		<official-title>To amend the Energy Employees Occupational Illness
		  Compensation Program Act of 2000 to expand the category of individuals eligible
		  for compensation, to improve the procedures for providing compensation, and to
		  improve transparency, and for other purposes.</official-title>

		<section commented="no" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Compensation and Respect for Energy
			 Workers Act of 2008</short-title></quote> or the <quote><short-title>CARE Act</short-title></quote>.</text>
		</section><section id="id18799B5669A440DBB495CF25DCA2BCED"><enum>2.</enum><header>Expansion of
			 cancers for which individuals are eligible to receive compensation under the
			 Energy Employees Compensation Program Act of 2000 and the Radiation Exposure
			 Compensation Act</header><text display-inline="no-display-inline">Section
			 4(b)(2) of the Radiation Exposure Compensation Act (42 U.S.C. 2210 note) is
			 amended—</text>
			<paragraph id="id84EAE2FEF4634D67BA63A16E4E65B64A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(other than chronic
			 lymphocytic leukemia)</quote> and inserting <quote>(including chronic
			 lymphocytic leukemia)</quote>;</text>
			</paragraph><paragraph id="idBD5042078B7E423284CA0901EAC5082D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>posterior subcapsular
			 cataracts, nonmalignant thyroid nodular disease, parathyroid adenoma, malignant
			 tumors of the brain and central nervous system, brochio-alveolar carcinoma,
			 benign neoplasms of the brain and central nervous system,</quote> after
			 <quote>disease),</quote>; and</text>
			</paragraph><paragraph id="id75D45471BF4547A69085120BD6A9B6F1"><enum>(3)</enum><text>by striking
			 <quote>or lung</quote> and inserting <quote>lung, skin, kidney, salivary gland,
			 rectum, pharynx, or prostate</quote>.</text>
			</paragraph></section><section commented="no" id="id6142385E9E964E3D94E9DC8022537B7C"><enum>3.</enum><header>Distribution of
			 information to claimants and potential claimants</header>
			<subsection id="idF17D8428CFB0463CB5FABC5116D35DF5"><enum>(a)</enum><header>Independent
			 physicians for performance of medical and impairment
			 screenings</header><text>Paragraph (2) of subsection (b) of section 3631 of the
			 Energy Employees Occupational Illness Compensation Program Act of 2000 (42
			 U.S.C. 7384v) is amended—</text>
				<paragraph id="idA1038D391B914F87B8DBEDF84B6C59F3"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id776AA7C4BC25483AABAEF3FB3533C489"><enum>(2)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C); and</text>
				</paragraph><paragraph id="idB4FB5688098B48CD8510D3B7F85D4A19"><enum>(3)</enum><text>by inserting
			 after subparagraph (A) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5AD990E5F81742299FE1648A9AA48C06" style="OLC">
						<subparagraph id="id170A8440CB0C4382BDDEBEB50B0D7640"><enum>(B)</enum><text>lists of
				physicians qualified to perform medical and impairment screenings on matters
				relating to the compensation program who are identified for purposes of this
				subparagraph by one or more independent medical associations, institutions of
				higher education, or both selected by the President for purposes of this
				subparagraph;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id27479C6958144805BB8773C69640041B"><enum>(b)</enum><header>Notice of
			 available benefits</header><text>Such section is further amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5C6929F0D6EE4BCD9E43FF74EED45554" style="OLC">
					<subsection id="id148AC990BA1A431AA9388D3D3CA43A86"><enum>(d)</enum><header>Notice to
				claimants on available benefits</header><text>The President shall provide to an
				individual who files a claim for compensation under this subtitle or subtitle E
				written notice on the benefits for which the individual may be eligible under
				this
				Act.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id599EEB9430684802A82888785BA4AC61"><enum>4.</enum><header>Enhancement of
			 site profiles of Department of Energy facilities</header>
			<subsection id="id1DDD2856215245F485E9E48E9F344F4E"><enum>(a)</enum><header>Inclusion of
			 trade names of chemicals in site profiles</header><text>Subsection (c) of
			 section 3633 of the Energy Employees Occupational Illness Compensation Program
			 Act of 2000 (42 U.S.C. 7384w–1) is amended by adding at the end the following
			 new sentence: <quote>In identifying any chemical commonly used in a building or
			 process of a facility, an exposure assessment shall include the trade name (if
			 any) of such chemical.</quote>.</text>
			</subsection><subsection id="idE67A4076CFED4DC8ABF09117A54D0142"><enum>(b)</enum><header>Public access
			 to site profiles and related information</header><text>Such section is further
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id021DED830AB34A2CAA8E0B4CE97FB956" style="OLC">
					<subsection id="id78FF3C1E64AB4040A392C2A43E04451C"><enum>(e)</enum><header>Public access
				to site profiles and related information</header><text>The Secretary of Labor
				shall make available to the public each site profile prepared under subsection
				(a) and any other database used by the Department to evaluate claims for
				compensation under this
				Act.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id3AC00C0A5DEB43D7B074E9F5CBD618B3"><enum>5.</enum><header>Payment of
			 compensation to survivors and estates of contractor employees</header><text display-inline="no-display-inline">Section 3672 of the Energy Employees
			 Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7385s–1) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idBC949394923A43F1895ED8978204E89E" style="OLC">
				<section id="id5D48F96CADFA48A685D7F3E1FB583F64"><enum>3672.</enum><header>Compensation
				to be provided</header><text display-inline="no-display-inline">Subject to the
				other provisions of this subtitle:</text>
					<paragraph id="id2C61EFF1E87C4BCE8CFAD353EB6ABA03"><enum>(1)</enum><header>Contractor
				employees</header>
						<subparagraph id="idE1BE392BF81243E1B76832BDCAD037A0"><enum>(A)</enum><header>In
				general</header><text>A covered DOE contractor employee shall receive
				contractor employee compensation under this subtitle in accordance with section
				3673.</text>
						</subparagraph><subparagraph id="idDF91E43B86B148EFADE7AB9FCD207CD8"><enum>(B)</enum><header>Compensation
				after death of contractor employee</header><text>Except as provided in
				paragraph (2)(B), if the death of a contractor employee occurs after the
				employee applies for compensation under this subtitle but before such
				compensation is paid, the amount of compensation the employee would have
				received under this paragraph shall be paid to a survivor of the employee (for
				purposes of section 3674) or, if the employee has no survivors, the estate of
				the employee.</text>
						</subparagraph></paragraph><paragraph id="idA87FB7CCA8274E13A484FC55EBFF5E64"><enum>(2)</enum><header>Survivors</header>
						<subparagraph id="idDBBCDA36BD0C49E983606391BC9BE2B0"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), a survivor of a
				covered DOE contractor employee shall receive contractor employee compensation
				under this subtitle in accordance with section 3674.</text>
						</subparagraph><subparagraph id="idEA07DD43C7B64BF1B117AF6BCFD38246"><enum>(B)</enum><header>Election of
				contractor employee compensation or survivor compensation</header><text>A
				survivor who is otherwise eligible to receive compensation pursuant to both
				subparagraph (A) and paragraph (1)(B) shall not receive compensation pursuant
				to both subparagraph (A) and paragraph (1)(B), but shall receive compensation
				pursuant to subparagraph (A) or paragraph (1)(B), as elected by the
				survivor.</text>
						</subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id7B278890ED054261861C86DB8324EA28"><enum>6.</enum><header>Expansion of
			 authority of Ombudsman of Energy Employees Occupational Illness Compensation
			 Program</header><text display-inline="no-display-inline">Section 3686 of the
			 Energy Employees Occupational Illness Compensation Program Act of 2000 (42
			 U.S.C. 7385s–15) is amended—</text>
			<paragraph id="id5AA11B6859554F51BF18116A9881EC0C"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (c) to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="idA4B4EC4FD64E478AB01FF6EF5B02E3C5" style="OLC">
					<subsection id="IDcca5930778884ef684bfb73a65fea68a"><enum>(c)</enum><header>Duties</header><text>The
				duties of the Office shall be as follows:</text>
						<paragraph id="ID72a7a4c7110347c0b325534ee17dbff4"><enum>(1)</enum><text>To assist
				individuals in making claims under this subtitle and subtitle B.</text>
						</paragraph><paragraph id="ID30cdded92b064b7a9776179a00c3f920"><enum>(2)</enum><text>To provide
				information on the benefits available under this subtitle and subtitle B and on
				the requirements and procedures applicable to the provision of such
				benefits.</text>
						</paragraph><paragraph id="ID779398f5bdc449928be1ccf9ab8f5334"><enum>(3)</enum><text>To act as an
				advocate on behalf of individuals seeking benefits under this subtitle and
				subtitle B.</text>
						</paragraph><paragraph id="ID5058920e4a0041a5a56675e2b265c502"><enum>(4)</enum><text>To make
				recommendations to the Secretary regarding the location of centers (to be known
				as <quote>resource centers</quote>) for the acceptance and development of
				claims for benefits under this subtitle and subtitle B.</text>
						</paragraph><paragraph id="ID53fc87c477b647b08547c71a1dad727e"><enum>(5)</enum><text>To carry out such
				other duties as the Secretary shall
				specify.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id900F8A4F5A574EEF87016C6D896F1BDA"><enum>(2)</enum><text>in subsection
			 (d), by inserting <quote>or subtitle B</quote> after <quote>this
			 subtitle</quote>;</text>
			</paragraph><paragraph id="id0F653011C7054541A71E8CC384EAF5A5"><enum>(3)</enum><text>in subsection
			 (e), by inserting <quote>and subtitle B</quote> after <quote>this
			 subtitle</quote> each place it appears; and</text>
			</paragraph><paragraph id="id67719D6CFB4C4C6FAA390D0F4E10B192"><enum>(4)</enum><text>by striking
			 subsection (g) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1B4E818642CD47239F09F354CB8C647C" style="OLC">
					<subsection id="ID32ec08e795df49b39c6e998f69c42e8e"><enum>(g)</enum><header>Contract
				authority</header><text>The Ombudsman may contract for the services of
				individuals with expertise in such matters, including health physics, medicine,
				industrial hygiene, and toxicology, as the Ombudsman considers appropriate for
				the performance of the duties of the
				Office.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idB500E987E27D4EA893950AAB4425837F"><enum>7.</enum><header>Extension of
			 time for claimants to respond to requests for information</header><text display-inline="no-display-inline">If the Secretary of Labor requests
			 information from an individual who has filed a claim for compensation under the
			 Energy Employees Occupational Illness Compensation Program Act of 2000 with
			 respect to that claim, the individual shall have not less than 120 days to
			 respond to the request.</text>
		</section><section id="id68DB201E9198482C899C231B59BBB9B0"><enum>8.</enum><header>Extension of
			 statute of limitations for judicial review of contractor employee
			 claims</header>
			<subsection id="idBB9B24D2A5054844B3F399F9F29A9E9B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3677(a) of
			 the Energy Employees Occupational Illness Compensation Program Act of 2000 (42
			 U.S.C. 7385s–6(a)) is amended by striking <quote>within 60 days</quote> and
			 inserting <quote>not later than 1 year</quote>.</text>
			</subsection><subsection id="id53B8F4FDDBDD4F568493C48831ADBD54"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to final decisions of the Secretary of Labor under subtitle E of the
			 Energy Employees Occupational Illness Compensation Program Act of 2000 (42
			 U.S.C. 7385s et seq.) issued on or after the date of the enactment of this
			 Act.</text>
			</subsection></section><section commented="no" id="id967A17E3694249918C5973B11852BE6F"><enum>9.</enum><header>Payment of
			 transportation expenses and for personal care services</header>
			<subsection commented="no" id="id7623CA906F3C4A06AF1219B55F12F3EE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of enactment of this Act, the Secretary of Labor shall
			 prescribe regulations to provide for the direct payment to providers of the
			 costs to individuals described in subsection (b) of—</text>
				<paragraph commented="no" id="id5D23A7484C574DB7B1229B4C4CE265CB"><enum>(1)</enum><text>personal care
			 services (as that term is used in section 30.403 of title 20, Code of Federal
			 Regulations (as in effect on the day before the date of the enactment of this
			 Act)) authorized pursuant to section 3629 of the Energy Employees Occupational
			 Illness Compensation Program Act of 2000 (42 U.S.C. 7384t); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF665B3EF82DC44E289C4980598B2BE74"><enum>(2)</enum><text>necessary and
			 reasonable transportation expenses incident to securing medical services,
			 appliances, or supplies pursuant to section 3629(c) of such Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8E5C9DA15970430B96B48E73E5846A45"><enum>(b)</enum><header>Covered
			 individuals</header><text>An individual described in this subsection is an
			 individual who receives medical benefits under section 3629(a) of the Energy
			 Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C.
			 7384t(a)).</text>
			</subsection></section><section id="idCA804DA2C85846D3A92FE25DBE6601B2"><enum>10.</enum><header>Enhancement of
			 transparency in claims process</header>
			<subsection id="id1BE1CDBE4CD54AC382D455007989A242"><enum>(a)</enum><header>Information
			 provided upon denial of claim; correspondence in easily understandable
			 language</header><text>Not later than 90 days after the date of the enactment
			 of this Act, the President shall prescribe regulations to ensure that—</text>
				<paragraph id="idADC3685850B845E495DA8ECD41A060E5"><enum>(1)</enum><text>any notification
			 to an individual making a claim under the Energy Employees Occupational Illness
			 Compensation Program Act of 2000 that the claim has been denied, and all other
			 correspondence with such an individual with respect to a claim, are written in
			 language that is clear, concise, and easily understandable; and</text>
				</paragraph><paragraph id="id03152F2AA24B4EC2AAE73D785EF38DD4"><enum>(2)</enum><text>any such
			 notification is accompanied by an explanation of the reasons for denying the
			 claim and a description of the information, if any, the individual could have
			 submitted that might have resulted in approval of the claim.</text>
				</paragraph></subsection><subsection id="id2C8B71B26D3B4F2B9800DDCF72F980AD"><enum>(b)</enum><header>Document
			 retention</header><text>Not later than 90 days after the date of the enactment
			 of this Act, the Secretary of Labor and the Secretary of Energy shall jointly
			 prescribe regulations to ensure that the Department of Labor and the Department
			 of Energy—</text>
				<paragraph id="idC772C727B2F14B87A946621EF8E6223A"><enum>(1)</enum><text>retain all
			 original documents in the possession of such Departments related to a
			 Department of Energy facility if—</text>
					<subparagraph id="id521CC07FE8B64515A022B0C8A8A05F63"><enum>(A)</enum><text>employees of that
			 facility might reasonably be expected to file claims for compensation under the
			 Energy Employees Occupational Illness Compensation Program Act of 2000;
			 and</text>
					</subparagraph><subparagraph id="id20FD7F40BDCD48AB94A031F805ED4F00"><enum>(B)</enum><text>the documents
			 might reasonably be expected to be used by such employees in making such
			 claims; and</text>
					</subparagraph></paragraph><paragraph id="id495B62DC8D7641D3BEFC415D995E5AB0"><enum>(2)</enum><text>provide such
			 employees access to such documents.</text>
				</paragraph></subsection></section></legis-body>
