		<official-title>To amend the Energy Policy Act of 2005 to provide
		  assistance to States to establish and implement response plans to address
		  rising heating oil, natural gas, diesel, and other energy costs, and for other
		  purposes.</official-title>

		<section id="idE6F466433CE74976B2CEA086B188563D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Energy Response Act of
			 2008</short-title></quote>.</text>
		</section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Grants to States for
			 response plans for rising energy costs</header><text display-inline="no-display-inline">Subtitle B of title I of the Energy Policy
			 Act of 2005 (Public Law 109–58; 119 Stat. 616) is amended by adding at the end
			 the following:</text>

				<section id="id91E27A1CC91146569EDD0AD0AA2E926F"><enum>129.</enum><header>Grants to
				States for response plans for rising energy costs</header>
					<subsection id="idC7B8F8DF6BB94823A741E5C0CDCB48D7"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				make grants to States to pay the Federal share of the cost of establishing and
				implementing response plans to address rising heating oil, natural gas, diesel,
				and other energy costs.</text>
					</subsection><subsection id="idD1AD6B719763479FA2ABF93D419AD942"><enum>(b)</enum><header>Use</header><text display-inline="yes-display-inline">A grant under this section may be used by a
				State—</text>
						<paragraph id="id80C8FE57CF1F4691A766297E7058A29B"><enum>(1)</enum><text display-inline="yes-display-inline">to provide heating shelters for
				communities;</text>
						</paragraph><paragraph id="id4238426264484C5C882477162D67D5E7"><enum>(2)</enum><text display-inline="yes-display-inline">to provide energy assistance and
				information to elderly individuals, consumers, and small business
				concerns;</text>
						</paragraph><paragraph id="id2B114CC0639747DC8069FF4B72B267F1"><enum>(3)</enum><text display-inline="yes-display-inline">to provide information to individuals and
				small business concerns concerning State resources for individuals struggling
				with rising energy costs; and</text>
						</paragraph><paragraph id="id9E5713FF228E47EAB54FD9369FF478C0"><enum>(4)</enum><text>to otherwise
				address rising heating oil, natural gas, diesel, and other energy costs, as
				determined by the State and approved by the Secretary.</text>
						</paragraph></subsection><subsection id="id313646D83C6947C7AC9C098D3A8341AB"><enum>(c)</enum><header>Allocation</header><text display-inline="yes-display-inline">The Secretary shall allocate grants to
				States under this section using a formula established by the Secretary that is
				based on State population and per capita expenditures for energy.</text>
					</subsection><subsection id="idE64E7CCB18F34FCF9B6B8B49022F141B"><enum>(d)</enum><header>Federal
				share</header><text>The Federal share of the cost of establishing a response
				plan under this section shall be not more than 50 percent.</text>
					</subsection><subsection id="IDb6984fd2af21447b8c7e1f76b83b8a03"><enum>(e)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $1,000,000,000 for each of fiscal years 2009 through
				2013.</text>
