		</section><section id="HD88D2743BC644F1A978731DC04C7C4C"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <quote>United States
			 person</quote> means—</text>
			<paragraph id="HDF58D5E9A3F1400092FB36281563120"><enum>(1)</enum><text>any United States
			 resident or national,</text>
			</paragraph><paragraph id="H1682D934D9BC4922B28172BE41B4C166"><enum>(2)</enum><text>any domestic
			 concern (including any permanent domestic establishment of any foreign
			 concern), and</text>
			</paragraph><paragraph id="H33FF126113024BE880CAB38E51FC64F"><enum>(3)</enum><text>any foreign
			 subsidiary or affiliate (including any permanent foreign establishment) of any
			 domestic concern that is controlled in fact by such domestic concern,</text>
			</paragraph><continuation-text continuation-text-level="section">except that
			 such term does not include an individual who resides outside the United States
			 and is employed by an individual or entity other than an individual or entity

			<section commented="no" id="idB9FDA4EA51474ADB8EFB0922EFB61CD7"><enum>101.</enum><header>Civil
			 penalties for certain violations</header>
				<subsection id="id38D90953490A477B8C5951DD8DA57324"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 5 of title
			 17, United States Code, is amended by inserting after section 506 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id44ACD45E351746F5B756DE15FA69FB8E" style="OLC">
						<section id="ID6787846c38354b03b03ad121468f97f2"><enum>506a.</enum><header>Civil
				penalties for violations of section 506</header>
							<subsection id="IDe5cea137d4d3467894e932b7ad3c17f7"><enum>(a)</enum><header>In
				general</header><text>In lieu of a criminal action under section 506, the
				Attorney General may commence a civil action in the appropriate United States
				district court against any person who engages in conduct constituting an
				offense under section 506. Upon proof of such conduct by a preponderance of the
				evidence, such person shall be subject to a civil penalty under section 504
				which shall be in an amount equal to the amount which would be awarded under
				section 3663(a)(1)(B) of title 18 and restitution to the copyright owner
				aggrieved by the conduct.</text>
							</subsection><subsection id="IDd0ecc332137b4f1fb519bab0bf5824ae"><enum>(b)</enum><header>Other
				remedies</header>
								<paragraph id="IDbaa61985392b41e2b29d474cf6fe3e19"><enum>(1)</enum><header>In
				general</header><text>Imposition of a civil penalty under this section does not
				preclude any other criminal or civil statutory, injunctive, common law, or
				administrative remedy, which is available by law to the United States or any
				other person.</text>
								</paragraph><paragraph id="ID1cddded86c6e4d0eb0275d7094a3179e"><enum>(2)</enum><header>Offset</header><text>Any
				restitution received by a copyright owner as a result of a civil action brought
				under this section shall be offset against any award of damages in a subsequent
				copyright infringement civil action by that copyright owner for the conduct
				that gave rise to the civil action brought under this
				section.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID44583f45e2f3427899fcd6195b7320fe"><enum>(b)</enum><header>Damages and
			 profits</header><text>Section 504 of title 17, United States Code, is
			 amended—</text>

			 (b)—</text>
						<subparagraph id="ID161cbe9774a8487e8a24200a73347f6e"><enum>(A)</enum><text>in the first

			 civil actions; harmless error</header><text>Section 411 of title 17, United
			 States Code, is amended—</text>
					<paragraph id="IDb0492799b24043959f2faa848fd596ef"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="OLC">civil</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">infringement</header-in-text></quote>;</text>
					</paragraph><paragraph id="ID86de84431e2c46e3a62547ff85ce15db"><enum>(2)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="ID00383b79f2fb4a848702169720c4ab8d"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>no action</quote> and inserting <quote>no civil
			 action</quote>; and</text>

				registration satisfies the requirements of this section and section 412,
				regardless of whether the certificate contains any inaccurate information,

									<subparagraph id="id83FDB9CB5E31496BB34CC5591B571118" indent="up1"><enum>(A)</enum><text>the inaccurate information was
				included on the application for copyright registration with knowledge that it
				was inaccurate; and</text>
									</subparagraph><subparagraph id="id63C89A9A419D43D089F5634BE28E8A37" indent="up1"><enum>(B)</enum><text>the
				<deleted-phrase reported-display-style="strikethrough">inaccurate</deleted-phrase><added-phrase reported-display-style="italic">inaccuracy of the</added-phrase> information,
				if known, would have caused the Register of Copyrights to refuse
				registration.</text>
									</subparagraph></paragraph><paragraph id="idBA80BF462E094426AE267F6EB9407CDB" indent="up1"><enum>(2)</enum><text>In any case in which inaccurate
				information described under paragraph (1) is alleged, the court shall request
				the Register of Copyrights to advise the court whether the inaccurate
				information, if known, would have caused the Register of Copyrights to refuse
				registration.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID204c55399ed842bcb57b1ce3ab1fd8d4"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
					<paragraph id="ID66075cb862ea450195f21e8dcf6909aa"><enum>(1)</enum><text>Section 412 of
			 title 17, United States Code, is amended by striking <quote>411(b)</quote> and
			 inserting <quote>411(c)</quote>.</text>
					</paragraph><paragraph id="IDc10a08f1ad394c9bbd9afb2c3a962abc"><enum>(2)</enum><text>The item relating
			 to section 411 in the table of sections for chapter 4 of title 17, United
			 States Code, is amended to read as follows:</text>

			 general</header><text>Section 503(a) of title 17, United States Code, is
			 amended—</text>
					<paragraph id="IDde9e050620dc4f259dc8621992122a6e"><enum>(1)</enum><text>by striking
			 <quote>and of all plates</quote> and inserting <quote>, of all plates</quote>;
			 and</text>
					</paragraph><paragraph id="ID08e736cc32c64f90a148f0dc6c9059df"><enum>(2)</enum><text>by striking the
			 period and inserting <quote>, and of records documenting the manufacture, sale,
			 or receipt of things involved in such violation. The court shall enter, if
			 appropriate, a protective order with respect to discovery of any records that
			 have been seized. The protective order shall provide for appropriate procedures
			 to ensure that confidential information contained in such records is not
			 improperly disclosed to any party.</quote>.</text>
					</paragraph></subsection><subsection changed="deleted" id="ID159ce9beebe84559bf487be320cd2770" reported-display-style="strikethrough"><enum>(b)</enum><header>Protective
			 orders for seized records</header><text>Section 34(d)(1)(A) of the Trademark
			 Act (15 U.S.C. 1116(d)(1)(A)) is amended by adding at the end the following:
			 <quote>The court shall enter, if appropriate, a protective order with respect
			 to discovery of any records that have been seized. The protective order shall
			 provide for appropriate procedures to ensure that confidential information
			 contained in such records is not improperly disclosed to any
			 party.</quote></text>
				</subsection><subsection changed="added" id="id823985C4DA2C422DB5D1F99E3CAE293F" reported-display-style="italic"><enum>(a)</enum><header>In
			 general</header><text>Section 503(a) of title 17, United States Code, is
			 amended to read as follows:</text>
					<quoted-block changed="added" display-inline="no-display-inline" id="idF4D0B43E41674D83922972DB87F1866E" reported-display-style="italic" style="OLC">
						<subsection id="id1745FF9EB00A463B9D7188E3F53B88FF"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5F15531805CB43ACAAF714949E79C90C"><enum>(1)</enum><text>At any time while an
				action under this title is pending, the court may order the impounding, on such
				terms as it may deem reasonable—</text>
								<subparagraph changed="added" id="id2EA7B859BB9043D89D87D5977A8B54AA" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>of all
				copies or phonorecords claimed to have been made or used in violation of the
				exclusive right of the copyright owner;</text>
								</subparagraph><subparagraph changed="added" id="id97A16162603B469D870D83BEB447D419" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>of all
				plates, molds, matrices, masters, tapes, film negatives, or other articles by
				means of which such copies of phonorecords may be reproduced; and</text>
								</subparagraph><subparagraph changed="added" id="id2A21F6990EF84CDBBBBEF3ABA8AEF5B3" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>of
				records documenting the manufacture, sale, or receipt of things involved in any
				such violation, provided that any records seized under this subparagraph shall
				be taken into the custody of the court.</text>
								</subparagraph></paragraph><paragraph changed="added" id="id8C2356C1EE5E4346BA2E09CD63F582F1" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>For
				impoundments of records ordered under paragraph (1)(C), the court shall enter
				an appropriate protective order with respect to discovery and use of any
				records or information that has been impounded. The protective order shall
				provide for appropriate procedures to ensure that confidential, private,
				proprietary, or privileged information contained in such records is not
				improperly disclosed or used.</text>
							</paragraph><paragraph changed="added" id="id81EE8D993A3242A8A304A75B19CD9AB7" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The
				relevant provisions of paragraphs (2) through (11) of section 34(d) of the
				Trademark Act (15 U.S.C. 1116(d)(2) through (11)) shall extend to any
				impoundment of records ordered under paragraph (1)(C) that is based upon an ex
				parte application, notwithstanding the provisions of rule 65 of the Federal
				Rules of Civil Procedure. Any references in paragraphs (2) through (11) of
				section 34(d) of the Trademark Act to section 32 of such Act shall be read as
				references to section 501 of this title, and references to use of a counterfeit
				mark in connection with the sale, offering for sale, or distribution of goods
				or services shall be read as references to infringement of a
				copyright.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection changed="added" id="id686D454F2DCC45809E518CC4C3318921" reported-display-style="italic"><enum>(b)</enum><header>Protective order for
			 seized records</header><text>Section 34(d)(7) of the Trademark Act (15 U.S.C.
			 1116(d)(7)) is amended to read as follows:</text>
					<quoted-block changed="added" display-inline="no-display-inline" id="idFABA985C5C2842DB85B501CDD7089CFC" reported-display-style="italic" style="OLC">
						<paragraph id="idA517085287DF41B0A30BE9E17C821ECB"><enum>(7)</enum><text>Any materials seized
				under this subsection shall be taken into the custody of the court. For
				seizures made under this section, the court shall enter an appropriate
				protective order with respect to discovery and use of any records or
				information that has been seized. The protective order shall provide for
				appropriate procedures to ensure that confidential, private, proprietary, or
				privileged information contained in such records is not improperly disclosed or
				used.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H6BCFE75351924FC8B228178323922B58"><enum>203.</enum><header>Treble damages
			 in counterfeiting cases</header><text display-inline="no-display-inline">Section 35(b) of the Trademark Act of 1946
			 (15 U.S.C. 1117(b)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0C3842E651F14E2C007ED58818818040" style="OLC">
					<subsection id="HC4EE013A8B3F4E6EBD03993BCEC8D8C9"><enum>(b)</enum><text display-inline="yes-display-inline">In assessing damages under subsection (a)
				for any violation of section 32(1)(a) of this Act or section 220506 of title
				36, United States Code, in a case involving use of a counterfeit mark or
				designation (as defined in section 34(d) of this Act), the court shall, unless
				the court finds extenuating circumstances, enter judgment for three times such
				profits or damages, whichever amount is greater, together with a reasonable
				attorney's fee, if the violation consists of—</text>
						<paragraph id="HC9702842ED8A4A9F9C419CD45EA7CB40"><enum>(1)</enum><text display-inline="yes-display-inline">intentionally using a mark or designation,
				knowing such mark or designation is a counterfeit mark (as defined in section
				34(d) of this Act), in connection with the sale, offering for sale, or
				distribution of goods or services; or</text>
						</paragraph><paragraph id="HCB0E6E4937524013AA9C22447C916C3F"><enum>(2)</enum><text>providing goods or
				services necessary to the commission of a violation specified in paragraph (1),
				with the intent that the recipient of the goods or services would put the goods
				or services to use in committing the violation.</text>
						</paragraph><continuation-text continuation-text-level="subsection">In such a
				case, the court may award prejudgment interest on such amount at an annual
				interest rate established under section 6621(a)(2) of the Internal Revenue Code
				of 1986, beginning on the date of the service of the claimant’s pleadings
				setting forth the claim for such entry of judgment and ending on the date such
				entry is made, or for such shorter time as the court considers
				appropriate.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				used, or intended to be used, in any manner or part to commit or facilitate the
				commission of an offense referred to in subparagraph (A), except that property
				is subject to forfeiture under this subparagraph only if the United States
				Government establishes that there was a substantial connection between the
				property and the violation of an offense referred to in subparagraph
				(A).</text>

				constituting or derived from any proceeds obtained directly or indirectly as a
				result of the commission of an offense referred to in subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="IDc35ff2c5507a4709ba28686bec021e3a"><enum>(2)</enum><header>Procedures</header><text>The
				provisions of chapter 46 relating to civil forfeitures shall extend to any
				seizure or civil forfeiture under this section.
				<added-phrase reported-display-style="italic">For seizures made under this
				section, the court shall enter an appropriate protective order with respect to
				discovery and use of any records or information that has been seized. The
				protective order shall provide for appropriate procedures to ensure that
				confidential, private, proprietary, or privileged information contained in such
				records is not improperly disclosed or used.</added-phrase> At the conclusion
				of the forfeiture proceedings, unless otherwise requested by an agency of the
				United States, the court shall order that any property forfeited under
				paragraph (1) be destroyed, or otherwise disposed of according to law.</text>
								</paragraph></subsection><subsection id="IDedee9258493e44d882ddf24886667f56"><enum>(b)</enum><header>Criminal
				forfeiture</header>
								<paragraph id="IDdc4cd714e67b4a64a2a3dc6ada6a3de3"><enum>(1)</enum><header>Property
				subject to forfeiture</header><text>The court, in imposing sentence on a person
				convicted of an offense under section 506 or 1204 of title 17, or section 2318,
				2319, 2319A, 2319B, or 2320, or chapter 90, of this title, shall order, in
				addition to any other sentence imposed, that the person forfeit to the United
				States Government any property subject to forfeiture under subsection (a) for
				that offense.</text>
								</paragraph><paragraph id="ID485ba06cbe4a4416b37b0a44cc28437c"><enum>(2)</enum><header>Procedures</header>
									<subparagraph id="IDace80e18f5d44b30a8254a496cf09d78"><enum>(A)</enum><header>In
				general</header><text>The forfeiture of property under paragraph (1), including
				any seizure and disposition of the property and any related judicial or
				administrative proceeding, shall be governed by the procedures set forth in
				section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970
				(21 U.S.C. 853), other than subsection (d) of that section.</text>
									</subparagraph><subparagraph id="IDdf743bb7f17d4d9d9c65b7e1be2d0b26"><enum>(B)</enum><header>Destruction</header><text>At
				the conclusion of the forfeiture proceedings, the court, unless otherwise
				requested by an agency of the United States shall order that any—</text>
										<clause id="ID6536cb916cf24da99f1b55f089db0b61"><enum>(i)</enum><text>forfeited article
				or component of an article bearing or consisting of a counterfeit mark be
				destroyed or otherwise disposed of according to law; and</text>
										</clause><clause id="ID16e58b732ef9415a9945dc15be3c7db9"><enum>(ii)</enum><text>infringing items
				or other property described in subsection (a)(1)(A) and forfeited under
				paragraph (1) of this subsection be destroyed or otherwise disposed of
				according to law.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID39e32850137f4a01a70cf9ddd1e384f6"><enum>(c)</enum><header>Restitution</header><text>When
				a person is convicted of an offense under section 506
				<deleted-phrase reported-display-style="strikethrough">or 1204</deleted-phrase>
				of title 17 or section 2318, 2319, 2319A, 2319B, or 2320, or chapter 90, of
				this title, the court, pursuant to sections 3556, 3663A, and 3664 of this
				title, shall order the person to pay restitution to any victim of the offense
				as an offense against property referred to in section 3663A(c)(1)(A)(ii) of
				this
				title.</text>

			<section id="ID60b1e0256c434acaa4d13c02ee11c128"><enum>401.</enum><header>Intellectual
			 property enforcement coordinator</header>
				<subsection id="ID1a0084fad7f14569850f6ab3e4d76fdb"><enum>(a)</enum><header>Intellectual
			 Property Enforcement Coordinator</header><text>The President shall appoint, by
			 and with the advice and consent of the Senate, an Intellectual Property
			 Enforcement Coordinator (in this title referred to as the <quote>IPEC</quote>)
			 to serve within the Executive Office of the President. As an exercise of the
			 rulemaking power of the Senate, any nomination of the IPEC submitted to the
			 Senate for confirmation, and referred to a committee, shall be referred to the
			 Committee on the Judiciary.</text>
				</subsection><subsection id="ID612aab28422c48d3a26a3705e3d9bf53"><enum>(b)</enum><header>Duties of
			 IPEC</header>
					<paragraph id="ID8dde3c5619ed4514b96ee4f689246538"><enum>(1)</enum><header>In
			 general</header><text>The IPEC shall—</text>
						<subparagraph id="IDe20874780ed8472da370065328d64307"><enum>(A)</enum><text>chair the
			 interagency intellectual property enforcement advisory committee established
			 under subsection (b)(3)(A);</text>
						</subparagraph><subparagraph id="IDa54a6ffd4fea4aeb8ac7ef66af0c3160"><enum>(B)</enum><text>coordinate the
			 development of the Joint Strategic Plan against counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase> by the advisory
			 committee under section 403;</text>
						</subparagraph><subparagraph id="IDc8c5e42846dc4711ad110d7c8ee22699"><enum>(C)</enum><text>assist in the
			 implementation of the Joint Strategic Plan by the departments and agencies
			 listed in subsection (b)(3)(A);</text>
						</subparagraph><subparagraph changed="added" id="id5374A5351DA14E1C87E086DB3ADDEC36" reported-display-style="italic"><enum>(D)</enum><text>facilitate the issuance
			 of policy guidance to departments and agencies on basic issues of policy and
			 interpretation, to the extent necessary to assure the coordination of
			 intellectual property enforcement policy and consistency with other law;</text>
						</subparagraph><subparagraph id="IDbcec8a7a09934c099a317ab1089af96f"><enum>(<deleted-phrase reported-display-style="strikethrough">D</deleted-phrase><added-phrase reported-display-style="italic">E</added-phrase>)</enum><text>report directly
			 to the President and Congress regarding domestic and international intellectual
			 property enforcement programs;</text>
						</subparagraph><subparagraph id="IDec2c77c581ac49e7b98ec57d7b26ef8e"><enum>(<deleted-phrase reported-display-style="strikethrough">E</deleted-phrase><added-phrase reported-display-style="italic">F</added-phrase>)</enum><text>report to
			 Congress, as provided in section 404, on the implementation of the Joint
			 Strategic Plan, and make recommendations to Congress for improvements in
			 Federal intellectual property enforcement efforts; and</text>
						</subparagraph><subparagraph id="ID06255c8d851146d1b013639c1f2b6a40"><enum>(<deleted-phrase reported-display-style="strikethrough">F</deleted-phrase><added-phrase reported-display-style="italic">G</added-phrase>)</enum><text>carry out such
			 other functions as the President may direct.</text>
						</subparagraph></paragraph><paragraph id="ID0be22e47ffaf4e10a977021cddf3fa42"><enum>(2)</enum><header>Limitation on
			 authority</header><text>The IPEC may not control or direct any law enforcement
			 agency in the exercise of its investigative or prosecutorial authority.</text>
					</paragraph><paragraph id="IDccc454ffa4174de984c6cd7af51eb809"><enum>(3)</enum><header>Advisory
			 committee</header>

			 Copyrights, or a senior representative of the United States Copyright Office
			 appointed by the Register of Copyrights.</text>
							</clause></subparagraph><subparagraph id="ID96ab5b87a4304eeca50d819b1b0b1318"><enum>(B)</enum><header>Functions</header><text>The
			 advisory committee established under subparagraph (A) shall develop the Joint
			 Strategic Plan against counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase> under section
			 403.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd8f8f2e989ef4dcb9403653444426102"><enum>(c)</enum><header>Compensation</header><text>Section
			 5312 of title 5, United States Code, is amended by adding at the end the
			 following: <quote>United States Intellectual Property Enforcement
			 Coordinator.</quote>.</text>
				</subsection></section><section id="ID88688d9400a4469c9d3e24e4729dcd44"><enum>402.</enum><header>Definition</header><text display-inline="no-display-inline">For purposes of this title, the term
			 <term>intellectual property enforcement</term> means matters relating to the
			 enforcement of laws protecting copyrights, patents, trademarks, other forms of
			 intellectual property, and trade secrets, both in the United States and abroad,
			 including in particular matters relating to combating counterfeit and
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods.</text>
			</section><section id="ID3ed53e072a734d4ba6de7d77b7d731aa"><enum>403.</enum><header>Joint
			 strategic plan</header>
				<subsection id="ID69bba75a7f9d49ddb85b4d00705e08fa"><enum>(a)</enum><header>Purpose</header><text>The
			 objectives of the Joint Strategic Plan against counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase> that is referred to
			 in section 401(b)(1)(B) (in this section referred to as the <quote>joint
			 strategic plan</quote>) are the following:</text>
					<paragraph id="ID402d224f1aaf4db6bbb0c691fb9ae63a"><enum>(1)</enum><text>Reducing
			 counterfeit and <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods in the domestic
			 and international supply chain.</text>
					</paragraph><paragraph id="ID35a1704715dc4862a21a3729cc5e84e6"><enum>(2)</enum><text>Identifying and
			 addressing structural weaknesses, systemic flaws, or other unjustified
			 impediments to effective enforcement action against the financing, production,
			 trafficking, or sale of counterfeit or
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods.</text>
					</paragraph><paragraph id="IDea7b3a3841c74430a223938d267c171b"><enum>(3)</enum><text>Ensuring that
			 information is identified and shared among the relevant departments and
			 agencies, to the extent permitted by law and consistent with law enforcement
			 protocols for handling information, to aid in the objective of arresting and
			 prosecuting individuals and entities that are knowingly involved in the
			 financing, production, trafficking, or sale of counterfeit or
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods.</text>
					</paragraph><paragraph id="ID4c3ea0eee6bc42ba9cf0b6dbcb53d335"><enum>(4)</enum><text>Disrupting and
			 eliminating domestic and international counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase> networks.</text>
					</paragraph><paragraph id="ID14ddc34432e0473fa6644d93db2d3a2a"><enum>(5)</enum><text>Strengthening the
			 capacity of other countries to protect and enforce intellectual property
			 rights, and reducing the number of countries that fail to enforce laws
			 preventing the financing, production, trafficking, and sale of counterfeit and
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods.</text>
					</paragraph><paragraph id="ID3e7a2b1a7c154a0a965ce72e454b5d0c"><enum>(6)</enum><text>Working with
			 other countries to establish international standards and policies for the
			 effective protection and enforcement of intellectual property rights.</text>
					</paragraph><paragraph id="ID32038ec01ec3480a89b7a4b649d8f31b"><enum>(7)</enum><text>Protecting
			 intellectual property rights overseas by—</text>
						<subparagraph id="ID4b55362006af41b6b194cb7e1f46beab"><enum>(A)</enum><text>working with
			 other countries and exchanging information with appropriate law enforcement
			 agencies in other countries relating to individuals and entities involved in
			 the financing, production, trafficking, or sale of
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> or counterfeit
			 goods;</text>
						</subparagraph><subparagraph id="IDcfd85e5dd4cf4b1eb5b6f88d2c4cc97b"><enum>(B)</enum><text>using the
			 information described in subparagraph (A) to conduct enforcement activities in
			 cooperation with appropriate law enforcement agencies in other countries;
			 and</text>
						</subparagraph><subparagraph id="IDcd972d570d2a477d9cdf3412a860638a"><enum>(C)</enum><text>building a formal
			 process for consulting with companies, industry associations, labor unions, and
			 other interested groups in other countries with respect to intellectual
			 property enforcement.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd1bcb769593b42a2a82a02c4d213a581"><enum>(b)</enum><header>Timing</header><text>Not
			 later than 12 months after the date of the enactment of this Act, and not later
			 than December 31 of every third year thereafter, the IPEC shall submit the
			 joint strategic plan to the Committee on the Judiciary and the Committee on
			 Appropriations of the Senate, and to the Committee on the Judiciary and the
			 Committee on Appropriations of the House of Representatives.</text>
				</subsection><subsection id="ID942451b3bacb481897ab5e8e83f4a9e2"><enum>(c)</enum><header>Responsibility
			 of the IPEC</header><text>During the development of the joint strategic plan,
			 the IPEC—</text>
					<paragraph id="ID37e048d69a49441da0ff9a8ddc31b559"><enum>(1)</enum><text>shall provide
			 assistance to, and coordinate the meetings and efforts of, the appropriate
			 officers and employees of departments and agencies represented on the advisory
			 committee appointed under section 401(b)(3) who are involved in intellectual
			 property enforcement; and</text>
					</paragraph><paragraph id="ID810a8514f48a4c79b95fbd857eec4189"><enum>(2)</enum><text>may consult with
			 private sector experts in intellectual property enforcement in furtherance of
			 providing assistance to the members of the advisory committee appointed under
			 section 401(b)(3).</text>
					</paragraph></subsection><subsection id="ID9de640c4c0134b488a9e2fa468d4f5a8"><enum>(d)</enum><header>Responsibilities
			 of other departments and agencies</header><text>In the development and
			 implementation of the joint strategic plan, the heads of the departments and
			 agencies identified under section 401(b)(3) shall—</text>
					<paragraph id="ID57a7d87f6cda4dedbd85475d48bd91cc"><enum>(1)</enum><text>designate
			 personnel with expertise and experience in intellectual property enforcement
			 matters to work with the IPEC and other members of the advisory committee;
			 and</text>
					</paragraph><paragraph id="ID6a365337e9f741a9bf7538056c46aa3f"><enum>(2)</enum><text>share relevant
			 department or agency information with the IPEC and other members of the
			 advisory committee, including statistical information on the enforcement
			 activities of the department or agency against counterfeiting or
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>, and plans for
			 addressing the joint strategic plan.</text>
					</paragraph></subsection><subsection id="IDbbc14e67ba4241b0bea1b3af09c46fe8"><enum>(e)</enum><header>Contents of the
			 joint strategic plan</header><text>Each joint strategic plan shall include the
			 following:</text>
					<paragraph id="IDc2386acd2c5e425c868cc7f4ec5d741b"><enum>(1)</enum><text>A detailed
			 description of the priorities identified for carrying out the objectives in the
			 joint strategic plan, including activities of the Federal Government relating
			 to intellectual property enforcement.</text>
					</paragraph><paragraph id="ID37e37ddb9d7f468182c07b0fe23f82d1"><enum>(2)</enum><text>A detailed
			 description of the means and methods to be employed to achieve the priorities,
			 including the means and methods for improving the efficiency and effectiveness
			 of the Federal Government’s enforcement efforts against counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>.</text>
					</paragraph><paragraph id="ID1346db7af7084355bbeec62a51389ebb"><enum>(3)</enum><text>Estimates of the
			 resources necessary to fulfill the priorities identified under paragraph
			 (1).</text>
					</paragraph><paragraph id="ID1b32130ee6de42e6819c3555d465e884"><enum>(4)</enum><text>The performance
			 measures to be used to monitor results under the joint strategic plan during
			 the following year.</text>
					</paragraph><paragraph id="ID73ee2e0004e44fb4a82b54d5f857e265"><enum>(5)</enum><text>An analysis of
			 the threat posed by violations of intellectual property rights, including the
			 costs to the economy of the United States resulting from violations of
			 intellectual property laws, and the threats to public health and safety created
			 by counterfeiting and <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>.</text>
					</paragraph><paragraph id="ID81933a2005574d39bb156724bb3126f9"><enum>(6)</enum><text>An identification
			 of the departments and agencies that will be involved in implementing each
			 priority under paragraph (1).</text>
					</paragraph><paragraph id="ID5239fa3d68924dd28d226cc8e18675a1"><enum>(7)</enum><text>A strategy for
			 ensuring coordination between the IPEC and the departments and agencies
			 identified under paragraph (6), including a process for oversight by the
			 executive branch of, and accountability among, the departments and agencies
			 responsible for carrying out the strategy.</text>
					</paragraph><paragraph id="ID1f14d47e17e248d1856bbed2879e74a0"><enum>(8)</enum><text>Such other
			 information as is necessary to convey the costs imposed on the United States
			 economy by, and the threats to public health and safety created by,
			 counterfeiting and <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>, and those steps
			 that the Federal Government intends to take over the period covered by the
			 succeeding joint strategic plan to reduce those costs and counter those
			 threats.</text>
					</paragraph></subsection><subsection id="IDc0f931d12db945d78629ef3150afe809"><enum>(f)</enum><header>Enhancing
			 enforcement efforts of foreign governments</header><text>The joint strategic
			 plan shall include programs to provide training and technical assistance to
			 foreign governments for the purpose of enhancing the efforts of such
			 governments to enforce laws against counterfeiting and
			 <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>. With respect to
			 such programs, the joint strategic plan shall—</text>
					<paragraph id="ID2b01105139e44c14bb93a6133b6980ce"><enum>(1)</enum><text>seek to enhance
			 the efficiency and consistency with which Federal resources are expended, and
			 seek to minimize duplication, overlap, or inconsistency of efforts;</text>
					</paragraph><paragraph id="ID3bcd46c94a9d480eb0df945d661208d8"><enum>(2)</enum><text>identify and give
			 priority to those countries where programs of training and technical assistance
			 can be carried out most effectively and with the greatest benefit to reducing
			 counterfeit and <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> products in the United
			 States market, to protecting the intellectual property rights of United States
			 persons and their licensees, and to protecting the interests of United States
			 persons otherwise harmed by violations of intellectual property rights in those
			 countries;</text>
					</paragraph><paragraph id="ID139a4100828d4b169585c1a1ff48613e"><enum>(3)</enum><text>in identifying
			 the priorities under paragraph (2), be guided by the list of countries
			 identified by the United States Trade Representative under section 182(a) of
			 the Trade Act of 1974 (19 U.S.C. 2242(a)); and</text>
					</paragraph><paragraph id="IDfbb60f4d2df348e58cc8fa28bd9abef8"><enum>(4)</enum><text>develop metrics
			 to measure the effectiveness of the Federal Government’s efforts to improve the
			 laws and enforcement practices of foreign governments against counterfeiting
			 and <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase>.</text>
					</paragraph></subsection><subsection id="IDe17fd36792424a5f9d2c434451b984ae"><enum>(g)</enum><header>Dissemination
			 of the joint strategic plan</header><text>The joint strategic plan shall be
			 posted for public access on the website of the White House, and shall be
			 disseminated to the public through such other means as the IPEC may
			 identify.</text>
				</subsection></section><section id="ID67c26323ea634ccf9399877233750805"><enum>404.</enum><header>Reporting</header>
				<subsection id="ID78ef1ef1b65545d7a9bd73bce020bab8"><enum>(a)</enum><header>Annual
			 report</header><text>Not later than December 31 of each calendar year beginning
			 in 2009, the IPEC shall submit a report on the activities of the advisory
			 committee during the preceding fiscal year. The annual report shall be
			 submitted to Congress, and disseminated to the people of the United States, in
			 the manner specified in subsections (b) and (g) of section 403.</text>
				</subsection><subsection id="ID5839c99396b94f7dbf1aae7e1f82415a"><enum>(b)</enum><header>Contents</header><text>The
			 report required by this section shall include the following:</text>
					<paragraph id="ID13ca2820a76545c8bf7fdfcad226a076"><enum>(1)</enum><text>The progress made
			 on implementing the strategic plan and on the progress toward fulfillment of
			 the priorities identified under section 403(e)(1).</text>
					</paragraph><paragraph id="IDfb608ba11dde4180a1ce61df9d2cba7a"><enum>(2)</enum><text>The progress made
			 in efforts to encourage Federal, State, and local government departments and
			 agencies to accord higher priority to intellectual property enforcement.</text>
					</paragraph><paragraph id="ID049a98df8a284f5189474abb95fa54ad"><enum>(3)</enum><text>The progress made
			 in working with foreign countries to investigate, arrest, and prosecute
			 entities and individuals involved in the financing, production, trafficking,
			 and sale of counterfeit and
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> goods.</text>
					</paragraph><paragraph id="ID11118724179c4bb6a9f043fa5a8ef1a6"><enum>(4)</enum><text>The manner in
			 which the relevant departments and agencies are working together and sharing
			 information to strengthen intellectual property enforcement.</text>
					</paragraph><paragraph id="ID641ed70c24e84577b54fbda382715579"><enum>(5)</enum><text>An assessment of
			 the successes and shortcomings of the efforts of the Federal Government,
			 including departments and agencies represented on the committee established
			 under section 401(b)(3).</text>
					</paragraph><paragraph id="ID70019f2ae2314009b42a9039ef62578c"><enum>(6)</enum><text>Recommendations
			 for any changes in enforcement statutes, regulations, or funding levels that
			 the advisory committee considers would significantly improve the effectiveness
			 or efficiency of the effort of the Federal Government to combat counterfeiting
			 and <deleted-phrase reported-display-style="strikethrough">piracy</deleted-phrase><added-phrase reported-display-style="italic">infringement</added-phrase> and otherwise
			 strengthen intellectual property enforcement, including through the elimination
			 or consolidation of duplicative programs or initiatives.</text>
					</paragraph><paragraph id="ID2cb2c77d336b436aa557b6d424074a93"><enum>(7)</enum><text>The progress made
			 in strengthening the capacity of countries to protect and enforce intellectual
			 property rights.</text>
					</paragraph><paragraph id="IDfa9ad8f081f94a7a847dc23b148c14ed"><enum>(8)</enum><text>The successes and
			 challenges in sharing with other countries information relating to intellectual
			 property enforcement.</text>
					</paragraph><paragraph id="IDdec57949ffc340628e35a706fcd15411"><enum>(9)</enum><text>The progress made
			 under trade agreements and treaties to protect intellectual property rights of
			 United States persons and their licensees.</text>
					</paragraph></subsection></section><section id="IDbf9e029f3e7a4317ac35b948769df01f"><enum>405.</enum><header>Savings and
			 repeals</header>
				<subsection changed="deleted" id="ID18a4942303af477889c62f9ee4c6f891" reported-display-style="strikethrough"><enum>(a)</enum><header>Repeal of
			 coordination council</header><text>Section 653 of the Treasury and General
			 Government Appropriations Act, 2000 (15 U.S.C. 1128) is repealed.</text>
				</subsection><subsection changed="added" id="id5B5472340C51439886BB1B214366261A" reported-display-style="italic"><enum>(a)</enum><header>Transition from NIPLECC
			 to IPEC</header>
					<paragraph id="id64CFC9FAEA3849FB8B13A12CBB517EA9"><enum>(1)</enum><header>Repeal of
			 NIPLECC</header><text>Section 653 of the Treasury and General Government
			 Appropriations Act, 2000 (15 U.S.C. 1128) is repealed effective upon
			 confirmation of the IPEC by the Senate and publication of such appointment in
			 the Congressional Record.</text>
					</paragraph><paragraph id="idE986F3B884584C73AA0C1E26950FAABD"><enum>(2)</enum><header>Continuity of
			 performance of duties</header><text>Upon confirmation by the Senate, and
			 notwithstanding paragraph (1), the IPEC may use the services and personnel of
			 the National Intellectual Property Law Enforcement Coordination Council, for
			 such time as is reasonable, to perform any functions or duties which in the
			 discretion of the IPEC are necessary to facilitate the orderly transition of
			 any functions or duties transferred from the Council to the IPEC pursuant to
			 any provision of this Act or any amendment made by this Act.</text>
					</paragraph></subsection><subsection id="IDa34b2d08540c455cb427e668413669ef"><enum>(b)</enum><header>Current
			 authorities not affected</header><text>Except as provided in subsection (a),
			 nothing in this title shall alter the authority of any department or agency of
			 the United States (including any independent agency) that relates to—</text>
					<paragraph id="IDd5045fd3712647b5a20212a25e0a11c3"><enum>(1)</enum><text>the investigation
			 and prosecution of violations of laws that protect intellectual property
			 rights;</text>
					</paragraph><paragraph id="ID03f01b64c42c4263afb32b4d7fb6904d"><enum>(2)</enum><text>the
			 administrative enforcement, at the borders of the United States, of laws that
			 protect intellectual property rights; or</text>
					</paragraph><paragraph id="ID11c49287294f4ebc979df349f53d77bd"><enum>(3)</enum><text>the United States
			 trade agreements program or international trade.</text>
					</paragraph></subsection><subsection changed="deleted" id="IDad16d4cf00154edfa6a8cc0497ca0a7c" reported-display-style="strikethrough"><enum>(c)</enum><header>Register of
			 copyrights</header><text>Nothing in this title shall derogate from the duties
			 and functions of the Register of Copyrights.</text>
				</subsection><subsection changed="added" id="id2C1A114F2BD4421288A00C70A0106823" reported-display-style="italic"><enum>(c)</enum><header>Rule of
			 construction</header><text>Nothing in this title shall derogate from the
			 powers, duties, and functions of any of the agencies, departments, or other
			 entities listed or included under section 401(b)(3)(A).</text>
				</subsection></section><section id="IDac2f4a8d1acf4d9aa0c5d781a7c96dd5"><enum>406.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="ID4333aa5269af42fba4abd10cf7e65b03"><enum>(a)</enum><header>In
			 General</header><text>There are authorized to be appropriated for each fiscal
			 year such sums as may be necessary to carry out this title.</text>
				</subsection></section></title><title id="H12BB09988911409491355E6C8311006C"><enum>V</enum><header>Department of
			 Justice Programs</header>
			<section id="H4AD135A124974962A8002DE116D030C8"><enum>501.</enum><header>Local law
			 enforcement grants</header>
				<subsection id="H02C68270756847E197CFB0AB8C10B5CE"><enum>(a)</enum><header>Authorization</header><text>Section
			 2 of the Computer Crime Enforcement Act (42 U.S.C. 3713) is amended—</text>
					<paragraph id="H7A953F59CC2248CBA300DD769B17262D"><enum>(1)</enum><text>in subsection (b),
			 by inserting after <quote>computer crime</quote> each place it appears the
			 following: <quote>, including infringement of copyrighted works over the
			 Internet</quote>; and</text>
					</paragraph><paragraph id="H584FA7C937FF41CF8B9B77FAD468BD3F"><enum>(2)</enum><text>in subsection
			 (e)(1), relating to authorization of appropriations, by striking <quote>fiscal
			 years 2001 through 2004</quote> and inserting <quote>fiscal years 2009 through
			 2013</quote>.</text>
					</paragraph></subsection><subsection id="HF696DEBFF5914AD100B0F8DA6F484245"><enum>(b)</enum><header>Grants</header><text>The
			 Office of Justice Programs of the Department of Justice shall make grants to
			 eligible State or local law enforcement entities, including law enforcement
			 agencies of municipal governments and public educational institutions, for
			 training, prevention, enforcement, and prosecution of intellectual property
			 theft and infringement crimes (in this subsection referred to as <quote>IP–TIC
			 grants</quote>), in accordance with the following:</text>
					<paragraph id="H7B4200A13B294E4B89FC2DCE07003CA2"><enum>(1)</enum><header>Use of IP–TIC
			 Grant Amounts</header><text display-inline="yes-display-inline">IP–TIC grants
			 may be used to establish and develop programs to do the following with respect
			 to the enforcement of State and local true name and address laws and State and
			 local criminal laws on anti-piracy, anti-counterfeiting, and unlawful acts with
			 respect to goods by reason of their protection by a patent, trademark, service
			 mark, trade secret, or other intellectual property right under State or Federal
			 law:</text>
						<subparagraph id="HFEB039D5178D46B59200009C77A2981C"><enum>(A)</enum><text>Assist State and
			 local law enforcement agencies in enforcing those laws, including by
			 reimbursing State and local entities for expenses incurred in performing
			 enforcement operations, such as overtime payments and storage fees for seized
			 evidence.</text>
						</subparagraph><subparagraph id="H1049FACD167648609C3226169B76B828"><enum>(B)</enum><text>Assist State and
			 local law enforcement agencies in educating the public to prevent, deter, and
			 identify violations of those laws.</text>
						</subparagraph><subparagraph id="H577FB4C3DA9541C0849FCC72F075C3C"><enum>(C)</enum><text>Educate and train
			 State and local law enforcement officers and prosecutors to conduct
			 investigations and forensic analyses of evidence and prosecutions in matters
			 involving those laws.</text>
						</subparagraph><subparagraph id="H10F68EB5140248B7A6392E74CA77D067"><enum>(D)</enum><text display-inline="yes-display-inline">Establish task forces that include
			 personnel from State or local law enforcement entities, or both, exclusively to
			 conduct investigations and forensic analyses of evidence and prosecutions in
			 matters involving those laws.</text>
						</subparagraph><subparagraph id="H6DF325320C2242199008F1A3A41FA9AC"><enum>(E)</enum><text>Assist State and
			 local law enforcement officers and prosecutors in acquiring computer and other
			 equipment to conduct investigations and forensic analyses of evidence in
			 matters involving those laws.</text>
						</subparagraph><subparagraph id="H6C5266F7859B488D948F88D9E5668CFF"><enum>(F)</enum><text display-inline="yes-display-inline">Facilitate and promote the sharing, with
			 State and local law enforcement officers and prosecutors, of the expertise and
			 information of Federal law enforcement agencies about the investigation,
			 analysis, and prosecution of matters involving those laws and criminal
			 infringement of copyrighted works, including the use of multijurisdictional
			 task forces.</text>
						</subparagraph></paragraph><paragraph id="HC491A40D5DEB400296A33115B76170E3"><enum>(2)</enum><header>Eligibility</header><text>To
			 be eligible to receive an IP–TIC grant, a State or local government entity
			 shall provide to the Attorney General—</text>
						<subparagraph id="HBBA3C012B6FB4C20983C425B3DE2EFD"><enum>(A)</enum><text display-inline="yes-display-inline">assurances that the State in which the
			 government entity is located has in effect laws described in paragraph
			 (1);</text>
						</subparagraph><subparagraph id="HDE67D32E89974655AD8B4C62B71D3600"><enum>(B)</enum><text>an assessment of
			 the resource needs of the State or local government entity applying for the
			 grant, including information on the need for reimbursements of base salaries
			 and overtime costs, storage fees, and other expenditures to improve the
			 investigation, prevention, or enforcement of laws described in paragraph (1);
			 and</text>
						</subparagraph><subparagraph id="H8627BCF1CF5A4CCA9093F7C43F280094"><enum>(C)</enum><text>a plan for
			 coordinating the programs funded under this section with other federally funded
			 technical assistance and training programs, including directly funded local
			 programs such as the Edward Byrne Memorial Justice Assistance Grant Program
			 authorized by subpart 1 of part E of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.).</text>
						</subparagraph></paragraph><paragraph id="H2043FD60EDC344119122482826F2B150"><enum>(3)</enum><header>Matching
			 funds</header><text>The Federal share of an IP–TIC grant may not exceed
			 <deleted-phrase reported-display-style="strikethrough">90</deleted-phrase><added-phrase reported-display-style="italic">75</added-phrase> percent of the costs of the
			 program or proposal funded by the IP–TIC grant<deleted-phrase reported-display-style="strikethrough">, unless the Attorney General waives, in
			 whole or in part, the 90 percent requirement</deleted-phrase>.</text>
					</paragraph><paragraph commented="no" id="HD1FAD8DDEF5444709067F3329EDDA6B"><enum>(4)</enum><header>Authorization of
			 appropriations</header>
						<subparagraph commented="no" id="H21B2E2750F024E0FA1F513960B8C047"><enum>(A)</enum><header>Authorization</header><text>There
			 is authorized to be appropriated to carry out this subsection the sum of
			 $25,000,000 for each of fiscal years 2009 through 2013.</text>
						</subparagraph><subparagraph commented="no" id="HC5B66FABF8064E068DCC5819069C7F00"><enum>(B)</enum><header>Limitation</header><text>Of
			 the amount made available to carry out this subsection in any fiscal year, not
			 more than 3 percent may be used by the Attorney General for salaries and
			 administrative expenses.</text>
						</subparagraph></paragraph></subsection></section><section id="ID9f9127fdc124493b8a8574ea859f5dd8"><enum>502.</enum><header>Improved
			 investigative and forensic resources for enforcement of laws related to
			 intellectual property crimes</header>
				<subsection id="ID87c4e0d7e0ec43d9995ef0995e135009"><enum>(a)</enum><header>In
			 general</header><text>Subject to the availability of appropriations to carry
			 out this subsection, the Attorney General, in consultation with the Director of
			 the Federal Bureau of Investigation, shall, with respect to crimes related to
			 the theft of intellectual property—</text>
					<paragraph id="ID91bb208b78c6456c86c530455e6df1a0"><enum>(1)</enum><text>create an
			 operational unit of the Federal Bureau of Investigation—</text>
						<subparagraph id="ID3c89ab18f41042e5944b48181f695cc7"><enum>(A)</enum><text>to work with the
			 Computer Crime and Intellectual Property section of the Department of Justice
			 on the investigation and coordination of intellectual property crimes
			 <deleted-phrase reported-display-style="strikethrough">that are complex,
			 committed in more than 1 judicial district, or
			 international</deleted-phrase>;</text>
						</subparagraph><subparagraph id="ID2ed7b7b31c984cef87d188451f7ca352"><enum>(B)</enum><text>that consists of
			 at least 10 agents of the Bureau; and</text>
						</subparagraph><subparagraph id="ID1c4f1d4414cf49bb8081b19b70ca4eca"><enum>(C)</enum><text>that is located
			 at the headquarters of the Bureau;</text>
						</subparagraph></paragraph><paragraph id="ID6073913471f047c58301e560a4ff3c3a"><enum>(2)</enum><text>ensure that any
			 unit in the Department of Justice responsible for investigating computer
			 hacking or intellectual property crimes is
			 <deleted-phrase reported-display-style="strikethrough">assigned</deleted-phrase><added-phrase reported-display-style="italic">supported by</added-phrase> at least 2 agents
			 of the Federal Bureau of Investigation (in addition to any agent
			 <deleted-phrase reported-display-style="strikethrough">assigned
			 to</deleted-phrase><added-phrase reported-display-style="italic">supporting</added-phrase> such unit as of the
			 date of the enactment of this Act) to support such unit for the purpose of
			 investigating or prosecuting intellectual property crimes;
			 <deleted-phrase reported-display-style="strikethrough">and</deleted-phrase></text>
					</paragraph><paragraph changed="added" id="ID0c57a1747b9f444493f4783f5eed70ac" reported-display-style="italic"><enum>(3)</enum><text>ensure that all Computer
			 Hacking and Intellectual Property Crime Units located at an office of a United
			 States Attorney are assigned at least 2 Assistant United States Attorneys
			 responsible for investigating and prosecuting computer hacking or intellectual
			 property crimes; and <deleted-phrase reported-display-style="strikethrough"></deleted-phrase></text>
					</paragraph><paragraph id="IDd5c42fdf25674949b21643316d5e9983"><enum>(<deleted-phrase reported-display-style="strikethrough">3</deleted-phrase><added-phrase reported-display-style="italic">4</added-phrase>)</enum><text>implement a
			 comprehensive program—</text>
						<subparagraph id="ID83506a8c27a54d79ab9487e5b4ff82b7"><enum>(A)</enum><text>the purpose of
			 which is to train agents of the Federal Bureau of Investigation in the
			 investigation and prosecution of such crimes and the enforcement of laws
			 related to intellectual property crimes;</text>
						</subparagraph><subparagraph id="ID03408af6c489402784347f64c25e52e1"><enum>(B)</enum><text>that includes
			 relevant forensic training related to investigating and prosecuting
			 intellectual property crimes; and</text>
						</subparagraph><subparagraph id="ID24e644e70f944c84b4b8486b4fa134d0"><enum>(C)</enum><text>that requires
			 such agents who investigate or prosecute intellectual property crimes to attend
			 the program annually.</text>
						</subparagraph></paragraph></subsection><subsection id="ID615f2994800c4470bd0c678b458e81a8"><enum>(b)</enum><header>Organized crime
			 task force</header><text>Subject to the availability of appropriations to carry
			 out this subsection, and not later than 120 days after the date of the
			 enactment of this Act, the Attorney General, through the United States
			 Attorneys’ Offices, the Computer Crime and Intellectual Property section, and
			 the Organized Crime and Racketeering section of the Department of Justice, and
			 in consultation with the Federal Bureau of Investigation and other Federal law
			 enforcement agencies, shall create
			 <deleted-phrase reported-display-style="strikethrough">a Task Force to
			 develop</deleted-phrase> and implement a comprehensive, long-range plan to
			 investigate and prosecute international organized crime syndicates engaging in
			 or supporting crimes relating to the theft of intellectual property.</text>
				</subsection><subsection id="IDdc1019210a5c4f94ad97624b9088c4a0"><enum>(c)</enum><header>Authorization</header><text>There
			 are authorized to be appropriated to carry out this section $12,000,000 for
			 each of fiscal years 2009 through 2013.</text>
				</subsection></section><section id="IDc55cfaad9c5c46d1b5f55f73ff53febf"><enum>503.</enum><header>Additional
			 funding for resources to investigate and prosecute criminal activity involving
			 computers</header>
				<subsection id="IDbefaf7949a354b1d8ff172e54111f3fe"><enum>(a)</enum><header>Additional
			 funding for resources</header>
					<paragraph id="ID3673ae820bbc4e60af10322434aa954c"><enum>(1)</enum><header>Authorization</header><text>In
			 addition to amounts otherwise authorized for resources to investigate and
			 prosecute criminal activity involving computers, there are authorized to be
			 appropriated for each of the fiscal years 2009 through 2013—</text>
						<subparagraph id="IDffb7ba9fb8ec48a4994ecc98e4cd887e"><enum>(A)</enum><text>$10,000,000 to
			 the Director of the Federal Bureau of Investigation; and</text>
						</subparagraph><subparagraph id="ID0b5ee0243bfa40449aee87dadbaef932"><enum>(B)</enum><text>$10,000,000 to
			 the Attorney General for the Criminal Division of the Department of
			 Justice.</text>
						</subparagraph></paragraph><paragraph id="ID814ee2ab2c5247008eb5316a28fd8865"><enum>(2)</enum><header>Availability</header><text>Any
			 amounts appropriated under paragraph (1) shall remain available until
			 expended.</text>
					</paragraph></subsection><subsection id="IDa6a033b51731434fa1f0cc517e435af1"><enum>(b)</enum><header>Use of
			 additional funding</header><text>Funds made available under subsection (a)
			 shall be used by the Director of the Federal Bureau of Investigation and the
			 Attorney General, for the Federal Bureau of Investigation and the Criminal
			 Division of the Department of Justice, respectively, to—</text>
					<paragraph id="ID5de0ae7b88874799bf2b42c7d564e91e"><enum>(1)</enum><text>hire and train
			 law enforcement officers to—</text>
						<subparagraph id="ID7170c7645f474c569024152bc6b51a77"><enum>(A)</enum><text>investigate
			 crimes committed through the use of computers and other information technology,
			 including through the use of the Internet; and</text>
						</subparagraph><subparagraph id="ID09e244f187d4419a98f853f2589cb82d"><enum>(B)</enum><text>assist in the
			 prosecution of such crimes; and</text>
						</subparagraph></paragraph><paragraph id="ID9c51ab99cdb0417387c15bcf1417d95e"><enum>(2)</enum><text>procure advanced
			 tools of forensic science to investigate, prosecute, and study such
			 crimes.</text>
					</paragraph></subsection></section><section id="HCD92C1590D3249228B04BD294CC37946"><enum>504.</enum><header>International
			 intellectual property law enforcement coordinators</header>
				<subsection id="H1D466AD92F4347869F115E90FC00A5A9"><enum>(a)</enum><header>Deployment of
			 additional coordinators</header><text display-inline="yes-display-inline">Subject to the availability of
			 appropriations to carry out this section, the Attorney General shall, within
			 180 days after the date of the enactment of this Act, deploy 5 Intellectual
			 Property Law Enforcement Coordinators, in addition to those serving in such
			 capacity on such date of enactment. Such deployments shall be made to those
			 countries and regions where the activities of such a coordinator can be carried
			 out most effectively and with the greatest benefit to reducing counterfeit and
			 <deleted-phrase reported-display-style="strikethrough">pirated</deleted-phrase><added-phrase reported-display-style="italic">infringed</added-phrase> products in the United
			 States market, to protecting the intellectual property rights of United States
			 persons and their licensees, and to protecting the interests of United States
			 persons otherwise harmed by violations of intellectual property rights in those
			 countries. The mission of all International Intellectual Property Law
			 Enforcement Coordinators shall include the following:</text>
					<paragraph id="HB5C892F77B884CAD9DC24D37BE00F95F"><enum>(1)</enum><text>Acting as liaison
			 with foreign law enforcement agencies and other foreign officials in criminal
			 matters involving intellectual property rights.</text>
					</paragraph><paragraph id="H94BCEDE701D849C99B98E2F1819058DC"><enum>(2)</enum><text>Performing
			 outreach and training to build the enforcement capacity of foreign governments
			 against intellectual property-related crime in the regions in which the
			 coordinators serve.</text>
					</paragraph><paragraph id="H9FB226C261A14A169046939D792C10E4"><enum>(3)</enum><text display-inline="yes-display-inline"><deleted-phrase reported-display-style="strikethrough">Coordinating</deleted-phrase><added-phrase reported-display-style="italic">Assisting in the coordination of</added-phrase>
			 United States law enforcement activities against intellectual property-related
			 crimes in the regions in which the coordinators serve.</text>
					</paragraph></subsection><subsection id="HEC7A876456E7451785B2CF00A23D1853"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for each
			 fiscal year such sums as may be necessary for the deployment and support of all
			 International Intellectual Property Enforcement Coordinators of the Department
			 of Justice, including those deployed under subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HD1A49DD04EB649AAAF3BB1B5A36500E2" section-type="subsequent-section"><enum>505.</enum><header>Annual
			 reports</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, and annually thereafter, the
			 Attorney General shall submit to the Committees on the Judiciary of the Senate
			 and the House of Representatives a report on actions taken to carry out this
			 title.</text>
			</section><section changed="deleted" commented="no" display-inline="no-display-inline" id="idEF7950C9EEB94B2794203B47AD08E1FE" reported-display-style="strikethrough" section-type="subsequent-section"><enum>506.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated for each fiscal year such sums as may be
			 necessary to carry out this title.</text>
			</section></title><title changed="added" id="id9A2636EB9D6746A0906299E75C272E55" reported-display-style="italic"><enum>VI</enum><header>Miscellaneous</header>
			<section id="id9A0D9DAE5E924408B749438DAAEF668E"><enum>601.</enum><header>GAO study on
			 protection of intellectual property of manufacturers</header>
				<subsection id="id5ACF6991C6E44B1DA9C98EE6D4D11F37"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the Untied States shall conduct a study to help
			 determine how the Federal Government could better protect the intellectual
			 property of manufacturers by quantification of the impacts of imported and
			 domestic counterfeit goods on—</text>
					<paragraph id="idCE6B3268FEA947E3AC71D7C7CDB5B4E3"><enum>(1)</enum><text>the manufacturing
			 industry in the United States; and</text>
					</paragraph><paragraph id="idB1503AE21A9342BCB867677BBE5365E0"><enum>(2)</enum><text>the overall economy of
			 the United States.</text>
					</paragraph></subsection><subsection id="id91D3BA3816AB4DE0A182F1324C4F6724"><enum>(b)</enum><header>Contents</header><text>In
			 conducting the study required under subsection (a), the Comptroller General
			 shall examine—</text>
					<paragraph id="IDbab0050ead54413787663a132699e458"><enum>(1)</enum><text>the extent that
			 counterfeit manufactured goods are actively being trafficked in and imported
			 into the United States;</text>
					</paragraph><paragraph id="ID30d834539cab402b896f55bbb70958d8"><enum>(2)</enum><text>the impacts on domestic
			 manufacturers in the United States of current law regarding defending
			 intellectual property, including patent, trademark, and copyright
			 protections;</text>
					</paragraph><paragraph id="ID256ba0ad28d24ccba341628be78fb44e"><enum>(3)</enum><text>the nature and scope of
			 current statutory law and case law regarding protecting trade dress from being
			 illegally copied;</text>
					</paragraph><paragraph id="ID863628a75d0948e495ef37ea196063ec"><enum>(4)</enum><text>the extent which such
			 laws are being used to investigate and prosecute acts of trafficking in
			 counterfeit manufactured goods;</text>
					</paragraph><paragraph id="ID928ae77f86014baa9f8d29bfbad65c8c"><enum>(5)</enum><text>any effective practices
			 or procedures that are protecting all types of intellectual property;
			 and</text>
					</paragraph><paragraph id="ID42422f618cf840189eb7bfce175fa828"><enum>(6)</enum><text>any changes to current
			 statutes or rules that would need to be implemented to more effectively protect
			 the intellectual property rights of manufacturers.</text>
					</paragraph></subsection><subsection id="id92D7235BFF67483D8A2481A14F3595EB"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Comptroller
			 General shall submit to Congress a report on the results of the study required
			 under subsection (a).</text>
				</subsection></section><section id="idEDEF8ACA38FB49C98953D9B668ED1236"><enum>602.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="IDce2cacafe02741d8a3156cf8f862025a"><enum>(1)</enum><text>the United States
			 intellectual property industries have created millions of high-skill,
			 high-paying United States jobs and pay billions of dollars in annual United
			 States tax revenues;</text>
				</paragraph><paragraph id="ID2be7d64632d54e479de6c19926cd918f"><enum>(2)</enum><text>the United States
			 intellectual property industries continue to represent a major source of
			 creativity and innovation, business start-ups, skilled job creation, exports,
			 economic growth, and competitiveness;</text>
				</paragraph><paragraph id="ID0b72a861f7fe49f88c6615063bbfa51f"><enum>(3)</enum><text>counterfeiting and
			 infringement results in billions of dollars in lost revenue for United States
			 companies each year and even greater losses to the United States economy in
			 terms of reduced job growth, exports, and competitiveness;</text>
				</paragraph><paragraph id="IDf99722b729244d44b307345df11d5366"><enum>(4)</enum><text>the growing number of
			 willful violations of existing Federal criminal laws involving counterfeiting
			 and infringement by actors in the United States and, increasingly, by
			 foreign-based individuals and entities is a serious threat to the long-term
			 vitality of the United States economy and the future competitiveness of United
			 States industry;</text>
				</paragraph><paragraph id="ID6d2745ca09ff41c4a6660e7c25922a5d"><enum>(5)</enum><text>effective criminal
			 enforcement of the intellectual property laws against such violations in all
			 categories of works should be among the highest priorities of the Attorney
			 General; and</text>
				</paragraph><paragraph id="IDd6bbe81719f341eb93d1ef9bd5507266"><enum>(6)</enum><text>with respect to criminal
			 counterfeiting and infringement of computer software, the Attorney General
			 should give priority to cases—</text>
					<subparagraph id="ID71c1628c790049d88994d148b98216ca"><enum>(A)</enum><text>involving the willful
			 theft of intellectual property for purposes of commercial advantage or private
			 financial gain;</text>
					</subparagraph><subparagraph id="IDe836bdb58ea74039a36bff09f06b41c1"><enum>(B)</enum><text>where the theft of
			 intellectual property is central to the sustainability and viability of the
			 commercial activity of the enterprise (or subsidiary) involved in the
			 violation;</text>
					</subparagraph><subparagraph id="IDac600180b8114d569c8c36a0f1c1ef11"><enum>(C)</enum><text>where the counterfeited
			 or infringing goods or services enables the enterprise to unfairly compete
			 against the legitimate rights holder;</text>
					</subparagraph><subparagraph id="ID88f5cffa076e413095c8db51a0cf0b6b"><enum>(D)</enum><text>where there is actual
			 knowledge of the theft of intellectual property by the directors or officers of
			 the enterprise; and</text>
					</subparagraph><subparagraph id="IDf778b95d487b4cc2bf0f639444d8005a"><enum>(E)</enum><text>where the enterprise
			 involved in the theft of intellectual property is owned or controlled by a
			 foreign enterprise or other foreign entity.</text>
