		<official-title>To provide for the resolution of several land ownership
		  and related issues with respect to parcels of land located within the
		  Everglades National Park. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Everglades National Park Land
			 Exchange Act of 2008</short-title></quote>.</text>
		</section><section id="ID53ad3c1149704cb9bc9db365a94a4a63"><enum>2.</enum><header>Findings;
			 purpose</header>
			<subsection id="ID741dcbdfc3eb41b29548991cc762703a"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID40ddb84c811d4fd986cd827e9cf821d0"><enum>(1)</enum><text>the Everglades
			 National Park is a nationally and internationally significant resource
			 adversely affected by external factors that have altered the natural
			 hydrological conditions within the boundary of the National Park;</text>
				</paragraph><paragraph id="IDce5399d172744dd79934cbeb8c5ef7ec"><enum>(2)</enum><text>section 102(a) of
			 the Everglades National Park Protection and Expansion Act of 1989 (16 U.S.C.
			 410r–6(a)) modified the boundary of the National Park to include 107,600 acres
			 of land located in the Northeast Shark River Slough and the East Everglades,
			 each area of which is critical to the hydrology of the National Park;</text>
				</paragraph><paragraph id="ID21dc3cf027274a86a821e740e9ae1edf"><enum>(3)</enum><text>the construction
			 of modifications to the Central and South Florida Project authorized under
			 section 104(a) of the Everglades National Park Protection and Expansion Act of
			 1989 (16 U.S.C. 410r–8(a)) is designed to improve water deliveries to the
			 National Park through physical and operational modifications to the
			 Project;</text>
				</paragraph><paragraph id="ID8fe8ed292cc14c76a2afb62d30d86c0b"><enum>(4)</enum><text>the Comprehensive
			 Everglades Restoration Plan approved by section 601(b) of the Water Resources
			 Development Act of 2000 (114 Stat. 2680) provides guidance for the
			 implementation of numerous restoration projects located in the Everglades of
			 the State of Florida, including projects that would ultimately benefit the
			 National Park;</text>
				</paragraph><paragraph id="ID523a29c4d9e34759adae933a6504d351"><enum>(5)</enum><text>the success of
			 the Project, the Plan, and the future ecological health of the Everglades of
			 the State depends in part on the resolution of several land ownership issues
			 relating to parcels of land located in the National Park;</text>
				</paragraph><paragraph id="ID80f540b7aacd4b7e899963a7e35e68ca"><enum>(6)</enum><text>the United States
			 has entered into a contingent agreement that—</text>
					<subparagraph id="id1ED6828B28104D6BB2F42AA1AE977C1E"><enum>(A)</enum><text>provides for the
			 exchange of land with the Florida Power &amp; Light Company; and</text>
					</subparagraph><subparagraph id="idA3A638A6A88E44C3BB1FDB56E51E084B"><enum>(B)</enum><text>is contingent on
			 the approval of Congress;</text>
					</subparagraph></paragraph><paragraph id="idAC82097271E54B18B1B532275F70A653"><enum>(7)</enum><text>the land exchange
			 proposed in the Agreement is critical to the success of the Project;</text>
				</paragraph><paragraph id="ID4e841d13b2c04880b786da4f35a32024"><enum>(8)</enum><text>the Osceola
			 family of Roy Cypress has occupied the area of the National Park commonly known
			 as the <quote>William McKinley Osceola Hammock</quote> since before the date on
			 which the National Park was established; and</text>
				</paragraph><paragraph id="idADDF8540EE084955A5F39304747995D7"><enum>(9)</enum><text>the interests of
			 the Family and the United States would be enhanced by a further delineation of
			 the rights and obligations of each party because the Hammock may be impacted by
			 construction of improvements relating to the Project.</text>
				</paragraph></subsection><subsection id="IDbe369c2ce42b46748f3469d75d97a681"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to direct, facilitate, and expedite the exchange of
			 certain Federal land and non-Federal land in the State to further the public
			 interest by—</text>
				<paragraph id="ID83c745a1953c4533ba22c8483b20ac18"><enum>(1)</enum><text>authorizing an
			 exchange of land held by the United States that is affected by the
			 construction, operation, and maintenance of a relocated and raised section of
			 the Tamiami Trail, U.S. Rt. 41 roadway, pursuant to the Project;</text>
				</paragraph><paragraph id="ID57625978890a4f3dacca8766d61a3fae"><enum>(2)</enum><text>ratifying and
			 executing a contingent agreement between the United States and the Company to
			 exchange and relocate certain property interests of the Company (including the
			 provision of easements and other actions); and</text>
				</paragraph><paragraph id="ID3d8add29aef843dab0493ec9ae1dd737"><enum>(3)</enum><text>authorizing the
			 Secretary to enter into an agreement with the Family to allow the Family to
			 occupy and use certain parcels of land located in the National Park for
			 purposes consistent with the purposes and resource values of the National
			 Park.</text>
				</paragraph></subsection></section><section id="ID4c781055b579469fb812ec048b7ec54f"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID2e7013b359984522a2b198ba06c26dae"><enum>(1)</enum><header>Agreement</header><text>The
			 term <term>Agreement</term> means the agreement described in the
			 document—</text>
				<subparagraph id="id86A15D1521C24B3AB0C513E60C2D982D"><enum>(A)</enum><text>entitled
			 <quote>Contingent Agreement Between the United States of America and Florida
			 Power &amp; Light Company for Exchange and Relocation of Florida Power &amp;
			 Light Company’s Property Located In or Adjacent to the Everglades National Park
			 Expansion Area</quote>; and</text>
				</subparagraph><subparagraph id="id0EF3DB127D5444EEA62770CADE2EF698"><enum>(B)</enum><text>executed by the
			 United States and the Company on July 24, 2008, including any subsequent
			 amendments to the document.</text>
				</subparagraph></paragraph><paragraph id="idEC569F3A86C64C888A4389FC4D68E97F"><enum>(2)</enum><header>Company</header><text>The
			 term <term>Company</term> means the Florida Power &amp; Light Company.</text>
			</paragraph><paragraph id="idEE5AD89606E84AFCAD89D29D68956150"><enum>(3)</enum><header>Family</header><text>The
			 term <term>Family</term> means the Osceola family of Roy Cypress.</text>
			</paragraph><paragraph id="IDa69cabe164204db7966283d88c9ad91d"><enum>(4)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the parcels of land
			 that are—</text>
				<subparagraph id="id660362866DE145B28F564AA2CEB7C976"><enum>(A)</enum><text>owned by the
			 United States;</text>
				</subparagraph><subparagraph id="idBBA3832A4E644B358D5544A6399DEC7C"><enum>(B)</enum><text>administered by
			 the Secretary;</text>
				</subparagraph><subparagraph id="id25B87820774643A082766AD84F1E2D1D"><enum>(C)</enum><text>located within
			 the National Park; and</text>
				</subparagraph><subparagraph id="id55AEF90749344071B7CA1656741647BE"><enum>(D)</enum><text>generally
			 depicted on the map as—</text>
					<clause id="ID7130256e711944b3905cd6ff55d39922"><enum>(i)</enum><text>Tract
			 <inline-comment>___</inline-comment>, which is adjacent to the Tamiami Trail,
			 U.S. Rt. 41, in existence as of the date of enactment of this Act; and</text>
					</clause><clause id="ID7dc786ff761a4a0fa4957b09b40abb57"><enum>(ii)</enum><text>Tract
			 <inline-comment>____</inline-comment>, which is located on the eastern boundary
			 of the National Park.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe7d61e32d13a4a729fdd15c2593a2429"><enum>(5)</enum><header>Hammock</header><text>The
			 term <term>Hammock</term> means the parcel of land that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id10E2F19D8774454584AB9A191EC9C9A4"><enum>(A)</enum><text>commonly known as
			 the <quote>William McKinley Osceola Hammock</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE38DAB9B775142E192FD305BE1F8E3AD"><enum>(B)</enum><text>generally
			 depicted on the map as Tract <inline-comment>___</inline-comment>.</text>
				</subparagraph></paragraph><paragraph id="ID9db224c563dd40329f9232a9b1d457ad"><enum>(6)</enum><header>Map</header><text>The
			 term <term>map</term> means the map prepared by the National Park Service,
			 entitled “<inline-comment>____</inline-comment>”, numbered
			 <inline-comment>____</inline-comment>, and dated
			 <inline-comment>____</inline-comment>.</text>
			</paragraph><paragraph id="ID41808e3aac404d269bb494b1e41b5158"><enum>(7)</enum><header>Modified water
			 deliveries project</header><text>The term <term>modified water deliveries
			 project</term> means the modifications to the Project authorized under section
			 104(a) of the Everglades National Park Protection and Expansion Act of 1989 (16
			 U.S.C. 410r–8(a)).</text>
			</paragraph><paragraph id="ID69b7d77db9b04709a9936c550d0e31af"><enum>(8)</enum><header>National
			 Park</header><text>The term <term>National Park</term> means the Everglades
			 National Park located in the State.</text>
			</paragraph><paragraph id="ID8ae9157500f4412d801c464d0abe5ca8"><enum>(9)</enum><header>Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means the area of
			 land located in the State that is comprised of land that—</text>
				<subparagraph id="IDad1a9fcfe5b6498289903a5762b3211c"><enum>(A)</enum><text>is owned by the
			 State, the specific area and location of which shall be determined by the
			 State; and</text>
				</subparagraph><subparagraph id="ID778aeb5907b04b4a90cade0f4fdc2c80"><enum>(B)</enum><text>is owned by the
			 Company—</text>
					<clause id="idE67C9F0501B54727801FA3A093870A0B"><enum>(i)</enum><text>the
			 area of which comprises approximately 320 acres; and</text>
					</clause><clause id="idD7AC60A2BBA848E5A1D967E5E90F6C23"><enum>(ii)</enum><text>the location of
			 which is within the East Everglades Acquisition Area, as generally depicted on
			 the map as Tract <inline-comment>___</inline-comment>.</text>
					</clause></subparagraph></paragraph><paragraph id="id2F0F5AA2ACC9429BBCABBA72AB1EB154"><enum>(10)</enum><header>Plan</header><text>The
			 term <term>Plan</term> means the Comprehensive Everglades Restoration
			 Plan—</text>
				<subparagraph id="id2A4A5026C4AD42C1BCFD08CD203C84D8"><enum>(A)</enum><text>contained in the
			 Final Integrated Feasibility Report and Programmatic Environmental Impact
			 Statement, dated April 1, 1999; and</text>
				</subparagraph><subparagraph id="id3F43FD19559647828AC6A78BCBF303F3"><enum>(B)</enum><text>approved under
			 section 601(b) of the Water Resources Development Act of 2000 (114 Stat.
			 2680).</text>
				</subparagraph></paragraph><paragraph id="id627A787FBAD8446FA21A63CA4C00D1C8"><enum>(11)</enum><header>Project</header><text>The
			 term <term>Project</term> means the Central and Southern Florida
			 Project.</text>
			</paragraph><paragraph id="ID976513fb4df748a9942d4a9cc3a99830"><enum>(12)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8f4503718479467282982021a8deecb5"><enum>(13)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Florida.</text>
			</paragraph></section><section id="ID09f4cb79f08846c6bbe953c0f5b5efcd"><enum>4.</enum><header>Land
			 exchange</header>
			<subsection id="ID705bd426bb2a46a99ee86b6b4b2f6b58"><enum>(a)</enum><header>Land exchange
			 authorized</header><text>If the State offers to convey to the Secretary all
			 right, title, and interest of the State in and to the non-Federal land, and the
			 offer is acceptable to the Secretary, the Secretary shall, subject to valid
			 existing rights—</text>
				<paragraph id="id935A0716502448D7987BFEA31813EB4F"><enum>(1)</enum><text>accept the offer;
			 and</text>
				</paragraph><paragraph id="idC40B53F592304133BAF2D8203CB1D510"><enum>(2)</enum><text>convey to the
			 State all right, title, and interest of the United States in and to the Federal
			 land.</text>
				</paragraph></subsection><subsection id="ID40dae5703c90491e840552dddecad761"><enum>(b)</enum><header>Terms and
			 conditions</header><text>The land exchange under subsection (a) shall be
			 subject to such terms and conditions as the Secretary may require.</text>
			</subsection><subsection id="idB03B95B973D046568C8449A6197B211A"><enum>(c)</enum><header>Appraisals;
			 equalization</header>
				<paragraph id="id87B1D51ECE28447C8EC670D30547AA72"><enum>(1)</enum><header>Appraisals</header>
					<subparagraph id="id6C7561273C34431A888046D26CA75B97"><enum>(A)</enum><header>In
			 general</header><text>The Federal land and non-Federal land shall be appraised
			 by an independent appraiser selected by the Secretary.</text>
					</subparagraph><subparagraph id="idD9ED31588CE84998A9FADE23351D3383"><enum>(B)</enum><header>Standards</header><text>An
			 appraisal conducted under subparagraph (A) shall be conducted in accordance
			 with—</text>
						<clause id="idA5605E4133ED4045B72BC8DE56DD4927"><enum>(i)</enum><text>the
			 Uniform Appraisal Standards for Federal Land Acquisitions; and</text>
						</clause><clause id="id9C74024453C14048B07980C2DE7E61CB"><enum>(ii)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice.</text>
						</clause></subparagraph></paragraph><paragraph id="IDe783a2e1d07945a99ee9f83f9ec48c84"><enum>(2)</enum><header>Equalization</header><text>If
			 the values of the Federal land and the non-Federal land to be conveyed in the
			 land exchange under subsection (a) are not equal, the values may be equalized
			 by—</text>
					<subparagraph id="id5BA2981DA5EF439187E140E8533FB56E"><enum>(A)</enum><text>donation;</text>
					</subparagraph><subparagraph id="id5C654C9F623F4AED9C5B8A41CE03DCC0"><enum>(B)</enum><text>payment using
			 donated or appropriated funds; or</text>
					</subparagraph><subparagraph id="idDC819535408546D3B17D25451929E608"><enum>(C)</enum><text>the conveyance of
			 additional parcels of land.</text>
					</subparagraph></paragraph></subsection><subsection id="idC21B61A035EF49D2A24FF95A73932F24"><enum>(d)</enum><header>Deadline for
			 completion of exchange</header>
				<paragraph id="id8D442D3731D74380A723A59A22826E4E"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the land exchange
			 under subsection (a) shall be completed by not later than the date that is 90
			 days after the date on which the results of each appraisal conducted under
			 subsection (c)(1) are received by the Secretary and the State.</text>
				</paragraph><paragraph id="idFBF884D482F546CB98C7195A42775C19"><enum>(2)</enum><header>Exception</header><text>In
			 a case in which the Secretary or the State disputes the results of any
			 appraisal conducted under subsection (c)(1), the land exchange under subsection
			 (a) shall be completed by not later than the date that is 90 days after the
			 date on which the Secretary and the State resolve the dispute.</text>
				</paragraph></subsection><subsection id="id75D9CBF11F084CDF8DFAAD0935BB56D1"><enum>(e)</enum><header>Technical
			 corrections</header><text>Subject to the agreement of the State, the Secretary
			 may make—</text>
				<paragraph id="id07602D42D67547EE8130D6BC99DB8FF8"><enum>(1)</enum><text>minor corrections
			 to correct technical and clerical errors in the legal descriptions of the
			 Federal and non-Federal land; and</text>
				</paragraph><paragraph id="id5281DFEC22E9430AA73FB7441AD05482"><enum>(2)</enum><text>minor adjustments
			 to the boundaries of the Federal and non-Federal land.</text>
				</paragraph></subsection><subsection id="id77B9A807927D458B9795E410E81FE679"><enum>(f)</enum><header>Administration
			 of land acquired by Secretary</header><text>Land acquired by the Secretary
			 through the land exchange under subsection (a) shall—</text>
				<paragraph id="id082A7C1D186C44F7A20D678EA1CF3A73"><enum>(1)</enum><text>become part of
			 the National Park; and</text>
				</paragraph><paragraph id="id8BD17106BA064689A55EE0F07E9AF75D"><enum>(2)</enum><text>be administered
			 in accordance with the laws (including regulations) applicable to the National
			 Forest System.</text>
				</paragraph></subsection><subsection id="idC1D6A6E6B75248769C35B9EF25632A08"><enum>(g)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the National Park Service.</text>
			</subsection></section><section id="IDecc77d66e7fb498e94772e42f255b16b"><enum>5.</enum><header>Ratification of
			 contingent agreement between the United States and the Company</header>
			<subsection id="ID3041aa1920534a638283ebead9b55154"><enum>(a)</enum><header>Ratification of
			 agreement</header><text>The Agreement (including each term, condition,
			 procedure, covenant, reservation, and other provision contained in the
			 Agreement) is ratified.</text>
			</subsection><subsection id="IDacdfc09baac54c309088d0f8efa48867"><enum>(b)</enum><header>Execution of
			 agreement</header>
				<paragraph id="idDB2FFD84C67E4F59B6035974C59B4C5B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary shall execute the Agreement (including the land
			 exchange under section 4(a)).</text>
				</paragraph><paragraph id="id7BC77F5246C742838A189B55B9916461"><enum>(2)</enum><header>Technical
			 corrections</header>
					<subparagraph id="idD99E7558976648FC9CF3EC13CED52A0B"><enum>(A)</enum><header>In
			 general</header><text>In accordance with subparagraph (B), the Secretary,
			 subject to the agreement of the Company, may make minor corrections to correct
			 technical and clerical errors with respect to any land description or
			 instrument of conveyance contained in the Agreement.</text>
					</subparagraph><subparagraph id="id659280546F0C460BB51CE607CDAED0C7"><enum>(B)</enum><header>Written notice
			 requirement</header><text>To make a minor correction under subparagraph (A),
			 the Secretary shall provide written notice, the duration of which shall be not
			 less than 30 days, to—</text>
						<clause id="idFC10B3B75ECB4354A146FD53C02B65CF"><enum>(i)</enum><text>the
			 Committee on Energy and Natural Resources of the Senate; and</text>
						</clause><clause id="id92A5591C1DD34ABBBB3FBBB1EA0DB315"><enum>(ii)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID18f8d60ea5714ad39ada3f12205dadd9"><enum>(c)</enum><header>Environmental
			 assessment</header>
				<paragraph id="idEDDBF17CF70F4CBE87C277E7E6333910"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, in accordance with paragraph (2), the Secretary may prepare an
			 environmental assessment regarding the land exchange under section 4(a).</text>
				</paragraph><paragraph id="idAF08E64D34BD490591991590581490EA"><enum>(2)</enum><header>Requirements</header><text>In
			 preparing the environmental assessment under paragraph (1), the Secretary
			 shall—</text>
					<subparagraph id="idAAA652D99D2F44C1A88C7DED065CE260"><enum>(A)</enum><text>identify
			 any—</text>
						<clause id="idFE535505898E4BC98203290BF5FD369F"><enum>(i)</enum><text>immediate and
			 proximate effect that may arise from the land exchange under section 4(a);
			 and</text>
						</clause><clause id="id36AF6413906A494B811541A19CB0FBEC"><enum>(ii)</enum><text>potential
			 mitigation measure that the Secretary determines to be appropriate for each
			 immediate and proximate effect identified under clause (i); and</text>
						</clause></subparagraph><subparagraph id="id6B637F0FDE3C405796386DA5753BD0F2"><enum>(B)</enum><text>provide for a
			 period of public notice and comment with respect to the land exchange under
			 section 4(a).</text>
					</subparagraph></paragraph></subsection></section><section id="IDbc3240fb00c3404a9b104e2b017edbc3"><enum>6.</enum><header>Osceola family
			 perpetual use and occupancy agreement</header>
			<subsection id="IDcfff6158391842b2ac4b438ba8d5859b"><enum>(a)</enum><header>Perpetual use
			 and occupancy agreement</header><text>In accordance with subsection (b), and
			 subject to subsection (c), the Secretary may enter into an agreement with the
			 Family to allow the Family to occupy and use the Hammock in perpetuity for the
			 purpose of a domestic residence.</text>
			</subsection><subsection id="ID652cb95a850c4c0c9017be93efa9b35f"><enum>(b)</enum><header>Protection of
			 National Park</header><text>An agreement entered into by the Secretary under
			 subsection (a) shall ensure that the occupancy and use of the Hammock by the
			 Family—</text>
				<paragraph id="ID3d30cb5abc824fac93cc62753c1a10d3"><enum>(1)</enum><text>is carried out in
			 a manner consistent with—</text>
					<subparagraph id="id5BA6C3B741DF47CDBBB9B2B840E16FF6"><enum>(A)</enum><text>this Act;</text>
					</subparagraph><subparagraph id="idD5A281BEA69349588D424933BB4471D9"><enum>(B)</enum><text>the purposes and
			 resources of the National Park; and</text>
					</subparagraph><subparagraph id="id96CF050231A147A09FE49AE45D3DCCEB"><enum>(C)</enum><text>all applicable
			 laws (including regulations), including laws governing commercial activities
			 within the National Park (including regulations); and</text>
					</subparagraph></paragraph><paragraph id="IDf9c5c969e673411ba16c8feea5c4b744"><enum>(2)</enum><text>does not prevent
			 the Secretary from constructing any improvements necessary to allow for the
			 completion of the Project.</text>
				</paragraph></subsection><subsection id="IDf953c25de9d3430ba2dd12fd688f4588"><enum>(c)</enum><header>Preservation of
			 Hammock</header><text>Subject to the written approval of the Secretary, the
			 area of the Hammock shall not be enlarged—</text>
				<paragraph id="id17AEAC38201B4314B94B57D2D5D20006"><enum>(1)</enum><text>through the
			 addition of fill; or</text>
				</paragraph><paragraph id="id323566673DFF4902BC428AEF80D453A3"><enum>(2)</enum><text>by any other
			 means.</text>
				</paragraph></subsection></section></legis-body>
