			<paragraph id="H6A9E4F0DC8E74A289D5B497FC38E39AA"><enum>(1)</enum><text>According to the
			 United States Census, over 23,000,000 United States residents do not speak
			 English well.</text>
			</paragraph><paragraph id="HE11CCC45C28644E600E5AEE2817914D"><enum>(2)</enum><text>According to the
			 National Assessment of Adult Literacy, 93,000,000 adults in the United States
			 have limited reading, writing, and mathematics skills, and 14 percent of adults
			 in the United States have below basic proficiency in prose literacy.</text>
			</paragraph><paragraph id="H49F54B1EE27E42369C4801C36E2B5800"><enum>(3)</enum><text>Only three percent
			 of the 93,000,000 adults who could benefit from adult education services,
			 English literacy, and civics education programs actually participate in such
			 services and programs.</text>
			</paragraph><paragraph id="H362CEA2B8C304D55AE2C927375002F47"><enum>(4)</enum><text>There is a growing
			 and urgent need for additional English literacy and civics education programs
			 for adults in the United States.</text>
			</paragraph><paragraph id="H293ECB4F7E364FE89EDA212B2718117C"><enum>(5)</enum><text>It is beneficial
			 to new immigrants, host communities, States, and the Nation for immigrants to
			 timely adjust to life in the United States, learn English, become citizens, buy
			 homes, start businesses, send their children to college, and thrive
			 economically.</text>
			</paragraph><paragraph id="H40B32BC545664AC800B4771DA9AA93F"><enum>(6)</enum><text>A
			 proactive policy for new Americans at the State and local levels will maximize
			 the benefits immigrants bring to States and municipalities, while helping
			 immigrants integrate as quickly as possible.</text>
			</paragraph></section><title id="H0A53BD9A9FF5449000D9085911B17341"><enum>I</enum><header>Expanding English
			 Literacy and Civics Education</header>
			<section id="idF7D3B7A1E5CB4583A0FD8F0425F9BB17"><enum>101.</enum><header>Increased
			 investment in English acquisition under the Adult Education and Family Literacy
			 Act</header>
				<subsection id="H7EC9D606FA6D457294F41752617053CD"><enum>(a)</enum><header>Integrated
			 English literacy and civics education program</header><text>Section 203 of the
			 Adult Education and Family Literacy Act (20 U.S.C. 9202) is amended by adding
			 at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE58D05F5FC05497BB90000D92FD12BBD" style="OLC">
						<paragraph id="HCC929287EEEB4B98B621559E2276BE7E"><enum>(19)</enum><header>Integrated
				English literacy and civics education program</header><text display-inline="yes-display-inline">The term <quote>integrated English literacy
				and civics education program</quote> means a program of instruction designed to
				help an English language learner achieve competence in English through
				contextualized instruction on the rights and responsibilities of citizenship,
				naturalization procedures, civic participation, and United States history and
				government to help such learner acquire the skills and knowledge to become an
				active and informed parent, worker, and community
				member.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H8906141E7E0B4C00A18135B4FC69200"><enum>(b)</enum><header>State leadership
			 activities</header><text display-inline="yes-display-inline">Section 223(a) of
			 the such Act (20 U.S.C. 9223(a)) is amended by inserting after paragraph (11)
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H24E75E92E0AA48F1B7251EE24F536DAF" style="OLC">
						<paragraph id="HBDFE5405E2F64E16B3733207200065F1"><enum>(12)</enum><text display-inline="yes-display-inline">Technical assistance for grant applications
				of faith and community-based organizations.</text>
						</paragraph><paragraph id="HC5FF95E3CFC2408BA921FC7CD33C2E47"><enum>(13)</enum><text>The study of the
				effectiveness of distance learning or self-study programs to assist the English
				language learner population acquire
				English.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H3889D3E635C842C99E1F60EF1FF21E91"><enum>(c)</enum><header>National
			 Institute for Literacy</header><text>Section 242(c)(1) of such Act (20 U.S.C.
			 9252(c)(1)) is amended—</text>
					<paragraph id="H92CDB40DE784445EA3B6362794F99E6E"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
						<subparagraph id="H74AA6A9B8F1841E58B4FF639EBE12C19"><enum>(A)</enum><text>by redesignating
			 clauses (ii), (iii), and (iv) as clauses (iii), (iv), and (v), respectively;
			 and</text>
						</subparagraph><subparagraph id="H25F8697FCF474FECB61BEE70497504E3"><enum>(B)</enum><text>by inserting after
			 clause (i) the following new clause:</text>

			 subparagraph (F) the following new subparagraph:</text>

			 by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph id="HB9985BC6E9604FDC97466C849FB2E9E"><enum>(2)</enum><text>by
			 redesignating paragraph (3) as paragraph (4); and</text>
					</paragraph><paragraph id="H725DE836059A49E39B95001EC895B477"><enum>(3)</enum><text>by inserting after

				instructional needs based on the English ability and educational attainment of
				English language learners under recent migration patterns;
				and</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H6A2F57EC8FC547E9BEECC8E32110FA82"><enum>(e)</enum><header>National
			 leadership activities</header><text>Section 243 of such Act (20 U.S.C. 9253) is
			 amended—</text>
					<paragraph id="H496E7D632E0F4D8A85E7263E0053B753"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="H1847D3782CC64786AD96FAF63691E297"><enum>(A)</enum><text>in subparagraph

				participants in such programs to increase their civic participation and, if
				applicable, lead such participants to become United States
				citizens.</text>

							</clause></subparagraph></paragraph></subsection><subsection id="HF4F7229910B3429E001CED60BC12C"><enum>(f)</enum><header>Integrated English
			 literacy and civics education</header><text>Chapter 4 of subtitle A of such Act
			 (20 U.S.C. 9251 et seq.) is amended by adding at the end the following new
			 section:</text>

						<section id="H9FD87648E4394EA6AA572604BC970009"><enum>244.</enum><header>Integrated
				English literacy and civics education programs</header>
							<subsection id="idA37B2D11A6C5413BA78968E13A74EE15"><enum>(a)</enum><header>Program
				authorized</header>
								<paragraph id="H00360062CF61408FA53EDECD843DDBB1"><enum>(1)</enum><header>In
				general</header><text>From funds appropriated to carry out this section, the
				Secretary shall award grants to States, from allocations under subsection (b),
				for integrated English literacy and civics education programs.</text>
								</paragraph><paragraph id="id8A82CF797E6F45B18D99001A846C7622"><enum>(2)</enum><header>Definition of
				State</header><text>In this section the term <term>State</term> means each of
				the several States of the United States and the District of Columbia.</text>
								</paragraph></subsection><subsection id="H7669D683A93B449FB4A841F4782BC419"><enum>(b)</enum><header>Allocations</header>
								<paragraph id="HB3422640C8C44ECA8FFD7DAB49338816"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2) and with respect to funds
				described in subsection (a), the Secretary shall allocate—</text>
									<subparagraph id="HCF979BC11E1D4ABAB5D800B3D2A7A147"><enum>(A)</enum><text>65 percent to
				States on the basis of a State’s need for integrated English and civics
				education programs, as determined by calculating each State’s share of a
				ten-year average of the data compiled by the Office of Immigration Statistics
				of the Department of Homeland Security, for immigrants admitted for lawful
				permanent residence for the ten most recent years; and</text>
									</subparagraph><subparagraph id="H6A28E8331BE441A4AE4DA660D9DED7A9"><enum>(B)</enum><text>35 percent to the
				States on the basis of whether the State experienced growth, as measured by the
				average of the three most recent years for which data compiled by the Office of
				Immigration Statistics of the Department of Homeland Security are available,
				for immigrants admitted for lawful permanent residence.</text>
									</subparagraph></paragraph><paragraph id="HAD5FCCD36D38413B0051614134C29D00"><enum>(2)</enum><header>Minimum</header><text>No
				State shall receive an allocation under paragraph (1) in an amount that is less
				than $60,000.</text>
								</paragraph></subsection><subsection id="HC3605FB0D207477BB5E98547ABFFF7F8"><enum>(c)</enum><header>Authorization of
				appropriation</header><text>For the purpose of carrying out this section, there
				are authorized to be appropriated $200,000,000 for fiscal year 2009,
				$250,000,000 for fiscal year 2010, and $300,000,000 for fiscal year
				2011.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H531285E7D4F246079CEB366D002D01E3"><enum>102.</enum><header>Expansion and
			 evaluation of the Even Start Family Literacy Program</header>
				<subsection id="H5C1116250A5B40AFA5FFB518C002C5DA"><enum>(a)</enum><header>Expansion of
			 program</header><text>Section 1002(b)(3) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6302(b)(3)) is amended to read as
			 follows:</text>

						<paragraph id="H652D3E3E3210412F9CDAC2D554B3923E"><enum>(3)</enum><header>Even
				start</header><text>For the purpose of carrying out subpart 3 of part B, there
				are authorized to be appropriated $350,000,000 for fiscal year 2009 and each of
				the 5 succeeding fiscal
				years.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF5378972D501435AA63D12A31F9E8693"><enum>(b)</enum><header>Even Start
			 research and evaluation</header><text>Subpart 3 of part B of title I of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6381 et seq.) is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD31AC13B02EC44EDA156BBB5B8782A24" style="OLC">
						<section id="idC27B08D02E224C4C96A4FD4A9D3EF188"><enum>1243.</enum><header>Research</header>
							<subsection id="IDe8ffd29721504a3b8d0305c995cc56bc"><enum>(a)</enum><header>In
				general</header><text>In order to provide rigorous research utilizing
				appropriate, scientifically based research standards, the Director of the
				National Institute for Literacy shall design a plan (approved by the Secretary)
				to carry out, through a grant or contract, research into the components of
				successful family literacy services to inform the field and improve practice
				and increase program quality, in order to—</text>
								<paragraph id="ID3d40213877fe45849fb93df177876578"><enum>(1)</enum><text>improve the
				quality of existing programs assisted under this subpart or other family
				literacy programs; and</text>
								</paragraph><paragraph id="ID93fef971279745b8a6053f62c7f58bdc"><enum>(2)</enum><text>develop models
				for new programs to be carried out under this subpart.</text>
								</paragraph></subsection><subsection id="id71FD6A790A3640D088A225DECF98A078"><enum>(b)</enum><header>Consultation</header><text>In
				conducting the research described in subsection (a), the entity with which the
				Director of the National Institute for Literacy contracts or awards a grant
				shall consult with—</text>
								<paragraph id="ID47730123f7c042cbbbc5e6a4ccc845eb"><enum>(1)</enum><text>Even Start
				coordinators and practitioners, including individuals from migrant or tribal
				Even Start programs;</text>
								</paragraph><paragraph id="ID789a37088edf49f0a033b400b5c9f142"><enum>(2)</enum><text>individuals who
				are researchers and experts in family literacy, including early childhood and
				adult literacy;</text>
								</paragraph><paragraph id="IDfd65052ce4e2487d92492cbf1eab3cce"><enum>(3)</enum><text>individuals who
				are experts in literacy services for English language learners and the
				learners' families; and</text>
								</paragraph><paragraph id="IDea441afc0e7343bd88952c79b37135e9"><enum>(4)</enum><text>individuals who
				are representatives from other national organizations involved in family
				literacy.</text>
								</paragraph></subsection><subsection id="ID0eb7b5712cb8453d9304700ee5daf5ca"><enum>(c)</enum><header>Scientifically
				based research on family literacy</header>
								<paragraph id="IDeec8aef9bf754891b04563af13fc0330"><enum>(1)</enum><header>In
				general</header><text>The Director of the National Institute for Literacy, in
				consultation with the Secretary, shall carry out research that—</text>
									<subparagraph id="ID6957b8e5fc684874bdfc5c30d941dea5"><enum>(A)</enum><text>is scientifically
				based reading research; and</text>
									</subparagraph><subparagraph id="ID0e7f495c0e9846709d2c17fe30a5ae26"><enum>(B)</enum><text>determines—</text>
										<clause id="ID7f51dcdf63204af3a1ef0695046e8d36"><enum>(i)</enum><text>the most
				effective ways of improving the literacy skills of adults with reading
				difficulties; and</text>
										</clause><clause id="IDa5678a38486748bf8562f4816a575177"><enum>(ii)</enum><text>how family
				literacy services can best provide parents with the knowledge and skills the
				parents need to support the parents' children’s literacy development.</text>
										</clause></subparagraph></paragraph><paragraph id="IDbe5e80c577da4eaca6a833a02ced0a1e"><enum>(2)</enum><header>Use of expert
				entity</header><text>The Director of the National Institute for Literacy, in
				consultation with the Secretary, shall carry out the research under paragraph
				(1) through an entity, including a Federal agency, that has expertise in
				carrying out longitudinal studies of the development of literacy skills in
				children and adults and has developed effective interventions to help children
				with reading difficulties.</text>
								</paragraph></subsection><subsection id="IDcc341002811b4d84b25af07bf34d6870"><enum>(d)</enum><header>Dissemination</header><text>The
				Director of the National Institute for Literacy shall disseminate, pursuant to
				section 1207, the results of research described in subsections (a) and (b) to
				State educational agencies and recipients of subgrants under this
				subpart.</text>
							</subsection><subsection id="ID0261d1e23c524546ac8c43c6ad86e18e"><enum>(e)</enum><header>Report to
				Congress</header><text>Not later than 6 months after the date of completion of
				research under this section, the Director of the National Institute for
				Literacy shall—</text>
								<paragraph id="idD89D8D0B693F4D1F82ABB06443A484AB"><enum>(1)</enum><text>submit a report
				on the research to the Secretary, the Committee on Education and Labor of the
				House of Representatives, and the Committee on Health, Education, Labor, and
				Pensions of the Senate; and</text>
								</paragraph><paragraph id="id8E83369EF4BF4955919B1764F2342141"><enum>(2)</enum><text>make such report
				publicly available.</text>
								</paragraph></subsection></section><section id="IDfe49ca7228cb4091ab88ae3f585915d8"><enum>1244.</enum><header>Longitudinal
				evaluation</header>
							<subsection id="ID95f2c72bf0ef4287a13b8cca1cd8dc41"><enum>(a)</enum><header>National
				William F. Goodling Even Start Evaluation</header><text>The Director of the
				National Institute for Literacy shall review, make recommendations on, design,
				and plan for a longitudinal evaluation of the Even Start program under this
				subpart, as approved by the Secretary.</text>
							</subsection><subsection id="ID0a9ee94cc96443da8aa82cd196cb7407"><enum>(b)</enum><header>Considerations</header><text>In
				conducting the evaluation described in subsection (a), the Director of the
				National Institute for Literacy shall consider—</text>
								<paragraph id="IDa3d511c7ed2641b8b1f39136f465af65"><enum>(1)</enum><text>the extent to
				which programs under this subpart—</text>
									<subparagraph id="IDf98e885eb09f4908b94e58fc93ffcdf5"><enum>(A)</enum><text>provide family
				literacy services to adults and children not otherwise available or accessible
				to such children or adults, or that supplement child development or adult
				education services provided by other programs;</text>
									</subparagraph><subparagraph id="IDaaa6458e584d4b829c4056ed417f0c31"><enum>(B)</enum><text>strengthen
				parents' knowledge and skills that support parent-child relationships, parental
				involvement in schools, and family literacy and other educational activities in
				the home;</text>
									</subparagraph><subparagraph id="ID46ff8ebd7e7c4ce2b4d97fd8e49d7e9c"><enum>(C)</enum><text>improve adult
				participants' basic skill levels in reading, writing, speaking the English
				language, and basic mathematics; and</text>
									</subparagraph><subparagraph id="ID45272b90f5cb49b2b8a93390c29c9734"><enum>(D)</enum><text>increase adult
				participants' ability to maintain and retain employment; and</text>
									</subparagraph></paragraph><paragraph id="IDb730913fbfee4fad8cc94abd19364d11"><enum>(2)</enum><text>the extent to
				which programs under this subpart link families to needed community services
				and how differences in the type, length, mix, and intensity of services affect
				the desired program
				goals.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H9D1710B557B044EFB500151402B6D44D"><enum>103.</enum><header>Expanded
			 learning time for middle and secondary school English language
			 learners</header>
				<subsection id="idEDC2155AF4BC4EBAB9155EA520DE176B"><enum>(a)</enum><header>Definitions</header>
					<paragraph id="id79C6E8C738104EE6B5D6697CCFF876D1"><enum>(1)</enum><header>In
			 general</header><text>Unless otherwise specified, the terms used in this
			 section have the meanings given the terms in section 9101 of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
					</paragraph><paragraph id="id8A0A05AFF9A548AF88DA0FB496279463"><enum>(2)</enum><header>Other
			 Definitions</header><text>In this section:</text>
						<subparagraph id="H4011D040F55E4B008931E948DBACA2A0"><enum>(A)</enum><header>Expanded
			 learning time program</header><text>The term <term>expanded learning time
			 program</term> means—</text>
							<clause id="HE5B6FA86DFF74652A48F3D13A6E11B99"><enum>(i)</enum><text>a
			 summer learning semester at a school served by a local educational
			 agency;</text>
							</clause><clause id="HC6424EF9A9CD43CCA260F51844008D36"><enum>(ii)</enum><text>a
			 consolidated school district program;</text>
							</clause><clause id="H4001480DEA2D46368FFA8494A76CF585"><enum>(iii)</enum><text>an
			 extended day program that adds not less than one hour to the school day, if the
			 additional learning time—</text>
								<subclause id="id892878E366B6494D956351CD99E67D36"><enum>(I)</enum><text>focuses on
			 English language acquisition and core academics; and</text>
								</subclause><subclause id="id706BF5E3092D4223A09AE272746BC647"><enum>(II)</enum><text>allows for
			 enrichment opportunities that support learning; or</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1E2CC1BE6D5043ADADC4E6A7E49E2035"><enum>(iv)</enum><text display-inline="yes-display-inline">a semester or program described in clause
			 (i), (ii), or (iii) that is operated by—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id69BA5435C3E74F4CACE1B0DF42976BA8"><enum>(I)</enum><text display-inline="yes-display-inline">a local educational agency or a public
			 school; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id20DB548F511340F4BC0A99E8F2AB1D51"><enum>(II)</enum><text>a local
			 educational agency or a public school in a partnership with—</text>
									<item commented="no" display-inline="no-display-inline" id="idED2CE74266BC41889AF8FBCD494E0D4A"><enum>(aa)</enum><text display-inline="yes-display-inline">a nonprofit organization;</text>
									</item><item commented="no" display-inline="no-display-inline" id="idCF0592E134D2465B872178521DF3282D"><enum>(bb)</enum><text display-inline="yes-display-inline">a faith-based organization; or</text>
									</item><item commented="no" display-inline="no-display-inline" id="id1FAC308D82064299A8D5974468B07802"><enum>(cc)</enum><text display-inline="yes-display-inline">any other entity that meets State quality
			 assurance guidelines.</text>
									</item></subclause></clause></subparagraph><subparagraph id="id617AFCFCFF0A47D3803757FF9238C171"><enum>(B)</enum><header>State</header><text>The
			 term <term>State</term> means each of the several States of the United States
			 and the District of Columbia.</text>
						</subparagraph></paragraph></subsection><subsection id="H279D0A2E260F4FE9961B00D4BD1F1AF"><enum>(b)</enum><header>Program
			 authorized</header><text>From amounts appropriated under subsection (h), the
			 Secretary of Education shall award grants under this section to each State
			 educational agency served by a State to enable the State educational agency to
			 provide subgrants, on a competitive basis, to local educational agencies to
			 enable the local educational agencies to provide high quality expanded learning
			 time programs for middle and secondary school students who are English language
			 learners.</text>
				</subsection><subsection id="H00F92C87C87C47808E00F29ED606ABDD"><enum>(c)</enum><header>Grant
			 requirements</header>
					<paragraph id="id1993BEC9A53F44CCAFC0701407AED2F9"><enum>(1)</enum><header>Approved
			 applications</header><text>The Secretary shall only award a grant under this
			 section to a State educational agency for which the Secretary has approved an
			 application under this section.</text>
					</paragraph><paragraph id="H162F98590D7E40489356393DD693BA46"><enum>(2)</enum><header>Matching
			 requirement</header><text>To be eligible to receive a grant under this section,
			 a State educational agency shall provide matching funds, from non-Federal
			 sources, in an amount that is not less than 25 percent of the total amount of
			 funds received under the grant.</text>
					</paragraph><paragraph id="H2B01DBCBF10845F4BB67E02D55B41D90"><enum>(3)</enum><header>In-kind
			 contributions</header><text>In-kind contributions from private funding sources
			 may be used to meet the matching requirement described in paragraph (2).</text>
					</paragraph><paragraph id="HA9D68D9FE9A2472B001968A91774CDF4"><enum>(4)</enum><header>State
			 Application</header>
						<subparagraph id="id3BE1162EDFD749FAB348C4F0D0977AC7"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In order to receive a
			 grant under this section, a State educational agency shall submit an
			 application, that was developed collaboratively with community-based
			 organizations that serve English language learner communities, teachers, a
			 statewide organization of teachers, a representative from public libraries, and
			 other educators, to the Secretary at such time and in such form as the
			 Secretary may require.</text>
						</subparagraph><subparagraph id="idA8BBF04DA2D34FBDBED4E1DF52A9B5EF"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The application shall include a State plan
			 for providing high quality expanded learning time programs for middle and
			 secondary school students who are English language learners. The State plan
			 shall include—</text>
							<clause id="H6952C732E10C46B185DFAF6471387633"><enum>(i)</enum><text>a
			 description of the State needs regarding the English language learner student
			 population;</text>
							</clause><clause id="H720BB84DA6BA473DA8FED9199E1428F7"><enum>(ii)</enum><text>an
			 outline for an accountability standard to ensure the use of high quality
			 expanded learning time programs;</text>
							</clause><clause id="H37538F69648841FC9398146EA9F421E9"><enum>(iii)</enum><text>any other
			 requirement determined to be necessary by the Secretary; and</text>
							</clause><clause id="id4D7ED3907C254D96B04601FE77250301"><enum>(iv)</enum><text>guidelines
			 on—</text>
								<subclause id="H7848912E9E114F45A33159052092E504"><enum>(I)</enum><text>which expanded
			 learning time programs are determined to be high quality; and</text>
								</subclause><subclause id="H00BFD8B423394BE3B0407B16C0EFCC83"><enum>(II)</enum><text>how the State
			 educational agency will ensure that the State educational agency will meet the
			 requirements of subsection (e).</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="H91954E2ADE74483F91324F30529287BB"><enum>(d)</enum><header>Competitive
			 subgrants</header>
					<paragraph id="id2DAFA63851184C0999CDD3C235A60C4C"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency receiving a grant under this
			 section shall use the grant funds to award subgrants, on a competitive basis,
			 to local educational agencies to enable the local educational agencies to
			 provide expanded learning time programs to middle and secondary school students
			 who are English language learners in order to provide such students with
			 additional language and civics education.</text>
					</paragraph><paragraph id="H3E6040EC721B409000009DD72D5272D1"><enum>(2)</enum><header>Priority</header><text>A
			 State educational agency receiving a grant under this section shall give
			 priority in awarding subgrants under this section to local educational agencies
			 that demonstrate a need for expanded learning time programs for English
			 language learner middle and secondary school students.</text>
					</paragraph><paragraph id="HF691FC3AD7144D7C9E69666B216D4BB0"><enum>(3)</enum><header>Need
			 determination</header><text>A State educational agency shall determine a local
			 educational agency's need under paragraph (2) on the basis of—</text>
						<subparagraph id="H03B0FE8640EE4B82BFFFA5109F3D4FA1"><enum>(A)</enum><text>increases in the
			 number of students who are English language learners and served by the local
			 educational agency;</text>
						</subparagraph><subparagraph id="HE116EF1A9B0A4B4C9F7E7386610094B2"><enum>(B)</enum><text>substantial
			 increases in the local immigrant population served by the local educational
			 agency; and</text>
						</subparagraph><subparagraph id="HABD55D522CCE449A8BBD43C05F056794"><enum>(C)</enum><text>evidence that
			 expanded learning time programs are necessary to ensure that schools served by
			 the local educational agency will reach accountability standards under the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.).</text>
						</subparagraph></paragraph><paragraph id="H133E504EFC7A4AD39CCA3B62C02D2D1E"><enum>(4)</enum><header>Application</header><text>In
			 order to receive a subgrant under this section, a local educational agency
			 shall submit an application to the State educational agency at such time and in
			 such form as the State educational agency may require. The application
			 shall—</text>
						<subparagraph id="HB31B5880E0C145A384AAC32BCCE4D71D"><enum>(A)</enum><text>describe the needs
			 of the middle and secondary school English language learner student population
			 served by the local educational agency;</text>
						</subparagraph><subparagraph id="H9F8AF1C11956497CA6ED6CB03127607"><enum>(B)</enum><text>describe the types
			 of expanded learning time programs to be offered to middle and secondary school
			 students who are English language learners;</text>
						</subparagraph><subparagraph id="H48F21D27D58E43C8962FA2D7713B943"><enum>(C)</enum><text>describe how the
			 subgrant will be used;</text>
						</subparagraph><subparagraph id="id9A62F7DB67884E6EBCC6D8ED9D6B50BE"><enum>(D)</enum><text>include
			 guidelines on—</text>
							<clause id="H22EDA92087C34B7FB6934EEC793C44A7"><enum>(i)</enum><text>which expanded
			 learning time programs are considered to be high quality; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF4C5312D931D4A5687416E1F91BD4936"><enum>(ii)</enum><text>how the local
			 educational agency will meet the requirements of subsection (e);</text>
							</clause></subparagraph><subparagraph id="H127A5CE1E563435F97BD5B00130000C9"><enum>(E)</enum><text>contain an
			 assurance that the local educational agency will meet the requirements of
			 subsection (e);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H30881A639ED34842896750FA7715CBE7"><enum>(F)</enum><text>include an outline
			 for an accountability standard to ensure high quality expanded learning time
			 programs;</text>
						</subparagraph><subparagraph id="HD3FDF875B6404558876BDA01D5D343E6"><enum>(G)</enum><text display-inline="yes-display-inline">contain evidence of an agreement, between
			 the governing body of the local educational agency and the employees of the
			 local educational agency, including teachers, at participating schools or their
			 recognized representatives, to work the expanded schedule;</text>
						</subparagraph><subparagraph id="H2BC954E7ADAD44159E08A426212542BC"><enum>(H)</enum><text>describe the
			 process by which the local educational agency will ensure the meaningful
			 involvement of teachers, union representatives, parents, public libraries, and
			 school partners in the planning and implementation of the expanded learning
			 time program; and</text>
						</subparagraph><subparagraph id="HBAF41E0C72D342858430A7F6002DD800"><enum>(I)</enum><text>contain any other
			 requirement determined necessary by the State educational agency.</text>
						</subparagraph></paragraph><paragraph id="HA74CA30F80004B8B952805F255514276"><enum>(5)</enum><header>Matching
			 requirement</header><text>To be eligible to receive a subgrant under this
			 section, a local educational agency shall provide matching funds, from
			 non-Federal sources, in an amount that is not less than 15 percent of the total
			 amount of funds received under the subgrant.</text>
					</paragraph></subsection><subsection id="HADB5FFBBF2964229BB4935A3E307823D"><enum>(e)</enum><header>Supplement, not
			 supplant</header><text>A State educational agency and a local educational
			 agency shall use Federal funds received under this section only to supplement
			 the funds that would, in the absence of such Federal funds, be made available
			 from non-Federal sources for the education of students participating in
			 expanded learning time programs assisted under this section, and not to
			 supplant such funds.</text>
				</subsection><subsection id="H481EFFD94FFE4A09AF00004539BA8595"><enum>(f)</enum><header>Duration and
			 renewal</header>
					<paragraph id="idEE3D07C967FD47F7804632649032A74C"><enum>(1)</enum><header>Duration of
			 grants and subgrants</header><text>Grants and subgrants under this section
			 shall be awarded for a period that does not exceed 3 years in duration.</text>
					</paragraph><paragraph id="HF527F245F19142B896F50006F494108D"><enum>(2)</enum><header>Renewal of
			 grants and subgrants</header>
						<subparagraph id="idE810587AE2A94180B428D1771D88AB42"><enum>(A)</enum><header>In
			 general</header><text>Grants and subgrants under this section may be renewed in
			 2-year increments.</text>
						</subparagraph><subparagraph id="HF9969DAC43A24918B7E308DA226C00E5"><enum>(B)</enum><header>Conditions for
			 renewal</header><text>In order to be eligible to renew a grant or subgrant
			 under this paragraph, the State educational agency or local educational agency
			 shall demonstrate to the satisfaction of the Secretary or State educational
			 agency, respectively, that the State educational agency or local educational
			 agency, respectively, has complied with the terms of the grant or subgrant,
			 respectively.</text>
						</subparagraph></paragraph></subsection><subsection id="HEF172C9534E74EE8A35F6D975054D32"><enum>(g)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 section shall be construed to alter or otherwise affect the rights, remedies,
			 and procedures afforded to the employees of local educational agencies under
			 Federal, State, or local laws (including applicable regulations or court
			 orders) or under the terms of collective bargaining agreements, memoranda of
			 understanding, or other agreements between such employees and their employers,
			 including the right of employees of local educational agencies to engage in
			 good faith collective bargaining with their employers regarding their terms and
			 conditions of employment, and the procedures used to determine such terms and
			 conditions.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H33E5021415544EDF86273CAEFAE03EAE"><enum>(h)</enum><header>Authorization of
			 Appropriations</header><text>For the purpose of carrying out this section,
			 there are authorized to be appropriated $50,000,000 for fiscal year 2009 and
			 each of the 5 succeeding fiscal years.</text>
				</subsection></section><section id="id1196E7D689934F7A9E962A04631707B8"><enum>104.</enum><header>Definitions of
			 English language learner</header>
				<subsection id="idF771AA2B6FC448A69D77E5BC7ACDCBAF"><enum>(a)</enum><header>Adult Education
			 and Family Literacy Act</header><text>The Adult Education and Family Literacy
			 Act (20 U.S.C. 9201 et seq.) is amended—</text>
					<paragraph id="id42AD480042B942B689BF81DD2725DC4C"><enum>(1)</enum><text>in section 203(6)
			 (20 U.S.C. 9202(6)), by striking <quote>individuals of limited English
			 proficiency</quote> and inserting <quote>English language
			 learners</quote>;</text>
					</paragraph><paragraph id="id487D517EFE7B4038B75FFD9A2805DE41"><enum>(2)</enum><text>in section
			 203(10) (20 U.S.C. 9202(10))—</text>

					</paragraph></subsection></section><section id="H888F5963E49C4FD09C38C5CAD79C0546"><enum>105.</enum><header>Credits for
			 teachers of English language learners</header>
				<subsection id="H89ED34A7432943178D0067F900D51300"><enum>(a)</enum><header>In
			 general</header><text>Subpart A of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is
			 amended by inserting after section 25D the following new section:</text>
					<quoted-block id="H65FBBE436B754F52AAAEEBCA9C41355E" style="OLC">
						<section id="HB29CA2A7958446B6005F754E61D59C8D"><enum>25E.</enum><header>Teachers of
				English language learners</header>
							<subsection id="H81B47B38B0384FB3B4BAA67F04FD39F6"><enum>(a)</enum><header>In
				General</header><text>In the case of an eligible teacher, there shall be
				allowed a credit against the tax imposed by this chapter for the taxable year
				an amount equal to—</text>
								<paragraph id="H6F392144FE1845D8B73176F83EC068D8"><enum>(1)</enum><text>$1,500, for each
				of the first 5 taxable years for which the taxpayer is allowed a credit under
				this section, and</text>
								</paragraph><paragraph id="H558681542F204346BB0016FC5F3626EB"><enum>(2)</enum><text>$1,000, for any
				other taxable year.</text>
								</paragraph></subsection><subsection id="H5852FD96D2214A6C966D891512B47901"><enum>(b)</enum><header>Credit allowed
				only for 10 taxable years</header><text>No credit shall be allowed under this
				section with respect to a taxpayer for any taxable year after the 10th taxable
				year for which such taxpayer is allowed a credit under this section.</text>
							</subsection><subsection id="H6E4DF8F6576E4790813184E2F3127FAF"><enum>(c)</enum><header>Eligible
				Teacher</header><text>For purposes of this section—</text>
								<paragraph id="H1A08A3A6C1EB45C9A7C5B647D7C42099"><enum>(1)</enum><header>In
				general</header><text>The term <quote>eligible teacher</quote> means, with
				respect to a taxable year, any individual who is a full-time teacher in an
				academic subject, has received training in delivering academic instruction to
				English language learner students, and is employed in any English language
				learner school for the academic year ending in such taxable year.</text>
								</paragraph><paragraph id="HAECB0D21D3764D479BBC3FEF33AE4B7B"><enum>(2)</enum><header>English language
				learner school</header><text>The term <quote>English language learner
				school</quote> means any school—</text>
									<subparagraph id="H142A3C6EE46B4C5D9B1076B84923BCA2"><enum>(A)</enum><text>which provides
				elementary education or secondary education, as determined under State law,
				and</text>
									</subparagraph><subparagraph id="H5D27DFB505144358AF98CD60A422B0F7"><enum>(B)</enum><text>in which 10
				percent or more of the students enrolled are limited English proficient (as
				defined in section 9901 of the Elementary and Secondary Education Act of
				1965).</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H81EE7A4D25764B1E9EC4426BE41D64FA"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for such subpart is amended by
			 inserting after the item relating to section 25D the following new item:</text>

				</subsection><subsection id="HD9D5C35D19774EC09CFFD6E7C5C2D367"><enum>(c)</enum><header>Teacher
			 certification expenses</header><text>Part VII of subchapter B of chapter 1 of
			 the Internal Revenue Code of 1986 (relating to additional itemized deductions
			 for individuals) is amended by redesignating section 224 as section 225 and by
			 inserting after section 223 the following new section:</text>

						<section id="H1D7EACAB8B8544CFB2BDB3453D004EB1"><enum>224.</enum><header>Teacher
				certification expenses</header>
							<subsection id="H6597C26534A641A090FABAC6646EDDDA"><enum>(a)</enum><header>In
				General</header><text>In the case of an individual, there shall be allowed as a
				deduction for teacher certification expenses paid or incurred by the taxpayer
				for the taxable year.</text>
							</subsection><subsection id="HB426CDE957A04913AF6C1638C1646F8D"><enum>(b)</enum><header>Teacher
				certification expenses</header>
								<paragraph id="H411393DFB6024FAFBA789B15418800AC"><enum>(1)</enum><header>TESL
				certification expenses</header><text>For purposes of this section, the term
				<quote>TESL certification expenses</quote> means tuition and fees required for
				the enrollment or attendance of the taxpayer or the taxpayer’s spouse at an
				eligible educational institution (as defined in section 25A) for a course which
				is required for certification of such individual as qualified to teach English
				to elementary or secondary school students who are limited English proficient
				(as defined in section 9901 of the Elementary and Secondary Education Act of
				1965).</text>
								</paragraph><paragraph id="H6965362257C14CB69C704987D3D3B194"><enum>(2)</enum><header>State bilingual
				education certification expenses</header><text>For purposes of this section,
				the term <quote>State bilingual education certification expenses</quote> means
				tuition and fees required for the enrollment or attendance of the taxpayer or
				the taxpayer’s spouse at an eligible educational institution (as defined in
				section 25A) for a course which is required for certification of such
				individual as qualified to teach bilingual courses to elementary or secondary
				school students who are limited English proficient (as defined in section 9901
				of the Elementary and Secondary Education Act of 1965).</text>
								</paragraph><paragraph id="HF2AD52234B92474DBBEE953760F8BF34"><enum>(3)</enum><header>Exceptions</header><text>Such
				term shall not include any amounts to the extent such amounts—</text>
									<subparagraph id="H9C6ABBB98C504329983331FC6FDCB4FD"><enum>(A)</enum><text>are for a course
				that is part of the individual’s degree program, or</text>
									</subparagraph><subparagraph id="HF42E40C7937F48DAAC46E58D768436E7"><enum>(B)</enum><text>are funded by
				another person (or any governmental entity).</text>
									</subparagraph></paragraph></subsection><subsection id="HE1BBEBBA776A4FE99251181F5DFF7373"><enum>(c)</enum><header>Denial of double
				benefit</header><text>No deduction shall be allowed under this section for any
				expense for which a deduction or credit is allowed under any other provision of
				this
				chapter.</text>

			 research and development center</header>
					<paragraph id="H6E1640E9F05945A8B73C43D38661DE5D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Education shall direct the Commissioner for Education Research of the National
			 Center for Education Research established pursuant to section 131 of the
			 Education Sciences Reform Act of 2002 (20 U.S.C. 9531) to establish a national
			 research and development center for adult education and literacy as described
			 in section 133(c)(2)(A) of such Act (20 U.S.C. 9533(c)(2)(A)) (as amended by
			 subsection (a)).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H083E8A3C11F44732937E597784B9BEF"><enum>(2)</enum><header>Provision for
			 expansion of research</header><text>If, as of the date of the enactment of this
			 Act, the Commissioner has established a center for adult literacy in accordance
			 with section 133(c)(2)(A) of the Education Sciences Reform Act of 2002, the
			 Commissioner shall expand the topic of research of such center to include adult
			 education, in accordance with the amendment made by subsection (a).</text>
					</paragraph></subsection></section></title><title id="H51C84A13BEA7454D9D17DDD2FE32FA0"><enum>II</enum><header>Supporting English
			 Language Acquisition and Adult Education in the Workforce</header>
			<section display-inline="no-display-inline" id="H9C2DC439AF2A458EB7930051849D57D" section-type="subsequent-section"><enum>201.</enum><header>Credit for employer
			 provided adult English literacy and basic education programs</header>
				<subsection id="H36A6B285A11C4BC996806950D5571D29"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business related credits) is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE97B1903D3F043C38156555DAE2C42DA" style="OLC">
						<section id="HA4F57F8CCC7B4C7D9700ECBE2F2242B"><enum>45Q.</enum><header>Employer-provided
				adult English literacy and basic education programs</header>
							<subsection id="H4423AC7A301E45CCAF2EC39D005784AB"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">For the purposes of
				section 38, the credit determined under this section with respect to any
				employer for the taxable year is an amount equal to 20 percent of qualified
				education program expenses, or no more than $1,000 per full-time employee
				participating in the qualified education program.</text>
							</subsection><subsection id="H6A0AC03352AB4C19816173C7696F635"><enum>(b)</enum><header>Qualified
				education program expenses</header><text>For purposes of this section—</text>
								<paragraph id="H2ADC86A5160F4A2FB156B235EF224C38"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<quote>qualified education program expenses</quote> means expenses paid or
				incurred by an employer to make available qualified education to employees of
				the employer, who are English language learners or have not received a
				secondary school diploma, or its recognized equivalent, or who lack sufficient
				mastery of basic educational skills to enable the individuals to function
				effectively in society.</text>
								</paragraph><paragraph id="HCEA10DE9E2BD4190B819F6B500BA126C"><enum>(2)</enum><header>Qualified
				education</header><text display-inline="yes-display-inline">The term
				<quote>qualified education</quote> means adult education and literacy
				activities provided—</text>
									<subparagraph id="H7443FA30B50E473097009B3DB22F98B3"><enum>(A)</enum><text display-inline="yes-display-inline">by an eligible provider which for the
				fiscal year ending during the employer’s taxable year receives Federal funds
				under section 231 of the Adult Education and Family Literacy Act for adult
				education and literacy activities, or</text>
									</subparagraph><subparagraph id="HD03AD5024BF8410DAF3BB4451B7EF01C"><enum>(B)</enum><text display-inline="yes-display-inline">in curriculum approved by the Department of
				Education, the Employment and Training Administration of the Department of
				Labor, or in current use by a Federal agency.</text>
									</subparagraph></paragraph><paragraph id="H5E6B60D5EA72421DBF7FCA726B39ECBA"><enum>(3)</enum><header>Eligible
				provider; adult education and literacy activities</header><text display-inline="yes-display-inline">The terms <quote>eligible provider</quote>,
				and <quote>adult education and literacy activities</quote> shall have the
				respective meanings given to such terms in section 203 of the Adult Education
				and Family Literacy Act.</text>
								</paragraph><paragraph id="id832423B7D24443069BE9D16F6ABBD397"><enum>(4)</enum><header>English
				language learner</header><text>The term <quote>English language learner</quote>
				shall have the same meaning given to such term in section 9101(25) of the
				Elementary and Secondary Education Act of 1965.</text>
								</paragraph></subsection><subsection id="H6B3047CEE12644A2A04B1F124609A8A9"><enum>(c)</enum><header>Special
				rules</header><text>For purposes of this section—</text>
								<paragraph id="H4819ECF2290B40DE9800BE00BBD008DA"><enum>(1)</enum><header>Full-time
				employment</header><text display-inline="yes-display-inline">An employee shall
				be considered full-time if such employee is employed at least 30 hours per week
				for 25 or more calendar weeks in the taxable year.</text>
								</paragraph><paragraph id="H161BEF6909E046A099C5C67525BF80B3"><enum>(2)</enum><header>Aggregation
				rule</header><text>All persons treated as a single employer under subsection
				(a) or (b) or section 52, or subsection (m) or (o) of section 414, shall be
				treated as one person.</text>
								</paragraph></subsection><subsection commented="no" id="H4031339136A745B8992C8C3413F9EA56"><enum>(d)</enum><header>Denial of double
				benefit</header><text>No deduction or credit shall be allowed under any other
				provision of this chapter for any amount taken into account in determining the
				credit under this section.</text>
							</subsection><subsection id="H127EC969328949A3A74508F6AFFD2CB2"><enum>(e)</enum><header>Election To have
				credit not apply</header><text display-inline="yes-display-inline">A taxpayer
				may elect (at such time and in such manner as the Secretary may by regulations
				prescribe) to have this section not apply for any taxable
				year.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H940BE3B049194EC39CA6F8A9BF003C81"><enum>(b)</enum><header>Credit To be
			 part of general business credit</header><text>Subsection (b) of section 38 of
			 such Code (relating to current year business credit) is amended by striking
			 <quote>plus</quote> at the end of paragraph (32), by striking the period at the
			 end of paragraph (33) and inserting <quote>, plus</quote>, and by adding at the

				in coordinating alien integration and refugee resettlement programs with the
				grant program carried out under title III of the Strengthening Communities

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HF1086A3AAE324BB48FB272F4CBE2F956"><enum>302.</enum><header>Grants to
			 States</header>
				<subsection id="H68CF381484F740C8A7BBB6C04565787B"><enum>(a)</enum><header>Authority To
			 provide grants</header><text>Subject to subsections (c) and (d), the Chief of
			 the Office of Citizenship and Immigrant Integration is authorized to provide
			 grants to States to form State New American Councils as described in subsection
			 (b) to carry out activities described in section 303.</text>
				</subsection><subsection id="H2CA8055CA1D7469B939E4BB9A89B27A1"><enum>(b)</enum><header>State New
			 American Councils</header><text display-inline="yes-display-inline">A State New
			 American Council shall consist of not less than 15 and not more than 19
			 individuals from the State and shall include, to the extent practicable,
			 representatives from the following sectors:</text>
					<paragraph id="H9D524DB7834F4413A32B8168CEE75EE1"><enum>(1)</enum><text>Business.</text>
					</paragraph><paragraph id="H6ACBCA556C394AC4A1914566694FA2A3"><enum>(2)</enum><text>Faith-based
			 organizations.</text>
					</paragraph><paragraph id="H882E641518E9447BB0EFAAFBA850616D"><enum>(3)</enum><text>Civic
			 organizations.</text>
					</paragraph><paragraph id="HE3736208127F4A829982CE662400E685"><enum>(4)</enum><text>Philanthropic
			 leaders.</text>
					</paragraph><paragraph id="H5FDA39B1960E4AD1B19757C0FA9EDDDD"><enum>(5)</enum><text>Nonprofit
			 organizations with experience working with immigrant communities.</text>
					</paragraph><paragraph id="H6C104839AF734974B89226240801FDC9"><enum>(6)</enum><text>Education
			 organizations, including organizations representing teachers and other
			 employees.</text>
					</paragraph><paragraph id="H1F147A8A6E764428A037E328AE8FCC8E"><enum>(7)</enum><text>Representatives of
			 State adult education offices.</text>
					</paragraph><paragraph id="H5C454558B44143BA8EF4149BEFA4FB03"><enum>(8)</enum><text>Representatives of

			 statewide or local elected office holders.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA35BB4A0935640B79373E8DE3C3D06EC"><enum>(c)</enum><header>Waiver of
			 requirement</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idA273BCE1413F49ABB8AE8C22FDDA3189"><enum>(1)</enum><header>Authority to
			 grant</header><text>The Chief of the Office of Citizenship and Immigrant
			 Integration may award a grant under subsection (a) to a State without requiring
			 the State to form a State New American Council if the Chief determines that the
			 State is carrying out statewide initiatives to integrate immigrants into the
			 State and into the United States.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDDCB2A1C23344699E8045C4AE39CB20"><enum>(2)</enum><header>Guidelines</header><text>The
			 Chief shall establish guidelines for awarding grants to States described in
			 paragraph (1).</text>
					</paragraph></subsection><subsection id="HFD8D8CBCFA5F4369B6795BCDB43B9204"><enum>(d)</enum><header>Grants to local
			 governments</header><text>The Chief of the Office of Citizenship and Immigrant
			 Integration may provide a grant under subsection (a) to a local government if
			 the Chief determines that the State in which the local government is located is
			 unable or unwilling to apply for such a grant.</text>
				</subsection><subsection id="HC0FBDB182DD649BA9899F36ECE28D6A6"><enum>(e)</enum><header>Application</header><text>An
			 applicant for a grant under subsection (a) shall submit an application to the
			 Chief of the Office of Citizenship and Immigrant Integration. Such application
			 shall include—</text>
					<paragraph id="HD981B3F0126B43CA8E8B78B05796FF8C"><enum>(1)</enum><text>if the applicant
			 is a State seeking to form a State New American Council, an assurance that such
			 State New American Council will meet the requirements of subsection (b);</text>
					</paragraph><paragraph id="H17984215F4B042BF9D007D356940A481"><enum>(2)</enum><text>the number of
			 immigrants in the State in which the applicant is located;</text>
					</paragraph><paragraph id="H662A18976D4845F09F222790C512639D"><enum>(3)</enum><text>a
			 description of the challenges immigrants face in effectively integrating into
			 such State and local communities; and</text>
					</paragraph><paragraph id="H43A3ECC90FAD4303AFD839D8BB093789"><enum>(4)</enum><text>any other
			 information that the Chief may reasonably require.</text>
					</paragraph></subsection><subsection id="HE5CD5E5A20464C4DAFF1437ECA1EF576"><enum>(f)</enum><header>Duration</header><text>A
			 grant awarded under subsection (a) shall be for a period of 5 years.</text>
				</subsection><subsection id="H96F613888F304811B3D0E4F8C3D3076C"><enum>(g)</enum><header>Grant
			 amount</header><text>The amount of a grant awarded under subsection (a) shall
			 be not less than $500,000 and not more than $5,000,000 for each fiscal
			 year.</text>
				</subsection><subsection id="HDCDB5329E43646B1A243B1AB06CBFC2B"><enum>(h)</enum><header>Reservations</header>
					<paragraph id="H30CDF75785AA4A9489F1CCBA9C682CEF"><enum>(1)</enum><header>National</header><text>The
			 Chief of the Office of Citizenship and Immigrant Integration shall reserve not
			 more than 1 percent of the amount appropriated to carry out this title for such
			 Office, including the evaluation of funds distributed.</text>
					</paragraph><paragraph id="H3767D9D9468642F5A71B7657B6D7FE9D"><enum>(2)</enum><header>States</header><text>A
			 State awarded a grant under subsection (a) may reserve not more than 10 percent
			 of such grant amount for the creation and operation of the State New American
			 Council.</text>
					</paragraph></subsection></section><section id="H7770BDCB41E44D1EB73683EA0353EC00"><enum>303.</enum><header>Authorized
			 activities</header>
				<subsection id="H23C2D3B956FC4ABB9DC6EF0142C8CFC"><enum>(a)</enum><header>Mandatory
			 activities</header><text>A grant awarded under section 302(a) shall be
			 used—</text>
					<paragraph id="HF7DDCE3DAF5545CBA992AC71573AD65"><enum>(1)</enum><text>to
			 develop, implement, expand, or enhance a comprehensive integration plan;</text>
					</paragraph><paragraph id="H5BF6FE899CA2499F820012A48D904045"><enum>(2)</enum><text>to provide
			 subgrants to local communities as described in subsection (c);</text>
					</paragraph><paragraph id="H09016F9BEFFC488DBC46ED8EBF46B233"><enum>(3)</enum><text>if the grant is
			 awarded to a State to form a State New American Council, to convene meetings of
			 the State New American Council not less frequently than once each quarter;
			 and</text>
					</paragraph><paragraph id="HF5A1388544DC40D48E374DCFB53C12C2"><enum>(4)</enum><text>to convene public
			 hearings not less frequently than once each year to report on the activities
			 carried out by with such grant.</text>
					</paragraph></subsection><subsection id="H7A1DBECBC80341AC923DB8A4D8BDE771"><enum>(b)</enum><header>Permissible
			 activities</header><text>A grant awarded under section 302(a) may be
			 used—</text>
					<paragraph id="HF5FCC05C1DC34BB79861CBEFC68F8B1"><enum>(1)</enum><text>to
			 examine the status of immigrants in the State or municipality which was awarded
			 the grant;</text>
					</paragraph><paragraph id="HABEADC1E12F042F2AF33E0C3C4F71EFE"><enum>(2)</enum><text>to provide
			 technical assistance or training for State or local agencies to improve
			 services to immigrants;</text>
					</paragraph><paragraph id="HBBF02981D31244EC8FB0B00020B34968"><enum>(3)</enum><text>to review and
			 develop strategies to expand distance learning as a method of instruction for
			 language and civics education and available technological programs that may
			 supplement or supplant quality classroom instruction; and</text>
					</paragraph><paragraph id="H41781D86DA694A108700AA5048448293"><enum>(4)</enum><text>to coordinate with
			 entities of other States engaged in immigrant integration or refugee
			 resettlement activities.</text>
					</paragraph></subsection><subsection id="H5399ADAD56AE452EA1EFFF313C5F77E8"><enum>(c)</enum><header>Subgrants to
			 local communities</header>
					<paragraph id="H0CC3531E6C194422BBE02340D4DDFFA9"><enum>(1)</enum><header>Requirement to
			 award</header><text>A grant under section 302(a) shall be used to award
			 subgrants to entities of local governments to assist communities with local
			 efforts to integrate populations of immigrants and address community concerns
			 related to such populations.</text>
					</paragraph><paragraph id="H08F84A7821BB4456B3ED45A677EE0003"><enum>(2)</enum><header>Authorized
			 activities</header><text>Subgrants shall be awarded under paragraph (1) to
			 entities of local governments for use to carry out activities in accordance
			 with—</text>
						<subparagraph id="id63AFEC19502946D5A877FF87DC01DCB3"><enum>(A)</enum><text>a comprehensive
			 integration plan described in subsection (a)(1); and</text>
						</subparagraph><subparagraph id="id2B4FB60A6088473593D9D7FF55A58C56"><enum>(B)</enum><text>any guidance
			 provided by the Chief of the Office of Citizenship and Immigrant
			 Integration.</text>
						</subparagraph></paragraph><paragraph id="id0B42CD2E2EAE4BE1B48E7DABA50FE3E3"><enum>(3)</enum><header>Subgrant
			 amount</header><text>The amount of a subgrant awarded under this subsection
			 shall be not less than $100,000 and not more than $600,000 for a fiscal
			 year.</text>
					</paragraph></subsection></section><section id="H4AE18022838E45C88F9F49C00058E073"><enum>304.</enum><header>Accountability
			 and evaluation</header>
				<subsection id="H6472C65A699D43C1975BC700247610A1"><enum>(a)</enum><header>Accountability
			 system</header><text>Each entity awarded a grant under section 302(a) or a
			 subgrant under section 303(c) shall establish an accountability system to
			 measure the outcomes of the activities carried out with such grant or subgrant
			 and assess the effectiveness of such entity in achieving the integration goals
			 of—</text>
					<paragraph id="id7F5BAC2D8BBA4BC8A21FE41619169E99"><enum>(1)</enum><text>the Chief of the
			 Office of Citizenship and Immigrant Integration; and</text>
					</paragraph><paragraph id="id656E61FDFBA04FA1823BAF8FE77E51BD"><enum>(2)</enum><text>any applicable
			 comprehensive integration plan described in subsection 303(a)(1).</text>
					</paragraph></subsection><subsection id="HCA0120A5703F42B082C608B4C2BED4C"><enum>(b)</enum><header>System
			 requirements</header><text>The accountability system required by subsection (a)
			 shall consist of methods to measure the success of activities carried out with
			 a grant awarded under section 302(a) or a subgrant awarded under section 303(c)
			 in producing—</text>
					<paragraph id="H60CC115CAA3E46A88EA37D894F2899D7"><enum>(1)</enum><text>gains in the
			 integration of immigrants into the United States, including increases—</text>
						<subparagraph id="H6FE3BA253DD3439900EB472E6FF72ED1"><enum>(A)</enum><text>in the
			 understanding of the history and form of government of the United States and of
			 the responsibilities of United States citizenship;</text>
						</subparagraph><subparagraph id="H00F9A5A075EA48DA86FD24A884A1127C"><enum>(B)</enum><text>in obtaining the
			 skills needed to meet the requirements of section 312(a) of the Immigration and
			 Nationality Act (8 U.S.C. 1423(a));</text>
						</subparagraph><subparagraph id="HEA8EDC1341E142B194E594C8C114353"><enum>(C)</enum><text>in the
			 participation of such immigrants in volunteer or other community involvement
			 activities; and</text>
						</subparagraph><subparagraph id="H385F342CF7224BC486DB3274EA273977"><enum>(D)</enum><text>in the
			 participation of such immigrants who are parents in education of their
			 children;</text>
						</subparagraph></paragraph><paragraph id="H7325C98561CC46F1B8DFBE77C159309E"><enum>(2)</enum><text>gains in the
			 education levels of immigrants to the United States, including increases
			 in—</text>
						<subparagraph id="HA068C02CCC2447F0A723FE249C00A156"><enum>(A)</enum><text>the English
			 language proficiency of such immigrants;</text>
						</subparagraph><subparagraph id="H54BD35CDF88443468300330083A739E5"><enum>(B)</enum><text>the literacy
			 skills of such immigrants; and</text>
						</subparagraph><subparagraph id="HB9CCDFBF842A4EF080D88100300066E"><enum>(C)</enum><text>the rates of such
			 immigrants in obtaining a high school diploma or its recognized equivalent;
			 or</text>
						</subparagraph></paragraph><paragraph id="H9D42BB450B184AFC8932CA5EA75D1157"><enum>(3)</enum><text>gains in the
			 employment status of immigrants to the United States, including increases
			 in—</text>
						<subparagraph id="H6A3EC13DB192417AB2B6434D81CF45BE"><enum>(A)</enum><text>the level of job
			 skills of such immigrants, including workplace English; and</text>
						</subparagraph><subparagraph id="H6AF4752B53F342869136DEEAC935D2C"><enum>(B)</enum><text>the ability of such
			 immigrants to obtain and retain full-time employment.</text>
						</subparagraph></paragraph></subsection><subsection id="HA2473AA887BD46809C99D686F7B978F3"><enum>(c)</enum><header>Annual
			 evaluation</header><text>The Chief of the Office of Citizenship and Immigrant
			 Integration shall conduct an annual evaluation of the grant program established
			 under this title. Such evaluation shall be used by the Chief—</text>
					<paragraph id="HE317CE78CF2D4D9D8112D5F3F3EF180"><enum>(1)</enum><text>to
			 improve the effectiveness of programs carried out by the Chief;</text>
					</paragraph><paragraph id="H75C5625F47024C1AB794DCAFF630D93"><enum>(2)</enum><text>to
			 assess future needs of immigrants and of State and local governments related to
			 immigrants; and</text>
					</paragraph><paragraph id="H1F2DAD08E83442D88984ECA551C54E59"><enum>(3)</enum><text>to determine the
			 effectiveness of such grant program.</text>
					</paragraph></subsection></section><section id="H2B9890E99A224B948056B9ACD1ABA6E7"><enum>305.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated $100,000,000 for each of fiscal years 2009
			 through 2014 to carry out this title.</text>
