			<section commented="no" display-inline="no-display-inline" id="id2F92CCEF832F477DA4D30CDBA7A87EFC" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote>Providing Resources, Officers, and Technology To Eradicate Cyber Threats
			 to Our Children Act of 2008</quote> or the <quote>PROTECT Our Children Act of
			 2008</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="HFBF783858F7D43C98BD5AEFD6DE5911C" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
			 shall apply:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE6E0BE988F15461E905CEFE0E74FB62E"><enum>(1)</enum><header display-inline="yes-display-inline">Child exploitation</header><text display-inline="yes-display-inline">The term <quote>child exploitation</quote>
			 means any conduct, attempted conduct, or conspiracy to engage in conduct
			 involving a minor that violates section 1591, chapter 109A, chapter 110, and
			 chapter 117 of title 18, United States Code, or any sexual activity involving a
			 minor for which any person can be charged with a criminal offense.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08F47FC7DAF743BF993585EF62E4C6CC"><enum>(2)</enum><header display-inline="yes-display-inline">Child obscenity</header><text display-inline="yes-display-inline">The term <quote>child obscenity</quote>
			 means any visual depiction proscribed by section 1466A of title 18, United
			 States Code.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57AEDE41D3664ED5BC9C99B43FEEEF00"><enum>(3)</enum><header display-inline="yes-display-inline">Minor</header><text display-inline="yes-display-inline">The term <quote>minor</quote> means any
			 person under the age of 18 years.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBF8F46D65F1647AA00D2709B6FB45EBF"><enum>(4)</enum><header display-inline="yes-display-inline">Sexually explicit conduct</header><text display-inline="yes-display-inline">The term <quote>sexually explicit
			 conduct</quote> has the meaning given such term in
			 <external-xref legal-doc="usc" parsable-cite="usc/18/2256">section
			 2256</external-xref> of title 18, United States Code.</text>
				</paragraph></section><subtitle commented="no" id="HBC6754948A9F4231AA1E1BF097DE4F11" level-type="subsequent"><enum>A</enum><header display-inline="yes-display-inline">National Strategy for Child Exploitation
			 Prevention and Interdiction</header>
				<section commented="no" display-inline="no-display-inline" id="H62AC7B92E3004205BBCA3142B700FA2E" section-type="subsequent-section"><enum>111.</enum><header display-inline="yes-display-inline">Establishment of National Strategy for
			 Child Exploitation Prevention and Interdiction</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID9f50752283b344e5848749254e32cb80"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General of the United States
			 shall create and implement a National Strategy for Child Exploitation
			 Prevention and Interdiction.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id7E24E6F8C293431B900E79ECDFE664EE"><enum>(b)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">Not later than February 1 of each year, the
			 Attorney General shall submit to Congress the National Strategy established
			 under subsection (a).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id68E15173687E4248AE2B6ACCD7CB79DA"><enum>(c)</enum><header display-inline="yes-display-inline">Required contents of National
			 Strategy</header><text display-inline="yes-display-inline">The National
			 Strategy established under subsection (a) shall include the following:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6f95805f1fce49c1b6669591a55b42e8"><enum>(1)</enum><text display-inline="yes-display-inline">Comprehensive long-range, goals for
			 reducing child exploitation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID11329c164a5041bbb40aee60e4f87b06"><enum>(2)</enum><text display-inline="yes-display-inline">Annual measurable objectives and specific
			 targets to accomplish long-term, quantifiable goals that the Attorney General
			 determines may be achieved during each year beginning on the date when the
			 National Strategy is submitted.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9fec3870e0cd4ea8a48e9eabb9cd879d"><enum>(3)</enum><text display-inline="yes-display-inline">Annual budget priorities and Federal
			 efforts dedicated to combating child exploitation, including resources
			 dedicated to Internet Crimes Against Children task forces, Project Safe
			 Childhood, FBI Innocent Images Initiative, the National Center for Missing and
			 Exploited Children, regional forensic computer labs, Internet Safety programs,
			 and all other entities whose goal or mission is to combat the exploitation of
			 children that receive Federal support.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8e34f61b5041489c8d7fdb9afbf62c8e"><enum>(4)</enum><text display-inline="yes-display-inline">A 5-year projection for program and budget
			 goals and priorities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce5c6bf55ad142acbf3e5213c82aaab3"><enum>(5)</enum><text display-inline="yes-display-inline">A review of the policies and work of the
			 Department of Justice related to the prevention and investigation of child
			 exploitation crimes, including efforts at the Office of Justice Programs, the
			 Criminal Division of the Department of Justice, the Executive Office of United
			 States Attorneys, the Federal Bureau of Investigation, the Office of the
			 Attorney General, the Office of the Deputy Attorney General, the Office of
			 Legal Policy, and any other agency or bureau of the Department of Justice whose
			 activities relate to child exploitation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6cabcc866c50478eb13b3eee76cc7e0f"><enum>(6)</enum><text display-inline="yes-display-inline">A description of the Department’s efforts
			 to coordinate with international, State, local, tribal law enforcement, and
			 private sector entities on child exploitation prevention and interdiction
			 efforts.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4563f41d92074ee18e1a2ce5f54eced3"><enum>(7)</enum><text display-inline="yes-display-inline">Plans for interagency coordination
			 regarding the prevention, investigation, and apprehension of individuals
			 exploiting children, including cooperation and collaboration with—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID414daaceae3b40b7a5c75006b8d5848e"><enum>(A)</enum><text display-inline="yes-display-inline">Immigration and Customs Enforcement;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdfb255c7ab474655b8f14fbf944da953"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Postal Inspection
			 Service;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc0ba2b0c7d3c4be3b24d12417c793131"><enum>(C)</enum><text display-inline="yes-display-inline">the Department of State;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6fe374d0abcc4fee8749c6d826f0a87d"><enum>(D)</enum><text display-inline="yes-display-inline">the Department of Commerce;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc2e989417228455691188972512882ca"><enum>(E)</enum><text display-inline="yes-display-inline">the Department of Education;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2311224801c64a5c988f83368be31c52"><enum>(F)</enum><text display-inline="yes-display-inline">the Department of Health and Human
			 Services; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D9C3B32495244AEA8196C10CE1EE182"><enum>(G)</enum><text display-inline="yes-display-inline">other appropriate Federal agencies.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa3c60399a30b4c8b8b88cebf465d6ac7"><enum>(8)</enum><text display-inline="yes-display-inline">A review of the Internet Crimes Against
			 Children Task Force Program, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDd94945fcd51e4e18b6862acc5d10f0b1"><enum>(A)</enum><text display-inline="yes-display-inline">the number of ICAC task forces and location
			 of each ICAC task force;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID03af69a5a8a04aae8e22fc2734d40257"><enum>(B)</enum><text display-inline="yes-display-inline">the number of trained personnel at each
			 ICAC task force;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb3496e841a5b42f8936ad89f5b4e0c61"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of Federal grants awarded to
			 each ICAC task force;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9358b42b088d4871b155e1a2467aee34"><enum>(D)</enum><text display-inline="yes-display-inline">an assessment of the Federal, State, and
			 local cooperation in each task force, including—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID7aec67938d4a450f8c73df9631ed2e6f"><enum>(i)</enum><text display-inline="yes-display-inline">the number of arrests made by each task
			 force;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID4359bd06e3ec45a999cb25c7321573d9"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of criminal referrals to United
			 States attorneys for prosecution;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID352c483f22734e33954db2d47673f92f"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of prosecutions and convictions
			 from the referrals made under clause (ii);</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDdc14493dad9d44a5bca361403a0bff11"><enum>(iv)</enum><text display-inline="yes-display-inline">the number, if available, of local
			 prosecutions and convictions based on ICAC task force investigations;
			 and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDe5d8d3be36eb4cf58ccd29df08cb5e4f"><enum>(v)</enum><text display-inline="yes-display-inline">any other information demonstrating the
			 level of Federal, State, and local coordination and cooperation, as such
			 information is to be determined by the Attorney General;</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1f2cf9d754d545048c95126da386f4d1"><enum>(E)</enum><text display-inline="yes-display-inline">an assessment of the training opportunities
			 and technical assistance available to support ICAC task force grantees;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID24e0379bcbb848c2ac622bad5a4b5774"><enum>(F)</enum><text display-inline="yes-display-inline">an assessment of the success of the
			 Internet Crimes Against Children Task Force Program at leveraging State and
			 local resources and matching funds.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe038f66bc69744d3b17f409d6644edbd"><enum>(9)</enum><text display-inline="yes-display-inline">An assessment of the technical assistance
			 and support available for Federal, State, local, and tribal law enforcement
			 agencies, in the prevention, investigation, and prosecution of child
			 exploitation crimes.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID18baa47c7d594fefa3f3c5eaf694e7d2"><enum>(10)</enum><text display-inline="yes-display-inline">A review of the backlog of forensic
			 analysis for child exploitation cases at each FBI Regional Forensic lab and an
			 estimate of the backlog at State and local labs.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbb1ae24e29cc466f9c0c353b168ed944"><enum>(11)</enum><text display-inline="yes-display-inline">Plans for reducing the forensic backlog
			 described in paragraph (10), if any, at Federal, State and local forensic
			 labs.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72d7490310424e6fa4d19bc081b68693"><enum>(12)</enum><text display-inline="yes-display-inline">A review of the Federal programs related to
			 child exploitation prevention and education, including those related to
			 Internet safety, including efforts by the private sector and nonprofit
			 entities, or any other initiatives, that have proven successful in promoting
			 child safety and Internet safety.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID147111bf52414dc4a535cd66eaacd1b2"><enum>(13)</enum><text display-inline="yes-display-inline">An assessment of the future trends,
			 challenges, and opportunities, including new technologies, that will impact
			 Federal, State, local, and tribal efforts to combat child exploitation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72ede953719743979bd7f7dd80d91743"><enum>(14)</enum><text display-inline="yes-display-inline">Plans for liaisons with the judicial
			 branches of the Federal and State governments on matters relating to child
			 exploitation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7e75c91ced214893af6a6f008b5e2bcc"><enum>(15)</enum><text display-inline="yes-display-inline">An assessment of Federal investigative and
			 prosecution activity relating to reported incidents of child exploitation
			 crimes, which shall include a number of factors, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id82B99D8F9A1349A195C2A03C277DEC05"><enum>(A)</enum><text display-inline="yes-display-inline">the number of high-priority suspects
			 (identified because of the volume of suspected criminal activity or because of
			 the danger to the community or a potential victim) who were investigated and
			 prosecuted;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCDDBA1427F6D4FEFBFB56960278B4CA8"><enum>(B)</enum><text display-inline="yes-display-inline">the number of investigations, arrests,
			 prosecutions and convictions for a crime of child exploitation; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ECBCC34228B49A19FA471A2A27AEA47"><enum>(C)</enum><text display-inline="yes-display-inline">the average sentence imposed and statutory
			 maximum for each crime of child exploitation.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e5f174fe91547eba49058a1aead9a5d"><enum>(16)</enum><text display-inline="yes-display-inline">A review of all available statistical data
			 indicating the overall magnitude of child pornography trafficking in the United
			 States and internationally, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID8bbcc260212047f8aef79cd813f14405"><enum>(A)</enum><text display-inline="yes-display-inline">the number of computers or computer users,
			 foreign and domestic, observed engaging in, or suspected by law enforcement
			 agencies and other sources of engaging in, peer-to-peer file sharing of child
			 pornography;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID277d10f558df4061a71a64395aac7b08"><enum>(B)</enum><text display-inline="yes-display-inline">the number of computers or computer users,
			 foreign and domestic, observed engaging in, or suspected by law enforcement
			 agencies and other reporting sources of engaging in, buying and selling, or
			 other commercial activity related to child pornography;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID11a3244ac2c3481aad40e3d3401c1204"><enum>(C)</enum><text display-inline="yes-display-inline">the number of computers or computer users,
			 foreign and domestic, observed engaging in, or suspected by law enforcement
			 agencies and other sources of engaging in, all other forms of activity related
			 to child pornography;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8289f21c3f954203a07a973a4918a035"><enum>(D)</enum><text display-inline="yes-display-inline">the number of tips or other statistical
			 data from the National Center for Missing and Exploited Children’s CyberTipline
			 and other data indicating the magnitude of child pornography trafficking;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID852c8a674b0e49b89fd0941ac36aa5ca"><enum>(E)</enum><text display-inline="yes-display-inline">any other statistical data indicating the
			 type, nature, and extent of child exploitation crime in the United States and
			 abroad.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID66496e73f6f749209cea7bea829c7670"><enum>(17)</enum><text display-inline="yes-display-inline">Copies of recent relevant research and
			 studies related to child exploitation, including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDd73fe9d30e734fd4b2f9042e5ddcdbb7"><enum>(A)</enum><text display-inline="yes-display-inline">studies related to the link between
			 possession or trafficking of child pornography and actual abuse of a
			 child;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc77ecd6d9d7412da62981b795efd5ca"><enum>(B)</enum><text display-inline="yes-display-inline">studies related to establishing a link
			 between the types of files being viewed or shared and the type of illegal
			 activity; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb19a3418e828494bb6d7637650a249f7"><enum>(C)</enum><text display-inline="yes-display-inline">any other research, studies, and available
			 information related to child exploitation.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1a8324b10c6d470eb9b3f08f104197e4"><enum>(18)</enum><text display-inline="yes-display-inline">A review of the extent of cooperation,
			 coordination, and mutual support between private sector and other entities and
			 organizations and Federal agencies, including the involvement of States, local
			 and tribal government agencies to the extent Federal programs are
			 involved.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2b8e8420dbcd499689915e11a245d890"><enum>(19)</enum><text display-inline="yes-display-inline">The results of the Project Safe Childhood
			 Conference or other conferences or meetings convened by the Department of
			 Justice related to combating child exploitation</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID849cf74277074b3c97ce0a8e99312f9b"><enum>(d)</enum><header display-inline="yes-display-inline">Appointment of high-level official</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id34570C9079B946849D857E44C1EA2A10"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General shall designate a
			 senior official at the Department of Justice to be responsible for coordinating
			 the development of the National Strategy established under subsection
			 (a).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idECEBFF5433D74CACBD886D5305D4A545"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The duties of the official designated under
			 paragraph (1) shall include—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5ce4e073ef644df5aa26b15923015bb0"><enum>(A)</enum><text display-inline="yes-display-inline">acting as a liaison with all Federal
			 agencies regarding the development of the National Strategy;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3bcb85f05e354f658581418751c7e8c4"><enum>(B)</enum><text display-inline="yes-display-inline">working to ensure that there is proper
			 coordination among agencies in developing the National Strategy;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd877375be9964f3fb76c9cff89808113"><enum>(C)</enum><text display-inline="yes-display-inline">being knowledgeable about budget priorities
			 and familiar with all efforts within the Department of Justice and the FBI
			 related to child exploitation prevention and interdiction; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3270ee8be97f4c0a80d7a5fcc3ed1fd6"><enum>(D)</enum><text display-inline="yes-display-inline">communicating the National Strategy to
			 Congress and being available to answer questions related to the strategy at
			 congressional hearings, if requested by committees of appropriate
			 jurisdictions, on the contents of the National Strategy and progress of the
			 Department of Justice in implementing the National Strategy.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H0FBED0CD1FBE4797A112230809B671DC" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Establishment of National ICAC Task Force
			 Program</header>
					<subsection commented="no" display-inline="no-display-inline" id="H955D867FF7174BF684002C17FC777030"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id1CBDE2B40BCE44FB903FEC5C147AE6CE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established within the Department
			 of Justice, under the general authority of the Attorney General, a National
			 Internet Crimes Against Children Task Force Program (hereinafter in this title
			 referred to as the <quote>ICAC Task Force Program</quote>), which shall consist
			 of a national program of State and local law enforcement task forces dedicated
			 to developing effective responses to online enticement of children by sexual
			 predators, child exploitation, and child obscenity and pornography
			 cases.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8AACF8486B9346DAA45B9547E55E6394"><enum>(2)</enum><header display-inline="yes-display-inline">Intent of Congress</header><text display-inline="yes-display-inline">It is the purpose and intent of Congress
			 that the ICAC Task Force Program established under paragraph (1) is intended to
			 continue the ICAC Task Force Program authorized under title I of the
			 Departments of Commerce, Justice, and State, the Judiciary, and Related
			 Agencies Appropriations Act, 1998, and funded under title IV of the Juvenile
			 Justice and Delinquency Prevention Act of 1974.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7160D1F795254ED593D1118D33E9C1EA"><enum>(b)</enum><header display-inline="yes-display-inline">National Program</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id0DEFEEFF00EF40569616208A77C92FD1"><enum>(1)</enum><header display-inline="yes-display-inline">State representation</header><text display-inline="yes-display-inline">The ICAC Task Force Program established
			 under subsection (a) shall include at least 1 ICAC task force in each
			 State.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID37fc9ae76f9b48419d4140e2a93d677c"><enum>(2)</enum><header display-inline="yes-display-inline">Capacity and continuity of
			 investigations</header><text display-inline="yes-display-inline">In order to
			 maintain established capacity and continuity of investigations and prosecutions
			 of child exploitation cases, the Attorney General, shall, in establishing the
			 ICAC Task Force Program under subsection (a) consult with and consider all 59
			 task forces in existence on the date of enactment of this Act. The Attorney
			 General shall include all existing ICAC task forces in the ICAC Task Force
			 Program, unless the Attorney General makes a determination that an existing
			 ICAC does not have a proven track record of success.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9aa92b0569d940459ecf8561ab4b12ce"><enum>(3)</enum><header display-inline="yes-display-inline">Ongoing
			 review</header><text display-inline="yes-display-inline">The Attorney General
			 shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idEA1F1C72D873482AB98FEB2F4712B957"><enum>(A)</enum><text display-inline="yes-display-inline">conduct periodic reviews of the
			 effectiveness of each ICAC task force established under this section;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73FBB57D987242549332A1B7EF7231F6"><enum>(B)</enum><text display-inline="yes-display-inline">have the discretion to establish a new task
			 force if the Attorney General determines that such decision will enhance the
			 effectiveness of combating child exploitation provided that the Attorney
			 General notifies Congress in advance of any such decision and that each state
			 maintains at least 1 ICAC task force at all times.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa657b04ba24460aa279ea9fdaca3bd7"><enum>(4)</enum><header display-inline="yes-display-inline">Training</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAE335A30C2034EFB97C14D955E8BB311"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General may establish national
			 training programs to support the mission of the ICAC task forces, including the
			 effective use of the National Internet Crimes Against Children Data
			 System.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B437165096B4BEA9F4D900CB196D393"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">In establishing training courses under this
			 paragraph, the Attorney General may not award any one entity other than a law
			 enforcement agency more than $2,000,000 annually to establish and conduct
			 training courses for ICAC task force members and other law enforcement
			 officials.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19C8441E96894D4A8EE6C09311B54E37"><enum>(C)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">The Attorney General shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="id13F814288BDD41D7AB074564187E5A2C"><enum>(i)</enum><text display-inline="yes-display-inline">conduct periodic reviews of the
			 effectiveness of each training session authorized by this paragraph; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idE68FEA27C2B845B48C2FFD0EA75D6CD6"><enum>(ii)</enum><text display-inline="yes-display-inline">consider outside reports related to the
			 effective use of Federal funding in making future grant awards for
			 training.</text>
								</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H21F6964326194244941856B0CDD27EFE" section-type="subsequent-section"><enum>113.</enum><header display-inline="yes-display-inline">Purpose of ICAC task forces</header><text display-inline="no-display-inline">The ICAC Task Force Program, and each State
			 or local ICAC task force that is part of the national program of task forces,
			 shall be dedicated toward—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HB55D17569CC045678DC5DBF53C6C409"><enum>(1)</enum><text display-inline="yes-display-inline">increasing the investigative capabilities
			 of State and local law enforcement officers in the detection, investigation,
			 and apprehension of Internet crimes against children offenses or offenders,
			 including technology-facilitated child exploitation offenses;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9171BECA36F4A7C8CED8EBEE72A147"><enum>(2)</enum><text display-inline="yes-display-inline">conducting proactive and reactive Internet
			 crimes against children investigations;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H015CB50ECB8849598F99A2FD0068E8C8"><enum>(3)</enum><text display-inline="yes-display-inline">providing training and technical assistance
			 to ICAC task forces and other Federal, State, and local law enforcement
			 agencies in the areas of investigations, forensics, prosecution, community
			 outreach, and capacity-building, using recognized experts to assist in the
			 development and delivery of training programs;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5502FDEB7634241AF5567652E421033"><enum>(4)</enum><text display-inline="yes-display-inline">increasing the number of Internet crimes
			 against children offenses being investigated and prosecuted in both Federal and
			 State courts;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE01BEBABC4504759B2794D55A6D45BE2"><enum>(5)</enum><text display-inline="yes-display-inline">creating a multiagency task force response
			 to Internet crimes against children offenses within each State;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd45b9b64375c400fbe37d7651ec1ecda"><enum>(6)</enum><text display-inline="yes-display-inline">participating in the Department of
			 Justice’s Project Safe Childhood initiative, the purpose of which is to combat
			 technology-facilitated sexual exploitation crimes against children;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H932E5FD0218D4C20AEC792F3FDB68CD8"><enum>(7)</enum><text display-inline="yes-display-inline">enhancing nationwide responses to Internet
			 crimes against children offenses, including assisting other ICAC task forces,
			 as well as other Federal, State, and local agencies with Internet crimes
			 against children investigations and prosecutions;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4A6914A623C49F19DF90594D778582"><enum>(8)</enum><text display-inline="yes-display-inline">developing and delivering Internet crimes
			 against children public awareness and prevention programs; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB500FEF323C84FA68552E1ABB6DA6C91"><enum>(9)</enum><text display-inline="yes-display-inline">participating in such other activities,
			 both proactive and reactive, that will enhance investigations and prosecutions
			 of Internet crimes against children.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="H9B673C6ED659429B90814C8EE3277ED3" section-type="subsequent-section"><enum>114.</enum><header display-inline="yes-display-inline">Duties and functions of task
			 forces</header><text display-inline="no-display-inline">Each State or local
			 ICAC task force that is part of the national program of task forces
			 shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H0B20BB2D10AD4E60B01B65BE39F4CC37"><enum>(1)</enum><text display-inline="yes-display-inline">consist of State and local investigators,
			 prosecutors, forensic specialists, and education specialists who are dedicated
			 to addressing the goals of such task force;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3748603476764109B8F638026C00995D"><enum>(2)</enum><text display-inline="yes-display-inline">work consistently toward achieving the
			 purposes described in section 113;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41EA6F3931BA48219BD6653654928B7B"><enum>(3)</enum><text display-inline="yes-display-inline">engage in proactive investigations,
			 forensic examinations, and effective prosecutions of Internet crimes against
			 children;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD1ACA1AD2AF45D9A8720699224B25D9"><enum>(4)</enum><text display-inline="yes-display-inline">provide forensic, preventive, and
			 investigative assistance to parents, educators, prosecutors, law enforcement,
			 and others concerned with Internet crimes against children;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H45C909B468C9452AB647981DE98B23D2"><enum>(5)</enum><text display-inline="yes-display-inline">develop multijurisdictional, multiagency
			 responses and partnerships to Internet crimes against children offenses through
			 ongoing informational, administrative, and technological support to other State
			 and local law enforcement agencies, as a means for such agencies to acquire the
			 necessary knowledge, personnel, and specialized equipment to investigate and
			 prosecute such offenses;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC1456D4269D4FB7BF64DF428E501E8E"><enum>(6)</enum><text display-inline="yes-display-inline">participate in nationally coordinated
			 investigations in any case in which the Attorney General determines such
			 participation to be necessary, as permitted by the available resources of such
			 task force;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF8D36D45BE6493B84DE01D1E58C02B"><enum>(7)</enum><text display-inline="yes-display-inline">establish or adopt investigative and
			 prosecution standards, consistent with established norms, to which such task
			 force shall comply;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF37F047791414837A74FB725486E15DF"><enum>(8)</enum><text display-inline="yes-display-inline">investigate, and seek prosecution on, tips
			 related to Internet crimes against children, including tips from Operation
			 Fairplay, the National Internet Crimes Against Children Data System established
			 in section 115, the National Center for Missing and Exploited Children’s
			 CyberTipline, ICAC task forces, and other Federal, State, and local agencies,
			 with priority being given to investigative leads that indicate the possibility
			 of identifying or rescuing child victims, including investigative leads that
			 indicate a likelihood of seriousness of offense or dangerousness to the
			 community;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C63BE7413194BE5AEC6400A53E8088"><enum>(9)</enum><text display-inline="yes-display-inline">develop procedures for handling seized
			 evidence;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35675AD7846140CDBEB70012215D7429"><enum>(10)</enum><text display-inline="yes-display-inline">maintain—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idCB1D13CF539A45D9AB02E2339011B3E4"><enum>(A)</enum><text display-inline="yes-display-inline">such reports and records as are required
			 under this subtitle; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9EA1809E320C47B1B453F19D79CC1596"><enum>(B)</enum><text display-inline="yes-display-inline">such other reports and records as
			 determined by the Attorney General; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H74016E7C00D34F6FB7B8646CF3C2D9DB"><enum>(11)</enum><text display-inline="yes-display-inline">seek to comply with national standards
			 regarding the investigation and prosecution of Internet crimes against
			 children, as set forth by the Attorney General, to the extent such standards
			 are consistent with the law of the State where the task force is
			 located.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="H01B52470AD1A4DC98BCF9949E5D64B90" section-type="subsequent-section"><enum>115.</enum><header display-inline="yes-display-inline">National Internet Crimes Against Children
			 Data System</header>
					<subsection commented="no" display-inline="no-display-inline" id="id417D6E23115E40EE8450929A835CC65C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General shall establish,
			 consistent with all existing Federal laws relating to the protection of
			 privacy, a National Internet Crimes Against Children Data System. The system
			 shall not be used to search for or obtain any information that does not involve
			 the use of the Internet to post or traffic images of child exploitation.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idC7F84D83381345FFA98B208D72B2FF67"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose of system</header><text display-inline="yes-display-inline">The National Internet Crimes Against
			 Children Data System established under subsection (a) shall be dedicated to
			 assisting and supporting credentialed law enforcement agencies authorized to
			 investigate child exploitation in accordance with Federal, State, local, and
			 tribal laws, including by providing assistance and support to—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID2489ec5727a34df5be62822c007b04cd"><enum>(1)</enum><text display-inline="yes-display-inline">Federal agencies investigating and
			 prosecuting child exploitation;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4edb1049eb0f47f6ad8b5379d8e10a87"><enum>(2)</enum><text display-inline="yes-display-inline">the ICAC Task Force Program established
			 under section 112;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID933100cb9b2d4a0ca0087e1e4d8ea0eb"><enum>(3)</enum><text display-inline="yes-display-inline">State, local, and tribal agencies
			 investigating and prosecuting child exploitation; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD5D0F0BDC4A4AD194856C4FE58DFCA8"><enum>(4)</enum><text display-inline="yes-display-inline">foreign or international law enforcement
			 agencies, subject to approval by the Attorney General.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id80F94476F14F447C800155D4BE137918"><enum>(c)</enum><header display-inline="yes-display-inline">Cyber safe deconfliction and information
			 sharing</header><text display-inline="yes-display-inline">The National Internet
			 Crimes Against Children Data System established under subsection (a)—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id5E0EF601DF3641AA821C915DCF4A7973"><enum>(1)</enum><text display-inline="yes-display-inline">shall be housed and maintained within the
			 Department of Justice or a credentialed law enforcement agency;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4943A8463D9A4CCB9CED95D6FBE7F4C8"><enum>(2)</enum><text display-inline="yes-display-inline">shall be made available for a nominal
			 charge to support credentialed law enforcement agencies in accordance with
			 subsection (b); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9ffd058de7ca4199add726fdeac71e66"><enum>(3)</enum><text display-inline="yes-display-inline">shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAE011F70B8B244B4991884F519AFF24F"><enum>(A)</enum><text display-inline="yes-display-inline">allow Federal, State, local, and tribal
			 agencies and ICAC task forces investigating and prosecuting child exploitation
			 to contribute and access data for use in resolving case conflicts;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4f00bcb3b45b4242b76a16f86240db82"><enum>(B)</enum><text display-inline="yes-display-inline">provide, directly or in partnership with a
			 credentialed law enforcement agency, a dynamic undercover infrastructure to
			 facilitate online law enforcement investigations of child exploitation;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID719b36ec373d48079e23e380a6516ab9"><enum>(C)</enum><text display-inline="yes-display-inline">facilitate the development of essential
			 software and network capability for law enforcement participants; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77f005c8ad97435ebbaaecea7a4c27db"><enum>(D)</enum><text display-inline="yes-display-inline">provide software or direct hosting and
			 support for online investigations of child exploitation activities, or, in the
			 alternative, provide users with a secure connection to an alternative system
			 that provides such capabilities, provided that the system is hosted within a
			 governmental agency or a credentialed law enforcement agency.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7498A08671A64A67BFB84516A726D902"><enum>(d)</enum><header display-inline="yes-display-inline">Collection and reporting of data</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idE4A196A3F5144572A92D916493CC1244"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Internet Crimes Against
			 Children Data System established under subsection (a) shall ensure the
			 following:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID6602467d601146308b885f6fb847db40"><enum>(A)</enum><header display-inline="yes-display-inline">Real-time reporting</header><text display-inline="yes-display-inline">All child exploitation cases involving
			 local child victims that are reasonably detectable using available software and
			 data are, immediately upon their detection, made available to participating law
			 enforcement agencies.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc9f85a51fb2d4972a92fad0a78cedd0a"><enum>(B)</enum><header display-inline="yes-display-inline">High-priority suspects</header><text display-inline="yes-display-inline">Every 30 days, at minimum, the National
			 Internet Crimes Against Children Data System shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="id4024C8255F8840BDA8754C439DFBE2CC"><enum>(i)</enum><text display-inline="yes-display-inline">identify high-priority suspects, as such
			 suspects are determined by the volume of suspected criminal activity or other
			 indicators of seriousness of offense or dangerousness to the community or a
			 potential local victim; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id186A64CFC9D74DF89C7594E7C29F247B"><enum>(ii)</enum><text display-inline="yes-display-inline">report all such identified high-priority
			 suspects to participating law enforcement agencies.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82ad914a6a284a019b9ca8b3274b70f5"><enum>(C)</enum><header display-inline="yes-display-inline">Annual
			 reports</header><text display-inline="yes-display-inline">Any statistical data
			 indicating the overall magnitude of child pornography trafficking and child
			 exploitation in the United States and internationally is made available and
			 included in the National Strategy, as is required under section
			 111(c)(16).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA62D7A82FAC486589578E2BA2CD2CD2"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
			 construed to limit the ability of participating law enforcement agencies to
			 disseminate investigative leads or statistical information in accordance with
			 State and local laws.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id43AC50BEDF3D450C841243A0101FDC2C"><enum>(e)</enum><header display-inline="yes-display-inline">Mandatory requirements of
			 network</header><text display-inline="yes-display-inline">The National Internet
			 Crimes Against Children Data System established under subsection (a) shall
			 develop, deploy, and maintain an integrated technology and training program
			 that provides—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID82905fec439f4b2b9e6176ab86c18786"><enum>(1)</enum><text display-inline="yes-display-inline">a secure, online system for Federal law
			 enforcement agencies, ICAC task forces, and other State, local, and tribal law
			 enforcement agencies for use in resolving case conflicts, as provided in
			 subsection (c);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7efd1db083e04329bde69f9a94fee27c"><enum>(2)</enum><text display-inline="yes-display-inline">a secure system enabling online
			 communication and collaboration by Federal law enforcement agencies, ICAC task
			 forces, and other State, local, and tribal law enforcement agencies regarding
			 ongoing investigations, investigatory techniques, best practices, and any other
			 relevant news and professional information;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID240451e3cddd4112a4ae8e15b48b04d1"><enum>(3)</enum><text display-inline="yes-display-inline">a secure online data storage and analysis
			 system for use by Federal law enforcement agencies, ICAC task forces, and other
			 State, local, and tribal law enforcement agencies;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb05388f683e3453e80d025f6a1ff1dcb"><enum>(4)</enum><text display-inline="yes-display-inline">secure connections or interaction with
			 State and local law enforcement computer networks, consistent with reasonable
			 and established security protocols and guidelines;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91e724cce8cb4b37b42fadda38aa5d29"><enum>(5)</enum><text display-inline="yes-display-inline">guidelines for use of the National Internet
			 Crimes Against Children Data System by Federal, State, local, and tribal law
			 enforcement agencies and ICAC task forces; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05bc96b0e3f1404589972451f02e1240"><enum>(6)</enum><text display-inline="yes-display-inline">training and technical assistance on the
			 use of the National Internet Crimes Against Children Data System by Federal,
			 State, local, and tribal law enforcement agencies and ICAC task forces.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H200E35BB42524826A126BFEF1FB2A3E6"><enum>(f)</enum><header display-inline="yes-display-inline">National Internet Crimes Against Children
			 Data System steering committee</header><text display-inline="yes-display-inline">The Attorney General shall establish a
			 National Internet Crimes Against Children Data System Steering Committee to
			 provide guidance to the Network relating to the program under subsection (e),
			 and to assist in the development of strategic plans for the System. The
			 Steering Committee shall consist of 10 members with expertise in child
			 exploitation prevention and interdiction prosecution, investigation, or
			 prevention, including—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H1EECDC2A6A6449AABCD2F71502579425"><enum>(1)</enum><text display-inline="yes-display-inline">3 representatives elected by the local
			 directors of the ICAC task forces, such representatives shall represent
			 different geographic regions of the country;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe280b7a28a204b108f6ea449b6bbbc9a"><enum>(2)</enum><text display-inline="yes-display-inline">1 representative of the Department of
			 Justice Office of Information Services;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80EED333F6C64E689EB6C21391512E12"><enum>(3)</enum><text display-inline="yes-display-inline">1 representative from Operation Fairplay,
			 currently hosted at the Wyoming Office of the Attorney General;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D5F006B8E69448BB975C0442750D22E"><enum>(4)</enum><text display-inline="yes-display-inline">1 representative from the law enforcement
			 agency having primary responsibility for hosting and maintaining the National
			 Internet Crimes Against Children Data System;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53E24A45A0F1478DBEC12900553F7997"><enum>(5)</enum><text display-inline="yes-display-inline">1 representative of the Federal Bureau of
			 Investigation’s Innocent Images National Initiative or Regional Computer
			 Forensic Lab program;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7DE2CF81ED843559916F43B2DE639E3"><enum>(6)</enum><text display-inline="yes-display-inline">1 representative of the Immigration and
			 Customs Enforcement’s Cyber Crimes Center;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE62894D4FB804F7AA8D0BE6DBC19D2E"><enum>(7)</enum><text display-inline="yes-display-inline">1 representative of the United States
			 Postal Inspection Service; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4BE10435BE42465C8647F6F6D4B01C00"><enum>(8)</enum><text display-inline="yes-display-inline">1 representative of the Department of
			 Justice.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE912A284A6A843A6AAB933989B22B10"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated for each of the fiscal years 2009 through 2016,
			 $2,000,000 to carry out the provisions of this section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id9781567480874CAB9AB0B316FF4EC1EE"><enum>(h)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to
			 authorize any activity that is inconsistent with any Federal law, regulation,
			 or constitutional constraint.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="HE2436CF1026F4E46A200F80042464D6D" section-type="subsequent-section"><enum>116.</enum><header display-inline="yes-display-inline">ICAC grant program</header>
					<subsection commented="no" display-inline="no-display-inline" id="H9F3C84418F254A1BACD8C48047BBF7C1"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H577358B2B4A04E028C7094895631004E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General is authorized to award
			 grants to State and local ICAC task forces to assist in carrying out the duties
			 and functions described under section 114.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA752D80EF5A8443EA12D9FBC32192E17"><enum>(2)</enum><header display-inline="yes-display-inline">Formula grants</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="H9EEFF045F2514FDC9400E9B944217541"><enum>(A)</enum><header display-inline="yes-display-inline">Development of formula</header><text display-inline="yes-display-inline">At least 75 percent of the total funds
			 appropriated to carry out this section shall be available to award or otherwise
			 distribute grants pursuant to a funding formula established by the Attorney
			 General in accordance with the requirements in
			 <internal-xref idref="H62EB0C21BDDC4CAA90091165F4504CEC" legis-path="106.(a)(2)(B)">subparagraph (B)</internal-xref>.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H62EB0C21BDDC4CAA90091165F4504CEC"><enum>(B)</enum><header display-inline="yes-display-inline">Formula requirements</header><text display-inline="yes-display-inline">Any formula established by the Attorney
			 General under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref> shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="HC9BDC0F5D0E044E6AB301575BD4D32C8"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that each State or local ICAC task
			 force shall, at a minimum, receive an amount equal to 0.5 percent of the funds
			 available to award or otherwise distribute grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">subparagraph (A)</internal-xref>; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HFB34F42BA16746ADBDEE7495C2F3DE39"><enum>(ii)</enum><text display-inline="yes-display-inline">take into consideration the following
			 factors:</text>
									<subclause commented="no" display-inline="no-display-inline" id="H49750386C9DB46CDBB837EB8F4086B4C"><enum>(I)</enum><text display-inline="yes-display-inline">The population of each State, as determined
			 by the most recent decennial census performed by the Bureau of the
			 Census.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H4F5E2AD89BEE4ABB908D10DBD2033CBC"><enum>(II)</enum><text display-inline="yes-display-inline">The number of investigative leads within
			 the applicant’s jurisdiction generated by Operation Fairplay, the ICAC Data
			 Network, the CyberTipline, and other sources.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H421908D53C974E64A29EAA20CB237E73"><enum>(III)</enum><text display-inline="yes-display-inline">The number of criminal cases related to
			 Internet crimes against children referred to a task force for Federal, State,
			 or local prosecution.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H8DF6D239011D4E86BCA2EAC88D3F71A7"><enum>(IV)</enum><text display-inline="yes-display-inline">The number of successful prosecutions of
			 child exploitation cases by a task force.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HA4B85C767062418F87F1FDE752B6983B"><enum>(V)</enum><text display-inline="yes-display-inline">The amount of training, technical
			 assistance, and public education or outreach by a task force related to the
			 prevention, investigation, or prosecution of child exploitation
			 offenses.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H53F541F66776494ABEF53D73595E3B05"><enum>(VI)</enum><text display-inline="yes-display-inline">Such other criteria as the Attorney General
			 determines demonstrate the level of need for additional resources by a task
			 force.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1BB50AECFBC94DB8924C049000D122E0"><enum>(3)</enum><header display-inline="yes-display-inline">Distribution of remaining funds based on
			 need</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="H449894314FF64B5D8248D467178B234B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any funds remaining from the total funds
			 appropriated to carry out this section after funds have been made available to
			 award or otherwise distribute formula grants under
			 <internal-xref idref="H9EEFF045F2514FDC9400E9B944217541" legis-path="106.(a)(2)(A)">paragraph (2)(A)</internal-xref> shall be
			 distributed to State and local ICAC task forces based upon need, as set forth
			 by criteria established by the Attorney General. Such criteria shall include
			 the factors under
			 <internal-xref idref="HFB34F42BA16746ADBDEE7495C2F3DE39" legis-path="106.(a)(2)(B)(ii)">paragraph (2)(B)(ii)</internal-xref>.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC09725B0C39F46D489CE8902B514F37"><enum>(B)</enum><header display-inline="yes-display-inline">Matching requirement</header><text display-inline="yes-display-inline">A State or local ICAC task force shall
			 contribute matching non-Federal funds in an amount equal to not less than 25
			 percent of the amount of funds received by the State or local ICAC task force
			 under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>. A State or local
			 ICAC task force that is not able or willing to contribute matching funds in
			 accordance with this subparagraph shall not be eligible for funds under
			 <internal-xref idref="H449894314FF64B5D8248D467178B234B" legis-path="106.(a)(3)(A)">subparagraph (A)</internal-xref>.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79BD819F77F8454DB18A3E62192C03C4"><enum>(C)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Attorney General may waive, in whole or
			 in part, the matching requirement under subparagraph (B) if the State or local
			 ICAC task force demonstrates good cause or financial hardship.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA3F8269482E64E2EA89DB0EBD8C5DA01"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HA7672C38EC424B3DB72FF9131202DC03"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each State or local ICAC task force seeking
			 a grant under this section shall submit an application to the Attorney General
			 at such time, in such manner, and accompanied by such information as the
			 Attorney General may reasonably require.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF544DB18C27A4D38854E851D0565C779"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each application submitted pursuant to
			 paragraph (1) shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H36D6ED7C12B6479A83EB00550117C564"><enum>(A)</enum><text display-inline="yes-display-inline">describe the activities for which
			 assistance under this section is sought; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC8923BD506E1473D8300EC6176766259"><enum>(B)</enum><text display-inline="yes-display-inline">provide such additional assurances as the
			 Attorney General determines to be essential to ensure compliance with the
			 requirements of this subtitle.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAC610608EDAB46259EED63E4C39600A1"><enum>(c)</enum><header display-inline="yes-display-inline">Allowable
			 Uses</header><text display-inline="yes-display-inline">Grants awarded under
			 this section may be used to—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HAE8292460CC1425DB55698DC76F02500"><enum>(1)</enum><text display-inline="yes-display-inline">hire personnel, investigators, prosecutors,
			 education specialists, and forensic specialists;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD4E0C978B7664531A209F8D2565937C5"><enum>(2)</enum><text display-inline="yes-display-inline">establish and support forensic laboratories
			 utilized in Internet crimes against children investigations;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7AC80AF327A7498B9884DE719D2D18F2"><enum>(3)</enum><text display-inline="yes-display-inline">support investigations and prosecutions of
			 Internet crimes against children;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55570CDFE0544072BFDD9F13D34EA3FF"><enum>(4)</enum><text display-inline="yes-display-inline">conduct and assist with education programs
			 to help children and parents protect themselves from Internet predators;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDEE77A290B14D5A8E53C64DB1BD7258"><enum>(5)</enum><text display-inline="yes-display-inline">conduct and attend training sessions
			 related to successful investigations and prosecutions of Internet crimes
			 against children; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD969F8F1B70143F4BE43FFEC529EB45"><enum>(6)</enum><text display-inline="yes-display-inline">fund any other activities directly related
			 to preventing, investigating, or prosecuting Internet crimes against
			 children.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF81B93F81B94855B75DA162D89B9228"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting Requirements</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HEE91E7E914994F88001358F600C774EE"><enum>(1)</enum><header display-inline="yes-display-inline">ICAC reports</header><text display-inline="yes-display-inline">To measure the results of the activities
			 funded by grants under this section, and to assist the Attorney General in
			 complying with the Government Performance and Results Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law
			 103–62</external-xref>; 107 Stat. 285), each State or local ICAC task force
			 receiving a grant under this section shall, on an annual basis, submit a report
			 to the Attorney General that sets forth the following:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H2B5B8CA1B92D4FA5B2F924119BA014D8"><enum>(A)</enum><text display-inline="yes-display-inline">Staffing levels of the task force,
			 including the number of investigators, prosecutors, education specialists, and
			 forensic specialists dedicated to investigating and prosecuting Internet crimes
			 against children.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4DC37CB782F44A3DBFAA86B083D0C81F"><enum>(B)</enum><text display-inline="yes-display-inline">Investigation and prosecution performance
			 measures of the task force, including—</text>
								<clause commented="no" display-inline="no-display-inline" id="HB0DDDD7F1D20410893B680C884F983A2"><enum>(i)</enum><text display-inline="yes-display-inline">the number of investigations initiated
			 related to Internet crimes against children;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H28C2403466C8475AA0CBAA353F22C063"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of arrests related to Internet
			 crimes against children; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H8850A59D416D443485C16DBC74776673"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of prosecutions for Internet
			 crimes against children, including—</text>
									<subclause commented="no" display-inline="no-display-inline" id="H079188C986A148BCB3D2CD00DD57CA16"><enum>(I)</enum><text display-inline="yes-display-inline">whether the prosecution resulted in a
			 conviction for such crime; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HBECBC79E53B441E0005D779B1C78388D"><enum>(II)</enum><text display-inline="yes-display-inline">the sentence and the statutory maximum for
			 such crime under State law.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H980A06D5183040D489100016958B94F2"><enum>(C)</enum><text display-inline="yes-display-inline">The number of referrals made by the task
			 force to the United States Attorneys office, including whether the referral was
			 accepted by the United States Attorney.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H017380C7503C4F5E919BFF800A836B1"><enum>(D)</enum><text display-inline="yes-display-inline">Statistics that account for the disposition
			 of investigations that do not result in arrests or prosecutions, such as
			 referrals to other law enforcement.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D50F72320FA4EE093D630C70966DFE"><enum>(E)</enum><text display-inline="yes-display-inline">The number of investigative technical
			 assistance sessions that the task force provided to nonmember law enforcement
			 agencies.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H623FDD21B6D4473400A5F8644FCA8203"><enum>(F)</enum><text display-inline="yes-display-inline">The number of computer forensic
			 examinations that the task force completed.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB1217F0CBD74781BEA63151F542FEEF"><enum>(G)</enum><text display-inline="yes-display-inline">The number of law enforcement agencies
			 participating in Internet crimes against children program standards established
			 by the task force.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H229DC7F6AF304DDBB485D7B42DFF1D14"><enum>(2)</enum><header display-inline="yes-display-inline">Report to congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Attorney General shall submit a report to Congress
			 on—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HB9CD52DAE40F4B818C32D2FD8F7DC92C"><enum>(A)</enum><text display-inline="yes-display-inline">the progress of the development of the ICAC
			 Task Force Program established under section 112; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDC2BA7721CCE4ED99CDA40FEA7894A"><enum>(B)</enum><text display-inline="yes-display-inline">the number of Federal and State
			 investigations, prosecutions, and convictions in the prior 12-month period
			 related to child exploitation.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HC77EE830635544A7AC886B8390F2A508" section-type="subsequent-section"><enum>117.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
					<subsection commented="no" display-inline="no-display-inline" id="H676387854D2D4779AFDA88B3DFAFB612"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 carry out this subtitle—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H7B7F26368BBC4AA39FE8A84DCCEA8FA0"><enum>(1)</enum><text display-inline="yes-display-inline">$60,000,000 for fiscal year 2009;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0B33FDA1A14242E79E1B00D0B9DAABA5"><enum>(2)</enum><text display-inline="yes-display-inline">$60,000,000 for fiscal year 2010;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3138C335F2F949F386A271AA2EC6FE6C"><enum>(3)</enum><text display-inline="yes-display-inline">$60,000,000 for fiscal year 2011;</text>

			 shall remain available until expended.</text>
					</subsection></section></subtitle><subtitle commented="no" id="id62BF4BE90D6C46AB85C1EDCAC63774AA" level-type="subsequent"><enum>B</enum><header display-inline="yes-display-inline">ADDITIONAL MEASURES TO COMBAT CHILD
			 EXPLOITATION </header>
				<section commented="no" display-inline="no-display-inline" id="HCC48CBE86D7E4D68B1DA40058D405085" section-type="subsequent-section"><enum>121.</enum><header display-inline="yes-display-inline">Additional regional computer forensic
			 labs</header>
					<subsection commented="no" display-inline="no-display-inline" id="H0827F49E9C5441C39737DE30B6B256FC"><enum>(a)</enum><header display-inline="yes-display-inline">Additional Resources</header><text display-inline="yes-display-inline">The Attorney General shall establish
			 additional computer forensic capacity to address the current backlog for
			 computer forensics, including for child exploitation investigations. The
			 Attorney General may utilize funds under this subtitle to increase capacity at
			 existing regional forensic laboratories or to add laboratories under the
			 Regional Computer Forensic Laboratories Program operated by the Federal Bureau
			 of Investigation.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H7733EDDF10204A59A80785B571D386B1"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose of New Resources</header><text display-inline="yes-display-inline">The additional forensic capacity
			 established by resources provided under this section shall be dedicated to
			 assist Federal agencies, State and local Internet Crimes Against Children task
			 forces, and other Federal, State, and local law enforcement agencies in
			 preventing, investigating, and prosecuting Internet crimes against
			 children.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idD9216AC5878F4D0A82B255B71520FA5E"><enum>(c)</enum><header display-inline="yes-display-inline">New Computer Forensic labs</header><text display-inline="yes-display-inline">If the Attorney General determines that new
			 regional computer forensic laboratories are required under subsection (a) to
			 best address existing backlogs, such new laboratories shall be established
			 pursuant to subsection (d).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H1C7F9D1B25244311A4BFEE934B5BB1F"><enum>(d)</enum><header display-inline="yes-display-inline">Location of New Labs</header><text display-inline="yes-display-inline">The location of any new regional computer
			 forensic laboratories under this section shall be determined by the Attorney
			 General, in consultation with the Director of the Federal Bureau of
			 Investigation, the Regional Computer Forensic Laboratory National Steering
			 Committee, and other relevant stakeholders.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H41020E9651B643BCA5341FE798AF09A3"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and every year thereafter, the Attorney General shall
			 submit a report to the Congress on how the funds appropriated under this
			 section were utilized.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H8EBA01C12976474B9068926CD6926F72"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated for fiscal years 2009 through 2013, $2,000,000 to
			 carry out the provisions of this section.</text>
					</subsection></section></subtitle><subtitle commented="no" id="idCF584731891E4D6794E6ABC79B951031" level-type="subsequent"><enum>C</enum><header display-inline="yes-display-inline">Effective child pornography
			 prosecution</header>
				<section commented="no" display-inline="no-display-inline" id="ID701f42db034b4acfa4054158e9297ca0" section-type="subsequent-section"><enum>131.</enum><header display-inline="yes-display-inline">Amendment to section 2256 of title 18,
			 United States Code</header><text display-inline="no-display-inline">Section
			 2256(5) of title 18, United States Code is amended by—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID8bcd9f9305cf4cf0a83601e39610f249"><enum>(1)</enum><text display-inline="yes-display-inline">striking <quote>and</quote> before
			 <quote>data</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbd47d50152f4434b8bc94f11df789ffe"><enum>(2)</enum><text display-inline="yes-display-inline">after <quote>visual image</quote> by
			 inserting <quote>, and data which is capable of conversion into a visual image
			 that has been transmitted by any means, whether or not stored in a permanent
			 format</quote>.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDbeadbdf090b3480ba77c95a4b91d5de7" section-type="subsequent-section"><enum>132.</enum><header display-inline="yes-display-inline">Amendment to section 2260 of title 18,
			 United States Code</header><text display-inline="no-display-inline">Section
			 2260(a) of title 18, United States Code, is amended by—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID164e6ad8aec042ce85da4629b6faee72"><enum>(1)</enum><text display-inline="yes-display-inline">inserting <quote>or for the purpose of
			 transmitting a live visual depiction of such conduct</quote> after <quote>for
			 the purpose of producing any visual depiction of such conduct</quote>;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDef244b4ae5a9406d9acbe57f0dd571e8"><enum>(2)</enum><text display-inline="yes-display-inline">inserting <quote>or transmitted</quote>
			 after <quote>imported</quote>.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="idD7546AD2EFF84168976961A6FA37A659" section-type="subsequent-section"><enum>133.</enum><header display-inline="yes-display-inline">Prohibiting the adaptation or modification
			 of an image of an identifiable minor to produce child pornography</header>
					<subsection commented="no" display-inline="no-display-inline" id="id7C9F1D9ABF0144E5879B15452024FC7A"><enum>(a)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline">Subsection (a) of section 2252A of title
			 18, United States Code, is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idA346FEAE4ABA4EF9B14E8CA9F05F3782"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>;

			 18, United States Code, is amended by adding at the end the following:</text>

					</subsection></section></subtitle><subtitle commented="no" id="idD1721753EE22425F8B0CA0AD394E46EE" level-type="subsequent"><enum>D</enum><header display-inline="yes-display-inline">National Institute of Justice Study of Risk
			 Factors</header>
				<section commented="no" display-inline="no-display-inline" id="ID15c8fe336eb443a38f6c801fc433299c" section-type="subsequent-section"><enum>141.</enum><header display-inline="yes-display-inline">NIJ study of risk factors for assessing
			 dangerousness</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID67039e8bf67146409509e8cfe39eb884"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the National Institute of Justice shall prepare a report
			 to identify investigative factors that reliably indicate whether a subject of
			 an online child exploitation investigation poses a high risk of harm to
			 children. Such a report shall be prepared in consultation and coordination with
			 Federal law enforcement agencies, the National Center for Missing and Exploited
			 Children, Operation Fairplay at the Wyoming Attorney General's Office, the
			 Internet Crimes Against Children Task Force, and other State and local law
			 enforcement.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID41fee81b9bf04a89a66bda57f191554f"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of analysis</header><text display-inline="yes-display-inline">The report required by subsection (a) shall
			 include a thorough analysis of potential investigative factors in on-line child
			 exploitation cases and an appropriate examination of investigative data from
			 prior prosecutions and case files of identified child victims.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idD000D3C2D0A849FDAD225AC5A29C9690"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the National Institute of Justice shall submit a report
			 to the House and Senate Judiciary Committees that includes the findings of the
			 study required by this section and makes recommendations on technological tools
			 and law enforcement procedures to help investigators prioritize scarce
			 resources to those cases where there is actual hands-on abuse by the
			 suspect.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idDB91912AA8B14927B2902873E98178FD"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $500,000 to the National Institute of Justice to
			 conduct the study required under this section.</text>
					</subsection></section></subtitle></title><title commented="no" id="idAE83AE15D96E4EF9842A499970F077C2" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Enhancing the Effective Prosecution of
			 Child Pornography Act of 2007</header>
			<section commented="no" display-inline="no-display-inline" id="id9005AD9EDFED4C53A49764078A001F95" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote>Enhancing the Effective Prosecution of Child Pornography Act of
			 2007</quote>.</text>

			 communication service providers and remote computing service providers</header>
				<subsection commented="no" display-inline="no-display-inline" id="id58643705BCBB4CDD8FBCCC982A18659E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 110 of title 18, United States
			 Code, is amended by inserting after section 2258 the following:</text>

				communication service providers and remote computing service providers</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID3e3fddae45d24a8c851bb8f77b573d98"><enum>(a)</enum><header display-inline="yes-display-inline">Duty To report</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7d5a67be3a0c425ba0dbb6ec8acef791"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Whoever, while engaged in providing an
				electronic communication service or a remote computing service to the public
				through a facility or means of interstate or foreign commerce, obtains actual
				knowledge of any facts or circumstances described in paragraph (2) shall, as
				soon as reasonably possible—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDf390f0e299104fb6b7bc49aa3307cc74"><enum>(A)</enum><text display-inline="yes-display-inline">complete and maintain with current
				information a registration with the CyberTipline of the National Center for
				Missing and Exploited Children, or any successor to the CyberTipline operated
				by such center, by providing the mailing address, telephone number, facsimile
				number, electronic mail address of, and individual point of contact for, such
				electronic communication service provider or remote computing service provider;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID142ad7952e1e4aeda5261b1970533668"><enum>(B)</enum><text display-inline="yes-display-inline">make a report of such facts or
				circumstances to the CyberTipline, or any successor to the CyberTipline
				operated by such center.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76141326c8bf44e19d9e9151968c3bd7"><enum>(2)</enum><header display-inline="yes-display-inline">Facts or circumstances</header><text display-inline="yes-display-inline">The facts or circumstances described in
				this paragraph are any facts or circumstances that appear to indicate a
				violation of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDd3d40549e21b42a38c86f5f20f4535ce"><enum>(A)</enum><text display-inline="yes-display-inline">section 2251, 2251A, 2252, 2252A, 2252B, or
				2260 that involves child pornography; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa9a35b168fc24eaa9fb5f0dcc90a8848"><enum>(B)</enum><text display-inline="yes-display-inline">section 1466A.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID95a216417cea4b65b8781fd45bf29303"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of report</header><text display-inline="yes-display-inline">To the extent available to an electronic
				communication service provider or a remote computing service provider, each
				report under subsection (a)(1) shall include the following information:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID00f0a1ee240f423cbda3b79a17c4f35b"><enum>(1)</enum><header display-inline="yes-display-inline">Information about the involved
				individual</header><text display-inline="yes-display-inline">Information
				relating to the Internet identity of any individual who appears to have
				violated a Federal law in the manner described in subsection (a)(2), which
				shall, to the extent reasonably practicable, include the electronic mail
				address, website address, uniform resource locator, or any other identifying
				information, including self-reported identifying information.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbde3b6b0d6574fb6948d622012a6081c"><enum>(2)</enum><header display-inline="yes-display-inline">Historical reference</header><text display-inline="yes-display-inline">Information relating to when any apparent
				child pornography was uploaded, transmitted, reported to, or discovered by the
				electronic communication service provider or remote computing service provider,
				as the case may be, including a date and time stamp and time zone.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID03de55110b9f458a8a13ce8f04cedcde"><enum>(3)</enum><header display-inline="yes-display-inline">Geographic location
				information</header><text display-inline="yes-display-inline">Information
				relating to the geographic location of the involved individual, hosting
				website, or uniform resource locator, which shall include the Internet Protocol
				Address or verified billing address, or, if not reasonably available, at least
				1 form of geographic identifying information, including area code or zip code.
				The information shall also include any self-reported geographic
				information.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDda9f9e751cd440249341c050cac42a89"><enum>(4)</enum><header display-inline="yes-display-inline">Images of apparent child
				pornography</header><text display-inline="yes-display-inline">Any image of any
				apparent child pornography relating to the incident such report is
				regarding.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa239910cec004fd0a117a7c41d9abb4d"><enum>(5)</enum><header display-inline="yes-display-inline">Commingled images</header><text display-inline="yes-display-inline">Any images, data, or other digital files
				(collectively referred to as <quote>digital files</quote>) which are commingled
				or interspersed among the images of apparent child pornography. If it would
				impose an undue hardship to provide these commingled digital files as part of
				the report, because of the volume of the digital files or for other reasons,
				the reporting company shall, in lieu of providing those digital files, inform
				the CyberTipline of the existence of such digital files, and retain those
				digital files as if they were part of the report as required pursuant to
				subsection (h).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0177e11c23c84337a0f0083ced9ae6d9"><enum>(c)</enum><header display-inline="yes-display-inline">Forwarding of report to law
				enforcement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID279fc6400a544c57ba5880ab1fa5fce0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children shall forward each report made under subsection (a)(1) to
				any appropriate law enforcement agency designated by the Attorney General under
				subsection (d)(2).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc228135bafa54c16956a7b0171a73862"><enum>(2)</enum><header display-inline="yes-display-inline">State and local law
				enforcement</header><text display-inline="yes-display-inline">The National
				Center for Missing and Exploited Children may forward any report made under
				subsection (a)(1) to an appropriate official of a State or political
				subdivision of a State for the purpose of enforcing State criminal law.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe079c60fb17e461ca0cce9c1f9e9602e"><enum>(3)</enum><header display-inline="yes-display-inline">Foreign law enforcement</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children may forward any report made under subsection (a)(1) to any
				appropriate foreign law enforcement agency designated by the Attorney General
				under subsection (d)(3), subject to the conditions established by the Attorney
				General under subsection (d)(3).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID44598f2857a74a48a1c8be66e83b13e7"><enum>(d)</enum><header display-inline="yes-display-inline">Attorney general responsibilities</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7bcac8ab5aa14cf2ab6a6a0370aec932"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General shall enforce this
				section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8afbd060f34943e494aa5b378bb55a6c"><enum>(2)</enum><header display-inline="yes-display-inline">Designation of Federal
				agencies</header><text display-inline="yes-display-inline">The Attorney General
				shall designate promptly the Federal law enforcement agency or agencies to
				which a report shall be forwarded under subsection (c)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e8ccf67f88f42409e2bec3a21a3cbb1"><enum>(3)</enum><header display-inline="yes-display-inline">Designation of foreign
				agencies</header><text display-inline="yes-display-inline">The Attorney General
				shall promptly—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID55184cc6d3214a39baa3f02aef32645b"><enum>(A)</enum><text display-inline="yes-display-inline">designate the foreign law enforcement
				agencies to which a report may be forwarded under subsection (c)(3);</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd914c8af6a654663945922239c4f533c"><enum>(B)</enum><text display-inline="yes-display-inline">establish the conditions under which such a
				report may be forwarded to such agencies; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID764d11aa49b544f680a256d7cc591ee4"><enum>(C)</enum><text display-inline="yes-display-inline">develop a process for foreign law
				enforcement agencies to request assistance from Federal law enforcement
				agencies in obtaining evidence relating to a report referred under subsection
				(c)(3).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6eb2b28fd3324effabb8db71820c2d18"><enum>(e)</enum><header display-inline="yes-display-inline">Failure To report</header><text display-inline="yes-display-inline">An electronic communication service
				provider or remote computing service provider that knowingly and willfully
				fails to make a report required under subsection (a)(1) shall be fined—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDb838c0a9a52d436096613d90b4de1fe7"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of an initial knowing and
				willful failure to make a report, not more than $150,000; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8aac029093eb430b8c7f2f427fc840f8"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of any second or subsequent
				knowing and willful failure to make a report, not more than $300,000.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc1957f1beb9142c9aa82457a98320bbe"><enum>(f)</enum><header display-inline="yes-display-inline">Protection of privacy</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to require an electronic communication service provider or a remote computing
				service provider to—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDb7e7d46a5e524677b46f40a6e18459ff"><enum>(1)</enum><text display-inline="yes-display-inline">monitor any user, subscriber, or customer
				of that provider;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa865c133866b4d4aaf9297436ccecbac"><enum>(2)</enum><text display-inline="yes-display-inline">monitor the content of any communication of
				any person described in paragraph (1); or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9e5e587b00c346c78a7c21f7c57f9565"><enum>(3)</enum><text display-inline="yes-display-inline">affirmatively seek facts or circumstances
				described in subsection (a)(2).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID83c0ba9cf08c4d819a53748ac969d8bf"><enum>(g)</enum><header display-inline="yes-display-inline">Conditions of disclosure information
				contained within report</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID809b0b1d45fa40dea17e011e59899176"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a law
				enforcement agency that receives a report under subsection (c) shall not
				disclose any information contained in that report.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9a16b806ff664fbb9bf03350cce3210d"><enum>(2)</enum><header display-inline="yes-display-inline">Permitted disclosures</header><text display-inline="yes-display-inline">A law enforcement agency may disclose
				information in a report received under subsection (c)—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID4413b7b5d5eb44b79b774dbea44d65c0"><enum>(A)</enum><text display-inline="yes-display-inline">to an attorney for the government for use
				in the performance of the official duties of that attorney;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3db01a465995443db79caf6e0842f878"><enum>(B)</enum><text display-inline="yes-display-inline">to such officers and employees of that law
				enforcement agency, as may be necessary in the performance of their
				investigative and recordkeeping functions;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbc25d5e51d634be0931ae21a7534df20"><enum>(C)</enum><text display-inline="yes-display-inline">to such other government personnel
				(including personnel of a State or subdivision of a State) as are determined to
				be necessary by an attorney for the government to assist the attorney in the
				performance of the official duties of the attorney in enforcing Federal
				criminal law;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDeca92d75233c4c8ea16e05965b9d19ff"><enum>(D)</enum><text display-inline="yes-display-inline">if the report discloses a violation of
				State criminal law, to an appropriate official of a State or subdivision of a
				State for the purpose of enforcing such State law;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5d022b4674704974aafd0828bee2bc33"><enum>(E)</enum><text display-inline="yes-display-inline">to a defendant in a criminal case or the
				attorney for that defendant, to the extent the information relates to a
				criminal charge pending against that defendant;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4796a4f449e14fd6bc8b9781a01fcce9"><enum>(F)</enum><text display-inline="yes-display-inline">to an electronic communication service
				provider or remote computing provider if necessary to facilitate response to
				legal process issued in connection to that report, in which case, the
				electronic communication service provider or remote computing service provider
				shall be prohibited from disclosing the contents of that report to any person,
				except as necessary to respond to the legal process; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID692c9f7f9f7b45ae9d035dc32ea004c1"><enum>(G)</enum><text display-inline="yes-display-inline">as ordered by a court upon a showing of
				good cause and pursuant to any protective orders or other conditions that the
				court may impose.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4e87d6e451854c5eac4114a9f3d9648b"><enum>(h)</enum><header display-inline="yes-display-inline">Evidence preservation</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID66373a349f634047ad3ce4610828367b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the purposes of this section, the
				notification to an electronic communication service provider or a remote
				computing service provider by the CyberTipline of receipt of a report under
				subsection (a)(1) shall be treated as notice to preserve, as if such notice was
				made pursuant to section 2703(f).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf1f1c26cf73e42c2b4fabb0e9585e2ed"><enum>(2)</enum><header display-inline="yes-display-inline">Preservation of report</header><text display-inline="yes-display-inline">Pursuant to paragraph (1), an electronic
				communication service provider or a remote computing service shall preserve the
				contents of the report provided under subsection (a)(1) and the information
				described in section 2703(c)(2) relating to the involved individual for not
				less than 180 days after the date of submission of the report under subsection
				(a)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1a150ffe229e4a669dcc289b16b8efb4"><enum>(3)</enum><header display-inline="yes-display-inline">Authorities and duties not
				affected</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed as replacing, amending, or otherwise interfering
				with the authorities and duties under section 2703.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id68275CB5E57149F883A66E2D551A6D8C" section-type="subsequent-section"><enum>2258B.</enum><header display-inline="yes-display-inline">Limited liability for electronic
				communication service providers, remote computing service providers, or domain
				name registrar</header>
							<subsection commented="no" display-inline="no-display-inline" id="id23E83D68D4984D0B8200D428033E93D0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsections (b) and
				(c), a civil claim or criminal charge against an electronic communication
				service provider, a remote computing service provider, or domain name
				registrar, including any director, officer, employee, or agent of such
				electronic communication service provider, remote computing service provider,
				or domain name registrar arising from the performance of the reporting
				responsibilities of such electronic communication service provider, remote
				computing service provider, or domain name registrar under this section,
				section 2258A, or section 2258C may not be brought in any Federal or State
				court.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idC16FAEEE7A544124B0F3960BCEF7E7BD"><enum>(b)</enum><header display-inline="yes-display-inline">Intentional, reckless, or other
				misconduct</header><text display-inline="yes-display-inline">Subsection (a)
				shall not apply to a claim if the electronic communication service provider,
				remote computing service provider, or domain name registrar, or a director,
				officer, employee, or agent of that electronic communication service provider,
				remote computing service provider, or domain name registrar—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id414CC814D57345EDBE56ECD6B8492D96"><enum>(1)</enum><text display-inline="yes-display-inline">engaged in intentional misconduct;
				or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1BA91D38CBC245CE9792766A191DFA7A"><enum>(2)</enum><text display-inline="yes-display-inline">acted, or failed to act—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9EA5D9FBE0CE4CFE92FE6C16F00786DF"><enum>(A)</enum><text display-inline="yes-display-inline">with actual malice;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1FCFA0B7F244414FBFE9283490AC15AE"><enum>(B)</enum><text display-inline="yes-display-inline">with reckless disregard to a substantial
				risk of causing injury without legal justification; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC7EE2A8069C4049B435ADE2F860A94F"><enum>(C)</enum><text display-inline="yes-display-inline">for a purpose unrelated to the performance
				of any responsibility or function under this section, section 2258A, or section
				2258C.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id52592B108ADC4009B257B5FDA06DD076"><enum>(c)</enum><header display-inline="yes-display-inline">Ordinary business activities</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an act or
				omission relating to an ordinary business activity of an electronic
				communication service provider, a remote computing service provider, or domain
				name registrar, including general administration or operations, the use of
				motor vehicles, or personnel management.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id60814D3C68D048239D63D7D669D9B093"><enum>(d)</enum><header display-inline="yes-display-inline">Minimizing access</header><text display-inline="yes-display-inline">An electronic communication service
				provider, a remote computing service provider, and domain name registrar
				shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id9EB09DFD3638442F949FAC65055F185B"><enum>(1)</enum><text display-inline="yes-display-inline">minimize the number of employees that are
				provided access to any image provided under section 2258A or 2258C; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3D15F40944344058ECA73E662228D2F"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that any such image is permanently
				destroyed, upon notification from a law enforcement agency.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3004CEC3F0DB46FC85B4A551153E2A41" section-type="subsequent-section"><enum>2258C.</enum><header display-inline="yes-display-inline">Use of images from the CyberTipline to
				combat child pornography</header>
							<subsection commented="no" display-inline="no-display-inline" id="idAC3B05F46413442EB59AC3F7B21FE3C4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children is authorized to provide elements relating to any image
				reported to its CyberTipline to an electronic communication service provider or
				a remote computing service provider for the sole and exclusive purpose of
				permitting that electronic communication service provider or remote computing
				service provider to stop the further transmission of images. Such elements may
				include unique identifiers associated with a specific image, Internet location
				of images, and other technological elements that can be used to identify and
				stop the transmission of child pornography.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idCEAA9009AA3F495F80492D93571D873B"><enum>(b)</enum><header display-inline="yes-display-inline">Use by electronic communication service
				providers and remote computing service providers</header><text display-inline="yes-display-inline">Any electronic communication service
				provider or remote computing service provider that receives elements relating
				to an image from the National Center for Missing and Exploited Children under
				this section may use such information only for the purposes described in this
				section, provided that such use shall not relieve that electronic communication
				service provider or remote computing service provider from its reporting
				obligations under section 2258A.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id6CEE6946A6AD4E38B23070D210542040" section-type="subsequent-section"><enum>2258D.</enum><header display-inline="yes-display-inline">Limited liability for the National Center
				for Missing and Exploited Children</header>
							<subsection commented="no" display-inline="no-display-inline" id="id140355E1A1804AB0A71E445BF7ADBF47"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsections (b) and
				(c), a civil claim or criminal charge against the National Center for Missing
				and Exploited Children, including any director, officer, employee, or agent of
				such center, arising from the performance of the CyberTipline responsibilities
				or functions of such center, as described in this section, section 2258A or
				2258C of this title, or section 404 of the Missing Children's Assistance Act
				(42 U.S.C. 5773), or from the effort of such center to identify child victims
				may not be brought in any Federal or State court.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idDEF97F19C2EF485F8E67F58796417C01"><enum>(b)</enum><header display-inline="yes-display-inline">Intentional, reckless, or other
				misconduct</header><text display-inline="yes-display-inline">Subsection (a)
				shall not apply to a claim or charge if the National Center for Missing and
				Exploited Children, or a director, officer, employee, or agent of such
				center—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id5786E8E5792B413A8477BA66A0475485"><enum>(1)</enum><text display-inline="yes-display-inline">engaged in intentional misconduct;
				or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62DF50CDFF6D4AB29C850375CF670EA8"><enum>(2)</enum><text display-inline="yes-display-inline">acted, or failed to act—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idA2E95C98F5014C368C426AF497CA1EAE"><enum>(A)</enum><text display-inline="yes-display-inline">with actual malice;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2D53543DAE24CBAAD328C4285458457"><enum>(B)</enum><text display-inline="yes-display-inline">with reckless disregard to a substantial
				risk of causing injury without legal justification; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF23D3F92C0B9425795F05D1AE4439B20"><enum>(C)</enum><text display-inline="yes-display-inline">for a purpose unrelated to the performance
				of any responsibility or function under this section, section 2258A or 2258C of
				this title, or section 404 of the Missing Children's Assistance Act (42 U.S.C.
				5773).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA998128065CE4E04ABFF0BA8DE71148E"><enum>(c)</enum><header display-inline="yes-display-inline">Ordinary business activities</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an act or
				omission relating to an ordinary business activity, including general
				administration or operations, the use of motor vehicles, or personnel
				management.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id6D31746E4FD14FE1889C2E7F06CA610F"><enum>(d)</enum><header display-inline="yes-display-inline">Minimizing access</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idC6BC49E9EB3D49A68241B85E707E1292"><enum>(1)</enum><text display-inline="yes-display-inline">minimize the number of employees that are
				provided access to any image provided under section 2258A; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06605A68FFA64808A6F0FBCB68CDED57"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that any such image is permanently
				destroyed upon notification from a law enforcement agency.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id28B6ADB49DB0464F99C2B51048ABF36F" section-type="subsequent-section"><enum>2258E.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In sections 2258A through 2258D—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idC43DD097ED434ECE87BD95DA7F50E426"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>attorney for the
				government</term> and <term>State</term> have the meanings given those terms in
				rule 1 of the Federal Rules of Criminal Procedure;</text>

				meaning given that term in section 1101 of the Internet Tax Freedom Act (47
				U.S.C. 151 note);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F3537F2C428472EB94554B44D1D0985"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>remote computing
				service</term> has the meaning given that term in section 2711; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA006B9815A7942CDBB57CDA48CDE1471"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>website</term> means any
				collection of material placed in a computer server-based file archive so that
				it is publicly accessible, over the Internet, using hypertext transfer protocol
				or any successor

						<subparagraph commented="no" display-inline="no-display-inline" id="idBA3E888E6D8B4AD4929E1D89A47A5962"><enum>(A)</enum><text display-inline="yes-display-inline">inserting <quote>or for the purpose of
			 transmitting a live visual depiction of such conduct</quote> after <quote>for
			 the purpose of producing any visual depiction of such conduct</quote>;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc3f74c101424ad7a27d28d90d7d9999"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>transported</quote> the
			 first place it appears and all that follows and inserting the following:
			 <quote>transported or transmitted in or affecting interstate or foreign
			 commerce or using a facility or means of interstate or foreign commerce or
			 mailed, if that visual depiction was produced or transmitted using materials
			 that have been mailed, shipped, or transported in interstate or foreign
			 commerce by any means, including by computer, or if such visual depiction has
			 actually been transported or transmitted in or affecting interstate or foreign
			 commerce or using a facility or means of interstate or foreign commerce or
			 mailed.</quote>;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1b2b96d256ee4654aeea64745105ecac"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)(2), by striking
			 <quote>computer</quote> each place it appears and inserting <quote>using a
			 facility or means of interstate or foreign commerce</quote>; and</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0a33338a092343359a2599045d767853"><enum>(c)</enum><header display-inline="yes-display-inline">Certain activities relating to material
			 involving the sexual exploitation of minors</header><text display-inline="yes-display-inline">Section 2252(a) of title 18, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf4dfa29c1a314ec5b76f34f31df67d39"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>in
			 interstate or foreign commerce by any means including by computer</quote> and
			 inserting <quote>in or affecting interstate or foreign commerce or using a
			 facility or means of interstate or foreign commerce</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd970edec1b7a43c6b1364be42625c61e"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), in the matter preceding

			 States Code, is amended by striking <quote>transported in interstate or foreign
			 commerce by any means, including by computer</quote> the first place it appears
			 and inserting <quote>transported in or affecting interstate or foreign commerce
			 or using a facility or means of interstate or foreign commerce</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd61066de28ee4167b2ca841a1325d678"><enum>(f)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section or the amendments
			 made by this section may be construed to—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf7a7204ac7cc4ae7847191604c034c6f"><enum>(1)</enum><text display-inline="yes-display-inline">imply that there is not an overlap between
			 conduct in or affecting interstate or foreign commerce and conduct using a
			 facility or means of interstate or foreign commerce; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24e5b1fe9bfe4d28bef01d1c7c8eb8a9"><enum>(2)</enum><text display-inline="yes-display-inline">foreclose any argument or ruling with
			 respect to any Federal law that, for the purposes of Federal jurisdiction, the
			 use of a facility or means of interstate or foreign commerce affects interstate
			 or foreign commerce.</text>
