		<official-title>To provide financial aid to local law enforcement
		  officials along the Nation’s borders, and for other purposes.</official-title>

		<section id="id1C78985290194BCD8E26F7AB0CACC9AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Law Enforcement Relief Act of
			 2008</short-title></quote>.</text>
		</section><section id="id1EEC49B749B14B6FAF8FBCF09598FB7D"><enum>2.</enum><header>Border Relief
			 Grant Program</header>
			<subsection id="ID91F70FE9AB334732B6711032F02FDDC3"><enum>(a)</enum><header>Grants
			 authorized</header>
				<paragraph id="ID6357932A570947C883FD1EEAA4713E18"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General is authorized to award grants to an
			 eligible law enforcement agency to provide assistance to such agency to address
			 border-related criminal activity that occurs in the jurisdiction of such
			 agency.</text>
				</paragraph><paragraph id="idC160DEA375384E65920C0251D13BA65C"><enum>(2)</enum><header>Competitive
			 basis</header><text>The Attorney General shall award grants under this
			 subsection on a competitive basis.</text>
				</paragraph></subsection><subsection id="IDB31A5CF1D31A4DAAA09AD81F56BDC8EA"><enum>(b)</enum><header>Use of
			 funds</header><text>Grants awarded pursuant to subsection (a) may only be used
			 to provide additional resources for an eligible law enforcement agency,
			 including resources to—</text>
				<paragraph id="id092F805EE3C34890BA03180BB650B928"><enum>(1)</enum><text>obtain
			 equipment;</text>
				</paragraph><paragraph id="idD0A1E997212B4D979037EDC19A3E959D"><enum>(2)</enum><text>hire additional
			 personnel;</text>
				</paragraph><paragraph id="id800BCF253A294C30913EFCD7FC3C1C74"><enum>(3)</enum><text>upgrade and
			 maintain law enforcement technology;</text>
				</paragraph><paragraph id="id2EE347A0AD974200B8966C45900E4C55"><enum>(4)</enum><text>cover the
			 operational costs, including overtime and transportation costs; and</text>
				</paragraph><paragraph id="idE76C083579034A2582BA840D9C0527F3"><enum>(5)</enum><text>assist that
			 agency in responding to border-related criminal activity.</text>
				</paragraph></subsection><subsection id="ID34018257C8DB4A1C8C328943FAF61FC4"><enum>(c)</enum><header>Application</header>
				<paragraph id="ID1CDADA85567A4950A53411E401981E23"><enum>(1)</enum><header>In
			 general</header><text>Each eligible law enforcement agency seeking a grant
			 under this section shall submit an application to the Attorney General at such
			 time, in such manner, and accompanied by such information as the Attorney
			 General may reasonably require.</text>
				</paragraph><paragraph id="ID95F258B7DCB84E15A07E0D31802503D0"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted under paragraph (1) shall—</text>
					<subparagraph id="ID4F4789A939414A81A778C767D035B98A"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought; and</text>
					</subparagraph><subparagraph id="IDD4AD8EB529CF4524B6367DC8DFEF6F36"><enum>(B)</enum><text>provide such
			 additional assurances as the Attorney General determines to be essential to
			 ensure compliance with the requirements under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="ID00B04E8B35DA4FD8A8FC2F5286AB8AB8"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id08F8FAFE245F4E8694A376D069E4FB85"><enum>(1)</enum><header>Eligible law
			 enforcement agency</header><text>The term <term>eligible law enforcement
			 agency</term> means a tribal, State, or local law enforcement agency located or
			 performing duties in—</text>
					<subparagraph id="id55D0AAE5A0F94799A48BCCAF723E638A"><enum>(A)</enum><text>a county that is
			 not more than 100 miles from a United States border with—</text>
						<clause id="id4EE2B0914FD14B2E90350546BA8B8D7F"><enum>(i)</enum><text>Canada; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id6B8279E197834B8F91DA7220C000C7F6"><enum>(ii)</enum><text>Mexico;
			 or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9845F34702F3488381BE34434AF60A75"><enum>(B)</enum><text>a county that is
			 more than 100 miles from each of the borders described in subparagraph (A), if
			 such county has been certified by the Attorney General as a High Impact
			 Area.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF0264E59C2E4DF590F9715CE7C80A8C"><enum>(2)</enum><header>High Impact
			 Area</header><text>The term <term>High Impact Area</term> means any county
			 designated by the Attorney General as a High Impact Area, taking into
			 consideration—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB72F6DEFAD4B47368D3B6C80533EF3A6"><enum>(A)</enum><text>whether an
			 eligible law enforcement agency in that county has the resources to protect the
			 lives, property, safety, or welfare of the residents of that county;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2E87E2766C494C7ABFC2BD511D8A1856"><enum>(B)</enum><text>whether the
			 county has been designated as a “High Intensity Drug Trafficking Area” by the
			 National Drug Control Program under section 707 of the Office of National Drug
			 Control Policy Reauthorization Act of 1998 (21 U.S.C. 1706);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99C546A22CE5478AB269409C319F3BE4"><enum>(C)</enum><text>the relationship
			 between any lack of security along the United States border and the rise, if
			 any, of criminal activity in that county; and</text>
					</subparagraph><subparagraph id="ID5e8c7c9610d140ecb71201fc4c5dec1f"><enum>(D)</enum><text>any other unique
			 challenges that eligible law enforcement agencies face due to a lack of
			 security along the United States border.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6132A134FEBD46389636CEC1ED56D79F"><enum>(e)</enum><header>Authorization
			 of appropriations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id8632A0355AE54B5888CD972DD4ED773E"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated $100,000,000 for
			 each of the fiscal years 2009 through 2013 to carry out the provisions of this
			 section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCE6C0768D244876A7185FE52EC5F262"><enum>(2)</enum><header>Allocation of
			 authorized funds</header><text>Of the amounts appropriated pursuant to
			 paragraph (1), 33 percent shall be set aside for areas designated as High
			 Impact Areas under subsection (d)(2).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9053C659DD924BAC81B0220FD77BD946"><enum>(f)</enum><header>Supplement not
			 supplant</header><text>Amounts appropriated for grants under this section shall
			 be used to supplement and not supplant other tribal, State, and local public
			 funds obligated for the purposes provided under this title.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8A95D2D4FE22412A98E24952183F56BA" section-type="subsequent-section"><enum>3.</enum><header>Enforcement of Federal
			 immigration law</header><text display-inline="no-display-inline">Nothing in
			 this Act shall be construed to authorize tribal, State, or local law
			 enforcement agencies or their officers to exercise Federal immigration law
			 enforcement authority.</text>
