		<legis-type display="yes">AN ACT</legis-type>
		<official-title display="yes">To clarify the circumstances during which
		  the Administrator of the Environmental Protection Agency and applicable States
		  may require permits for discharges from certain vessels, and to require the
		  Administrator to conduct a study of discharges incidental to the normal
		  operation of vessels.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="HE69AA66D9F0146189F7D3D2433A0147E" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H7B3FC96EE24A44D0A1B23434479D5600"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53E1DEFA227C4FE39EA123332B1D20B"><enum>(2)</enum><header display-inline="yes-display-inline">Covered
			 vessel</header><text display-inline="yes-display-inline">The term <term>covered
			 vessel</term> means a vessel that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HC22025A6048948F7B5BD3854E6B86B1"><enum>(A)</enum><text display-inline="yes-display-inline">less than 79 feet in length; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2EADC4DEB54D4D9D8901DA06FD28D0D8"><enum>(B)</enum><text display-inline="yes-display-inline">a fishing vessel (as defined in section
			 2101 of title 46, United States Code), regardless of the length of the
			 vessel.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7BE7E5AEC24424E9902372800E90032"><enum>(3)</enum><header display-inline="yes-display-inline">Other terms</header><text display-inline="yes-display-inline">The terms <term>contiguous zone</term>,
			 <term>discharge</term>, <term>ocean</term>, and <term>State</term> have the
			 meanings given the terms in section 502 of the Federal Water Pollution Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H0877ADD779C2449CBAF3305C9BFF7EEE" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Discharges incidental to normal operation
			 of vessels</header>
			<subsection commented="no" display-inline="no-display-inline" id="HAAF41821341044F6AAAB0093C3382CA1"><enum>(a)</enum><header display-inline="yes-display-inline">No permit requirement</header><text display-inline="yes-display-inline">Except as provided in subsection (b),
			 during the 2-year period beginning on the date of enactment of this Act, the
			 Administrator, or a State in the case of a permit program approved under
			 section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>), shall
			 not require a permit under that section for a covered vessel for—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD7F30858CAC44143AF17DDE536B004B3"><enum>(1)</enum><text display-inline="yes-display-inline">any discharge of effluent from properly
			 functioning marine engines;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE6CCB1E2CFAD4ADAAE1F4881C7322D53"><enum>(2)</enum><text display-inline="yes-display-inline">any discharge of laundry, shower, and
			 galley sink wastes; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD901C1778CB346BEB6067CF84C649153"><enum>(3)</enum><text display-inline="yes-display-inline">any other discharge incidental to the
			 normal operation of a covered vessel.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H864EAF66BAEA4DDFB6ECAC73A75263C4"><enum>(b)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply with respect
			 to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8D79FAB654EE4B7DBC270911E21493F3"><enum>(1)</enum><text display-inline="yes-display-inline">rubbish, trash, garbage, or other such
			 materials discharged overboard;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H559C7749737B4CAA857300CEBBCDFE34"><enum>(2)</enum><text display-inline="yes-display-inline">other discharges when the vessel is
			 operating in a capacity other than as a means of transportation, such as
			 when—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H8B0C68D73A254073924837B3FBF25EE0"><enum>(A)</enum><text display-inline="yes-display-inline">used as an energy or mining
			 facility;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2E80394F3191479BA8309943A4576F91"><enum>(B)</enum><text display-inline="yes-display-inline">used as a storage facility or a seafood
			 processing facility;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93777D9CD2A44C239F013838EDFADDF6"><enum>(C)</enum><text display-inline="yes-display-inline">secured to a storage facility or a seafood
			 processing facility; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAB6FEE658E5D4F0AA09BE618CFC4421"><enum>(D)</enum><text display-inline="yes-display-inline">secured to the bed of the ocean, the
			 contiguous zone, or waters of the United States for the purpose of mineral or
			 oil exploration or development;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2BEA3DEF822481892FB1329DD2BB0C6"><enum>(3)</enum><text display-inline="yes-display-inline">any discharge of ballast water; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H072EB5AF35BC4E438339040006E8B5C4"><enum>(4)</enum><text display-inline="yes-display-inline">any discharge in a case in which the
			 Administrator or State, as appropriate, determines that the discharge—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H435C607497FF4E919DD83D97A260FFC6"><enum>(A)</enum><text display-inline="yes-display-inline">contributes to a violation of a water
			 quality standard; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4BF2EA77F364144965EB5995B093786"><enum>(B)</enum><text display-inline="yes-display-inline">poses an unacceptable risk to human health
			 or the environment.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H714A29286F4D4C968364643DEA3CF3EC" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Study of discharges incidental to normal
			 operation of vessels</header>
			<subsection commented="no" display-inline="no-display-inline" id="HBA9733BADB564879BF45A81E421B065E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
			 Secretary of the department in which the Coast Guard is operating and the heads
			 of other interested Federal agencies, shall conduct a study to evaluate the
			 impacts of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEB6371DC51FF4EC7A477DF276837CA00"><enum>(1)</enum><text display-inline="yes-display-inline">any discharge of effluent from properly
			 functioning marine engines;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4A23C258F4D4FB4B69F24618F96C85D"><enum>(2)</enum><text display-inline="yes-display-inline">any discharge of laundry, shower, and
			 galley sink wastes; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFF349B9331494249BC20FE43E33D8CD4"><enum>(3)</enum><text display-inline="yes-display-inline">any other discharge incidental to the
			 normal operation of a vessel.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6487DA7707704A5CB3EEA306322F9DA6"><enum>(b)</enum><header display-inline="yes-display-inline">Scope
			 of study</header><text display-inline="yes-display-inline">The study under
			 subsection (a) shall include—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1AF3395A1BC04DEBA8F1E07C8FE2EF3D"><enum>(1)</enum><text display-inline="yes-display-inline">characterizations of the nature, type, and
			 composition of discharges for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H979D54AB8C9D433DA0EAC4669312C459"><enum>(A)</enum><text display-inline="yes-display-inline">representative single vessels; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD818FF7FF8F348F4A2A52FF414DBB11"><enum>(B)</enum><text display-inline="yes-display-inline">each class of vessels;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18D9DB99D36D466A846CFEC411C8DBD"><enum>(2)</enum><text display-inline="yes-display-inline">determinations of the volumes of those
			 discharges, including average volumes, for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H923E4A32C8754756B0869FD024D1EA41"><enum>(A)</enum><text display-inline="yes-display-inline">representative single vessels; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB7268A3C2D54D048037F7006078F1EF"><enum>(B)</enum><text display-inline="yes-display-inline">each class of vessels;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6ABC270CFE6B431694B632490095951D"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the locations, including
			 the more common locations, of the discharges;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H170C1E211A724893878328F6E2625C02"><enum>(4)</enum><text display-inline="yes-display-inline">analyses and findings as to the nature and
			 extent of the potential effects of the discharges, including determinations of
			 whether the discharges pose a risk to human health, welfare, or the
			 environment, and the nature of those risks;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55949BEC9A12441B84F472B376A800F4"><enum>(5)</enum><text display-inline="yes-display-inline">determinations of the benefits to human
			 health, welfare, and the environment from reducing, eliminating, controlling,
			 or mitigating the discharges; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E7D83EC5CDB486EB0246D15CB78B5E9"><enum>(6)</enum><text display-inline="yes-display-inline">analyses of the extent to which the
			 discharges are currently subject to regulation under Federal law or a binding
			 international obligation of the United States.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5F41AC0A9FB842DE8244492C008D00AD"><enum>(c)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">In carrying out the study under subsection
			 (a), the Administrator shall exclude—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8BA5F0AA6F5648AFA6E1C1C74553E5AD"><enum>(1)</enum><text display-inline="yes-display-inline">discharges from a vessel of the Armed
			 Forces (as defined in section 312(a) of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1322">33 U.S.C. 1322(a)</external-xref>);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB3CD626CAC3A4C70BF4D11DDB2714203"><enum>(2)</enum><text display-inline="yes-display-inline">discharges of sewage (as defined in section
			 312(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1322">33 U.S.C. 1322(a)</external-xref>) from a
			 vessel, other than the discharge of graywater from a vessel operating on the
			 Great Lakes; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC810FB6E466842BB813C49CCDDE15441"><enum>(3)</enum><text display-inline="yes-display-inline">discharges of ballast water.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE574829E322C446AAF165C672B6F616E"><enum>(d)</enum><header display-inline="yes-display-inline">Public comment; report</header><text display-inline="yes-display-inline">The Administrator shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H393B2D8B2ED74EF99FAA3CAACF451E50"><enum>(1)</enum><text display-inline="yes-display-inline">publish in the Federal Register for public
			 comment a draft of the study required under subsection (a);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C73247908314F04B8D1919BEFB651C"><enum>(2)</enum><text display-inline="yes-display-inline">after taking into account any comments
			 received during the public comment period, develop a final report with respect
			 to the study; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H205234B51C4A43468C0012402D291CB8"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 15 months after the date of
			 enactment of this Act, submit the final report to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H612EA2E9124B493288E3206EDA00E2FF"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Transportation and
			 Infrastructure of the House of Representatives; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3FA374401B34498597565632009433B9"><enum>(B)</enum><text display-inline="yes-display-inline">the Committees on Environment and Public
			 Works and Commerce, Science, and Transportation of the Senate.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
