<paragraph id="ID0c57600acb374327a3fa89ac5a4f7b1d"><enum>(1)</enum><header>Initial
				report</header><text>If a report described in subsection (e)(3)(A) has not been
				submitted for a core IT investment project, the Agency Head, in coordination
				with the Chief Information Officer and responsible program managers, shall
				prepare an initial report for inclusion in the first budget submitted to
				Congress under section 1105(a) of title 31, United States Code, after the
				designation of a project as a core IT investment project, which
				includes—</text>
								<subparagraph id="ID278e30ea93f64181a97633cdde6a6286"><enum>(A)</enum><text>a description of
				the primary business case and key functional requirements for the
				project;</text>
								</subparagraph><subparagraph id="ID29a82d25dcbc42049badd5d3b90d6aba"><enum>(B)</enum><text>an identification
				and description of any portions of the project that have technical requirements
				of sufficient clarity that such portions may be feasibly procured under firm,
				fixed-price contracts;</text>
								</subparagraph><subparagraph id="IDe54866554969404fadbb00a283b7b7da"><enum>(C)</enum><text>an independent
				cost estimate for the project;</text>
								</subparagraph><subparagraph id="ID1c842a6577c34b88ab3e1bd5aedabbf6"><enum>(D)</enum><text>certification by
				the Chief Information Officer that all technical requirements have been
				reviewed and validated to ensure alignment with the reported business case;
				and</text>
								</subparagraph><subparagraph id="ID87b71cb7a0d04e04b40a2f30f70f1d57"><enum>(E)</enum><text>any changes to the
				primary business case or key functional requirements which have occurred since
				project inception.</text>
								</subparagraph></paragraph><paragraph id="ID21d3bd96ce834bebadaf6ca77b916162"><enum>(2)</enum><header>Quarterly review
				of business case</header><text>The Agency Head, in coordination with the Chief
				Information Officer and responsible program managers, shall—</text>
								<subparagraph id="id76B2E4D5EA8F4CA5B3BBD83110CF0989"><enum>(A)</enum><text>monitor the
				primary business case and core functionality requirements reported to Congress
				for designated core IT investment projects; and</text>
								</subparagraph><subparagraph id="idE13F10559FD546E088DD9DDF1C0E84AE"><enum>(B)</enum><text>if changes to the
				primary business case or key functional requirements for a core IT investment
				project occur in any fiscal quarter, submit a report to Congress not later than
				7 days after the end of such quarter that details the changes and describes the
				impact the changes will have on the cost and ultimate effectiveness of the
				project.</text>
								</subparagraph></paragraph><paragraph id="IDadb3327c20164bb58da7b20055a002b5"><enum>(3)</enum><header>Alternative
				significant deviation determination</header><text>If the Chief Information
				Officer determines, subsequent to a change in the primary business case or key
				functional requirements, that without such change the project would have
				significantly deviated—</text>
								<subparagraph id="idF772D43FA0F445288EBB0511DAD34F0C"><enum>(A)</enum><text>the Chief
				Information Officer shall notify the Agency Head of the significant deviation;
				and</text>
								</subparagraph><subparagraph id="id95D548A6BD304849977C4E6FA46EC7F9"><enum>(B)</enum><text>the Agency Head
				shall fulfill the requirements under subsection (d)(2) in accordance with the
				deadlines under subsection (d)(3).</text>
								</subparagraph></paragraph><paragraph id="IDf02f9ad2288b497cb1c3ee6eca793bd0"><enum>(4)</enum><header>Alternative
				gross deviation determination</header><text>If the Chief Information Officer
				determines, subsequent to a change in the primary business case or key
				functional requirements, that without such change the project would have
				grossly deviated—</text>
								<subparagraph id="id5218864EF3A0471B9923399DD33B5BC2"><enum>(A)</enum><text>the Chief
				Information Officer shall notify the Agency Head of the gross deviation;
				and</text>
								</subparagraph><subparagraph id="idEBB8B44063DF4653BDAB7A2302F229F2"><enum>(B)</enum><text>the Agency Head
				shall fulfill the requirements under subsections (e)(2) and (e)(3) in
				accordance with subsection
				(e)(4).</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDb8b785de2f0b4dcab2b6caacb9940cf0"><enum>(b)</enum><header>Inclusion in the
			 budget submitted to congress</header><text>Section 1105(a) of title 31, United
			 States Code, is amended—</text>
				<paragraph id="IDca7a1f85e5244c05ad96cd95ad1d20ab"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>include in each budget the
			 following:</quote> and inserting <quote>include in each budget—</quote>;</text>
				</paragraph><paragraph id="idC6A6B78CFF8D4B2B988578A2B6DB5A48"><enum>(2)</enum><text>by redesignating
			 the second paragraph (33) (as added by section 889(a) of Public Law 107–296) as
			 paragraph (35);</text>
				</paragraph><paragraph id="id4127DC015A14417BA293B434866A07F0"><enum>(3)</enum><text>in each of
			 paragraphs (1) through (34), by striking the period at the end and inserting a
			 semicolon;</text>
				</paragraph><paragraph id="ID063d30564e914e3b8283e0f8aca0cc82"><enum>(4)</enum><text>in paragraph (35)
			 (as redesignated by paragraph (2)), by striking the period at the end and
			 inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="IDdf23e321a829460198c3889a218fb3fa"><enum>(5)</enum><text>by adding at the
			 end the following:</text>

				</paragraph></subsection><subsection id="IDacc5a248f1784f57bb1b35bb5983e3ad"><enum>(c)</enum><header>Improvement of
			 information technology acquisition and development</header><text>Subchapter II
			 of chapter 113 of title 40, United States Code, is amended by adding at the end
			 the following:</text>
				<quoted-block changed="deleted" committee-id="SSAP00" display-inline="no-display-inline" id="id8BD19BABACC34195A38CB19CA04BC24B" reported-display-style="strikethrough" style="OLC">
					<section id="id43F86BD90D6F474A95038D0FAF7084BF"><enum>11319.</enum><header>Acquisition
				and development</header>
						<subsection id="IDb6244787be4d4dd39b21a505ce91c703"><enum>(a)</enum><header>Establishment of
				programs</header><text>Not later than 120 days after the date of the enactment
				of this section, each Agency Head (as defined in section 11317(a) of title 49,
				United States Code) shall establish a program to improve the information
				technology (referred to in this section as <quote>IT</quote>) processes of the
				agency overseen by the Agency Head.</text>
						</subsection><subsection id="ID659958275d344aaebcfcccb5246303c7"><enum>(b)</enum><header>Program
				requirements</header><text>Each program established pursuant to this section
				shall include—</text>
							<paragraph id="ID1b6fc03d7ac74bac82b9ebc8afa20a1b"><enum>(1)</enum><text>a documented
				process for information technology acquisition planning, requirements
				development and management, project management and oversight, earned-value
				management, and risk management;</text>
							</paragraph><paragraph id="IDb2725543aa8c4f43aa4cb4e60502bc58"><enum>(2)</enum><text>the development of
				appropriate metrics for performance measurement of—</text>
								<subparagraph id="id9BECFA0310964AAEBB89D0B43F8D69BC"><enum>(A)</enum><text>processes and
				development status; and</text>
								</subparagraph><subparagraph id="idB517970B7B934FC5B3E898883EB526CB"><enum>(B)</enum><text>continuous process
				improvement;</text>
								</subparagraph></paragraph><paragraph id="IDe5d2e8ba2db14d7ab5d04aed2e805d71"><enum>(3)</enum><text>a process to
				ensure that key program personnel have an appropriate level of experience or
				training in the planning, acquisition, execution, management, and oversight of
				information technology; and</text>
							</paragraph><paragraph id="ID2dde163733984381822f4bed7768170b"><enum>(4)</enum><text>a process to
				ensure that the applicable department and subcomponents implement and adhere to
				established processes and requirements relating to the planning, acquisition,
				execution, management, and oversight of information technology programs and
				developments.</text>
							</paragraph></subsection><subsection id="IDf3597b963e2c4b7ebff7e5d786e924d8"><enum>(c)</enum><header>OMB
				Guidance</header><text>The Director of the Office of Management and Budget
				shall—</text>
							<paragraph id="ID0900ee75e44346049992ef7a0fa2a390"><enum>(1)</enum><text>prescribe
				uniformly applicable guidance to the administration of all the programs
				established under subsection (a); and</text>
							</paragraph><paragraph id="idC4D400FF774440D4AF7C4019FEBF365C"><enum>(2)</enum><text>take any actions
				that are necessary to ensure that Federal agencies comply with the
				guidance.</text>
							</paragraph></subsection><subsection id="id2263B0A6CB9F4B81AAD807D7F3DDFD76"><enum>(d)</enum><header>Annual report to
				Congress</header><text>Not later than the last day of February of each year,
				the Agency Head shall submit a report to Congress that includes—</text>
							<paragraph id="IDc8e6edc894e24ee9ae31de17a05acd70"><enum>(1)</enum><text>a detailed summary
				of the accomplishments of the program established by the Agency Head pursuant
				to this section;</text>
							</paragraph><paragraph id="ID6249156055d24a17ac765a51242d78e1"><enum>(2)</enum><text>the status of
				completeness of implementation of each of the program requirements, and the
				date each such requirement was deemed to be completed;</text>
							</paragraph><paragraph id="IDef72a7bfe6bc48548e41dd21e2d94e16"><enum>(3)</enum><text>the percentage of
				Federal IT projects covered under the program compared to all of the IT
				projects of the agency, listed by number of programs and by annual dollars
				expended;</text>
							</paragraph><paragraph id="ID25784a7927d84f79b7f1d589143461ce"><enum>(4)</enum><text>the
				identification, listed by name and position, of—</text>
								<subparagraph id="id4F8F330E7FBA43048AF4879CB08339FB"><enum>(A)</enum><text>the person
				assigned responsibility for implementation and management of the program and
				the percent of such person’s time used to carry out such responsibility;
				and</text>
								</subparagraph><subparagraph id="id65D193B0C5224B67894BEA04664747D8"><enum>(B)</enum><text>the person to whom
				the person described in subparagraph (A) reports;</text>
								</subparagraph></paragraph><paragraph id="IDa9d5a62a49764d89b9a924c9edba2efe"><enum>(5)</enum><text>a detailed
				breakdown of the sources and uses of the amounts spent by the agency during the
				previous fiscal year to support the activities of the program;</text>
							</paragraph><paragraph id="IDd13cdfb97a104b09b49dd3877e879c08"><enum>(6)</enum><text>a copy of any
				guidance issued under the program and a statement regarding whether each such
				guidance is mandatory;</text>
							</paragraph><paragraph id="ID3485a5c801954c8d876678aa950212e4"><enum>(7)</enum><text>the identification
				of the metrics developed in accordance with subsection (b)(2);</text>
							</paragraph><paragraph id="ID16272c9d7fc941e28ab507e9f9190ce5"><enum>(8)</enum><text>a description of
				how paragraphs (3) and (4) of subsection (b) have been implemented and any
				related agency guidance; and</text>
							</paragraph><paragraph id="IDabdad79d312d4498a1a5b3e3afab103a"><enum>(9)</enum><text>a description of
				how continuous process improvement has been implemented and the objectives of
				such
				guidance.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id16ADFFADC97243BD85D525E6983DCA6D"><enum>(d)</enum><header>Clerical
			 amendments</header><text>The table of sections for chapter 113 of title 40,
			 United States Code, is amended—</text>
				<paragraph id="idF561107E9C4A4EEB92DC622568691920"><enum>(1)</enum><text>by striking the

			 Force</header>
			<subsection id="ID3a7182ca60c745f2af8746d7ecb82e61"><enum>(a)</enum><header>Purpose</header><text>The
			 Director of the Office of Management of Budget (referred to in this section as
			 the <quote>Director</quote>), in consultation with the Administrator of the
			 Office of Electronic Government and Information and Technology at the Office of
			 Management and Budget (referred to in this section as the <quote>E-Gov
			 Administrator</quote>), shall assist agencies in avoiding significant and gross
			 deviations in the cost, schedule, and performance of IT investment projects (as
			 such terms are defined in section 11317(a) of title 40, United States
			 Code).</text>
			</subsection><subsection id="ID7883a74f751644cdb26b3e898cb6c0a5"><enum>(b)</enum><header>IT Strike
			 Force</header>
				<paragraph id="id4D97CAF4C39A4CF9BFE31A46DBDB58BF"><enum>(1)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the E-Gov
			 Administrator shall establish a small group of individuals (referred to in this
			 section as the <quote>IT Strike Force</quote>) to carry out the purpose
			 described in subsection (a).</text>
				</paragraph><paragraph id="IDf1836c24bdd54601a30209b49b45d443"><enum>(2)</enum><header>Qualifications</header><text>Individuals
			 selected for the IT Strike Force—</text>
					<subparagraph id="idBD173D132CBC4D85B23881E3687B1F30"><enum>(A)</enum><text>shall be certified
			 at the Senior/Expert level according to the Federal Acquisition Certification
			 for Program and Project Managers (FAC–P/PM); or</text>
					</subparagraph><subparagraph id="id2934AD8195674B7F82E6154650E0AFA3"><enum>(B)</enum><text>shall have
			 comparable education, certification, training, and experience to successfully
			 manage high-risk IT investment projects.</text>
					</subparagraph></paragraph><paragraph id="ID734abe96129e45ca9c6a339529b03119"><enum>(3)</enum><header>Number</header><text>The
			 Director, in consultation with the E-Gov Administrator, shall determine the
			 number of individuals who will be selected for the IT Strike Force.</text>
				</paragraph></subsection><subsection id="ID327374d97baf4eee928219795f11127d"><enum>(c)</enum><header>Outside
			 consultants</header>
				<paragraph id="id51F3B804EB364EEAB0B752165872E234"><enum>(1)</enum><header>Identification</header><text>The
			 E-Gov Administrator shall identify consultants in the private sector who have
			 expert knowledge in IT program management and program management review teams.
			 Not more than 20 percent of such consultants may be formally associated with
			 any 1 of the following types of entities:</text>
					<subparagraph id="IDd95f83f2fffc480c91ed367884b7062e"><enum>(A)</enum><text>Commercial
			 firms.</text>
					</subparagraph><subparagraph id="IDd14bf7aed1c94c06902ae4ae5335e259"><enum>(B)</enum><text>Nonprofit
			 entities.</text>
					</subparagraph><subparagraph id="ID95c26641bd00426a9abab5f6593bd008"><enum>(C)</enum><text>Research and
			 development corporations receiving Federal financial assistance.</text>
					</subparagraph></paragraph><paragraph id="ID4f35866b509d4ce484c6442f8de10ef5"><enum>(2)</enum><header>Use of
			 consultants</header>
					<subparagraph id="idAABA175652E14511B96D9B65BA3B6651"><enum>(A)</enum><header>In
			 general</header><text>Consultants identified under paragraph (1) may be used to
			 assist the IT Strike Force in assessing and improving IT investment
			 projects.</text>
					</subparagraph><subparagraph id="idED5AB49759EC4C3EB677B0987DAD35B6"><enum>(B)</enum><header>Limitation</header><text>Consultants
			 with a formally established relationship with an organization may not
			 participate in any assessment involving an IT investment project for which such
			 organization is under contract to provide technical support.</text>
					</subparagraph><subparagraph id="id062C15E7859E40A291C3D87FF712EA92"><enum>(C)</enum><header>Exception</header><text>The
			 limitation described in subparagraph (B) may not be construed as precluding
			 access to anyone having relevant information helpful to the conduct of the
			 assessment.</text>
					</subparagraph></paragraph><paragraph id="ID677d1bf91dec4479adc356a1bbdf7055"><enum>(3)</enum><header>Contracts</header><text>The
			 E-Gov Administrator, in conjunction with the Administrator of the General
			 Services Administration (GSA), may establish competitively bid contracts with 1
			 or more qualified consultants, independent of any GSA schedule.</text>
				</paragraph></subsection><subsection id="ID1f81641325d44e67b28e773ff5260c1a"><enum>(d)</enum><header>Initial response
			 to anticipated significant or gross deviation</header><text>If the E-Gov
			 Administrator determines there is reasonable cause to believe that a major IT
			 investment project is likely to significantly or grossly deviate (as defined in
			 section 11317(a) of title 40, United States Code), including the receipt of
			 inconsistent or missing data, the E-Gov Administrator shall carry out the
			 following activities:</text>
				<paragraph id="ID517f174dd0b04253b6adff394c80db39"><enum>(1)</enum><text>Recommend the
			 assignment of 1 or more members of the IT Strike Force to assess the project in
			 accordance with the scope and time period described in section 11317(c)(1) of
			 title 40, United States Code, beginning not later than 7 days after such
			 recommendation. No member of the Strike Force who is associated with the
			 department or agency whose IT investment project is the subject of the
			 assessment may be assigned to participate in this assessment. Such limitation
			 may not be construed as precluding access to anyone having relevant information
			 helpful to the conduct of the assessment.</text>
				</paragraph><paragraph id="ID1020f2bdf944437883f9ec376d74685c"><enum>(2)</enum><text>If the E-Gov
			 Administrator determines that 1 or more qualified consultants are needed to
			 support the efforts of the IT Strike Force under paragraph (1), negotiate a
			 contract with the consultant to provide such support during the period in which
			 the IT Strike Force is conducting the assessment described in paragraph
			 (1).</text>
				</paragraph><paragraph id="IDa27aea8bc5d442dc9a23cf2f2952a702"><enum>(3)</enum><text>Ensure that the
			 costs of an assessment under paragraph (1) and the support services of 1 or
			 more consultants under paragraph (2) are paid by the major IT investment
			 project being assessed.</text>
				</paragraph><paragraph id="ID2a0016d997034b789ee4e56dd8fefab2"><enum>(4)</enum><text>Monitor the
			 progress made by the IT Strike Force in assessing the project.</text>
				</paragraph></subsection><subsection id="IDd433a849fbde4221ae759a5eee7e9858"><enum>(e)</enum><header>Reduction of
			 significant or gross deviation</header><text>If the E-Gov Administrator
			 determines that the assessment conducted under subsection (d) confirms that a
			 major IT investment project is likely to significantly or grossly deviate, the
			 E-Gov Administrator shall recommend that the Agency Head (as defined in section
			 11317(a)(1) of title 40, United States Code) take steps to reduce the
			 deviation, which may include—</text>
				<paragraph id="ID1ea03a7378904285ad52e858ad783883"><enum>(1)</enum><text>providing training
			 or mentoring to improve the qualifications of the program manager;</text>
				</paragraph><paragraph id="IDcfd5717704464a9faefb0f1eb90b02eb"><enum>(2)</enum><text>replacing the
			 program manager or other staff;</text>
				</paragraph><paragraph id="ID0865b331b1da464795e654bf2af529f9"><enum>(3)</enum><text>supplementing the
			 program management team with Federal Government employees or independent
			 contractors;</text>
				</paragraph><paragraph id="ID282c866191c34b14aa41bf01d2e1252a"><enum>(4)</enum><text>terminating the
			 project; or</text>
				</paragraph><paragraph id="ID0942cdd0c2604707b0ec8f89837698b7"><enum>(5)</enum><text>hiring an
			 independent contractor to report directly to senior management and the E-Gov
			 Administrator.</text>
				</paragraph></subsection><subsection id="IDb7d9e6a8e7574bb880fd78537d91b03d"><enum>(f)</enum><header>Reprogramming of
			 funds</header>
				<paragraph id="id8603E78895B243D799A2ED780245E473"><enum>(1)</enum><header>Authorization</header><text>The
			 Director may direct an Agency Head to reprogram amounts which have been
			 appropriated for such agency to pay for an assessment under subsection
			 (d).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID40d90302b2474b3baf901cf114d764e1"><enum>(2)</enum><header>Notification</header><text>An
			 Agency Head who reprograms appropriations under paragraph (1) shall notify the
			 <committee-name added-display-style="italic" committee-id="SSAP00" deleted-display-style="strikethrough">Committee on Appropriations of the
			 Senate</committee-name> and the <committee-name committee-id="">Committee on
			 Appropriations of the House of Representatives</committee-name> of any such
			 reprogramming.</text>
				</paragraph></subsection><subsection id="ID3dcf153406914d20910b91e0e2ed2407"><enum>(g)</enum><header>Report to
			 Congress</header><text>The Director shall include in the annual Report to
			 Congress on the Benefits of E-Government Initiatives a detailed summary of the
			 composition and activities of the IT Strike Force, including—</text>
				<paragraph id="IDdf89706d10e746f6be917730979e8a14"><enum>(1)</enum><text>the number and
			 qualifications of individuals on the IT Strike Force;</text>
				</paragraph><paragraph id="ID9e2b51f412ff4f3196ce9d6e1993485d"><enum>(2)</enum><text>a description of
			 the IT investment projects that the IT Strike Force has worked during the
			 previous fiscal year;</text>
				</paragraph><paragraph id="IDad1a8cb916c249738fcdd449f6fdcb0f"><enum>(3)</enum><text>the major issues
			 that necessitated the involvement of the IT Strike Force to assist agencies
			 with assessing and managing IT investment projects and whether such issues were
			 satisfactorily resolved;</text>
				</paragraph><paragraph id="id6FAFFA9DB33C46E3826249A5325DFB01"><enum>(4)</enum><text>if the issues
			 referred to in paragraph (3) were not satisfactorily resolved, the issues still
			 needed to be resolved and the Agency Head’s plan for resolving such
			 issues;</text>
				</paragraph><paragraph id="id599E1E1186D74AD3A2A2933D8855B306"><enum>(5)</enum><text>a detailed
			 breakdown of the sources and uses of the amounts spent by the Office of
			 Management and Budget and other Federal agencies during the previous fiscal
			 year to support the activities of the IT Strike Force; and</text>
				</paragraph><paragraph id="IDb1c86a005d5c470398f2589733f9b774"><enum>(6)</enum><text>a determination of
			 whether the IT Strike Force has been effective in reducing the amount of IT
			 investment projects that deviate or significantly deviate.</text>
				</paragraph></subsection></section></legis-body>

			 Oversight Enhancement and Waste Prevention Act of
			 2008</short-title></quote>.</text>

			 deviations</header><text>Section 11317 of title 40, United States Code, is
			 amended to read as follows:</text>

						<subsection id="idfb688b1a-2083-4328-bddc-5686dd6a986e"><enum>(a)</enum><header>Definitions</header><text>In
				this subchapter:</text>
							<paragraph id="idfae006d6-f298-44a9-9860-febf1ca89a3e"><enum>(1)</enum><header>Agency
				head</header><text>The term <term>Agency Head</term> means the head of the
				Federal agency that is primarily responsible for the IT investment project
				under review.</text>
							</paragraph><paragraph commented="no" id="id670bed82-249a-46ec-9642-94367c3f2fc5"><enum>(2)</enum><header>ANSI EIA–748–B
				standard</header><text>The term <term>ANSI EIA–748–B Standard</term> means the
				measurement tool jointly developed by the American National Standards Institute
				and the Electronic Industries Alliance to analyze Earned Value Management
				systems.</text>
							</paragraph><paragraph id="id7227fafe-a613-4448-a29e-9c4dc9ec0684"><enum>(3)</enum><header>Appropriate
				congressional committees</header><text>The term <quote>appropriate
				congressional committees</quote> means—</text>
								<subparagraph id="id93010c40-7e79-4e41-a72b-bb173f678464"><enum>(A)</enum><text>the
				<committee-name committee-id="SSGA00">Committee on Homeland Security and
				Governmental Affairs of the Senate</committee-name>;</text>
								</subparagraph><subparagraph id="ide0955a06-a93c-422b-bd46-4fa761f3b60c"><enum>(B)</enum><text>the
				<committee-name committee-id="">Committee on Oversight and Government Reform of
				the House of Representatives</committee-name>;</text>
								</subparagraph><subparagraph id="id21ca75b9-dcc0-46bd-92a5-8efd2af2246a"><enum>(C)</enum><text>the
				<committee-name committee-id="SSAP00">Committee on Appropriations of the
				Senate</committee-name>;</text>
								</subparagraph><subparagraph id="id6a0e9bc0-5865-4217-9ae3-6df871bb4cfc"><enum>(D)</enum><text>the
				<committee-name committee-id="">Committee on Appropriations of the House of
				Representatives</committee-name>; and</text>
								</subparagraph><subparagraph id="id1a9a5c12-d7fe-4337-a510-995c683ce19b"><enum>(E)</enum><text>any other relevant
				congressional committee with jurisdiction over an agency required to take
				action under this section.</text>
								</subparagraph></paragraph><paragraph id="id61476f19-1dd4-4604-a75c-0a7a29e24cd7"><enum>(4)</enum><header>Chief information
				officer</header><text>The term <term>Chief Information Officer</term> means the
				Chief Information Officer designated under section 3506(a)(2) of title 44 of
				the Federal agency that is primarily responsible for the IT investment project
				under review.</text>
							</paragraph><paragraph id="id5b53e2f9-236e-459b-b23e-1e6ec68b20ff"><enum>(5)</enum><header>Core IT investment
				project</header><text>The terms <term>core IT investment project</term> and
				<term>core project</term> mean a mission critical IT investment project
				designated as such by the Chief Information Officer, with approval by the
				Agency Head under subsection (b).</text>
							</paragraph><paragraph id="id105ee787-9888-4cad-86e1-265dd8283875"><enum>(6)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Office of Management and
				Budget.</text>
							</paragraph><paragraph id="id977DFA02DF6942CBBB3B4FBD99F6AD0D"><enum>(7)</enum><header>Earned value
				management</header><text>The term <term>Earned Value Management</term> means
				the cost, performance, and schedule data used to determine project status and
				developed in accordance with the ANSI EIA–748–B standard.</text>
							</paragraph><paragraph id="idb6bb6e16-61a8-4767-ae6a-7f3cd34dc1f5"><enum>(8)</enum><header>Grossly
				deviated</header><text>The term <term>grossly deviated</term> means cost,
				schedule, or performance variance that is at least 40 percent from the Original
				Baseline.</text>
							</paragraph><paragraph id="ide8c6b81d-a178-41cd-a3e7-2abb8783e05f"><enum>(9)</enum><header>Independent government
				cost estimate</header><text>The term <term>independent government cost
				estimate</term> means a pragmatic and neutral analysis, assessment, and
				quantification of all costs and risks associated with the acquisition of an IT
				investment project, which—</text>
								<subparagraph id="id56eb1279-ec72-4c91-9ad6-cfadb8d460db"><enum>(A)</enum><text>is based on programmatic
				and technical specifications provided by the office within the agency with
				primary responsibility for the development, procurement, and delivery of the
				project;</text>
								</subparagraph><subparagraph id="id7f852ccc-13f9-4fd4-a710-21eee3a6f6d8"><enum>(B)</enum><text>is formulated and
				provided by an entity other than the office within the agency with primary
				responsibility for the development, procurement, and delivery of the
				project;</text>
								</subparagraph><subparagraph id="idc8d94c14-d93f-4464-85b4-6d477e1d74e0"><enum>(C)</enum><text>contains sufficient
				detail to inform the selection of an Earned Value Management baseline benchmark
				measure under the ANSI EIA–748–B standard; and</text>
								</subparagraph><subparagraph id="id874673b5-a91f-42b7-9572-fe9314210ee0"><enum>(D)</enum><text>accounts for the full
				life cycle cost plus associated operations and maintenance expenses over the
				usable life of the project’s deliverables.</text>
								</subparagraph></paragraph><paragraph id="id0b885047-3b5d-4f73-8b3e-794c83624025"><enum>(10)</enum><header>IT investment
				project</header><text>The terms <term>IT investment project</term> and
				<term>project</term> mean an information technology system or acquisition
				that—</text>
								<subparagraph id="idcc403b0b-a9a2-448f-8c28-9616f3d8976a"><enum>(A)</enum><text>requires special
				management attention because of its importance to the mission or function of
				the agency, a component of the agency, or another organization;</text>
								</subparagraph><subparagraph id="id0dfddfc7-be48-42ef-a178-6ee2e9cc48eb"><enum>(B)</enum><text>is for financial
				management and obligates more than $500,000 annually;</text>
								</subparagraph><subparagraph id="id9347f739-f87c-4751-9f83-2ae50b2b3465"><enum>(C)</enum><text>has significant program
				or policy implications;</text>
								</subparagraph><subparagraph id="id0b28e8d4-1b1f-4f49-a3bb-0f02c601082f"><enum>(D)</enum><text>has high executive
				visibility;</text>
								</subparagraph><subparagraph id="idd529f691-ff75-4a88-91c8-dc0811e28dcf"><enum>(E)</enum><text>has high development,
				operating, or maintenance costs;</text>
								</subparagraph><subparagraph id="id6960b79d-c0f6-42e1-a5af-322f7edbb2c1"><enum>(F)</enum><text>is funded through other
				than direct appropriations; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2c27280-7fb2-4577-840a-e92db724a6e0"><enum>(G)</enum><text>is defined as major by
				the agency’s capital planning and investment control process.</text>
								</subparagraph></paragraph><paragraph id="iddf1a8931-2ad1-4535-b3b4-eb45ff69ca71"><enum>(11)</enum><header>Life cycle
				cost</header><text>The term <term>life cycle cost</term> means the total cost
				of an IT investment project for planning, research and development,
				modernization, enhancement, operation, and maintenance.</text>
							</paragraph><paragraph id="id74148f2e-da6e-402f-82f7-2736d368027e"><enum>(12)</enum><header>Original
				baseline</header>
								<subparagraph id="idd0e2eee1-7756-4bd3-a06d-ababa4efb55b"><enum>(A)</enum><header>In
				general</header><text>Except as provided under subparagraph (B), the term
				<term>Original Baseline</term> means the ANSI EIA–748–B Standard-compliant
				Earned Value Management benchmark established at the commencement of an IT
				investment project.</text>
								</subparagraph><subparagraph id="id9b5bf29f-2cab-40dc-9e68-a6ebf8cc6982"><enum>(B)</enum><header>Grossly deviated
				project</header><text>If an IT investment project grossly deviates from its
				Original Baseline (as defined in subparagraph (A)), the term <term>Original
				Baseline</term> means the ANSI EIA–748–B Standard-compliant Earned Value
				Management benchmark established under subsection (e)(3)(C).</text>
								</subparagraph></paragraph><paragraph id="ida67380a6-a252-4c21-9281-a737547549c1"><enum>(13)</enum><header>Significantly
				deviated</header><text>The term <term>significantly deviated</term> means
				Earned Value Management variance that is at least 20 percent from the Original
				Baseline.</text>
							</paragraph></subsection><subsection id="iddf509f21-9942-4940-a7d6-ab4644cd3524"><enum>(b)</enum><header>Core IT investment
				projects designation</header><text>Except as provided under paragraph (2), each
				Chief Information Officer, with approval by the Agency Head, shall—</text>
							<paragraph id="id7B26568D6A1D4A11A9642B34AA0F05B5"><enum>(1)</enum><text>identify the major IT
				investments that are the most critical to the agency; and</text>
							</paragraph><paragraph id="id544C1046EB264E0CA96F56BA8F12768F"><enum>(2)</enum><text>designate those most
				mission critical IT investment projects as <quote>core IT investment
				projects</quote> or <quote>core projects</quote>, after considering, among
				other factors—</text>
								<subparagraph id="ida6667a04-b487-4df0-a062-7c8a0042f717"><enum>(A)</enum><text>whether the project
				represents a significant high-dollar value relative to the average IT
				investment project in the agency’s portfolio;</text>
								</subparagraph><subparagraph id="idf1d21fa2-06b2-4cae-b7e1-9c305ee6cece"><enum>(B)</enum><text>whether the project
				delivers a capability critical to the successful completion of the agency
				mission, or a portion of such mission;</text>
								</subparagraph><subparagraph id="id2a3c0c09-eed3-447f-b3fe-c9ec1a1e224c"><enum>(C)</enum><text>whether the project
				incorporates unproven or previously undeveloped technology to meet primary
				project technical requirements; or</text>
								</subparagraph><subparagraph id="id805B0C23AE59429AACF9E642AF161A71"><enum>(D)</enum><text>whether the project would
				have a significant negative impact on the successful completion of the agency
				mission if the project experienced significant cost, schedule, or performance
				deviations.</text>
								</subparagraph></paragraph></subsection><subsection id="idc095cf1b-73d4-4a0a-bfbf-2df7b55e3be0"><enum>(c)</enum><header>Cost, schedule, and
				performance reports</header>
							<paragraph id="id0886fa6d-a21e-4c67-b58c-fc87a9a69d80"><enum>(1)</enum><header>Quarterly
				reports</header><text>Not later than 14 days after the end of each fiscal
				quarter, the project manager for an IT investment project shall submit a
				written report to the Chief Information Officer that includes, as of the last
				day of the applicable quarter—</text>
								<subparagraph id="id6e17552a-e0cf-45b6-b4e6-8b2f24bd1277"><enum>(A)</enum><text>a description of the
				cost, schedule, and performance of all projects under the project manager’s
				supervision;</text>
								</subparagraph><subparagraph id="id0f7247ff-0cbf-4b04-ab73-4c67d46a2765"><enum>(B)</enum><text>the original and current
				project cost, schedule, and performance benchmarks for each project under the
				project manager’s supervision;</text>
								</subparagraph><subparagraph id="id8dea81d8-00b2-40ee-99a0-2a27a354dc40"><enum>(C)</enum><text>the quarterly and
				cumulative cost, schedule, and performance variance related to each IT
				investment project under the project manager’s supervision since the
				commencement of the project;</text>
								</subparagraph><subparagraph id="id227be141-86df-44ee-adf7-3e45b7a08300"><enum>(D)</enum><text>for each project under
				the project manager’s supervision, any known, expected, or anticipated changes
				to project schedule milestones or project performance benchmarks included as
				part of the original or current baseline description;</text>
								</subparagraph><subparagraph id="iddfe26cee-e655-4de7-a90b-863429ff0886"><enum>(E)</enum><text>the current cost,
				schedule, and performance status of all projects under supervision that were
				previously identified as significantly deviated or grossly deviated; and</text>
								</subparagraph><subparagraph id="id1F01F04360F84FEDA185719BB5CE3633"><enum>(F)</enum><text>any corrective actions
				taken to address problems discovered under subparagraphs (C) through
				(E).</text>
								</subparagraph></paragraph><paragraph id="id0c3ccffe-504d-44d5-b838-22605ef3562d"><enum>(2)</enum><header>Interim
				reports</header><text>If the project manager for an IT investment project
				determines that there is reasonable cause to believe that an IT investment
				project has significantly deviated or grossly deviated since the issuance of
				the latest quarterly report, the project manager shall submit to the Chief
				Information Officer, not later than 14 days after such determination, a report
				on the project that includes, as of the date of the report—</text>
								<subparagraph id="id2e227dc4-646e-49ea-9b80-bab20518cd57"><enum>(A)</enum><text>a description of the
				original and current program cost, schedule, and performance benchmarks;</text>
								</subparagraph><subparagraph id="id98659d12-1372-4b00-bf6d-e5ff11ff5fde"><enum>(B)</enum><text>the cost, schedule, or
				performance variance related to the IT investment project since the
				commencement of the project;</text>
								</subparagraph><subparagraph id="id94f605a1-ab60-484b-8b05-16687c109e14"><enum>(C)</enum><text>any known, expected, or
				anticipated changes to the project schedule milestones or project performance
				benchmarks included as part of the original or current baseline
				description;</text>
								</subparagraph><subparagraph id="id3879ab6f-b366-4e8f-80a6-1c941102fead"><enum>(D)</enum><text>the major reasons
				underlying the significant or gross deviation of the project; and</text>
								</subparagraph><subparagraph id="idF40E15EF071440C783EFBA44C0AB8F40"><enum>(E)</enum><text>a corrective action plan
				to correct such deviations.</text>
								</subparagraph></paragraph></subsection><subsection id="id62613e49-5f30-41f8-9011-9b2ccea03363"><enum>(d)</enum><header>Determination of
				significant deviation</header>
							<paragraph id="idb69cebca-7b6f-4f46-a0d2-a4ff938753bd"><enum>(1)</enum><header>Chief information
				officer</header><text>Upon receiving a report under subsection (c), the Chief
				Information Officer shall—</text>
								<subparagraph id="id33c9914e-1fb4-4f70-9e5e-54a2b266362d"><enum>(A)</enum><text>determine if any IT
				investment project has significantly deviated; and</text>
								</subparagraph><subparagraph id="ide7e66b1a-9b44-46ce-b34b-8539a18a0a71"><enum>(B)</enum><text>report such determination
				to the Agency Head.</text>
								</subparagraph></paragraph><paragraph id="iddc88695a-2c43-4e32-aa9a-bdb0ae04a0cd"><enum>(2)</enum><header>Congressional
				notification</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has significantly deviated and the
				Agency Head has not issued a report to the appropriate congressional committees
				of a significant deviation for that project under this section since the
				project was last required to be re-baselined under this section, the Agency
				Head shall submit a report to the appropriate congressional committees, the
				Director, and the Government Accountability Office that includes—</text>
								<subparagraph id="id73808021-8ae0-4ed6-8276-ae36f9ad39ca"><enum>(A)</enum><text>written notification of
				such determination;</text>
								</subparagraph><subparagraph id="id53ba3216-76d5-4ecd-87b2-25ca55273776"><enum>(B)</enum><text>the date on which such
				determination was made;</text>
								</subparagraph><subparagraph id="idb1d6e5bd-02cc-4d81-a1c3-df9711f47670"><enum>(C)</enum><text>the amount of the cost
				increases and the extent of the schedule delays with respect to such
				project;</text>
								</subparagraph><subparagraph id="id4ff41262-d16c-48f3-864d-7baf4c6563e1"><enum>(D)</enum><text>any requirements
				that—</text>
									<clause id="id50d1d8fe-6b34-4b20-b8ff-7cf6ad98b0ff"><enum>(i)</enum><text>were added subsequent to
				the original contract; or</text>
									</clause><clause id="id487f9ee8-f494-4c6a-9e47-4887ee07c364"><enum>(ii)</enum><text>were originally
				contracted for, but were changed by deferment or deletion from the original
				schedule, or were otherwise no longer included in the requirements contracted
				for;</text>
									</clause></subparagraph><subparagraph id="id7bc74de6-9aa7-4f3c-a433-61354d504422"><enum>(E)</enum><text>an explanation of the
				differences between—</text>
									<clause id="id962bbe20-3126-4d8c-a68a-986ff42c35ef"><enum>(i)</enum><text>the estimate at
				completion between the project manager, any contractor, and any independent
				analysis; and</text>
									</clause><clause id="ide8754c57-02da-440c-b950-34aa130e6fb1"><enum>(ii)</enum><text>the original budget at
				completion;</text>
									</clause></subparagraph><subparagraph id="id472fe769-d115-4242-8e38-759f15af69cb"><enum>(F)</enum><text>a statement of the
				reasons underlying the project’s significant deviation; and</text>
								</subparagraph><subparagraph id="id0fc41d42-7911-4264-8ade-b3bcf4d4d18e"><enum>(G)</enum><text>a summary of the plan of
				action to remedy the significant deviation.</text>
								</subparagraph></paragraph><paragraph id="id1b37a836-52f6-40d6-b916-903cf4cb3b59"><enum>(3)</enum><header>Deadline</header>
								<subparagraph id="ide9cef08c-36e0-482c-af58-8a544f85bf7b"><enum>(A)</enum><header>Notification based on
				quarterly report</header><text>If the determination of significant deviation is
				based on a report submitted under subsection (b)(1), the Agency Head shall
				notify Congress and the Director in accordance with paragraph (2) not later
				than 21 days after the end of the quarter upon which such report is
				based.</text>
								</subparagraph><subparagraph id="ideb99494a-5f67-4e35-b057-49783dcbbeb5"><enum>(B)</enum><header>Notification based on
				interim report</header><text>If the determination of significant deviation is
				based on a report submitted under subsection (b)(2), the Agency Head shall
				notify Congress and the Director in accordance with paragraph (2) not later
				than 21 days after the submission of such report.</text>
								</subparagraph></paragraph></subsection><subsection id="idb82d6827-01a0-47b2-8b43-87d9c16ba5ec"><enum>(e)</enum><header>Determination of gross
				deviation</header>
							<paragraph id="id3bac9cbc-b439-46ed-8135-4ea3b4c13edb"><enum>(1)</enum><header>Chief information
				officer</header><text>Upon receiving a report under subsection (c), the Chief
				Information Officer shall—</text>
								<subparagraph id="idb4dbd5e2-df02-47f1-be84-82e20633b078"><enum>(A)</enum><text>determine if any IT
				investment project has grossly deviated; and</text>
								</subparagraph><subparagraph id="id846f8927-7731-4465-84d4-1d7e6910ce33"><enum>(B)</enum><text>report any such
				determination to the Agency Head.</text>
								</subparagraph></paragraph><paragraph id="id2d7dadb7-9e38-4dbf-97e5-fc97c840cce8"><enum>(2)</enum><header>Congressional
				notification</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has grossly deviated and the Agency
				Head has not issued a report to the appropriate congressional committees of a
				gross deviation for that project under this section since the project was last
				required to be re-baselined under this section, the Agency Head shall submit a
				report to the appropriate congressional committees, the Director, and the
				Government Accountability Office that includes—</text>
								<subparagraph id="id9ac0e0d8-2d0f-4bdd-a008-d69e7d898f12"><enum>(A)</enum><text>written notification of
				such determination, which states—</text>
									<clause id="id67fb5dce-05f1-48ab-a5aa-85a5cfd54260"><enum>(i)</enum><text>the date on which such
				determination was made; and</text>
									</clause><clause id="id8340bece-d0e1-4f62-917e-3d72aa5d3d76"><enum>(ii)</enum><text>an indication of whether
				or not the project has been previously reported as a significant or gross
				deviation by the Chief Information Officer, and the date of any such
				report;</text>
									</clause></subparagraph><subparagraph id="idffbf73e2-1db8-4452-acdd-d273c705ef96"><enum>(B)</enum><text>incorporations by
				reference of all prior reports to Congress on the project required under this
				section;</text>
								</subparagraph><subparagraph id="idd45903c9-0e13-4bba-8605-38b131d7b793"><enum>(C)</enum><text>updated accounts of the
				items described in subparagraphs (C) through (H) of subsection (d)(2);</text>
								</subparagraph><subparagraph id="id5c46657b-bd8a-4e6e-9d9e-c61e4f21c77b"><enum>(D)</enum><text>the original estimate at
				completion for the project manager, any contractor, and any independent
				analysis;</text>
								</subparagraph><subparagraph id="idc30c9ee1-9020-44d2-807d-aac0f0d75e2a"><enum>(E)</enum><text>a graphical depiction
				that shows monthly planned expenditures against actual expenditures since the
				commencement of the project;</text>
								</subparagraph><subparagraph id="ida229bedd-e215-47c2-9bdb-ce7027dcee82"><enum>(F)</enum><text>the amount, if any, of
				incentive or award fees any contractor has received since the commencement of
				the contract and the reasons for receiving such incentive or award fees;</text>
								</subparagraph><subparagraph id="idfb7dc537-29e6-4249-8e57-7b69794c5dfd"><enum>(G)</enum><text>the project manager’s
				estimated cost at completion and estimated completion date for the project if
				current requirements are not modified;</text>
								</subparagraph><subparagraph id="idac6218fe-e7ba-46c8-bebe-9dd24e7688a8"><enum>(H)</enum><text>the project manager’s
				estimated cost at completion and estimated completion date for the project
				based on reasonable modification of such requirements;</text>
								</subparagraph><subparagraph id="id2fd03287-ddbf-4457-a81d-ea3c48834c6b"><enum>(I)</enum><text>an explanation of the
				most significant occurrence contributing to the variance identified, including
				cost, schedule, and performance variances, and the effect such occurrence will
				have on future project costs and program schedule;</text>
								</subparagraph><subparagraph id="id1efcd77d-8884-4c7c-80a9-6a56f3d2a1ae"><enum>(J)</enum><text>a statement regarding
				previous or anticipated re-baselining or re-planning of the project and the
				names of the individuals responsible for approval;</text>
								</subparagraph><subparagraph id="idc0e6313d-85cb-4143-9f8b-feb01a35c572"><enum>(K)</enum><text>the original life cycle
				cost of the investment and the expected life cycle cost of the investment
				expressed in constant base year dollars and in current dollars; and</text>
								</subparagraph><subparagraph id="id0475f727-b928-4aed-a72d-ecba959e03b6"><enum>(L)</enum><text>a comprehensive plan of
				action to remedy the gross deviation, and milestones established to control
				future cost, schedule, and performance deviations in the future.</text>
								</subparagraph></paragraph><paragraph id="id6b773c58-ec07-438a-b18b-69ab65f3c6bf"><enum>(3)</enum><header>Remedial
				action</header>
								<subparagraph id="idD8658F3434D44726A1C604320B3849EE"><enum>(A)</enum><header>In
				general</header><text>If the Chief Information Officer determines under
				paragraph (1) that an IT investment project has grossly deviated, the Agency
				Head, in consultation with the Chief Information Officer, shall develop and
				implement a remedial action plan that includes—</text>
									<clause id="idcdbfe792-41c2-458e-b235-b5c37247b2fb"><enum>(i)</enum><text>a report that—</text>
										<subclause id="id7f472dba-d32c-435c-be11-be207b1b7cce"><enum>(I)</enum><text>describes the primary
				business case and key functional requirements for the project;</text>
										</subclause><subclause id="id7e2fc0c1-a058-4802-861d-5ad2499406c9"><enum>(II)</enum><text>describes any portions
				of the project that have technical requirements of sufficient clarity that such
				portions may be feasibly procured under firm, fixed-price contract;</text>
										</subclause><subclause id="id73e18c34-27d6-4dbd-85d0-2554b815f122"><enum>(III)</enum><text>includes a
				certification by the Agency Head, after consultation with the Chief Information
				Officer, that all technical requirements have been reviewed and validated to
				ensure alignment with the reported business case;</text>
										</subclause><subclause id="ide59ab7f6-6085-4a25-9b8c-e0eadb354fce"><enum>(IV)</enum><text>describes any changes to
				the primary business case or key functional requirements which have occurred
				since project inception; and</text>
										</subclause><subclause id="id9d0adba7-70ea-4547-b225-422b18c8eca5"><enum>(V)</enum><text>includes an independent
				government cost estimate for the project conducted by an entity approved by the
				Director;</text>
										</subclause></clause><clause id="id58347936-3326-4016-8577-bf670d9b6f28"><enum>(ii)</enum><text>an analysis that—</text>
										<subclause id="id18c75140-d338-4f43-81ff-5a1bdfe4caeb"><enum>(I)</enum><text>describes agency business
				goals that the project was originally designed to address;</text>
										</subclause><subclause id="id09afa840-b33e-4c01-9135-532eeded4226"><enum>(II)</enum><text>includes a gap analysis
				of what project deliverables remain in order for the agency to accomplish the
				business goals referred to in subclause (I);</text>
										</subclause><subclause id="id05ad98d8-a0a0-4810-8f4f-fb21578ececa"><enum>(III)</enum><text>identifies the 3 most
				cost-effective alternative approaches to the project which would achieve the
				business goals referred to in subclause (I); and</text>
										</subclause><subclause id="ida76fe4ee-d357-477f-b6dc-5dd8ab6c01a3"><enum>(IV)</enum><text>includes a cost-benefit
				analysis, which compares—</text>
											<item id="id32252eaf-3aee-41ed-94fc-2f8368e396ac"><enum>(aa)</enum><text>the completion of the
				project with the completion of each alternative approach, after factoring in
				future costs associated with the termination of the project; and</text>
											</item><item id="ide6d3788c-957d-4658-814d-770ba2f1c74b"><enum>(bb)</enum><text>the termination of the
				project without pursuit of alternatives, after factoring in foregone benefits;
				and</text>
											</item></subclause></clause><clause id="id6f119259-688b-4562-b74d-72c125204107"><enum>(iii)</enum><text>a new baseline of the
				project is established that is consistent with the independent government cost
				estimate required under clause (i)(V); and</text>
									</clause><clause id="id9d976d7d-303e-4339-a48a-f14d4eeb14c0"><enum>(iv)</enum><text>the project is
				designated as a core IT investment project and subjected to the requirements
				under subsection (f).</text>
									</clause></subparagraph><subparagraph id="ID60865cfc93b2464897734093e547ab98"><enum>(B)</enum><header>Submission to
				congress</header><text>The remedial action plan and all corresponding reports,
				analyses, and actions under this paragraph shall be submitted to the
				appropriate congressional committees and the Director.</text>
								</subparagraph><subparagraph id="ID650d7b72d91e4dd2bfdffa9bacdf8970"><enum>(C)</enum><header>Reporting and analysis
				exemptions</header>
									<clause id="ID8ba9279f159d4240b8b4fadce910e1a1"><enum>(i)</enum><header>In
				general</header><text>The Chief Information Officer, in coordination with the
				Agency Head and the Director, may forego the completion of any element of a
				report or analysis under clause (i) or (ii) of subparagraph (A) if the Chief
				Information Officer determines that such element is not relevant to the
				understanding of the difficulties facing the project or further continuation of
				the project in a timely and cost-efficient manner.</text>
									</clause><clause id="ID2b2bc61e347b477e95b651956cd4ce38"><enum>(ii)</enum><header>Identification of
				reasons</header><text>The Chief Information Officer shall include the reasons
				for not including any element referred to in clause (i) in the report submitted
				to Congress under subparagraph (B).</text>
									</clause></subparagraph></paragraph><paragraph id="idade5a421-b4aa-4c39-a4f4-476986710a54"><enum>(4)</enum><header>Deadline and funding
				contingency</header>
								<subparagraph id="id3e9129d6-37ba-468b-aee1-763c8a2a277c"><enum>(A)</enum><header>Notification and
				remedial action based on quarterly report</header>
									<clause id="id9d4de49f-056c-4932-a9aa-88066802c29b"><enum>(i)</enum><header>In
				general</header><text>If the determination of gross deviation is based on a
				report submitted under subsection (c)(1), the Agency Head shall—</text>
										<subclause id="id995af964-94de-4a62-9d82-0d3a24d8378a"><enum>(I)</enum><text>not later than 45 days
				after the end of the quarter upon which such report is based, notify the
				appropriate congressional committees and the Director in accordance with
				paragraph (2); and</text>
										</subclause><subclause id="id9de480b3-7e91-48ea-975b-31b3a8a6d2a7"><enum>(II)</enum><text>not later than 180 days
				after the end of the quarter upon which such report is based, ensure the
				completion of remedial action under paragraph (3).</text>
										</subclause></clause><clause id="iddc7c0cf3-5666-4b51-a5ce-8acc70ee9013"><enum>(ii)</enum><header>Failure to meet
				deadlines</header><text>If the Agency Head fails to meet the deadlines
				described in clause (i)(II), additional funds may not be obligated to support
				expenditures associated with the project until the requirements of this
				subsection have been fulfilled.</text>
									</clause></subparagraph><subparagraph id="id8d94bc14-0155-4218-9663-abc14caa8566"><enum>(B)</enum><header>Notification and
				remedial action based on interim report</header>
									<clause id="id334b4f17-ef97-44b7-8ca4-5feb2795649a"><enum>(i)</enum><header>In
				general</header><text>If the determination of gross deviation is based on a
				report submitted under subsection (c)(2), the Agency Head shall—</text>
										<subclause id="id4779a644-b37a-4d8b-93bc-d7a3447f2763"><enum>(I)</enum><text>not later than 45 days
				after the submission of such report, notify the appropriate congressional
				committees in accordance with paragraph (2); and</text>
										</subclause><subclause id="idf025c234-560d-4c0e-89f4-c3c1b9d2215f"><enum>(II)</enum><text>not later than 180 days
				after the submission of such report, ensure the completion of remedial action
				in accordance with paragraph (3).</text>
										</subclause></clause><clause id="id5927714f-8f4b-4b46-97f6-2be478f1dd0e"><enum>(ii)</enum><header>Failure to meet
				deadlines</header><text>If the Agency Head fails to meet the deadlines
				described in clause (i)(II), additional funds may not be obligated to support
				expenditures associated with the project until the requirements of this
				subsection have been fulfilled.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="idebfb9005-68f7-454d-a568-01a6cd114c8b"><enum>(f)</enum><header>Additional requirements
				for core IT investment project reports</header>
							<paragraph id="ide1aad06f-e6ad-4155-bdd5-c4ce45280e97"><enum>(1)</enum><header>Initial
				report</header><text>If a report described in subsection (e)(3)(A) has not been
				submitted for a core IT investment project, the Agency Head, in coordination
				with the Chief Information Officer and responsible program managers, shall
				prepare an initial report for inclusion in the first budget submitted to
				Congress under section 1105(a) of title 31, United States Code, after the
				designation of a project as a core IT investment project, which
				includes—</text>
								<subparagraph id="idb5dd3951-a939-4e22-a883-272bf933511b"><enum>(A)</enum><text>a description of the
				primary business case and key functional requirements for the project;</text>
								</subparagraph><subparagraph id="idd0670718-80f6-47ce-b5e4-313b838703bd"><enum>(B)</enum><text>an identification and
				description of any portions of the project that have technical requirements of
				sufficient clarity that such portions may be feasibly procured under firm,
				fixed-price contracts;</text>
								</subparagraph><subparagraph id="id03ca2f8e-731c-464b-982f-e712e14f6d6f"><enum>(C)</enum><text>an independent cost
				estimate for the project;</text>
								</subparagraph><subparagraph id="ida9e02f70-9daa-4c05-b9bd-cf74aba7cd79"><enum>(D)</enum><text>certification by the
				Chief Information Officer that all technical requirements have been reviewed
				and validated to ensure alignment with the reported business case; and</text>
								</subparagraph><subparagraph id="id1a13a076-6039-4c10-8d7a-a20e4489df18"><enum>(E)</enum><text>any changes to the
				primary business case or key functional requirements which have occurred since
				project inception.</text>
								</subparagraph></paragraph><paragraph id="id83545c71-6fcc-47ac-ad77-c1ce36faa643"><enum>(2)</enum><header>Quarterly review of
				business case</header><text>The Agency Head, in coordination with the Chief
				Information Officer and responsible program managers, shall—</text>
								<subparagraph id="ide479b527-ea85-41c4-8a8e-ff09da1094db"><enum>(A)</enum><text>monitor the primary
				business case and core functionality requirements reported to Congress and the
				Director for designated core IT investment projects; and</text>
								</subparagraph><subparagraph id="id7063aed8-2e8a-49f1-bf82-6e991843f8ea"><enum>(B)</enum><text>if changes to the primary
				business case or key functional requirements for a core IT investment project
				occur in any fiscal quarter, submit a report to Congress and the Director not
				later than 14 days after the end of such quarter that details the changes and
				describes the impact the changes will have on the cost and ultimate
				effectiveness of the project.</text>
								</subparagraph></paragraph><paragraph id="id80f9cb69-d7f8-4250-a09e-8863f861de42"><enum>(3)</enum><header>Alternative significant
				deviation determination</header><text>If the Chief Information Officer
				determines, subsequent to a change in the primary business case or key
				functional requirements, that without such change the project would have
				significantly deviated—</text>
								<subparagraph id="id934413b1-1940-4d38-abc9-8715457fc134"><enum>(A)</enum><text>the Chief Information
				Officer shall notify the Agency Head of the significant deviation; and</text>
								</subparagraph><subparagraph id="idde766b01-a7cd-4e74-b30b-b929047699ba"><enum>(B)</enum><text>the Agency Head shall
				fulfill the requirements under subsection (d)(2) in accordance with the
				deadlines under subsection (d)(3).</text>
								</subparagraph></paragraph><paragraph id="id1e916a84-9577-4553-89b4-1ff7f2cfddc4"><enum>(4)</enum><header>Alternative gross
				deviation determination</header><text>If the Chief Information Officer
				determines, subsequent to a change in the primary business case or key
				functional requirements, that without such change the project would have
				grossly deviated—</text>
								<subparagraph id="ide345c514-17e7-4d92-af74-7671e5212b34"><enum>(A)</enum><text>the Chief Information
				Officer shall notify the Agency Head of the gross deviation; and</text>
								</subparagraph><subparagraph id="id8297ccba-a4c7-4bfe-a82c-04550e371f54"><enum>(B)</enum><text>the Agency Head shall
				fulfill the requirements under subsections (e)(2) and (e)(3) in accordance with
				subsection
				(e)(4).</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id8ef417c2-f121-4582-8f00-db43908516a4"><enum>(b)</enum><header>Inclusion in the budget
			 submitted to congress</header><text>Section 1105(a) of title 31, United States
			 Code, is amended—</text>
				<paragraph id="id81bb44d3-f3a0-45c1-b861-a7262b5c7041"><enum>(1)</enum><text>in the matter preceding
			 paragraph (1), by striking <quote>include in each budget the following:</quote>
			 and inserting <quote>include in each budget—</quote>;</text>
				</paragraph><paragraph id="id644c4e4d-c7b5-4304-95df-72be143779b2"><enum>(2)</enum><text>by redesignating the
			 second paragraph (33) (as added by section 889(a) of Public Law 107–296) as
			 paragraph (35);</text>
				</paragraph><paragraph id="id261f86be-b1ee-4564-a30d-ae3f0f246061"><enum>(3)</enum><text>in each of paragraphs (1)
			 through (34), by striking the period at the end and inserting a
			 semicolon;</text>
				</paragraph><paragraph id="iddc8e9640-d135-4bc1-97fa-04a434d20a80"><enum>(4)</enum><text>in paragraph (35) (as
			 redesignated by paragraph (2)), by striking the period at the end and inserting
			 <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id745f4a14-8fc3-455f-a45d-8fa7d5b6bfb8"><enum>(5)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="SSAP00" display-inline="no-display-inline" id="id0eeedda2-cc93-4284-ba7d-b1b77d5c9e67" reported-display-style="italic" style="OLC">

				under section 11317(f) of title 40, United States Code, relating to the core IT
				investment projects of the
				agency.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id4511d6f6-09cf-4381-8ad2-998ef39f1744"><enum>(c)</enum><header>Improvement of
			 information technology acquisition and development</header><text>Subchapter II
			 of chapter 113 of title 40, United States Code, is amended by adding at the end
			 the following:</text>
				<quoted-block changed="added" committee-id="SSAP00" display-inline="no-display-inline" id="idd98bb3a2-fdb5-43e4-abe3-24af04da35c1" reported-display-style="italic" style="OLC">
					<section id="ide3a0cbc2-6cf9-4957-b98f-409dc34c4fa7"><enum>11319.</enum><header>Acquisition and
				development</header>
						<subsection id="id3808e6d6-1ff7-4be6-9c64-ff6c4d37ac94"><enum>(a)</enum><header>Establishment of
				programs</header><text>Not later than 120 days after the date of the enactment
				of this section, each Chief Information Officer, upon the approval of the
				Agency Head (as defined in section 11317(a) of title 40, United States Code)
				shall establish a program to improve the information technology (referred to in
				this section as <quote>IT</quote>) processes overseen by the Chief Information
				Officer.</text>
						</subsection><subsection id="id1420d0cb-62db-47eb-8d0f-89764158b504"><enum>(b)</enum><header>Program
				requirements</header><text>Each program established pursuant to this section
				shall include—</text>
							<paragraph id="id4116c13f-199c-48ff-80bd-50049c0dcff5"><enum>(1)</enum><text>a documented process for
				information technology acquisition planning, requirements development and
				management, project management and oversight, earned-value management, and risk
				management;</text>
							</paragraph><paragraph id="id934616c2-3794-44c5-bf6f-c9c18a7e7651"><enum>(2)</enum><text>the development of
				appropriate metrics for performance measurement of—</text>
								<subparagraph id="id9dfbad91-df7d-4657-b246-e9c52a81cc1f"><enum>(A)</enum><text>processes and development
				status;</text>
								</subparagraph><subparagraph id="ida951a303-181b-488a-a2a9-bc72844564a1"><enum>(B)</enum><text>continuous process
				improvement; and</text>
								</subparagraph><subparagraph id="idDF8CEBF9CF024E6CB1E40187D39CA40E"><enum>(C)</enum><text>achievement of project
				outcomes;</text>
								</subparagraph></paragraph><paragraph id="id12d4c35a-75e5-4a9d-ab4c-a8a9230456f9"><enum>(3)</enum><text>a process to ensure that
				key program personnel have an appropriate level of experience and training and
				education, at an institution or institutions approved by the Director, in the
				planning, acquisition, execution, management, and oversight of information
				technology;</text>
							</paragraph><paragraph id="id10c2fdff-eed5-4149-8dc2-439ea9040f9e"><enum>(4)</enum><text>a process to ensure that
				the applicable department and subcomponents implement and adhere to established
				processes and requirements relating to the planning, acquisition, execution,
				management, and oversight of information technology programs and developments;
				and</text>
							</paragraph><paragraph id="idC673B311A2824D4181B7623682669FAA"><enum>(5)</enum><text>a process for the Chief
				Information Officer to intervene or stop the funding of an IT investment if it
				is at risk of not achieving major project milestones.</text>
							</paragraph></subsection><subsection id="idef8df9cb-dfc5-4f18-9d8b-3ba8db9eb58a"><enum>(c)</enum><header>OMB
				Guidance</header><text>The Director of the Office of Management and Budget
				shall—</text>
							<paragraph id="id5bc70878-3476-429d-af95-350659ffcc7e"><enum>(1)</enum><text>prescribe uniformly
				applicable guidance to the administration of all the programs established under
				subsection (a); and</text>
							</paragraph><paragraph id="id79c24da8-70d8-41c1-a071-6d20add9a2e3"><enum>(2)</enum><text>take any actions that are
				necessary to ensure that Federal agencies comply with the guidance.</text>
							</paragraph></subsection><subsection id="idd76f8874-6657-4e12-bfb8-1fcafd0c8c1d"><enum>(d)</enum><header>Annual report to
				Congress</header><text>Not later than the last day of February of each year,
				the Agency Head shall submit a report to Congress that includes—</text>
							<paragraph id="id53e0b291-5388-46ae-ba46-af94e76b390e"><enum>(1)</enum><text>a detailed summary of the
				accomplishments of the program established by the Agency Head pursuant to this
				section;</text>
							</paragraph><paragraph id="iddf251063-0a4e-4e34-b49b-71a897951982"><enum>(2)</enum><text>the status of
				completeness of implementation of each of the program requirements, and the
				date each such requirement was deemed to be completed;</text>
							</paragraph><paragraph id="ide8c2b4ee-a1ce-49cd-b712-3fda453b7bcc"><enum>(3)</enum><text>the percentage of Federal
				IT projects covered under the program compared to all of the IT projects of the
				agency, listed by number of programs and by annual dollars expended;</text>
							</paragraph><paragraph id="id8b08927d-8a6a-4092-be53-adf20d7ef5d2"><enum>(4)</enum><text>a detailed breakdown of
				the sources and uses of the amounts spent by the agency during the previous
				fiscal year to support the activities of the program;</text>
							</paragraph><paragraph id="id365fb641-48e0-490f-9a40-ffee9d91e1e5"><enum>(5)</enum><text>a copy of any guidance
				issued under the program and a statement regarding whether each such guidance
				is mandatory;</text>
							</paragraph><paragraph id="ida9391d9a-f71e-497c-b619-edb7f37db9f1"><enum>(6)</enum><text>the identification of the
				metrics developed in accordance with subsection (b)(2);</text>
							</paragraph><paragraph id="id5a435ba3-87ee-4b8c-9491-a6e9b3347a82"><enum>(7)</enum><text>a description of how
				paragraphs (3) and (4) of subsection (b) have been implemented and any related
				agency guidance; and</text>
							</paragraph><paragraph id="id52850db2-91cc-4da3-9bf4-9bf6acc1aaee"><enum>(8)</enum><text>a description of how
				continuous process improvement has been implemented and the objectives of such
				guidance.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id4e87d881-a163-4fee-aabb-3e8d287cfc78"><enum>(d)</enum><header>Clerical
			 amendments</header><text>The table of sections for chapter 113 of title 40,
			 United States Code, is amended—</text>
				<paragraph id="idc1b5a1d8-6351-4cc6-bf6a-2fee30686eac"><enum>(1)</enum><text>by striking the item
			 relating to section 11317 and inserting the following:</text>

				</paragraph></subsection></section><section changed="added" committee-id="SSAP00" id="id83550d37-5437-4693-adc5-46f32643fa77" reported-display-style="italic"><enum>3.</enum><header>IT Strike Force</header>
			<subsection id="id47f96670-5ddb-426e-94b9-c1a03cd95b4d"><enum>(a)</enum><header>Purpose</header><text>The
			 Director of the Office of Management of Budget (referred to in this section as
			 the <quote>Director</quote>), in consultation with the Administrator of the
			 Office of Electronic Government and Information and Technology at the Office of
			 Management and Budget (referred to in this section as the <quote>E–Gov
			 Administrator</quote>), shall assist agencies in avoiding significant and gross
			 deviations in the cost, schedule, and performance of IT investment projects (as
			 such terms are defined in section 11317(a) of title 40, United States
			 Code).</text>
			</subsection><subsection id="id1db3485e-c8d7-4682-9b93-e6ff5977f7ad"><enum>(b)</enum><header>IT Strike
			 Force</header>
				<paragraph id="idec41a463-3845-4def-b677-49728f4744bd"><enum>(1)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the E–Gov
			 Administrator shall establish a small group of individuals (referred to in this
			 section as the <quote>IT Strike Force</quote>) to carry out the purpose
			 described in subsection (a).</text>
				</paragraph><paragraph id="idc6320503-43a6-46b6-b09b-98049a002331"><enum>(2)</enum><header>Qualifications</header><text>Individuals
			 selected for the IT Strike Force—</text>
					<subparagraph id="id7d11e4f1-6478-4216-a130-eecf18d8745b"><enum>(A)</enum><text>shall be certified at the
			 Senior/Expert level according to the Federal Acquisition Certification for
			 Program and Project Managers (FAC–P/PM); or</text>
					</subparagraph><subparagraph id="idae879601-37cd-4cc6-83ef-428508fb32ca"><enum>(B)</enum><text>shall have comparable
			 education, certification, training, and experience to successfully manage
			 high-risk IT investment projects.</text>
					</subparagraph></paragraph><paragraph id="ided39a54e-91a1-4ceb-9f7d-a584084ab5d1"><enum>(3)</enum><header>Number</header><text>The
			 Director, in consultation with the E–Gov Administrator, shall determine the
			 number of individuals who will be selected for the IT Strike Force.</text>
				</paragraph></subsection><subsection id="idc92fe65f-860b-4a52-a71a-8a1e18466e15"><enum>(c)</enum><header>Outside
			 consultants</header>
				<paragraph id="id0572a950-fbd4-4a04-8688-3dc56fd0fa78"><enum>(1)</enum><header>Identification</header><text>The
			 E–Gov Administrator shall identify consultants in the private sector who have
			 expert knowledge in IT program management and program management review teams.
			 Not more than 20 percent of such consultants may be formally associated with
			 any one of the following types of entities:</text>
					<subparagraph id="idca97d11f-83af-4946-ba2f-b2b4b060d75e"><enum>(A)</enum><text>Commercial firms.</text>
					</subparagraph><subparagraph id="idf8f4bd8f-6d6a-4991-b6de-177bfc00986e"><enum>(B)</enum><text>Nonprofit
			 entities.</text>
					</subparagraph><subparagraph id="id6347e3ea-a4de-40d6-80d7-c7b25671fb5c"><enum>(C)</enum><text>Federally funded research
			 and development centers.</text>
					</subparagraph></paragraph><paragraph id="id4e8fdb3c-640c-4e18-b956-93081aacdb3c"><enum>(2)</enum><header>Use of
			 consultants</header>
					<subparagraph id="id42541b02-a3bd-4197-a2f9-4d52b7cd9102"><enum>(A)</enum><header>In
			 general</header><text>Consultants identified under paragraph (1) may be used to
			 assist the IT Strike Force in assessing and improving IT investment
			 projects.</text>
					</subparagraph><subparagraph id="idebdd6a83-b6eb-4539-bf14-f6c51b187f4f"><enum>(B)</enum><header>Limitation</header><text>Consultants
			 with a formally established relationship with an organization may not
			 participate in any assessment involving an IT investment project for which such
			 organization is under contract to provide technical support.</text>
					</subparagraph><subparagraph id="id47ef81b0-9248-4d22-846c-a19bcb4da8fd"><enum>(C)</enum><header>Exception</header><text>The
			 limitation described in subparagraph (B) may not be construed as precluding
			 access to anyone having relevant information helpful to the conduct of the
			 assessment.</text>
					</subparagraph></paragraph><paragraph id="idbf69878a-75c9-4bd8-8ca7-926559dbdb3e"><enum>(3)</enum><header>Contracts</header><text>The
			 E–Gov Administrator, in conjunction with the Administrator of the General
			 Services Administration (GSA), may establish competitively bid contracts with
			 one or more qualified consultants, independent of any GSA schedule.</text>
				</paragraph></subsection><subsection id="id906f1bd7-4c7d-4065-a943-47852a64e397"><enum>(d)</enum><header>Initial response to
			 anticipated significant or gross deviation</header><text>If the E–Gov
			 Administrator determines there is reasonable cause to believe that a major IT
			 investment project is likely to significantly or grossly deviate (as defined in
			 section 11317(a) of title 40, United States Code), including the receipt of
			 inconsistent or missing data, the E–Gov Administrator shall carry out the
			 following activities:</text>
				<paragraph id="id4df0a4fa-a4dd-471c-93fa-46e256c9e5b2"><enum>(1)</enum><text>Recommend the assignment
			 of one or more members of the IT Strike Force to assess the project in
			 accordance with the scope and time period described in section 11317(c)(1) of
			 title 40, United States Code, beginning not later than 14 days after such
			 recommendation. No member of the Strike Force who is associated with the
			 department or agency whose IT investment project is the subject of the
			 assessment may be assigned to participate in this assessment. Such limitation
			 may not be construed as precluding access to anyone having relevant information
			 helpful to the conduct of the assessment.</text>
				</paragraph><paragraph id="id7411526e-4ec3-4820-a4a8-d2b0654a33f7"><enum>(2)</enum><text>If the E–Gov
			 Administrator determines that one or more qualified consultants are needed to
			 support the efforts of the IT Strike Force under paragraph (1), negotiate a
			 contract with the consultant to provide such support during the period in which
			 the IT Strike Force is conducting the assessment described in paragraph
			 (1).</text>
				</paragraph><paragraph id="id4e2b72cc-22ef-4724-9872-fb070f5e12df"><enum>(3)</enum><text>Ensure that the costs of
			 an assessment under paragraph (1) and the support services of one or more
			 consultants under paragraph (2) are paid by the major IT investment project
			 being assessed.</text>
				</paragraph><paragraph id="id1c151bac-4858-4607-b47a-c9aa6b9fae16"><enum>(4)</enum><text>Monitor the progress made
			 by the IT Strike Force in assessing the project.</text>
				</paragraph></subsection><subsection id="id4410613a-7e2e-44df-8d89-0d851e012006"><enum>(e)</enum><header>Reduction of
			 significant or gross deviation</header><text>If the E–Gov Administrator
			 determines that the assessment conducted under subsection (d) confirms that a
			 major IT investment project is likely to significantly or grossly deviate, the
			 E–Gov Administrator shall recommend that the Agency Head (as defined in section
			 11317(a)(1) of title 40, United States Code) take steps to reduce the
			 deviation, which may include—</text>
				<paragraph id="id42c893d8-c962-4ee2-88e9-76b1d60afc2b"><enum>(1)</enum><text>providing training,
			 education, or mentoring to improve the qualifications of the program
			 manager;</text>
				</paragraph><paragraph id="id63bf9a53-056a-477f-ae28-5fc9a1f8eef6"><enum>(2)</enum><text>replacing the program
			 manager or other staff;</text>
				</paragraph><paragraph id="idb26786db-f8b8-482b-8efb-2a4ccd65be8c"><enum>(3)</enum><text>supplementing the program
			 management team with Federal Government employees or independent
			 contractors;</text>
				</paragraph><paragraph id="id27d3854f-d275-4b4c-b4f7-51ef921bd4c8"><enum>(4)</enum><text>terminating the project;
			 or</text>
				</paragraph><paragraph id="id6d6c7738-21ab-4882-b3ae-94bd5017515d"><enum>(5)</enum><text>hiring an independent
			 contractor to report directly to senior management and the E–Gov
			 Administrator.</text>
				</paragraph></subsection><subsection id="ide280fc7c-b553-470e-9633-9cb6c4a2c109"><enum>(f)</enum><header>Reprogramming of
			 funds</header>
				<paragraph id="idd9629ded-cfc0-4703-bf75-e2310ce09f7d"><enum>(1)</enum><header>Authorization</header><text>The
			 Director may direct an Agency Head to reprogram amounts which have been
			 appropriated for such agency to pay for an assessment under subsection
			 (d).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96d4f1a6-af42-4ba9-9bed-19d1223e7684"><enum>(2)</enum><header>Notification</header><text>An
			 Agency Head who reprograms appropriations under paragraph (1) shall notify the
			 <committee-name committee-id="SSAP00">Committee on Appropriations of the
			 Senate</committee-name> and the <committee-name committee-id="">Committee on
			 Appropriations of the House of Representatives</committee-name> of any such
			 reprogramming.</text>
				</paragraph></subsection><subsection id="idb6f25e69-18a2-4f35-8d4b-e59abaf87638"><enum>(g)</enum><header>Report to
			 Congress</header><text>The Director shall include in the annual Report to
			 Congress on the Benefits of E–Government Initiatives a detailed summary of the
			 composition and activities of the IT Strike Force, including—</text>
				<paragraph id="id265d927c-df22-40cd-bc22-ca0667c840dc"><enum>(1)</enum><text>the number and
			 qualifications of individuals on the IT Strike Force;</text>
				</paragraph><paragraph id="id1d0234d4-8c97-4745-bf81-f3061f6a1777"><enum>(2)</enum><text>a description of the IT
			 investment projects that the IT Strike Force has worked during the previous
			 fiscal year;</text>
				</paragraph><paragraph id="id94fc3dfc-6589-47d2-98c3-9d16292d8d83"><enum>(3)</enum><text>the major issues that
			 necessitated the involvement of the IT Strike Force to assist agencies with
			 assessing and managing IT investment projects and whether such issues were
			 satisfactorily resolved;</text>
				</paragraph><paragraph id="id04018063-0b0f-4fe7-945d-6ef7b02f1843"><enum>(4)</enum><text>if the issues referred to
			 in paragraph (3) were not satisfactorily resolved, the issues still needed to
			 be resolved and the Agency Head’s plan for resolving such issues;</text>
				</paragraph><paragraph id="iddcc7af44-9030-4e67-8514-a5aa348dd3ae"><enum>(5)</enum><text>a detailed breakdown of
			 the sources and uses of the amounts spent by the Office of Management and
			 Budget and other Federal agencies during the previous fiscal year to support
			 the activities of the IT Strike Force; and</text>
				</paragraph><paragraph id="id7f0ade7d-f86e-426f-afe0-40a8b6b892ad"><enum>(6)</enum><text>a determination of
			 whether the IT Strike Force has been effective in—</text>
					<subparagraph id="idA0C3A7DF171C4F929E8338AF36DB7577"><enum>(A)</enum><text>preventing projects from
			 deviating from the original baseline; and</text>
					</subparagraph><subparagraph id="idEAB1C4D854A740B5BC82E6665895FC27"><enum>(B)</enum><text>assisting agencies in
			 conducting appropriate analysis and planning before a project is funded.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
