		<section id="H996E6EF4030B4886A55C7994D1A91497" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Providing Real Outreach for Veterans
			 Act of 2008</short-title></quote> or the <quote><short-title>PRO–VETS Act of 2008</short-title></quote>.</text>
		</section><section id="HDF86A917BE3F4F6DA2012FA28A9C1B4"><enum>2.</enum><header>Sharing
			 information to improve veterans’ access to benefits</header>
			<subsection id="H139E006EFFE243ACA5FB9FB431E23C"><enum>(a)</enum><header>Agreement on data
			 transfer</header>
				<paragraph id="H565332C74B334400BFFACA51BEC4E87C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Veterans Affairs shall enter an
			 agreement with the Secretary of Defense providing for the transfer of data to
			 the Secretary of Veterans Affairs in accordance with this section for the
			 purpose of providing members of the Armed Forces and veterans with
			 individualized information about veterans benefits each member and veteran may
			 be eligible for.</text>
				</paragraph><paragraph id="H3AF3C44756C44286AE30301B11C75BAA"><enum>(2)</enum><header>Contents of
			 Agreement</header>
					<subparagraph id="HDA8934529C2E451394EB83150169AC15"><enum>(A)</enum><header>Specific
			 Criteria for Identification of Data</header><text>The agreement shall specify
			 criteria to identify data of the Department of Defense, including personnel
			 data and data contained in an electronic medical record system, that the
			 Secretary of Defense and the Secretary of Veterans Affairs agree could be used
			 by the Secretary of Veterans Affairs—</text>
						<clause id="H1411EB0687074C20ADD4D1B915FE6D4D"><enum>(i)</enum><text>to
			 determine the eligibility of a member of the Armed Forces or veteran for
			 veterans benefits; and</text>
						</clause><clause id="HFB5A76564BCD4C78A1E9397FCD7E8CB3"><enum>(ii)</enum><text>as
			 an indicator of a likelihood that a member of the Armed Forces or veteran is
			 eligible for veterans benefits.</text>
						</clause></subparagraph><subparagraph id="H075AAF981C98435BBD2572F25BB37B"><enum>(B)</enum><header>Electronic Data
			 Transfer Method</header><text>The agreement shall contain a description of an
			 efficient electronic method to be used for the transfer of data identified in
			 accordance with the criteria specified under
			 <internal-xref idref="HDA8934529C2E451394EB83150169AC15" legis-path="1.(a)(2)(A)">subparagraph (A)</internal-xref> under the
			 agreement.</text>
					</subparagraph><subparagraph id="HCBE655263BAB499683EABB596058492"><enum>(C)</enum><header>Transfer of
			 Data</header><text display-inline="yes-display-inline">Under the agreement, the
			 Secretary of Defense shall transfer data identified in accordance with the
			 criteria under
			 <internal-xref idref="HDA8934529C2E451394EB83150169AC15" legis-path="1.(a)(2)(A)">subparagraph (A)</internal-xref> to the Secretary of
			 Veterans Affairs as follows:</text>
						<clause id="H58E85D72FBA2446F84E7F6839E02A543"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a member of the Armed Forces
			 who is scheduled for discharge or separation from service, at the time the
			 Secretary of Defense first learns of the scheduled discharge or separation, but
			 not later than one month after the date of discharge or separation.</text>
						</clause><clause id="H340A7134A5D7424497E680F07EF4FE47"><enum>(ii)</enum><text>In
			 the case of a member of the Armed Forces or veteran not covered under
			 <internal-xref idref="H58E85D72FBA2446F84E7F6839E02A543" legis-path="1.(a)(2)(C)(i)">clause (i)</internal-xref>, at such time as is
			 specified under the agreement, but subject to
			 <internal-xref idref="H4F508BB2A1CD4FEEA6EA933BF797CC" legis-path="1.(e)">subsection (e)</internal-xref>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H21B1DB97417C4F12AE17005EC820AAFC"><enum>(b)</enum><header>Identification
			 of benefits available</header>
				<paragraph display-inline="no-display-inline" id="H3124D7DF4C06403DABC2E004CE3D4F04"><enum>(1)</enum><header>Generation of
			 initial list</header><text display-inline="yes-display-inline">Not later than 7
			 days after the date the Secretary of Veterans Affairs receives data concerning
			 a member of the Armed Forces or veteran under the agreement under
			 <internal-xref idref="H139E006EFFE243ACA5FB9FB431E23C" legis-path="1.(a)">subsection (a)</internal-xref>, the Secretary shall compile
			 a list with respect to the member or veteran of all veterans benefits for which
			 the member or veteran may be eligible based on the data. The list shall be
			 divided into—</text>
					<subparagraph id="H85328B65054A4924B96EF7AB9BD87428"><enum>(A)</enum><text>benefits for which
			 the member or veteran has a high probability of being eligible; and</text>
					</subparagraph><subparagraph id="HA8B8FBA23EF34AB5907B86E2D91DCC1"><enum>(B)</enum><text>all other benefits
			 for which the member or veteran may be eligible.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HF4C04261944948E19996E49EA228C7F8"><enum>(2)</enum><header>Updated benefits
			 list</header><text display-inline="yes-display-inline">The Secretary shall
			 update the list under
			 <internal-xref idref="H3124D7DF4C06403DABC2E004CE3D4F04" legis-path="1.(b)(1)">paragraph (1)</internal-xref> with respect to a member of
			 the Armed Forces or veteran on an annual basis using any information that the
			 Department of Veterans Affairs may possess about the member or veteran.</text>
				</paragraph></subsection><subsection id="HBF05724D8D2F4BBF973CB79B60001FA3"><enum>(c)</enum><header>Notification of
			 available benefits</header>
				<paragraph id="HF1EC6E31246147F3B53285CCB244982F"><enum>(1)</enum><header>Initial
			 notification</header><text display-inline="yes-display-inline">Upon compiling
			 the list of benefits under
			 <internal-xref idref="H3124D7DF4C06403DABC2E004CE3D4F04" legis-path="1.(b)(1)">subsection (b)(1)(A)</internal-xref> with respect to a
			 member of the Armed Forces or veteran, the Secretary of Veterans Affairs shall
			 send a notice of the benefits to the member or veteran or the legal
			 representative of the member or veteran. The notice shall also contain an
			 explanation of each such benefit and a summary of any application requirements
			 and procedures that the member or veteran must comply with to be eligible to
			 receive the benefit.</text>
				</paragraph><paragraph id="HD1D717F055CF49DA843194FDC63BAF"><enum>(2)</enum><header>Subsequent
			 Notifications</header>
					<subparagraph id="HA15361419986457C88B56C894630343D"><enum>(A)</enum><header>Second
			 notice</header><text display-inline="yes-display-inline">If a member of the
			 Armed Forces or veteran provided a notice under
			 <internal-xref idref="HF1EC6E31246147F3B53285CCB244982F" legis-path="1.(c)(1)">paragraph (1)</internal-xref> does not apply for any
			 benefit listed in the notice by the end of the 60-day period beginning on the
			 date that the Secretary sent the notice, the Secretary shall send a second
			 notice to the member or veteran or the legal representative of the member or
			 veteran. The notice shall contain the same information as the notice sent to
			 the member, veteran, or legal representative under
			 <internal-xref idref="HF1EC6E31246147F3B53285CCB244982F" legis-path="1.(c)(1)">paragraph (1)</internal-xref>.</text>
					</subparagraph><subparagraph id="HABB9E5537AAA426C9E859245264FEFEA"><enum>(B)</enum><header>Subsequent
			 annual notices</header><text display-inline="yes-display-inline">If a member of
			 the Armed Forces or veteran provided a notice under
			 <internal-xref idref="HA15361419986457C88B56C894630343D" legis-path="1.(c)(2)(A)">subparagraph (A)</internal-xref> does not apply for
			 any benefit listed in the notice by the end of the year beginning on the date
			 that the Secretary sent the notice, the Secretary shall send a subsequent
			 notice to the member or veteran or the legal representative of the member or
			 veteran. The notice shall contain information on the veterans benefits for
			 which the member or veteran has a high probability of being eligible based on
			 the updated list under subsection (b)(2) with respect to the member or
			 veteran.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HDAD9198862EA460A804CDE003E7CA8C"><enum>(3)</enum><header>Notices based on
			 changed circumstances</header>
					<subparagraph id="HB03C883780584AD390D14C478C004B3B"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall send a notice to the member or
			 veteran or the legal representative of the member or veteran if, based on data
			 available to the Secretary, the Secretary identifies a member of the Armed
			 Forces or veteran as having a high probability of being eligible for a veterans
			 benefit and—</text>
						<clause id="H3E5C699E78C34E94B375532CB942D2D"><enum>(i)</enum><text>the
			 member or veteran has not applied for the benefit;</text>
						</clause><clause id="HCBC839969906404C913DE47F44728551"><enum>(ii)</enum><text>the
			 Secretary has not sent the member or veteran a notice under this subsection
			 with respect to the benefit; and</text>
						</clause><clause id="H636BED569AE5411194E6BB945D18FC20"><enum>(iii)</enum><text>the Secretary
			 has not informed the member or veteran of the benefit under
			 <internal-xref idref="HED2F1A185A1F44BDBC0194CE86C70467" legis-path="1.(d)(2)">subsection (d)(2)</internal-xref> or any other provision
			 of law.</text>
						</clause></subparagraph><subparagraph id="H3E25815AC2A540A3AFE429A30715E4ED"><enum>(B)</enum><header>Contents</header><text>The
			 notice under
			 <internal-xref idref="HB03C883780584AD390D14C478C004B3B" legis-path="1.(c)(3)(A)">subparagraph (A)</internal-xref> shall contain
			 information on the benefit for which the veteran has a high probability of
			 being eligible, an explanation of such benefit, and a summary of any
			 application requirements and procedures that the member or veteran must comply
			 with to be eligible to receive the benefit.</text>
					</subparagraph></paragraph><paragraph id="H9546707D53AD4B2CAC94EEF4F1FABAC0"><enum>(4)</enum><header>Option to
			 decline further notices</header>
					<subparagraph id="H39A1B5AA9C4147E9B8155800D4CBD1BC"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall provide each member of the Armed
			 Forces and veteran that is sent a notice under this subsection with the option
			 to decline further notices under this subsection.</text>
					</subparagraph><subparagraph id="H47726E46FAAD4731A211EA174D73C578"><enum>(B)</enum><header>Notice of
			 option</header><text>Each notice under this subsection shall include
			 information concerning the option to decline further notices under this
			 subsection.</text>
					</subparagraph><subparagraph id="HAD4DE03B93DF486786ABF76FBA2D144B"><enum>(C)</enum><header>Prohibition of
			 further notices</header><text>If a member of the Armed Forces or veteran
			 declines further notices under this paragraph, the Secretary may not send any
			 notices under this section to the member or veteran after the date the member
			 or veteran declines further notices.</text>
					</subparagraph></paragraph><paragraph id="H2E2000572D0D478BA7ED7600B1A11D89"><enum>(5)</enum><header>Method of
			 delivery of notices</header>
					<subparagraph id="HBCABD7F77D9D46D894204D2EFDDAB25B"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to
			 <internal-xref idref="HFC14E0C07F2B4E2DB8DDAE50BFFA576F" legis-path="1.(c)(5)(B)">subparagraph (B)</internal-xref>, all notices under
			 this subsection shall be sent—</text>
						<clause id="HAF6EF097C756438988AEC2917D63DD10"><enum>(i)</enum><text>by
			 mail; and</text>
						</clause><clause id="HB1EEFF488D774BA4AFFA6BBC5CE530E8"><enum>(ii)</enum><text>electronically,
			 if the Secretary has electronic contact information for the member, veteran, or
			 legal representative of the member or veteran.</text>
						</clause></subparagraph><subparagraph id="HFC14E0C07F2B4E2DB8DDAE50BFFA576F"><enum>(B)</enum><header>Option on method
			 of delivery of notices</header><text>The Secretary shall provide each member
			 and veteran with the opportunity to be sent notices under this subsection
			 solely—</text>
						<clause id="H350534E1611A427881CD94A3E604CD4"><enum>(i)</enum><text>by
			 mail; or</text>
						</clause><clause id="H88446D2D36C44873BDC1E9FA8DAEBEB9"><enum>(ii)</enum><text display-inline="yes-display-inline">through electronic methods, such as
			 email.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H3F63C50E9DF5480300E02E70E1002632"><enum>(d)</enum><header>Application
			 Process</header>
				<paragraph id="HB6BA3A10E766412F83016706E636BD91"><enum>(1)</enum><header>Streamlined
			 Application Process</header>
					<subparagraph id="H16F04CC50E944923B0F13CB71C496702"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Veterans Affairs shall use the data received under
			 <internal-xref idref="H139E006EFFE243ACA5FB9FB431E23C" legis-path="1.(a)">subsection (a)</internal-xref> and any additional relevant
			 data that the Department of Veterans Affairs has in its possession to reduce
			 the amount of information that a member of the Armed Forces or veteran must
			 provide when the member or veteran applies to the Department for veterans
			 benefits. The use of such data may include prepopulating a paper or Web-based
			 application form to be used by the member or veteran with the data.</text>
					</subparagraph><subparagraph id="H5884DC8CDA584FF5B18801D4F012A3D6"><enum>(B)</enum><header>Confirmation</header><text display-inline="yes-display-inline">The Secretary may require that a member of
			 the Armed Forces or veteran confirm or verify any data that the Department of
			 Veterans Affairs uses under
			 <internal-xref idref="H16F04CC50E944923B0F13CB71C496702" legis-path="1.(d)(1)(A)">subparagraph (A)</internal-xref> to determine the
			 eligibility of the member or veteran for veterans benefits.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HED2F1A185A1F44BDBC0194CE86C70467"><enum>(2)</enum><header>Evaluation of
			 eligibility</header>
					<subparagraph commented="no" id="H572C12B8CF2E432DB5F12D786C4B585D"><enum>(A)</enum><header>Review of
			 list</header><text>When evaluating a member of the Armed Forces or veteran for
			 eligibility for veterans benefits, the Secretary shall review the list of
			 benefits for the member or veteran compiled under
			 <internal-xref idref="H21B1DB97417C4F12AE17005EC820AAFC" legis-path="1.(b)">subsection (b)</internal-xref>.</text>
					</subparagraph><subparagraph commented="no" id="HEED0F2C7EF444155A045C7B587239B6"><enum>(B)</enum><header>Disclosure of
			 information</header><text>If the Secretary determines that the member or
			 veteran has a high probability of being eligible for a benefit so listed for
			 which the member or veteran did not apply, the Secretary shall inform the
			 member or veteran of the benefit and of the opportunity to apply for the
			 benefit.</text>
					</subparagraph><subparagraph commented="no" id="HEA40A8CB3166413A9908AC52EC7F6F37"><enum>(C)</enum><header>Record of
			 Disclosure</header><text display-inline="yes-display-inline">If the Secretary
			 informs a member or veteran of a benefit under
			 <internal-xref idref="HEED0F2C7EF444155A045C7B587239B6" legis-path="1.(d)(2)(B)">subparagraph (B)</internal-xref>, the Secretary shall
			 keep a record, for a period of not less than 5 years, that contains, at a
			 minimum—</text>
						<clause id="H4AA47162BCDF4814AB3ED137E787BA2"><enum>(i)</enum><text>the
			 date on which the Secretary informed the member or veteran of such
			 benefit;</text>
						</clause><clause id="HF94B6F0258C140C7A4E4494D1CB13DD"><enum>(ii)</enum><text>the
			 name of the member or veteran; and</text>
						</clause><clause id="HF0682A70E3B3487BBBDA4C9209BA35BB"><enum>(iii)</enum><text>a
			 general description of the information provided to the member or veteran by the
			 Secretary.</text>
						</clause></subparagraph></paragraph><paragraph id="H0E23C26C317B4F279BA158A11493DB2B"><enum>(3)</enum><header>Notice of
			 denial</header><text>Not later than 30 days after the date a member of the
			 Armed Forces or veteran is determined not eligible for a veterans benefit for
			 which the member or veteran has applied, the Secretary shall provide notice to
			 the member or veteran of the determination. The notice shall include an
			 explanation of the reason for the determination.</text>
				</paragraph></subsection><subsection id="H4F508BB2A1CD4FEEA6EA933BF797CC"><enum>(e)</enum><header>Transition
			 period</header><text>Not later than 5 years after the date of enactment of this
			 Act, for all veterans discharged from the Armed Forces prior to the date of
			 enactment of this Act, the Secretary of Defense shall transfer to the
			 Department of Veterans Affairs all data that exists in electronic systems of
			 the Department of Defense on the date of the transfer and that meet the
			 criteria specified in
			 <internal-xref idref="HDA8934529C2E451394EB83150169AC15" legis-path="1.(a)(2)(A)">subsection (a)(2)(A)</internal-xref>.</text>
			</subsection><subsection id="H9DE1022617F04289AB55C0F2FF996D7D"><enum>(f)</enum><header>Relation to
			 other law</header><text display-inline="yes-display-inline">The Secretary of
			 Veterans Affairs shall implement this section in a manner that does not
			 conflict with the processes, procedures, and standards for the transition of
			 recovering members of the Armed Forces from care and treatment through the
			 Department of Defense to care, treatment, and rehabilitation through the
			 Department of Veterans Affairs under section 1614 of the Wounded Warrior Act
			 (title XVI of Public Law 110–181; 10 U.S.C. 1071 note).</text>
			</subsection><subsection display-inline="no-display-inline" id="H398B7491188D4FFEA028A1BA387336AE"><enum>(g)</enum><header>Privacy</header>
				<paragraph id="H8BD03E4C3FD94D47AF993481A8F8D137"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Defense shall provide a member of the
			 Armed Forces or a veteran the opportunity to decline authorization for the
			 transfer under
			 <internal-xref idref="H139E006EFFE243ACA5FB9FB431E23C" legis-path="1.(a)">subsection (a)</internal-xref> of some or all of the data
			 associated with the member or veteran.</text>
				</paragraph><paragraph id="H63E7EE37F75B4BD3A427C35DC424802F"><enum>(2)</enum><header>Consent
			 presumed</header><text>If a member of the Armed Forces or veteran does not
			 decline an authorization under
			 <internal-xref idref="H8BD03E4C3FD94D47AF993481A8F8D137" legis-path="1.(g)(1)">paragraph (1)</internal-xref>, the member or veteran
			 shall be treated as having authorized the transfer of data under
			 <internal-xref idref="H139E006EFFE243ACA5FB9FB431E23C" legis-path="1.(a)">subsection (a)</internal-xref> until any date on which the
			 member or veteran declines the authorization of the transfer.</text>
				</paragraph><paragraph id="HCE9D9BE1D76741C6B200F6EB7E6EEB26"><enum>(3)</enum><header>Prohibition of
			 data transfer</header><text display-inline="yes-display-inline">Data associated
			 with a member of the Armed Forces or a veteran may not be transferred under
			 <internal-xref idref="H139E006EFFE243ACA5FB9FB431E23C" legis-path="1.(a)">subsection (a)</internal-xref> after any date on which the
			 member or veteran declines the authorization of such transfer under
			 <internal-xref idref="H8BD03E4C3FD94D47AF993481A8F8D137" legis-path="1.(g)(1)">paragraph (1)</internal-xref>.</text>
				</paragraph><paragraph id="HCFCE11FCFFDE460980A918A87417F478"><enum>(4)</enum><header>Construction</header>
					<subparagraph id="HF88A199D111B484BA56EE50040FB0952"><enum>(A)</enum><header>Health Insurance
			 Portability and Accountability Act</header><text>Nothing in this section shall
			 be construed as waiving regulations promulgated under section 264(c) of the
			 Health Insurance Portability and Accountability Act of 1996 (Public Law
			 104–191).</text>
					</subparagraph><subparagraph id="HB46E43AACD9D4A6C84BADF1578B7A8D7"><enum>(B)</enum><header>Privacy
			 Act</header><text>Transfers of data to the Secretary of Veterans Affairs under
			 the agreement under subsection (a) shall be treated as a routine use of a
			 record for purposes of section 552a of title 5, United States Code.</text>
					</subparagraph></paragraph></subsection><subsection id="HE1EC0A5B78DB411BBC58175B99438DD6"><enum>(h)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H975666CE3D2041AD81D9FE98CBB068DC"><enum>(1)</enum><header>Veteran</header><text>The
			 term <term>veteran</term> has the meaning given such term under section 101 of
			 title 38, United States Code.</text>
				</paragraph><paragraph id="HBC3F108259494EC8B118CCCB399B45C"><enum>(2)</enum><header>Armed
			 forces</header><text>The term <term>Armed Forces</term> shall have the meaning
			 given the term <term>armed forces</term> under section 101 of title 10, United
			 States Code.</text>
				</paragraph><paragraph id="H547C3723DFD44246BD492E2FE0AE09D5"><enum>(3)</enum><header>Veterans
			 benefits</header><text display-inline="yes-display-inline">The term
			 <term>veterans benefits</term> means benefits under laws administered by the
			 Secretary of Veterans Affairs.</text>
